I told the bill collector that I had agreed to buy out the lease with the apartment complex manager via emails and he did n't care. He told me to call the apartment complex and discuss that with them in which I did via emails. The apartment manager told me there was nothing that she could do since it was at the bill collectors office. Also, I asked her to let me have my apartment back and I would catch up the late rent but she said no. I had only been out of the apartment for a month and a half. Taking to the bill collector again I told him that I could prove the agreement for buying out the lease for {$2600.00} but he refused, said the emails could be altered. He said they want over {$8000.00}. and nothing less. I asked for an itemized bill in which I received XXXX letters. XXXX letter with no itemization on it just the {$8000.00}. amount. The second letter said all collection processes were going to stop until the debt could be verified. Now, this past week the bill collector started calling again demanding {$8000.00}. When I told him the amount was wrong, not within the laws of the state of Missouri, asked him not to call my cell phone anymore, he hung up on me. Today, my mother said Hunter Warfields office called my moms home phone asking for me which I found embarrassing because I had to explain why a bill collector was calling them. They did not know what fair market value was for my phone and I would have to pay {$200.00} to cancel my contract and pay for the phone in full or to wait until the system says I can purchase the phone and then get credit for the months I had paid on the lease past the time allowed by contract that was not mine. mean while the phone was having problems with charging so I went to the company store to have it looked at. they did not do a loaner phone or back up because they said it will only be a few hours ... .They then said it was a bigger problem and sent it off to be worked on and activated my old phone. i was informed while working on the phone that they lost everything I had on the phone and needed to replace the phone with what they said would be a upgrade. they sent a XXXX XXXX that had been recalled and that will not even be allowed on a plane, it was over heating and shutting off on its own.I called about both problems and they took the payment to end the lease but did not reimburse me for the payment made as I was told would happen. I took off work and sat all day at the company store again to get it fixed. they replaced the battery and told me it would be fine ... .I walked out of store as it was closing and within 15 minutes it over heated and turned off again ... unable to miss any more work and sit all day aging I call the insurance that I had been also paying on the phone how also told me I had to go to store there is no other way. I I am in XXXX XXXX and all my signs and cards, contacts and registration was to that phone number. I called XXXX and explained I had a XXXX on my XXXX from the phone the sold me and I had to where gloves to hold it on a air conditioner to cool it on speaker phone to make to call to them. They sent me a ledger and letter on company letterhead via email saying that all of our financial obligations pertaining to the lease had been fulfilled. I sent that information over to XXXX XXXX and to the loan process at the time was XXXX XXXX, on XX/XX/2021. I started calling on XX/XX/2021 because I had not heard anything back. I was told by XXXX XXXX '' Underwriting dropped the ball, and that she had to refile and reorganize the loan and get it back over to underwriting and that she was working with her manager with her manager to expedite it '' I asked was then anything I needed to do she said no. That was the lie got every time I called for most of the week. Until I called on XX/XX/2021 and explained that we are less than a week out from closing and I needed to speak with XXXX 's manager. Her manager 's name is XXXX XXXX and he informed me on XX/XX/2021 that the issue was that the loan had been denied/cancelled because the documentation that I sent over via pertaining to the lease was not given to them, he said XXXX, told me that I explained she had not. And he stated that he was working with her to get the issue corrected. XXXX and XXXX then started trying to convince me that I needed to the loan as a primary residence. I called the main PNC Mortgage number trying to get more information on what was going on to find out that there had been at least 3 other applications that filed in my husband name that was not authorized by me or him. The problem is that their verification process includes giving them my full social security number over a mobile line. This is the only company in the last couple years that apparently have not gotten away with asking for your full social security number over the phone. When the rest of the industry has figured out how to verify identity without asking for a full social security number, I am unsure why Chase is so far behind. They state that they do this for consumer protection yet requiring the consumer to state their social security number over a cellular connection is indeed not protecting them. This was only part of the problem. \n\nIn addition I received a letter dated XX/XX/XXXX ( received XX/XX/XXXX ) that summarized the results of the end of lease inspection report. The same letter stated that payment was due on XX/XX/XXXX. I could not understand how they wanted me to pay the bill prior to receiving the inspection report dated XX/XX/XXXX and not received until XX/XX/XXXX. I assume they wanted me to make a guess at what the report would say?? Also, no bill was actually ever sent to us and no reasonable due date was ever communicated. A due date of XX/XX/XXXX, 10 days before the inspection report was mailed to us ( again, not received until XX/XX/XXXX ) is  unreasonable. \n\nI can not pretend to know what is going on with this department but I am all for paying the negligible amount they ask for if they could just figure out how to verify my identity without putting me at risk. It seems every other financial institution has figured out already. \n\nAnyway, I am more than happy to settle the debt over the phone but refuse to give my social security number over the phone which is considered personal identifiable information and a major contributor to identity theft incidents. If Chase wishes to protect the consumer then they should start by changing their verification process. The manager soon leases the property to a new tenant and I know this because I had to visit the property to retrieve a misdelivered package which was never found. After signing off with the leasing office in XXXX, I received no mail, no email, no phone call or any sort of communication at all until Last month I Received calls directly from the collection company regarding a debt of {$610.00} about wall repaint, refrigerator replacement, etc, which I had no knowledge of for over 2 years. I only have the contract from XX/XX/XXXX to XX/XX/XXXX in hand. But on the contract it clearly stated that \" Landlord may use, apply, or retain the whole or any part of this Security Deposit to the extent required for the payment of any rent, additional rent or any other sums as to which the Tenant is in default including, but not limited to, any damage beyond ordinary wear and tear to the Premises, including the common areas, or its fixtures or appliances ''. And if any fee was occurred I should have been notified immediately since my contact information and other legal documents are on record. But leasing office did not inform me on anything, and we signed off on the day we moved out with no payments no residual security deposit owed to the apartment. In addition, I called the leasing office of XXXX XXXX, they refused to talk to me since they passed this case to the collection agency already. Then I called the collection agency about my case, and I tried to communicate with the representative : XXXX ( code:XXXX ), but he was rude and treated me with little respect and an attitude that he specifically told me multiple times repeatedly to \" just pay your bills ok? He then advised me that I could go ahead and just start mailing in payments as I saw fit every week. I told him that I would not mail in money orders, because money orders tend to get stolen and it takes weeks to get it back. I then told him that I needed to make my payments online, and he said that was fine. Since XX/XX/XXXX, I have made 8 other calls to try and make payments on their sms-collects.com website, which goes through a 3rd party, with no success. It keeps telling me to verify my account number and pin number and try again. Since XX/XX/XXXX, I have been in constant contact with XXXX at XXXX XXXX and he's told me that they don't know why I am getting that error and said they checked with their clerical department who also could not tell me why I was getting that error. The last call I made to XXXX was on XX/XX/XXXX, and I left a voicemail stating my frustration and that I really needed some help on this. I told them I want to pay them. I have not received a call back since and today is XX/XX/XXXX. So, Since I have made a total of 9 calls and can't get an answer back on this, I would like to file a complaint, because it seems like they do not want to help someone who is willing to pay on their debt and if they can not even return phone calls or fix their website, then I am not willing to possibly sacrifice XXXX XXXX dollars in money orders, in the mail for it to possibly get stolen. Spruce provided an email to us and the seller with the specific steps to follow and information that we needed to provide to process the lease transfer and lien release, as we all a timeline of how long the process would take once all information was submitted, which was 8-12 days. \n\nThey also offered the ability to expedite the process for a fee of egregious amounts. To completed the process in 5-7 days, the fee is equal to 6 months of lease payments. To expedite to 1 day, the fee is equal to almost 27 months of lease payments. \n\nSpruce then proceeded to request additional payments, including a {$550.00} transfer fee and prepaid shipping labels, and to add additional undisclosed steps to the process that pushed the timeline beyond their initial estimate. For example, they stated clearly in the initial communication that the 8-12 day \" clock '' would start once all information was received, but then did not officially start the \" clock '' on their end until they processed the {$550.00} payment a full 4 days after we submitted the information. This delay is going to force us to move our closing date, which will result in excess mortgage interest charges between when our loan is funded and when we close, and additional expense incurred by us to change our moving plans. The only way to avoid this and close on time is to pay the aforementioned expedite fee. \n\nAdditionally, they are have been wholly unresponsive. We tried to contact them 2 days before closing to confirm that they had all of the information they needed, but after over 7 hours on hold they never answered. When I was able to get a hold of them the day before closing, the representative could not help, refused to transfer me to a supervisor because they claimed they could not get a hold of anyone, and only offered to have a supervisor call me back on a timeline that would be after our scheduled close, or at best before close but not nearly soon enough to close on time. After I refused and demanded to speak to someone who could resolve the issue, they hung up on me. \n\nIt is crystal clear that the whole process is designed to force consumers to pay additional fees to the company that are not actually avoidable without additional hardship on consumers. We spoke with them on the phone multiple times throughout the process and each time they make clear that they can finish in time for us to close if we pay a fee, and if not, they will not commit to any closing date. They are using their position of power in that they can delay closing to abuse consumers and extort additional, egregiously high fees from both the seller and buyer in the transaction. This is not a one off interaction, but an intentionally designed process that is unfair and abusive to consumers. This made the 'Adjusted Capitalized Cost ' for the vehicle which was leased upon at XXXX miles a year for 36 months at {$48000.00} or {$520.00} per month. The total rent charge during my lease duration was to be {$18000.00} We had leased the vehicle for 5 months which means we paid XXXX payments for a total of {$2600.00} ( XXXX x XXXX ). The buyout of the lease was then listed around {$46000.00} on the Ally website. On XX/XX/2022, I was in a not-at-fault accident where a semi-truck wheel came loose from the vehicle and hit my car and totaled it. I informed my insurance and started my claim. \n\nXXXX valued my car at {$55000.00} ( or {$54000.00} with my {$1000.00} deductible ). Ally 's total loss department then requested the exact value of the car at the time of the accident which was the {$54000.00} of which XXXX is legally required to abide. However, this means that Ally then took the overage and also netted around {$8500.00} more than the car was sold at XXXX due to our down payment. \n\nAlly conveniently took off the buyout amount for the lease once the car was totaled so that they could keep the overage. Also, in Ally 's lease they note on Section 38. ( a ) If the money we get from your insurance is more than the Unamortized Capitalized Cost ( see definition in this section ), we will not give you credit for the excess. '' Ally stole our money and requested the exact amount from XXXX that the car was told it was worth rather than using their Unamortized Capitalized Cost. They should have requested the Unamortized Capitalized Cost which can be used by using the rent charge by the remaining XXXX payments, taking out the XXXX payments already received, Which leaves {$7600.00} in unearned rent charge which when subtracted from additional payments equals {$8600.00}. That added to the residual value notes on the lease of {$38000.00} equals {$46000.00}. This means that when Ally requested and kept the overage that XXXX sent of {$54000.00} they came out with a surplus of over {$7000.00}. \n\nWe spent several hours on the phone with the Ally Total Loss Department on XX/XX/2022. They would not answer our questions. We even had a group call with XXXX and Ally where they tried to get Ally to answer our questions. They would literally go silent on the phone. We even had a response that said they got to keep the money because on the lease it says they can keep the \" market value of the car '' which is not true and not stated on the lease. And also some paperwork she sent in didnt have my name on it, ( I have proof ) so the company denied my request for help.
