Since they cashed the check I assumed the buyout was complete and I had no further obligation for the loan. \n\nFast forward to XX/XX/XXXX ( a year and a half later ) I am wanting to purchase a home and my lender checked my credit. You can imagine my utter disbelief that not only did Ally fail to report a {$0.00} balance to the bureaus, but they also placed the account in Chargeoff status! Therefore, I was not able to qualify for the loan due to my scores being negatively impacted, as well as the debt being added to my XXXX. \n\nI immediately called Ally and provided proof that they did receive and deposit a check for the amount of {$9800.00}. At this point I was asked to call back in XXXX hours. \n\nOn XX/XX/XXXX I called back and was advised it was still being reviewed. \n\nFinally, on XX/XX/XXXX, after spending hours on the phone speaking with multiple people and proving to them that they received and cashed the check sent over a year prior, I was informed that Ally was returning the {$9800.00} to me.XXXX  They provided NO explanation as to why or how this erroneous error occurred, and even more frustrating : UNWILLING to fix the issue. I was told to contact the dealership. \n\nToday, XX/XX/XXXX I contacted XXXX XXXX, the collections company used by Ally Financial, and spoke with a representative and a manager. Even though this account has been reported as Chargeoff with the bureaus, they have no record of my account. I find it incredulous that over a year after my account was placed erroneously placed in Chargeoff status, the collections company has no record of this.\n\nAlly Financial initially violated the FCRA when they accepted my payment and failed to accurately report the account status to the 3 major bureaus. They further violated the Act by reporting false and derogatory information.\n\nAlly Financial also violated the FDCPA when they failed to inform me that my account was reported as delinquent/chargeoff. After 2 to 3 week, I went to the dealer to pay the buy out amount. Then, they said that I have to pay more now because of the rent charge. It is very fair that they don't let you pay and charge you more. \n\nThe dealer should not advertise lease credit of {$7500.00}, make consumers pay later to charge more rent charges and fees without a notice. It's a fraud and false advertisement. I also have screenshots of the texts I sent to the sale people to let them know that I want to buy out ASAP. Now, the Mercedes-Benz finacial service is asking me to pay more than what I agreed on the lease start date and billing me the rent charge that I was not told when I signed the lease. The dealer said I have to pay more rent charges even if I tried to pay earlier to prevent this charge. \n\nI told the dealer and financial service that I would like to start the dispute and arbitration process for the discrepancy amount and asking them to release the title, but no response from them until XX/XX/XXXX. \n\nI have already paid the amount I agreed on the date of lease, which {$75000.00}.\n\nI believe that using the tax credits to advertise cheaper car prices, then making more profits by making consumers pay later and charges more rent charges without a notice seem like treating the consumers unfairly. I feel that what they are doing right now is deceiving the consumers and abusing the tax credits and the system to make more profits for themselves. I would like to request the Bureau to investigate this issue, initiate an administrative adjudication proceeding by filing a Notice of Charges alleging a violation of a consumer protection statute, or filing an action in federal district court. In fact they have received every payment on time and I have offered to pay also the residual 11 monthly lease payments in advance, so that Ally would get all the funds to which it was entitled under the term of the lease agreement. I immediately notified my bank and they wired the money to US Bank. \n\nOn XX/XX/XXXX, I received a phone call from US Bank asking me again what I planned on doing with the lease. I advised if she could read the notes on my account as I had just spoke with a representative on Friday XX/XX/XXXX and the rep said there were no notes regarding my payment. I then advised of the bank wire transfer and she said the lease maturity department does not take bank wire transfers. I said, why was I provided the bank wire information by US Bank if that was the case. After being transferred 3 additional times, they were able to locate my bank wire payment. And then I was told that they would need to send it back to me and that it could take 5 business days and I would need to send another check. I asked why I would need to send another check when they already had my money? I was given the excuse that it was with another department of US Bank which was the collections department. I advised that the collections department should be able to refund my money to the lease department. And the worst part is that they are now threatening collection actions if I don't send in a check when they are the one 's who have my money. I have spoken with a Senior Rep ( asked for a supervisor ). How can a bank treat a client like this? How can they provide me an expedited payment method through bank wire and then after they have the money refuse to apply the payment to my lease. US BANK stated theyll accept the amount up to 10 days after but of course my bank will not accept that verbally. Theres no reason they shouldnt be able to date the letter for later. They also listed incorrect tax information on the letter which further delayed the process. See attached for letter dated 10 days after the issue date and the incorrect sales tax info of 9.5 %. Sales takes in Tennessee are 7 % I feel due to high car prices at the moment US Bank has changed their policies on loans to make it more difficult for consumers to purchase or trade in their cars at the end of lease. I returned the next day with a cashier check for {$31000.00}. That amount includes the taxes and registration fee. However, the salesman explained to me that the amount due changed and I had to pay an additional {$21.00}. Again, when I asked for an explanation, he just said that it may be interest, however, he told me to call XXXX AgainXXXX XXXX, according to the person, was unable to tell me over the phone. So, once more and to finish the nightmare, I paid that amount, not knowing what I was paying for. \n\n\nAt that point, I decided to stay quiet even though I know my rights. I have had numerous issues trying to transfer title with Ally, and have submitted other complaints with the CFPB. This is a BRAND NEW ISSUE, but related to my previous issues. \n\nI attempted to transfer lienholder at my DMV and am having a very hard time convincing them that I could NOT have filed sooner because of the delinquency and errors committed by Ally in providing me with the title of the car I purchased through a lease buyout on XX/XX/XXXX - XXXX am being assessed hundreds of dollars in penalties now and tons of extra hassle. I did not have a title from Ally within 30 days of the sale, which was XX/XX/XXXX, and is required by law. I received it XX/XX/XXXX after many attempts to get in touch with them and much hassle and headaches. That title had a glaring error : the odometer statement was wrong by XXXX miles ( too high ), even though I had provided all the odometer statements, etc., to Ally in order to transact. I went through a process to get that corrected with Ally, and also suffered consequences with my new lender, XXXX XXXX XXXX XXXX, because I was delayed in recording them as the new lienholder. XXXX XXXX XXXX XXXX hiked up my rate to 14 % from around 3 % because I was delinquent in recording them as the new lienholder on the title, EVEN THOUGH I HAD NO TITLE TO ACTUALLY FILE BECAUSE ALLY STILL WAS CORRECTING IT. I received a corrected title with the correct odometer reading as per the odometer statement on XX/XX/XXXX, after much hassle and stress in dealing with Ally. THIS IS 5 MONTHS AFTER THE DATE OF SALE. \n\nLooking at the affidavit that was signed by Ally Financial, which accompanied the corrected title ( sent XX/XX/XXXX ), it appears that there is one new error on the affidavit. The car YEAR is XXXX in actuality. On the affidavit, it reads \" XXXX. '' Furthermore, in the affidavit, the reason that Ally Financial provides for the title reassignment is a misrepresentation of the truth ( please see attached ). The TRUE reason for the corrected title, and should have been cited on the affidavit was for the ODOMETER ( that is an option on the affidavit ). Instead, Ally alleges it was for \" Other '' : \" during reassignement ( sic ), the agent has made a strikeover on the buyer 's address in error. The address should be read as \" XXXX XXXX XXXX '' NO FRAUD INTENDED. '' THIS IS A LIE. There was never any issue with the address. Please see the original title with the address clearly stated and with the WRONG odometer reading, and the certified copy of the title with the CORRECTED odometer reading. I received a check for {$28000.00} on XX/XX/21 and per XXXX  instructions ( see Attachment 2 - XXXX  ) forwarded the check to GM Financial with the completed Authorization for Certificate of Title Release. \n\nOn XX/XX/21 I received a call from XXXX saying the check was short but I would have to call XXXX  to find out how much. I called XXXX and they said {$290.00} but that I would have to handle the payment with XXXX. I called XXXX back and offered to pay the difference over the phone to get it taken care of. At this point their story changed, and they said they could not accept the check after all, as it was for a lease buy out and had to go through XXXX. They said the had NOT cashed the check and were mailing it back to XXXX. It would be mailed in 2-3 business days. \n\nOn XX/XX/21 I called XXXX to see if they could simply do a stop payment on the check and reissue for the correct amount to XXXX. They said XXXX HAD cashed the check on XX/XX/21 and the loan was active, that I couldnt have two loans on the same vehicle at the same time, and they would have to wait to receive the funds back. I conferenced in XXXX to ask why they cashed a check they couldnt accept, and why they told me they hadnt when they had. Those questions went unanswered. I asked them to get XXXX on the phone so that all parties were present as I now had a lease payment and and loan payment due within days of each other. XXXX got XXXX on the line and promptly hung up. XXXX said they would start the buyout process on their end from the beginning. \n\nOn XX/XX/21 XXXX called me because I was late ( for the first time in the 39-month lease ) on my payment. I explained the entire situation to the representative and paid {$600.00} to avoid it negatively impacting my over XXXX credit score ( see Attachment 3 - XXXX XXXX  Payment ). The representative said the refund check for {$28000.00} was requested and would be mailed out in 2-3 days. I also learned that XXXX had cut ties with XXXX that day and I would have to complete the buyout through the dealership. \n\nOn XX/XX/21 I called XXXX to see if they had received the check. They had not. I explained that I did not want to make my first payment, which was due the following day on XX/XX/21 in the amount of {$380.00} being that they would be getting the funds back from XXXX presumably any day. They explained that I had a 14 day grace period before a late fee would be assessed for my credit would be impacted. More than enough time, one would think. \n\nOn XX/XX/21 I called XXXX to see if they had received the check. They had not. I called XXXX and after the standard 50 minute hold time just to get a representative on the phone, I was informed that the check was not sent out yet because of a 14 day waiting period - it would be mailed out on XX/XX/21. I was understandably frustrated and said a bad word, to which XXXX promptly hung up on me. \n\nOn XX/XX/21 I called XXXX to see if they had received the check. They had not. I called XXXX to see if it was mailed on XX/XX/21 and get the tracking number as one would presume there would be for a {$28000.00} check going through the mail. They told me it was not mailed on XX/XX/21, it was mailed on XX/XX/21 via standard mail so no tracking number. \n\nOn XX/XX/21 I was forced to make my first payment on the XXXX loan in the amount of {$380.00} ( see Attachment 4 - XXXX Loan Payment Receipt ) so as to, once again, avoid any of this from impacting my credit. \n\nOverall I have {$980.00} sitting out there in limbo, all the while XXXX spouts lie after lie and sits on {$28000.00} for OVER A MONTH.
