On XXXX XXXX, XXXX my husband passed away. On XXXX XXXX, XXXX, his social security check was dispersed to the account and I withdrew the funds as usual to pay expenses. The bank later withdrew the funds saying they did so because he had passed. I visited the bank and spoke with XXXX XXXX. She told us the bank placed a hold on the account pending a response from Social Security. My daughter and I visited Social Security to gain clarity. We were told they had not requested a refund from the bank as I was entitled to the funds because they were a payout from the month of XXXX when he was still alive. We went back to the bank to tell the representative we had met with what was said at Social Security, but were met with a denial. At that point the representative said the government had a hold on the account even though a couple hours before she said the hold had been placed by the bank. XXXX XXXX said we needed to meet with the branch manager who would return on XXXX XXXX, XXXX. On XXXX XXXX, XXXX, we met with the branch manager, XXXX XXXX. She stated she needed proof from Social Security that I was entitled to the funds. My daughter called the Social Security office and placed the call on speakerphone. The Social Security representative stated the same information as the representative we spoke with in the office the day before- that the bank should not have withdrawn the funds. However, XXXX XXXX stated they did not know their jobs even though the representative stated she would be able to send something to the treasury to the same effect. After waiting a few minutes, XXXX XXXX asked my daughter to contact the Social Security office again and ask if they could email the release statement directly to her and she would forward it to the treasury department. When my daughter called the third representative said she could not email it because of the confidential information. She also stated she did not see information from the treasury requesting the money back. She stated she sees the funds were paid to the bank on XXXX XXXX. She said if the bank chose to send the funds back, I could fill out an underpayment form to get the funds back. In the meantime, my check direct deposits into the bank tomorrow, XXXX XXXX and the bank is going to take my whole check to settle the overdraft fees they unnecessarily caused. I am left with no money to pay my bills and at XXXX XXXX XXXX I have no other source of income. The bank caused this error and are not hearing my pleas for help to stop it. They have been told my multiple people at Social Security that they should not have taken my money, but they refuse to put it back. Please help me get my money back before I lose my home. I checked my tracking number and it indeed noted a delivery through XXXX but it was signed by a XXXX I lived alone at the time and there was no one home, therefore impossible for anyone to sign. XXXX simply leaves packaged on my front porch. I then attempted to determine where the package was with XXXX, however when I entered my address the automated system noted that the address I was providing ( my address ) did not match the address on the package from the sender and there was nothing else they could do and I needed to contact the sender. I tried repeatedly to contact the sender with no response- they simply sent me a shipping label stating it was sent to me. After days of back and forth I disputed this with Chase and was refunded. At the time I was XXXXXXXX XXXX XXXX so simply purchased the crib from XXXX instead and didn't think about it again. After XXXX XXXX my daughter, in XXXX and later in XXXX I looked at card statements and noticed this charge reappeared on my account after it was initially removed. I called Chase to tell them I did not receive the crib and had to purchase another one. The told me, there was nothing they could do since it was out of the window the had to dispute again. I tried to reach out to the sender again and appeal and no help there. I then went to XXXX to get extra help. I found that the tracking number was indeed never sent to my address or my name and the sender was a fraud who had faked a shipping label. However, XXXX XXXXXXXX was not able to provide me with the name/address for security reasons. However, they stated if the sender called them they would confirm I did not receive the item to help me get a refund. After >6 attempts I was not able to get them to call and Chase was no help. I didn't know this was an option to file a complaint. But, I think consumes should be protected against this type of fraud. Scammers know that XXXX is unable to do anything but confirm that the package did not come to my address and they also know the days in which banks will no longer let you dispute again. And it is very easy for this window to pass as a new mom - being occupied with a new baby. We made various attempts to contact them to resolve this issue and it seems like nobody new who we should get in contact with to get this issue resolved! We ended up sending a letter which got no response. Then we sent a certified letter which did get a response we found out they got the message. In trying to get a hold of someone who knew what we should do or the process we should follow was very, very difficult. we got switched from one Department to another department and people just did not know what they were doing. \nAfter a lot of effort I finally got ahold of Ocwen 's Reverse mortgage servicing Department and a person named XXXX XXXX. Tried to let him know what was going on and the efforts we made to get ahold of someone who could help and the fact that we had been trying for months to do so. I let him know that we needed to find out how much money they had spent to acquire the reverse mortgage, all of the charges that were involved, and what we needed to pay. He gave me the amount that was due at the time of our conversation or the prior month. \nI let him know that we needed to have it retroactive back to XXXX when we tried to contact them because we made the effort to resolve this issue and we couldn't get a hold of anyone to do it. He said they don't have any means of going back and getting the payoff to the XXXX date. I asked him if I could speak with his supervisor and he would not give me a phone number. However, I did get an email for his overseer Mr. XXXX and sent him an email explaining what was going on and asking for his help. \nBecause we felt that the lack of communication was on Ocwen and that we had been treated unfairly reached out to the consumer affairs Department, HUD, and the Attorney General the state of California. This is part of the process we're going through now. We also found out that there's not a whole lot of information about how to deal with people who handle reverse mortgages. Even the governmental departments don't really know what's happening with those mortgages. \nIt's very frustrating when you have a huge company that doesn't fulfill their responsibilities and gives you the run around and are not willing to work with you. What really gets me the most is that Wells Fargo knows this to be true and instead of taking the higher road and look to make things right with their Customers in anyway possible they rather continue to inflict as much pain and suffering as possible under the guise of doing all they can to help their Customers in need... \nWell back to my complaint specifics and to be clear the home was not my secondary home, I was not making XXXX a month and I had considerable debt that was not taken into account during the XXXX modification request. the modification offered at the time only provided the illusion of fiscal support. We would just need to get their approval and there would be a non-refundable pet fee but the owner would have final decision on that. \nProspective tenants requested a copy of the lease agreement for review and were told via email The lease agreement doesnt get generated until the non-refundable reservation fee is paid. Prospective tenants questioned terms of the lease as we would like to understand what terms we are agreeing to before we send a non-refundable deposit. Property manager responds It is a 12 month lease. If you have more detailed questions a call may be easier Follow up phone call between prospective tenant and property manager completed between XXXX XXXX  and XXXX XXXX  and discussed pet addendum ( 2 ) and putting lease together so terms can be reviewed in detail before paying the non-refundable deposit. ( This is the first instance we felt we were being misled to commit to something financially before having supporting written documents. ) Prospective tenant sends follow up email to Propert Manager at XXXX XXXX  stating that Lease agreement and Maintenance Addendum looks good Can we bother you for a Pet Addendum? You mentioned possible a {$500.00} cleaning fee/deposit. At some point, wed love to get a dog. Ours passed away a few years ago. With the yard on this property, it would be really nice to be able to have one again. We had a yellow lab. Not sure what well get this time around but it wont be 75+ lbs dog thats for sure. Ready to sign from there.. ( 3 ) After phone conversation with property manager eluding that owner is dog friendly and that per addendums are drafted after the fact, prospective tenants agree to lease terms. Tenants send screenshot to Property Manager stating that payment has been made in full. Again requested the pet addendum. ( 4 ) XXXX XXXX XXXX  Rental Contracts signed ( Working with Real Estate Agents , Maintenance Addendum , Move out expectations Addendum ) XXXX All parties completed signing the Lease. Tenants again emailed Property Manager stating, Following up on the pet addendum. Not sure if you had a chance to connect with the owners over the weekend. Deposit and first month rent was paid on Friday. I can confirm funds were pulled from our account ( 5 ). This was the fifth request for the pet addendum which property managers continued to ignore meanwhile continuing to misrepresent the property as DOG friendly. At this point we were in the process of looking for a dog but did not yet own. \nGeneral welcome email received from XXXX XXXX confirming initial lease start date of XX/XX/XXXX XXXX Official first day of lease. Email from WK to LS stating I want to touch on the pet agreement again. We most definitely would like to get a dog this year to help the kids transition with the move. Also, wed like to feel like our friends with pets can come and go without fearing wed have to pay the {$1000.00} penalty fee described in the initial agreement we signed. Please draft the pet addendum for us so we can be proactive in paying the deposit and avoid any unnecessary penalties. ( 6 ) LS responds to the email stating We dont usually do the pet addendum until you have the pet ( due to the addendum being specific to YOUR pet ). So once you know the dog that you are getting, please contact our office with that information and we will draft up the pet addendum for all parties to sign off on. Friends pets are able to visit the home from time to time and the {$1000.00} penalty fee will not be applied. That unauthorized pet fee would only be charged if we did a periodic inspection or a maintenance item and found that a pet was living in the home without going through the approval process ( owner permission, pay pet fee, and pet addendum drafted up. Tenants understanding based on 1 ) lease listing on website stated pet friendly 2 ) intent to get a dog ( <75 lbs ) was discussed in at least 6 previous phone conversations and emails with Property Managers implying verbally and via email owner approval of having a dog in the home and that pet addendum would be drafted after we secured the pet. We asked them numerous times if they followed up with the owner regarding the pet ( prior to signing the lease ) and the response was unequivocally that the pet addendum would be drafted after we have the pet ( per Property Managers XX/XX/XXXX email specifically ). \nXXXX Tenant email to Property Manager We found two beautiful dogs. How do we proceed with adding them to our agreement and owner approval. Pet fee is in order XXXX Property Manager responded Please let me know what kind of dogs you are looking at getting and about what their weight is. When are you looking to bring them into the home? Just let me know and then I will reach out to the owners and see if I can get you permission to have them Tenants understood this reply as we had only permission for one dog so company would need to reach out to the owners to specifically see if 2 dogs are allowed. Tenants sent email response stating both dogs are Rhodesian Ridgebacks. Eventually male would be 70 lb and female about 60 lb, brother and sister, 11 wks old. Also stated we reached out to a local dog trainer to setup professional potty and behavioral training for dogs. \nXXXX Property Manager email included verbatim from owners Im not interested in having dogs at the house. I havent had good experiences with that. ( The property owners are stating we are not allowed to have a dog at all. Tenants requested the Realtors have a discussion with the property XXXX regarding us having a dog in the home plus a formal pet addendum at least 6 times before and during the process of signing the lease. Property Managers consistently implied that having a dog in the home is a non-issue. Pet addendum would be drafted after getting the pet. ) Tenants requested additional conversation via phone and reconsideration.\n\nProperty Manager responded in length, We couldnt request approval for something you didnt have yet. To ask for approval, we must know the breed of the dog and the weightI am sorry that these are not the responses that you were hoping to get from the owners but there is nothing that we can do about it.\n\nTenants respond via email reminding Property Managers that when we were ready to move forward with the lease it was held up over the pet addendum which we requested to sign prior to or in concert with the lease agreement to avoid the current situation. We were assured all would be fine. You knew the owner ( after 7 years of experience together ). All we had to do is give the breed but even then we wanted to see it in writing. Repeated attempts by [ tenants ] for the Pet Addendum Tenants also referenced that in the listing, the property was noted as pet friendly or we would not have reached out for the rental. \nXXXX Phone call between Tenant and Property Manager. Both reiterating above points. Property Manager denied any compromise Tenant send follow up email to Property Manager asking if there are \" certain breeds the homeowner will consider, or is the discussion of all pets off the table? Please be specific if there are certain criteria a pet should meet. Thanks for clarifying.\n\nProperty Manager responded he would ask the owners and asked if this would be for one or two dogs.\n\nTenant responded Either/or. I am interested to know what our limitations are when continuing the search ( breed, age, number ). Any specifics are helpful vs us finding something we like, requesting permission, then being told no. Im sure you can see how the current process can be frustrating. \nXXXX Still no response received from any member of the Property Management team.\n\nDuring these discussions, there was also ongoing questioning of the water quality due to strong smells when running the water which the Property Manager and Landlord refused to assess. We physically inhabited the home less than two weeks ( assumed the rental payments early to secure the home ).\n\nThe Property Managers were deceitful and misleading on multiple accounts ( attempting to pressure us into sending a non-refundable deposit prior to reviewing lease terms, misrepresenting the property as dog friendly only to say that \" no dogs are allowed in the home '' after the lease was signed, refusing to send someone to XXXX the concern for water quality. \n\nOn XX/XX/XXXX Tenants gave notice that they will be vacating the property effective XX/XX/XXXX. \n\nProperty Managers are refusing to disclose if our {$3000.00} security deposit will be returned in full. The home was inhabited for less than two weeks by tenants due to delayed moving and summer travels. Tenants paid out of pocket for lawn treatments and overgrown landscaping during this short rental period so the home blended with the other well-kept homes in the community.\n\nProperty Managers are also demanding two months rent to be paid in full or in a payment plan by Friday XX/XX/XXXX or else they will turn our account over to collections which they threaten \" will not Reflect favorably on your credit. I called many, many times to the LO and processor over the course of weeks, my emails were practically unanswered. The only times answered were after 3 to 5 of the same emails sent. After appraisal came back and all income docs sent, the processor informed me I had a 30 year loan not a 20 year as discussed initially with LO. They were telling me I had a Debt-TO-Income problem. I do not know because of non-disclosure what they were using in the final numbers. I only know I should not have been denied based on DTI. I have the right to state what happened to me, and my concerns without the fear or threat of being retaitaliation against or being subjected to additional intimidation and violations. \nI was discriminated against, my rights were violated, I was intimidated, harassed, and I was not treated equitably. There was no demarcation of the lender and builder, they acted as XXXX entity. My personal, private, and confidential information was breached by them. Now I must deal with all the horrors, stress, anguish, and lack of security of my personal, private information to include identifying banks, and balances etc. being compromised, this is not acceptable and should never have occurred. This treatment occurred because of my race, age, and marital status. \n\nI also have the right for these matters to be resolved by the laws, rules, and regulations that govern buying a home and obtaining a loan to purchase the home. I am requesting that my concerns be addressed and not just dismissed as they have been by the attorney representing XXXX XXXX and the Investigator for XXXX XXXX. I am requesting that the matters and violations be resolved to my satisfaction and resolved immediately. l did not give XXXX XXXX or XXXX XXXX  permission to violate any of my rights. I am willing to engage in a respectful discussion about what occurred to resolve these matters. \nThe original closing date was XX/XX/2023, the closing date was changed to XX/XX/2023. The violations occurred before the contract was breached on XX/XX/2023. When XXXX XXXX asked if I agreed with changing the closing date from the original date, I stated to XXXX XXXX, during our telephone conversation on XX/XX/2023, that I was not in agreement with changing the closing date. The information included in the document was given to XXXX XXXX  over a secure portal. XXXX XXXX  authorized XXXX XXXX sending my private, personal, and confidential information in a non-secure email to people that I did not give my consent to have my personal, private and confidential information, this breach will have a lasting negative impact on me and my future. This was a disrespectful, blatant violation of my rights and my information has forever been compromised. This must be addressed and fixed, immediately. \n\nPrior to the breach of my information, on XX/XX/2023 XXXX XXXX informed me of the re-listing of the home. XXXX XXXX stated that XXXX of the reasons why the home was being relisted was because I did not meet the requirements of the loan. This was very concerning, because on XX/XX/2023 while in correspondence with XXXX XXXX of XXXX XXXX, I informed her that I had completed the additional task required by XXXX XXXX  and I received the following response from XXXX XXXX, I will review and let you know of anything additional we may need. \n\nOn XX/XX/2023, at no time while corresponding with XXXX XXXX was, I informed that I did not meet the requirements of the loan because the current home was not sold prior to XX/XX/2023, and for that reason they were relisting of the home on XX/XX/2023. The selling of the current home could have taken place after XXXX date was not listed on the loan agreement or sales contract as the final date the home had to be sold. Therefore, the excuse that the home was not sold was not and still is not an acceptable excuse, this was misleading to say the least. Reference the emails included as attachments. \nOn XX/XX/2023, at XXXX XXXX  from XXXX XXXX phone XXXX I received a very disturbing telephone call from XXXX XXXX and XXXX XXXX that I provide them with the listing agreement of my current home. \nXXXX XXXX and XXXX XXXX placed that additional condition on me that was not a part of the loan application or the housing contract, also, they were not a part of the contract in which they demanded. Several times they demanded the listing agreement for the current home, a contract between me and XXXX XXXX XXXX XXXX XXXX, my current broker in charge current XXXX XXXX, Broker in Charge, they also used not getting the listing agreement as the reason why they re-listed the home on XX/XX/2023, reference emails listing agreement. \nXXXX XXXX  in their response stated that current Broker In Charge XXXX XXXX was not identified as the new Broker in Charge, that is not true. When XXXX XXXX initiated the telephone call with XXXX XXXX on XX/XX/2023 they demanded ( to me ), that XXXX XXXX give them the listing agreement, they had full knowledge that XXXX XXXX was the current Broker In Charge. Also, when XXXX XXXX sent the email reiterating the conversation it was obvious and known by XXXX XXXX and XXXX XXXX that XXXX XXXX was the Broker in Charge. Note the attached emails pertaining to the demands for the listing agreement. \n\nXXXX XXXX began using XXXX stereotype towards me after they did not receive the listing agreement. After I completed the required task of XXXX XXXX  I emailed XXXX XXXX and expressed my concerns/ reference my email about the concerns and matters. When I spoke to XXXX XXXX about my concerns, after the joint telephone call he initiated, first XXXX XXXX acted as if he was not part of the telephone call, I then reminded XXXX XXXX that the call came from his telephone. XXXX XXXX began using the XXXX stereotype to discredit my concerns, dismiss my questions, reprimand me, put me in my place for questing XXXX XXXX XXXX XXXX males, shaming me, exerting their power, and controlling in the situation. XXXX XXXX does not have the right to violate me then define the violation, nor does XXXX XXXX or XXXX XXXX  have that right, I was victimized by him, and no one has the right to take away my rights or violate me. \nDuring our telephone conversation XXXX XXXX spoke for his company and XXXX XXXX. When I informed XXXX XXXX of my concerns, the way I was being treated, and the lack of demarcation of the XXXX XXXX  and XXXX XXXX, XXXX XXXX stated, you are angry, angry at XXXX XXXX and mad at me. \nWhen is it acceptable or appropriate for a lender to use XXXX stereotypes and intimidation because they are asked legitimate questions, and the customer has legitimate concerns about how they are being treated? \nAfter I made the request to XXXX XXXX to stop using the XXXX stereotype XXXX XXXX continued the use of the XXXX stereotype, reference attached emails. \n\nXXXX XXXX  and XXXX XXXX did not address these very important matters out lined in my response and I am requesting that these matters be addressed. \nWhen XXXX XXXX, Broker in Charge of XXXX real estate, ( XXXX, XXXX, male of XXXX descent ) responded to their email XXXX XXXX nor XXXX XXXX responded or answered his questions. \nI am once again asking under what authority does XXXX XXXX and XXXX XXXX  have to demand the current home XXXX listing agreement? \nXXXX XXXX also contacted XXXX XXXX about the closing dates etc. After XXXX XXXX contact with XXXX XXXX about the dates, XXXX XXXX continued the inequitable treatment. XXXX XXXX did not tell the truth when I asked to move the orientation date reference email chain. It is also apparent that XXXX XXXX did not even inform person conducting the orientation of my request, see email also. I was given less than XXXX days to have an inspection and to close on the home, additional inequitable treatment and very concerning. Since then they have attempted two previous times to foreclose on us. It was during this time that another fraudulently forged copy of the note was given to us as proof of ownership by XXXX XXXX. We recently wrote a cease and desist letter requesting accounting documents to validate their claim of debt and ownership but we got no response. When I returned from that trip and saw that my card had not arrived in the mail as promised and expected, I called and was sent a new card ( via courier service ) with a new card number. I did not know about the fraudulent charges until I received the first bill for the card, in early XXXX, showing a credit balance instead of showing the almost {$4500.00} I had charged and did owe. I called to ask about the \" credit '' and stated that I wanted to pay what was due because I had made the charges ; they told me to wait for the next bill. I was told that an investigation was underway, and I was given a \" security credit '' for some of the fraudulent charges, which totaled more than my authentic charges - hence the \" credit balance '' situation on the first bill. Now I have received the second bill, and I see that the security credits have all been reversed and Citi Bank is saying that I am liable for the purchases. I had no idea that over {$17000.00} had been charged fraudulently, until I saw this bill showing the reversal of all the security credits. They never contacted me about this, except for one call from a woman in the investigation department. I later tried multiple times to reach her, leaving her messages with no response - as well as calling customer service, security, and the fraud department multiple times about the problem, and being told I should contact that same woman. Today I went into my local Citi branch and asked for help in contacting the right people to resolve this. On the phone, I was told that that woman no longer works for the department and that my case has been assigned to someone else. Neither the woman nor the newly assigned man ever contacted me after that initial call I had with her. I was not even in XXXX, the city where the fraudulent charges were made, on XX/XX/XXXX ; I was flying home to XXXX from XXXX XXXX California. On XX/XX/year>, the broker had a conversation with the sellers agent at XXXX XXXX XXXX guaranteeing a specific closing date and the pre-approval amount. Those misrepresentations were relied upon by the seller, the sellers agent, the buyers agent, and me. The brokers continued misrepresentation influenced the seller to accept my offer and influenced me to deposit {$50000.00} in XXXX money into escrow and enter into a purchase contract for {$900000.00}. Since his request for a contact back to discuss this further has still been unfulfilled I am now forced to open another complaint. \n\nWe have received the response from Chase stating that the merchant gave them documentation showing that the item was delivered to the address we have on file. This is simply not a true statement. This package has been confirmed now by XXXX separate customer service agents at XXXX on XXXX separate occasions that it was not delivered to our home at XXXX XXXX XXXX XXXX XXXX XXXX NV XXXX. \n\nIn addition to support that this is a false claim the tracking information only provides that it was delivered to XXXX XXXX XXXX so how they can confirm that it was delivered to our address, without calling XXXX is completely baffling me. XXXX XXXX XXXX is the city of XXXX people, the fact that the address is not on the tracking information, is even more reason for a call to be completeld. I do not understand why they are not required to contact fedex to confirm this information. \n\nThis has gone on so long that I am now 2nd guessing myself and I have now contacted XXXX a XXXX time. Still when I give them the tracking information and the address that it should have been delivered to they confusingly say no mam, that is not where it was delivered. \n\nThey can not give me the address in which it was delivered for security purposes which I understand they don't want me showing up at somebody else 's house to get my package that should have been delivered last year around XXXX time. \n\nAt this point this is based on principle alone, and the fact that people are being too lazy to confirm this information. I now feel as if we have been ripped off by 2 separate companies this should have been a very easy claim to review. This company is a contractor who is supposed to take care of the Wells Fargo customers Complaints and provide resolutions, but instead, this company ECMO send the complaints to their sub-contractors, employees who work from the comfort of their homes without any supervision and NOT under WELLS FARGOs control. My last complaint here was closed as solved by an ECMO called XXXX XXXX it was about a ECMO WHO MAILED XXXX LETTERS TO MY RESIDENTIAL ADDRESS WHEN THE ISSUE OF MY COMPLAINT IS ABOUT WELLS FARGO REFUSING TO USE MY XXXX XXXX MAILING ADDRESS. This ECMO who is working from the comfort of their homes without any supervision answered my complaints by not providing any solution to my complaints but this ECMO COPIED AND PASTED the answers of the previous contractor XXXX XXXX WHO ANSWERED MY PREVIOUS COMPLAINT WHO provided a lot of complements to herself as ECMO and the rest of the ECMOs the good job she is performing as ECMO and by telling me that she and all the ECMOs are highest WELLS FARGO position, most intelligent most trusted at Wells Fargo XXXX but the action of the ECMOs indicates the opposite. Here some of what this ECMO said in writing in her response to my complacent number XXXX : 1- The concern of the distinction between mailing and physical address has been sent for review to upper management. The outcome of this review is proprietary and confidential ( IT MEANS NO SOLUTION, The solution is invisible, it is secret ). 2- Should this occur again in the future, please either give us a call. ( Well I have been contacting you about this same issue for 3 years and in more than 104 complaints. Do you think I need you to tell me to complain more if this continues? Keep in mind as a financial institution, we have multiple checks and balances around accounts, account opening, and products offered. For the past 3 years and by 110 complaints till now trying to get WELLS FARGO BANK to respect my privacy rights and my civil rights by following my account mailing preference by directing all my mail to my po box as indicated on my account but I did not succeed to penetrate the thick brains ( if it exist ) of the WELLS FARGO employees. I am filing my complaint here for the 11th time and I am requesting those no-brainer Called ECMOs to forward my complaint to a real Wells Fargo manager . And not to who are called ECMOs. The Executive Complaint Management Office ( ECMO ) is NOT WELLS FARGO BANK. This company is a contractor who is supposed to take care of the Wells Fargo customers Complaints and provide resolutions, but instead, this company ECMO send the complaints to their sub-contractors, employees who work from the comfort of their homes without any supervision and NOT under WELLS FARGOs control. My last complaint here was closed as solved by an ECMO called XXXX XXXX it was about a ECMO WHO MAILED XXXX LETTERS TO MY RESIDENTIAL ADDRESS WHEN THE ISSUE OF MY COMPLAINT IS ABOUT WELLS FARGO REFUSING TO USE MY po box MAILING ADDRESS. This ECMO who is working from the comfort of their homes without any supervision answered my complaints by not providing any solution to my complaints but this ECMO COPIED AND PASTED the answers of the previous contractor XXXX XXXX WHO ANSWERED MY PREVIOUS COMPLAINT WHO provided a lot of complements to herself as ECMO and the rest of the ECMOs the good job she is performing as ECMO and by telling me that she and all the ECMOs are highest WELLS FARGO position, most intelligent most trusted at Wells Fargo , but the action of the ECMOs indicates the opposite. Here some of what this ECMO said in writing in her response to my complacent number 102 : 1- The concern of the distinction between mailing and physical address has been sent for review to upper management. The outcome of this review is proprietary and confidential ( IT MEANS NO SOLUTION, The solution is invisible, it is secret ). 2- Should this occur again in the future, please either give us a call. ( Well I have been contacting you about this same issue for 3 years and in more than 104 complaints. Do you think I need you to tell me to complain more if this continues? Is the solution you are providing for my issue? ) 3- This is not a matter of the branch manager knowing how to complete a task. Keep in mind as a financial institution, we have multiple checks and balances around accounts, account opening, and products offered. This was the answer of ECMO working from the comfort of their home answering my complaint about a manager who was setting me up to get me to sign in for a new account against my will when all I REQUESTED FROM HIM is to renew an ATM card and my complaint has nothing to do with checks or accounts opening. But I am glad this ECMO informed the public that the WELLS FARGO MANAGERS DO NOT KNOW HOW TO REORDER AN ATM CARD. 4- This ECMO working from the comfort of their home wrote in her answer to my complaint : we are highly regulated by agencies and laws meant to keep customers safe. This is not meant as a sales tactic or a way to try and pressure you into a product you do not want or need. ( WELLS IF YOU FOLLOW THE LAWS THEN WHY DO YOU STILL DIRECTING YOUR MAIL TO MY RESIDENTIAL ADDRESS AND YOU ARE REFUSING TO USE MY MAILING ADDRESS? ) Your statement is misleading. 5- This ECMO Seems to be out of her mind when in her answer she discussed the Lack of Appointments Available Which it was not in my complaint. It seems she was just copying and pasting answers from her screen. 6- This ECMO stated : Wells Fargos Company rating with the Better Business Bureau and overall public image is something we are aware of. ( It seems that WELLS FARGO HAS NOTHING MORE TO OFFER AS THEY ARE AWARE THAT WELLS FARGOS RATTING AT THE BETTER BUSINESS IS ( F ) and WELLS FARGO IS STILL HIRING THIS ECMO COMPANY TO DEAL WITH THE PUBLIC!! I advise Wells Fargo to reconsider their decision about those so-called ECMOs. 7-We reviewed your concern around not offering an email address or a digital portal for customers to submit complaints. In XXXX of XXXX I purchased a home in XXXX XXXX, Texas using a FHA loan in hopes of rebuilding a life for my kids and I. \n\nFHA : When an FHA loan is being used, the appraiser has two objectives. The Department of Housing and Urban Development ( HUD ) requires him to determine the current market value, as with any appraisal. But they also require a property inspection to make sure the home meets HUD 's minimum standards for health and safety. \n4150.2 The appraisal process is the lenders tool for determining if a property meets the minimum property requirements and eligibility standards for a FHA insured mortgage. Underwriters bear primary responsibility for determining eligibility ; however, the appraiser is the on-site representative for the lender and provides preliminary verification that the General Acceptability Criteria standards have been met. \n\n\" FHA-approved lenders are obliged to apply to our underwriting standards, not only to protect our insurance fund, but to make certain families can sustain their mortgages, '' said Acting FHA Commissioner XXXX XXXX . \" Due diligence is at the root of mortgage lending protecting lenders, the FHA, and certainly homeowners from the prospect of foreclosure. '' In XXXX of XXXX we began having plumbing issues and in XXXX of XXXX I noticed an error in my appraisal that would have disqualified the home and the loan from funding. The appraiser used by Cardinal Financial marked my utilities as public water and sewer when in fact they are private water well and septic. Had it been marked properly Cardinal was required to ensure the following minimum property requirements per the FHA. \n\n6Does the report indicate that the water is private? If yes, does the appraiser provide a comment on the availability of public water and if the subject is required to connect? Also, does the appraiser comment if private utilities are common for the area and if there is any impact on the subject 's marketability?\n\n8Does the report indicate that the sewer is private? If yes, does the appraiser provide a comment on the availability of public sewer and if the subject is required to connect?\n\nIf also on private water, is there a comment noting if the subject meets the minimum FHA distance requirements from the well to the storage tank, drain field, and property? \nAlso, does the appraiser comment if private utilities are common for the area and if there is any impact on the subject 's marketability?\n\nThis was not performed, and the home does not and can not physically qualify. The costs to bring the property up to todays health and safety code are over {$100000.00} FHA WELL TO SEPTIC REQUIREMENTS ARE AS FOLLOWS. \n\nSeptic to well minimum XXXX distance this property is less than XXXXt Well to drain field minimum XXXX ft although they will allow a minimum of XXXX with a waiver this property is XXXXft FHA will accept the state/local distance requirements for well/septic systems as long as they are not less than XXXX  feet between the well and septic tank drainfield Well to property line minimum of XXXXft this property is less than XXXXft For properties that are served by wells, FHA loan rules now say, When an individual Water Supply System is present, the Mortgagee must ensure that the water quality meets the requirements of the health authority with jurisdiction . \n\n( a ) Requirements for Well Water TestingA well water test is required for, but not limited to, Properties : where the distance between the well and septic system is less than 100 feet.\n\n( Q ) Sewage SystemThe Mortgagee must confirm that a connection is made to a public or community sewage disposal system whenever feasible and available at a reasonable cost. If connection costs to the public or community system are not reasonable, the existing Onsite Sewage Disposal Systems are acceptable provided they are functioning properly and meet the requirements of the local health department. When the Onsite Sewage Disposal System is not sufficient and an off-site system is available, the Mortgagee must confirm connection to an off-site sewage system. When the Onsite Sewage Disposal System is not sufficient and an off-site system is not available, the Mortgagee must reject the Property unless the Onsite Sewage Disposal System is repaired or replaced and complies with local health department standards.\n\nPer Cardinal Financials website by definition a FHA appraisal is the following.\n\nWhat is an FHA appraisal? \nThe FHA appraisal process is unique in that the appraiser basically performs double-duty as both an appraiser and an inspector.\n\nWhen you use a Conventional loan to buy a house, your appraiser is mainly concerned about the current market value of the property. But when you use a federally-insured FHA loan , the appraiser has two objectives : Determine the houses value, and inspect it to make sure it meets minimum standards for health and safety set by the Department of Housing and Urban Development ( HUD ).\n\nThe real difference between the two is the level of inspection that HUD requires in order to fund the loan.\n\nIf the FHA appraiser flags certain issuespeeling paint, loose handrails, or other safety issuesthe loan is put on hold until theyre fixed. In addition, with a fundamentally sound place to live, the borrower may have more of an incentive to make their payments in order to keep the home.\n\nWhat Are the FHA 's Minimum Property Standards?\n\nAccording to the U.S. Department of Housing and Urban Development ( HUD ), the FHA requires that the properties financed with its loan products meet the following minimum standards : Safety : The home should protect the health and safety of the occupants.\n\nSecurity : The home should protect the security of the property.\n\nSoundness : The property should not have physical deficiencies or conditions affecting its structural integrity.1 According to information found on the FHA/HUD official site , the lender is responsible for making sure a particular property lives up to local requirements and that community sewage systems are properly licensed and that said systems are \" adequate '' enough to service the property.\n\nThe reason this property can not physically qualify even with repair is the following again directly from Cardinals website under what if my home does not pass FHA inspection? The only alternative is a FHA XXXX loan aka a rehab loan which requires a minimum of 1 acre for properties with both a well and septic. This property is less than 1 acre and that is the reason a replacement system is so expensive for this property. There is physically not enough room for repair or replacement which is requirement number XXXX  in the checklist for well and septic waivers that was yet another requirement not performed prior to approval.\n\n5. Evidence that the system is working properly. And there is sufficient space for repair/maintenance. \n\n\nIt has been over a year and a half since I reported the error to XXXX XXXX and Cardinal. Rather than taking accountability for their error, I have been unable to pay my mortgage since XXXX of XXXX due to spending over {$30000.00} to date on maintenance and attorneys fees trying to prove liability. I had to take a {$9000.00} loan at a XXXX XXXX interest rate for the initial retainer. I also can not afford alternative living expenses while paying an attorney so my XXXX children and I are forced to live in an uninhabitable health hazardous home until this is resolved. \n\nMy kids and I have not had a safe, sound home in 2 years. We do not know if our water is safe due to it being less than XXXX from a source of pollution. There is raw sewage coming up my shower drains and running across my driveway. Not to mention I live on XXXX XXXX and this is an environmental hazard. Everything we own smells like mold. I have been put on XXXX XXXX medication due to not knowing if we will be forced to start over again. It is apparent their only strategy is to mentally and financially drain me to the point I am forced to give up pursuing them. \n\nDespite the following from the FHA handbook ; 4155.2 4.1.b Lender Responsibility for Appraisals Lenders, including sponsoring lenders, are equally responsible, along with appraisers, for the quality, integrity, accuracy and thoroughness of appraisals. The lender will be held accountable if it knew, or should have known, that there were problems with the integrity, accuracy and thoroughness of an appraisal submitted to FHA for mortgage insurance purposes. Lenders that submit appraisals to HUD that do not meet FHA requirements are subject to the imposition of sanctions by the HUD Mortgagee Review Board ( MRB ). \n\nXXXX XXXX from the FHA Home ownership department has stated that there was no way the lender could have known the actual source of the utilities since the appraiser marked them as public ( although it was listed as septic and well in the public XXXX and the appraiser took a picture of the water well storage tank included in the appraisal ) therefore they are not holding Cardinal accountable to their own rules and regulations, and Cardinal has taken that as they are not liable for their clients mistake leaving me holding an over {$100000.00} repair bill or to spend thousands facing the possibility of being homeless to pursue them. \n\nThe FHA also states the following which has not been done. \n\n\" Lenders must report to FHA all findings of fraud and material misrepresentations. Lenders must also report any material findings concerning the origination, underwriting, or servicing of the loan, that the lender is unable to mitigate or otherwise resolve. '' I have also found evidence below that Cardinal Financial forces appraisers to submit as is appraisals only.\n\nI recently did an appraisal for them for one property and called for a foundation inspection since I noticed a crack in the wall, and noticeable sagging on the first and second floors of the house. There was nothing out of the ordinary with the report otherwise. Cardinal came back 3 TIMES and forcefully told me \" we require as-is reports ''. So basically Cardinal Financial is just cancelling orders immediately once they find out the appraiser is not going to rubber stamp and ignore an obvious issue. they told me to change my report from subject to inspection to as-is and remove the concern about the foundation. they didnt want a cost to cure. They wanted an as is ignoring the problem. Wasnt about me not complying with a cost to cure or finding the value of a defect situation Weve had two AMCs recent that asks us to ignore the problems too. Wonder if it has to do with packaging the loans up and MBSs and some type of quality issue? Its completely wrong. The sad part is this -- if they find an appraiser who rubber stamps this, then the borrower could be out tons of money, I spoke with some of the other people at the old firm I used to work at and they confirmed that they have had issues with Cardinal in the past. One time Cardinal even asked one of their appraisers to change the effective date on a appraisal and when he refused they said \" we wont tattle ''. So you know what, good riddance. I'm glad I asked that they be taken off my client list. I don't need a shady *** client like that. I just spoke with an appraiser @ HUD. She said it does not matter what the report is for, if there is an FHA case number, the property does not meet HUD 's minimum property standards and the report is 'as-is ', this is in violation of FHA guidelines and ( at a minimum ) the appraiser is going to get a letter from HUD. She said she wouldn't touch this assignment with a XXXX foot pole. I've asked them to reassign. \n\nhttps : XXXX The FHA appraisal report guide says to complete AS-IS when, - there are no repairs, alterations or inspection conditions noted by the appraiser ; Meaning by Cardinal Financial only accepting `` as is '' appraisals, it does not allow the appraiser to notate any needed/required inspections aka subject to which wouldve been required had the appraiser marked well and septic. Therefore they are bypassing FHA requirements and passing all liability to the appraiser/borrower. Essentially telling the appraiser we do not accept a property that requires further inspection which they would only know after the assignment has been performed and if you want the assignment/to get paid change it from subject to to \" as is '' and assume all liability. \n\nOn XX/XX/XXXX I sent the following to the FHA along with the amendment to the sales contract notating the property was well and septic. \n\nI have not received any communication on the below information provided proving the lender Cardinal Financial was aware the property was on private septic and well. Not to mention the XXXX stated the same. You are creating a culture of irresponsibility by not holding your FHA lenders accountable to the rules you created. You are providing the loophole for the lender to get away with great harm to both the borrower and the appraiser as you will see below multiple questionable practices from Cardinal Financial persuading appraisers to \" look the other way '' as was done in my case leaving me and the appraiser holding an over XXXX bill. Cardinal has stated to me personally that \" the FHA has investigated the matter and have not requested any additional information. '' If the FHA does not care to hold them accountable then it falls on the borrower and appraisers liability insurance with zero consequence to them and at a cost of foreclosure to the home owner. \n\nAs of XX/XX/XXXX I have not received a response yet the FHA states Lenders are responsible to determine if any repairs will be required to meet HUD Handbook standards. Lenders are reminded they are responsible for the acts of their agents, including appraisers When lending to low- and moderate-income borrowers, lenders are expected to use professional judgment and rely upon prudent underwriting practices in determining when a property condition requires additional inspections or repairs. \n\nConditions that would warrant additional repairs include those that pose a threat to the safety of the occupants, jeopardize the soundness and structural integrity of the property, or adversely affect the likelihood of a low- or moderate-income borrower from becoming a successful homeowner. \n\nIn the appraisers responses during discovery to my attorney and Is requests for communication with the appraisal management company she provided documentation from XXXX XXXX stating Cardinal needs to perform an appraisal compliant to FHA rules and regulations to determine the property does not qualify on XX/XX/XXXX. \n\nAs of XX/XX/XXXX Cardinal Financial has refused to do so. \n\nBoth the FHA and Cardinal have attempted to deflect to my personal home inspection.\n\nTodays question : Is a home inspection required when using an FHA mortgage loan?\n\nThe short answer is no. \nAgain, this quote comes from HUD, which is the federal department that oversees the Federal Housing Administration mortgage insurance program. They are the official source for all guidelines and requirements relating to this program. And their disclosure clearly states that a home inspection is not required when using an FHA loan. \nFor a Federal Housing Administration ( FHA ) loan to be approved, the home must pass an FHA inspection and appraisal. That means it must be worth the purchase price and have such basics as electricity, drinkable water, adequate heat, a stable roof, fire exits and more. \nThey have also insultingly provided me with a document I signed entitled For your protection get a home inspection which directly contradicts the FHA appraisal definition by stating An appraisal is different from a home inspection and does not replace a home inspection. Appraisals estimate the value of the property for lenders. An appraisal is required to ensure the property is marketable. Home inspections evaluate the condition of the home for buyers. \n\nNote this document conveniently leaves out the following. \n\nFHA : When an FHA loan is being used, the appraiser has two objectives. Ask a qualified home inspector to inspect your potential new home and give you the information you need to make a wise decision. \n\nFinding problems with your home after closing is profoundly different from finding an error in the appraisal that would have disqualified the home and the loan from funding. \n\nTo be clear this is not about a broken or working septic system for that matter.
