Description of the Problem This complaint concerns Nissan Account # XXXX, which was a lease with a maturity date of XX/XX/XXXX. The vehicle was returned on XX/XX/XXXX, with a balance of {$4100.00}, stemming from a dispute over damages allegedly caused to the headlights. \n\nThe key issues with Nissans handling of this account are : Re-aging of Debt : Nissan has repeatedly re-aged this account, falsely updating its status as open and active while inaccurately reporting payment obligations. \nThis ongoing re-aging creates the misleading appearance that payments are due, despite the lease term having ended in XXXX. \nErroneous Credit Reporting on All Three Bureaus : Nissan reported the account as \" open, '' with a balance owing and $ XXXX monthly payments, to all three credit bureaus : XXXX : \" Full termination/balance owing. '' XXXX : \" Full termination/balance owing. '' XXXX : \" Lease - full termination. '' These inaccurate entries made it appear as though I was delinquent on payments when there was no active obligation. \nFailure to Adequately Investigate or Correct Errors : When I disputed the reporting, Nissan failed to adequately investigate and correct the errors. Instead, they responded with comments like Completed. Investigation of FCRA dispute - consumer disagrees and This has already been investigated. \nCollection Efforts on a Disputed Debt : In XXXX, I received a collection letter for the balance owed on this terminated lease, further demonstrating improper debt collection practices. \nThese actions by Nissan have caused significant harm to my creditworthiness, leading to a decreased credit score, difficulty obtaining a home loan, and forcing me to purchase a vehicle through Carvana under less favorable terms. \n\n2. Violations Cited and Applicable Laws Fair Credit Reporting Act ( FCRA ) Violations : 15 U.S.C. 1681s-2 ( a ) : Furnishers must report accurate information to credit bureaus. Nissans re-aging of this account and inaccurate reporting of payment obligations constitute false and misleading information. \n15 U.S.C. 1681i : When a dispute is filed, furnishers must conduct a reasonable reinvestigation to correct inaccuracies. Nissans failure to properly investigate and correct errors violates this provision. \n15 U.S.C. 1681b : Prohibits reporting without a permissible purpose. Nissans ongoing reporting of a terminated lease as open and active lacks a legitimate purpose. \nFair Debt Collection Practices Act ( FDCPA ) Violations : 15 U.S.C. 1692g : Debt collectors must validate debts upon request. Nissans collection efforts on a disputed debt, without proper validation, violate this provision. \n15 U.S.C. 1692e : Prohibits false or misleading representations. Reporting the account as open, with a balance owing and no payment being made, is deceptive and misleading.\n\n15 U.S.C. 1692f : Prohibits unfair practices, including re-aging and pursuing collections on a terminated lease without adequate investigation or correction. \nConsumer Financial Protection Bureau ( CFPB ) Guidelines : CFPB Rules on Accurate Reporting : Require creditors to provide clear and accurate reporting of debt obligations. Nissans actions violate CFPB guidelines by creating the false impression of delinquency on a lease that had terminated in XXXX. \nStatute of Limitations : Most states impose a 4 to 6-year statute of limitations on collection of lease balances. Nissans collection activity in XXXX on a lease terminated in XXXX is likely outside the statute of limitations, rendering the collection improper. \n3. Penalties Owed According to the Law FCRA Statutory Damages : Nissans reporting to three credit bureaus ( XXXX, XXXX, XXXX ) over a period of 6 years ( XXXX ) constitutes ongoing violations. \n180 violations ( 6 years 3 bureaus ) at {$1000.00} per violation totals {$180000.00}. \nFDCPA Statutory Damages : Improper collection efforts, failure to validate the debt, and misrepresentation of the account constitute multiple violations. \n{$1000.00} per violation plus compensatory damages. \nCFPB Civil Penalties : Reckless and knowing violations of federal consumer protection laws are subject to civil penalties : Tier 2 : Up to {$25000.00} per day for reckless violations. \nFor 180 days of reporting violations, penalties total {>= $1,000,000}. \nCompensatory Damages : Financial harm caused by an inability to obtain a home loan and unfavorable vehicle financing terms. \nEmotional distress from ongoing credit damage. \n4. Documented Pattern of Non-Compliance Nissan has a documented history of consumer complaints for similar practices, including re-aging accounts, failing to investigate disputes, and improperly reporting terminated leases. These patterns reflect systemic disregard for consumer protection laws. \nDocumented Pattern of Non-Compliance NMAC has exhibited a pattern of similar behavior, as evidenced by : Class Action Lawsuit : In XXXX XXXX XXXX XXXX XXXX XXXX XXXX, plaintiffs alleged that XXXX XXXXXXXX XXXX with halogen headlamps had a defect causing dimming of the low beam headlights. Nissan settled this lawsuit, providing extended warranty coverage and reimbursements. \nConsumer Complaints : Numerous consumers have reported issues with NMAC regarding end-of-lease balances and improper credit reporting. This has caused so many problems for so many people, and according to the media, all people have to do is pay Westlake Portfolio Management ( WPM ). Thats what everyone says. Just send them your payments. WELL, its really Not that simple. First of all, WPM is a Collection Agency. Does anyone know what that really means? All of the accounts are in Collections! Why is that ok? Collection Agencies handle accounts that are delinquent and the original creditor has made all attempts for customers to pay, unavailable and unsuccessful. \n\nA Collection Agency on your credit can cause your credit score to plummet by XXXX XXXX. A Collection Agency on your credit can cause people to Not be hired or Lose a Current Job. A Collection Agency on your credit can prevent a home purchase. Why should the people that were doing business with XXXX have to suffer because they decided to shut the business down? Not only is the Collection Agency issue a problem, but what do they do about warranty issues. WPM has made it clear that they will Not honor any warranty. There are people with their vehicles STUCK in the shop because they were never paid for repairs. They have also told individuals that the term of their car notes is 136 months! Do you know how many Years 136 months is? XXXX Would you pay a car note that long? Another issue is most didnt even know they were leasing their vehicle until all of this happened. Others found out after they paid their deposits. These are people that werent able to get a car loan, and now theyre APPROVED! The excitement about having a nice vehicle with an affordable down payment blinded most of us. Nothing about XXXX said Lease. They were the King of Credit. It was a Buy Here Pay Here Car Lot. What about that says Lease? \n\nI dont know of a vehicle from them worth more than {$15000.00} and to own it will cost at least {$30000.00}. With a lease certain terms that were available. You could turn it in and walk away. You could trade it in for another vehicle. You could make a balloon payment and then begin a purchase. These options werent even known by many of the customers, but now None of those options are available anymore. Theres nowhere to return the vehicle. WPM says they only collect on the debt and even if you return the car, youll still have to pay for it! There are people with a car and No Paperwork. They have Nothing saying they even have a vehicle from XXXX. Nothing! They cant even register the vehicle! WPM doesnt have anything on them! They just have a vehicle they cant do anything with, not even operate legally! Just pay yall say. There's not even a guarantee that WPM even had the titles. Have you even looked at the reviews? Horrible! People are waiting for titles long after paying for their vehicles. I know of someone that had their vehicle totaled and cant do anything with the check from the insurance company because XXXX is on it and WPM doesnt have her account! Now she has No vehicle and a check that might as well be a piece of blank paper. Just pay the yall say! \n\nWPM says they dont need to issue any new contracts because theyre honoring the original contract. How is that when theyve canceled the warranty, changed the terms of the payments, removed the lease options, dont have titles, and dont even have everyones account! Just pay yall say. Would you pay? What about the rights of the consumer? We are aware that to yall were nobody. Nothing. I mean we couldnt even purchase a car at a regular lot. We didnt even know we were leasing. We made a down payment before signing paperwork ( that locked us into the lease without even knowing that was what it was ) We cant even find an attorney that will listen to us because whos going to pay them? XXXX is bankruptcy and the business has been dissolved. We want you to know that We are Not a bunch of Nobodys. We Matter. We have Rights as consumers! We have a Voice! We Demand to be heard! \n\nWPM has made hard inquiries on peoples credit without any consent! They have automatically deducted payments on bank accounts without permission! They harass people by calling several times a day from different numbers! They dont care about how they speak to people! They even hang up or yell over people. They arent even supposed to officially take over until XX/XX/XXXX. ( According to an interview with the XXXX ) The law states that they have to send out a verification letter within 5 days of contact, and they didnt. They cant even validate the debt! Theyre asking people to send them their original contracts! Pay them YALL say! Why should they pay them? There are so many things that have been done illegally! People have cars in other peoples name that they didnt know about. People have vehicles with VINs different than their paperwork. People have accident reports on their insurance since theyve had the vehicles that they did didnt make or know about. Pay them YALL say! WPM is a debt collection agency and most of the people werent even delinquent! Tell us again that we should just shut up and pay. \n\nPeople are scared. People are stressed to the max. Why pay again? Because they bought the information? What about XXXX filing bankruptcy followed by XXXX XXXX XXXX Are our vehicles part of the bankruptcy? Are they listed as assets? Should ANYONE be collecting while the bankruptcy is in process? Who do we have in our corner? Who cares about us? \n\nThey had over 40 dealerships in 10 states! Do you know how many customers that is? Thousands! What about us? Some people have already paid $ XXXX into their car already for a car worth {$7000.00}, and they still have more than {$15000.00} to go. They dont want to lose their only means of transportation, but at what cost? We were preyed upon and now were been preyed upon by a different company and thrown away by the rest of the world as if were trash! Just pay YALL say. We say NO! Since WPM has only some of our information, what about the rest of the accounts? Who has them? We Demand proof that we can get our titles once the vehicles paid off. We Demand Validation of the Debts? Are they ( WPM ) even licensed to collect in the states we all live in? We Demand a new contract with terms that they plan on adhering to! We want to be turned over to a finance company for negotiations. We want WPM off of our credit reports completely and all collection activity stopped immediately! We want attorneys to work with us to ensure all if our rights are observed and that WPM be made to stop. They are harassing people and pressuring them to pay a debt they legally cant collect on right now. We dealt with enough from XXXX, we refuse to go from a bad company to the worst company. WE DEMAND THAT OUR VOICES BE HEARD! WE WONT BACK DOWN! Why not take some time to actually investigate this matter instead of telling us to JUST PAY WPM! HELP US! PLEASE! We can be contacted via XXXX under XXXX XXXX XXXX XXXX. Join us and read our stories. See for yourself what this situation is doing to Thousands of people that have been thrown into the lions den. We are Not trying to get a free car! We just want to be treated fairly and justly, and be taken seriously. We are willing to pay a reasonable amount to a finance company under a new contract, or to the bankruptcy courts for the blue book value of the vehicles. Thank you for taking the time to hear me out. XXXX and Bridgecrest are controlled by XXXX XXXX XXXX ( XXXX founder ) and his son XXXX XXXX XXXX ( XXXX XXXX ), and operate an integrated dealer-captive lender structure that the CFPB has previously identified as presenting significant risk of consumer harm. \n\nI am filing this complaint to : ( 1 ) report a specific transaction exhibiting the same pattern the CFPB previously enforced against, and ( 2 ) request CFPB investigation into whether this pattern constitutes an ongoing unfair, deceptive, or abusive act or practice under the Consumer Financial Protection Act, 12 U.S.C. 5531.\n\nDETAILS OF THE TRANSACTION : On XX/XX/XXXX, XXXX sold me a used XXXX XXXX XXXXXXXX XXXX XXXX XXXX ( VIN : XXXX, XXXX miles ) for {$95000.00} a 20 % premium above the vehicle 's original new MSRP of approximately {$79000.00}. XXXX charged more for a XXXX-year-old used vehicle than the same vehicle cost when it was brand new. \n\nThe purchase was financed at XXXX % APR through Bridgecrest, XXXXXXXX XXXX affiliated captive lender. The Amount Financed was {$95000.00} over XXXX months, producing approximately {$31000.00} in finance charges on the inflated principal. \n\nI have made XXXX consecutive on-time payments via AutoPay totaling {$76000.00} ( {$9000.00} down payment plus {$67000.00} in monthly payments ). I still owe {$50000.00} on a vehicle currently worth {$30000.00} {$33000.00}. I have been approximately {$18000.00} {$21000.00} underwater throughout the life of this loan despite a perfect payment history. \n\nTHE PATTERN THE CFPB SHOULD INVESTIGATE : The CFPB 's own Data Spotlight on Negative Equity found that only XXXX % of auto loans industry-wide are originated with negative equity. Independent analysis of XXXXXXXX XXXX XXXX XXXX ( XXXX XXXX, XX/XX/XXXX ) found that approximately one-third of XXXX loans were underwater at origination XXXX to 4 times the industry rate. XXXX XXXX ( XX/XX/XXXX ) found that approximately 44 % of vehicles financed through XXXX since XXXX are underwater. The CFPB 's own data further shows that consumers who finance negative equity are more than twice as likely to face repossession within XXXX years. \n\nThis is not an isolated incident. It is the predictable output of a business model that : 1. Prices vehicles above fair market value ( in my case, above the original new MSRP ) ; 2. Originates the financing through an affiliated captive lender that profits from interest on the inflated principal ; 3. Eliminates the independent lender underwriting check that normally protects consumers in arm's-length transactions ; 4. Bundles add-on products such as XXXX coverage into the financed principal, where they accrue interest at the loan rate ( in my case, {$1000.00} in XXXX coverage that accrues to approximately {$1500.00} with interest and which, by its own terms, does not cover the negative equity situation the transaction structure guaranteed at origination ). \n\nTHE CORPORATE FAMILY 'S ENFORCEMENT HISTORY : In XXXX, the CFPB brought an {$8.00} XXXX enforcement action against XXXX for deceptive auto lending practices. XXXX is the parent entity controlled by XXXX XXXX XXXX. His son, XXXX XXXX XXXX, founded and serves as XXXX of XXXX. Bridgecrest was established as the captive financing arm for both XXXX and XXXX. The structure the CFPB previously sanctioned has been replicated and scaled through XXXX. \n\nIn XXXX, the CFPB sued XXXX XXXX XXXX, which operates the same integrated dealer-lender model, alleging that the company \" misrepresented costs in loan agreements and tricked customers into high-cost loans on used cars '' by incentivizing dealers to inflate vehicle prices to increase loan principal balances. The parallels to XXXXBridgecrest 's operations are direct. \n\nCURRENT REGULATORY AND MARKET CONTEXT : XXXX is currently the subject of significant independent scrutiny : the XXXX XXXX XXXX report ( XX/XX/XXXX ) raised concerns about XXXX 's lending and accounting practices, and the XXXX XXXX report ( XX/XX/XXXX ) documented alleged accounting irregularities and {$800.00} XXXX in loan sales to a suspected undisclosed related party. The XXXX XXXX law firm has initiated a mass arbitration campaign against XXXX on behalf of consumers alleging similar unfair lending practices. \n\nPRE-ARBITRATION CONDUCT : On XX/XX/XXXX, I served a formal Claim Notice under Section XXXX of XXXX 's Arbitration Agreement. XXXXXXXX XXXX XXXX XXXX team acknowledged receipt in writing and responded : \" we are unable to modify or restructure financing terms. '' XXXX refused to engage in good-faith resolution of my claim. On XX/XX/XXXX, I filed a Demand for Arbitration with the XXXX XXXX XXXX under Case No. XXXX. \n\nVIOLATIONS ALLEGED : 1. Unfair, Deceptive, and Abusive Acts or Practices under CFPA, 12 U.S.C. 5531, by structuring a transaction that eliminates independent market discipline and systematically originates negative-equity loans at XXXX times the industry rate.\n\n2. Deceptive pricing practices by offering a \" discount '' relative to current new-vehicle MSRP while concealing that the price exceeded the vehicle 's own original new MSRP.\n\n3. Deceptive sale of GAP coverage financed into the loan principal, where the coverage by its own terms can not address the negative-equity situation that the transaction was structured to create. \n\nDESIRED RESOLUTION : 1. CFPB investigation of XXXXBridgecrest lending practices, including the systemic origination of negative-equity loans at rates substantially exceeding industry norms ; 2. Principal reduction of my loan balance to align with the vehicle 's current fair market value ; 3. Reduction of the XXXX % APR to a competitive rate ; 4. Disgorgement of the interest collected on the inflated portion of the principal ; 5. Such other relief as the CFPB deems appropriate. \n\nI have attached ( or will provide upon request ) : the AAA Demand for Arbitration, Supplemental Evidentiary Brief, Retail Installment Contract, and XXXX XXXX Resolution correspondence documenting XXXX 's refusal to engage in pre-arbitration resolution.","date_sent_to_company":"2026-04-09T20:17:45.000Z","issue":"Managing the loan or lease","sub_product":"Loan","zip_code":"342XX","tags":null,"has_narrative":true,"complaint_id":"21104655","timely":"Yes","company_response":"Closed with explanation","submitted_via":"Web","company":"Bridgecrest Acceptance Corporation","date_received":"2026-04-09T20:03:41.000Z","state":"FL","company_public_response":null,"sub_issue":"Problem with additional products or services purchased with the loan"},"highlight":{"complaint_what_happened":["COMPANY : XXXX, XXXX and Bridgecrest Credit Company , LLC ( XXXX XXXX XXXX ) PRODUCT : Vehicle loan or lease ISSUE : Problem with the loan or lease SUB-ISSUE : Loan balance remaining after the vehicle is repossessed and sold / Billing disputes or issues SUMMARY : This complaint concerns the same corporate family that was the subject of the CFPB 's XXXX {$8.00} XXXX enforcement action against XXXX for deceptive auto lending practices."],"product":["Vehicle loan or lease"],"issue":["Managing the loan or lease"],"sub_product":["Loan"],"sub_issue":["Problem with additional products or services purchased with the loan"]},"sort":[16.355206,"21104655"]},{"_index":"complaint-public-v1","_id":"2795944","_score":16.192276,"_source":{"product":"Credit reporting, credit repair services, or other personal consumer reports","complaint_what_happened":"On approximately XX/XX/XXXX I contacted XXXX XXXX XXXX regarding the buyout price for my lease vehicle, which was to expire XX/XX/XXXX. I didn't write this. XXXX XXXX did. We aren't asking yall to sign your name. We're asking you to copy it and send it to every single news media outlet in your area. We need to be heard! \n\nIm writing this at this hour because this situation has caused me to lose many nights of sleep. \nAs you know XXXX XXXX XXXX XXXX XXXX XXXX ) closed its doors in XXXX and recently filed for XXXX XXXX Bankruptcy. All of the accounts are in Collections!! Why is that ok? Collection Agencies handle accounts that are delinquent and the original creditor has made all attempts for customers to pay, unavailable and unsuccessful. \nA Collection Agency on your credit can cause your credit score to plummet by XXXX points. They have also told individuals that the term of their car notes is 136 months!! Do you know how many Years 136 months is?? XXXX Would you pay a car note that long? \nAnother issue is most didnt even know they were leasing their vehicle until all of this happened. Others found out after they paid their deposits. These are people that werent able to get a car loan, and now theyre APPROVED! The excitement about having a nice vehicle with an affordable down payment blinded most of us. Nothing about XXXX said Lease. They were the XXXXXXXX XXXX XXXXXXXX. It was a Buy Here Pay Here Car Lot. What about that says Lease? \nI dont know of a vehicle from them worth more than {$15000.00} and to own it will cost at least {$30000.00}. With a lease certain terms that were available. You could turn it in and walk away. You could trade it in for another vehicle. You could make a balloon payment and then begin a purchase. These options werent even known by many of the customers, but now None of those options are available anymore. Theres nowhere to return the vehicle. WPM says they only collect on the debt and even if you return the car, youll still have to pay for it!! There are people with a car and No Paperwork. They have Nothing saying they even have a vehicle from XXXX. Nothing! They cant even register the vehicle! WPM doesnt have anything on them!! They just have a vehicle they cant do anything with, not even operate legally!! Just pay yall say. \nTheres not even a guarantee that WPM even had the titles. Have you even looked at the reviews?? Horrible! People are waiting for titles long after paying for their vehicles. I know of someone that had their vehicle totaled and cant do anything with the check from the insurance company because XXXX is on it and WPM doesnt have her account!! Now she has No vehicle and a check that might as well be a piece of blank paper. Just pay the yall say! \nWPM says they dont need to issue any new contracts because theyre honoring the original contract. How is that when theyve canceled the warranty, changed the terms of the payments, removed the lease options, dont have titles, and dont even have everyones account!! Just pay yall say. \nWould you pay? What about the rights of the consumer? We are aware that to yall were nobody. Nothing. I mean we couldnt even purchase a car at a regular lot. We didnt even know we were leasing. We made a down payment before signing paperwork ( that locked us into the lease without even knowing that was what it was ) We cant even find an attorney that will listen to us because whos going to pay them? XXXX is bankruptcy and the business has been dissolved. We want you to know that We are Not a bunch of Nobodys. We Matter. We have Rights as consumers! We have a Voice! We Demand to be heard!! \nWPM has made hard inquiries on peoples credit without any consent!! They have automatically deducted payments on bank accounts without permission!! They harass people by calling several times a day from different numbers!! They dont care about how they speak to people!! They even hang up or yell over people. They arent even supposed to officially take over until XXXX XXXX. ( According to an interview with the XXXX ) The law states that they have to send out a verification letter within 5 days of contact, and they didnt. They cant even validate the debt!! Theyre asking people to send them their original contracts!! Pay them YALL say! Why should they pay them?? \nThere are so many things that have been done illegally! People have cars in other peoples name that they didnt know about. People have vehicles with VINs different than their paperwork. People have accident reports on their insurance since theyve had the vehicles that they did didnt make or know about. Pay them YALL say!!! WPM is a debt collection agency and most of the people werent even delinquent!! Tell us again that we should just shut up and pay. \nPeople are scared. \nThey had over 40 dealerships in 10 states! Do you know how many customers that is? Thousands!! What about us? Some people have already paid $ XXXX into their car already for a car worth {$7000.00}, and they still have more than {$15000.00} to go. They dont want to lose their only means of transportation, but at what cost? We were preyed upon and now were been preyed upon by a different company and thrown away by the rest of the world as if were trash!! Just pay YALL say.\n\nWe say NO!!! Since WPM has only some of our information, what about the rest of the accounts? Who has them? We Demand proof that we can get our titles once the vehicles paid off. We Demand Validation of the Debts? Are they ( WPM ) even licensed to collect in the states we all live in? We Demand a new contract with terms that they plan on adhering to!! WE DEMAND THAT OUR VOICES BE HEARD!!!! WE WONT BACK DOWN!!! Why not take some time to actually investigate this matter instead of telling us to JUST PAY WPM! HELP US! PLEASE!!! We can be contacted via XXXX under XXXX XXXX XXXX Customers. Join us and read our stories. See for yourself what this situation is doing to Thousands of people that have been thrown into the lions den. We are Not trying to get a free car!! We just want to be treated fairly and justly, and be taken seriously. We are willing to pay a reasonable amount to a finance company under a new contract, or to the bankruptcy courts for the blue book value of the vehicles. Thank you for taking the time to hear me out. I hope that we hear from you soon. \n\nSigned A Human Being With Rights P.S This letter will be sent to every news station in every city that XXXX operates in, and we will send this and other letters weekly until we are taken seriously.","date_sent_to_company":"2023-03-31T10:43:36.000Z","issue":"Attempts to collect debt not owed","sub_product":"Auto debt","zip_code":"29349","tags":"Servicemember","has_narrative":true,"complaint_id":"6778079","timely":"Yes","company_response":"Closed with explanation","submitted_via":"Web","company":"Westlake Services, LLC","date_received":"2023-03-31T10:26:44.000Z","state":"SC","company_public_response":"Company has responded to the consumer and the CFPB and chooses not to provide a public response","sub_issue":"Debt was already discharged in bankruptcy and is no longer owed"},"highlight":{"complaint_what_happened":["A Collection Agency on your credit can cause your credit score to plummet by XXXX points. Thank you. \n\n\nXX/XX/XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, AL XXXX XXXX Acct # : To Whom It May Concern : I have been a long time loyal and happy customer of XXXX for over 25 years with XXXX XXXX XXXX XXXX XXXX FL. Today, I am extremely upset, frustrated, and very disappointed in Southeast Toyota Finance in re : this urgent matter/issue. I received a late marker for 30 days or more late on all three credit reports/bureaus and my SETF account. I have never been late once in my life on a car payment. I always pay on time or within the grace period ( as one can see documented on my account ). I would like the marker, and any comments attached to marker reversed ASAP. My credit score took a 50 point hit because of this. I have good credit and been trying to build it stronger. I value my relationship with SETF and this is very stressing to me. This is all I can think about and I worry how this affects my future buying power without correction. I had 100 percent payment history on all my bills before this. **Please give me a moment to explain with proof and documentation. On Saturday, XX/XX/XXXX, I took a lease buyout of my XXXX XXXX XXXX at XXXX of XXXX, FL. I signed all the documents on this day, and it was recorded/finalized. ( I have a copy of all my documents ). At this time there was only one current ( not late ) payment left on the lease. At the dealership and after speaking with a Supervisor at SETF day before the signing, I was told that it is not a problem including the last payment in the lease buyout ( {$350.00} ). I was told this is the normal procedure at end of lease ( which end of lease was not even due yet ). This payment was not due yet at the time I signed the documents. I even asked since I was told it might take time process the account closing will the payment be late and the Dealer/SETF said not at all, because the date the documents were signed for lease buyout by XXXX XXXX XXXX guarantees the payment of last lease payment and buyout. And that is the date it will be recorded for payment and closure. Though it might take longer to process. XX/XX/XXXX is the date that my one remaining car payment and lease buyout was finalized and recorded. At this time on XX/XX/XXXX. XXXX XXXX XXXX became my new loan holder for the same previously mentioned vehicle and paid XXXX for the XXXX XXXX XXXX last car payment and any fees due. I have attached copies of all documentation that I received from XXXX of XXXX XXXX XXXX, at the dealership on Saturday, XX/XX/XXXX. I am also attaching a letter From XXXX XXXX confirming as such and the new loan. \nAs previously mentioned, I was told from the local dealer and SETF Corporate ( your office/Company ) it can take a few days to process but it would NEVER be late/reported to the credit bureau, because it was paid in full and lease satisfied on Saturday, XX/XX/XXXX. I triple checked this information. \nIf this was going to happen I would have made the last payment online separate from the lease buyout. But I was told not necessary by XXXX ( last payment as previously mentioned inc in lease buyout ). Never would I imagine getting a late marker with comments on my credit report. \n2 On all three credit reports, it does note account was closed and satisfied, but still shows late marker/delinquency. This is affecting my life by mental stress that this mistake has caused, plus my credit score dropping, and if not corrected will affect my future buying power/credit score.\n\nI have called Southeast Toyota Finance and uploaded similar emails thru my account page and I have heard nothing back. I am only told via phone it will be investigated and no one can help me at this moment, but on their end it shows payment was made on time and account was closed. Representatives of SETF says It takes time. But I do receive daily credit alerts of this issue. Each time I call I ask for a Su\npervisor and they said none are available and one will call me back but I have not heard anything back. \nPLEASE, PLEASE rectify the situation for me, so I do not have to escalate this problem anymore and I can put it behind me. Also remain a happy and loyal XXXX customer. Because right now I am anything but that. \nThank you in advance for all your help and immediate attention to this matter and for a quick resolvement. Under the settlement agreement, AHFC must pay up to {>= $1,000,000} in compensation to 714 servicemembers who were harmed by the alleged violations '' .I have filed for court proceedings. Honda Finance Settles Discrimination Investigation American Honda Finance Corporation will pay {$24.00} million in compensation and change the way it does business to settle a discrimination case brought by the Justice Department and the Consumer Financial Protection Bureau. The two federal agencies teamed up to investigate complaints about American Honda Finance Corporations unsavory lending practices. Borrowers alleged that Honda Finance was engaged in a pattern of discrimination in its lending practices. Specifically the joint investigation looked at a system of subjective and unsupervised discretion in loan pricing that resulted in XXXX XXXX, XXXX, XXXX XXXX and XXXX borrowers paying higher interest than other loan customers. This was not an isolated instance of a rogue employee doing the wrong thing. The practice was widespread, affecting thousands of minority customers. The DOJ and CFPB coordinated investigation revealed that, on average, XXXX Americans were made to pay more than {$250.00} more than XXXX over the course of the loan ; Hispanics {$200.00} more on average ; and XXXX XXXX {$150.00} more on average. All, because of their race or national origin, not because of their credit-worthiness. \n\nThe crux of the problem was that Honda Finance, like other captive auto lenders, allowed car dealers wide discretion to vary the interest rate beyond that which could be justified by objective factors of credit-worthiness. Often the car buyer will ask the finance manager something like, Whats the best rate you can get me? Or, What do I qualify for? The finance manager comes back with a number that is higher than that initially set by the bank, but the borrower has no idea that is not the lowest rate based on credit-related factors. They have no idea the rate offered is based on race-based prejudice rather than market-based factors. Honda Finance encouraged this behavior with its incentive system that paid the dealers more for loans that included a higher interest markup. One might say that Honda Finance incentivized deceptive or discriminatory conduct.\n\nAs a result of the settlement, Honda will limit the dealers discretion to charge interest rate markups and change the way it pays the dealers to place its loans. Justice Department Civil Rights Division leader XXXX XXXX explained, We believe that Hondas new compensation system balances fair compensation for dealers and fair lending for consumers. We hope that Hondas leadership will spur the rest of the industry to constrain dealer markup in address discriminatory pricing. \n\nIt is not hard to read between the lines. XXXX clearly implies that Honda Finance is not alone. Other dealers and lenders also conspire to offer minorities less favorable terms than they offer to XXXX. Interest should be a function of the cost of credit, related to the ability of the borrower to repay the loan. Whether a borrower has light or dark skin or comes from XXXX, XXXX or Tennessee should be irrelevant to the rate of interest he or she pays. The Equal Credit Opportunity Act ( ECOA ) and other consumer protection laws prohibit discriminatory pricing.\n\nThe landmark settlement was filed this week in the Central District of California. The terms must now be approved by the court..\n\nfrom these reports AHFC still operates in discrimination, fraud, identity theft, harassment and a bunch of other malicious acts.","date_sent_to_company":"2023-12-24T03:40:27.000Z","issue":"Managing the loan or lease","sub_product":"Lease","zip_code":"11234","tags":null,"has_narrative":true,"complaint_id":"8051146","timely":"Yes","company_response":"Closed with explanation","submitted_via":"Web","company":"AMERICAN HONDA FINANCE CORP","date_received":"2023-12-24T02:42:45.000Z","state":"NY","company_public_response":null,"sub_issue":"Billing problem"},"highlight":{"complaint_what_happened":["The DOJ and CFPB coordinated investigation revealed that, on average, XXXX Americans were made to pay more than {$250.00} more than XXXX over the course of the loan ; Hispanics {$200.00} more on average ; and XXXX XXXX {$150.00} more on average. This is through relocating to 3 different states and having the same cell ph # for 10 years which they frequently called me on. I had lived in XXXX XXXX for 2 years and been at my employment for 14 months. I had just sent XXXX a monthly payment in early XXXX. On XX/XX/XXXX, I came home to and found a letter in my mail ( not even certified ) that was from my corporate payroll office in XXXX XXXX notifying me that my wages were going to be garnished with the next pay which was 2 weeks later in the amount of {$89.00} by a company called GCC Services. All the letter contained was a phone number, no address. I called the number to speak to a male representative and after explaining why I was calling he advised me they were Student Loan Collection Company and they had 10 of my loans. I was floored as the one thing I know is that I can not run from Student Loans and had been in touch with XXXX who had told me in the last 2 years they had all of my loans. Also these loans in question were all acquired from XX/XX/XXXX-XX/XX/XXXX when I attended XXXX XXXX ( online ) XXXX, XXXX. I was informed via email and by XXXX about a year prior that those loans are being investigated as the school was deemed unaccredited and I would be informed when and if I would begin repayment. I never received anything from the company. I went to an attorney 4 days later and started bankruptcy proceedings, my Chapter XXXX was confirmed on XX/XX/XXXX. I was encouraged to include my vehicle. There was one garnishment payment that was deducted from my payroll and it was refunded a month later via Chapter XXXX, however, once finalized I was informed by my corporate payroll office that on XX/XX/XXXX, the company actually sent a \" cancellation of wage garnishment '' but I cant find out why. This was in XXXX when I learned this and about 3 weeks later, towards end of XXXX, I called GCC Services back ( XXXX, XXXX ) and asked why I didn't receive anything. First he asked, have you tried creating account and going online, which I did, but unsuccessful because I received never ending time capsule that never allowed me to access site. However, I was promised the information. Then he informed me that he now cant find anything as far as statements because my loans were sent back to the Dept of Education and they no longer had them. I also want to add that when I went to gccservices website there was an entire page dedicated to \" How Wage Garnishment Begins '' which none of it pertained to the way I was notified. I brought this up in my conversation with GCC to which I don't remember a response. Gcc services opened up a whole can or worms and left me clean up before they even spread.
