Equifaxs Refusal to Investigate Based on Identity Documents is Misleading and Unlawful Equifaxs response claims it was unable to locate a credit file unless I provide a Social Security Number ( SSN ), full address, date of birth, and multiple forms of documentation. This requirement contradicts the provisions of 15 U.S.C. 1681g ( a ), which states that a consumer reporting agency must clearly and accurately disclose to the consumer all information in the consumers file at the time of the request, using reasonable identification. \n\nNowhere in the FCRA is a consumer required to provide a Social Security Number or multiple government-issued documents to obtain their credit report. The law explicitly uses the term reasonable, not exhaustive, and courts have held that the burden to verify identity must be balanced against the consumers rights to access and correct inaccurate data XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX \n\nBy insisting on excessive documentationparticularly when Equifax is actively furnishing derogatory information under my nameEquifax is effectively denying me access to challenge or correct my own credit file, in violation of both 1681g ( access to file ) and 1681i ( duty to reinvestigate disputed information ). \n\n\n\n2. Contradiction Between Their Claim and Public Records Equifax claims it can not locate a file under my name due to no recent activity or lack of SSN, yet continues to furnish credit data to third parties that impact my creditworthiness. This contradiction reveals either : Equifax is knowingly reporting unverifiable or misattributed data, or Equifax does in fact have a file, but is willfully refusing to disclose itan act that may constitute willful noncompliance under 15 U.S.C. 1681n.\n\nEither scenario results in harm to me as a consumer and violates my right to transparency and due process under the law. \n\n\n\n3. Unlawful Burden Shifting and Denial of Consumer Protections Equifaxs recommendation to contact the other two credit bureaus is a red herring. The FCRA imposes independent obligations on each credit reporting agency to : Provide access to ones file, Conduct a reinvestigation when a dispute is submitted, Remove inaccurate, unverified, or incomplete information within 30 days. \n\nEquifax can not legally defer its responsibilities to XXXX XXXX XXXX \n\n\n\nRequest for CFPB Action Given these failures, I respectfully request that the CFPB direct Equifax to : 1. Promptly disclose the full contents of any file they maintain under my name, pursuant to 1681g ; 2. Conduct a reinvestigation of the disputed entries I have challenged, pursuant to 1681i ; 3. Cease any further dissemination of disputed or unverifiable data until proper verification has been completed ; 4. Be held accountable under 1681n and 1681o for any willful or negligent refusal to comply with federal law. \n\nEquifaxs behavior, as documented, denies me fundamental protections under the FCRA and represents a pattern of obstruction that undermines the integrity of the credit reporting system. It was never my address. \n\nIn response to my complaint, XXXX sent me access to a questionnaire to fill out with detailed information about my credit history, and my personal information, including Social Security information. \n\nWhen I first learned of the credit companies misrepresenting my credit history in XXXX, I was asked to fill out such a questionnaire. At that time, I did give the credit companies access to all my personal information. I provided proof that my Social Security number belongs to me, but none of the credit agencies changed their misrepresentation in my credit report. XXXX claimed that the change could not be made because the information was a part of my credit history. It certainly was NOT a part of my credit history. My Social Security number has never belonged to anyone but me. The credit agencies would not change their fraudulent verification data in their computer system. The large number of credit agency information breaches justifies the Social Security Agency refusal to provide consumer data ( SSNs ) to credit agencies. \n\nThe questionnaire was a distraction. If I trust them again with all my private information, they do nothing to repair their fraudulent credit report. This was proven in XXXX. \n\nCRAs do not collect information from consumers, but rather collect it from businesses, including credit card companies, banks, employers, landlords, and others. When an individual applies for credit, the lender will pull their credit report from XXXX or one of the other CRAs to see if they have a history of repaying their debts. \n\nWhen consumers make a dispute, they often fail to get an adequate answer, or any answer at all, from the credit reporting company. \n\nSince XXXX, I found other irregularities. I was unable to open credit union accounts or get credit. For example, XXXX would have allowed me to put money into an account, but not to take money out ). My current landlord forces me to XXXX for a rent voucher to take with CASH to a distant cash-transfer location XXXX XXXX XXXX XXXX XXXX XXXX. They refuse to accept a check from a debit account, or to take cash to the rental company office in person. XXXX XXXX recently ( XX/XX/XXXX ) refused to open a XXXX XXXX deposit account for me because XXXX failed to verify me, claiming a Social Security number conflict. To some companies, XXXX reported that I had zero credit. \nTo avoid further fraudulent reporting, I cancelled all my credit cards. I never had a problem with my credit history before. I never wanted to deal with fraudulent credit card companies again. \n\nXXXX should have reported that I froze my credit reporting due to the companies misrepresenting my credit history. \n\nI do not accept XXXX response as constructive. They already know that my Social Security number is mine. They purposely set up their verification process to use fraudulent information. This is their policy. Many consumer complaints describe this process. I agreed to the terms, created the account under my legal name ( XXXX XXXX ), and began making consistent monthly payments of {$25.00} over the course of an entire year. \n\nDespite meeting all payment obligations on time and in full, I later discovered that not a single payment from this account was reported to any of the three major credit bureaus. When I contacted Self Inc. to address the issue, they claimed that due to an inconsistency in the last two digits of my Social Security Number, they were unable to report my account to the credit bureaus. \n\nThis explanation is deeply flawed and unacceptable for several reasons, both legally and ethically. \n\n\n\nKey Violations and Concerns 1. Negligent Identity Verification Self stated in writing that they are required to collect and verify Social Security information during the application process. However, their system failed to detect a mismatch in my SSN at the time of account creation. Refusal to Refund Funds Collected Under a Faulty Account Self refused to refund the funds I paid over the year, claiming the account does not belong to me because of the SSN mismatch even though : It was created in my name. \nIt was tied to my email. \nI was the one making the payments. \nThey maintained contact with me and confirmed the account history. \n\nThis results in a highly disturbing contradiction : Self took money from me for a service they say they couldnt provide, and then claimed Im not entitled to reimbursement because of their own verification error. \n\n\nPersonal and Financial Impact This experience has caused me severe emotional distress, as well as real and measurable financial harm : I entered this program specifically to improve my credit score in preparation for major life goals such as securing business credit, auto financing, and potentially homeownership. \nAfter a full year of paying diligently, I discovered zero progress on my credit due to Selfs internal failure. \nI was denied opportunities because of a credit score that should have improved under this program. \nI now have the additional burden of pursuing legal action and filing regulatory complaints just to reclaim funds and ensure my credit report is clean and accurate. \nI also have audio recordings of Selfs support team confirming the verification failure, which supports my claim. \n\n\nRequested Action I am requesting that the CFPB compel Self Inc. to : 1. Provide a full refund of all funds paid into the Credit Builder Account.\n\n2. Acknowledge in writing their verification failure and contradictory reporting behavior.\n\n3. Permanently correct or remove any false or partial credit entries from my report.\n\n4. The CMA is not above the law, and it can not excuse American Express from complying with statutes such as the FCRA, Fair Debt Collection Practices Act ( FDCPA ), and the Truth in Lending Act ( TILA ). Furthermore, any agreement allegedly entered into becomes null and void when the institution fails to provide required disclosures, such as the right to rescind, and instead engages in fraudulent, misleading, and deceptive conduct.\n\nI have already lawfully rescinded any such agreement, and I do not consent to being bound by it. The CMA can not strip me of my legal rights as a consumer. \n\nXXXX. Cease and Desist Violations Your correspondence blatantly disregards my lawful cease and desist notice, intended to stop harassment, coercion, and intimidation over an alleged debt. Also on a phone call with a representative, Amex falsely implied that lifting this cease and desist would allow them to further assist me, a manipulative tactic aimed at coercing compliance. This is a violation of my right to limit or terminate communications regarding an alleged debt, and it exemplifies bad faith and predatory behavior. \n\nXXXX. Misrepresentation of Validated Debt Sending billing statements, transaction summaries, or the CMA does not constitute lawful debt validation under the FDCPA. I have repeatedly requested specific documentation such as : Full accounting ledger and journal entries, Documentation of all assignments, hypothecations, or securitizations, The original wet-ink signature contract, Records of tax implications or benefits accrued from my SSN-based activity, etc. \n\nYou have refused or failed to provide any of this. Sending billing statements does not validate debt, and your refusal to produce the original, lawful documentation proves your reporting is unverified and deceptive. \n\nXXXX. Falsely Claimed Accurate Credit Reporting American Express claims to be accurately reporting the account. However, you are reporting a closed account as delinquent, which is a direct contradiction and a misrepresentation of its status. A closed account can not be active in collections. Reporting such accounts as delinquent is deceptive and defamatory, and negatively impacts my credit profile without just cause. \n\nXXXX. False Compliance with Laws Your claim that American Express complies with all laws and regulations is disproven by your actions. You have failed to : Provide a proper and complete debt validation package, Honor my cease and desist notice, Accurately report the status of the account, Disclose my rights or lawful remedies, Respect my privacy and consumer protections. \n\nYour practices reflect constructive fraud, abusive and unfair debt collection, and manipulation of consumer data. \n\nYou cant & havent answered any of my questions or concerns nor have you rebuttal any dispute or affidavits delivered to you AMEX or American Express. \nYou constantly fail to throughly investigate the situation at hand, as my account has been under review for XXXX XXXX XXXX XXXX  years. \n\n\nFinal Position : I, The consumer, rescind all prior alleged agreements with American Express based on your deceptive, fraudulent, and rights-violating conduct. You have failed to provide any documentation I demanded forfeiting your right to collect any alleged debts. XXXX had more than 2 years to provide a legitimate response & you continue to clown, hindering my credit profile with the false reporting of this account regardless of the inaccuracies brought to your attention. Noncompliance & negligence of my consumer protection rights is vivid.
