CFPB v. Performant Recovery

Payments have been mailed to consumers who were identified as an affected customer of Performant Recovery, a student loan debt collection company. According to the consent order of the Consumer Financial Protection Bureau (CFPB) vs. Performant Recovery, the company delayed help that these consumers were entitled to receive on their defaulted loans under the Federal Family Education Loan Program.

Affected consumers are receiving a refund because, according to the consent order, the delay may have cost them money. Consumers can cash their check right away, and they do not need to send the CFPB any information. Under the consent order, Performant Recovery should no longer be collecting or servicing student loan debt.

Victim compensation

The CFPB has contracted RUST Consulting to administer payments for this case and answer consumers' questions.
