At that time, I did give the credit companies access to all my personal information. I provided proof that my Social Security number belongs to me, but none of the credit agencies changed their misrepresentation in my credit report. XXXX claimed that the change could not be made because the information was a part of my credit history. It certainly was NOT a part of my credit history. My Social Security number has never belonged to anyone but me. The credit agencies would not change their fraudulent verification data in their computer system. The large number of credit agency information breaches justifies the Social Security Agency refusal to provide consumer data ( SSNs ) to credit agencies. \n\nThe questionnaire was a distraction. If I trust them again with all my private information, they do nothing to repair their fraudulent credit report. This was proven in XXXX. \n\nCRAs do not collect information from consumers, but rather collect it from businesses, including credit card companies, banks, employers, landlords, and others. When an individual applies for credit, the lender will pull their credit report from XXXX or one of the other CRAs to see if they have a history of repaying their debts. \n\nWhen consumers make a dispute, they often fail to get an adequate answer, or any answer at all, from the credit reporting company. \n\nSince XXXX, I found other irregularities. I was unable to open credit union accounts or get credit. For example, XXXX would have allowed me to put money into an account, but not to take money out ). My current landlord forces me to XXXX for a rent voucher to take with CASH to a distant cash-transfer location XXXX XXXX XXXX XXXX XXXX XXXX. They refuse to accept a check from a debit account, or to take cash to the rental company office in person. XXXX XXXX recently ( XX/XX/XXXX ) refused to open a XXXX XXXX deposit account for me because XXXX failed to verify me, claiming a Social Security number conflict. To some companies, XXXX reported that I had zero credit. \nTo avoid further fraudulent reporting, I cancelled all my credit cards. I never had a problem with my credit history before. I never wanted to deal with fraudulent credit card companies again. \n\nXXXX should have reported that I froze my credit reporting due to the companies misrepresenting my credit history. \n\nI do not accept XXXX response as constructive. XXXX could NOT FIND ANY history regarding ANY account for me UNTIL WE FURNISHED IT TO THEM during a dispute call. During that conference call, Experians Dispute Center employee had to provide XXXX with an account number ( XXXX ) since XXXX could NOT find one in their system. XXXX now uses that account number ( the one provided by Experian ). Note : this is verified by notes in the Experian Dispute Center. \n\nB. XXXX could NOT find ANY OTHER account number in their system ( related to me ). \n\nC. During the conference call including Experians Dispute Center, XXXX asked me for personal data including my name, address, my Social Security Number, current phone number, and specifically asked if I had lived at various addresses. XXXX XXXX  could NOT FIND ANY RECORD of me in their system. \n\nDuring that conference call, when XXXX admitted they could not find any record of me in their system, Experian Dispute Center asked XXXX if they would authorize removal of the information since it could not be verified. XXXX stated they, \" could NOT remove any data unless they first found the account and verified that it was a mistake '' ( seriously ). \n\nD. XXXX now has my personal data in their file since we furnished my personal data to them while they were trying to locate the file ( See Item C ). \n\nE. I have NEVER LIVED at the following address Frontier is questioning XXXX XXXX XXXX XXXX XXXX XXXX XXXX  TX ( The XXXX XXXX XXXX XXXX verified this was NOT a residential address. ) F. I have NEVER done any business with XXXX XXXX. \n\nG. There is NO mention of XXXX XXXX on my XXXX or XXXX credit reports. \n\nH. This situation has been disputed three ( 3 ) times through Experian but NO changes have resulted. The Experian credit report continues to be incorrect by including the XXXX XXXX information ( see image below ). \n\nI. Due to a lifestyle change, since XXXX 2003, I have  had NO utility costs ( including landline telephone, electric, water, sewage ) and NO cellphone costs. \n\nH. Despite there being many other ways to verify identity, they are refusing to return funds to users who never agreed to using biometric data.\n\nThe details : I have had an account with Robinhood since XXXX. In that time, I have only ever linked a single bank account to the account, from which funds were transferred into Robinhood to invest, and occasionally transferred back to when funds were withdrawn. \n\n6 Months ago, on XX/XX/XXXX, I transferred {$1700.00} from my Robinhood account into my bank account without issue. It was to my surprise, on XX/XX/XXXX, that I attempted to initiate a transfer of {$400.00} from my Robinhood account to the same bank account I've been connected to for over 6 years, and I was met with a prompt to \" verify my identity ''. Initially, the prompt asked that I upload a picture of the front and back of my government issued ID, so I took a picture of the front and back of my driver 's license and submitted it. After doing so, I was met with a prompt to scan my face for biometric data. This was a deal-breaker for me. \n\nI have never in my life consented to giving any company I've done business with any of my biometric data, and I have never consented to giving Robinhood my biometric facial data at any point during my business with them. I contacted customer support to find out how to withdraw the amount without providing this data, as there are plenty of other ways to verify my identity. To my surprise, they refused to assist me, and claimed that I would have to submit \" selfies '' ( the app asks for pictures from multiple angles ) to verify my identity to withdraw funds. As a software engineer with extensive knowledge in data collection and, I knew there was no logic to this ask. Robinhood is not in possession of my facial biometric data, and therefore they have no means to use that data to confirm my identity, because they have nothing to compare it against. This was a bald-faced attempt at invasive, unjustified, and unwarranted data collection.\n\nAfter an extended back-and-forth, the support person, \" Deep '', claimed that their customer agreement grants them the authority to withhold my funds from me until I submit facial biometric data. The section of their user agreement they claimed granted them this authority ( section 6, paragraph 2 ) reads : \" What this means for you : When you open or apply to open an Account, Robinhood will ask for your name, U.S. residential address, date of birth, social security number, telephone number, citizenship, and other identifying information that will allow Robinhood to identify you. Robinhood may also ask for copies of your drivers license, passport, other unexpired, government-issued identifying documents with a photograph, or other identifying documents. From time to time, Robinhood may ask you to confirm or reverify your identity, or may require that you provide certain additional documents, as necessary. '' When I responded that the paragraph they pointed to did not, in fact, grant them the authority to withhold my funds unless I give them access to my facial biometric data, I explained that what that paragraph granted access to was : - My name - My US Residential address - My social security number - Telephone number - Citizenship - Other identifying information that will allow Robinhood to identify me- Copies of my driver 's license - Passport - Other expired, government-issued identifying documents with a photograph - Other identifying documents.\n\nI explained that I was glad to re-verify my identity using any combination of the above listed articles, but that according to that agreement, no user has agreed to provide Robinhood access to their biometric data. I also questioned why Robinhood insisted on collecting a 3D scan of my face to withdraw funds when : - I was attempting to transfer funds to the only bank account that has ever been connected to my Robinhood account.\n\n- I was willing to provide my SSN, images of my driver 's license, verified transaction history, phone number, email, or any other identifying information available to prove my identity.\n\n- I was able to withdraw over 4 times the amount I was attempting to withdraw 6 months ago.\n\n- I never agreed to allowing them to use my facial biometric data to withdraw funds.\n\nThe support person again refused, and this time pointed to paragraph 6, section 3 as the justification, which reads : \" You understand that Robinhood may take steps to verify the accuracy of the information you provide to Robinhood relating to your Account in your application or otherwise. You authorize Robinhood or its agents or third-party vendors to contact any person or firm noted therein or in any other information you may provide to Robinhood from time to time, or any other normal sources of debit or credit information and other similar databases, and authorize any such person or entity to furnish such information about you as may be requested or required by Robinhood. You acknowledge that Robinhood may restrict your access to your Account pending such verification. You will provide prompt notification to Robinhood of any changes in the information including your name, address, e- mail address, and telephone number ''.\n\nI then explained that nowhere in that paragraph does the subject of biometric data come up, nor could Robinhood could not possibly use my facial biometric data to verify my identity, as it currently does not possess that information and therefore has nothing to compare newly collected data against, but again was refused and told that I would be required to provide 3D scans of my face to withdraw funds.\n\nRobinhood is now holding my funds hostage and refuses to return my money to me unless I provide them with 3D scans of my face, which I never agreed to, and never will. The alert directed me to email Experian if this was not me who made this change. I sent emails to the provided address at XXXX, XXXX, and XXXX and only received an automated response saying \" Thank you for contacting Experian! We got your email and aim to respond within XXXX business days from your initial request ... '' I then tried calling them a total of XXXX times over XXXX hours and was never let out of the IVR to talk to a human. All this time I knew that my account was being hacked as I was not the one who changed my email address. Since I work in the financial service/credit card industry I knew right away this was an account takeover attempt as I had previously had my credit card information stolen XXXX earlier this year from various breaches at other companies. I tried numerous times to reach Experian on any number I could find on their website including XXXX, XXXX, XXXX, XXXX XXXX  XXXX I tried calling Experian on XX/XX/XXXX : - XXXX ( XXXX seconds spent in IVR trying to connect to person ) - XXXX ( XXXX min ) I tried calling back again on XX/XX/XXXX during normal business hours : - XXXX ( XXXX min ) - XXXX ( XXXX min ) - XXXX ( XXXX sec ) - XXXX ( XXXX min ) - XXXX ( XXXX min ) - XXXX ( XXXX min ) - XXXX ( XXXX min ) - XXXX ( XXXX min ) I then proceeded to reach out to them on XXXX and XXXX at XXXX and heard back from an Customer Service Representative at Experian who setup a call with me at XXXX that lasted for XXXX minutes. During that call the Experian Employee confirmed to me that my account was taken over and proceeded to lock my account so that I, nor the hacker, could log in and view my reports. This was done XXXX hours after the account was taken over so really did not do much. The Experian Employee told me that per Experian policy they not authorized to disclose the hackers email address that was set and instead opened up an internal case ( # available upon request ) at Experian to review. After receiving this information that my account was in fact hacked and taken over, I filed a police report with the with my local police Department, ( report # available on request ). I had also opened an initial CFPB complain ( report # available on request ) as well as a follow up complaint ( report # available on request ) a few days later with more details on the incident after not hearing back from Experian. At XXXX on XX/XX/XXXX I received a call from another member of Experian Customer Service who provided me additional information. The Experian Employee on the phone confirmed to me that the hacker changed my email address, then changed my password via a password reset to that email address. The Experian Employee said that the hacker then changed my security question and pin. The Hacker changed the security question of \" favorite teacher '' to \" yo-yo '' and PIN to \" XXXX '' The Experian Employee told me that this is not the first time that the Experian Employee has seen those answers to other accounts that were taken over. The Experian Employee also shared with me the email address that the hacker changed the account to ( available upon request ). The Experian Employee was able to help me regain control of my account. Once I had control I was able to see that the hacker pulled a copy of my credit report which gave them access to the following : date of birth, last XXXX address history, employer, middle initial, my credit scores for all XXXX bureaus, first XXXX digits of every credit account and loan that I have had in my life, payment history on every credit account and loan that I have had in my life, current balance/open date, status of every credit and loan, past inquiries from companies. I could tell this was the case as Experian 's interface saves all past reports you generate, and the timestamp that was generated for this one was XX/XX/XXXX at the exact time when my account was taken over by the hacker and I lost possession. Given all of this information that was taken I immediately placed fraud alerts on all of my Credit Bureau accounts that remain in place. I also filed a report with the various law enforcement and state agencies for identify theft and hacking. I was also forced to add on an expensive {$25.00} a month Experian Credit Protection package to perform dark web scans, and give me the ability to lock my report, and a private phone line to contact so that if my account was taken over again I would have better alerts and controls in place instead of getting an email and having to wait XXXX  days for a response. Overall I just can not believe that this happened. Experian dropped the ball massively in protecting my very sensitive data in allowing an email change to take place at XXXX at night, followed by changes to password, security question, security pin, address, and my report being drawn. All of this without any KYC checks being done, or any two-factor authentication taking place and zero notification back to the contact info that I set up on the account to verify all this strange behavior ... which is even more appalling knowing that Experian sells two-factor authentication products on the market yet fails to protect our most sensitive information with it unless you pay {$25.00} a month. I told them no so they said they were going to send me a text to the phone on file to verify my identity and stop this transaction. They sent me a text and I gave them the security code that was sent to me. This is a text I have seen from Wellsfargo before to identify my Identity. I will attach picture of how it came in through the same text log that wellsfargo has sent me before so i honestly thought this was Wellsfargo. I logged in to my wellsfargo app and noted there was a wire transfer for {$13000.00}. I immediately asked them about it and they said there were sending me another text to stop online banking so they this fraud transactions would stop. They sent me text and I read the code back to them then they told me I had to press certain numbers on my phone so that they could activate the alerts on my phone. I had to dial XXXX. Then I noticed there was another wire transfer for {$9100.00}. At this point I got very nervous and I did let them know I was not comfortable with the situation that I suspected something didn't seem right and they said there were cancelling my card associated with these transactions and that they would give me a tracking number for me to stay on the phone. I hung up an called wellsfargo myself. When I hung up i got text messages supposedly from WellsFargo asking them to call back at XXXX that fraud representative was trying to reach me. Once I called WellsFargo myself I asked if they had called me and they asked me what number was i called from and I gave them the number and i will attach a photo of the caller ID where the call came from and phone number the Wellsfargo rep even stated yes that is our number. But then she looked in my account and told me they had not called and that there were not red flags she could see or fraud stops, then this Rep also sent me a text to to my phone that came under the same text history as the hacker had just done, this text was so that I would allow her to make changes in my account. Wellsfargo now shut down my accounts and online activity and filed a real claim. So I personally nor physically did not send money to anyone. However this money was transferred out of my account. So for the purpose of the report I will say that money was sent/paid out but it was not done on purpose by me. Also 2 days later I realized my phone was not ringing since I got off the phone with the scammer. I spoke to a XXXX associate and they asked what I had pressed with the scammer and they told me my phone calls had most likely been forwarded to the number I pressed. They helped me to unforward my phone calls. The bank is telling me they won't help me unless law enforcement investigates. That card was the only way I could replace what I needed to work. I called their support line twice, passed every security check, and then was told they couldnt discuss my account because I was not verified. After asking I asked them a simple question : Did you Citibank ever request a verification or not? They wouldnt answer. Instead, they told me someone would follow up. That never happened. The second call was the same more silence and excuses. I know they don't want to get Best Buy deeper cause they know that they didn't ask for verification Ive since filed reports with the Consumer Financial Protection Bureau and the police. A laptop I previously purchased which now wont power on no longer appears in my account history. I can not return or exchange it, despite paying for warranty coverage and XXXX membership. Thats not just customer negligence its digital theft. I've been trying to get a refund and exchange so I can continue my work and literally I'm I'm still on hold and no one can help me about picking about being able to pick up my product I paid for and exchanging gimbals and a refund for my laptop hindering me from doing my work. \n\nThe emotional and psychological toll of this situation is very real. I already avoid places like this because of how often Im profiled. I try to stay calm, do the right thing, and avoid drama. But this time, I was targeted, lied to, humiliated, denied service, blocked from my purchases, and stripped of the protections I paid for all because of how I look. Filing of FTC Identity Theft Report & Statement of Identity Theft Before addressing AHFCs response, I want to reiterate the most important fact : I filed an FTC Identity Theft Report because this debt is NOT mine. \n\nThis report officially documents that someone has used my information without my knowledge, consent, or authorization. By law, the FTC Identity Theft Report triggers certain protections, including : The right to block fraudulent reporting The right to require furnishers to cease reporting unverifiable accounts The obligation for furnishers to perform enhanced fraud investigations The right to request all business records associated with the fraudulent account The requirement that the furnisher NOT continue reporting unless they can PROVE the account is legitimate Despite this, AHFC continued reporting and did not conduct any meaningful identity verification.\n\nUnder FACTA ( Fair and Accurate Credit Transactions Act ), when a consumer submits an identity theft report, the furnisher must either provide verified evidence of account ownership or delete/block the account. \n\nAHFC did neither. \n\nXXXX. AHFCs Validation Does NOT Establish That I Opened the Account AHFC claims they mailed a debt validation package on XX/XX/XXXX. The documents included were : a credit application a lease agreement a payment history a debt validation letter However, none of these documents provide ANY of the following : Identity verification logs Proof that I personally applied for credit Proof that I physically signed the contract IP address logs ( for digital signatures, if any ) Drivers license scan authenticating the customer Dealership surveillance or identity confirmation Voice recordings from dealership staff Audit trail confirming application origin Proof that the signature is mine Proof that the Social Security number was verified Any third-party identity-checking records Without these items, AHFC has not validated anything. \n\nValidation requires proof of identity, not merely internal copies of documents. \n\nXXXX. The Credit Application Does Not Prove I Submitted It AHFCs credit application which they rely on as evidence does not contain : Any authenticated signature from me Any handwriting I recognize as mine Any verifiable origin of the application Any evidence tying me physically or digitally to the dealership Any video, audio, or digital footprint linking ME to the application Identity thieves commonly submit falsified or stolen credit applications. \nAn application containing my name does not prove I completed it. \n\nAdditionally, the application includes data fields that do not match my actual historical employment, address patterns, or legitimate financial behavior. This is consistent with identity theft. \n\nAHFC can not rely on an application that has no authentication chain, no origin verification, and no signature validation. \n\nTherefore, the application does NOT constitute legal proof of debt ownership. \n\nXXXX. The Lease Agreement Is Not My Agreement, Not My Signature, and Not Authorized by Me AHFC attached a Closed End Motor Vehicle Lease dated XX/XX/XXXX, which they claim I entered into. That document includes : A signature that is NOT mine Initials that I did NOT write Terms I never agreed to A vehicle I never drove, leased, or saw A payment schedule that does not match any account I have ever held A fraudulent lease agreement is NOT binding on a victim of identity theft. \n\nA valid contract requires : A meeting of the minds Clear consent Knowledge of terms Intent to enter the agreement A verified signature None of these are present. \n\nA signature alone especially XXXX that I dispute is not legally binding. \n\nUnder federal law, when I dispute a signature, the burden shifts to the furnisher to prove : The signature is authentic Identity was verified at origination The dealership followed proper Red Flag Rules AHFC did not provide anything that meets this burden. \n\nXXXX. Payment History Does Not Prove Account Ownership AHFCs payment history only shows that : Someone made payments Insurance paid funds after a total loss A remaining balance exists None of this proves I made payments. \nPayment activity is NOT proof of identity. \n\nFraud victims frequently discover accounts with partial payment history showing : Thieves using stolen identities Dealerships entering fraudulent deals Fraudulent insurance claims Stolen or misappropriated vehicles AHFCs provided payment ledger only proves that the account exists NOT that I am responsible for it. \n\nXXXX. AHFC Did NOT Provide Any Identity Verification Evidence To validate this account under identity theft laws, AHFC must produce : Drivers license scan Application IP logs In-store security footage Identity verification records Dealer-submitted Red Flag compliance forms Identity authentication data AHFC provided none of these. \n\nInstead, they responded with internal documents that could easily belong to an identity thief. \n\nThis is not proper validation under FDCPA, FCRA, FACTA, or FTC Identity Theft regulations. \n\nXXXX. AHFC Assigned the Account to Collections Despite It Being Identity Theft AHFC admits in their letter that they already : Declared the account deficient Assigned it to XXXX XXXX for collection Instructed me to contact the collection agency Sending a debt to collections AFTER an FTC Identity Theft Report is illegal. \n\nOnce identity theft is declared, AHFC must : Freeze collection Stop reporting Conduct a fraud investigation Block the account if no proof exists AHFC did none of this. \n\nXXXX. AHFCs Response Does Not Resolve the Issue and Is Not an Explanation Their response states : This dispute will be processed according to our internal dispute handling policies. \n\nInternal policies do NOT override federal law. \nInternal policies do NOT prove anything. \nInternal policies do NOT validate a debt. \nInternal policies do NOT resolve an identity theft claim. \n\nA valid response requires documentation not general statements. \n\nThe case is NOT resolved. \n\nXXXX. What a Fair Resolution Requires Given the facts, the only fair and lawful resolution is as follows : Immediate deletion of the AHFC account from all credit bureaus Permanent cessation of collection activity Written confirmation that the account has been removed Acknowledgment and acceptance of the FTC Identity Theft Report Notification to XXXX XXXX that the account is fraudulent Removal of all negative marks associated with the fraudulent account Compliance with identity theft blocking requirements under FCRA 605B AHFC can not simply attach internal documents and call that validation. \nThey must provide proof of identity, which they did not. \n\nXXXX. I have disputed many inaccuracies with XXXX and regardless of the dispute and documentation provided to prove my claim, XXXX has not proven to have adopted reasonable procedures for meeting the needs of commerce for consumer credit, personnel, insurance, and other information in a manner which is fair and equitable to the consumer, with regard to the confidentiality, accuracy, relevancy, and proper utilization of such information. \n15 U.S. Code 1681- Congressional findings and statement of purpose ( a ) Accuracy and fairness of credit reporting The Congress makes the following findings : ( 1 ) The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. \n( 2 ) An elaborate mechanism has been developed for investigating and evaluating the credit worthiness, credit standing, credit capacity, character, and general reputation of consumers. \n( 3 ) Consumer reporting agencies have assumed a vital role in assembling and evaluating consumer credit and other information on consumers. \n( 4 ) There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. \n\n( b ) Reasonable procedures It is the purpose of this subchapter to require that consumer reporting agencies adopt reasonable procedures for meeting the needs of commerce for consumer credit, personnel, insurance, and other information in a manner which is fair and equitable to the consumer, with regard to the confidentiality, accuracy, relevancy, and proper utilization of such information in accordance with the requirements of this subchapter. \n\nIn the US Code copied above Congress is very clear in noting that the procedures used by any and all credit reporting agencies are the be fair and equitable to the CONSUMER, me, XXXX XXXX, who they are making the report about. There is nothing fair about constantly battling corporations over incorrect, inaccurate unverified data. The use of these elaborate mechanism have failed me gravely and I will explain that in detail below. Congress is also very clear that these corporations and financial institutions are to respect the CONSUMERS right to PRIVACY first and foremost, more than anything. XXXX has violated my right to privacy, credit worthiness, credit standing, credit capacity, my character and credit reputation with continued negligence. \n\nI would first like to address the inaccuracies for three Dept of Ed/Aidvantage accounts reporting on my consumer report furnished by XXXX. All three of these accounts are reporting an account number or XXXX followed by a series of XXXX 's for the remaining account numbers. This was the end of a promotion so I paid off the remaining total XXXX before the due date on XXXX XXXX Best Buy wrote down. I only paid XXXX My bank account reflected that the XXXX left my account on XXXX XXXX. At that time, my Best Buy account statement did not reflect my payment for XXXX  As a matter of fact, they increased my interest rate that months by falsely stating they did not receive my payment to pay off the last month of a promotion. At that time  it was disputed that they were paid. Best Buy citibank credit card services said they would fix the discrepancy. Instead they applied my payment for XXXX to the following month XXXX and kept the high interest rate penalty for not making the end of promotion payment in XXXX. By adding it to XXXX, theyre admitting that I made the payment on time and that the only reason I got charged eith high interest rate is because they falsified my payment History. This is reflected in the statement on XX/XX/XXXXThe exact payment for XXXX is reflected on the XXXX account statement. It is obvious that we called in to fix it immediately after the discrepancy was identified. I could not identify a discrepancy until I received the account statement. \n\nUpon realizing that I was still paying on some thing that should have been paid off a long time ago. I called Best Buy again to figure out why it had not been paid off. XXXX a month for a bill that should be completely paid for by now and after calculating it out, they owe me money. When calling in to resolve the matter, I was informed that they cannot see the records that far back so I had Best Buy snail mail me my records and this is how I discovered that Best Buy never fixed their discrepancy from XX/XX/XXXX which you can see by the XX/XX/XXXXstatement that they were contacted and informed to correct my payment history.  It was their system or their personnel that did not apply the payment correctly. It left my bank on time. I disputed it at that time which is why its reflected on the very next months account statement. After receiving the records, I called Best Buy to make a dispute, but due to them sending me the monthly statements records out of order, I could not quite figure out exactly what was wrong, so I had to call back and make a second dispute after I put the months in chronological order. I was told at that time by the employee which was a male that it would be resolved. I called back in at that time to find out if it was resolved, and I was informed by a female employee that the only way that you can make a dispute is by sending my dispute via mail to My Best Buy Credit Card Services, XXXX XXXX XXXX XXXX XXXX XXXX XXXX. This completely contradicted with a male employee said. I was informed there was no way to email Best Buy and this was the only way to contact them to resolve a dispute they consider to be out of their current date range and accessible on their computers. This is a lie because when I called back 11 business days ago another employee pulled up the records right there on the phone with me after I told them I had already sent in a dispute letter and they hadnt responded pass. The time frame that they said they were going to respond. I mailed them the screenshots from my bank account as requested along with correlating copies of the Best Buy account statements onXX/XX/XXXXI was informed that in 30-90 days I would have a response from Best Buy. I received no response from Best Buy. I called back in and Best Buy claimed they never received the letter at all. On XX/XX/XXXX I spoke to Employee ID Z19058 and was informed that the matter would be resolved in 7 to 10 business days. I called back on the 11th business day today, the XXXX XXXX XXXX, and was informed by XXXX an account verification specialist, that they could only fix the payment for that promotion month in XX/XX/XXXX unless I had disputed it before or on the same month according to the fine print. I did disputed it at that time and Best Buy assured me at that time that it would be resolved and I believed them. \nI made the payment for XX/XX/XXXXon time and then I had to wait for the account statement to find out they claimed they received no end of promotion payment.  IlThere is no way for me to know if Best Buy is going to act like the money didnt show up in their bank account until i recieve their account statement! I had to call them and tell them Oh yes you did get that money and then they were like you are right we did only for them to pay it to the wrong month! Im not talking to kindergartners learning math who  dont know how to read, write, and add Im talking a full grown adults which makes me think they know what theyre doing and its fraud and they are con artists. Unless maybe I was talking to children and they are participating in breaking child labor laws.\n I have spoken to multiple Best Buy employees at this point, and none of them have informed me until now that they could never resolve it and the only thing that they could do was give me XXXX. I have probably paid well over XXXX due to the incorrect high interest penalty for XX/XX/XXXX andXX/XX/XXXX. I didnt do anything wrong as a customer and it is their employees and their company that falsely documented my payment history. And, now they claim they never received the certified mail with proof of that. XXXX  actually tried to tell me to send it again and wait another 30 to 90 days while simultaneously telling me that the only way I couldve gotten it resolved is if I had done it in a certain amount of time. They cant read They cant write. They cant do math. They dont report things in a timely manner and when you contact them, they never respond. They have no brick and mortar building and every time you call you get a different customer service representative. I have spent hours upon hours upon hours trying to resolve this with Best Buy and I have been lied to and misled and punished for their incompetence and gross negligence. Icing in the cake, today, I have now been told there is nothing I can do about it. Its fraudulent, I have paid my bill off and they are trying to keep me in eternal debt to them by falsifying my payment history and then furthermore disregarding all evidence, giving me no way to contact them except for mail in the 21st century, and then, claiming they didnt even receive the mail, but the United States, postal service certified. They did deliver it to their XXXX XXXX which is the only way I can deliver any documentation that I paid them on time. They refuse to accept email because it will be dated and they cannot deny they received it which is why I sent it certified mail.  No matter what I did Best Buy was determined to steal from me, regardless of anything I did as a customer and that is the definition of a confidence scheme or trick to deceive Someone out of their hard earned money. I cant dispute what Best Buy did until the next month when I receive an updated account statement. Regardless of that, I paid on time and anything else they say after that is to trick me out of my money. XXXX  stated that I had to make a dispute the month before or on the same month. I DID dispute it at that time. I made my payment ON TIME and when the dispute was made THEY AGREED at that time and there is no reason a customer should suffer for a companys GROSS NEGLIGENCE or INCOMPETENCE. The only reason I need to make a dispute it because they screwed up! And then, would you look at that, its so common practice for them to screw over their customers that they made a rule for it! Knowing full well theyre tactic is to claim the customer didnt pay and then subsequently never fix it when the customer reports it. They take your money thaf they know they already have and then apply it to the wrong payment period. Because they specifically made a rule for end of promotion payments that prevents customers from paying it off. I paid it off on XX/XX/XXXX and I have been paying for it all the way into XX/XX/XXXX because they refuse to admit I paid it off in XX/XX/XXXX. Its fraud and because Ive been taking so much money they know they XX/XX/XXXX probably well over XX/XX/XXXX \nPenal Code section 487 defines grand theft in California. In California, grand theft consists of stealing money, labor, real property, or personal property with a value exceeding XX/XX/XXXX. Every payment I make Im not supposed to be making because of their fraud increases their penalty. The pictures I attached are of the day I went into the UPS store and painstakingly wrote up what happened and then attached screenshots of my bank account and copies of the account statements for the months I received high interest for payments that were paid on time.  XX/XX/XXXX and XX/XX/XXXX Automatic payments dont work with Best Buy because somehow theyre automatic system randomly acts like you never paid anything or you paid less than what you actually did. Which means they are falsifying their customers payment history on purpose. Each page is numbered. I have a witness at theXX/XX/XXXX who helped me send the letter. I gave the information for my bank over the phone to Best Buy and Best Buy told me I had to send a letter with screenshots to prove that I made those payments. They refused to contact my bank directly. Best Buy claims they received no letter. Again, They can call my bank themselves if they want and get the wire transfer numbers and dates for when I made my payments, but they do not. this was all included in the letter. They put the burden of proof on me and I submitted the burden of proof to them and they claim the US Postal Service never sent it to them. The pictures prove I sent the letter. It proves I went to XXXX The pictures inside that letter prove I made my payments on time. It also proves Best Buy falsified my my payment history and that they intentionally applied the payment to the wrong month so that they could charge me illegally for high interest. I shouldnt have to be writing this, I used Best Buy auto payments, my bank reflects the payment was paid on time, the pictures show I paid and sent certified mail. Proof  I have done everything I can possibly do to resolve this matter, and I have spent gobs of time trying to do just that and the fact that I am typing this out right now goes to show why no one should ever do business with Best Buy or Citibank. I am flabbergasted that the governments solution for accountability of a company falsely changing their customers payment history, considering they pay taxes to the IRS, is that I write this letter for it to be sent to themwhich I already did. I sent it to their Best Buy credit card XXXX XXXX  address in XXXX XXXX Missouri and what I am writing now is nowhere near as comprehensive. The reason they dont call my Bank themselves is because they know they lied about my payment history. They have nothing to gain from proving that a customer paid the payment. They make their money by claiming their customers dont make their payments on time and create irroneous rules to prevent their customers from getting their money back. None of their rules matter all that should matter is that the customer paid on time and they need to apply the payment to when it was paid. I have never seen a company take a payment and apply it to the wrong month. Never! It doesnt matter what company it is if they claim they didnt receive the payment. All Ive ever had to do is provide proof that I did make the payment and then they add the payment to the correct month because that was the month that had the discrepancy. It is a logical for me to make two payments on the next month and never have the payment I made for the correct month ever be applied to it. They are falsifying my payment history and then stonewalling me when I ask them to stop lying and pay it to the correct month and remove the penalty for high interest for missing that month payment. I never missed XXXX XXXX months payment I paid on time. It was their responsibility to document My payment. They had no problems proving I had made the payment when they were confronted about it. There is no reason for them to apply it to the wrong month except that is how they illegally charge their customers high interest for a missed payment, even though they made the payment on time. When I disputed this, there is no reason the high interest should not have been removed and the payment applied to the correct months unless they are making money off of fraud victims. XXXX informed me today that this illegal fraudulent business practice is so common that they made a rule for it. A rule to intentionally trick and con customers that DO PAY ON TIME out of their money. Best Buy intentionally miss led me by telling me that if I paid my bills on time I would not be hit with high interest. What they did not tell me is that they would falsify my payment history. I did not sign a contract agreeing to them falsifying my payment history. I did not sign a contract agreeing to them denying me any right to redress or to protect myself from their fraud. Five major rights of consumers: safety, information, choice, voice, and redress. Best Buy misled me as a customer. I have done everything right and I still cant get my money back from Best Buy. They withheld information from me. They lied to me. They have given me no way to redress them for my own safety. They have victimized me and probably countless others via false advertising. I paid on time. I have no control over what Best Buy does with my payment after I pay. And I should not be made to be penalized for what they do after I pay them because I do not run Best Buy and I am not responsible for Best Buy. I am the customer and I did my part as the customer. The bank did their part in the US Postal Service did their part. And so far all I can get from Best Buy is we lost it. we didnt receive it. You never did it. We gave you an incredibly small window to address us after we finally told you about it and because of this were gonna keep taking your money. We know you didnt do anything wrong but we operate illegally through fraud and thats how we steal everybodys money. I didnt walk into a casino. I walked into Best Buy. The casino tells you youre gonna lose your money and the casino customer knows the risks. I walked into a department store and I bought some products with a Best Buy debit card from Citibank. I made my payments on time. I did nothing illegal. I did not lie. I made my payments on time. I was told if I made my payments on time I could get a XXXX XXXXnterest or a low interest loan. This is what Best Buy advertised. It is false advertising if customers make the payments they dont accept the payments and still charge you high interest. I made the payment. The bank says I made the payment on time. But somehow Best Buy can lie and write down on mud Best Buy account statement that for some reason they just didnt receive that payment for well over XXXX. Who wants to do business with a company that loses a payment for over XXXX? They did not accept my payment for XXXX XXXX and falsely claimed I didnt make a payment at all. That is not what I agreed to when I signed up for Best Buy business card I did not agree to business fraud. I agreed that if I missed a payment, then they could charge me high interest. I did not agree to be charged high interest for false reasons or false claims that they were a legal practicing business. Do they also falsely claim how much money they make to the IRS? If theyre lying to their customers and theyre lying about what other businesses are doing like the US Postal Service and my bank then theyre probably lying to the IRS because as a tax paying citizen, I know theyre stealing my money.  I know theyre not above changing their accounting books to benefit them while screwing everybody else over. Financial Fraud is listed among unlawful business practices.\n\n There are all kinds of unlawful business practices and win a customer like me paid extra money, pays on time, calls, and makes the dispute, and follows every single guideline a company offers, and they still cant receive their money back well it makes you wonder how many unlawful business practices does Best Buy and Citibank have and how are they allowed to be operating because as a loyal customer for well over eight years what they are doing to me right now makes no sense because the company that wants to keep their customers doesnt treat their customers like this unless it was always there intention to learn a customer in on false advertising, misrepresent the contract, falsify financial records of payment from their customers, and raise the interest so high that customers become life long slaves to their companies by forcing their customers into debt by illegal methods. I pay XXXX  a month for products I have already paid for and Im about to sell because they are that old. Im no longer gonna have the products I bought from Best Buy and theyre still going to try to charge me for them unless I give them even more money. Its Debt bondage, also known as debt slavery, bonded labour, or peonage, is the pledge of a person's services as security for the repayment for a debt or other obligation. Where the terms of the repayment are not clearly or reasonably stated, the person who holds the debt has thus some control over the laborer, whose freedom depends on the undefined debt repayment.[1] The services required to repay the debt may be undefined, and the services' duration may be undefined, thus allowing the person supposedly owed the debt to demand services indefinitely.[2] Debt bondage can be passed on from generation to generation. I was told if I made my payments on time I could pay off my debt. I was not told that they would falsify my payments to where I could never pay off my debt. These are unlawful and unfair business practices when a person like me cant pay them off because they change the rules and my payment history to keep me from ever paying them off. Its illegal. Its fraud. Its mondern day debt bondage. On top of that they have hit my credit report making these false claims negating me the opportunity to have a better credit rating, stopping me from having access to opportunities. I should be afforded for having a good credit rating which I would have if they would stop committing fraud. I needed to buy a better car and I cant afford the car I want because I have Best Buy falsifying my payment history and ruining my credit. They are ruining my life for no reason. Ive done everything right and because I did business with a Best Buy they have ruined my credit, my life opportunities, and quite frankly stated today theres nothing I can do about it because they cant confirm or deny that charging customers who paid on time, insanely high interest, for not paying is FRAUD! I served my country and I am suffering tyranny from a freaking department store in a credit card company!!!!! They wont let me go free unless I give them even more money for the falsified interest they put on my bill. I would have to actually pay the insanely high interest off all at once in order to get out from under them. I didnt do anything wrong and I dont deserve this. Fun fact, they can falsify my payment history again and keep charging me high interest until the day I die because theres no accountability for them. I would have to get a lawyer. Thats even more money. I should not have to spend my hard earned money  I earned from serving my freaking country and putting my life on the line to pay off a god dang appliance from a department store!!!!!! Every hour I spend on this is them stealing another hour of my life. They should not be able to operate in the US. They should lose their business license. The fact that they falsify their customers payment history should be enough to close down their businesses. We have modern technology and computers dont lie. They just compute. If the bank said, I paid then it should be reflected in Best Buys bank. And if its not, the only thing I should have to do with the customer is show them I paid, and they wont even let me do that. They wont let me send in the records. They wont admit they received the mail. But, theyll take my money I paid in XXXX and apply it to the XXXXXXXX They change the rules to benefit them and screw over the customer. Theyre trying to keep their business practices in the stone ages by forcing people to mail. It is obvious everything they are doing is to avoid accountability from their customers for illegal business practices. This is America, the land of the free. I have a lot of other things going on in my life besides Best Buys in ability to do their own job. They take my payments every month, but they managed to lose my payment on the month when they know they can get an obscene amount of interest if I dont pay. I feel violated, frustrated, and a whole list of other negative emotions, because of the gaslighting I have received from Best Buy credit card services. You pay they claim you didnt pay. You sending mail they claim you did not send in mail. You want to provide proof they will not let you provide proof. Denial is their favorite word so they can get that plausible deniability. They can claim all day they didnt know. But they do know and the bank knows as does the US Postal Service and I know.  I do not have this problem with any of the other companies that I deal with on a daily basis. I am tired, and I have just spent hours trying to write this in a way to where it would convey how unbelievably ridiculously stupid my situation is with Best Buy credit services. I gave up time. I only had {$62.00} in my checking account ; how much \" at risk '' could I be, if I granted this, and then changed my password the next day, right? \n\nWell, it turns out that any customer can dispute any payment made, or even any withdrawal made, from their checking account, even by the droves, and even 15 transactions all at once over a couple of days, regardless of how negative that takes the account balance to, assuming all of the disputed transactions were found to have instead have been legitimate ; which was the case here. \n\nNow, I realize that a bank 's requirements for proof of identity can be phonied up ; all a scammer would need is access to your various components of identification ; which this scam company required as well ; a copy of my debit card, my Driver 's license, my Social Security number. I have historically given this kind of information out many times during the last 50 years of my adult lifetime, when applying for loans ; so in effect, it is not the bank 's fault, if I was stupid enough to give out these tenets of my identity along with my username and password, even temporarily. However, especially because of this, in this day and age, with all of the identity theft and scams going on, a large bank such as Chase, should have consumer protections in place that automatically trigger personal contact with the account holder, whenever there is any unusual or suspect transactions taking place of any magnitude ; certainly when multiple disputes are lodged basically all at once, from the supposed customer ; they should reach out, to make sure it is the actual customer making these disputes, as opposed to some imposter. \n\nChase could have emailed me to verify whether it was me disputing these payments that had been called back into my account pending an investigation. They could have had a limit of 1 disputed  transaction per week, perhaps ; unless the customer otherwise met personally with a bank officer that knows the customer ; they could have listed in the memo next to the amount in my transactions list, \" Customer payment taken back, '' or forfeited or rescinded ; ( \" Adjustment reversal '' is just too vague of a term ) -They also could have called me on the phone to ask me if I really think that multiple payments, like I had been making every month to these credit card companies all year, were suddenly to be disputed? ; the fact is, they did nothing to interrupt, or even question this scam payment-reversal process, or do anything that might raise any suspicion on my part. \n\nThe upshot is that the aggregate of these payments reversed from my credit card companies raised my credit card balances by {$4100.00} ; and then the scammers even disputed that it was me taking this money out at the ATM to send to them ; that added another {$800.00} of temporary increase in my checking account balance ; which I unknowingly assumed was the lender 's money being put into my account, that I needed to send back to them, as part of their loan validation process. By the way, Chase took that {$800.00} out of my {$1300.00} Social Security deposit last month, the day it hit ( XX/XX/XXXX ). \n\nI just can't understand how, when I can't spend even one more dollar than my credit limit on these credit cards, and I can not withdraw one penny more than what is in my checking account ; yet with these reversals, the credit card companies allowed money to flow out from them which took my balance owed, way over the credit limits on these cards ( Don't you think the credit card companies should not be allowed to reverse any part of the customer 's payments they had received, that would make this credit card holder 's balance to go beyond the credit limit in their account?! I certainly do! ) -But not being contacted in any way by either Chase Bank or the credit card companies, to check on these numerous disputes suddenly being made all at once ; and yet for multiple payments I had made even 3 months earlier ; and I also think the only part of the full memo I saw next to these drawbacks of my payments, was the word Adjustment, or maybe Adjustment Rev ; but even Adjustment Reversal doesn't unquestionably send the message, like for example : Cust Paymnt Returned, or Cust Credit Card Bal . Raised, or CC Payment Refunded might even be better. \n-But when you add all of these factors up, boy, is this the opposite of consumer protection! \n\nAt this point, I am most interested in seeing that this can not happen to anyone else. It seems absolutely imperative that this standard operational procedure, regarding disputed transactions, must change violently and immediately! I sent proof of a triple payment paid to old national on time, and that was paid prior to these two other payments listed on their own website. I have no problem complying though I just thought that they had lost the payments or there was some issue on their part. Proof of the triple payment credited in XX/XX/XXXX2023, another XX/XX/XXXX23 payment, a XX/XX/XXXX23 payment and then the two payments Old National has listed as cleared on their website under my payment history that totals seven payments in 2 months. listed on their website that's seven payments in 2 months. I'm ahead and payments even without the proof but the payment I'm just trying to send proof of payment for. Old National honestly has a problem with their phone, I am hearing tons of static. I have switched phones but I can not hear the agent whatsoever. I have calmly tried to explain this to XXXX who just continues talking over me and keeps accusing me or being a liar. I assure you as a loan originator and a prominent business person in society of sound mind and age I'm not playing games especially one of my payments are ahead and I'm assisting with a servicer error. XXXX attempts everything she can fighting me instead of trying to work this out. I have sent proof of payment six times, I even hired a forensic accountant, and my bank has sent legal documentation twice. All documents rejected for new excuses every time frivolous excuses, I cut off the corner of the statement so XXXX considered a partial statement, the second time my proof was denied was because I had put notations on which payment was Old Nationals  and XXXX considered it altered, another time I didn't provide that back page that is provided for doing your balancing the time it's blank another rejection, and then this final time I sent proof of payment including copy of Old Nationals  website where they stated my payments were processed for the months they were asking for, falsifying they had never ever received any payments in 9 months completely untrue I emailed the entire statement carefully, with nothing missing, nothing written on the proof and again it was rejected because the agents stated they will not allow a statement as proof of payment. \nThe bank vice president and to tell her including myself have begged for Old National to inform what they are requiring and how we can send it to them. For some reason the refusing to answer me they go quiet or ignore me I've asked for this information in writing and they refuse. At the bank on speaker it was the artist conversation ever XXXX just ignored us hey just kept stuttering or saying nothing when we ask questions and then we received his manager who was extremely rude where we're trying to assist for the servicing error and provide them documents they've already been provided several times but they just continued not to answer questions refusing to tell us where to send it how to send it and what they wanted. I've been into the bank twice the first time my banker, XXXX was on the phone we were having a very difficult time of hearing her or she was just ignoring us we couldn't figure out it was very odd, my banker informed XXXX there was fraud on my account and a problem with verifying payments and it could take up to 30 days. The vice president of the bank was dumbfounded and confused because they never ever been requested what Old National was requesting and informed me the only thing I have to provide them or legal proof of payment is a bank statement if they think that I'm altering it she would send it directly to them but we could not get an answer on where to send it to. The banker kept trying to explain to XXXX what the issues were but there was no talking to XXXX she just kept talking over them or never ever answered any questions the banker got up and walked out of the room she was so aggravated with the situation. They sent to another banker because she threw her hands up and left the room at that time there was no getting anywhere with XXXX did as the maker told me and told her just hang up talk to her later. XXXX did date some things that she wanted, but they were so odd the banker had me put the phone on hold and asked me if this lady had issues that this was absurd this is from a banker that I'm suing. XXXX had stated something in these regards payments written down on letterhead from each bank, with tracking numbers or tracers or some kind of registration number even the banker didn't know what she was was referring to and stated we can't do some huge internal investigations on payments, that's why we have statements we don't have time for this nonsense. I was then informed that it would not be providing any letterheads unless I wanted to talk to corporate or the fraud department see if they would do an investigation but that wasn't going to happen overnight and basically she got it it would happen at all it was a waste of the banks energy and time. The second time it was her partner XXXX from Old National I was with XXXX  Vice President we repeatedly kept asking which payments or how do you want these proof of payments to XXXX who just sat there and wouldn't respond. The XXXX VP again asked for proof in writing to be sent to the bank so that this could be cleared up and done and over with. XXXX and then his manager who we ask for because we couldn't receive any information whatsoever from XXXX, promised me I would receive an email either by the end of the day or the next morning. An email please note I was told over and over again and still being told that this Bank never ever does any kind of business over an email. That was another one of the excuses of why I couldn't send payment they don't use emails. Request never came. In fact the very first time I sent payment proof and the second third time this Bank never said this isn't good enough we hate it you have to resend it it has a fingerprint on it whatever no notification whatsoever and they refuse to answer my phone calls I just kept calling leaving messages I felt like it was intentional like time would run out so they could steal my car I honestly feel like I'm in the middle of some kind of scam. It's so weird and unbelievable and they are so against a customer who's been a great customer who they were loaning money to approximately 4 months ago for another car but I changed my mind because I had such an excellent history with them now treat it like dirt honestly treat it like dirt they won't even accept an email like they always have for a question or even proof of payment to save my vehicle while my parent is XXXX and my sister as well. XXXX told me to go ahead and email the statements, the manager told me to go ahead and send them the statements. I was given an email the same one I had used several times for this Bank and always received a response until now when I'm told they don't use emails whatsoever and that no Bank business is going to be done that way. I took hours away from my family for they needed me the most and spent a great deal of time once again providing the information requested so that the service or can service my account properly finally. Once again proof is rejected and they're going to come steal my car. I'm told no statements and they don't allow conversations by email, it's just another excuse. I tried calling and speaking with XXXX who's back from vacation but I can't even hear her and she refuses to try a different phone even though I've tried three different ones. At the bank we can barely understand her because of some kind of humming noise as well on the Bank 's phone. So currently I don't know what to send how I'm allowed to send it what is considered proof of payment that's different from the rest of the world and what's considered proof of payment by State regulators and the Attorney General who informed me a statement is a legal document and there is no reason it should be refused I would have to contact an attorney but most definitely something didn't seem right here and I needed to report this Bank. XXXX talks down to me screams at me calls me names and refuses to answer any questions she's a bully I'm uncomfortable speaking with her and she gives me great stress I'm threatened repeatedly that they're going to come take my car even though I'm ahead in payments. Old National has been listing my social security number legally on documents as reference numbers I have been toward a great deal of fraud because of it and they refuse to stop this is why I'm having problems with my bank currently they don't care they just keep distributing my social security number illegally. What contract did they provide you when you verified these companies had my written consent to share my personal information with you? Provide it as evidence. 5. Was this account authorized by my credit card? 6. Did they provide anything other than alleged transactions and experiences as mentioned in 15 USC 1681a ( 2 ) ( A ) ( i )? Do you have any contract with me or written consent from me where I give you permission to furnish this account? Do you have any documentation/evidence on file of you notifying the consumer that this negative information was being reported to you before you added it to the report? Provide the negative information notice pursuant to 15 USC 1681s-2 ( 7 ) ( A ) ( i ). Pursuant to 15 USC 1681 ( b ) -You must follow reasonable procedures and must be fair and EQUITABLE to the consumer. Taking a persons word without proper evidence is NOT fair nor is it equitable to the consumer when this causes harm to the consumer. I found out this fact by going onto XXXX and typing in www.equifaxdatabreachsettlement.com and typing in my last name and the last XXXX digits of my social security number and submitting that information and received the following response : Thank You Based on the information you provided, our records indicate that your personal information was impacted by this incident. For more information, visit the FAQ page. But it further stated that : The deadline to file an Extended Claims Period claim passed on XX/XX/XXXX. I have also been notified that my personal information is currently on the dark web and have printed out said claims as evidence of said breach. They aren't helping me with my accounts if they can not pick and choose how to verify my account or over verify my account. \n\nSince my passcode was added I am the only one who has stuck to my word. \nSince I do not like to give my social or last 4 of the SSI # over the phone to be repeated by an agent/supervisor the passcode is in place and also should not be repeated. \n\nMy passcode has been repeated MULTIPLE TIMES, COMPLAINTS IGNORED. \nI have filed so many complaints it raises concerns about the company as a whole. \nThey have dropped so many issues I have raised concern about that I am sure it is discrimination in that area as well as to why I am being ignored an my money can not be secured. \n\nIt doesn't matter if NFCU agrees to the last statement or disagree since I am still going through the exact same things as I did years ago. \n\nNO CONSISTENCY, THEREFORE MY ACCOUNT IS RARELY SECURED. \nWith any Financial Institution accounts need to be secured. \nNOT SOMETIMES! I had never worked with the Mortgage Dept and only hoped that I would have a better chance getting the help I need as a FIRST TIME HOME BUYER by using my own credit union. \n\nI couldn't have been more wrong!!! \n\nOn XX/XX/XXXX, I was transferred to XXXX who I asked to not run my credit unless he can provide what I am looking for. \nI asked if he can do A LAND AND HOME PACKAGE. \nHe needed me to explain so I said, I found a commercial lot selling Newly Built Manufactured homes and I will find an agent eventually to help with finding the land to put it on. \nHe said, YES WE DO LAND AND HOME PACKAGES and I can help you with the agent who can find the land for you. \n\nSO HE COMPLETELY UNDERSTOOD WHAT I SAID AND MY REQUEST. \n\nSo he referred me to a company that will help with finding agents. \n\nXXXX had me lift my security freeze and he ran my credit. \nAfter that I was emailed XXXX things to upload. \nOne was a PURCHASE AGREEMENT. \n\nHow will I have that if, I am still waiting for the loan amount I qualify for? \nSo that could not be answered and they knew that. \nI paid {$41.00} for a credit check fee. And answered the 3rd question. \n\nI was not given an option to just upload all of my documents. \nI could only answer their questions. \n\nOn XX/XX/XXXX, I had to call NFCU since my Loan Officer XXXX XXXX never called me. He emailed me, and didn't respond to my question. \nWhen I called NFCU, my loan office was emailed and her name was XXXX XXXX so I guess XXXX is out. \n\nXXXX called me back and I asked her, I said XXXX stated you do land and home packages and I need confirmation and she said no we don't. \nHer next question was please explain what you are trying to do. \n\nI said, I want to purchase an ALREADY BUILT BRAND NEW Manufactured home and put it on private land that an agent is now helping me find. \nXXXX then said, \" Oh, yes! We do land and home packages ''. I said great! \n\nShe said you just need to upload the documents so your application can be processed. \nI told her that only XXXX questions were sent. \n\nDid completed taxes Credit Check balance that needs to be paid and Purchase Agreement. \n\nShe said ignore the Purchase agreement since we send that too soon. \n\nShe said, look out of the rest of the documents and after that call she sent my application to underwriting without allowing me to receive the request for the other documents. \nSo nothing else was able to be uploaded. \n\nI did not call on my BDAY so I called on XX/XX/XXXX and I was transferred to XXXX the manager at my request. \nHe shared that they both were wrong! \n\nXXXX and XXXX since NFCU doesn't do LAND AND HOME Packages. \nTherefore my application was processed by XXXX in the Mortgage Dept under False Pretenses. That he may benefit from and I had to pay for that credit check. \n\nXXXX also said, XXXX new better as well and could have tried to fix the problem and only added to it by sending my application to underwriting too soon. \n\nAnd your application has been denied, said. \nI told him I want my money back and my complaints filed against XXXX and XXXX. \nOn that day maybe 6 hours later, NFCU sent me an email requesting for documents. \n\nI did not upload anything since I was told my application was denied. \n\nNot sure if he did anything but on XX/XX/XXXX, I called back and asked for a manager again and this time I spoke to XXXX was a manager and then to XXXX who was over XXXX. That was FTC. \n\nDuring the call with XXXX, since she also stated, \" you need to get credit and keep it in good standing for 2 years. \nI stated, I do have credit in good standing for over two years. \n\nIt with a SARCASTIC TONE she said, \" I am looking at your credit ''. \nI said, then you missed everything. \n\nI have had a Checking Line of Credit with NFCU since XXXX NEVER LATE. \nThat alone is over two years of good credit history. \nI told her that I have XXXX XXXX XXXX accounts and one since XXXX paid in full and never late. The other is XXXX paid in full never late. \n\nSince she spoke to me in such a nasty tone, I shared that I also have a XXXX XXXX XXXX  and my credit card has been open and paid in full since XXXX. \nI said, so what are you talking about? \n\nShe ignored that, and went straight to another part of my credit file. \nShe said you have XXXX COLLECTIONS on your file. \n\nFor lenders to not be interested in XXXX XXXX stated XXXX collections and one was Medical. \nI said, if it's true that you do not look at medical then the truth is YOU ONLY SEE ONE COLLECTION. \nAt that collection is XXXX XXXX XXXX XXXX. I paid the bill and they changed it to CO with {$2300.00}. Since I paid that balance. They corrected the issue by stating Charge Off with a {$0.00} Balance. \n\nI know more about my credit than XXXX ever wood and I am insulted by her nastiness. \n\nRegardless, why NFCU decided to deny my application or credit. \nTHESE PROBLEMS WILL NOT BE IGNORED. \n\nFrom the missed verification, over verification and RARE PROPER VERIFICATION. \nNFCU needs a reminder that when accounts are not verified, at any time it's an issue. \nIf they can pick and choose how to verify or when to verify my account that issue will be reported. It takes 3 seconds to ask for my passcode. \nJust 3 seconds. They much rather argue about why they do not have to ask than to verify my account with passcode. \n\nThey also rather I put in a CFPB complaint. \n\nSince XXXX wrongdoing as well as XXXX 's NFCU HAS DECIDED TO RETALIATE AS IF ANY OF THIS WAS MY FAULT. \n\nI decided to report everything in this one complaint since NFCU is good at brushing things THEY DO under the rug and still think they can RETALIATE and I not report that too. \n\nNow when I call NFCU, not only was it rare that I received help, Now I am sent to Management, Fraud, Resolutions or Escalations they automatically respond so no agents as if any of this were my doing. \nXXXX only wants the last 4 of my social and DOB that lots of people can answer. \n\nSo from Mgmt to agents they are aware of Identity Theft so each time they ask for something that others can answer, ignoring my passcode. It says they can careless who accesses my account. I am still not giving that information. \n\nI am going to call from a Verified Line like I have always done, I will give them my name and Passcode if they ask. I am not giving them anything else besides my business name and the passcode there as well. \n\nI called again on Saturday the XXXX of XXXX since I am still getting emails from NFCU requesting for me to upload documents on a denied account. \nI need the HARASSMENT TO STOP AS WELL. \n\nThe lady in resolutions answered and didn't verify my account since she only wanted my name. The lady that XXXX had call me which is XXXX in the executive dept. \nWhen she called she said, I don't usually ask for the passcode but since your complaints are mainly on it not being asked, I will ask. \n\nTHAT DOES NOT HELP MY ACCOUNT REMAIN SECURED AT ALL. \nSo I wanted to make sure I mention her too. \n\nXXXX later emailed me about why she doesn't have to refund my credit check fee. \nShe said that first just so she can get around saying, they will not pull out the money. \n\nI asked for my denial letter. \nAfter I received it, I sent her an email speaking in everything that she tried not to discuss and I am attaching it to my CFBP complaint. \n\nAnd although I missed this part in my letter. \n\nOn XX/XX/XXXX since the agents were at it again and said, that my passcode matched the other accounts, I spoke to supervisor and asked why my information can not be private. She couldn't explain that. \n\nThese XXXX different account numbers can have what ever passcode I choose if appropriate. I DO NOT NEED AN AGENT OR SUPERVISOR STATING ON THE CALL THAT THEY MATCH. And that being the reason the business account wasn't verified with passcode. \n\nIf I choose to have the same passcode THAT IS MY BUSINESS. \nIf I were someone scamming, they wouldn't know that the business accounts have the same passcode so asking for my passcode protects my account and funds. \n\nSince she shared they are all the same, I decided to change that and report that my information could have been stolen at the hands of the agents. \n\nSoon after I was back on the phone with a supervisor changing my passcodes. \nThere was an issue with the call. \n\nI explained everything and that I do not want my personal information shared AT ALL. \nI was verified on the personal side and she did not ask for my passcode. \nI gave it to her. This is to quickly change my other XXXX passcodes since I have XXXX business accounts. \n\nI was sent an email to verify XXXX XXXX and then changed the passcode. \nShe did not repeat it. \n\nAnd then on XXXX XXXX business account she wanted me to give her the current passcode and once I gave her the new passcode she repeated it out loud and started spelling it. Trying to stop her from doing that, THE SUPERVISOR STARTED YELLING AT ME ON THAT CALL SO IT TURNED INTO A SHOUTING MATCH. \n\n\nI don't need to go on, I would like my complaint ( s ) FILED. \n\nAs for the credit check refund. \nI was emailed by the executive dept that I will get that back and the only reason it was approved was due to the Fraudulent transaction with XXXX in the Mortgage dept. \n\nFOR THE RECORD I NOTICED ANOTHER HOSPITAL WAS ADDED TO MY CREDIT ON XX/XX/XXXX. Affidavit of Truth / Proof of Claim Non-Negotiable : An Affidavit of Truth / Proof of Claim Non-Negotiable was sent to XXXX on or about XX/XX/XXXX requesting validation of debt within a specified time frame ( 10 days ) via GAAP ledger actual accounting and verification of their claim against me via a sworn affidavit or hand signed invoice in accordance with the Bill of Exchange Act ( 1882 ) ; Uniform Commercial Codes, Federal Fair Credit Reporting Act and New Jersey Statutes for lawful purposes ; a true and certified copy ( NOT photocopy ) of the Original Note / Credit Agreement and other discoverable items which XXXX  has defaulted upon as of this date. Violation of Federal Rules of Evidence [ FRE ] Rule 1002, which mandates the production of the document to prove its contents.\n\n8. Violation of the Uniform Commercial Code U.C.C 8-102 which defines a certificated security and establishes that ownership or entitlement requires possession of the original document or proper assignment.\n\n9. CFPB Lawsuit Against Experian : I recently became aware of the CFPB 's lawsuit against Experian regarding their failure to properly investigate credit report errors and reinserting inaccurate information. This highlights a systemic issue in the credit reporting industry, where consumers are being harmed by inaccuracies and non-compliance with federal law. \nXXXX. XXXX XXXX XXXX : I also recently became aware of the fact that my personal information was part of Equifaxs data breach, but because of my late awareness of the fact I was not a part of the settlement ( I hereby reserve my right to file a claim independently for the harm done to me ). I found out this fact by going onto XXXX and typing in XXXX and typing in my last name and the last 6 digits of my social security number and submitting that information and received the following response : Thank You Based on the information you provided, our records indicate that your personal information was impacted by this incident. For more information, visit the FAQ page. But it further stated that : The deadline to file an Extended Claims Period claim passed on XX/XX/XXXX. I have also been notified that my personal information is currently on the dark web and have printed out said claims as evidence of said breach. See exhibits B1-B6. \n\n\n__________________________________________________________________ SUBJECT OF DISPUTE This affidavit concerns the inaccurate reporting by EXPERIAN regarding my XXXX  account XXXX XXXX. Those inaccuracies violate EXPERIAN obligations under the Fair Credit Reporting Act ( FCRA ) 15 U.S.C. 1581c ( b ), which mandates maximum possible accuracy of consume credit information.\n\nThe inaccuracies are as follows : The last updated dates are inaccurately reported as one of the dates ( XXXX ) are not the same as Experian and XXXX. \n\nThe Payment Status are being inaccurately reported and do not match.\n\nThe 2 YEAR PAYMENT HISTORY being reported do not match as shown on Defendants FICO report of the year XXXX whereas Experian is the only Credit Reporting Agency showing the negative reporting.\n\nThe OLDER DEROGATORY EVENTS whereas Experian is the only Credit Reporting Agency is showing the negative reporting. \n\nThe MORE DETAILS Date Closed portion of Defendants XXXX Report is inaccurately reported whereas 2 of the Credit Reporting Agencies XXXX XXXX, XXXX ) are reporting 2 different dates and Experian not reporting at all ; also the Last Activity portion of the same Report is inaccurately reported whereas 2 of the Credit Reporting Agencies XXXX and Terms portion of the same Report is inaccurately reporting whereas Experian is the only Credit Reporting Agency showing a Revolving term on said report and XXXX and XXXX are not ; and also on the Scheduled Payment portion of the same Report is inaccurately reported whereas XXXX is the only Agency reporting on said portion as Experian and XXXX are not : and also on the High Balance section of the same report is inaccurately reported whereas only XXXX is reporting on said report and XXXX and Experian are not. \n\nNotice of Willful Noncompliance If EXPERIAN fails to correct or remove the inaccurate information or conduct a reasonable reinvestigation as required by law, this will be interpreted as a willful noncompliance under 15 U.S.C. 1681m.
