Commonwealth of Pennsylvania v. Navient Corp.
Section 1042 of the CFPA, 16 U.S.C. § 5552, authorizes states to enforce the CFPA’s prohibition against unfair, deceptive, or abusive acts or practices. That section requires a state that brings such an action to notify the Bureau. However, the Bureau argued in an amicus brief filed before the Third Circuit that nothing in the section, either explicitly or implicitly, prohibits a state from bringing an action that is parallel to one that the Bureau has already brought.
