All the responses have ignored that simple fact. \n\nIt was previously determined that ERS provides \" public safety ''. One response stated that it was not it's \" primary purpose ''. In light of COVID ERS been determined to be an \" essential service ''. Public Safety is the essence of ERS. \n\nI have filed a Freedom of Information Act request revealed that no list exists for what 501 ( c ) ( 6 ) employers qualify. See attached.\n\nEvery response does not address the issue of WHAT IS THE STANDARD. I have been told to get ERS to complete the PSLF form but it only lists 501 ( c ) ( 3 ) status as a qualifier. The 10th anniversary for PSLF was XXXX and it has been a disaster. I utilized forbearance and in-school deferment options all I could but during my 2nd year of XXXX school I received notice that I no longer qualified for assistance and would need to start paying my loan immediately. The monthly loan amount was more than {$400.00} per month and as a XXXX student with a salary of only {$5800.00} a year this was a struggle. \n\nAfter finishing XXXX school the job market was less than ideal. I missed some payments and got behind. I contacted XXXX XXXX for assistance and they informed me that the only program I qualified for was a \" rate reduction program ''. In this program they reduce your interest rate to 1 % and you pay the interest on your loan ONLY. None of the money goes towards the principal which has now exploded to just over {$54000.00}. \n\nI now have a secure job and I have been making payments and each month I pay what I can and the principal NEVER goes down. As a young consumer at the time of this loan I feel like I was taken advantage of by XXXX XXXX. It is n't that I do n't want to pay my loan, it is more that I have made payments for XXXX years and my loan balance has n't decreased a cent. XXXX XXXX, now Navient, simply collects money from me every month and calls the program a way to help consumers. This does n't HELP consumers, it suffocates them. I am a teacher so I will never make enough money to make the monthly payments that they want from me and LIVE. \n\nI reached out to them to see if we could settle this account for a smaller amount and they declined. I filed a complaint with the XXXX about their predatory lending techniques and they sent me a letter with the promissory note included. According to a XXXX XXXX XXXX with the Office of Customer Advocate, the Rate Reduction Program, \" is a special modification program that is designed to assist customers in resolving delinquency and repaying their student loans ''. \n\nThe problem is, the Rate Reduction Program DOES NOT help consumers repay their student loans, it helps make the pockets of Navient thicker by collecting \" interest only '' payments from those who are financially struggling. Here is an idea Navient, if you really want to help consumers repay their student loans why do n't you take the interest rate down to 0 % for one year and allow them to make a pre-set payment that will ACTUALLY help them pay down their principal. \n\nAs I said before, I want to pay my debt back, but I do n't think it is right for me to have made payments for 3 years and still owe the same amount. My agency was not generous as what people might think about granting tuition assistance or re-paying their employee 's student loans as part of a recruiting and retention program. So, as I struggle to pay back the loans, the PSLF program has offered a way for me to complete. Anyways, what I did not know and felt deceived is the number of payments on my account that were not credited. My loan originated with the XXXX XXXX XXXX and was transferred to XXXX XXXX & XXXX. Only a portion ( 8 )  payments from XXXX within the last year before I applied to the PSLF program were accepted and counted against my PSLF from the past 15 years. I also did not realize that if you are one day late in making your payment, that payment is n't credited as well. So, with this I feel robbed that all the payments I have made are not being credited properly and therefore caused to make more payments than what is needed for forgiveness in this plan. As time goes on and with my limited income with the Government being politicized it feels that the struggle to make my student loan payment is worse. I have tried to work with my lender, the thing is I am hearing impaired and the preferred method of contact is by email. This was a devastating time for my mom and dad who were struggling keep the lights on and food on the table, let alone pay a {$400.00} a month student loan bill. Meanwhile, I was just out of college working at a XXXX making {$8.00} an hour. Needless to say, without any other choice, my family defaulted on this loan. It destroyed my dad 's and my credit scores which has taken me over ten years to rebuild. I had a few other student loans that I was able to consolidate with the US. Department of Education ( XXXX ) with a reasonable interest rate and an affordable payment. However, since this loan was a private student loan, it was not able to be consolidated with my other loans so I was left with this 9.5 % interest rate and high balance that is not moving despite our recent excellent pay history. I wanted to begin my adult life and begin to rebuild my credit so we entered into a repay plan to get our loan out of default and back current. We completed the repay plan and got the loan current, which was not an easy task. Here is where we are now feeling the affect. After we completed the repay plan and got the loan brought current, XXXX then capitalized the 2+ years of delinquent interest, fees, late charges, etc. back into the loan amount. The balance after the recapitalization was well over {$40000.00}! We have been current on this loan for the last several years paying {$410.00} a month. I feel that this loan is nothing less than predatory. It is now twelve years after the loan was originally issued and I do not see how I will be able to pay this loan off. Every extra dollar that I have goes towards this loan which takes things away from my daughter and my wife which is not fair, and I do not think that should be the penalty of wanting to obtain higher education. \nMy parents are now over XXXX and my mother 's health is deteriorating. Notably, organizations such as the Project on Predatory Student Lending have urged private lenders like XXXX, XXXX, XXXX-SOFI, and SOFI to recognize that the private student loans made to XXXX XXXX students are not enforceable and should be canceled immediately. \nIn my case, I was compelled to refinance my private loans due to exorbitant interest rates that rendered my monthly payments unmanageable. I struggled for years to pay my loans and it has cause significant burden, stress, XXXX, and personal harm. I have documentation of multiple conversations through the course of my struggles with my loan providers, as well as a note I wrote about my stress, XXXX and anger over an irrelevant degree. A now defunct degree that I poured my time, heart and soul into that I am still stuck paying a fortune for. My balance has does nothing but increase due to the interest rates I was being charged, despite years of monthly payments. \n\nI was forced to refinance with SoFi or risk loosing everything I had and destroying my credit, believing it would provide a more sustainable repayment plan. However, my interactions with SoFi have been fraught with inconsistencies and a lack of clear guidance : XX/XX/XXXX : I spent several hours on the phone with SoFi representatives who informed me that they were merely the servicer of my loans and did not own them. This directly contradicts their earlier statements, adding to my confusion and frustration. \n\nI still possess all of the original records from The XXXX XXXX that document the deceptive marketing tactics, misleading promises, and predatory lending practices that I experienced firsthand. The default and rehabilitation process was explained to me and although I disagreed with the result, I immediately undertook measures to start the rehabilitation process. At the time, I did not have the strength to fight the default. It was more important to me to get healthy and resume my life. I did just that I have been clean and sober for nearly 13 years and have been employed throughout that time period. I have made every single payment to AES. However, due to the increased financial burden and payment schedule, my debt to AES has barely decreased and every month it is a struggle to meet all of my financial obligations. '' Lender 's Response : \" The Office of Consumer Advocacy at the Pennsylvania Higher Education Assistance Agency ( PHEAA ) received recent correspondence through the Consumer Financial Protection Bureau ( CFPB ) portal regarding your rehabilitated student loan account, administered by American Education Services ( AES ). The OCA performed a thorough review of your Consolidation Loan, which was issued under the Federal Family Education Loan Program ( FFELP ). Specifically, we reviewed the financial activity, the communication history, and any available options. In the inquiry, you indicated that the principal balance on your Federal Consolidation Loan increased significantly following its default to the guarantor, the Pennsylvania Higher Education Assistance Agency ( PHEAA ), and the subsequent rehabilitation process. You requested for the default status to be reversed and for all payments to be reapplied to the loan. Your Federal Consolidation Loan disbursed on XX/XX/XXXX was initially serviced by AES. The original principal balance of the loan was {$56000.00}. Because sufficient payments were not received, the loan became significantly past due. As mentioned in your inquiry, you attempted to defer repayment on the loan due to your participation in a rehabilitation program. While the initial deferment application was received on XX/XX/XXXX, a default claim was already in the process of being filed with the guarantor, and the loan defaulted to PHEAA effective XX/XX/XXXX. The default balance was {$67000.00}. PHEAAs payment records confirm that you made timely payments from XX/XX/XXXX through XX/XX/XXXX. By doing so, you qualified for the loan rehabilitation process to have the loan removed from default status. A copy of the document that you signed for the rehabilitation process is attached. Some personal information has been removed for privacy reasons. At that time, you agreed to repay the total amount due on the loan, inclusive of the accrued outstanding interest, collection costs, and other charges assessed. Our goal is to enable theseborrowers who are struggling in defaultto get the same protections previously made available to tens of millions of other borrowers to help weather the uncertainty of the pandemic. \nUnder the XXXX XXXX, private lenders made federal student loans to students and guaranty agencies insured these funds, which were, in turn, reinsured by the federal government. After these loans enter default, they are transferred from the lender to the guaranty agency. While some FFEL Program loans are now held by the Department because they were purchased by the federal government during the financial crisis over a decade ago, many others remain with private entities. \nToday, the Department is announcing that it will expand the 0 % interest rate and pause of collections activity to XXXX XXXX borrowers who defaulted on a privately-held FFEL Program loan . This action will protect more than XXXX borrowers who were at risk of having their federal tax refunds seized to repay a defaulted loan. This relief will be made retroactive to XX/XX/XXXX, the start of the XXXX national emergency. \nThe Department will work to automatically return any tax refunds seized or wages garnished over the past year. Borrowers who made voluntary payments on any of these loans during the past year will have the option to request a refund of those amounts. The Department will also work with the guaranty agencies, who hold these defaulted FFEL Program loans, to implement the 0 % interest rate for these borrowers. \nIn addition, any of these loans that went into default since XX/XX/XXXX, will be returned to good standing. The guaranty agencies that hold those loans will assign them to the Department and request that the credit bureaus remove the record of default. \nThis action builds upon steps already taken by the XXXX XXXX to help federal student loan borrowers. Those steps include pausing student loan interest, repayment, and collections activity for tens of millions of borrowers with loans held by the Department through XXXX XXXX, XXXX. The Department also requested a waiver from the XXXX XXXX XXXX so that individualsdespite currently or previously defaulting on federal student loans or previously being delinquent on paymentswill still be eligible for a Paycheck Protection Program loan and related loan forgiveness.
