Upon learning of these protections, I promptly contacted Credit9 to request application of the XXXX interest rate cap retroactive to my XXXX XXXX start date of XX/XX/XXXX. \n\nCredit9 informed me that although I qualify for SCRA protections, they would not apply the 6 % interest rate cap because the loan has already been paid in full. I requested written documentation citing the legal or policy basis for denying retroactive SCRA relief on a paid loan, but to date, no such documentation has been provided. \n\nThe SCRA requires creditors to reduce the interest rate to 6 % during the period of XXXX XXXX upon proper notice and to forgive, not defer, interest above 6 %. The statute does not state that eligibility is voided simply because the loan was paid off before the servicemember became aware of their rights. They also provided a full ledger showing every payment made to each creditor. \n\nDespite this, Credit9 continues to collect on the loan, assess interest, and report the account as past due. I later learned that Americor, Credit9, and XXXX XXXX XXXX are affiliated entities under the same ownership, which was not clearly disclosed when I agreed to the loan. I believe I was misled into converting my already-settled debts into a new, high-interest loan with the same affiliated company. \n\nI requested full documentation of how Credit9 disbursed the loan funds and how they were applied to Americor, but they have not provided this information. Their written response on XX/XX/XXXX only stated that they found no misrepresentation. \n\nI am requesting that the CFPB review this affiliate lending arrangement for deceptive and unfair business practices and require Credit9 to suspend collections and reconsider or cancel the remaining loan balance. XXXX specifically told me to ignore these letters and not communicate with the banks. \nIf I had been allowed to settle directly, the original credit card debts would already be paid off. Instead, I was locked into a much more expensive 24.99 % APR loan with Credit9. \nXXXX. My loan balance fluctuates in suspicious ways. \nMy principal has gone down to around {$3900.00}, only to rise back up to over {$4000.00} the following week. This has happened repeatedly. \nThis makes me feel like my money is being mishandled or interest is being improperly calculated or applied. \nXXXX. I have been paying for YEARS but my principal barely moves. \nLoan Amount : {$4600.00} Current Principal : {$3900.00} Total Paid to Date : {$5100.00} ( more than the original loan amount ) Interest Paid So Far : {$2400.00} Despite paying more than what I originally borrowed, I still owe almost the entire principal due to the predatory structure of the loan. This is unreasonable and financially abusive. \nXXXX. I was even incentivized to leave a XXXX review. \nCredit9 offered me a {$25.00} gift card for a XXXX review, which I accepted because I felt pressured. This is unethical and manipulative. \nXXXX. I asked for help many times and was dismissed. \nWhen I reached out to the representative who originally helped me, I was told only that a principal payment will help, but none of my questions about rate reduction, refinancing, or balance fluctuations were addressed. \nI recently became a mother and lost my job. Even after requesting assistance and proving my hardship, all they offered was a small temporary payment reduction. This still leaves me in a cycle where the loan barely decreases. \nXXXX. At that point, I requested to speak to a supervisor and file a complaint. ( 1st Complaint ) XXXX ( 2nd Call ) The phone rang for literally half a second and hung up before I got the opportunity to answer. \nXXXXGot another call and told them that I can't do the payment. I started talking about my complaint request when they hung up on me mid-sentence. \nXXXXIn good faith, I sent a certified letter ( 1st Time ) requesting documentation of the phone calls and transcripts that they didn't receive until XX/XX/XXXX. \nXXXXGot another call and talked about extreme financial hardship. \nXXXX ( 1st Call ) Got another call and mentioned both about my extreme financial hardship and the 1st complaint from XXXX. It was at this time that they mentioned a \" loan modification '', which was the first time I ever heard of it. I talked about the 1st & 2nd complaints and the caller tried to come up with excuses for both in regards to why the supervisors never got back to me. I also talked about the previous documentation request letters that I sent ( XXXX & XX/XX/XXXX ) and she believed that Credit9 \" Wouldn't give that to me. '' I mentioned possible FDCPA violations and requested a supervisor to file another complaint. They claim to be a cash Disbursement Department, however if its taking three to four months there is not any cash being disbursed, instead they are trying to work out a payment plan. Their misrepresentation needs to be stopped. The consumer can view funds withdrawn in the form of ACH & reflected in the scammers account, yet the consumer does not have access to funds & unable to withdraw funds that are fraudulently withdrawn under false pretenses. I had to go without paying for months and go into default. Before this, I had not missed a payment on my consumer credit for the purposes of this account. I had built up my credit with my creditors. They said No money is paid by me until a settlement is reached and once the settlement is reached I would use the funds I paid which were XXXX from XX/XX/XXXX until XX/XX/XXXXXXXX XXXX XXXX, and with a loan from Credit9 to pay the settlements and I would make payments to XXXX for the loan balance. They stated I would be able to get other consumer credit, even with the same companies. In XX/XX/XXXXXXXX XXXX  I was informed I was not approved for the loan to pay off the settlements due to a XXXX  I am currently involved. The problem is if they had asked me about bankruptcy the day I signed up, I would Not have signed up because I was aware of my XXXX. I would have continued to make payments on my credit, and still been ablt to use my credit. As a result my credit score dropped terribly due to the default and they wanted me to continue to pay them the long way, with no rebound in my credit score and hefty fees instead of being able to remove the credit settlements, which would have improved my credit. I made all of my payments to Americor monthly based on the closest payday to my payment. I later realized the charges I was paying them were more than what was going to pay in my settlements. I then opted out, I no longer opted into their program, it did not do anything to benefit me as they said it would. I have been damaged terribly, I no longer have the use of any credit which I used for my business. I have no credit to obtain any other credit. There was not 1 question asked about bankruptcy when I signed up, they had all of my information including how much credit debt I had, it was not possible for them not to see XXXX XXXX They have paid pennies on the settlements but most of what I paid was taken in fees by Americor.I could used other ways to pay my credit down but I was assured Americor was the best way to go. This letter clarifies all of my grievances with Americor funding including but not limited to improper explanation of the lending process, improper explanation of how my credit score would be affected as well as repaired, improper information on how this debt consolidation lender would handle my case.\n\nWhile I truly appreciate your professionalism I strongly feel that the program offered by Americor is a deep rooted predatory scam preying on the desperation of it's ill informed clients that includes clear bait-and-switch tactics as well as blatent and egregious misrepresentations brought across by the agents that enrolled me into Americor 's program.\n\nThe first issue I encountered by Americor is the targeting of new members through written marketing materials followed by a call with a trained professional that verbally promises a 0 % interest rate loan would be provided for 12-18 months from the time of the loan 's initiation date which was made to sound as a guarantee and works quite effectively at enrolling new clients. As per my conversation with Credit 9 they let me know that that 0 % interest is absolutely non-existent and actually stands at 16 % for New York which according to our conversation is the lowest rate you have seen. This is the first tactic that is incredibly deceptive and violated my rights as a consumer.\n\nThe next issue is the guarantee by Americor 's agents of : \" once debt to the 5 creditors enrolled in Americor 's program has been negotiated and paid in full, since Americor is a lending company not a debt consolidation company '' ( my debt advisor 's words on a recorded conversation ) the IRS would never receive a 1099 from the debtor for income earned. I repeatedly asked if she was certain of this and she repeatedly told me not to worry. There would NEVER be a tax form sent by the creditors because the loan would pay them back and no debt is consolidated thereby no income was earned. This again is blatantly deceptive by the Americor representatives as I just received a 1099 form from two of the creditors that have been paid with the Credit 9 loan. In addition, you have advised me during today 's conversation that this was a stipulation in the agreement that I signed with Americor which of course I had not read all the details in full as the advisor and another party read off the contents of the contract they deemed important and I was rushed through the e-sign process by my advisor. I was under the impression that both conversations should be archived as it was told to me that the conversations were being recorded.\n\nMy third concern is regarding a false promise made by Americor in regards to getting my credit fully back to where it started after a year of enrollment into this program. This is a MAJOR reason I entered into Americor 's program to begin with. I was promised by their representatives that as long as I followed the program 's guidelines my credit which was above 740 when I first entered this program would be repaired by paying off the creditors in full. Now my score is XXXX which deeply affects my ability to persue job opportunities, starting a family and other major factors determining my and my family 's future. \n\n\nIn addition XXXX XXXX, XXXX and XXXX XXXX all either significantly dropped my line of credit or in XXXX 's case closed my line of credit in its entirety while still holding me to the balance owed. \n\n\nI was assured by my advisor that once I receive my loan from Credit 9 that all RAM payments to Americor made on time ( which they all were as I have been perfect with my payments ) and all of the debts settled ( 4 out of 5 enrolled accounts have been settled in full in XX/XX/2019 XXXX would reflect on my credit report by the middle of XXXX. \n\n\nThus far no improvement has been shown on my XXXX, XXXX, or XXXX  reports and my FICO score is still in shambles. \n\n\nLastly, Americor also promised a debt adviser would reach out to me every few months to go over the state of my finances. I signed up for their program XX/XX/XXXX. \n\nTheir program- as it was presented to me by their salesperson XXXX XXXX- would involve Americor contacting my creditors on my behalf in an effort to negotiate and reduce outstanding balances ; then, through a monthly payment I would make into a 'trust account ', Americor would pay any settlements secured with those creditors and, over the course of a few years, I would be completely debt-free with each creditor while paying much less in both balance and interest. \n\nSadly, I learned over the next several months that nearly all the information given to me by XXXX XXXX to induce me into signing up for their program was false : # 1 ) I was told after 6 months in their program I could apply for their consolidation loan ; After spending 9 months in their program, they never made me an offer for such a loan - when I brought this to their attention, their response was : Oops, sorry you were told that, but that's not how it works here. \n\n# 2 ) I was told they would negotiate settlements with my creditors, but they did not. Over the course of 9 months I provided them with every correspondence I received from every creditor ( many of which asked me to contact them to discuss either alternative payment arrangements or even to discuss lowering my balances ) ; after 9 months in the program, Americor only communicated with 2 out of 14 listed creditors - and I learned this by contacting the actual creditors themselves, who told me no one from Americor had ever contacted them to discuss my account/debt with any of them # 3 ) Americor provides zero ability to contact, chat, communicate or email with their settlement negotiators who are working on your behalf. There is no way to verify what exactly is being communicated to my creditors, why they were not contacting 12 of my 14 creditors to even commence negotiations, or to learn how I could help them expedite their process. There is no way to actually communicate with their team responsible for executing the terms of their agreement with me. \n\n# 4 ) After having enough of their nonsense, on XX/XX/XXXX I cancelled their program. This required both an email notification AND a live phone conversation with one of their agents ( they make it extremely difficult to know exactly how to cancel ). Their agent repeatedly tried to convince me to remain in their program, but I was adamant and ultimately he agreed to let me cancel, sending me an email that as of XX/XX/XXXX I was cancelled from the program and they would refund me the existing balance in my trust account. That's when things got... interesting. \n\nOn XX/XX/XXXX I received a call from XXXX at Americor who asked why I had not made my scheduled monthly deposit into my trust account ; I informed her I had cancelled and was waiting on the refund of my trust account balance. She acknowledged this and the call was ended. \n\nAfter the call ended, XXXX - without my consent - REVERSED my program cancellation and RE-ENROLLED me back into their program ( I only learned about it from an email I received on XX/XX/XXXX from Americor that WELCOMED me back into their program and that directly referenced my call with XXXX as the source ). Unbelievable!!!!! \n\nFurious, I immediately contacted them by phone to inform them I did NOT re-enroll and XXXX XXXX  efforts to do so were both unauthorized and fraudulent, and then demanded they shut my account down and immediately refund me not just my trust account balance but also the fees I paid for their program. \n\nOn XX/XX/XXXX, I posted a review of my experience on XXXX  ; Americor responded with a detailed apology acknowledging AND admitting to everything I just outlined above ; then asked that I contact their president to discuss a resolution. I sent an email to the address they provided on XX/XX/XXXX. \n\nAs of XXXX, I have received no communication of any kind from Americor. None.
