  • The Bureau issued this final rule to amend Regulation X, which implements the Real Estate Settlement Procedures Act of 1974, and implements a commentary that sets forth an official interpretation to the regulation. This final rule implements provisions of the Dodd-Frank Wall Street Reform and Consumer Protection Act regarding mortgage loan servicing.

  • The Bureau issued this final rule to amend Regulation Z, which implements the Truth in Lending Act and the official interpretation to the regulation, which interprets the requirements of Regulation Z. This final rule implements provisions of the Dodd-Frank Wall Street Reform and Consumer Protection Act regarding mortgage loan servicing.

Protections for Borrowers Affected by the COVID-19 Emergency Under the Real Estate Settlement Procedures Act (RESPA), Regulation X
June 28, 2021

  • The Bureau issued this final rule to amend Regulation X to assist mortgage borrowers affected by the COVID-19 emergency. The final rule establishes temporary procedural safeguards to help ensure that borrowers have a meaningful opportunity to be reviewed for loss mitigation before the servicer can make the first notice or filing required for foreclosure on certain mortgages. In addition, the final rule temporarily permits mortgage servicers to offer certain loan modifications made available to borrowers experiencing a COVID-19-related hardship based on the evaluation of an incomplete application. The Bureau has also finalized certain temporary amendments to the early intervention and reasonable diligence obligations that Regulation X imposes on mortgage servicers.

  • The Bureau issued this interim final rule to amend Regulation X. The amendments temporarily permit mortgage servicers to offer certain COVID-19-related loss mitigation options based on the evaluation of an incomplete loss mitigation application.

March 8, 2018

  • The Bureau issued this final rule amending certain aspects of the mortgage servicing rule issued in 2016 relating to periodic statements. These amendments revise the timing requirements for servicers transitioning between modified or unmodified periodic statements and coupon books when consumers enter or exit bankruptcy.

  • On Aug. 4, 2016, the Bureau issued a final rule amending certain mortgage servicing rules issued by the Bureau in 2013. This final rule makes several non-substantive corrections to the 2016 amendments. The corrections address two typographical errors, the authority citation for Regulation Z, and several amendatory instructions relating to certain official commentary to apply the correct effective date.
