You can expect to hear from your service ( s ) within four weeks, but it may take longer if additional information is needed from you.\n\n( See Attachments : XXXX XXXX XXXX ) Nelnet is my student loan service. On my account dashboard it states : APPLICATION REQUEST : Were reviewing your repayment plan application we received on XX/XX/2023. Please allow time for your request to be completed. \n\n( See Attachment : XXXX  ) Interest resumed on XX/XX/2023 and my payment was due by XX/XX/XXXX. ( My next payment due date is currently listed as XX/XX/23 which I have already paid and payment has been accepted. \n\n( Compare Attachment : XXXX XXXX XXXX  ) When I called Nelnet the automated answering machine states that email is the best way to receive information from Nelnet. I have received emails preparing me for the start of the repayment process. However, I have not received any emails from Nelnet regarding the status of my SAVE application request nor requesting any additional information. \n\nNelnet has not contacted me within the contracted 4-week window. The servicer has not accepted or denied my SAVE application, nor requested additional documents. This has led to interest added to my federal student loans balance which would be paid on my behalf if my SAVE application was accepted.\n\n( See Attachment : XXXX ) The Federal Student aid website, under the page SAVE Repayment Plan Offers Lower Monthly Loan Payments states : The SAVE Plan has an interest benefit : If you make your full monthly payment, but it is not enough to cover the accrued monthly interest, the government covers the rest of the interest that accrued that month. This means that the SAVE Plan prevents your balance from growing due to unpaid interest.\n\n( See Attachment : XXXX XXXX I have tied to reach out to Nelnet directly to fix the problem. And have been unsuccessful at requesting information from the company because I can not get through to a customer service representative. \n\nOn Monday, XX/XX/2023 at XXXX XXXX : I called Nelnet twice to speak with a customer representative to discuss my loan terms. \n\nThe automated called asked for my social security number, birthday, and zip code. The automated message said the the call center was not open and automatically hung up. \n\nNelnets Website state that the call center is open Mondays XXXX EST. \n\nOn Tuesday,XX/XX/2023 at XXXX XXXX : I called Nelnet again. Gave my social security, birthday and zip and instead of hanging up I was transferred to hold. The automated message stated it would only take a few minutes to wait on the line for the next available representative. In any case, you must be aware of scams that are employed to steal a customers password? I have heard that sometimes copies of an ATM transaction can be illegally made from an ATM machine. \nWhy should I, a Chase customer for over 25 years with six accounts maintaining an average balance of at least {$150.00}, XXXX a month, be held solely responsible for this apparent fraud. \nTHIS IS OUTRAGEOUS! \n\nHERE IS THE RESPONSE THAT i RECEIVED FROM CHASE BANK We aim to give exceptional service and are sorry if we did not meet this goal when you contacted us about the ATM withdrawals from your account. ( See Attachment 1 ) The fraudulent transactions were made at an ATM machine, operated by the XXXX XXXX in the XXXX XXXX. I have been using the ATM at this bank for six years. Apparently, someone was able to hack into my account and made six fraudulent transactions during a short period! \nChase must have realized that fraud was being committed because they sent me a message at XXXX XXXX on XX/XX/XXXX, asking me whether I attempted a withdrawal of {$370.00}. When I saw the message at XXXX XXXX, I replied No. At that time, I was not aware of the five other fraudulent withdrawals. I immediately received a message from Chase saying that my atm card was closed and that I would receive a new card. ( See Attachment 2 ). \nOn XX/XX/XXXX I noticed that in addition to {$370.00} fraudulent transaction, Chase had also credited me for the other five fraudulent charges. ( See Attachment 3 ) So, you can imagine how shocked I was on XX/XX/XXXX when I looked at my account online and discovered that all the fraudulent charges had been re-applied to my account! ( See Attachment 4. ) Of course, I called Chase immediately and they passed me on to the Fraud Department. \n\n\n\n\n\nThere I spoke with XXXX, a supervisor who told me that an investigation had been done, and that since my password was used, I was to be liable for all the charges. She said a letter was sent to me, advising me of the decision. The conversation was very short. When I asked her if she would call me back if we got disconnected. XXXX said, we wont get disconnected, When I asked if there was someone else, I could talk with about this matter, she said I could look that up on XXXX. As of today, I have not received the letter. \nI have had an account with Chase for over 25 years. During most of that time, I have maintained four accounts with an average balance of more than the {$75000.00} minimum balance requirement to receive free checking. Usually more than twice that amount. In the past I have received excellent service from Chase including several warnings about suspicious transactions. As stated above, I even received a warning about these fraudulent transactions. However, in this instance Chase has let me down. While SPS did acknowledge this proof of income, we requested clarification on the unemployment status and benefits, because we received subsequent Request for Mortgage Assistance ( RMA ) forms on XX/XX/XXXX, and XX/XX/XXXX, in which you indicated in section number four that at least one borrower was unemployed and receiving unemployment benefits Facts : See the actual date time stamps from the portal File Submitted on XXXX not XXXX ( see portal history previously submitted ) Was opened by XXXX on XXXX 7 days later, XX/XX/XXXX, you made the following request for additional information on the portal, not on XXXX. You are required to use the real time postings on-line with the portal, not your internal times based on when you upload info to your system or when you say you started and action. \nOn XX/XX/XXXX the XXXX asked for items that had been provided on other forms in the original submission. There was an error on the social security number of the SPS version of the UBAF which is required by SPS and is completed by hand by the borrower vs the automated forms prepared by the court portal. However, under Reg X 12 CFR 1024.41 ( b ) you are required to use Due Diligence in your review of all the documentation provided, which included multiple forms on the court ordered and automated documents ; including the RMA, standard UBAF, XXXX, as well as copy of the real social security card that were submitted. In addition to these forms, there was a complete explanation of the {$75.00} miscellaneous on both UBAFs as the three-page detailed financial statement clearly showed the make up of the {$75.00} being {$25.00} other property expense and {$50.00} miscellaneous ( by all standards a nominal amount of miscellaneous to capture random out of pocket expenses is standard to reflect an accurate budget. ( see attachment 1 ) As to the unemployment, a full explanation was provided, see attachments 2 and 3 ( Hardship letter & employment hire packet ), as well as providing the employment documents including a copy of the social security card, see prior issue on the social security card. \nSPS continued to ask for unemployment explanation, even though provided with initial and subsequent pay stubs, posting asking for them to see other documents provided. Statements on XX/XX/XXXX indicating that he was now working, including the initial pay stub. XX/XX/XXXX additional pay stub reflecting his ownership. On XX/XX/XXXX you ask for the employment status again. XX/XX/XXXX you get the response to see previous, which you do not do. Then on XX/XX/XXXX a message was posted Received clarification on XX/XX/XXXX - XXXX first of XXXX is hire date for XXXX XXXX XXXX which is not clear -- -Need exact clarification on hire date in MM/DD/YY format NOTE : This is an admission of not using information provided in other filings. ALSO NOTE : That a submission made on XX/XX/XXXX took them until XX/XX/XXXX to reply or 19 days, well beyond the 7 days allowed by Reg X. The Program Manager for the court, sent them a notice on XXXX asking for the status after 12 days. \n\nCompany Response item 2 Additionally, you indicated the Homeowners Association ( HOA ) amounts were clear on all forms, except for one typo on one page submitted to SPS. Please note we required clarification if the true and correct HOA amount was {$220.00}, or {$240.00} to accurately calculate the monthly expenses. SPS sent you the enclosed Required Information Notices dated XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX, which outlined documents and/or clarification which were still needed to complete our review. We received all required documentation as of XX/XX/XXXX. \n\nFACTS : The request made on XX/XX/XXXX, acknowledged that there was a different amount on the other forms, which proves they looked at the forms but did nothing with them for the prior issues. In addition, it raises the issue with the form completed by hand versus those provided by the system. They were sent a corrected manual form on XX/XX/XXXX showing the {$220.00} amount. \n\nThe dates these requests were made in the portal, highlights the failure of record keeping at SPS. They were actually made on XX/XX/XXXX, XX/XX/XXXX, XXXX, XX/XX/XXXX. This is verified by the attached portal history. \n\n\nMultiple Reg X Violations 1. Starting with failure to use all documentation provided and to use reasonable Due Diligence to review provided information. Validated by their own statements on XX/XX/XXXX about the HOA fee. \n2. The date review from the court record on the portal, clearly is in contrast to the dates of requests made on the portal. Several of which were never made as proven on the UNALTERABLE portal history. \n3. Please also see that the fraud account for XXXX XXXX XXXX that Equifax told CFPB that was removed in XXXX was actually added back at some time and removed again with all my real account information. I asked for the case number for our call. After much hesitation he told me the ticket number was ( XXXX ). On XX/XX/XXXX my account was closed, and I could no longer log into my chime account with my phone. So, I emailed Chime and got the same list of things I needed to upload to chime to prove who I was. I drove to my hometown bank XXXX and showed the teller the emails between chime and me. The teller printed out a detailed activity report of the transactions on my account. She highlighted the {$1000.00} transfer to XXXX  which is chime. I get back home and start the upload process. I uploaded a picture of me holding my drivers license with a sheet of paper with my name and date written on it along with my social security card. A picture of my electric bill with my name and address on it. After waiting a few hours to see if my funds were unfrozen, since I uploaded everything that was asked of me, my account was still frozen. So, I called XXXX again and spoke with XXXX at XXXX XXXX eastern time zone. I was somewhat agitated by this time especially after this guy could not help me. I asked for the case number for our call. After much hesitation he told me the ticket number was ( XXXX ). On XX/XX/XXXX my account was closed, and I could no longer log into my chime account with my phone. So, I emailed Chime and got the same list of things I needed to upload to chime to prove who I was. I drove to my hometown bank XXXX and showed the teller the emails between chime and me. The teller printed out a detailed activity report of the transactions on my account. She highlighted the {$1000.00} transfer to stride which is chime. I get back home and start the upload process. I uploaded a picture of me holding my drivers license with a sheet of paper with my name and date written on it along with my social security card. A picture of my electric bill with my name and address on it. A picture of the documents that my bank printed out for me, showing the detailed transactions on my account. I sent a second dispute per their instructions on the back of their letter to them via email on XX/XX/XXXX and included attachments of the Card Security Debt Cancelation program, the supporting documentation I sent to XXXX XXXX with my unemployment information and benefit request form, the proof that XXXX XXXX had been making my payments for me under the plan, and the correspondence I received from XXXX XXXX regarding payments, showing a payment made in XX/XX/XXXX. The documentation Portfolio Recovery sent me with their letter of XX/XX/XXXX included a statement date of XX/XX/XXXX which did not include payments that were made XXXX, XXXX, XXXX and XX/XX/XXXX and forward. I told them that the XX/XX/XXXX documentation they sent in their letter dated XX/XX/XXXX is irrelevant to this case and the balance they are trying to collect on is incorrect even if I didn't have the protection program! I asked that they again, please coordinate with \" XXXX XXXX XXXX '' for an accurate account balance through at least XX/XX/XXXX. Then, at least that would be close to the remaining amount, after all payments made by XXXX XXXX  to my account and those made by me, that should be canceled under the Card Security Debt Cancelation program! In response to my dispute on the Consumer Financial Protection Bureau 's website, Portfolio Recovery Associates indicated and provided evidence that they sent a letter correspondence to my home on XX/XX/2020 ( see attachment. ) Upon review of that letter, it contained an address that I have never resided at in my life and Portfolio Recovery Associates stated that when they did not hear back from me that is when they reported negatively to my credit files with all three credit bureaus and since my complaint, they have submitted sufficient evidence to that address to connect me to the debt that they purchased. I am writing this complaint because I just received correspondence from Portfolio Recovery Associates at my correct address dated XX/XX/2020, indicating they received my dispute and provided me with documentation that they feel links me to the debt, such as my last 4 of my social security number, the account open date provider by the seller and just my name. If you are contacting me from outside my state, provide the licensing information from your state as well. Again I would like all the requested information provided to me in totality via postal mail due to your companies deprivation of allowing me to request this information independently before you placed this account on my credit reports.
