I have sent TransUnion a copy of my birth certificate, social security card, proof of address, and drivers license to identify myself however TransUnion continues to send the same letter indicating that they will not correct the information due to reporting from XXXX XXXX. I then reached out to XXXX XXXX regarding the trade line they are reporting on my credit profiles. XXXX XXXX continues to indicate that they are not reporting the incorrect information that TransUnion alleges and they do not understand why TransUnion is reporting the information incorrectly. TransUnion is the only CRA reporting my social security number incorrectly. Both XXXX  and XXXX have my social security number listed correctly ( see attached ). TransUnion is out of compliance with the law. Its willful noncompliance has been a major financial hardship in my life as I have been denied lines of credit, housing, insurance, and other consumer products due to the unmatched social security number. TransUnion refuses to complete a real investigation and properly verify my personal information as required under FCRA. They have sent the same letter in response to my request for correction on two separate occasions ( first on XX/XX/XXXX and again on XX/XX/XXXX ). I have continued to call XXXX XXXX, to no avail. They were made aware of this security issue and the failure of TransUnion to maintain my security freeze and also allow for someone to use my personal information to place a loan illegally and fraudulently through identity theft.\n\nTransUnion did not maintain my security freeze. TransUnion allowed a forged DocuSign document to continue to repeatedly report a fraudulent loan on my TransUnion report despite being notified of the fraud. I contacted TransUnion on XX/XX/XXXX via certified mail about the recently negative information reported by XXXX XXXX, XXXX, XXXX XXXX, XXXX XXXX XXXX, XXXX, XXXX XXXX XXXX , XXXX XXXX XXXX , XXXX XXXX XXXX XXXX XXXX , and New Jersey Federal Bankruptcy Court- XXXX in the file TransUnion maintains under my Social Security number. Upon reviewing a copy of my credit report, I see an entry listing Reference Number XXXX states I filed a Chapter XXXX Bankruptcy in XX/XX/XXXX and the Chapter XXXX Bankruptcy was Discharged in XX/XX/XXXX. I challenged the accuracy, compliance and reportability of this listing. I requested TransUnion to please validate this information with New Jersey Federal Bankruptcy Court- XXXX and provide me with copies of any documentation associated with this account, bearing my signature. In the absence of any such documentation bearing my signature, I formally requested that this information be immediately deleted from the credit file TransUnion maintain under my Social Security number. I reminded TransUnion that they have 30 days to complete this investigation, as per the Fair Credit Reporting Act Section 611 ( a ) ( 1 ) ( A ), and I kept careful records of TransUnions actions, including TransUnions Method of Verification. I did not consent to XXXX or any means of automated verification. While TransUnion conducted their investigation, I contacted the New Jersey Federal Bankruptcy Court- XXXX via certified mail and return mail. In respond to my certified letter, the New Jersey Federal Bankruptcy- XXXX reported that they do not report or verify information with credit bureaus and credit agencies do not contact the Court to verify bankruptcy filing. In addition, I contacted XXXX XXXX XXXX, via certified mail, a third-party vendor that provide or sales public records to local, state, and federal courts to TransUnion. I requested a security freeze of the credit file they maintain under my Social Security number. XXXX XXXX XXXX placed the requested security freeze on the account bearing my Social Security number. TransUnion reported on XX/XX/XXXX that my account bearing my Social Security number was verified and information updated. Therefore, TransUnion has willing and knowingly report inaccurate, incomplete, unfair, unverifiable information on my credit file bearing my Social Security number. According to the Fair Credit Reporting Act ( FCRA ) Section 623 ( a ) ( 3 ) 623 [ 15 U.S.C. 1681s-2 ] ( a ) ( 3 ), states the duty to provide notice of dispute. If the completeness or accuracy of any information furnished by any person to any consumer reporting agency is disputed to such person by a consumer, the person may not furnish the information to any consumer reporting agency without notice that such information is disputed by the consumer. Furthermore, TransUnion has not updated my credit file bearing my Social Security number. I went to XXXX XXXX Police Department in XXXX, New Jersey to file an Identity Theft report but was denied because there was not a balance from the unauthorized inquiries, Chapter XXXX Bankruptcy, and Chapter XXXX Bankruptcy. TransUnion has violated the FCRA and I request that remove ALL unauthorized inquiries, the Chapter XXXX, and Chapter XXXX Bankruptcy as listed from the New Jersey Federal Bankruptcy- XXXX . On XX/XX/2018, Transunion closed the 2nd complaint by responding that they are unable to delete the Fraud Alert since the address on my driver 's license does not match their database. This is false. The address on my driver 's license is on my credit report/file. Transunion also responded that a social security card is not an identifying document. This contradicts Transunion 's response under CFPB Complaint #  XXXX. ( please see page 2 of Complaint # XXXX ) Transunion is not properly handling CFPB complaints and consumer disputes. In addition to this, Transunion regularly marks disputes as \" duplicates '' in order to avoid responding to them and in order to avoid addressing the issues raised in the disputes. A full description of the situation was provided in the dispute. \nDuring TransUnion 's investigation, they contacted XXXX, referenced the LAST FOUR DIGITS of the social security number instead of the COMPLETE social security number necessary to differentiate between the complainant 's account and another customer with similar SSN. Thereby, accessing incorrect customer account information. \n\nOn XX/XX/2019 the TransUnion investigation determined that the reported Chapter XXXX Bankruptcy filing listed in the complainant 's credit report was accurate and would remain on the credit report for seven years. \n\nOn XX/XX/2019 complainant contacted XXXX and spoke with Customer Service Supervisor, XXXX ( employeXXXX ID # XXXX ) from XXXX, who verified the complainant 's account using the COMPLETE social security number, notified the complainant that a separate investigation would be opened with a \" back office team '' who \" should '' report their findings directly to TransUnion and correct the incorrect credit report. XXXX stressed the importance of investigators using the COMPLETE social security number in order to access the correct customer file throughout the investigation. XXXX claimed that he was UNABLE to provide the complainant with any documentation that reflected the inaccuracy of the credit reporting and the lack of a Chapter XXXX Bankruptcy filing on the complainant 's account. Please allow 5 to 7 days for postal mail delivery. '' First, I was not attempting to make a request to receive a copy of my credit report. Second, the fact that I have an open dispute with TransUnion about information contained in my file should not block me from temporarily lifting the security freeze which is in place. TransUnion is in violation of Nevada Revised Statute NRS 598C.350 [ Temporary release of consumer report upon request of consumer ], as the only requirements to temporarily release the freeze is that I provide sufficient identification to establish my identity, the PIN provided by TransUnion pursuant to NRS 598C.300 ( a ) ( 3 ). \n\nMy next attempt by calling the TransUnion automated voice response system at XXXX to temporarily remove the freeze. Except as provided in subparagraph ( A ) ( ii ), a security freeze shall remain in place until the consumer directly requests that the security freeze be removed. It does not function to the standard set for CRAs in the law. \nTransUnion unfroze my credit in XXXX XXXX XXXX. I did not request my credit be unfrozen. That is why both XXXX and XXXX have no record of this fraudulent loan. \nI did not authorize this. That goes against the laws that oversee TransUnion. \nRemove the fraudulent items from my credit report with TransUnion. This includes the loan and inquiries by Dividend Finance. \nTransUnion was made aware of this error. Their website was not functioning at all this year, but I found ways to reach out to them including emails, contact via XXXX ( which no longer works either ), and handwriting letters to them to let them know they have this security issue and my credit had become unfrozen without my consent- allowing a fraudulent loan to be placed on ( only ) my TransUnion report by using identity theft via a forged XXXX document. \nDespite being informed of this, multiple times, TransUnion sided with the fraud. I believe to be retaliated upon due to me reporting various improper use of my credit report via my CFPB complaint number XXXX. \n\nSubsequently, I'm having this issue concerning some type of technical issue with TransUnion 's system. Your system will not allow me to access my any of my personal or credit information or allow me to Unfreeze my credit report. TransUnion states that proper authentication was not verified which has cause me major interruptions and delays in conducting critical personal business. I've made several attempts to resolve this issue over the phone with TransUnion agents, supervisors, managers, and the Tech department and no one can help fix this issue. Several issue tickets have been reported by TransUnion agents or Tech team to resolve issues I'm having with accessing my credit report, freezing/unfreezing my credit report, requesting freeze/unfreeze via online thru my TransUnion account system for weeks and no results or issues resolve on TransUnion 's part. I am also unable to request my TransUnion free credit report via XXXX due to these issues. For weeks now, no one has reach back out to me, or resolved this issue, again, after several requests. TransUnion seems to have been sued for these similar issues per the below docket number information. \n\n\nPer Docket number XXXX XX/XX/XXXX, the Bureau issued an order against TransUnion, parent company of XXXX of the XXXX nationwide consumer reporting agencies, and XXXX of its subsidiaries, Trans Union LLC, and TransUnion XXXX, XXXX ( collectively , TransUnion ), which are headquartered in XXXX, Illinois. Security freezes and locks block certain third parties, such as lenders, from accessing consumers credit reports to prevent a potential identity thief from obtaining new credit in those consumers names. Consumers can remove or lift security freezes upon request to, for example, apply for credit. Starting in XX/XX/XXXX, Federal law has required nationwide consumer reporting agencies to provide security freezes as a free service, whereas locks are a feature of certain paid products. The Bureau found that TransUnion, from as early as XXXX, failed to timely place or remove security freezes and locks on the credit reports of tens of thousands of consumers who requested them, including certain vulnerable consumers ; in some cases, those requests were left unmet for months or years. The Bureau found TransUnions failure to place or remove security freezes in a timely manner occurred as a result of problems, including systems issues, that TransUnion knew about but failed to address for years. The Bureau found that TransUnions failure to place or remove security freezes in a timely manner violated the Fair Credit Reporting Act ( FCRA ), and TransUnions failure to place or remove both security freezes and locks in a timely manner was unfair in violation of the Consumer Financial Protection Act of 2010 ( CFPA ). Further, the Bureau found that TransUnion engaged in deceptive acts and practices by falsely telling certain consumers that their requests had been successful when they had not. Again, I tried via their online terminal and automated security freeze line to place a security freeze on my credit report, I was unsuccessful after repeated attempts. Shortly thereafter, I wrote the TransUnion fraud department a letter ( see attached ), requesting a freeze be placed on my account and furnishing all the information necessary to do so. They sent a form letter and a \" security freeze request form '' in response, which I am filling out and returning today. I am still getting confirmations from XXXX in the other woman 's name at my address. I have received someone else 's credit report and social security number in the mail. Her credit report also listed her address and phone number in the file. This is third time this woman 's information has ended up in my file and it is worse this time because I am retired and cutting back on my debt while she is increasing hers. TransUnion uses social security numbers as identifiers but seems more interested in like numbers than exact numbers.
