Message from Acting Director

Dear Chair Lucas:

I write concerning the Equal Employment Opportunity Commission’s (EEOC) MD-715 report. Certain aspects of the MD-715 report conflict with Executive Orders issued by President Trump, including Executive Order 14151, Ending Radical and Wasteful Government DEI Programs and Preferencing, Executive Order 14168, Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government, and Executive Order 14281, Restoring Equality of Opportunity and Meritocracy. For example, the MD-715 asks agencies to report whether their EEO policy statement addresses “gender identity” as a protected basis. It also asks agencies to report whether their strategic plans reference “diversity and inclusion principles.” Finally, several aspects of the report concern barrier analysis requirements that are rooted in disparate impact theories of discrimination.

I urge the EEOC to review its MD-715 report and revise it to comply with President Trump’s Executive Orders concerning these matters. The CFPB provides its response to the MD-715 consistent with these orders and declines to respond to the aspects of the report in conflict with these Executive Orders.
