But my payments are up to date and not delinquent. Next payment is due XX/XX/XXXX and the payment is {$510.00}. \n\nReported Late Payment/Missed Payment : It continuously shows 60 to 89 days past due with 20 missed payments. As of today XX/XX/XXXX this account is up to date. \n\nThese entries do not reflect the accurate history of my payments and account management. To the best of my knowledge and record-keeping, I have not missed any payments, nor have I made payments that were late as reported. These inaccuracies appear to be a result of a system error, processing delay, or incorrect reporting from the creditor Ally Financial. \n\nLegal Basis for My Complaint : I am invoking my rights under the following federal laws and regulations : Fair Credit Reporting Act ( FCRA ) Under the Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681, credit reporting agencies and furnishers of credit information are legally required to ensure that the information they report is accurate, complete, and up-to-date. The FCRA further mandates that if a consumer disputes an item on their credit report, the credit reporting agency must investigate the dispute and resolve it within 30 days.\n\n15 U.S.C. 1681e ( b ) : Requires that consumer reporting agencies maintain and report information that is accurate and fair to ensure the credit report is an accurate reflection of the consumer 's credit history.\n\n15 U.S.C. 1681i ( a ) ( 1 ) ( A ) : Ensures that any consumer dispute regarding inaccurate information is investigated within 30 days by the credit reporting agency and the information is corrected or removed if it is found to be inaccurate.\n\nFair Debt Collection Practices Act ( FDCPA ) If these late payments are being reported by a third-party debt collector, the Fair Debt Collection Practices Act ( FDCPA ), 15 U.S.C. 1692, prohibits collectors from reporting false information to credit bureaus.\n\n15 U.S.C. 1692e ( 8 ) : States that debt collectors are prohibited from communicating false information about the status of any debt, including information related to late payments, missed payments, or non-payment.\n\nConsumer Credit Protection Act ( CCPA ) Under Section 602 of the CCPA, all consumer reporting agencies must comply with requirements to report accurate data, and creditors are held accountable for providing accurate data to credit bureaus.\n\n15 U.S.C. 1681s-2 ( a ) : Creditors must ensure that the information they provide to credit reporting agencies is accurate and must investigate any disputes regarding inaccuracies in their reporting.\n\nRequested Actions : I respectfully request that the Consumer Financial Protection Bureau investigate the inaccuracies on my credit report. There is a toggle switch that goes off, and no pop-up warning is displayed, nor do you get any notice that this has happened. \nSince this time, I have made screen recordings that show when I log in the switch is turned off automatically. When I toggle the switch back on, a warning pop up appears to ask if I am sure I want to turn paper statements on. But when I log off and back in, the paper statements are turned off with no warning. It happens every time I log into the app, and if I forget to toggle the switch to turn paper statements back on, there is no notice given that this has happened. \nAdditionally, even though my email is correct and I am the one logging into the app where the statements are turned off, the statement emails do not come to me. After I made a complaint about this on XX/XX/XXXX, I was sent the emails, which show they went to my husband 's email. \nNot only did the paper statements get turned off in XX/XX/XXXX, but the escrow shortage statement was also an email. As a result, even though I always pay above my payment amount, my payment was short for 4 months until I was sent a paper letter. When I received the notice, I brought my payment current, paid the late fee, and figured out what happened. I turned the paper statements back on, and I again automated my payment to be above my payment amount. However, the mortgage company reported the late payments to the credit bureau. \nOn XX/XX/XXXX, after being notified by the credit bureau, I sent a secure message to Freedom, explaining what happened and asking for the late payments to be removed from my credit report. I was denied and told to call customer service. The case number for this complaint was XXXX. \nOn XX/XX/XXXX, I called the customer service and spent about an hour explaining the problem with their app, what happened, and asked again to have the late payments removed from my account. I was again denied. I called the customer service line at XXXX at about noon and spoke to 2 agents. \nI feel the app is deceptive and needs to be fixed. Just logging into the app should not turn off the paper statements. And, if it did, I should at least get a pop-up or warning, which I don't. Further, if I log into the app and mistakenly turn off paper statements by forgetting to do the toggle, then my email is the one that should be notified.
