Strengthening State-Level Consumer Protections

Enforcing consumer protection law has long been a state-federal partnership in which the states have often taken the lead. Over the last century, in response to evolving markets, states have refreshed the core standards of fair dealing that form the bedrock of consumer protection law. States should once again refresh their UDAP statutes to address the challenges of the modern economy.

In this report, the CFPB offers states several recommendations for strengthening state-level consumer protection law, including adding a ban on "abusive" practices similar to the CFPA, strengthening law enforcements' investigatory authority and options for consumer remedies, and ensuring private rights of action are readily available. The CFPB also offers proposals on specific issue areas, such as junk fees and consumer privacy.
