It is my belief this company is using a retaliation tactic to cause harassment against me, now by using my DECEASED, ex husbands social security number to create more credit fraud. \nPlease investigate this company, who had my ex husbands social security number, on loan documents from XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, XXXX XXXX, XXXX, CO XXXX. I had requested the loan be removed from collections with Performant  due to the death of the primary signer on XXXX Student loans that I co signed XXXX. That same day ( XX/XX/XXXX ) I went to the Chase Bank branch in XXXX XXXX ( XXXX XXXX XXXX ) with my mother 's death certificate to close her account, as I am the beneficiary of the account ( I am also the executor of her estate ). At which time I was advised by XXXX they could not close her account or let me withdraw any of the funds due to the negative {$99.00} XXXX hold on the account. Two days later XXXX contacted me and advised me that I could withdraw some of the funds from the account, but not the {$1200.00} representing her social security benefits that were electronically deposited to her account after her death on XX/XX/2021. They further advised me that \" XXXX '' requires a 120 day hold to allow the government time to reclaim the benefits. However, they are putting a 180 day hold on the {$1200.00}, and I would have to wait 6 months to receive the {$1200.00}. \n\nSubsequently, I have researched the \" XXXX '' they mentioned and determined they are not allowed to keep electronically deposited funds or put a hold on funds for her social security benefits that are deposited to the account prior to receiving notification of her death. I did not notify of my mom 's death until XX/XX/2021. In addition, they did not put a hold on the account until XX/XX/XXXX, which I assume is because that was the date that they too also became aware of my mother 's death. Please note my mother 's death certificate was signed by the coroner on XX/XX/2021. Please see below, from XXXX, XXXX XXXX, pages 4-5 : \" Requirement to Return Post-Death Benefit Payments It is important to understand that once a payment has been credited to payees account, it becomes the property of the account holder. In the case of post-death payments, the payments become property of the joint account holder or decedents estate. The government can not legally authorize or direct an RDFI to take funds already credited to an account and send them to the government. This is the reason that RDFIs are directed only to return post-death payments that they receive after they become aware of the payees death, using an R14 or R15 code. Such returns are legally permissible because the payments have not been credited to the recipients account and therefore have not become property of the joint account holder or decedents estate ... RDFIs are cautioned that Fiscal Service does not authorize or direct RDFIs to debit or otherwise affect the account of a recipient, including to return post-death payments already credited to an account. '' The XXXX further states on page 8 of Chapter 5 the following : \" No Holding of Payments Under no circumstances should an RDFI hold benefit payments indefinitely in a suspense account, or by any other means, nor should benefit payments otherwise be held if any of the conditions apply on when to return a benefit payment. Holding benefit payments may constitute a breach of the RDFIs warranty for the handling of federal government ACH payments under 31 CFR part 210 and could result in an RDFIs inability to limit its liability. '' According to the XXXX, it appears that Chase bank should allow me to withdraw the {$1200.00} as it was credited to the account on XX/XX/2021, PRIOR to Chase Bank becoming aware of my mother 's death on XX/XX/2021. Chase bank can not put any hold on the account, let alone for 180 days, on my mother 's account! \n\nChase Bank has cited the XXXX that they are required to hold the funds for reclamation from the Government. However, that is NOT what the XXXX requires of them. Evidently, according to the XXXX, what Chase bank should have done was flagged my mom 's account once they became aware of her death ( XX/XX/XXXX ) so no further government deposits can be credited to the account, not put a hold on previously credited government deposits to my mom 's account prior to becoming aware of my mother 's death. Then, if they receive government funds after becoming aware of my mother 's death, such funds should be returned to the government by the bank. What they can not do is put a hold on the account, for any time period, let alone for {$99.00} XXXX, and wait for the government to debit the account. \n\nThe 120-day rule in XXXX that Chase Bank cites for justification of putting a hold on the account, is not used for that purpose, but rather the 120 days is how long the government has to initiate a claim against the bank for not returning money the bank received AFTER becoming aware of her death that they should have returned to the government. My mother has not received any social security government benefits AFTER the bank became aware of her death, so no funds should be returned to the government. Theyve continued to deny it over and over and over again. I usually dont get a denial. They just dont upload the information. I now received my Social Security benefits to my XXXX  account and have been for nearly a year. Social Security has not been able get the money back from XXXX XXXX  as they no longer have that ability told me I have to do that. They did provide me with a letter that was certified in stamped, as I was told to do by a supervisor at XXXX XXXX, which I provided to them only to be told they no longer use that. At the time I open the account, Social Security had my mothers married name listed in place of her maiden name, which was just an error when the account was opened online. I took my mothers original death certificate and a certified copy of her birth certificate to Social Security for them to correct the record. That was done after I was receiving benefits onto my card. Ive explained all of this multiple times and my sister and my brother-in-law who is a licensed attorney in the state of California have tried to help me by writing a letter and they will not even reply to them, even though I provided them a declaration under penalty of perjury.  I am beginning to think the fraud is happening at XXXX XXXX as they dont want to give me any information or release this money. I have repeatedly asked that they just allow me to have it put on a bank account where I am receiving my Social Security funds at present. They have given me phone numbers and websites to attempt to do this, but it is only to set up your benefits or to change them from Social Security, but does not allow me to change the initial funds on the card because I am already receiving the money from Social Security to a bank account and Has no way for me to address just the funds on the direct express card. I cannot have a phone even though my sister has purchased me one. I do not have a computer or email that I am willing to give out. I do however use my sisters phone number and her email which is how I am contacted through Social Security and they have that information on file. I recently received a letter from direct express in the mail, where my mailman delivers my mail, which said if you suspect fraud contact us so I again contacted and said no this is my correct address. Im confirming to you but still they dont accept the ID. I was told one time that I didnt call within five days after it was faxed so its no longer valid. I was told another time that I sent in three items and you can only send in either a California ID or drivers license or birth certificate and Social Security card, so its been denied for those reasons even though I never receive anything in writing or an email, but when I call and Im told that. I cant find anywhere where those instructions are written and it seems arbitrary and capricious that theyre just finding ways to Deny my requests. My family had to support me for years and this is morally legally wrong that they are tiring up my money that has already been issued to me from Social Security at one time they told me I denied my own benefits and they were sending it back, which they never did. Rather Social Security requested the money For the entire time, and I have that letter, but they were told they could only send back one month this needs to be looked into and I have asked for supervisors many times I either told no or after holding for an hour to two hours to talk to somebody. I have to hold another hour or two to speak to a supervisor. I have literally spent hundreds of hours From phone calls on this matter. When i called XXXX to discuss the matter with them, the woman on the phone seemed understanding and asked if I had insurance. I said yes, but what does that matter, since I did not agree to services. She said, well as you can see, we gave you a cash discount on your bill, and if we bill your insurance it will be billed from the original amount, so your insurance will cover the difference of what is left on your bill, and we can keep the cash discount on there, so your balance will be {$0.00} and you will have no out of pocket costs. Therefore, even though I still felt I did n't owe the money, I reluctantly gave them the insurance information, which is in my husband 's name. They billed the insurance, but then took the cash discount off and never put it back on! So I got a new bill still owing {$860.00}! I called up to complain and all they told me was that when they bill insurance that they are not allowed to give the cash discount, so the woman I spoke to basically lied to me to get me to give up our insurance information! I told them that I was not going to pay it and that I could not afford to pay it. She said it might go to collections then. I figured that since they did not have my social security # or even my correct date of birth, and I never signed any of the typical financial agreements, that I would be safe from it being reported to my credit. Also, when the collection company received the bill, they sent me the typical disclosure letter that I had 30 days to dispute the debt. I sent them a dispute letter stating that I did n't consent to services and never signed any financial agreements. I asked them to prove where I agreed to pay for services and to send a signed financial agreement or to cease all collection activity. They never sent me proof. All they sent was a statement of the bill. This is not valid proof. Anyone could give my name and address and say that I should be the one responsible for the bill. The patient and I do n't even have the same last name, and they do n't even have my ssn, not to mention the fact that the date of birth that they have listed on file for me is wrong. I started to receive benefits from Social Security ( XXXX ) however before this took effect I was sued by XXXXXXXX XXXX did not attend court since I could not get counsel did not have assistance to do so. They gave me no opportunity for payment plan, but did later agree to the {$20.00} later after being sued having added an amount of about {$10000.00} or so to my debt owed to them. Corresponding with Attorney XXXX XXXX mentioned above. I have been making those agreed upon payments every since up until now XX/XX/XXXX previous I asked for the amount of how much I had paid they wrote back with about as I can somewhat remember {$2500.00} to {$3000.00} this was about a couple of years ago. The attorney I am now paying Stephen Bruce & Associates after they date XX/XX/XXXX is saying my balance is {$13000.00} and due now. Mailed by one of the lawyers of that firm XXXX XXXX XXXX, they previously wrote that I should give a phone number to be reached I did but they did not call. I sent {$50.00} from my Social Security Benefits that month instead of {$20.00}. They wrote again saying they are aware I have a job with XXXX XXXX in XXXX, XXXX and would garnish my check and if I would send and payment in the amount of {$250.00} no later than XX/XX/XXXX. I recently sent a money order of {$100.00} and told them I would send the rest on XX/XX/XXXX. Only since I do not want my check garnished I might possibly lose the Social Security Benefits since I must not go over a certain amount each month and I did. I have no other support except my job at XXXX and the benefits XXXX. There second letter is threatening and they are asked to reconsider by a letter written alone with the {$100.00} by me. I am not sure of my rights but did know they may garnish my check. I do not have a checking account since they did ask for it my check stub and last 2 pay period summary. I did not send those since like I said I would like to know my rights. The letter did say if they may set a payment agreement rather that the garnishing with my debt Visa from my job at XXXX XXXX XXXX, XXXX. I have been only working about 10 months. The had not every said they would garnish my Social Security XXXX benefits since I wonder about that as well. Is this legal procedure? \nThe letter reads : Dear XXXX XXXX Our client has requested that your file be reviewed for garnishment of your wages with XXXX XXXX. Despite my best and dogged efforts to retain the property since my parents deaths, and to personally manage these debts, Bank of America has refused to consider me for a loan modification, debt settlement or other home retention options. If this foreclosure sale proceeds I will lose my home without ever having been evaluated for a home retention program. \n\nMy mother and father passed away in XX/XX/XXXX and XX/XX/XXXX respectively. Their house was under water and had two mortgages. After my fathers death it was on the market for over a year and did not sell. As there are no assets, I have personally made mortgage payments, paid property taxes and insurance premiums and related expenses. I am not only the successor in interest, but am also the sole Trustee for a Trust, in my fathers name, in which the propertyand no other assetsis held. Still, as indicated in the included notices from XX/XX/XXXX and XX/XX/XXXX, Bank of America has denied my eligibility for any modification options based on the assertion that the borrower must be a living person. I have asked about assuming the loan such that I can be eligible for modification and have been told on multiple occasions that this is not an option. However, as successor in interest and Trustee, I should be afforded both rights. \n\nI was further denied by Bank of America the right afforded under Rhode Island state law to a foreclosure mediation conducted by a third party designated by the state. The law is intended to prevent foreclosures and insurmountable arrearages. Though the law states that, as heir of the mortgagor, I am legally entitled to this mediation, Bank of America denied me this opportunity since I am not the named borrower. Furthermore, I am currently unable to receive a statement on the account. I have been trying to obtain a figure showing what is due on the loan for the last three weeks, a process that I was told would take 48-72 hours, and despite multiple calls and hours on hold and requests to have this expedited, this figure has still not been sent. \n\nBank of America has repeatedly lost track of the fact that my parents are deceased. I have been in steady contact with them since XX/XX/XXXX to resolve this situation and, as shown in the provided document, Bank of America offered its condolences on the death of the borrower and requested a death certificate as recently as XX/XX/XXXX. As recently as last week I was told I was not authorized to receive basic information on the account. This has happened countless times in the last years despite having gone through the authorization process and sending the required documentation and death certificates on many, many occasions. \n\nFurthermore, I received a notice dated XX/XX/XXXX from the law firm representing Bank of America in the foreclosure sale which indicated that they had no documentation confirming I am the Trustee of the Trust in which the property is held. I have provided this documentation to Bank of America many times. This notice, which demonstrated a lack of even basic information about my being connected to the property, stated that they would be pursuing foreclosure. I sent the Trust documents directly to the law firm with signature confirmation but on XX/XX/XXXX I received a notice that a sale date had been set. A request I made in writing in XX/XX/XXXX to have the debt verified and the name and address of the original creditor provided has still not been met. \n\nThere is a first mortgage on the property, held by another investor and managed by another servicer, that is also in default and in foreclosure. Initially both this first mortgage and the HELOC were held by Bank of America but in XX/XX/XXXXBank of America sold the first mortgage. Rather than reviewing my eligibility for modification or letting me assume the loan, Bank of America took a loss in selling the first mortgage and complicated the situation greatly. Since then, Bank of America has essentially held the process of getting these loans resolved hostage. Bank of America has continued to refuse to review me for modification or for a settlement of the HELOC debt, thereby limiting my ability to achieve a long-term solution on the first mortgage as well. The first mortgage holder has said that they are unable to offer solutions until a resolution is reached with Bank of America. Bank of America is now saying that they will not let me modify or assume the loan because there is a first mortgage - a mortgage they sold! I have gone through the process multiple times of submitting cash settlement offers and packages as instructed with accompanying documents, only to be told upon following up, that the department to which I sent all these personal documents did not exist. This has happened several times. My hands have been tied. My frustration is beyond words. \n\nBank of Americas refusal to recognize my rights as successor in interest and Trustee has resulted in growing debts on the property and the exact type of high arrearage amounts that the RI foreclosure mediation law is intended to prevent. There are several thousand dollars due in back taxes, a tax sale scheduled, and the house needs extensive work. I would like to attend to these things, but without access to a long-term solution with Bank of America, it would risk my financial security and health. A copy of the law has been attached. Colorado law also states that failure to adhere to Colorado laws on security subjects them to punitive damages up to XXXX times the amount of the deposit. I never received ANYTHING until I received a phone call a few days ago at WORK from a debt collector XXXX ( Transworld systems ) saying I was being sent to collections. I asked for a verification of the debt, which I received on XX/XX/XXXX, and I have attached. I do not believe legitimate the verification is legitimate, as it just shows charges ; but no proof that any attempt was ever made by the XXXX XXXX XXXX XXXX to send me the charges. Again, I NEVER RECEIVED THEM. The verification provided by XXXX says that we owe XXXX dollars for cleaning charges ; however there has NEVER been a detailed account provided by the Links At XXXX XXXX of what each charge is is for, as REQUIRED by Colorado XXXX. \n\nThe second problem was brought to my attention upon receiving the verification of the debt. It lists the move out date as XX/XX/XXXX. Its showing that we should still owe {$400.00} in rent. This is a clerical error made by The Links at XXXX XXXX. The move-out date was XX/XX/XXXX NOT XX/XX/XXXX. The {$400.00} charge for gross scheduled rent is incorrect. We received the final amount due to The XXXX XXXX XXXX XXXX and it was paid on XX/XX/XXXX. We were billed correctly for the the 17 days of pro-rated rent and utilities ; for the amount of XXXX. This is in accordance with our move out date of XX/XX/XXXX. I have provided the final payment confirmation that was paid at XXXX XXXX for the amount of {$1000.00}. \n\nI have also attached XXXX emails sent by my wife to the XXXX property managers confirming she left our keys as instructed on the move-out date of XX/XX/XXXX XXXX Colorado Code XXXX XXXX - Property - Real and Personal Article XXXX - Tenants and Landlords Part XXXX - Security Deposits- Wrongful Withholding XXXX. Return of Security Deposit Universal Citation : CO Code XXXX ( XXXX ) A landlord shall, within XXXX month after the termination of a lease or surrender and acceptance of the premises, whichever occurs last, return to the tenant the full security deposit deposited with the landlord by the tenant, unless the lease agreement specifies a longer period of time, but not to exceed XXXX days. No security deposit shall be retained to cover normal wear and tear. In the event that actual cause exists for retaining any portion of the security deposit, the landlord shall provide the tenant with a written statement listing the exact reasons for the retention of any portion of the security deposit. When the statement is delivered, it shall be accompanied by payment of the difference between any sum deposited and the amount retained. The landlord is deemed to have complied with this section by mailing said statement and any payment required to the last known address of the tenant. Her insurance wasn't yet finalized and I was in a long drawn out battle to become the executor of my mom 's estate, then Covid hit and the courts were shut down, as well as most of the economy. \n\nTwo collection companies are sending my deceased mother collection letters, which they said Citizens bank authorized them to do so. The issue is Citizens bank already knew my mother was deceased. \n\nAlso, Citizens bank has added my name to XXXX 's, which is another reason I want to resolve this ongoing issue. \n\nI called XXXX collection dept. and explained the situation and I was instructed to go to a XXXX branch and show my mother 's death certificate, I went to the actual location where my mom opened her account. \n\nI was greeted by XXXX XXXX XXXX, the branch manager, although she couldn't assist me because she didn't have access to any information, to know where to start. \n\n\nShe was a loyal customer and the situation was not intentional by any means. Mom had a great relationship with Citizens bank. They stated that they needed verification documents of which I provided via email and fax. These documents included my birth certificate showing I am the son of both deceased borrowers and I sent them the copies of both death certificates. On XX/XX/XXXX, Mr Cooper filed foreclosure even though they knew I was repeatedly sending in information that could confirm me as successor in interest. I was confirmed as successor in interest on XX/XX/XXXX based on the very same documentation I had already been sending them since XX/XX/XXXX. I have a confirmation letter dated XX/XX/XXXX sent from Mr. Cooper to myself that states, \" We received your inquiry on XX/XX/XXXX, related to your interest in the above referenced property. We have received documentation that establishes your status as the confirmed successor in interest ... ''. \n\nAfter being confirmed, I started the process of trying to get a workout to the foreclosure. It was a very long process and I had to send in multiple Borrower Response Packages. The application for assistance was submitted with me as borrower and the co-borrower was left blank. I provided all of the documentation that they requested, such as bank information, check stubs, employment verification and a XXXX form to request my tax transcripts from the IRS. They approved my 2nd application for assistance on XX/XX/XXXX after I had moved into the home because Mr Cooper said that I couldn't get assistance unless the house was owner-occupied. I received a XXXX XXXX Streamline Loan Mod approval on XX/XX/XXXX and the 90 day Trial Payment Plan started on XX/XX/XXXX. I successfully completed the XXXX XXXX XX/XX/XXXX. \n\nAfter successfully completing the trial, Mr Cooper sent me a Loan Modification Agreement and Loan Assumption Agreement on XX/XX/XXXX. My information was the only information provided on the application for assistance and my information was the only information used to approve the loan modification. However, both agreements showed up with both my name and my spouses ' name. My spouse didn't give her information and was not included in any application. Nor did she sign anywhere to allow them to include her in assuming the debt. I had only asked to do a loan modification and willingly agree to assume the debt even though I am not on the deed. The deed still remains in both my parents names. But Mr Cooper will not accept agreements without my spouse also agreeing to accept responsibility for the debt. They want her to sign both the Loan Modification Agreement and the Loan Assumption Agreement which makes her liable for the debt even though she didn't sign the application agreeing to have her personal information included. \n\nThe last page of the Borrower Response Package that I signed as \" Borrower Signature '' and \" Co-Borrower '' was left blank, has a paragraph of which I agreed to disclose my personal information. However, my wife didn't agree to any such thing and I did not sign with the intention of giving Mr Cooper permission on her behalf to share her personal information. The only personal information that I agreed to be evaluated or shared with a 3rd party such as XXXX XXXX was strictly my information. However, they used the acquired tax transcripts to obtain and use her personal information and they included it in the agreements which she never wished to be a part of. \n\nI asked Mr Cooper to remove my wife 's information from the agreements and they refused to do it. Stating that she had to accept assuming the debt based on the fact that we are married. I feel that this is discrimination based on my marital status and forcing her to accept a debt that she didn't apply for is ridiculous. Mr Cooper is essentially saying that I can't own a house on my own without my spouse also being liable for the debt as well. How is it then that My wife owns her own house and I am not liable for her mortgage. Why can't Mr Cooper do the same? When she bought her house, I had to sign the mortgage paperwork as Non-borrower but at least her lender acknowledged in the paperwork that I am not liable. I am not on the deed to her house either. \n\nNot only are they saying that I can't accept the approved Loan Modification Agreement based on my information only only as borrower, they are also saying that I can't accept the Loan Assumption without also getting my wife to agree to be liable and with a paragraph included in the assumption paperwork that leaves the Estates of both of my parents liable for the debt as well. So they pretty much want as many people as possible to be liable. How is that legal? \n\nThe reason I am complaining is that I will lose the house I grew up in because Mr Cooper won't allow me to assume the loan as successor in interest and as the only borrower, because I am married. \n\nAlso, It took them close to a year to confirm me as successor in interest which allowed the house to get further and further behind. If they had confirmed me when I sent the first documentation ( which was the same documentation they used a year later to confirm me XXXX, then the house wouldn't have been in foreclosure in the first place and I wouldn't need a loan modification to stop a foreclosure action. Aren't they supposed to refrain from accelerating a loan when they are informed of the potential that a successor in interest exists or simply because of the death of both borrower 's? If so then how were they able to file foreclosure in XX/XX/XXXX when they acknowledged in a letter that they had received my information for successor in interest in XX/XX/XXXX? They knew my parents had both died and they still proceeded to foreclosure even after I had told them I would assume the loan. \n\nPlease help me get this resolved. It seems fraudulent to me that they could steal my wife 's information off our joint tax return copies when she didn't sign anything allowing them to use or disclose her information to anyone. Over the past XXXX and a half weeks, I have been managing the passing of a close family member, which required me to be away from home and unavailable. During this time, I did not have access to mail or critical documents. \nAdditionally, I encountered restricted access to your online and telephone platforms, which further limited my ability to communicate. I brought into the bank both a copy of my wife 's death certificate and a copy of the executor certificate issued by the XXXX XXXX ( NJ ) Surrogate Court confirming that I was the executor of my wife 's estate and had the authority, in all manners, to act in connection with her estate and her affairs. ( I am also her sole beneficiary and offered to provide a copy of the Letters Testamentary with the Will Annexed from the surrogate 's office confirming that I am the sole beneficiary of her estate, but that was not requested. ) I also signed all the paperwork the bank requested I sign, including the form of affidavit from the State of New Jersey confirming that I was the deceased 's husband so that no NJ Inheritance Tax was due. However, instead of closing the first account and giving me the funds and changing the second account into my name, the bank branch employee said he couldn't do that and had to send everything to Bank of America 's Estate Unit and that they would close the account and send me the funds. And my spouse had his own business and was doing quite well at that time. \n\nIn XXXX I had a company try to help me get the loan modified but the XXXX people would not return the calls from the company called XXXX XXXX  XXXX XXXX XXXX ( XXXX ). The only thing they were able to do was to help get my spouses name removed from the deed and the city and county tax records, in case at a later date I was able to get XXXX to work with me.. Though they continued to send me letters threatening to foreclose, I made my mortgage payments and tried to find a way out. The way out was to refinabnce the property and get out from under XXXX. I was unable to get the property refinanced because I had a bankruptcy from XXXX. And because of the value of the property versus what was still owed on it. \n\nSo I had an independent appraisal done and discovered the property was only worth {$72000.00} and I still owed {$100000.00}, and I had recommendations to try to get the company to do a loan modifcation, XXXX said no. Said the original owner would not agree. So short sale or deed in lieu, pay it off. I could not pay it off. So the collection attempts continued. \n\n\nAnyway before they passed my contract to my current collectors XXXX ( XXXXXXXX XXXX XXXX ) in XXXX XXXX. I had them to send me a copy of all my payment records, I had only been late once in the 20 years. Which is why I could not understand them trying to foreclose and take my home I was not behind or ever late. But I finally agreed to a Deed in Lieu, and then everything changed when XXXX took over. \n\nI had already purchased a new home by the time they told me in XXXX XXXX that they would not agree to a deed in lieu. I tried to have the realtor who sold me my current home to do a short sale on the property, but my realtor got back to me and said XXXX would not work with them. They asked what should they do. I said nothing I could do. \n\nEventually they said we could try to do a deed in lieu. I was bombarded with forms with the same forms to fill out and to send to them. At first their main sticking point was my spouses estate. My spouse had no other heir but me, so his name was removed from the the property. But XXXX insisted on 'paperwork '. Finally after many attempts to get them to accept his XXXX certificate ( They had asked that when I send it in to them the third and fourth times to make sure I put the account number was on the certiciate,. But when I asked specifcally what was wrong with the certificate, why they were not accepting it. I was told by writing on it that made it a voided document ). I sent 7 copies to XXXX of my husbands death cetificate to them and I was only told on XXXX XXXX XXXX that the issue of the XXXX certicate was resolved. \n\nYet we proceeded on with the deed in lieu, And at one time after several people showed interest in buying the property I contacted XXXX gave them the names and information they requested on 2 separate realtors, but no one was ever allowed to work with XXXX toward a short sale. Then back to the deed in lieu because you can not have someone try to short sale if you are working a deed in lieu. So we tried to do a deed in lieu again and I was bombarded with forms to fill out. However when I sent in the forms the main sticking point was my spouses estate. For months I tried to get a lawyer but just could not afford one to get me in court to get the estate probated. Fimnally I was advised to call the court and explain my situation the fact that I could not afford a lawyer and ask if I could get in court. But probate court clerk said the process had been completed, there was nothing else to be done and there would not be a court date. The XXXX people told me at one time they had spoken to my souse and that 's how the knew I was a fraud. Thats why after I finish speaking to them some of the people there do n't want to speak to me again. Anyway the process that had been done is sometimes done when there is only one heir. They told me where I could find information about the type of procedure that had been done on line and give it to XXXX. I found the information and sent it to them but since they never acknowledge exactly what they responded too when I 've sent them information. And they never said anything else about it I did not know til now that the issue is resolved. I only found out because they keep calling me sometimes twice a day, they send me uninformative letters sometimes 3 a week. But after contacting the better business bureau the Onbudsman from XXXX did contact me and said at least the issue of my spouse is resolved. But all the forms that I have sent by mail, FAX email and on their site has a shelf life and may have to be done over, I explained that my tax returns form XXXX will not change no mater how long they keep them. And I have filled out so many Form 4506 T, & TEZ for my tax info from the IRS, I can not believe they will send them again. Likewise my income information, All my income is from the Gov., Military Retirement, Military XXXX, Civil Service Retirement and Social Security. I have sent them the printed information directly from these agencies and they will not change in a year. This too is harassment. Whatever info on Home Affordable, or HUD forms will not change. The reason I am at this point in my life will not change. I still do n't have anyone who is obligated to help me pay my bills, I am still XXXX XXXX XXXX and not self employed The only thing that will change is my bank information. If they ask for a copy of a statement on the first I might have {$8000.00}, but on the second or third not so much because I have to pay my bills. So there might be {$1000.00}, but I am not interested in putting one red cent into that property. But effective XXXX XXXX XXXX I will send them a copy of everything I have signed inlast 60 days every tax form, bank statement and copis of the 10 pages of info I sent on line. Have it copied and ready to drop in the mail as soon as post office opens. By regular mail I caanot afford certified mail just to have them tell me ythe initial on the form does n't belong to anyone who works there. \n\nRecently ( XXXX XXXX XXXX ) while working on refinancing my new home XXXX was contacted about the amount owed on my property that they are managing, XXXX had my mortgage Co. get me on the phone before they would give them the information. That was fine except while the mortgage company was clearly still on the phone XXXX rep told me that my property was in foreclosure and the date of foreclosure was being sent to me as we spoke. When I asked what about the new deed in lieu we were working on? That I just completed the paperwork online the night before. since the paperwork from XXXX XXXX was decided they could not do the deed in lieu. He said 'oh yes I see we have an application ''. So my new mortgage company representative asked that person point blank \" Sir do you have an application on file for the deed in lieu and is that package complete ''. The XXXX representative said 'let me verify ' then came back and said 'yes we have everything we need '. On XXXX XXXX I was asked for another hardship letter, a new Request for Assistance form. Thats the last letter I have received but the phone calls keep coming always some scare tactics or just hangup when I answer. \n\nI am not the first last or only person they have done similar things too. I know each case is different but I like every peson they are swindling know their case is individual. They can not or should not be allowed to handle ever case by thhe same standards. New Hard wood floors in XXXX, security system furnace and Air conditioner. I decided I had to move on. I have been trying to unburden myself with this property actually since my spouse XXXX that 's when they first started to talking about taking my home. Now all I want to do is give it to them and they are harassing me and delaying and checking my credit reports and making sure my credit is ruined and still have not done a thing to move forward.
