Providing equal credit opportunities (ECOA)
Resources to help industry understand, implement, and comply with the fair lending requirements of the Equal Credit Opportunity Act (ECOA) and Regulation B.
On March 9, 2021, the Bureau issued an Interpretive Rule to clarify that the prohibition against sex discrimination in ECOA and Regulation B encompasses sexual orientation discrimination and gender identity discrimination, including discrimination based on actual or perceived nonconformity with sex-based or gender-based stereotypes and discrimination based on an applicant’s associations.
On May 6, 2020, the Bureau issued that clarify responsibilities of creditors collecting Small Business Administration Paycheck Protection Program loan applications during the COVID-19 pandemic. These FAQs address the requirements for providing notifications of action taken under ECOA and Regulation B to PPP applicants.
