Privacy Protection For Filings Made with the Court Primary tabs ( a ) Redacted Filings. Unless the court orders otherwise, in an electronic or paper filing made with the court that contains an individual 's social-security number, taxpayer-identification number, or birth date, the name of an individual, other than the debtor, known to be and identified as a minor, or a financial-account number, a party or nonparty making the filing may include only : ( 1 ) the last four digits of the social-security number and taxpayer-identification number ; ( 2 ) the year of the individual 's birth ; ( 3 ) the minor 's initials; and ( 4 ) the last four digits of the financial-account number. \n\n( b ) Exemptions From the Redaction Requirement. The redaction requirement does not apply to the following : ( 1 ) a financial-account number that identifies the property allegedly subject to forfeiture in a forfeiture proceeding ; ( 2 ) the record of an administrative or agency proceeding unless filed with a proof of claim ; ( 3 ) the official record of a state-court proceeding ; ( 4 ) the record of a court or tribunal, if that record was not subject to the redaction requirement when originally filed ; ( 5 ) a filing covered by subdivision ( c ) of this rule; and ( 6 ) a filing that is subject to XXXX of the Code. \n\n( c ) Filings Made Under Seal. The restrictions on public access to the motion and unredacted document remain in effect until a further court order. XXXX XXXX, XXXX. ) XXXX Notes on XXXX The rule is adopted in compliance with section XXXX ( c ) ( XXXX ) of the E-Government Act of 2002, Public Law No. XXXX. Section XXXX ( c ) ( XXXX ) requires the Supreme Court to prescribe rules to protect privacy and security concerns relating to electronic filing of documents and the public availability... of documents filed electronically. The rule goes further than the E-Government Act in regulating paper filings even when they are not converted to electronic form, but the number of filings that remain in paper form is certain to diminish over time. Most districts scan paper filings into the electronic case file, where they become available to the public in the same way as documents initially filed in electronic form. It is electronic availability, not the form of the initial filing, that raises the privacy and security concerns addressed in the E-Government Act. \n\nThe rule is derived from and implements the policy adopted by the Judicial Conference in XX/XX/XXXX to address the privacy concerns resulting from public access to electronic case files. See http : //www.privacy.uscourts.gov/Policy.htm. The Judicial Conference policy is that documents in case files generally should be made available electronically to the same extent they are available at the courthouse, provided that certain personal data identifiers are not included in the public file. \n\nWhile providing for the public filing of some information, such as the last four digits of an account number, the rule does not intend to establish a presumption that this information never could or should be protected. For example, it may well be necessary in individual cases to prevent remote access by nonparties to any part of an account number or social-security number. It may also be necessary to protect information not covered by the redaction requirementsuch as driver 's license numbers and alien registration numbersin a particular case. In such cases, protection may be sought under subdivision ( c ) or ( d ). Of course, that is not filed with the court, see Rule XXXX ( f ) ( the debtor submits this information ), and the copy of the notice that is filed with the court does not include the full social-security number or taxpayer-identification number. Thus, since the full social-security number or taxpayer-identification number is not filed with the court, it is not available to a person searching that record. \n\nThe clerk is not required to review documents filed with the court for compliance with this rule. As subdivision ( a ) recognizes, the responsibility to redact filings rests with counsel, parties, and others who make filings with the court. \n\nSubdivision ( d ) recognizes the court 's inherent authority to issue a protective order to prevent remote access to private or sensitive information and to require redaction of material in addition to that which would be redacted under subdivision ( a ) of the rule. These orders may be issued whenever necessary either by the court on its own motion, or on motion of a party in interest. \n\nSubdivision ( XXXX ) allows an entity that makes a redacted filing to file an unredacted document under seal. This provision is derived from section XXXX ( c ) ( XXXX ) ( iv ) of the E-Government Act. Subdivision ( f ) allows the option to file a reference list of redacted information. This provision is derived from section XXXX ( c ) ( XXXX ) ( v ) of the E-Government Act, as amended in XXXX. \n\nIn accordance with the E-Government Act, subdivision ( f ) of the rule refers to redacted information. The term redacted is intended to govern a filing that is prepared with abbreviated identifiers in the first instance, as well as a filing in which a personal identifier is edited after its preparation. \n\nSubdivision ( g ) allows an entity to waive the protections of the rule as to that entity 's own information by filing it in unredacted form. An entity may elect to waive the protection if, for example, it is determined that the costs of redaction outweigh the benefits to privacy. As to financial account numbers, the instructions to Schedules E and F of Official Form 6 note that the debtor may elect to include the complete account number on those schedules rather than limit the number to the final four digits. Including the complete number would operate as a waiver by the debtor under subdivision ( g ) as to the full information that the debtor set out on those schedules. The waiver operates only to the extent of the information that the entity filed without redaction. If an entity files an unredacted identifier by mistake, it may seek relief from the court. \n\nTrial exhibits are subject to the redaction requirements of Rule XXXX to the extent they are filed with the court. Trial exhibits that are not initially filed with the court must be redacted in accordance with this rule if and when they are filed as part of an appeal or for other reasons. \n\nChanges After Publication. Rule XXXX is intended to parallel as closely as possible Civil Rule XXXX and Criminal Rule XXXX. The Advisory Committees have worked together to maintain as much consistency as possible in the three versions of the rule. The rule has been revised to implement the several style revisions suggested by the Style Subcommittee of the Standing Committee. Subdivision ( b ) was reorganized and renumbered. Subdivisions ( b ) ( XXXX ) and ( b ) ( XXXX ) were added in response to suggestions by the Department of Justice. Subdivision ( b ) ( XXXX ), formerly subdivision ( b ) ( XXXX ), was amended in response to the suggestion of the Committee on Court Administration and Case Management so that the subdivision now refers to court records that become a part of the record in the pending matter. The term entity has been substituted for person in subdivision ( c ) and for party in subdivisions ( e ) and ( f ) to conform the rule to the definitions provided in the Bankruptcy Code. \n\nCommittee Notes on RulesXXXX Subdivision ( h ) is new. It prescribes a procedure for the belated redaction of documents that were filed without complying with subdivision ( a ). \n\nGenerally, whenever someone discovers that information entitled to privacy protection under subdivision ( a ) appears in a document on file with the courtregardless of whether the case in question remains open or has been closedthat entity may file a motion to redact the document. A single motion may relate to more than one unredacted document. The moving party may be, but is not limited to, the original filer of the document. The motion must identify by location on the case docket or claims register each document to be redacted. It should not, however, include the unredacted information itself. \n\n\nSubsection ( h ) ( XXXX ) authorizes the court to alter the prescribed procedure. This might be appropriate, for example, when the movant seeks to redact a large number of documents. In that situation the court by order or local rule might require the movant to file an omnibus motion, initiate a miscellaneous proceeding, or proceed in another manner directed by the court. \n\n\nUnless the court orders otherwise, the motion must identify the proposed redactions, and the moving party must attach to the motion the proposed redacted document. The attached document must otherwise be identical to the one previously filed. The court, however, may relieve the movant of this requirement in appropriate circumstances, for example when the movant was not the filer of the unredacted document and does not have access to it. I supporting documentation, as mention below. Fifth Third denied my dispute stating the transfer was valid despite approximately 40 pages of evidence I submitted that was ultimately dismissed with prejudice. I have edited out all identifying information such as name, account number, address, Social Security number, etc** On XX/XX/XXXX at approximately XXXX, I received a text message on my cell phone from XXXX XXXX thanking me for changing my password. Shortly thereafter I received 700+ text messages within a span of 30 minutes which locked up my phone. Fearing that every account I have was now compromised I began changing passwords as quickly as I could to limit the damage. Within the 700+ text messages I found the unknown party was going for my 2-factor authentication codes, allowing them access to not only financial sites but also sensitive information on XXXX and XXXX accounts. I was able to lock down the most important accounts within 20 minutes of the breach. I confirmed with my wife REDACTED that she was not on the XXXX XXXX website prior to changing all passwords. \n\nOn XX/XX/XXXX I discovered a {$2000.00} withdraw pending from my Fifth Third Checking Account REDACTED to a payee listed as XXXX XXXX XXXX bearing account number REDACTED. The XXXX XXXX XXXX account was added as a PAYEE ; a service we have never used before to pay bills or transfer funds. Neither my wife nor any of my extended family bank with XXXX XXXX XXXX. We immediately went to our local Fifth Third Branch in REDACTED and opened new accounts and put holds on the old. We were advised by Personal Banker REDACTEDr to dispute the {$2000.00} payment once it cleared. During this time frame I attempted to contact XXXX  XXXX XXXX both by phone and social media, but they declined to speak with me as I was not an account holder with them after providing my name and State of residence along with the account number. \nOn XX/XX/2019 I disputed the now-cleared withdraw with Fifth Third Bank customer service under case # REDACTED and were advised it would be investigated with an Investigator being in contact if more information was needed. In the mean time the identity thief opened up an XXXX XXXX  checking account along with a XXXX credit card under my name. I began freezing our credit through the Big Three to prevent further accounts being opened fraudulently. \n\nOn XX/XX/2019, REDACTED called Fifth Third Bank to release the hold temporarily so that we could withdraw our direct deposit funds to pay bills. XXXX was advised by customer service that there was no update on the dispute case. The funds were placed in our new checking account and REDACTED contacted Fifth Third Bank once again on XX/XX/2019 to reinstitute the security hold. \n\nOn XX/XX/2019 I received a letter dated XX/XX/XXXX from Fifth Third stating the {$2000.00} payment was determined to be valid and that the dispute was closed in the banks favor. A customer service representative at Fifth Third Bank advised my wife and I that the Investigator made contact with XXXX XXXX XXXX and reported the account to which {$2000.00} was paid was under my name, REDACTED. \n\nOn the evening of XX/XX/2019, I was on the phone with XXXX  XXXX XXXX fraud line pleading my case that account REDACTED had no connection to me, other than having {$2000.00} of my money from Fifth Third Account ending in REDACTED. I spoke with REDACTED out of the XXXX, Maryland XXXX Fraud Department for approximately one hour. REDACTED was able to find the account and located the {$2000.00} payment that was credited on or about XX/XX/XXXX. REDACTED asked if I lived in Missouri to which I answered no, I reside in REDACTED. I gave REDACTED my name, date of birth, and cell phone number to compare against the XXXX XXXX XXXX account in question. Although he could not legally tell me the account holders name or phone number, REDACTED stated my name, SSN, phone number, address, and date of birth were in no way attached to the XXXX XXXX XXXX account ending in REDACTED. REDACTED advised I needed to file a dispute with Fifth Third Bank. I advised REDACTED that I had already filed a dispute with Fifth Third and that it was found to not be fraud according to their investigator. Perplexed, REDACTED continued to look into the account and found no notes on the XXXX  XXXX XXXX account in which a Fifth Third Investigator had reached out in regards to fraud. \n\nI wish to dispute the ruling of case REDACTED due to the following : 1 ) On XX/XX/2019 I was a victim of a security breach on my personal and financial accounts including, but not limited to : Fifth Third Bank, XXXX, XXXX, XXXX, XXXX XXXX, XXXX XXXX, XXXX, XXXX XXXX. The only known financial lost I have suffered thus far is {$2000.00} withdrawn to make a payment against XXXX XXXX XXXX account REDACTED. \n\n2 ) I did not authorize any payment to any XXXX XXXX XXXX account, including but not limited to account REDACTED 3 ) Fifth Third Bank advised the dispute from XX/XX/XXXX was found to be invalid and closed due to XXXX XXXX XXXX advising the account was under the name of REDACTED. \n\n4 ) Upon contacting XXXX XXXX XXXX independently on XX/XX/2019, I was advised account REDACTED listed owner did not match my name, date of birth, SSN, address, state of residence, phone number, or email. REDACTED of XXXX  XXXX XXXX Fraud Department advised there were no notes under the account in which any investigator made contact to confirm ownership of the XXXX  account ending in REDACTED. REDACTED completed his report while I was on the phone with him and advised it was being sent up to his superiors but that I needed to reach out to Fifth Third Bank. \n\n5 ) At this point I am being told by one large organization to file a dispute with a second large organization that dismissed my claim with no valid reason given. Attached to this dispute appeal is all paperwork I have gathered in regards to this breach, including but not limited to credits report showing I do not have nor have ever had a XXXX  XXXX XXXX account, credit or otherwise. \n\n\n\nAs a two-decade account holder with Fifth Third Bank, I perceive I am being given the cold shoulder with no explanation of why because I am not a multi-million dollar organization or account holder. I have had no problems with Fifth Third Bank in the past 20 years and have entrusted them with my lively hood. As a person wiser than myself once said, The Bank of Trust can only accept deposits ; there are no withdraws. \n\nAs a XXXX XXXX that has served for over 13 years in both REDACTED, I take my oath of Integrity very seriously. To be told an investigation took place and later independently discover the findings are based on falsehoods is, in lesser words, disturbing. XXXX XXXX can be seen on security footage walking the full perimeter of my home looking into the windows and taking pictures inside and outside of my home. XXXX attempted to open my side door but was locked. XXXX then banged on the side door which is when I opened my front door to gain an understanding of why he was at my home. He then told me he was there on behalf of Fay Servicing , LLC to conduct an occupancy check. I informed him that both he and Fay Servicing , LLC have full knowledge that I currently occupy the home. Where XXXX quickly excused himself and left. My husband asked what he was there for the man told my husband that I was committing mortgage fraud which is not true. My husband asked for his name and company. The man handed my husband a paper with a made-up company and no name was provided. XXXX XXXX Police was called footage was shared and a statement was provided. \n\nOn XX/XX/XXXX, Fay Servicing , LLC sent correspondence stating that I did not send them my tax information and that I was in violation of the IRS. The correspondence has the account number whiteout and when I called I was told I could not speak with anyone unless I provided an account number. I asked if they could look up my information with my address and phone number I was told no. \n\nOn XX/XX/XXXX, my mother Redacted had to go to the hospital emergency room due to all the stress. She believes someone is following her which I believe is because the same car she describes has been parked outside of my home right out of Security camera view. \n\nIve called Fay Servicing , LLC XXXX, XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, GA XXXX XXXX. No one will answer my calls. \n\nI've called XXXX XXXX XXXX ID : XXXX XXXX whose license is being used by Fay Servicing , LLC to do business in Georgia. XXXX XXXX stated that she does not work for Fay Servicing , LLC but has worked for Southeast Mortgage my original Mortgage Company before being sold to XXXX XXXX XXXX. Fay Servicing now uses XXXX XXXX  in correspondence which was not done until after speaking with XXXX XXXX. \n\nI've been getting harassing robocalls when reversed lookup it is the same robocaller associated with Fay Servicing , LLC, XXXX XXXX XXXX XXXX, and all persons mentioned previously. The numbers are masked by the XXXX XXXX, however, the true number can be verified through the robocall ers registration number and IP address. \n\nOn XX/XX/XXXX, I received notification through the Georgia Filing Activity Notification System that I solely sold my Deed. I spoke to a representative named XXXX on XX/XX/XXXX and he told me the review was completed on XX/XX/XXXX and would be sent out to me. I received the letter 10 days later on XX/XX/XXXX via regular mail. I have since sent a letter to XXXX XXXX, the CEO of LexisNexis, Risk Solutions. \n\nU.S. Bankruptcy Courts do NOT provide any information to credit reporting agencies, nor do they ever validate and/or confirm public records. It is the credit reporting agencies, and/or other third party providers ( LexisNexis ) who collect information regarding public cases from public records. Public records information is NEVER validated by the Recorder of Deeds nor the U.S. Court system due to the Fair Credit Reporting Agency PRIVACY LAW. Considering the information indicating a Fair Credit Reporting Act violation, the bankruptcy information currently showing under my social security number NEEDS to be PERMANENTLY DELETED from my credit report immediately. \n\nLexisNexis needs to provide me with copies of all documentation associated with this Public Record Account bearing either a court order to place this information in my credit report, or my authorization of release bearing my signature. I was never contacted by an insurance company, only the debt collector. I went to the police and filed a report, and while I was there the collector called and spoke to the officer. It appears likely that someone has given my name and filed a false insurance claim using my personal information. The debt collector was never able to tell me any thing about the accident, or the other party involved. \n\nI have repeatedly told the collector that I do not, and have NEVER owned or even driven the type of vehicle in question, and I was not in an accident of any kind in XX/XX/2016 as they allege. Correct, delete, or verify information within 30 days of receipt of a dispute ; and,4. Inform consumers about negative information which is in the process of or has already been placed on a consumer 's credit report within one month. \nBased on the Fair Credit Reporting Act, A furnisher of negative information must notify the person that they are reporting negative information on his or her credit report. Second, the furnisher must report accurate and factual information to the credit reporting agency. The Texas Federal Court informed me that they did not report bankruptcies to the credit reporting agencies.
