( Americor ) to get our debts consolidated, to include one loan with XXXX XXXX XXXX ( XXXX ) belonging to me, and one loan from XXXX XXXX XXXX belonging to my husband. On XX/XX/XXXX, Americor Financial Inc. reached a settlement with XXXX XXXX XXXX for the account belonging to me, in the amount of {$4300.00}. There was an initial payment of {$350.00} on XX/XX/XXXX, and then {$350.00} every month for the next 11 months. The last payment to XXXX XXXX XXXX for my account was made XX/XX/XXXX. On XX/XX/XXXX, I contacted XXXX XXXX XXXX , XXXX ( XXXX ) to inquire about a separate issue. I spoke with a lady named XXXX. After that issue was resolved, XXXX from XXXX XXXX XXXX , XXXX then informed me that my XXXX XXXX XXXX loan was sold to them XX/XX/XXXX. I informed XXXX from XXXX XXXX XXXX , XXXX that Americor Funding Inc. should have contacted them because I was in their debt consolidation program. XXXX from XXXX XXXX XXXX , XXXX said they were never contacted by Americor Funding Inc. I then said I will contact Americor Funding Inc. to find out what is going on. \n\nBefore contacting Americor Funding Inc., me and my husband went on our Americor Funding Inc. account online and noticed that both XXXX XXXX XXXX accounts had the same account number, but different loan amounts. At that point, we contacted Americor Funding Inc. to see what was going on. Americor Funding Inc. informed us it was a discrepancy, but, was not clear on the exact nature of the discrepancy. I then told Americor Funding Inc. How is there a discrepancy when we had two separate accounts and different last names. Also, you all ( Americor Funding Inc. ) emailed us a letter on XX/XX/XXXX showing the settlement with my XXXX XXXX XXXX loan and another letter showing the settlement with XXXX XXXX XXXX XXXX XXXX for my husbands XXXX XXXX XXXX loan. The letter for my loan shows that my loan was paid off by Americor Funding Inc. to XXXX XXXX XXXX on XX/XX/XXXX. The letter for my husbands account shows that the first payment made from Americor Funding Inc. to XXXX XXXX XXXX XXXX XXXX was on XX/XX/XXXX. In addition to all of that, Americor Financial Inc. knew the XXXX account was sold to XXXX, but failed to inform me and my husband. Americor Funding Inc. suggested they wanted to use additional money from our XXXX account, to pay XXXX XXXX XXXX XXXX XXXX for my loan, that has already been negotiated, and was already being paid to XXXX XXXX XXXX. Me and my husband quickly said NO, why would we pay or negotiate for an account with XXXX XXXX XXXX XXXX XXXX, when it was already being paid to XXXX XXXX XXXX? \n\nOn XX/XX/XXXX, we called XXXX to inquire about both loans. The number on the XXXX website led us to XXXX XXXX XXXX, the company that owns XXXX. We spoke with XXXX XXXX, from XXXX XXXX XXXX, and he was far from helpful. We asked if XXXX XXXX XXXX  or XXXX XXXX XXXX was receiving payments for my loan, with the last payment being on XX/XX/XXXX? XXXX  XXXX from XXXX XXXX XXXX stated, Yes. I than asked, Why would you all sell an account that yall went into agreement with, with Americor Funding Inc.? He responded with, What do you think? We shouldve held on to only your account? This is a business. It was a business decision. I then replied, You dont sell peoples account, because now this other company is coming after me for a loan that you sold them, but yet, you are still receiving money from Americor Funding Inc. for it. I told him ( XXXX XXXX  ) I was going to get a lawyer and seek legal advice from my military JAG office. But I assume he hung up prior to me finishing that last statement. \n\nOn XX/XX/XXXX, after being on the phone with XXXX XXXX from XXXX XXXX XXXX, I contacted XXXX XXXX XXXX XXXX XXXX to let them know the issue going on with XXXX XXXX XXXX, and they informed me they were going to put my account in Dispute status, and for me to mail them the documents from Americor Funding Inc. stating that my loan was negotiated and paid off. \n\n\nI am filing this complaint because I feel as though something should be done to/about Americor Funding Inc., XXXX XXXX XXXX, and XXXX XXXX XXXX. Neither of them seem to have peoples best interest at heart and, has caused me unnecessary stress. Point 1 : Americor Funding Inc. followed up with XXXX XXXX XXXX and knew the account was sold, but didnt communicate that information with me and my husband. Americor Funding Inc. wanted to spend additional money from my XXXX account, to pay XXXX XXXX XXXX XXXX XXXX for my loan ( which had one payment left to be paid off ), even though they ( Americor Funding Inc. ) negotiated and settled with XXXX XXXX XXXX for my loan. They ( Americor Funding Inc. ) showed no remorse or no sympathy. If they are doing this to me, as an XXXX XXXX XXXX, there is no telling who else they are doing this to. Point 2. XXXX XXXX XXXX and XXXX XXXX XXXX  should be held accountable as well. XXXX XXXX XXXX negotiated and settled my loan with Americor Funding Inc., and were in the process of selling my loan account 2 months later. Also, XXXX XXXX XXXX did not inform XXXX XXXX XXXX XXXX XXXX that they ( XXXX ) already received and accepted a negotiated settlement and was receiving payments from Americor Funding Inc. XXXX XXXX from XXXX XXXX XXXX was very rude and disrespectful. He offered poor advice. He said to take XXXX XXXX XXXX XXXX XXXX to court. \n\nI feel as though you should investigate every account that Americor Funding Inc., XXXX XXXX XXXX, and XXXX XXXX XXXX has. I feel as though the treatment I received, and disregard for my current situation, is unacceptable. This makes me believe these companies are doing this to most, if not all their clients. I am in the process of renewing my XXXX XXXX to be a XXXX XXXX  in the US XXXX, and Americor Funding Inc., XXXX XXXX XXXX, and XXXX XXXX XXXX are holding me up tremendously. I am requesting termination of my contract with Americor Funding Inc. right now, and also requesting I be refunded my money in the XXXX account. With the $ 5K+ in the XXXX account with Americor Funding Inc. , I could use that to negotiate myself, and then start making payment arrangements with my creditors. Instead, Americor failed to perform the services promised while continuing to withdraw funds from my account. \n\nDebt Settlement Agreement On XX/XX/XXXX, I entered into a Debt Resolution Agreement with Americor Financial. The company represented that it would negotiate settlements with creditors enrolled in the program and that fees would only be charged after a settlement was successfully negotiated and approved by me. \n\n\nUnder the agreement : Americor would negotiate settlements with enrolled creditors. \nFees would only be charged after a settlement was successfully negotiated and I approved the settlement terms. \nAmericors settlement fee was 29 % of the enrolled debt associated with each settlement. \nThe debts enrolled in the program included : XXXX XXXX XXXX XXXX  / XXXX XXXX XXXX / XXXX XXXX  XXXX XXXX The total enrolled debt was approximately {$8200.00}. \n\n\nTimeline XX/XX/XXXX Enrolled in Americors debt settlement program. \nXX/XX/XXXX Sent Americor proof that two enrolled debts had already been paid directly. \nXX/XX/XXXX Americor representative XXXX XXXX confirmed that the Comenity account ending in XXXX and the XXXX account ending in XXXX had been paid in full and removed from the program. \nXX/XX/XXXX Requested that Americor close my account and stop all withdrawals. \nXX/XX/XXXX Americor withdrew additional funds from my account despite my request to terminate the program. \n\n\nFailure to Perform Contracted Services Americor did not negotiate settlements for the XXXX or XXXX accounts. I personally negotiated and paid these debts in full. Americor later acknowledged that the debts had been paid and removed them from the program. \nOn XX/XX/XXXX, Americor representative XXXX XXXX sent written communication confirming that the creditors reported the debts as paid. \nThe communication stated : We have been informed by XXXX that your account ending in XXXX has been paid in full. Due to this, Americor is unable to proceed with negotiations on this account. As a result, we will be removing the debt from your program. Please note that this change only applies to the specific account mentioned above. Your program will continue with any remaining enrolled accounts as normal. \nThe communication further stated : We have been informed by XXXX that your account ending in XXXX has been paid in full. Due to this, Americor is unable to proceed with negotiations on this account. As a result, we will be removing the debt from your program. Please note that this change only applies to the specific account mentioned above. Your program will continue with any remaining enrolled accounts as normal. \nThis confirms that Americor did not negotiate or resolve these debts.\n\nA. No Fee Until Successful Negotiation Clause The agreement states that Americor will not charge any fee for its services until it successfully negotiates a debt and the consumer makes a deposit toward the settlement of that debt.\n\nDespite not negotiating these debts, Americor continued collecting funds from my account. \nDuring a phone call on XX/XX/XXXX, an Americor representative informed me that my account had incurred over {$700.00} in additional fees due to alleged delinquency.This statement is inaccurate. \nDuring the XXXX federal government shutdown, I temporarily paused payments due to financial hardship. However, funds already existed in my Americor account which could have been used for negotiations. \nThe representative also claimed the fees were related to negotiations with XXXX, even though I had already agreed to the settlement terms directly. \nThe amount referenced also appears inconsistent with the 29 % fee structure specified in the contract. \nConcern : Two debts ( XXXX and XXXX ) were paid directly by the consumer and later acknowledged by Americor as already paid. This raises the question of whether any fees were charged for debts that Americor did not negotiate. \nB. Good Faith Negotiation Obligation The agreement states that Americor will work in good faith to resolve each of the debts listed by negotiating settlements with creditors. \nConcern : If negotiations were not attempted before those debts were resolved directly by the consumer, regulators may review whether Americor fulfilled its good-faith negotiation obligation.\n\nC. Settlement Approval Requirement The agreement provides that settlement offers must be presented to the consumer and approved before Americor may proceed with settlement. \nConcern : For the XXXX and XXXX accounts, no Americor-negotiated settlement was presented for approval because the debts were already paid. \n\n\nImproper Fees On XX/XX/XXXX, I requested that Americor close my account and discontinue withdrawals. Despite this request, Americor withdrew funds from my account on XX/XX/XXXX. \nDespite not negotiating these debts, Americor continued collecting funds from my account. On XX/XX/XXXX, I was informed that my account had incurred more than {$700.00} in fees due to alleged delinquency. This explanation appears inconsistent with the agreement stating that settlement fees are earned only after a negotiated settlement and a payment toward that settlement. \nA. Dedicated Settlement Account Structure The agreement requires deposits into a dedicated settlement account intended to fund negotiated settlements and program fees. \nConcern : Funds continued to be withdrawn after the debts were confirmed paid and after a request was made to terminate the program. \nB. Right to Withdraw from the Program The agreement allows the consumer to withdraw from the program at any time without penalty by providing notice. \nOn XX/XX/XXXX, I requested that Americor close my account and stop all ACH withdrawals.\n\nDespite this request, Americor withdrew additional funds from my account on XX/XX/XXXX. \nThis withdrawal occurred after authorization had been revoked and may violate the Electronic Fund Transfer Act ( 15 U.S.C. 1693 ). \nConcern : A withdrawal from the account occurred on XX/XX/XXXX after a termination request was made on XX/XX/XXXX. \nC. Clause Concerning Consumer-Negotiated Settlements The agreement states that settlements reached directly with creditors may still be considered part of the program even if the consumer negotiated them personally.\n\nConcern : Americor later acknowledged the debts had already been paid and removed them from the program, suggesting the company did not negotiate those settlements.\n\nConsiderations The conduct described above may warrant review under consumer protection frameworks governing debt relief services, electronic fund transfers, and unfair or deceptive business practices.\n\nPotential Legal Concerns Missouri Merchandising Practices Act ( Mo. Americor also charged a XXXX % settlement fee based on the original enrolled balance, further eroding any claimed savings. \n\nExamples : XXXX Account Original enrolled balance : {$1400.00} Settlement amount : {$2000.00} Americor settlement fee : {$400.00} Total cost : {$2400.00} This resulted in me paying more than my original debt, despite the program being marketed as debt reduction. \n\nXXXX XXXX  XXXX Account Original enrolled balance : {$7700.00} Inflated balance used for negotiation : {$9000.00} Settlement offer : {$6400.00} Estimated Americor fee : ~ {$1200.00} Total projected cost : ~ {$7600.00} This settlement provided no meaningful reduction from my original balance once Americors fee was included. Any claimed savings existed only because the balance had been artificially inflated during nonpayment. \n\nCredit and Legal Harm As a direct result of participating in Americors program : My credit score dropped from approximately XXXX to XXXX within months. \n\nXXXX account was charged off. \n\nI was subsequently sued in XXXX XXXX XXXX XXXX XXXX XXXX by the creditors successor entity. \n\nI incurred additional financial exposure, legal risk, and long-term credit damage. \n\nWhile Americors contract contains general disclosures that negative credit outcomes may occur, the sales presentation and marketing materials emphasized debt reduction and savings, not the likelihood of paying more than original balances or facing civil litigation. \n\nWhy This Is Deceptive Americors marketing created a net impression that debts would be reduced relative to original balances. In XX/XX/XXXX, I cancelled a debt consolidation service with Americor for, among other things, failure to pay my creditors from the funds I was providing them in their debt settlement program. This led to a complaint filed with your office, referenced as complaint number XXXX, from which Americor provided your office with an outlandishly false response suggesting they in fact were paying my creditors as agreed, and they went as far as to suggest they would offer {$500.00} to me as a good faith gesture to resolve the issue. \n\nUnsurprisingly, while your office considered the complaint 'closed ', I of course never received Americor 's 'good faith payment ' as they misled you they would send me. After a high pressure sales pitch by their representative, XXXX XXXX, I signed up and gave Americor power of attorney to negotiate my debts. \nUnfortunately, my credit scores still plunged and it was difficult to make the expensive payments to Americor but I held on and trusted they would help me resolve and payoff my debts. Part of the agreement was a 25 % fee on settled accounts, which made me hesitant to sign up at first, but XXXX XXXX reassured me that it would be worth it in the long run. I was also promised a loan at 35 % interest after one year of payments to payoff any outstanding settlements. However, that loan never materialized and only offered recently in XX/XX/XXXX when I expressed displeasure with Americor 's activities. I was denied that loan. \nWhat did materialize was an accumulation of fees, more than equal to the amounts that were going to pay off outstanding settled debts. In XX/XX/XXXX, I offered to deposit a lump sum of {$3500.00} to speed up payoffs of my open settled accounts. However, Americor aggressively insisted that the money be used as leverage to negotiate two larger outstanding accounts instead that were in pre-negotiation stages. I later found out why they chose this route, which was to continue to charge me the monthly settlement fees for Americor 's benefit, not mine. \nI finally had enough with this company in XX/XX/XXXX and stopped all future payments to them. I demanded a detailed accounting records and any documentation to assist me to contact any outstanding accounts to resume payments directly to them or pay them off.
