When it was time to the lease to get over I went to the store and sat for hours and they tried to look up the contract that said I could pay fair market value and I was informed that the contract was under the ssn of my ex husband and did not apply. They did not know what fair market value was for my phone and I would have to pay {$200.00} to cancel my contract and pay for the phone in full or to wait until the system says I can purchase the phone and then get credit for the months I had paid on the lease past the time allowed by contract that was not mine. mean while the phone was having problems with charging so I went to the company store to have it looked at. they did not do a loaner phone or back up because they said it will only be a few hours ... .They then said it was a bigger problem and sent it off to be worked on and activated my old phone. i was informed while working on the phone that they lost everything I had on the phone and needed to replace the phone with what they said would be a upgrade. they sent a XXXX XXXX that had been recalled and that will not even be allowed on a plane, it was over heating and shutting off on its own.I called about both problems and they took the payment to end the lease but did not reimburse me for the payment made as I was told would happen. I took off work and sat all day at the company store again to get it fixed. they replaced the battery and told me it would be fine ... .I walked out of store as it was closing and within 15 minutes it over heated and turned off again ... unable to miss any more work and sit all day aging I call the insurance that I had been also paying on the phone how also told me I had to go to store there is no other way. I I am in XXXX XXXX and all my signs and cards, contacts and registration was to that phone number. I called XXXX and explained I had a XXXX on my XXXX from the phone the sold me and I had to where gloves to hold it on a air conditioner to cool it on speaker phone to make to call to them. They would not fix the problem. I was forced to give up my number and end service with XXXX. I have a XXXX on my XXXX and a phone that is not operable. They own me and XXXX ***does not have a contract** on the phone and account in my name and ssn. I am out thousands due to all the problems and missed calls with XXXX. All the records lost and personal information/documents/photos/numbers. They removed the collection for one creditor and then gave it to Diversified Consultant that has reported it on XX/XX/XXXX, XX/XX/XXXX and XX/XX/2019. No matter what we did we could n't get ahead. We contacted our Servicing company, Ocwen. All we wanted to do is put the amount we were behind put on the back end of the mortgage to start fresh. Ocwen was asking for the same documents over and over again, Pay stubs, profit and loss from our XXXX XXXX, taxes from the last three years, bank statements from last 6 months. They kept coming back and telling us that things were unreadable, or illegible. We started snail mailing the papers because it was getting ridiculous. Then by the time we got everything in and they decided to look at the paperwork, the process had \" expired ''. So we would have to start the process over again from the very beginning, including the application and re sending the papers that we had JUST sent them!!!! Because why? Didnt they just get them? Had things changed over a few days? This is still going on today, we are just starting the fourth attempt to get help. We were communicating with our 2nd mortgage holder as well. They were being as helpful as ever, at least we think so. They told us the only way to save our house at that point was to file for bankruptcy under chapter XXXX. That would wipe out the 2nd mortgage and free us from that monthly bill. We found a local lawyer who practices bankruptcy law. He charged us several thousand dollars to file the case and it was pretty much done. Things were going well. Bills were getting paid, except for the mortgage. We contacted ocwen again to tell them we were unable to pay the bill for an unknown amount of time and if there was anything they could do, like defer the payments a few months. The woman on the phone, I wish I had written her name down at the time, told us we did not have to pay the mortgage because we were protected under the bankruptcy, and our payments were not going to the mortgage anyway, they were going to an escrow account. She told us to keep the money and .they may or may not be asking for it when the time is right. We were saving as much of it as possible. We have XXXX little girls and XXXX cars in rough shape and having difficulty. We had lots of personal and social issues with our children we had to take care of, so the money didnt always go where it should have, but instead, where it was needed. We were told after a while by our attorney that we should have been making payments and should start as soon as possible. And so we started paying what we could to stave off any attempt to take our house. We were paying in small increments, XXXX here XXXX there. XXXX was taking extra side work to help out as much as he could and I had as many children as she could have legally. We were refinancing our house for four years with Ocwen and not getting anywhere. We were making full payments for XXXX and XXXX. Ocwen had hired a lawyer firm to help get relief from stay. Our attorney informed us of this and asked what steps we were taking to stop it. We told him in an email that we were in fact talking to ocwen and trying to refinance as well as making full payments. Apparently he didnt think we were doing enough because he didnt even represent us in court. We didnt find out until we received a letter in the mail saying that the relief of stay was granted. We were devastated! How could they even ask for the relief if we were in the middle of a refinance and were talking with them. We were also making payments, which we found out they were not accepting them anymore when we had our XXXX payment returned to us, as well as XXXX payment. We didnt know about any ability to appeal until we spoke to another attorney about it. At that point it was too late. Apparently you only have 14 days to appeal. We just want a fair shake at saving our house and it seems like Ocwen is dropping the ball and letting/helping us fail. THE INACCURACIES ARE VERY HARMFUL TO MY CREDIT SCORE. XXXX XXXX IS LISTED WITH OVER 90 DAYS OF LATE PAYMENTS. AND THEY UPDATE THE LATE PAYMENTS EVERY MONTH, KNOWING THAT THESE ACCOUNTS ARE FRAUDULENT. I took my car back to Car-Mart and they said there is no crack and the air works and that it is not running hot. They also said my service agreement is void. I have been complaining about this problem since the beginning and the only thing they did to remedy it was put Freon in the car. \nI looked at the XXXX XXXX there is no evidence that they tried to fix the main issue. Each pointed the finger at the other. We didn't know if they would just apply it to our new lease payments. \n\nSpeaking with the Volvo Car Financial Rep after we leased our XXXX XXXX, we were told that Volvo Car Financial and XXXX Volvo were two separate entities that have no financial relationship or obligation to each other. To a layman outside of the Car Selling industry this seems odd. \n\nWe also told the VCF Rep that the Business Manager at XXXX Volvo called Volvo Car Financial to ask that they remove the late payment from our credit report considering the ramifications of our identity theft and that we had been doing business with VCF for decades and never missed a payment by purposefully setting up autopay. The Service Rep at VCF said that was not possible since the XXXXe Dealership manager could not take it upon herself to call without the customer 's permission. We were actually standing right next to the Business Manager when she called VCF upon our request. So yes, she did call with our permission. \n\nInsofar as returning the extra {$480.00} held by VCF, this Service Rep told us that we would have had to ask them for a return of the money BEFORE ending the lease and leasing a new vehicle. THAT is exactly what we did on XX/XX/XXXX and were told that it wasn't up to VCF to return the money, it was up to the dealership. Turns out that this is NOT true. So yes, we asked for the return of our money BEFORE the lease ended and got no where. \n\nIn the interest of fairness and justice, we asked VCF to remove the 'late payment ' status considering the extenuating circumstances. We also filed a dispute with XXXX, whose Rep told us that it was up to VCF to correct it and do the right thing. Their hands were tied and that algorithms would determine our credit score based on VCF 's decision to do right by us or not. This will impact our borrowing of money, the cost of borrowing money etc. for 7 years. Considering that we are elderly, who knows where we will be in 7 years. I only received 4.pages of a questionable document that appears to be fragmented and forged. I never saw or signed the document furnished to me by GCM. The date that I received the 4 pages ( again not the 75 I was told comprised the original lease document ) was today, XX/XX/XXXX. \n\nAs well, the four pages received have 2 signatures that appear electronic in nature. The two signatures bear the spelling of my first and last name, but are not mine, nor did I use data to sign any document for the lease of the unit. The signatures born on the document were received from Genesis Credit Management are not my signature. In accordance with the application process, after seeing the apartments I signed the lease in person using handwriting to affix my personal signature. I did not sign the lease over a data connection. \n\nIn XXXX of XXXX, during my residency at XXXX XXXX  and while awaiting the completion of my home purchase, I made management aware of my intent to move out upon the completion of my home purchase. I spoke with the front desk and administration several times as my purchase dates rolled forward. Repeatedly, I was told to give written notice 2 months prior to any move-out date. XXXX XXXX was fully aware shortly after move-in ( XX/XX/XXXX ) that I was purchasing a home and therefore would be there as a short-term resident. Per management 's instruction and lease provisions, On XX/XX/XXXX, I provided written statement of move-out that was delivered to the office. \n\nAfter getting my final move in date in the month of XX/XX/XXXX, I requested a moveout inspection with XXXXXXXX XXXX management, which was promptly denied. The pages received today include no such mention of the deposit amount. It just didn't seem fair for me to have to pay for an apartment I could not although i wish i could have, but was not at all going to be using, so after reading an article on XXXX offering tenant rights on early termination of leases and steps they could take, they suggested that I explain the situation to property management/landlord and mutually terminate the lease, and with their permission move out of that apartment. A XXXX XXXX, XXXX XXXX, and a House Collector, have continuously pestered me and bothered me despite having asked their entire organization and anyone else related to this matter to stop contacting me. \n\nNational Credit Systems , Inc. has placed this invalid debt amount on my XXXX Credit report, for which I have had to file an investigation disputing the invalidity of the debt. I received a letter today, XX/XX/2018  from National Credit Systems , Inc. stating that they have reported this invalid debt to all three credit reporting agencies and have also threatened that they are going to inform their client ( XXXX/XXXX  XXXX XXXX  ) to file a lawsuit against me to collect this invalid debt amount. \nMe and my guarantor have continuously been pestered unnecessarily by this organization starting from XX/XX/2018 to XX/XX/2018. \nXX/XX/2018 is when XXXX XXXX ( National Credit Systems , Inc. ) began unnecessarily contacting me over the phone, and that too, all he did was antagonize me assuming that the invalid debt was somehow valid, despite it certainly not being so. We have since encountered numerous problems throughout the closing process, all of which can be attributed to their dysfunctional loan process and poor communication. \n\nI 'll start from the beginning when I spoke with the mortgage banker over a month ago. To his credit he gave us fair warning that, because Chase did not have our condo association on file, there would be an additional audit step and it could potentially delay the closing. However, so long as the condo association was cooperative it likely would n't be a problem. I was also given to understand that Chase would be able to handle this on their end. \n\nIn the interim we completed and submitted all the necessary documents requested of us, leaving ample time for Chase to complete the condo documents, which was over 3 weeks ago. From what I recall, the underwriting team reached out to the association on XXXX XXXX to obtain the necessary documents. On XXXX XXXX they finally got in touch with the association, which in itself was an unnecessary waste of time. It 's unclear that their conversation was at all productive though, as Chase still could not provide us a definitive answer as to what documents we needed to provide. Incredibly, after numerous unanswered phone calls and messages and emails, that answer did not come until last Tuesday, XXXX XXXX. Once given the answer we immediately ordered the documents, while also incurring a completely unnecessary {$35.00} rush fee on top of the document ordering fees. {$35.00} is n't a lot when considering how much we are paying Chase for closing costs, but it could have easily been avoided had we simply been told to order the documents 3 weeks ago when there was still plenty of time. In addition, the loan processor they assigned to us left for vacation on XXXX XXXX with little warning, and will not return until XXXX. Why on earth would Chase assign a loan processor to us that would be out of the office during the most crucial time period for our closing? \n\nStill, we were willing to look past this as it seemed we would still be able to close on time. The condo documents were received by Chase on XXXX XXXX, which provided them a whole week to finalize the loan package. We were also informed by the mortgage banker on XXXX XXXX that everything would be sent to underwriting and be ready for us to close. On Wednesday XXXX XXXX ( 2 days before closing ) they still had n't updated us on the status of the loan package, so we called the loan processor 's replacement. She informed us that the loan was still in the audit stage and that there was nothing anyone could do about. This is wholly inexcusable. A client should never have to hear this 2 business days before the closing date. Again, had we been apprised of this sooner, we could have attempted to rearrange times with our closing attorneys as well as the sellers to help smooth things out. Now we are left with rearranging the closing date, relying on the good graces of the seller, and inconveniencing all parties involved. Luckily our current lease does not expire until XXXX, but if it had been sooner we would have no place to live. \n\nI then tried to call the loan processor 's manager to seek some kind of remedy, but they were unavailable ( lack of availability is a pervasive issue throughout Chase ). I completed the online application and received a prequalification letter for a Jumbo Portfolio Fixed Rate Loan with an interest rate of XXXX XXXX I was shocked and delighted to receive a XXXX XXXX  interest rate which was unheard of at the time. I contacted my preferred lender at XXXX XXXX who informed that I had an excellent rate that he could not match. He was shocked the bank could offer such a low rate. The prequalification letter was for a purchase price of {$930000.00}, loan amount of XXXX, down payment of {$98000.00} and estimated monthly payment of {$4900.00}. Later I received a loan estimate with a monthly payment estimated at {$5000.00} On XX/XX/XXXX, I informed XXXX that I was waiting on the executed contract from the seller and continued to upload documents. On XX/XX/XXXX, XXXX informed me that XXXX had to disclose today, and he needed the sales contract. I was advised to upload the contract I submitted in lieu of a ratified one. On XX/XX/XXXX, I uploaded the executed sales contract to XXXX client portal. \n\nREQUEST TO COMPLETE AN AMENDED TAX RETURN On XX/XX/XXXX, XXXX informed me that, after reviewing my tax documents, he noticed XXXX of my investment properties did not appear on my XXXX tax return but was on my XXXX tax return. XXXX advised me to complete an amended return so the income, which amounted to about {$25000.00}, could be counted towards my debt-to-income ratio. I informed XXXX that I was on the phone with my XXXX when he responded on XX/XX/XXXX, stating please let me know asap on the current home being rented, I am concerned we have waited too long to get the tax issue resolved, with the current tax ratios are over 50 %. I believe the ratios were 51-55 % at that time. I was also informed via phone that I would also have to pay the past due taxes before my loan would be approved. I asked why I was just now receiving this information. XXXX stated he was providing updates as he received them from underwriting. I called XXXX to inform him that his calls/emails about the amended tax returns were causing me stress. It took 4-5 days to get the amended returns. I had 5-6 calls/emails regarding the amended returns, some with XXXX panicking. I advised XXXX that his stress caused me to stress and asked him not to call me with panic but with solutions. On XX/XX/XXXX, t I uploaded the amended returns to the client portal. I then asked XXXX how long it would take to receive the loan approval. On XX/XX/XXXX, XXXX responded, it should just take a couple of days. \nOn XX/XX/XXXX, I receive an email from XXXX titled, XXXX XXXX. The subject read, Hi the head of underwriting just called me and said we cant accept an amended return to qualify. Please call. I was in complete shock! XXXX did not offer any solutions which was disappointing. I then offered a few solutions : 1. I reminded XXXX about my new job offer and asked if I could qualify with the new salary 2. I asked if the seller/developer lowered the price of the home could I qualify and asked the amount I would qualify for 3. I asked if my fianc could be added to the loan as we live together. I also asked XXXX why underwriting asked for the amended tax return on multiple occasions if I they would not accept them. I did not receive a response. \nOn XX/XX/XXXX, I shared the offer later prior to negotiations. XXXX informed me that the salary, plus a lease of {$3100.00} on our current home and a reduction of {$50000.00} on the loan would allow me to qualify. \n\nXXXX XXXX I contacted XXXX  manager who was dismissive. As a result, I contacted the regional VP XXXX XXXX XXXX on XX/XX/XXXX and shared my story. He informed me that XXXX does not accept amended returns to qualify a loan. He further stated that no bank does. The reason being if the customer does not get approved, the bank could be liable for paying the customers IRS bill as they advised them to submit the amended return to qualify. He asked for all the documentation and said he would research my situation. \n\nOn XX/XX/XXXX, my fianc started an application. He was told that his mortgage lates ( XXXX ) which were a result of his divorce, would not put in a position to help us qualify for a loan. He and I have similar salaries and somewhat similar credit scores. This was surprising as he was approved for a conventional loan. In all fairness, I was told by a different loan XXXX that jumbo loans are harder to get approved. \n\nOn XX/XX/XXXX, I informed XXXX that we were going to receive an application for the full lease amount of {$3300.00} for our current residence. I later asked for a new ratio calculation. I then shared my executed job offer with XXXX XXXX. On XX/XX/XXXX XXXX XXXX congratulated me on the offer and said he needed to contact XXXX to determine what the new ratios would be at the higher base salary. Once I have that information, I can request a ratio exception. Let me connect with XXXX and we will advise no later than XXXX. \n\nAt some point ( I believe it was on XXXX ), I was told that I needed to supply my XXXX tax return to show the rental income for my investment property on my schedule E. Yet another new ask. When I asked about the ratio exception, XXXX XXXX stated he never committed to that even though I have it in writing. He also asked me to show rents received from my investment property. I forward my tenants rental payment history on XXXX from XX/XX/XXXX XX/XX/XXXX. I assume the new lease was not enough and that implied that I was being dishonest. I informed XXXX that I had reached out to my XXXX  but wondered why the requirements had changed again. XXXX XXXX also informed me that the rental income from our current residence would not be considered in the qualification process as there is no rental history. Again, this was my first time hearing this! I asked XXXX about this on XX/XX/XXXX. His response, This was presented to me yesterday saying that underwriting would not accept a lease on the departure residence. I again asked why I was receiving this information on XX/XX/XXXX when I am scheduled to close on XX/XX/XXXX. XXXX  response was, That is when I thought there would be an exception for the lease. I also again asked why underwriting would not take the amended returns they requested. XXXXXXXX response was, I assumed they would accept it. \n\nLOSS SUMMARY Several assumptions were made that resulted in loan denial. If I had received the correct information sooner, the {$5000.00} XXXX could have been refunded. We also approved a rental application on XX/XX/XXXX as we did not want to put the family in a same situation we were in. We found a new construction home which is $ XXXX less than the previous home and sourced temporary housing until that home is complete. It will cost us {$1000.00} per month ( we hope to only be there 2 months ) and {$200.00} a month for our pod. Our new loan will be at an interest rate of XXXX %, raising our payment by {$880.00} a month or {$10000.00} for the first year and {$21000.00} for the second year until rates decline and we can refinance. This is not a small amount of money!!! It is providing an unnecessary financial hardship on our family!!! Our children were devastated when we broke the news to them. Furthermore, I was berated by the sellers agent who is also a managing partner for the development. The payment amount was extremely minor - many institutions do not even report XXXX day late, and many others do not do so for amounts under {$50.00} or {$100.00}. This practice is extremely unfair. This negative reporting will stay on my credit for XXXX  years! \n\nBofA WILL NOT WORK WITH ME OR HELP to fix this problem, and repeatedly gave me false information over the phone. I escalated to a supervisor and he continued to give me false and misleading information. This is deceptive. BofA initially told me they reported me because I was XXXX  days late. That is false. They lied to try to make my complaint go away. The {$25.00} payment was due XX/XX/XXXX and the account was paid in full ( {$70.00} ) on XX/XX/XXXX. BofA lied to me to justify their unfair reporting. As mentioned, I was so busy and stressed during the pandemic I simply did not notice the {$60.00} balance triggering the penalty. I can not even see what transaction caused the balance because their online banking makes it so difficult to understand my account information. \n\nBofA HARMED ME THROUGH UNFAIR POLICIES. I spoke with her twice and she is as much a manipulator as the sales person and manager. Her dad told my mother about some of the problems they had to deal with last year which included an abusive relationship that developed between this girl and her boyfriend. He said that  XXXX  had severed all ties with him and he ( the ex ) had no idea where she was living or working at this point. From what her dad told my mother it sounded as if her dad and his friends dealt with the boy and persuaded him that it would be a very bad idea to contact this girl. Her dad did make it clear that he was abusive and that she would not be in contact with the ex-boyfriend because he was bad news. Later in the week, my roommate gave us ( the roommates  )  background information on her relationship with this ex. She said that he had been abusive to her and that he was suicidal. She also told us that he showed up at her work and at school last year.   Honestly, she was never my favorite roommate. She was very dirty, often leaving dishes coated in food in the sink for days and leaving food out on the counter uncovered for long periods of time. She also had no respect for my roommates and me. She would use our property and not clean it and she would talk loudly on her cell phone out on our porch and in the kitchen at all hours of the night. She was also openly  XXXX  against  XXXX    XXXX   ; this was an issue I took great offense with because it is not how I was raised. I learned to ignore these qualities ; I understand that in college you dont always get to pick who your roommates are and that you re not always going to get along with them. She was a very irritating person, but I put up with it without complaint ( I did try to talk to her about it but quickly discovered that that approach wasnt going to work. ) I found it best to just ignore the behaviors I didnt care for. However, I went from being annoyed to fearing for my safety. Towards the end of my last semester of my junior year it became very clear that she was talking to her ex again. Over time, the situation became more and more volatile. They were constantly arguing on the phone. This is when I started to fear for my own personal safety but I was not sure what to do. Since she claims he was unstable I didnt know what he was capable of. I know that he had picked her up at  XXXX  before ; I dont believe he had been in our apartment. However, it wouldnt be very hard to follow her to our apartment because security was minimal at this complex, and for most of the first semester the key pads to get on our floor at  XXXX  wasnt working, so anyone could get in. There was only  one  lock on the door of our apartment ; if he wanted to get in, he couldve. I didnt feel protected living there. In late  XXXX   XXXX , everything boiled over. My roommate got into a fight with her ex because he had called her parents ( I dont know what he said to them  ).  She was out on our porch screaming profanities at the top of her  XXXX  so I went out and said that everyone could hear her (  I  didnt want the cops called  ) . She came back in the apartment a short time later and blew up at me. I asked her why she continued to talk to him and she claimed she did it to protect us from him. She said that if she cut him off she feared that he would come to the apartment and hurt all of us. She also said that I dont seem to mind when the  XXXX  downstairs are yelling all the time. I told her to never use that word in front of me again and that I have never heard someone downstairs yelling like she was. After this fight, it was very clear to me that I was not safe in that apartment, and that I was not willing to place my personal safety in the hands of someone making very poor choices. I was incredibly uncomfortable and I wanted to get out of there as soon as possible. My parents were not happy with the situation and told me that I needed to move immediately.   I got in touch with the manager of   XXXX   and at first she seemed like she was on top of things ; she agreed I needed to be moved and that there would be no additional charges since I was moving under duress .She asked me if I would please write to management and tell them how well she handled the situation, because evidently some people had reported that she was not a very good manager. I asked to be moved into an apartment that hadnt had any problems because I didnt want to be in the same situation a second time. The manager said that the girl who would know that information was out with a cold and wouldnt be there until the next day. When I went to speak with management the next day to follow up on the search for a new apartment, the manager said she had hand-picked this apartment because she completely understood that I need to feel safe in my own home. She said that there might be a slight increase because it was a different layout and in the newer phase. After that she continued to change her stories, it was as if the person I had talked to the day before disappeared and I was talking to her for the first time. She sent me into another employees office to sign the new lease. This is when I was told it would be  XXXX  plus parking, I was paying  XXXX . I said I couldnt afford that so she went to talk to the  manager  because only the  manager  can determine prices. She came back and said it would be  XXXX . Again, we told her we werent paying any more than we already were. This employee said she would see if she could find something else more in my price range, so I went back to the apartment to wait until I heard news. She called me many hours later and said that was the best apartment available and that it would be  XXXX . At this point my mom called the  manager  to tell her that I needed to move immediately and we would not pay additional money. She kept telling my mother different stories about how I just wanted to move out of my apartment but that I didnt need to move, to how she had worked many hours of overtime to find me the perfect apartment. My mother firmly told her that I was to be moved immediately because of safety and if it was not done I would not be staying in that apartment for another night. After my mother spoke with the manager, I was told I had to go down to the office and speak with her. Everything went downhill from here. She was very rude to me, like I was putting her out. She claims that when she said I wouldnt have to pay anything the day before, I was getting my terminology mixed up and thats not what she meant. I asked her point blank several times whether I would be charged more to live in this new apartment and she refused to answer my question. It was very clear we were not going to get anywhere and lies were piling up so I walked out of the office and told her my mom would call her, she said my mother was not to call her.   My mom called me about  5  minutes later and said I needed to go down to the office and get my keys for my new apartment. I was incredibly confused, since I had just walked out of there and the  manager  was angry with me! She had apparently called my mom as soon as I left the room. The managers behavior can only be described as bazar, she was telling me and my mom multiple different stories within minutes of each other, each story would contradict the one she had just told. After this I went down and got my keys, the manager apologized profusely and blamed other office staff for the mix-up. She never took responsibility for her own actions. I moved into my new apartment, a  XXXX  with only  one  occupant, the manager assured me that someone had walked the apartment and that it was even better than the one I had been in and that the occupant in it seemed very nice. I immediately noticed that it had not been cleaned after the old people moved out, there was trash in the room, furniture had been chewed on ( I think the previous resident had a puppy ) and the carpets reeked of  urine  ( the previous occupant had left multiple air fresheners in the apartment, when I took them out is when I started smelling  urine  ). I notified the apartment about the carpets and it took over a week for the problem to be fixed. I didnt have a lot of contact with my new roommate but I did find out she wasnt notified I would be moving in.   After returning from spring break I started to notice a lot of men coming in and out of the apartment. One man would come in, the apartment would fill with the smell of weed ( I have been to concerts before and smelled pot ), they would cook a whole bunch of food and leave a mess, and then he would leave. Then another guy would come, the apartment fills with the smell of weed again, they would eat, and he would leave. It was like our apartment was a revolving door. I was extremely uncomfortable with this. I stayed locked in my room for most of the day, only coming out when I knew my roommate wasnt there. There were multiple occasions when I was there that the apartment smelled like weed. I dont do drugs and I dont want to be around them. I also dont want to be held responsible for any damage done to the apartment. I started to feel like a prisoner because I was so uncomfortable coming out of my room while strange people were there. I felt completely unprotected and unsafe in that apartment. I was nervous to say anything about the illegal activity in the apartment because she would know exactly who was reporting it since I was the only  one  there. I was in contact with my parents and filling them in on what was going on. My parents lived about   XXXX   XXXX   XXXX   so I was stuck because that was too far of  XXXX   XXXX  to make while still enrolled in school. However, one night after I returned from work I walked into the apartment and there was a huge crowd of people. Everyone froze, I walked into my room, and everyone began laughing. The apartment reeked of pot. I also noticed that the unoccupied room had been broken into. They left around  XXXX  and returned at about     XXXX   XXXX   The apartment again filled with the smell of pot and they didnt leave until after     XXXX   XXXX  . I cant describe what it feels like to be in an small apartment, with a bunch of random men who have been partying, none of which I know, who stare at me as I walk in, and all I have is a small lock on my bedroom door and no other way of getting out of the apartment. I have never felt this kind of fear before I moved into this apartment complex, and I have never again felt this fear after moving out. I talked it over with my parents and again we agreed that I was in an extremely unsafe environment. After dealing with the  manager  the first time I had to move, there was no way I wanted to talk to her again. I packed everything up, quit my job, and moved back home to  XXXX .   It was incredibly hard having  XXXX   XXXX   XXXX  hours for classes until my semester ended. My mother and I scheduled a meeting with the regional  manager  of  XXXX   XXXX  in  XXXX   XXXX  to discuss everything that had taken place. She did not take responsibility for anything. She did let us know that the previous manager that we had worked with was no longer with the company. We explained to her that we would not be paying anymore rent because I was not safe in this environment and management had done nothing to address these safety issues. We did not feel it was fair to continue to pay rent on an apartment where my safety was not guaranteed or even addressed. She explained that they were not responsible for ensuring safety at the apartment complex and that they had floors of legal representatives if we were going to pursue legal action. My experience at  XXXX  was horrific. I feel it was handled extremely poorly and I lived every day in fear. I feel that  XXXX  interfered in my studies. Both of these situations took up a lot of my time. I was dealing with both of these roommates and also fearing for my personal safety, while also trying to complete my classes. I do not feel that  XXXX  takes any steps to keep occupants safe on that property. This has created a lot of problems for me. My rent had been paid on time every month and I had left both rooms that I occupied in better condition than when I arrived. I began receiving calls from debt  collectors  every single day, some of which even threatened to take legal action against me. I had blocked all calls from them. I got in touch with student legal representation through the college and they informed me that I was definitely not the only student who had these types of issues from  XXXX   XXXX . However, they informed me that the way  XXXX  had their lease written would make it very hard to take legal action against them. They said I had  two  options, I could either continue to pay my rent even thought   XXXX   XXXX   did nothing to satisfy my safety concerns or I could choose to not pay rent. I chose the second option. They informed me that they would help me choose an apartment complex next year that they had not had any issues with, clearly showing that they knew  XXXX    XXXX   was at fault. This entire experience was traumatizing and I did not want to return to this school. I did not return to finish my degree ; instead I found a smaller, private college and lived on campus the following year. For the two years that it took me to finish my degree at this new school, I had absolutely no issues with housing, both on and off campus.   It is now over 4 years later and this debt continues to haunt me. I am in the process of purchasing a house and would like to resolve this matter as it reflects poorly on my credit. I have been told by my loan  officer  that it would be a good idea to take care of this housing debt and that the debt collector is saying I owe about  XXXX  dollars in unpaid rent and various extra late fees. Since between that transitions I notice many changes between the payments done while on XXXX and how it was done with ocwen. I also notice my payments were not being reflected into my credit report, it seemed like it was still delinquent and like it was never been paid. I did my diligence by pay on time for over 4 years and my credit reported seem never to change, I was wasnt able to make purchases or even a small loan for a cell phone, this has been both deviating and embarrassing. \nXX/XX/XXXX-XX/XX/XXXX In order to get my credit going I decide to get help from family using them as a primary in order to get a credit line, I was able to see my credit increasing however the mortgage was still not being reported on my credit made things very challenging for me when it comes to recovering my life back in terms to my financial hardship that most American faced because of the market crash. \nFor years I been try to figure out what happen to my credit by hiring agents that are specialized with these types of hardships and, my investigation had lead me to understand that something was not done right between the transition with XXXX and ocwen. Subsequently, I received another preapproval on XX/XX/2021 for {$370000.00}. I signed a purchase contract and put up {$15000.00} in due diligence. My expected closing date was XX/XX/2021. \n\n\n\nWe went through with the process of getting the actual approval. The process was very confusing as I was asked for the same documentation several times and asked to explain XXXX XXXX for minimal amounts, such as {$5.00}. Although confused by the requests, I provided what was requested. Per request, I also uploaded pay stubs for the months of XXXX and XXXX. I work XXXX different contract jobs, XXXX as a XXXX employee and XXXX as a XXXX employee. On XX/XX/XXXX, I uploaded pay stubs from both of my jobs. After explaining my contract employment to XXXX XXXX, he advised me to only submit the paystubs for the XXXX position and not the XXXX position, so after that conversation, I only uploaded the pay stubs for the XXXX job. \n\n\n\nXXXX day before the projected closing date, everything started to go downhill. XXXX XXXX informed me that I would not be able to close on XX/XX/XXXX because the title had not been cleared by the attorney because they did not contact the attorney within a reasonable time. He contacted the closing attorney at XXXX XXXX on XX/XX/2021, just XXXX business days before expected closing. I was very upset because I had no clue that we were behind in our timeline, because on XX/XX/XXXX the original closing attorney notified XXXX XXXX and his team that they would not be able to handle the closing. XXXX XXXX and I had a conversation, I communicated to him to then reach out to XXXX XXXX to handle the closing. XXXX XXXX said that he had personally spoken with Attorney XXXX XXXX at XXXX and XXXX and he was told that she would handle the closing. However, on XX/XX/XXXX, the sellers listing agent reached out to confirm closing and he was made aware that the original attorney from XXXX and XXXX would not be able to handle the closing. \n\n\n\nTherefore, I was forced to ask the selling agent for an extension. I received that extension and the new closing date was scheduled for XX/XX/2021. On XX/XX/2021, we were still not able to close, for reasons unknown to me at that time. However, the seller went to the attorneys office and signed closing documents, leaving me with a 7-day window to close before losing the due diligence monies of {$15000.00}. On XX/XX/2021, I reached out to XXXX XXXX many times via phone, text and email but I received no response. \n\n\n\nOn Friday, XX/XX/2021 ( after our second prospective closing date ), XXXX XXXX contacted me via phone and let me know that there was a problem with finalizing loan documents. He stated that because I am a contract employee and my contract states that my end date for employment is XX/XX/2021, I would need to prove that my employment would not end at that time and that it was in fact indefinite. XXXX XXXX also sent an email following up on our conversation that further stated XXXX been instructed that even if they said its an indefinite contract, that would work. ( this email is attached for your review ) On XX/XX/2021, XXXX XXXX contacted my recruiting agencys HR department and asked if the employment is indefinite. Because this was a holiday weekend, XXXX XXXX did not receive a response until XX/XX/2021. The response was there is a situation in which her employment contract could keep getting extended but XXXX hesitant to say indefinitely as were at the mercy of the client in that regard. But is there a possibility of her remaining an employee of ours for a very long time, yes, there is that possibility. \n\n\n\nOn XX/XX/2021, I went to the Movement Mortgages XXXX, NC XXXX and asked to speak with someone in regards to my loan because I was not receiving any communication from my loan XXXX and at this point, we were on a race against the clock. There, I spoke to XXXX XXXX. XXXX informed me that we were looking to close on XX/XX/2021. However, I could not go off of XXXX words. I needed a concrete answer in writing. XXXX let me know that the underwriters were reviewing my file and I needed to wait for a response. At XXXX on XX/XX/2021, XXXX XXXX texted me and stated that he would call me shortly. I waited for his call for an hour and then I texted him and asked when he was going to call. He called me directly after that. He let me know that the response from HR was not sufficient and further clarified to me that the underwriters wanted to see the term indefinite. \n\n\n\nBecause this response was not sufficient, on XX/XX/2021, I reached out to the XXXX XXXX of the recruiting agency to clarify the issue of the stop date for employment of XX/XX/2021. He directly emailed XXXX XXXX and stating the way our system is set up we need to have a start date and end date for our contractors. The end date is an internal control that our systems require us to enter. XXXX XXXX role at XXXX is indefinite and there is a strong possibility they will bring her on their payroll. In the event that does not happen, we would place XXXX XXXX with XXXX of our other clients at the same salary if not more. If you have any questions please feel free to reach out to me. What was indicated in the letter is temporary or irregular employment, insufficient stability of income. \n\n\n\nXXXX XXXX XXXX I am very familiar with the mortgage approval process and this was the farthest from fair and ethical. I have never seen someone get pre-approve and the loan fall through after signing closing disclosure and seller signing closing documents because of something that was the exact same at the beginning of the process. Evidenced by the reason for being denied, XXXX XXXX was incompetent in preapproving me for the loan. I have learned that per FHA guidelines ( the loan that I was applying for ), if a person is a contract employee, they would need two years history doing this type of work. At the time of pre-approval, I did not have two years of immediate history of contractual employment, however, I do have over 16 continuous years in this field working salaried and contract positions. XXXX XXXX was aware of that and still pre-approved me. I relied on his pre-approval and submitted a contract with {$15000.00} due diligence. \n\n\n\nThere is no excuse to wait until a week and two days after the prospective closing, signing the initial closing disclosure, the seller signing the closing documents, home insurance documents were submitted and paid for, the attorney cleared the title, paying for the appraisal and home inspections, terminating my current lease, hiring movers, and giving away furniture, to then find out that I was denied for the loan. Additionally, the reason for the denial is XXXX that should have been addressed early on, prior to pre-approval. \n\n\nXXXX XXXX and his team lacked integrity, professionalism, knowledge, communication, dignity and morals throughout this process. I have been denied a loan for reasons that were the same when we began the process and all throughout. There was no concern and there was a clear lackadaisical attitude about my loss of due diligence monies. On XX/XX/XXXX, I got a notification that my credit had a late payment reported. I went and looked because that was very strange, as I am pretty neurotic about paying bills. I saw it belonged to TD XXXX  Card Services. I called the customer service line, as I had no way to access the account to pay - I didnt even have the account number. ( I still have not received any information, paperwork, or cards for this account, beyond my account number. ) I saw late fees had accumulated as well. I went ahead and updated my address verbally with the customer service agent at this time to make sure I got all future correspondence. The representative asked if I would like to make a payment, I let her know I would make a payment when I got paid on XX/XX/XXXX. On XX/XX/XXXX, I made a payment of {$230.00} toward the XXXX statement. On XX/XX/XXXX, I had {$980.00} in my account, which is more than enough to cover the payment. I also never got a notification to my phone from my bank that it was declined, which I receive with every declined purchase. When I looked into the declined charges with my bank, they had no record of the declined payment. I was never notified of this, and I was charged a returned check fee, despite it being a direct pull, not a check. At the end of XXXX, I noticed the declined payment. I thought it was weird for the reasons previously mentioned, but it wasnt worth the hassle, so I waited until I got paid, as XXXX was tighter financially, so I could pay it in full again. On XX/XX/XXXX, I paid {$280.00}. On XX/XX/XXXX, I had {$870.00} in my bank. I went to pay my monthly payment in XXXX, and I saw it had also been declined, according to the invoice provided by TD XXXX Card XXXX, and all of these had been reported to my credit agency. Unfortunately, I never was contacted again. The TD XXXX Card Services phone system that customers can make payments through still says it went through. I contacted TD XXXX  Card Services on XX/XX/XXXX to discuss this, as it was weird that it had happened twice. Finally, on XX/XX/XXXX, a man by the name of XXXX XXXX of XXXX, Florida, who called from XXXX and claimed to be a representative of TD XXXX Card Services. I was very sick that week, so I returned his call on XX/XX/XXXX. During our call, XXXX said he had mailed me a letter since he hadnt heard back - had I seen it? I said I hadnt yet received it. Looking back at my invoice, it is my old address that is on all my invoices, including after speaking to XXXX XXXX and giving my current address. I let XXXX XXXX know my address had been previously updated when I spoke to the last customer service representative, and he said it didnt matter because I had enrolled in virtual billing by the time I spoke with him. However, this still meant that if invoices were sent, they were sent to the wrong address. I let XXXX XXXX know that I work some nights and work a lot, so I hadnt yet been able to call him back until then. To my recollection, he did not notify me that the recording regarding the debt was being recorded, nor that it was an attempt to collect debt. XXXX XXXX said he looked into my claim that the returned check fees were correct and had concluded that it wasnt an error on TD XXXX  Card Services. He wouldnt expand any further or provide documentation. XXXX XXXX said he couldnt help me further. I verified verbally that it wasnt my bank ; he told me that it must be. He said he saw I had been called. I told him I hadnt, but asked for the phone number to verify. XXXX XXXX gave me the phone number and it had been the caller who had been calling me three times a day since XX/XX/XXXX and just stayed silent every time I answered and didnt leave a voicemail. After that phone call, I did more digging and talked to my bank and looked at statements. My bank has no history or documentation of declined payments. The XX/XX/XXXX statement reflects my payment made on XX/XX/XXXX. The XX/XX/XXXX statement was sent to me on XX/XX/XXXX at XXXX PM. There is no mention of the payment bouncing, and the statement 's new balance reflects the payment. This statement is for the billing period of XX/XX/XXXX to XX/XX/XXXX. The next statement, sent to me on XX/XX/XXXX at XXXX pm, shows a returned check fee. I was never notified of this, other than this XX/XX/XXXX statement, which was for the billing period of XX/XX/XXXX to XX/XX/XXXX. At the time of the statement, the payment was already considered late, as the payment was due XX/XX/XXXX. XXXX XXXX claimed that this counted as notification of the bounced payment, despite it being too late to fix anything at that point. I asked him what I could do to dispute further or who I could talk to that was higher than him. XXXX XXXX said I had done all I could and that there was no one higher than him. Despite XXXX XXXX claiming he spoke with my bank, XXXX XXXX, and confirmed the declined transactions, XXXX XXXX  has confirmed no one can see declined transactions past 24 days prior. This means XXXX XXXX could not have discussed confirmed the declined transactions with my bank, XXXX XXXX, like he claimed to me and in my file, as it was not possible. To review, my first claim was acknowledged as received and being worked on on XX/XX/XXXX at XXXX XXXX. 24 days prior to this date was XX/XX/XXXX. XXXX XXXX did not contact me until XX/XX/XXXX at XXXX XXXX. So even if XXXX XXXX contacted my bank that day, XX/XX/XXXX, he couldnt have discussed either the bounced amount from XX/XX/XXXX or XX/XX/XXXX. I also confirmed with XXXX XXXX  that they keep documentation of contact from credit card companies regarding clients, and they have none from TD Bank, TD XXXX  Card Services, or XXXX XXXX himself. XXXX XXXX  also verified they would need my permission to discuss my account with any outside party, which includes, but XXXX XXXX to, XXXX XXXX and TD XXXX Card Services. I would like to note that XXXX XXXX verified to me verbally that he did, in fact, discuss this with my bank. This was confirmed to be in my TD XXXX  Card Services account by a separate customer service representative. TD XXXX Card Services has also violated the Fair Debt Collection Practices Act by harassing me via phone call. They have called me XXXX times a day almost every day since XX/XX/XXXX from the number XXXX. XXXX XXXX, a TD XXXX Card Services representative, confirmed this was TD XXXX  Card Services calling. However, every time I answered, no one would speak, and when I missed the calls, they wouldnt leave a voicemail. I work some night shifts, which I did share with XXXX XXXX, and this has disrupted my sleep. This has also disrupted my work day. As of today, XX/XX/XXXX, I have been called by this number XXXX times since XX/XX/XXXX. The calls started as usually two calls per day, sometimes one, then grew to be consistently three times a day. I have received no voicemails from this number. TD XXXX Card Services has also sent invoices, per them, to the wrong address at least once, as my address was never updated on my invoices. Every invoice to date has the incorrect address on it. I have also made written requests for validation of all these charges, and they are continuing to contact me, while also not providing me with validation other than XXXX XXXX word. XXXX XXXX refused to provide documentation and just kept telling me he looked into it. On XX/XX/XXXX, I gracefully offered arbitration instead of going directly to suing, as I had already consulted with an attorney and they recommended starting with an attempt at arbitration, then pursuing further legal action if it was declined. At this point, I am willing to make a deal, which will be required to be in writing and my legal team will review before I sign it. I will pay what I owe, which is {$740.00}, in full by XX/XX/XXXX. I will also pay an additional {$100.00} out of good faith, for a total of {$840.00}. You will remove the late payments from my credit. I will forfeit ability to open an account with you again. How this will benefit you is I will not post on social media about this period I can sign a NDA if you would like. I also will not pursue legal action. You all will receive the {$740.00} I truly owe and the {$100.00} and will not have to deal with me again, nor will have to deal with a lawsuit ( possible class action ) or the reaction on social media. I will not make any more reports to any agency, including but not limited to the FTC or consumer financial protection bureau. This will benefit me as the false report to my credit will go away, I will not have to take the time off from work to pursue legal action, including but not limited to your clerical errors or violations of the Fair Debt Collection Practices Act, and the harassment will stop. However, my attempts at arbitration were avoided by TD XXXX Card Services employee, XXXX XXXX, who refused to discuss this with me and chose to call me at a time he knew I would be unavailable on XX/XX/XXXX at XXXX XXXX, then closed the case on XX/XX/XXXX, per the customer service representative I spoke to on XX/XX/XXXX, and wouldnt answer his phone. His voicemail was full as well. He waited eight days prior to closing with only one attempt at connection ( without telling me via voicemail he would do so ), knowing I wasnt available to return his call, as it was explicitly stated that it was not my best mode of communication due to my work hours, but I would call him back. I did see on my statement I could call TD XXXX Card Services to figure out a mutually beneficial agreement because this has been very stressful. XXXX XXXX would not answer his phone and his voicemail is full. I tried calling another representative, XXXX, but it was just a bunch of transferring that led no whe prior to speaking with me on XX/XX/XXXX, even though I notified XXXX XXXX that I would call him back when I could and a better way to contact me was via email due to my work schedule ( emergency medicine ) not permitting me time to do so until today, XX/XX/XXXX. XXXX had called on XX/XX/XXXX. XXXX also was called by another customer service agent I spoke to on XX/XX/XXXX named XXXX, and she was unable to reach him as well. XXXX directed me to the TD XXXX Card Services line and assured me someone there would be able to help me. I was forwarded to another Customer Care Line, where the representative continued to say XXXX looked into it and he couldnt help me further, per my record. He also said that the only way to get late payments off credit reports is to dispute the late payment at each credit bureau, and that TD XXXX Card Services is unable to remove any late payment charges. Not unwilling - unable. This was something that XXXX XXXX had also said during our first conversation. Per the law, this is untrue and was deceptive in nature. This conversation was recorded by TD Bank, as well as myself. Additionally, despite myself telling TD XXXX Card Services that I had spoken to legal aid, they made no attempt to get any information for the legal aid and continued to communicate with me. Until the XX/XX/XXXX statement, my credit limit had been {$2200.00}. In the XX/XX/XXXX statement, it appears TD XXXX  Card Services lowered my credit limit to {$620.00}, which is lower than the initial financing amount, even without the incorrect late charges and returned check fees. Unfortunately, it appears I did have the money in my account, and per the XXXX, I see I am not the only one with this issue. Regardless, I did offer arbitration prior to suing and reporting. I thought it was fair for both sides, and saves us both a lot of time and money. However, all attempts to communicate and arbitrate have been avoided by XXXX XXXX, a representative of TD XXXX Card Services. \n-- -- -- Update from XX/XX/XXXX I now have received a letter from XXXX XXXX, a \" Customer Experience Advocate '' who, like XXXX, resides in Florida, via the mail. I have attached it. However, what XXXX did was avoid my phone calls and didn't actually make true attempts to contact me. She also did not address what is in this complaint, and made false statements. I actually returned her call. On XX/XX/XXXX, XXXX called me from a blocked number, so all I saw was \" Private Number ''. I received this phone call at XXXX XXXX  that day. I will attach proof of this as well via phone logs and the voicemail recordings. I was never notified that I would be called from a private number and I was also working at that time, and realistically, not many people would answer a call from a private number. I have been very transparent with my work schedule. I returned XXXX 's call at the number she provided ( XXXX ) on XX/XX/XXXX. I called twice, once at XXXX XXXX  and again at XXXX pm, as XXXX told me she works Monday through Friday, between XXXX XXXX  to XXXX XXXX. I let XXXX know that I was off for the rest of the day, but would be working tomorrow. The voicemail lasted for one minute and detailed my work schedule, including that I work during her working hours, but would try my hardest to return her call as soon as I could. I let her know that I worked the next day, but would try to return a call that day if she called. I noted that if I didn't return her call that day, I would try her again as soon as my work schedule allows, as she is not there on weekends. I let her know she is welcome to email me as well. XXXX called me back on Friday, XX/XX/XXXX at XXXX XXXX. She asked me to call back, acknowledged receipt of my voicemail and therefore all the information about my work schedule, and told me her schedule one again as Monday through Friday, XXXX XXXX  to XXXX XXXX. However, the letter I received today, also attached, was marked XX/XX/XXXX. It is suffice to say that no real attempt was made to contact me, as XXXX was fully informed of and acknowledged my schedule and my cooperation. \n\nAdditionally, to continue what XXXX wrote in the letter - which was unhelpful and did not address the majority of what was written above, TD Bank does have documentation of my address change, as I have notified every representative of TD Bank I have spoken to since XX/XX/XXXX ( see screenshot of call log ), which, if TD Bank 's representatives ' claim is true that they were sending out statements to the wrong address. My address changed on XX/XX/XXXX ( see 60 day notice sent to leasing office that is attached ). I started my mail forwarding on XX/XX/XXXX, but continued to check my mailbox ( see document ). I also subscribe to the service USPS provides called XXXX XXXX, where you see all mail they deliver to you. Additionally, per TD Bank 's website, I should have received my card within 7-10 business days, so I should have received the card in XX/XX/XXXX. ( See screenshot of their FAQ, marked with today 's date and time. ) I also reported that I did not receive any documentation or my card to every representative of TD Bank I spoke to. I was never sent any documentation or a new card, despite TD Bank 's own FAQ saying my card should have been canceled and I should have been sent another card. \n\nXXXX also said many times how they couldn't find any documentation that I didn't receive information, my card and documents regarding the card, statements, etc. However, they have not provided any documentation that I did receive them. There are plenty of measures to document this, such as certified mail or read receipts. Who knows if they sent it, or if they did, who has all my account information. \n\nXXXX also claims that I didn't provide my full account history, my name, or account number in the screenshots I sent showing I had money in my account. Seeing as my full account history isn't relevant to those two months and an invasion of privacy by a company that has shown repeated incidences of why they can't be trusted, I will not be providing that. I will, however, provide the month 's history up until a few days after the payment was made, as it will show that had you put a hold on the funds or processed them, you would have received the money. I have also attached TD Bank 's own terms and conditions, which states how long a payment should really take. Each statement I have attached shows an additional two business days, my account information, my address, and my starting and ending balances for the month, as requested. I guess XXXX doesn't realize that I am not required to hand over personal information here - she is supposed to request the CFPB to retrieve it. Per the form I filled out for this, \" If you don't want the company ( s ) to see any personal information on an attachment, please remove or hide it before uploading. '' and \" Describe what happened, and well send your comments to the companies involved. \nInclude dates, amounts, and actions that were taken by you or the company. \nDo not include personal information, such as your name, account number, address, Social Security number, etc. We may ask for some of this information later, to help the company identify you and your account. '' I have asked for proof, yet you all have neglected to provide that. When addressed with XXXX, XXXX lied and said he had spoken personally to my bank. Evidence of this not happening is in the screenshot of the discussion with XXXX XXXX, unless XXXX is admitting he and an XXXX XXXX  employee broke privacy law and they disclosed information to each other. This and XXXX 's other forms of dishonest practice were not addressed by XXXX in her letter. \n\nXXXX also has neglected to address the fact that TD Bank violated the Fair Debt Collection Practices Act, other than saying she updated my account to a \" cease and desist '', which doesn't address prior violations. \n\nAdditionally, I had spoken to a representative of TD Bank on XX/XX/XXXX and said I needed an extension to pay the exorbitant payment due XX/XX/XXXX, which had increased in size from TD Bank 's dishonest practices. I explained I get paid on XX/XX/XXXX and had been picking up more shifts, but I had had two surgeries in the past month ( XX/XX/XXXX, and was out of work for two weeks and XX/XX/XXXX ) and was having a hard time coming up with the full amount. I asked the representative ( and this has been documented as well ) if I what I could that day and paid the rest on XX/XX/XXXX when I got paid, would I be able to get an extension on my due date. The representative said he had a better plan for me - He would do the extension to XX/XX/XXXX, if I put my debit card on file and agreed to the full amount being auto drafted on that date. I agreed and put my card on file. On XX/XX/XXXX, my card had not been drafted. I did, however, have a late charge and a note that my account had been charged off on the XX/XX/XXXX. When I called TD Bank to discuss this on XX/XX/XXXX, when I noticed the payment hadn't drafted, I was bounced around from representative to representative, and was also told the payment was still pending. I was then given a number that I was told was a TD Bank division that would help me solve this, and that they would be open the next day at XXXX XXXX. The number was XXXX, which belongs to a collection agency called XXXX XXXX. I called the next day and they were not, in fact, open the next day, and that it was a collection agency that TD Bank sells their charge offs to. I spoke with a representative on XX/XX/XXXX and they confirmed they are a separate company from TD Bank. TD Bank, despite charging off my account on XX/XX/XXXX, still took my payment from my account on XX/XX/XXXX. I have provided proof of all these with supporting documents attached. Despite it clearly being pulled from my account on XX/XX/XXXX, TD Bank also has it documented as done on XX/XX/XXXX, which is falsifying documents. XXXX also falsified information in an official complaint when he said he said he spoke with my bank. \n\nFinally, it is clear that XXXX didn't actually read my complaint, as she said \" You would like to pay what you borrowed, \" plus an additional {$100.00} if we remove any negative reporting on your credit '' - which isn't what I said. I was reporting what went on. That offer is gone, and me writing that statement was in quotations, as it was what I initially offered in order to prevent them from dealing with what is proving to be an inevitable lawsuit. \n\nAll this to say TD Bank has not addressed or proven anything in my complaint. They have refused to provide documentation of their claims, and only try to weakly refute mine.
