The CFPB is issuing this interpretive rule to clarify that lenders clarifies that these lenders are “card issuers” for purposes of Regulation Z because the term “credit card” encompasses digital user accounts that consumers use to access Buy Now, Pay Later (BNPL) credit.
This notice responds to a request that the CFPB make a preemption determination regarding certain provisions in a commercial financing law in New York State. The notice states the CFPB’s intent to make a determination, its preliminary conclusion that TILA does not preempt the New York law, and the possibility of issuing a determination on commercial financing laws in three other states. The notice solicits public comment.
