On XX/XX/XXXX, another attempt was made online to place a security freeze & receive a copy of my consumer report. \n\nAfter several attempts to contact them within 2 weeks with leaving voice messages, I receive no call, confirmation letter & PIN number if a security freeze, and no consumer report. On XX/XX/XXXX, I once again send an online request for a security freeze and consumer report. I try once again to contact Sagestream , LLC in regards to if they have received my Personal Identifiable Information & when will my security freeze confirmation and consumer report will be sent. It seems Sagestream , LLC, despite having a phone system set-up, no-one is every available at their offices. Despite calling numerous time and leaving voice messages, no one answers, calls get forwarded to voicemail, and no-one returns voice messages. \n\nOver 2 months has passed and they are harboring my Personal Identifiable Information with who knows who has possession of them. As well, I have not received my consumer report or confirmation of security freeze. Neither have I received one phone call or contact within that time confirming a freeze despite leaving voice messages several times within 7 weeks and calling during normal hours of business operation. On XX/XX/XXXX, I've decided once again to send a request via fax to Sagestream , LLC to the number stated on the site ( XXXX ) .I 've sent the fax twice containing my Personal Identifiable Information to secure a security freeze and request consumer reports information. Also, on the same day, I've sent a request for a freeze and consumer report via registered mail to their P.O. Box in XXXX XXXX, California ( XXXX. XXXX XXXX ) with USPS Priority with Tracking Number XXXX XXXX XXXX XXXX XXXX XXXX. \n\nIt's been about 11 weeks since my first request, 7 weeks since my second attempt, and about one week since my last attempt ( and will be my last ) in regards to placing a security freeze and retrieving my consumer report. On XX/XX/2022, the company sent a response stating that it was exempted from both placing a security freeze and opting me out of their sharing of my consumer report in their offices as they claimed that the company does not offer direct to consumer products that may be opted out. The correspondence, which included two letters, used the Fair Credit Reporting Act Section 603 ( x ) to justify supposed exemption from placing the requested freeze and opt out. In response to the letters, I immediately called the company on the same day and attempted in vain to have the company place the security freeze and permanent out-out. I spoke with two male representatives, XXXX and XXXX, and both were adamant in the position and specifically stated that the company was content in its decision to not allow me to engage in my right to have a security freeze or opt-out. On XX/XX/2022, Early Warning Services LLC, sent to me a consumer report and the report included several pages regarding consumer rights and FCRA. The 15-page document on page 12 has a header that states verbatim \" CONSUMERS HAVE THE RIGHT TO OBTAIN A SECURITY FREEZE '' and under said header it goes into minor particulars of how consumers have a right to place a security freeze and sue any violator. On the same page before the section dealing with the security freeze there is a bullet point stating that I as consumer have the right to limit prescreened offers of credit and insurance. It baffles me to no end that Early Warning would send a consumer report detailing to me that I have the right to both place a security freeze and permanently opt-out of prescreened offers and yet also send to me correspondence detailing to me that it is exempt from such requirements. I did take the liberty to call the CFPB prior to this online complaint and was informed by the agent that she had no documentation on any such exemption of any CRA from adhering to the FCRA reporting requirements. And on the contrary, in my own research, I can find no such exemption for any CRA to not allow a consumer to engage in his right and place a security freeze or opt-out of the said CRA 's sharing of consumer information without the consumer 's express consent. And my research details that many other consumers have also had issues with Early Warning not placing security freezes or calling in to the company and having the agents tell them that Early Warning is exempt from placing such freezes because it is a specialty agency. I have researched the laws and the section that Early Warning likes to weaponize against consumers does not offer any type of exemption to any CRA to place security freezes or allow consumers to opt-out of the sharing of the consumer data. Please allow 5 to 7 days for postal mail delivery. '' First, I was not attempting to make a request to receive a copy of my credit report. Second, the fact that I have an open dispute with TransUnion about information contained in my file should not block me from temporarily lifting the security freeze which is in place. TransUnion is in violation of Nevada Revised Statute NRS 598C.350 [ Temporary release of consumer report upon request of consumer ], as the only requirements to temporarily release the freeze is that I provide sufficient identification to establish my identity, the PIN provided by TransUnion pursuant to NRS 598C.300 ( a ) ( 3 ). \n\nMy next attempt by calling the TransUnion automated voice response system at XXXX to temporarily remove the freeze. I provided all of the information required by law.\n\n15 U.S.C. 1681c-1 ( c ) ( 2 ) : This section of the FCRA requires the credit reporting agency to place the security freeze within one business day after receiving the request, and to provide the consumer with a unique personal identification number ( PIN ) that can be used to temporarily lift or permanently remove the freeze.\n\n15 U.S.C. 1681c-1 ( d ) : This section of the FCRA prohibits credit reporting agencies from charging consumers to place, temporarily lift, or permanently remove a security freeze.\n\n15 U.S.C. 1681c-1 ( e ) : This section of the FCRA specifies the circumstances under which a credit reporting agency may temporarily lift a security freeze, such as when the consumer requests it, or when a person has applied for credit in the consumer 's name.\n\nOn XXXX XXXX XXXX, Clarity Services Inc., responded to my request and informed me that the company required me to submit a copy of my social security card in order to implement the freeze. This requirement is in violation of my rights under the FCRA, as indicated above, as well as other relevant laws and regulations. It is not a necessity by law for Clarity Services Inc. to make this request for a security freeze.\n\nAccording to the FCRA, 15 U.S.C. 1681b ( c ) ( 1 ) ( F ), a consumer reporting agency such as Clarity Services Inc. must have a permissible purpose for obtaining credit information, and demanding to obtain a consumer 's social security card/number without their consent would be a violation of this section. Demanding a copy of my social security card without my consent for the purpose of placing a security freeze on my credit information does not meet this requirement.\n\nAdditionally, the FCRA 15 U.S.C. 1681b ( c ) ( 2 ) requires a consumer reporting agency to obtain a consumer 's written consent before obtaining or using sensitive information like their social security number and demanding a copy of the social security card without obtaining consent would be a violation of this section. Clarity Services Inc. did not obtain my written consent before demanding a copy of my social security card.\n\nFurthermore, FCRA 15 U.S.C. 1681b ( c ) ( 3 ) requires a consumer reporting agency to take reasonable steps to ensure the security and confidentiality of the information it collects, and demanding a copy of a social security card without sufficient security measures in place is a violation of this section. \n\nAs per the Health Insurance Portability and Accountability Act ( HIPAA ) it is illegal for a non-covered entity to request a copy of a person 's social security card. It is not a requirement by law for me to provide a copy of my social security card in order to obtain a security freeze on my credit information. I have a right to obtain a security freeze on my credit information upon my request upon providing reasonable identification like a government-issued ID. \n\nEven though placing a security freeze on my credit report does not prevent fraud from occurring, it can make it more difficult for someone to open new accounts in my name. I also know that it does not affect my credit score or prevent me from getting my free credit report. However, the credit reporting agency must place the freeze within one business day after receiving the request, and must provide the consumer with a unique personal identification number ( PIN ) that can be used to temporarily lift or permanently remove the freeze.
