The dealership was Toyota of XXXX, and salesman XXXX XXXX. The interest rate at the time was a little higher than I'd paid for vehicles in prior years. XXXX told me the loan was a lease, but ended up not being a lease ( I later learned ) and to come back after a year to 18 months they would put me in a different Toyota with a better interest rate. \n\nI had purchased other vehicles from XXXX in previous years, starting at Toyota on XXXX XXXX with a XXXX XXXX, then a lease XXXX  from XXXX Toyota  in XXXX  Texas, then a purchased XXXX XXXX  and finally a XXXX XXXX XXXX. When I called and emailed the dealership attempting to acquire another Toyota as he had instructed, after several weeks and multiple emails and phone calls I was told he was no longer at the company, which didn't make sense because I knew from past dealings he'd been with them for many years and had no intention of going to another dealership. Finally someone told me that he had passed away, and that the XXXX XXXX I was in was not a lease as had been explained, but instead a purchase at a high interest rate. I am on a fixed income as a 100 % XXXX vet and recently ran into some financial difficulties. \n\nFrom the inception of the last agreement with Toyota I paid anywhere from $ XXXX a month extra toward the loan included in the autodraft payment to reduce the principal on the loan. When I tried to get another vehicle I was told that stock wasn't available at the time due to a chip shortage, even in XXXX and throughout XXXX. \n\nI was attempting to get something at a lower interest rate, thinking it was ending the lease to purchase a new XXXX at a better interest rate than what I had been paying since roughly XXXX or XX/XX/XXXX. \n\nThe vehicle was repossessed in late XXXX or XXXX of XXXX. I was fortunate, that the vehicle wasn't sold at auction prior to XX/XX/XXXX and through Toyota representatives and XXXX XXXX I paid in urgency fees and money orders for repossession, storage and past due payments, an approximate total of {$3500.00} While attempting to recover my personal belongings, through XXXX XXXX, a third party repossession and recovery service that I would have to pay money to recover clothing, paperwork or other personal items from my vehicle. This occurred over the phone, and was told to me by a woman that answered the phone for that business. \n\nI then told her that the toyota representative informed me less than XXXX hours prior to my call with her, that I was not to pay any fees for acquiring my personal belongings. \n\nI also had contacted TDLR ( Texas Department of Licensing and Regulation ) to determine whether or not recovery and repossession companies fell under the same regulatory guidelines as towing vehicle companies do. TDLR told me they don't regulate recovery and repossession businesses. \n\nI was at a loss, because seemingly so, these companies charge consumers whatever they want, and are not available during normal business hours of XXXX Monday through Friday or even after hours in which consumers XXXX acquire their belongings from recovered vehicles. \n\nAfter navigating the website, from XXXX XXXX, unsuccessfully, and speaking to the same woman, I was told which buttons to press onscreen that seemingly had no connection to my situation or vehicle, but was a necessary part of their convoluted process to acquire my belongings. \n\nThe appointment was made and upon arrival I noticed that the property didn't appear to be a business in the operation of anything, and seemingly just a location with a XXXX foot fence surrounding interior portions of the property. XXXX sign on an exterior corner wall had faded out words, and was missing the standard verbiage on display at towing facilities in Texas. \n\nI was only able to make the appointment on the phone and avoid fees to recover my property because I told the woman on the phone that Toyota told me to tell them they weren't supposed to charge me to acquire my belongings. It seemed as if, since Toyota told me that at the onset, that they are aware consumers are routinely charged erroneous fees by XXXX XXXX services located at the edge of XXXX and XXXX XXXX Texas ; otherwise why would they mention it and why would the receptionist or admin staff at XXXX tell me I had to pay those fees, and then change their mind after I as a consumer tell them the lending company, Toyota said I was not obligated to do so. \n\nAfter numerous attempts on XX/XX/XXXX using XXXX XXXX and paying over {$3500.00} in payments, consisting of XXXX separate transactions Toyota told me my loan was reinstated and they'd sent a hold to XXXX XXXX, to prevent the auction of my XXXX XXXX XXXX. This occured prior to XXXX on that date. That amount included the repossession fee, storage and transportation from XXXX to XXXX XXXX ( auction facility ). After paying that, I was then told that I would also need to pay additional storage, in the amount of roughly {$10.00} a day plus other fees, perhaps taxes, they were unsure. I spoke to numerous representatives at XXXX XXXX on XX/XX/XXXX, and the XXXX as they and Toyota instructed me to do. They as of yet, XXXX pm, central, have been unable to tell me what that amount is, or even when I can make an appointment to acquire the vehicle, and that they don't make appointments the day of hold received or redemption forms from the lender. It appears this business practice is merely a way of taking more money from consumers, who are likely already struggling financially, via undue delays, and business practices in which lenders and auction service companies don't communicate in any way, that facilitates or enables a modicum of standard business financial services. \n\nSo far today, I've made XXXX phone calls in an attempt to schedule an appointment with XXXX XXXX, who again doesn't allow consumers to acquire redeemed properties the day they receive the paperwork from lenders allowing consumers to acquire their property after reinstating loans. I also made no less than XXXX phone calls between Toyota and XXXX XXXX on XX/XX/XXXX. \n\nI am concerned that during this loan, which was said to be a lease and not to worry about anything, to trade up the year after the acquisition of the XXXX XXXX, was a ploy to entangle me or contractually engage me, in business with toyota motor credit, for not just two to three years, but more like 5 to 8 years if the deal had went through as initially explained and guaranteeing Toyota monies from me through what would have been XX/XX/XXXX, ( date of first lease/loan payment ) and into another loan, with a standard average of 60 months would've been XXXX or XXXX. \n\nI am concerned that there were fees and or un-necessary expenditures embedded in the paperwork for the XXXX XXXX that resulted in longer payment periods, and that perhaps I was victim to the procedures or policies of toyota motor credit, that resulted in the lawsuit from the CFBP against toyota ( and resulted in a judgement of {$60.00} million against Toyota Motor Credit ), because of all the nuances and exceedingly difficult hurdles already mentioned, that I encountered while dealing with Toyota, XXXX, and XXXX. \n\nIt seems as if lending corporations, recovery and repossession services work in concert to extort and entangle consumers in processes that only facilitate the enrichment and financial gains of Americans facing financial hardships. It has been almost impossible thus far to navigate this process no one at any company has been able to provide an actual fact based answer, or solution. \n\nDue to this, I lost the ability to generate income for utilities, food, rent, and other necessity items because it was my only mode of transportation. After several conversations, supervisors, and writing appeals to AES, I am still left struggling to rebuild my credit ( which had been in good standing for quite some time! ). Below is the last letter I wrote to the appeals office, per their supervisor-who helped draft the verbiage for me. He stated that I should write an appeal to clarify my reasoning for the dispute. \nOn XX/XX/2022, I called into your office regarding a bill that I received in XXXX for XXXX for {$14.00}. I explained that I didnt understand the purpose of the bill as I was set-up on an auto payment status. The person on the phone stated that I needed to be re-certified for the Income Driven Payment Plan and then assisted me in doing so. A payment agreement was set and it was my understanding that this would also take care of the {$14.00} balance on the account. At no time during that recorded conversation was I instructed or asked to pay the {$14.00}, or I would have immediately. \nThe auto payments went on as scheduled and then on XX/XX/2022 I received a notification of a derogatory credit report for non-payment of {$1700.00}. I immediately called back to AES to question this report. The lady that I spoke with was very helpful and stated that Loan Sequence # 1 was showing a {$0.00} payment due and therefore the auto payments were not being contributed to that particular loan. However, it was not disclosed at that time that the {$14.00} was not cleared and therefore the reason for the negative credit report. She stated that she recognized the error and would send over a request to have the derogatory reporting removed. I was at ease knowing this was being handled. \nXX/XX/2022 I received another negative credit reporting for {$1700.00}. Due to these two reportings, my credit score went from an XXXX to a XXXX! I called back to AES as I thought this matter was rectified. The person that I spoke to this time stated that they, too, would process a dispute. I wasnt made aware of a form that needed to be completed, but then received a dispute form in the mail on XX/XX/XXXX. I then called back to AES to ask why I was receiving a form nearly a month later when twice now I was told the matter would be resolved. This person said I had to complete it in order to request the removal of the derogatory reporting. I completed and uploaded, and mailed the form as requested. I called back today, as instructed, to check on the status and was told my request was denied. \nWhile XXXX explained that the {$14.00} was a past due amount, he understood that there was clearly miscommunication and could see by my account history that I have been making every effort to remain in good standing with my payments. \nIt is my hopes that whoever is reviewing this correspondence can see that I am in no way attempting to avoid payments and doing everything in my power to cooperate. For what its worth, my family and I just lost a bid on our first new home due to this credit reporting and we are absolutely devastated. Additionally, I have a new vehicle waiting to arrive from the plant and I am truly hoping this can be rectified prior to having to sign papers on a new lease. \nI have worked extremely hard to maintain a good credit score and would graciously appreciate your understanding to submit a correction on my behalf. I did the right thing be not allowing them to assume ownership. After I could not receive any assistance felt it was unfair. I had a different representative who then said I could file for an extension and she sent an email to me which had a form to electronically fill out. I filled it out and when sending it back I contacted consumer portfolio only to learn that the previous rep who said i could be incorrect and had misled me.words were again exchanged and no solution at the time was found, A couple of weeks later I was told I went on to the website where i was granted an extension. I applied and was said to have signed for it. \n\n\nI never signed in, never seen this agreement they speak of but i learned that after i questioned how i had still had my car if i was actually that far behind. I struggled so had to get caught up on my loan but achieved that only to have two parents pass and my brother. all within a 6-week time frame. Three funerals, my job, my poor sister who still isnt okay to this day and here I am trying to maintaining myself. I initiated my relocation to XXXX to ensure I am a better support to my younger sister. had to fina a new job, was in constant communication with consumer portfolio, updated addresses and more. Eventually, I received no mail, no bills and the phone calls quit coming in. \n I called and asked what was going on and they stated i went on to the website and requested they not call me with a stop call request. \n\n\nI never logged in to any site and never asked them not to call. That's fact Got myself together and asked them to rese3nd out my bills yet they never came. \n\nUpon relocating my account was transferred to a new office where i spoke with a representative open time, where i had arrangements made. \nI was not even aware of nor was i notified., i was told to pay XXXX dollars, no repossession would stop and there were no options.,, I argued the amount was incorrect because they slapped me with fees i was not inclined to have, my balance owed jumped two more payments. \n\ni pleaded and pleaded and made no progress. They would not listen to me when I asked for literally 6 more days and i would have had that account paid off in full., they resumed. Stated they'd open an investigation and I requested a much higher level supervisor and they stated a call back would be made. \n\nThat call neve3r came. No resolution.\n\nThey treated me like an idiot, a fake, and like honestly ..a subprime consumer because not a single one of them had any compassion or empathy to my situation, my efforts to resolve it or the well being whatsoever.\n\nThey state they offer multiple payment plans. Sure, only to draw you in to take the loan/ good luck maintaining it. During the purchase of my vehicle at the dealership, they tried forcing me into add-ons and packages i didn't need to0 increase the total loan amount were very very forceful and even made you feel bad and intimidated me when i opposed. \n\n\nEverything in my mind said do not accept it but by this i just wanted the XXXX out. \nsure enough, they tried to mislead me on my APR % which changed multiple times. \n\nFurther that, their truth in lending is very gray and very dishonesty. This stop call items on the site were definetly not done with my knowledge and i believe they may be false.\n\nnot only this but my data has been breached,. Im a victim of a horrendous case of identity theft, cps doesnt care. but they sell my data to whoever asks for it without even verifying that companies credentials. This company is scamming me to my face, falsifying documents, changed owed balances and refused to trake accountability or to work with mew. I cant loose my car. iu need it as i drive daily at work. please assist me in finding a resoltuomn so i can leep the car.\n\nHault the reposssoion. I know my rights and i know them very well. I am seeking relief from this SBA Loan debt due to the sellers criminally fraudulent actions, the SBA lenders criminal negligence, and negligence on the part of the SBA itself. My complaint of XX/XX/XXXX and later complaints finally got the attention of the Office of the Inspector General at the SBA long after the statute of limitations to file criminal charges against the seller. But the criminally negligent actions of the bank and the SBA have not been properly addressed. The Inspector General closed the case and ceased collection and wage garnishment actions several years ago in XX/XX/XXXX but to this day I have a {$2.00} XXXX dollar lien on my home and I can not get business loans to start or purchase a new business due to this lien and the threat of collections still exists. On XX/XX/XXXX I received 20+ foreclosure notices for my home and request for me to pay {>= $1,000,000} within the next 90 days from the bank. The bank has been paid in full by my payments of {$500000.00} in principal plus {$200000.00} in interest and loan fees and by the SBA Loan guarantee of {>= $1,000,000} paid on XX/XX/XXXX. I have been a successful businessman most of my professional life. Now I can no longer pursue this career path due to the actions of an admitted criminal and the criminal fraud and negligence of the Bank. Meanwhile my family is suffering financially and emotionally. The summary below sites exact pages and paragraphs of the SBAs SOPs to show the negligence and crimes on the part of the SBA and XXXX XXXX  and I sent detailed information and the documents to back this up to the Inspector General many years ago in XX/XX/XXXX. My hope with this was to make their job extremely easy. Anyone of the numerous blatant violations of the SBAs SOPs should release me from the debt. It is NOT a hard decision at this point. The proof is there. Thank you for your help with this. \nBACKGROUND : In XX/XX/XXXX my business partner and I purchased a XXXX XXXX XXXX XXXX Franchise with an SBA loan through XXXX XXXX  and a line of credit through XXXX XXXX XXXX. When the business was sold to us, the seller, XXXX XXXX of XXXX, Ca., and his business broker, XXXX XXXX , grossly misrepresented the business and its earnings and expenses. In XX/XX/XXXX in a mediation proceeding, XXXX XXXX openly admitted to FRAUD and agreed to assume the business and ALL of its debts. There are multiple witnesses including attorneys and former employees of XXXX XXXX  SBA department who were present when XXXX admitted to fraud and agreed to assume the business and its debts. There are also documents prepared by a forensic CPA that show how XXXX double counted his earnings, and understated expenses. XXXX did pay off the remainder of the {$800000.00} line of credit to XXXX XXXX XXXX but failed to pay XXXX XXXX, the SBA Lender. It later came to my attention that XXXX XXXX  also committed fraud. XXXX XXXX wanted to work with XXXX XXXX as they are a large business brokerage firm. Our loan from XXXX was the first of many bad loans they made to XXXX XXXX clients to gain that relationship. I have also been told by insiders that there is a paper trail of illegal commissions paid to XXXX XXXX and XXXX XXXX of XXXX XXXX  in relation to this and other loans. Due to their criminal actions, bad loans, and gross negligence XXXX XXXX  has changed its name 5 times in the past 10 years. It has been XXXX XXXX, BBCN Bank, XXXX XXXX, XXXX XXXX, and now Bank of Hope. \nFRAUD AND NEGLIGENCE ON THE PART OF THE SBA LENDER AND SBA : Small Business Administration ( SBA ) Standard Operating Procedures ( SOP ) require that a lender request a seller 's tax return transcript using the form 4506T when funds are sought to purchase an existing business. See SOP 50 10 5 ( F ), page 185. From my communications with the SBA and with XXXX XXXX, the seller 's income statements and tax transcripts of the three years prior to the sale are not a part of the loan file. XXXX XXXX  claims they obtained the necessary tax transcripts from the seller, but they are not in their loan files or the loan files that are in the possession of the SBA or  Department of Treasury. I have a letter from XXXX XXXX XXXX of the SBA stating the files do not contain the tax transcripts. BBCN  / XXXX XXXX  has sent me the entire loan package in response to my complaints with the FDIC. The only documents contained in the Budget Loan docs file are : The Note, the Unconditional Guarantees, the Agreement to Provide Insurance, Corporate Resolution to Borrow/Grant Collateral, Hazard Insurance Disclosure, Business Loan Agreement, Commercial Security Agreement, Deed of Trust, and Assignment of Trust Account. \nTherefore, there is no Lender Credit Memo, no Seller Tax Transcripts, no reconciliation by the lender of any discrepancies in the tax transcripts and the financial statements of the seller, no certification of franchise document, ( see SOP 50 10 5 ( F ) page 195 ), and no lease for the second premises on XXXX XXXX  XXXX XXXX in XXXX, Ca. ( See SOP 50 10 5 ( F ) page 194, lease required for guaranty application ). This location is specifically mention on page 1 of the Business Loan Agreement yet no lease exists for it. These documents are not in the SBA or Department of Treasury files either. Their non-existence is a valid basis upon which to deny liability on the guaranty. Additionally, this lack of documentation is in itself a violation of SOP. See current SOP 50 10 5 ( F ) page 10 requiring a 7 ( a ) lender to maintain complete loan files.\n\nFailing to obtain these documents significantly impacted the funding of this loan. For example, if the lender obtained the tax transcript or the second lease they would have been able to see that the business should not have been valued at {$2.00} XXXX. \nOn the other hand, if the Lender 's agent, XXXX XXXX, did obtain the Seller 's tax transcripts and he failed to review them as required, and the transcripts show that the Seller was grossly misstating his adjustable net cash flow, and the business 's profitability, then the Lender failed to follow standard SBA lending procedures. See SOP 50 10 5 ( F ), pages 185-186, requiring a Lender to compare the tax transcript with the financial statements of the Seller to see if a significant discrepancy exists, and to delay the disbursement of funds until the discrepancies are sorted out. The SBA can deny its liability on a guaranty where a Lender disburses proceeds before a discrepancy is resolved.\n\nIn the U.S. Small Business Administration Authorization ( SBA 7 ( A ) Guaranteed Loan ) form it is written on page 9 item 48. Guarantee on SBA Form 148, by XXXX XXXX XXXX aka XXXX XXXX, resident of California. \nA. Third Deed of Trust on land and improvements located at XXXX XXXX XXXX   XXXX  CA XXXX. This property is residential. \nThis is my property and XXXX XXXX had no authority of any kind to guarantee my property for this loan. Therefore this foreclosure, lien, and entire loan guarantee are null and void and an act of criminal fraud. \n\nXXXX XXXX of XXXX XXXX  promised that we would be able to use {>= $1,000,000} of the SBA loan as a revolving line of credit to XXXX XXXX XXXX XXXX. I have a list of vehicles that I can provide that were subject to this agreement. 13 CFR 120.30 provides that the SBA loan proceeds may NOT be used for floor plan financing, or other revolving lines of credit. Obviously, no XXXX XXXX company keeps cars long term so there was clearly no other purpose for the {$1.00} XXXX and the cars listed in the loan documents. \nAuthorization, issued by the SBA for this loan, says that the guarantee is contingent upon the Lender complying with Form 750, the SBA Loan Guarantee Agreement. Because of the numerous violations of Standard Operating Procedures, XXXX XXXX  did not comply with Form 750 's requirement that the Lender comply with SBA Rules and Regulations. Therefore the guarantee was not operative. I have just pointed out at least 4 ways  XXXX XXXX  did not comply with SBA SOPs. Any one of these is a basis on which to deny my liability for the guaranty. XXXX XXXX  paid {>= $1,000,000} to a criminal in my name without my consent. Any documents I may have signed consenting to the loan were contingent upon the Bank and the SBA following the specific rules of the SBA and the bank did not do that nor did the SBA itself follow its own rules. Therefore I did not consent to the funding of this loan nor did I guarantee the loan. I have made several Freedom of Information Act requests for the documents over the years and again just recently from the SBA and requested them from the bank several times. Neither has been able to provide the documents in question because they do not exist and were not created or reviewed as they should have been. XXXX XXXX  has had 5 name changes over the past 10 years to avoid dealing with their crimes and bad loans and criminal loan practices. They have been XXXX XXXX, BBCN Bank, XXXX XXXX, XXXX XXXX, and now Bank of Hope. Bank of Hope is turning all of its old loan accounts over to collections and foreclosure specialists in one more attempt to steal from myself and many other victims. This information is all verifiable through a simple Freedom of Information Act ( FOIA ) request. \nAnother discrepancy is that XXXX XXXX has already paid {$500000.00} in principal plus {$200000.00} in interest and loan fees and I have 2 letters from the SBA stating that they honored their loan guarantee and paid {>= $1,000,000} to XXXX XXXX. Yet I am still being charged for the full {>= $1,000,000} plus penalties and interest. XXXX XXXX  also has a separate {>= $1,000,000} lien on my property which XXXX XXXX of XXXX explained in her letter dated XX/XX/XXXX, was for a {$100000.00} line of credit that was paid in full in early XX/XX/XXXX. Yet they have not removed the lien. I believe the lien was for the SBA loan which they were paid in full plus interest and loan fees that XXXX XXXX paid and the loan guarantee that the SBA paid. Therefore the lien should be removed in either case. Between the {>= $1,000,000} SBA collections and the {>= $1,000,000} lien XXXX has, they are effectively charging me {>= $1,000,000} for a {>= $1,000,000} debt that I dont even owe. I also have an email dated XX/XX/XXXX from XXXX XXXX, their SBA representative, that states, the SBA is scrutinizing all my past files as well as current. I am out of compliance Finally, we paid {$53000.00} to have an SBA Loan guarantee which XXXX XXXX  claimed was to protect us, but instead it protects the bank and causes us further damages. I am asking to be released from this debt and it should be charged back to XXXX XXXX  and its successors. \nMy family and my children are being punished for the crimes and negligence of others. We are financially insolvent and can not afford this wage garnishment, debt, or lien. We will lose everything as we are already struggling to make ends meet. I was told that yes, I could have this extension, all I had to do was to continue to make monthly payments. I did so, by auto-deduct from my bank account ( Chase ) and in fact I am paid up through XX/XX/XXXX. \nOn XX/XX/XXXX my car was missing, and I found out through the police, whom I called to report a stolen vehicle, that it had been repossessed. I then spent many hours calling Chase. My account had been deleted and my car had been towed to somewhere about an hour from where I live. I was told the only way I could get my car back was to send {$18000.00} in cash via XXXX XXXX to XXXX  TX. Alternatively I could send a cashier 's check to a post office box in XXXX XXXX, TX but they could not tell me how long that might take nor would they given me any written instruction or guarantee that I would even get my car back. I actually did try to find out how to send this large amount of cash by XXXX XXXX and that is not even possible, at least not from the part of the country where I live! I called many XXXX XXXX and was told they do NOT sent that kind of cash, the most you could send is {$3000.00} a day, and you can only do that a few times, not the number of times you need to get to {$18000.00}. I was warned by several XXXX XXXX offices that this sounded like fraud and I might lose all my money if I even attempted it. \n\nI opened a dispute with Chase but the next week I was told they consider the repossession to be valid, but I was not even given a reason why, they just hang up. \nAgain, I was paid up, plus I was never contacted by Chase, told I needed to do anything, and my car was just taken. When I was transferred to the owner I was told XXXX give me a call back. Next I contacted the bank Carvant who gave me the loan. The first person I spoke with name was XXXX. She told me to get an estimate and they would help try to cover the cost of the repair. I waited all day for the owner to respond if they were able to use the XXXX so at around XXXX I called them back no answer, so I left a message. I then called my insurance company back and had road side assistance come get the car, and I paid the extra mileage fee. I called them back to see if the car arrived they said yes theyll get to it tomorrow and get the estimate for the bank. They called me the following day and XXXX said he did a diagnostic and the transmission need a control valve and stated they were sending it out for repairs. On Friday XX/XX/2018 he gave me an estimate for XXXX. He told me on the phone that the part originally cost XXXX dollars but on the estimate it states {$460.00}. Then I was charged a diagnostic fee of XXXX. I had spoken with the mechanic from the XXXX dealer in XXXX XXXX department, and they said I definitely needed to replace the transmission so it was an unnecessary charge because I told them from the beginning. The email from XXXX states Hey XXXX, per our discussion, this is the estimate of what it will cost to fix the car. It does not need a new transmission. The control valve ( that controls the shifting in the automatic transmission ) has to be replaced. Let me know if you have any questions. At XXXX he sends another email hi chimere that it didnt work out with the control valve, we tried to save money. Unfortunately, the transmission need to be replaced so please forward this estimate to whoever you need to. Let me know what they say. The transmission price XXXX, another diagnostic charge XXXX, and XXXX XXXX XXXX parts described above XXXX grand total XXXX. I send it over to the bank. After going to get my children from school everyone was closed. \nMonday XX/XX/2018 I begin calling again to both the dealer and the bank because my rental fees are adding up now. Thats when all the XXXX call you back games continued some more, but they never do. Finally, I speak with a manager at the bank because thats who XXXX XXXX claiming theyre waiting for a response from them I speak with someone named XXXX who promised to call back he was acting manager because the manager XXXX was out on vacation. Again they never called back. I called back later that day and no one answered the phone again at the bank I was sent to voicemail. I spoke with XXXX numerous times he claiming to call me back once he hears from someone saying theyre not calling him back either. I call back to the bank no answer Im now being sent to voicemail. What bank dont answer the phone? I guess Im calling too much. I continuously called back and spoke with a Lady name XXXX XXXX who was so rude she said she was XXXX Manager we eventually had words and she said they wasnt paying for anything and if I dont fix the car they were going to repossess it. I call the dealer back to relay the message, but when I do call the dealer back same thing no answer. Im now assuming theyre on the phone with one another, but when I do reach someone they havent heard from the bank. Now Im furious because I feel like theyre giving me the run around. \nTuesday XX/XX/2018 again Im calling everyone the dealer still hasnt heard from the bank. The bank hasnt got in touch with the manager on vacation. XXXX not in today at XXXX XXXX via the phone call is what I was told, but I was already headed there. Guess who I see when I get there XXXX. Now how did that happened his excuse when I ask if he dodging me no I just came back I wasnt here. O.K. can you call the bank while Im here he reaches someone at the bank and walk into the service area where theyre fixing cars. I stayed there for an hour and a half because he claimed that someone was calling him back, that never happened. I called the bank myself they say theyre still waiting on an answer from the owner, but why didnt XXXX just state that. I went to speak with XXXX he says I dont know whats going on I have to talk to XXXX, but the President of XXXX XXXX hear everything but never come out the office because Im requesting another vehicle or my money back. How is raising the estimate helping me it obviously hurt me because theyre not paying it. Now Im crying for help mentally unstable, emotionally broken, and financially caught in a jam. I file a complaint with BBB. That same day XXXX call and say they doing you a favor and charging you XXXX Im totally confused he just called and said XXXX. I call XXXX back he says theyre playing two sides going behind my back saying different stuff to both of us. At this point I dont know who I can trust I feel like theyre together on this because while talking to XXXX I explain I shouldnt be responsible for repair he say well its your responsibility if you don t repair the car then we have to repossess it. \nXX/XX/2018 I contact the CEO again via email and phone about their poor customer service. Of course I never got a response. I finally get a call back from XXXX XXXX asking am I going to be able to make my payment on XX/XX/XXXX because if I dont they going to repossess the car. I call the dealer again XXXX the President /Manager/Sale person claim he still waiting for the bank so now I told them about themselves too Im tired of the games. Its now XXXX XXXX still waiting for the bank. I call and speak with XXXX to fix my car and Ill pay for it. For some reason Im on speaker but XXXX President /Manager/Sale person state you have to come in and put half of the repair cost down. I couldnt believe it all this time of me wasting money on a rental car all the phone calls etc, now he says this. I had to tell them about themselves again hurt, broke, and super stressed where Im getting that type of money from? I made a complaint with the attorney general office. \nMonday XX/XX/2018 the CEO call back he first tell me they stop doing business with them 4 months ago and his bank do try to be decent with their customers to help with these situations. I explain to him well how did I get a loan from the bank if you werent doing business with them. He states oh it was XX/XX/2018 because we dont like the way they do business. He says they dont trust the repair cost and he was sending his own mechanic out to get the car and give XXXX 2 days to look at the car. By then XXXX XXXX responded to BBB it state The customer purchased a used vehicle, all vehicles both new and used breakdown. We offered and suggested at time of purchase that the customer purchase a warranty to cover the types of issues she is complaining about, she decided not to. We are not affiliated with the company that financed the vehicle, as such we can not comment on any interactions between the customer and her lender. We feel bad that the vehicle broke down however it is not our fault, its unfortunate that the customer did not take our advice and purchase a warranty but that was her choice. I did not accept the response made by the business I stated why wouldnt I get the warranty it was at no cost to me. I give the CEO and mechanic time to get the car and check it out. \nXX/XX/2018 I realized XXXX XXXX responded to the Attorney General complaint with the same response as the XXXX  response by now they added we suggested she purchase an extended warranty for her car which could have been financed by her lender, for whatever reason she decided not to purchase the warranty. Funny how they remembered to add that after I questioned them on their response from XXXX. I finally get the call from XXXX and because I called them everything but their name at XXXX XXXX they stated to them that the cost of the vehicle is now XXXX Carvant will pay half plus defer my payments for 2 months it would be added to my final payment I didnt agree because I refuse to put one dime in XXXX XXXX pockets ever again. I called the XXXX XXXX back numerous times and left a message telling them to tow the car back to my house and Ill find someone else to fix the repairs. Not XXXX call back. I also, reached out to the CEO again asking who being truthful still no response. The car is in New York at XXXX XXXX XXXX when XXXX responded to the Attorney General complaint they state the car is repossessed. \nI dont know which way to turn. Everywhere I look for help I have been turned down. There is no lemon law for cars 10 years old only 6 years and newer with a warranty. However, its not my fault I was lied to that I had major repair coverage through GAP. I dont know anything about GAP, but when I call them they say they do have major repair coverage but the dealer didnt pay that on my vehicle just total loss. These people are some serious liars and scammers. Im wondering how many other people they done this too who didnt fight back but paid or took a loss. Im sure all people who are struggling are targeted mostly XXXX it was a money scheme to me due to the tax season. I didnt use tax money for my deposit and I think it is wrong that they lie to people knowing there is not one law in the state of Connecticut to back people like myself up. When I called on that Friday telling them to fix my car the guy who answered said they had 3 other cars there waiting for transmission repairs what a coincidence. \nI sent the car over to XXXX XXXX  on XX/XX/2018 their fees came to 3400+. I spoke with budget and they sent over another estimate so I can share with Carvant bank who still claiming they wanted to help, but once I send them another estimate they say I have to pay XXXX of the bill which again is impossible. At this time its XXXX I told them to pick up the car. I wanted to do a voluntary repo. They never picked up the car and once I called budget transmission about trying to make some arrangements to pay for the repairs I was told they gave them the title and the car is now for sale for XXXX .
