I request that you conduct a reasonable investigation into these matters within XXXX days, as required by FCRA 1681i ( a ) ( 1 ), and delete or correct any unverifiable or inaccurate information. If you fail to complete the investigation within the statutory timeframe ( extendable to XXXX days only if additional information is provided by me ), the disputed items must be deleted under FCRA 1681i ( a ) ( 5 ).\n\nPlease note that under FCRA 1681s-2 ( b ), you must forward this dispute to the furnishers of the information ( listed below ) and require them to investigate and verify the accuracy of the reported data. If the information can not be verified as accurate, complete, and current, it must be removed from my report. I have enclosed copies of supporting documentation, including my credit report excerpts, and I am sending copies of this letter to the furnishers via certified mail. \nThe disputed items are as follows : * XXXX XXXX Services Account ( XXXX ) Reported Details : Status : Charge Off ; Balance : {$1900.00} ; Amount Past Due : {$1900.00} ; Date of XXXX Delinquency : XX/XX/XXXX ; Narrative Codes : XXXX, XXXX, XXXX, XXXX. \nGrounds for Dispute : This account is inaccurately reported as a charge-off with an outstanding past due balance. Under FCRA 1681s-2 ( a ) ( 1 ), furnishers must report accurate and complete information. The status may not reflect any post-charge-off payments or settlements, violating the requirement for up-to-date reporting. Additionally, the delinquency dates appear re-aged or inconsistent with my records, in violation of FCRA 1681c ( a ), which prohibits reporting delinquencies older than XXXX years from the original date. Narrative code XXXX ( XXXX days past due ) conflicts with the charge-off status if the account was closed without resolution. Code XXXX indicates \" XXXX XXXX deferred, '' yet it is reported as past due, violating FCRA 1681s-2 ( a ) ( 1 ) for inaccurate reporting. Codes XXXX and XXXX suggest prior disputes resolved by the furnisher, but the current delinquency does not reflect this resolution, breaching FCRA 1681s-2 ( a ) ( 3 ) for failure to note resolved disputes. Code XXXX marks it as \" previously in disputenow resolved, '' making the ongoing past due status incomplete and unverifiable. Deferment code XXXX invalidates the delinquency reporting under FCRA 1681s-2 ( a ) ( 1 ). Unresolved dispute indicators ( XXXX, XXXX, XXXX ) require update or deletion per FCRA 1681s-2 ( a ) ( 3 ). Regardless of having Equifax not doing what they are to enforce was a big obstacle on then to cooperate but I was able to somehow the account in dispute have it remove with the excision on one collection medical account that is refusing to remove the account from been reported to my file.
Knowing the situation that one is not mine and two I was fair to ask them to produce the evidence that they believe belong to me four chances and they did get back with any..
Equifax in the meantime responded that the collection account is in fact they are reporting is accurate, really! That is to say something is wrong with how this all play and what is been done are two separate reality.
I then summited documents of been a victim of identity theft by mail twice, they claim never received.
That is when I then summited a complaint and also summited for the 3 time the documents relate to identity theft.
I reported a complaint with the consumer protection agency Bureau. I am glad I have because you will find all this on my account with you is all there so they can not deny not having any record of it.
On or about XX/XX/XXXX I receive a letter from Equifax disregarding any knowledge of Identity theft the only mention this We have received you request concerning your annual free credit report from Equifax and are looking forward to assisting you.
However, the information you provided as proof of your identity does not match your information currently on file. Therefore, to protect your credit information, we must ask for some additional information in order to verify your identification and address.
I then immediately gave then a call the representative says that I need it to resubmit my id and copy of social security card From this point forward they have denied assistance to me with my credit file because they can not verify who I am On or around XX/XX/XXXX send to Equifax I then again for the 3 time summited proof of identity I provided to them by fax the following : XXXX State Id issue from DMV Copy of my Social Security Card issue from the Social Security Administration On XX/XX/XXXX When I call they say that they can not help me because the information send to them does not match their record. I was not told what records they are referring they will refuse to help me or give any advice because I can not proof my identity.
This is crazy I have giving then the only proof with correct identification On XX/XX/XXXX I pull one credit report online on an account I have with Equifax To my surprise this is what change on my credit profile was 1. My name was change adding an middle initial that I dont have 2. There were added some other names used about 4 names that Is not me never have use such name 3. My employment history was gone delete 4. My address history was gone 5. New address were listed that I never live on those address reported 6. There was 11 derogatory charged off account added to my credit file 7. Another collection account 8. 3 third buyers account 9. They have added or was reported another Social security number no mine In summary my identity was overnight change with new name new address middle name added a new social security number, I only have one. I am getting calls from does creditor demanding money all day long this have cause lot of damage to my poor health already in jeopardy I call then and ask who and why that has been added to my record I then see something is wrong please investigate.
They denied saying that it was correct how can it be? Yesterday or the day before was not there and today is there? Something does not match up They are reporting incorrect information all of it.
Is clear to see what has happen and they cant figure this out, they did it, because I have called the creditor which by the way I have an account with then in good standing if I have account not paid would I be having any account with that company no! So this is what I have found out whoever that person is they have use my name with another social security an open credit card account And I am definitely they have used my identity is clear but now their information have been merge with mine.
And because of that I am not longer who I am base on Equifax this is XXXXup.
What did they forget that I have reported identity theft and what I got was get kick out of my credit file.XXXXup So I have call and call they refuse to see what I have investigate saying that the only way they may not help if I provided to then my identity So a then again send it by fax this time I have added more identification for the to see they are mistaken. Receipt from the United States Postal Service ( USPS ) as Evidence The receipt from USPS or any other evidence from a government entity, such as the USPS, could be used as evidence in disputes related to debt payments, communications, or deliveries related to account holders. These receipts can serve as documentation proving that a debt holder fulfilled their responsibilities by sending payments or communications, which may serve as evidence to defend against a claim or provide documentation in the context of financial disputes.\n\n2. Duties and Responsibilities of the Consumer Financial Protection Bureau ( CFPB ) The Consumer Financial Protection Bureau ( CFPB ) has a critical role in enforcing consumer protection laws, including those related to debt collection and credit reporting. The CFPB ensures that : Debt collectors comply with the Fair Debt Collection Practices Act ( FDCPA ).\n\nCredit reporting agencies follow guidelines for the accuracy of credit reports under the Fair Credit Reporting Act ( FCRA ).\n\nThe Consumer Financial Protection Act of 2010 enables the CFPB to regulate entities that handle consumer credit and debt-related services to protect consumers from unfair practices. \n\nThe CFPB provides enforcement and oversight to ensure that debt holders, consumers, and reporting agencies comply with regulations that ensure transparency, fairness, and the proper removal or correction of inaccurate or outdated information on credit reports. \n\n3. Action for Debt Holders with Evidence A debt holder who has evidence of fulfilling their responsibilities ( such as payment receipts or evidence of communication from USPS ) can take the following actions : Dispute the debt : Submit a formal dispute to the creditor, debt collector, or credit reporting agency ( CRA ) under FCRA Section 611. The CRA must then investigate within 30 days.\n\nProvide documentation : Provide evidence ( USPS receipt, proof of payment, etc. ) supporting the debt holder 's claim to the creditor, or the CRA during the dispute process.\n\nSubmit complaints : If the dispute is unresolved, a complaint can be submitted to the CFPB. The Bureau will intervene and help mediate between the consumer and the creditor or debt collector.\n\n4. Protection for Account Holders Consumers have specific protections under FCRA and FDCPA, which prevent unfair or inaccurate reporting and collection practices. The following are the protections available to account holders : Fair Debt Collection Practices Act ( FDCPA ) : Prevents debt collectors from engaging in abusive, unfair, or deceptive practices, including harassment and misrepresentation. \n\nFair Credit Reporting Act ( FCRA ) : Provides the right to dispute inaccurate information on credit reports. The law mandates that creditors or debt collectors must correct or delete erroneous data from credit reports.\n\nActions to protect the account holder : Dispute inaccurate debt information through the credit reporting agencies, or directly with the creditor or debt collector.\n\nFile a formal complaint with the CFPB if the issue remains unresolved.\n\n5. Probable Cause for Removal of Debt from Credit Reports A debt can be removed from an account holder 's credit report under the following conditions : Inaccuracy : Under FCRA Section 611, a consumer can dispute inaccuracies, and the CRA is obligated to investigate and correct any errors. If the debt holder provides evidence that the debt is incorrect, it should be removed. \n\nObsolescence : Under FCRA Section 605, negative information like missed payments, defaults, or charged-off debts must be removed after seven years, and bankruptcies after ten years.\n\nDebt Validation : Under FDCPA Section 809, a consumer can request verification of the debt. If the debt collector can not validate the debt, the account should be removed from the credit report.\n\nFraudulent Charges : If the debt was incurred due to identity theft or fraud, the consumer can request the removal of the debt from their credit report.\n\n6. Responsibilities of Credit Reporting Agencies Credit reporting agencies ( CRAs ) are required to : Maintain accurate and up-to-date information : As outlined in FCRA Section 607, CRAs must ensure that the information they report is accurate and fair.\n\nInvestigate disputes : Under FCRA Section 611, CRAs must investigate any disputes related to the accuracy of credit report information within 30 days. If an item is found to be incorrect, the CRA must delete or correct it. \n\nProvide the consumer with information : Upon the resolution of a dispute, CRAs must notify the consumer of the result and provide them with a free copy of the updated credit report. \n\n7. Provisions and Actions from the CFPB The CFPB enforces consumer rights in this context by ensuring compliance with FCRA, FDCPA, and other relevant laws. If a consumer experiences problems with debt collection or inaccurate credit reporting, they can : File a complaint with the CFPB, which will then investigate the issue and take corrective action as needed.\n\nWork with debt collectors and credit reporting agencies to mediate disputes and ensure compliance with consumer protection laws.\n\nThe CFPB can enforce penalties or corrective actions, including fines or penalties against non-compliant entities.\n\n8. Corrective Actions for the Debt Holder To rectify the situation and ensure that the debt is removed from their credit report, the debt holder should : Request validation of the debt and provide any necessary proof that the debt is either settled, inaccurate, or fraudulent.\n\nDispute the debt directly with the credit reporting agency or debt collector, providing evidence of payment or other documentation. \n\nFile a complaint with the CFPB if the issue is not resolved after disputes with the creditor or CRA.\n\nSeek legal counsel if necessary, especially if the debt has resulted in significant negative impacts on their credit report or financial situation.\n\nRelevant Sections of Law ( Consumer Financial Protection Bureau Website ) Fair Debt Collection Practices Act ( FDCPA ) : 15 U.S.C. 1692 Fair Credit Reporting Act ( FCRA ) : 15 U.S.C. 1681 Consumer Financial Protection Act of 2010 : Public Law 111-203 You can access these regulations directly on the CFPB website or through the official U.S. government website for legal code.\n\nFor more in-depth information on each of these regulations, visit : CFPB Laws and Regulations : CFPB official site 1.
