Also when I use the number on the back of the card which I've done at least 10 times my call is simply dropped so I cannot verify my account. The verbal password that I gave them I've been using for probably close to a decade. I'm very frustrated the representative I spoke to said she was at the top of the security team she could not push it up any higher that the people she reports to do not take phone calls that she's heard of this problem other people that cannot find their account with the security experts and I just need to wait. I've also been told they have a system failure since last Thursday. So I cannot use my card, I cannot get into my information so that I can work on getting a refund/reimbursement for my child's school that I charged, I cannot get my credit that they owe me and I can't even close down the credit card.  The most frustrating thing to me is that the last woman that I spoke to said that there are several people that have this problem and it hasn't gotten to be a big enough problem that they're doing anything about it it was for the word she used. That she has no way to talk to anybody higher than she is she can only send them an email and I just need to wait until they respond. I have been trying to do a cash-out refinance with Rocket Mortgage since XX/XX/2021. The process is only supposed to take around 30 days, which would have had me closing on the week of XXXX XXXX. Originally, they told me I wasnt able to use my fathers social security income, which comes to me as I am his caretaker, although that was how I qualified to purchase the property to being with. The week of XXXX, on either the XXXX and XXXX, I was called and made aware that I have a lien from XXXX XXXX XXXX XXXX XXXX XXXX, which came from down payment assistance I received at the time of purchase. Rocket Mortgage intentionally contacted the wrong party, XXXXXXXX XXXX, in regards to paying off the lien. Rocket Mortage knew full well the lien holder was XXXX, as I received a call from the banker that it was there and was emailed information from the origination team regarding the same information. On XX/XX/XXXX, I called and was told that all of the payoff documentation was sent on that previous day, which would have been XX/XX/XXXX, and that it would upload on my account by the XXXX. On XX/XX/XXXX I notice that my online account hasnt updated, so I call to request an update. At that time, I was told that they never received any documentation. When I state to the individual, I was speaking with at the time that I was told that Rocket Mortgage has all of my information, they were unable to find any records of that call, even though they record and monitor every call. I upload the mortgage payoff amount myself and send them the instructions to pay off the lien, which I obtained from the lienholder itself. I call frequently after that and get a different answer based on what call center I get routed to. Over the next few days, I ended up speaking to someone on the processing team that suggested I just try to refinance, without doing the cash out, due to their difficulties with them getting the pay-off information from the lien holder. I call to speak with my banker to see if this is an option. Instead of my banker calling me back, the director, XXXX, calls me and tells me that I need to let them do their jobs. The next day, his assistant, to my understanding, calls, and reiterates the same thing and that they are experts. I iterate to both of them that if I didnt have to tell them who to call, maybe I would believe they were experts. As stated above, I reached out to the lien holder ( XXXX XXXX myself multiple time to get the information, and they send me a screenshot of communication they have sent Rocket Mortage, telling them what information is needed to calculate the payoff amount for the lien and this was dated XX/XX/2021. I call XX/XX/XXXX and ask to receive transcripts of the comments on my account so I can get a better idea of the status of my loan. I am connected with a senior research analyst and I discuss the problem with him, as what is needed is a preliminary closing disclosure, which was reiterated to Rocket Mortgage multiple times. That was in the disclosures and the emails. The whole premise was ridiculous. \n\nThe realtor contacted me to find out why the appraisal hadn't been ordered, I told her that the loan officer had not been in touch since we finished the home inspection that thursday. She told the Real estate agent that she had been unable to contact me. \n\nBottom line I asked for a new loan officer. The action taken was to assign a loan processor and operations manager. The previous loan officer 's narrative was that I was not responsive to her requests for information and I had not told her to correct the documents to add one loan and take off another. When the loan originator contacted me she explained that the loan was left off because it did not appear on the credit report. I wasn't aware of that but I did tell the loan officer ( that's how she knew about it ). \n\nNow I'm working with a processor who seems to still be working with the loan officer. The bank has not responded in anyway about my concerns with the loan officer. The loan officer is sending misleading documents to my realtor indicating documents that I did not complete. I did complete those documents, I was telling her about the other documents. She also sent this information to the realtor without my permission. Prime Lending did not assign another loan officer, she is still the assigned loan officer. \n\nThe documents that were sent to the realtor are not the documents that were needed to process the loan. The whole process is misleading and I'm stuck in the middle. The documents that were sent to the realtor are not the documents that were needed to close the loan. She was made aware that she did not list all the debts properly by me. It did not \" come to light '', I told her. \n\nThe realtor I am working with also said in her contacts with her she usually responded with she was unable to get certain information because she was not at her computer, etc .... She just fell off the face of the earth for 5 days and then told everyone that I was holding up the process. The person who hacked our account created all these to include payments to people we do not know and 2 transfers to a credit card ending on XXXX, which the hacker added to our account right before doing the transfers. They were only able to get {$50.00} out into their card, then removed the card from our account. \n\nAlso, the same day, a transaction charging a \" XXXX XXXX '' for services we did not provide that person ( because we do not know who he is! ) was reported as an unauthorized transaction for a total of {$240.00}. This case is filed by Paypal as Case ID : XXXX. \n\nThe day we get all this horror in our account, we try to contact PayPal to report the issue, and of course, customer service is unavailable due to the pandemic crisis. I understand the terrible threat this virus crisis represents to all businesses, but honestly, do not think that in an emergency situation such as a security concern, customers would have to figure out in their online platform how to file a claim and wait for the best, until they please to respond. In the meantime, you give hackers the opportunity to walk away with your money, with your personal and business accounts information, and with your privacy trashed. \n\nThe only way to deal with this claims is online, on a message center that glitches all the time. You have to wait 12-24 hours to get a response. In the meantime, you are going crazy as you know your bank accounts are susceptible to getting accessed and you loosing your money. \n\nI've been chatting and emailing PayPal since XXXX XXXX, 2020 until today, XXXX XXXX, 2020, still trying to resolve this issues. On XXXX XXXX I was able to speak with someone over the phone, the agent assured me they will be resolving the cases ASAP. \n\nUntil today, only case XXXX is partially resolved, because one of the CC transfers for {$50.00} is still not restored in our available balance. Fortunately most of the transactions in this case were chosen by the hacker to get paid from a business savings account that has been closed for 2 years now. And that was just by the grace of God! \n\nI had to place stop payments from PayPal from all my bank accounts to protect our funds ; I had to withdraw the little money in that account that is only being used for me to send money to my sister. She holds one of the issued debit cards to this account, so she can access funds when I deposit to her, but now we feel very insecure to use this. \n\nBut case XXXX is still active, they have not resolved it and they had no shame in sending me a message that this will be closed in favor of the sender! Can you believe? I have a whole record of the desperate messages I've been sending since receiving this notification on XXXX XXXX, 2020, as the PayPal system obligates me to respond to this claim, when I did nothing! My answer choices to the claim are non-applicable : - I've already shipped the product or provided the service - I've already issued a refund - I'll issue a refund to my customer and close this case I can not respond to this claim, which means the hacker will be favored, and the PayPal customer will be punished for something they did not do. And this is all due to their flawed automated system and their disgraceful policy and bad corporate decision to have this kind of situations handled by a machine rather than a human expert on security cases available immediately as a problem arises. \n\nI file this complaint not only to make you aware of this particular case, but that I'm sure this makes part of a huge wave of safety issues in the financial services arena. On Wednesday XX/XX/2021, at XXXX I contacted Albert support through text message at the following number 639-37 asking why my direct deposits were still pending and not yet made available to my account balance. I then was asked to verify my albert cash account phone number with a verification code sent to my mobile device. I received the verification code from this number XXXX ( XXXX ) XXXX at XXXX and verified the account as instructed. The support team responded at XXXX stating Hi XXXX - Our compliance team conducted a review of the activity in your account. The direct deposits that were sent to my account were in my name and is also my property which can be proved by the state of New Jersey and myself. So now in panic mode since the funds I have been waiting 4 months for are now not available to me I contact support again because I was not informed what external bank account my funds are being sent to nor a date as to when. This is the response I received from Albert cash support on XXXX XXXX at XXXX Hi XXXX Based on the pattern of activity, we identified transactions that are not consistent with Albert 's standards and guidelines. For security reasons, funds issued via federal payroll providers would require to be withdrawn directly through them. In the notice I presented to her, I go into more detail concerning the nature of the actual cash value items known as loans which are promissory notes. I instructed XXXX XXXX to deliver the notice to her branch manager and also informed her that the notice pertains to her also. Reply YES or 1 to authorize ; Reply NO or 2 To Decline transaction. '' I responded NO and received the response \" Thank you for confirmation transaction declined case ID # XXXX. '' As I was contacting Chase Bank at XXXX XXXX, I received an incoming phone call from the same number at XXXX XXXX  I was calling for customer service ( XXXX ) so I answered. The gentleman # 1 said his name was XXXX and that he needed to verify my Chase account because there were wire transfers by XXXX XXXX, XXXX XXXX, XXXX XXXX and XXXX XXXX. I told him I did not authorized any of the transfers. He verified my information, and even had an OTP code sent to my phone so we could talk further about my account. He also asked for my address and birthdate ( which is what Chase generally asks for to verify my account when I bank over the phone. ) From there, he alerted me my savings account was compromised and recommended that I transfer all my savings into my checking account. I told him I was not sure this was a valid call and asked to be transferred to a supervisor. He said he would transfer me to a supervisor at we got disconnected, so I called the Chase customer service number back at XXXX XXXX, only to receive a phone call from that same number at XXXX XXXX. I was connected with gentleman # XXXX, at which point I said I'd like to call back to Chase. He said this is an urgent matter and we need to work quickly as these transfers are scheduled to go through within the next 10 minutes. He walked me through what he explained was a reversal by processing a Wire Transfer and typing REVERSAL into the message field. I sent the first one to XXXX XXXX  in XXXX, AL at approximately XXXX XXXX  for {$3500.00}. He said typing reversal is so that the fraud department can flag the wire transfer and stop it from going through. As soon as I hit send, at XXXX XXXX, I received a call from XXXX. I put the first person on hold and answered the call, ( which I believe was the actual Chase bank calling to verify the funds transfer ). I told him I was already talking to someone from Chase about reversing the wire transfers and he told me to go ahead and hang up with gentleman # XXXX and to talk to him instead. I went back over to gentleman # XXXX and he told me that this was a known scamming number and to give him the number that was calling me. I believe gentleman # XXXX ( or possibly someone else ) then contacted my bank and posed as me to validate the wire transfer. ( I was given confirmation of this later by Chase bank ). He said he needed to transfer me to another gentleman with higher authorization because a wire transfer for over {$10000.00} was coming through. Gentleman # XXXX worked quickly to give me more information and instruction on processing what I thought was another reversal to another bank ( XXXX XXXX  in XXXX, FL ). I received another call from the XXXX number but ignored it as they'd let me know this was a scamming number. I NEVER AUTHORIZED ANY OF THE TRANSACTIONS THAT CAME THROUGH. The gentlemen that I was speaking to contacted Chase to verify and approve the transactions. He walked me through 2 more transactions, one for {$13000.00} and one for {$4500.00} before transferring me to another gentleman. ( With every transfer, each person I spoke to, I could hear what sounded like a chirping smoke detector in the background. ) This next guy said he needed to verify my account so asked me to enter my debit card number, expiration date and CVV. I said I didn't feel comfortable saying it so he had me enter it into the IVR. That didn't register for him so he \" reset his IVR '' and asked that I enter my debit card number and pin. He then said I needed to enter my existing credit card number that I had with Chase and I said I didn't think I needed to do that. I asked if maybe I should cancel both debit cards for me and my husband and get new ones. He read me the exact same disclosure about getting a new debit card that I have received from Chase, confirmed my mailing address and said I would get them in 24-48 hours. He also said he would like to follow up on XX/XX/XXXX with a phone call at XXXX to verify that the funds have returned to my account. I said that was okay and we ended the call at XXXX XXXX. \nI immediately called Chase back at XXXX and spoke to a customer service representative, letting them know that I was just scammed and that I needed them to check to see if the wire transfers showing as pending on my account were being reversed. I was told that they were initiated and were not reversed and that no one from Chase called me except to get authorization for the charges. This rep confirmed that they did receive a call from me to confirm the charges ( which is NOT a call that I made at all, and is why I believe the scammers used my information to call and approve the wire transfers. ) I told her it was imperative that these wire transfers get canceled or recalled and that I needed to escalate this immediately. While I was on the phone, attempting to recall the wire transfers, I received FOUR emails from Chase stating that my wire transfers were sent, as requested ( received at XXXX for transaction # XXXX, at XXXX for transaction # XXXX, at XXXX for transaction # XXXX, and at XXXX for transaction # XXXX. ) I was then put me on hold to prepare to transfer me and at XXXX, I received another text message from XXXX that stated Chase bank Alert A debit card pre-authorization hold of {$250.00} was added to account ****. Reply YES If valid, Fraud Reply NO, ; I did not respond to this text message. I was then transferred me someone else who verified my account and again told me that I initiated the wire transfers. I explained that I did, thinking that I was speaking to an actual Chase Bank representative but that I needed them to immediately recall ALL FOUR of those wire transfers. He said that he was filing a claim for a wire recall. I ended that call at XXXX XXXX. One hour later, not sure of what the resolution was going to be, I contacted Chase customer service again and got instruction that I needed to send a secure message through my online portal in order to initiate a wire recall and that no wire recall notes existed in my account at that point. Frustrated, I asked to speak to a supervisor who again told me that I initiated the wires so it is not considered fraud but that I will just have to wait 1 to 2 days to hear if they were successful in recalling the wire transfers. I have spoken to a total of 9 representatives at different departments by the end of XX/XX/XXXX, including one Virtual Banking Assistant named XXXX XXXX and none of them could give me a definitive answer as to whether this was being handled, if someone was working on it, or if there were any additional levels of security to protect my account since the entire account had been compromised in the last 24 hours. \nOn XX/XX/XXXX at XXXX XXXX  XXXX, I contacted the Chase claims department and obtained my claim # XXXX. I spoke to XXXX who told me that she does see an existing claim for a wire recall. I asked how I can find out the status of the claim and she said I would need to wait for a message to appear in my secure message center or for the funds to appear back in my account. At XXXX that same morning the scammers called me back ( from the cloned Chase customer service number ) to verify that the funds had been recovered to my account. I hung up and immediately called Chase and spoke to a customer service rep. I confirmed that a claim had been started for the 4 wire transfers that were fraudulent and asked if I could report someone impersonating Chase to gain information about their customers. She stated that they dont have a department that handles that and that they do not have control over scammers. \nOn XX/XX/XXXX at XXXX XXXX  I called and spoke to someone in the Chase Claims department about my claims and obtained confirmation that the wire recalls were going through and that the Wire Research Team would reach out to me on the secure message center with more information. I called back to the Claims department at XXXX inquiring about more detail about what I could do to ensure the wire recalls were being processed. That rep said they couldnt help me with wire transfers and so I asked to speak to a supervisor and at XXXX, I was transferred to a supervisor named XXXX XXXX I explained my situation to him and HE transferred me to a wire expert named XXXX, who was actually in the claims escalation department. She said that Wire Research team was working on my claims. \nFriday XX/XX/XXXX at XXXX, I called the Claims department after receiving secure messages referencing the FOUR totally separate claims ( for my ONE account ) with FOUR different reference codes. ( XXXX XXXX, XXXX XXXX, XXXX XXXX and XXXX XXXX ) I was given instruction in the messages for the largest transfer to XXXX XXXX  for {$13000.00}, to PLS SEND LETTER OF INDEMNITY TO WIRE-XXXX. I spoke to XXXX who said there were no updates. I asked to speak to a supervisor and she transferred me to XXXX who I explained my situation to and he said he needed to transfer me to the Money Movement Department. I spoke to XXXX in the department and she immediately started direct messaging with the Wire Research Team. I was advised that the Wire Research Team could not be reached by phone, only by secure message or message from someone in the Money Movement Department. She gave me that number ( XXXX ) She confirmed that a claim has been filed ( # XXXX ) and that the wire recalls were confirmed to be sent on XX/XX/XXXX ( one day after I called to report and request recalls ). She asked the Wire Research team to clarify what was communicated to me in the secure message : What is the Letter of Indemnity and who is this letter between, if I am sending it to the receiving bank? She said it is between me and the receiving bank. \nMonday XX/XX/XXXX : Called the number I was given for the Electronic Money Movement Department at XXXX to speak to someone who could send messages to the Wire Research Team . Spoke to XXXX who said that no one in this department could message with the wire research team. \nXX/XX/XXXX : I received two secure messages from the Wire Research team that stated that in order for my question to be answered about the Hold Harmless letter I needed to send to the recipient bank ( of which I only received the email address for XXXX bank and not the other bank that 3 of the 4 wires were sent to and not XXXX  where they were sent ) I needed to contact the Claims Department. I called the Chase Claims Department and asked my question and the person had no idea so I asked to speak to a supervisor. I spoke to someone name XXXX who stated that We are not able to pursue recovery for your wire recall and that I needed to work with the recipient bank. I asked if she could then message with the XXXX XXXX team to obtain MORE information about this decision and if it included not just the {$13000.00} wire, but the {$3500.00}, {$4500.00} and {$3500.00} other wires that were sent on my account. She said she had NO WAY TO MESSAGE WITH THEM. I told her how frustrated this made me because I have been contacting them every day for status updates and for CLEAR instruction on how to proceed and what I can do and have gotten nowhere. She stated that there are gaps in our departments and that we are not equipped to handle these things and that feedback has been sent on these things, maam. I asked her to clarify what things were being provided feedback on and she said your case. I asked what that meant and she just said unfortunately we are not able to pursue this wire recall any longer. I told her that I have already contacted the FBI, my local law enforcement, the FTC, the attorney general and am talking to the media about this. \nXX/XX/XXXX : Called Claims dept and spoke to XXXX. I asked if this crime had been reported to the IRS under the Bank Secrecy Act and she said she didnt know what that was so I asked to speak to a supervisor. I was transferred to XXXX, a Claims Supervisor, who stated this is not considered a crime or fraud because you were scammed. Because of that, we wouldnt have any knowledge of whether this was reported to the government or not. I advised her that Ive spoken to a reporter and she said she needed to escalate me to the Executive Office. I asked if thats all I had to say to be escalated and that I had notified several reps before her that I was speaking to the media. She put me on hold to transfer me but I got disconnected before that went through. \nXX/XX/XXXX Spoke to XXXX in claims who confirmed that Chase is not pursuing recovery of my funds through wire recall. I asked if this was for ALL of the wire transfers that occurred ( all 4 ) or just the {$13000.00}. I was not informed via message center or by anyone other than on XX/XX/XXXX that recovery was halting. She said all the transfer recoveries were stopping. \nXX/XX/XXXX Met with XXXX XXXX at the XXXX XXXX XXXX XXXX XXXX XXXX XXXX. I told her what happened and asked if she could find out if ALL the wire recoveries were ceasing or just the largest one. I also asked what the Letter of Indemnity was that I was told to send to the recipient bank in order to continue pursuing recovering the largest transfer of {$13000.00}. I gave her my Claim number as well as all 4 reference numbers for each of the wire transfer recalls. I also showed her a series of Secure Messages I received that I had printed out. She called the Claims Dept. and was told that she needed to direct message ( through a system called XXXX XXXX ) to the Wire Research Team. After speaking with them via chat, she was directed to talk to claims. She called back into claims, escalated to a supervisor who told her she needed to ask these questions to the Wire Research Team. XXXX advised me that the 3 transfers to XXXX Bank were still being pursued but that the other one was halted. She then showed me the Wire/ACH Escalation form that she submitted for all 4 of my fraudulent wire transfers. She advised me that a supervisor in the Executive Office would be contacting me and if they did not by Monday, to let her know and she would continue to help. She said she will be my point person going forward. \nI received a call from XXXX in the Executive Office Branch of Chase bank letting me know that someone named XXXX would be handling my case and calling me from XXXX ext. XXXX and that their hours are XXXX XXXX XXXX XXXX. My case is under review. \nI believe that the handling of this is flippant and negligent and I have no trust in my financial institution to work for my good. I do not believe that Chase appropriately and urgently requested a SWIFT Recall of the 4 wire transfers when I called in to request it ( as I was advised that they were not filed until one day after I called to have them recalled. ) I also did not give verbal authorization to Chase to process any of the wire transfers completed. The people committing this crime impersonated me, contacted Chase bank and authorized the wires to go through. Additionally, I have been advised that I need to send a Letter of Indemnity to the recipient bank of the largest transfer and was given an email address to XXXX XXXX  that is not for clients or customers, but to be used by industry partners. I believe that Chase is trying to shirk responsibility of this process. They stated that they could not speak to Citizens Bank and that they could not advise me on the potential for defaulting. \n\nI subsequently reached out XX/XX/XXXX about my concerns about the program via XXXX account portal. I expressed that I was worried about all the phone calls and would like to cancel my account with them and withdraw from their program. They instructed me to ignore the phone calls as this is part of the process. They told me not to make payments to lenders and that if I did, they can not settle my debt and that I would end up owing more as interest has ben accruing. They persuaded me at the time with scare tactics not to withdraw from the program and stated this is just how it works and they understood my feelings. Via email I was instructed to manage calls from creditors in in the following way : 1. Ignore phone calls from the creditors 2. If I did speak with a creditor, mention my hardship, but do not let on that I am working with XXXX and 3. Do not respond to creditor scare tactics when threatened with adverse action by creditors ignore it, as this will only delay my XXXX program. \n\nWhile I was reviewing the Legal Security Agreement they had told me to sign. I was receiving reminder emails to sign the document. The email stated This reminder will be re-sent every day until completed. This is a poignant example of the pressure they put on me throughout my involvement with the program. \n\nContacted them by phone multiple times about concerns : XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. \n\nXXXX presented themselves as experts with posts about student loans on their social media pages and numerous articles about student loans ( federal and private ) and repayment on their website. They knew that by not making payments as outlined in contract with the lender, it is broken and that there are few to no options to pull oneself out of default once the student loan is in default. XXXX misrepresented themselves as knowledgeable. In an article on their website : Why a Private Student Loan Can Be a Really Bad Option, written by XXXX themselves, they state You should be doubly sure that you would be in a position to make the minimum payments on your private student loan, even if life doesnt go as you had planned. Yet they pulled my private student loans into the settlement plan without my asking them to. \n\nXXXX refused negotiate/speak with my lenders and creditors on my behalf until I had put enough money away in escrow for them to negotiate. However, when presenting me with an Authorization to Communicate, they defined it in writing that this will authorize us to speak AND negotiate with your creditors on your behalf. On the Authorization itself it was expressed as hereby XXXX XXXX XXXX relief ( XXXX ) express authorization and/or permission to speak as an agent with the undersigneds creditors and to negotiate It goes on to relate all the ways in which XXXX can contact and work directly with the creditors. It was also instructed in an email to change your address and phone number with creditors to ours. \n\nI did eventually call Citizens Bank regarding my private student loans out of fear of default. The representative for citizens bank asked me to have XXXX contact Citizens bank to explain their role. When I called XXXX and requested they contact Citizens bank, I was told by customer support that we dont do that. We only contact your creditors during negotiation. I was instructed to cease contact with my creditors. \n\nI pulled one of my credit accounts from the program as I was able to settle it myself. When I expressed this to the XXXX, the woman told me that I should not have done that as they could have saved me more money if I would have waited a few years for money to build up in escrow. \n\nI made one final call to XXXX XX/XX/XXXX, recorded conversation. Asking them to do something to help me out of default since they work with private student loans. There was no remorse and they told me that unless I re-enroll with the program, they will not help me any further. \n\nThey also claim to stop creditors from calling incessantly, however, this was never done. Creditors were calling me, my family, and individuals I work with. I ultimately had to withdraw from the program and get a lawyer to have the creditor calls stopped. \nDisclaimers say that they do not provide advice, but articles they have written on their website state : we also focus on educating consumers across XXXX on how to best manage their money. This was withheld from me when I became fearful and felt threatened financially by both XXXX and my private lender Citizens Bank. \n\nWhen I pulled out of XXXX, I communicated fully with XXXXCitizens bank. I explained for a second time what had happened and my desire/willingness to get back on track as prior to XXXX I was in very good standing. I made my normal payment XX/XX/XXXX prior to the involvement of XXXX. When I withdrew I called to let my lender know that all I could pay on that day XX/XX/XXXX was {$150.00} as I had nothing more than that after paying rent that was due on the 1st. I set up another payment for the day I got paid ( which is only once per month ) for {$420.00} as this is what I was told I needed to pay. This was prior to my loan defaulting. Later in XXXX, I received a bill from Citizens bank stating that I owed {$2800.00}. I had just made a payment days prior and told that they would allow me to make payments to catch up. When the bill came, I assumed it was sent prior to my call with the lender. So I had made a payment for XXXX and Citizens Bank placed me into default XX/XX/XXXX and neglected to inform me that this was happening. I was under the impression that if I was communicating and making payments, I would avoid default. As the process was in place for default, no payment was made that month. \n\nI called in XXXX to set up regular payments. I explained the hardship in my personal and financial life as well as the fiasco with XXXX. They told me to pay {$750.00}, which I did on XX/XX/XXXX. They told me that they could not set up automated payments at the time and I would have to call each month to make a payment. I called on XX/XX/XXXX and made a payment of {$430.00} with a confirmation # XXXX, but was told just today XX/XX/XXXX that they weren't able to process that payment so they initiated the process to send my debt to a third party collection agency. As I was unaware that this was happening. I called on XX/XX/XXXX to make a payment of {$500.00} and was able to set up auto pay at that time. Last week I received a letter from Frontline Asset Strategies claiming that they now own my debt. I was confused and submitted a letter disputing the debt as I have been making regular payments and each time have been assured that I am ok. I spoke with an actual person on XX/XX/XXXX and they did not tell me that the debt was sent to collections. \n\nI received an email from XXXX XXXX XXXX  this morning stating a settlement offer is on the table that would change my debt from {$74000.00} to {$44000.00} as long as I make the lump sum payment by XX/XX/XXXX. My partner and I initiated XXXX loans to pay the settlement and I called Citizens Bank to discuss the transfer to collections as well as the settlement. The person I spoke to said that I was still enrolled in automated payments that they would be collecting and was not aware that my debt had been sold. When I asked about the settlement, she spoke to her supervisor and then came back and told me that there is no settlement and that they just accidentally sent my debt to collections. She told me that they will be taking the debt back from XXXX. Meanwhile, a call to XXXX  resulted in them saying that the settlement is on the table until Citizens takes the debt back, which could be tomorrow, next week, who knows? I have been jerked around by Citizens for so long and there has been SO much unprofessional miscommunication. They direct me one way, I go that way, then because of an error on their end, I am punished for it. XXXX was a person who mysteriously moved houses many times, and for some reason, the last time she was evicted from her home in XXXX XXXX fine apartment located in a luxurious area of XXXX, NJ. \n\nThe first time she started asking me for certain investments was in XXXX, which is where my tragedy beganinvestments of {$5000.00}, then {$10000.00}, and so on. I only knew about the operation superficially, and nothing concrete was ever shown to me because this business has the disadvantage of being difficult to control and not 100 % visible. Subsequently, these investments increased, and the most incredible part was that she began to give me supposed profits by depositing them into my account, but very cleverly, she would take them back by asking for more investment. using my chase bank account. \n\nThese investments were related to fruits and other products, but to be exact, I never saw invoices or anything concrete, just communications with a supposed broker ( who I assume is part of the scam ) who handles selling the product and managing the payment collection from the client. The broker would take their commission and deliver the money to the people or investors. \n\nMy initial investment reached a point where it bled me financially to the extent of bankrupting my company due to the lack of working capital, and I barely survived. I began a lawsuit thanks to the contracts and agreements that were electronically signed by XXXX, which were clear and well-drafted ( this lawsuit is currently in court ). \n\nThe total of the first investment, after calculating interest and supposed profits, was approximately {$220000.00}. This money was the fruit of my labor when I had my construction business. After some time, I learned there was a way to recover this money, or at least part of it, because there had been a loss, and the merchandise was damaged during the trip when it arrived in XXXX on XX/XX/XXXX. \n\nAnd then, coincidentally, XXXX had an accidenta car hit her. And supposedly, there was no one to inspect or take care of the cargo because the airline did not apply the required refrigeration for that shipment of pitahaya or dragon fruit. XXXX spent a long time recovering from the accident and operations, unfortunately, as I considered her my friend. \n\nI had never had any problems with banks, and fortunately, these were my savings and a large part of my working capital. So, during that time, I remained in contact with XXXX because her business model was profitable, but she liked to deceive people. I didnt realize this until later. Now, the second investment was practically forced on me ; otherwise, she would not give me the documents to collect that insurance and recover my money or at least part of it. \n\nAfter spending XXXX years in this situation trying to recover my money, I also suffered a fatal car accident on XX/XX/XXXX, where a driver crashed into my parked vehicle while I was waiting for the light to change from red to green. This accident destroyed my vehicle and left both me and my girlfriend injured. It literally paralyzed my life, and I desperately sought solutions because I could only survive with what little I made since I was not allowed to work due to the accident. \n\nIn XX/XX/XXXX, XXXX contacted me, telling me she had found part of the documents to collect the insurance, and she mentioned a very good business involving granadilla and basil, along with other plants. I took the precaution of having her sign another document, and this is where my tragedy began because I had a loan from XXXX XXXX. Since I was organized with my credit and tax obligations, she then told me about these businesses, saying there was already a client, etc., etc. \n\nShe said we needed to pay the supplier, a certain XXXX XXXX XXXX from XXXX who belonged to a company called XXXX XXXX S.A.S. and XXXX XXXX. Curiously, my loan had matured, and there was no more money. XXXX began to pressure me psychologically, saying that the payment had to be made as soon as possible. She would call me up to XXXX times a day or more. At that time, she was still in New Jersey. \n\nThe pressure and desperation were so intense that I finally gave in and managed to get approximately {$25000.00}. She told me to charge the card for a payment in my company, and in this way, I would access cash immediately because, according to her, she had no credit and did not want to miss this opportunity with XXXX XXXX and other clients who urgently needed the product. XXXX had a strange appointment in XXXX and came to New Jersey because she was supposedly living in Ohio, helping some friends with some businesses, from where she also mysteriously fled. \n\nI met with her because I picked her up at the airport, and she explained her new business to me. She said, \" Remember, we are going to recover the previous losses with this business. The client needs many weekly orders, and this will help us recover. '' Obviously, this was where the scam started.\n\nI managed to process the payment ; the money from my business credit card was deposited in two transactionsone for {$15000.00} and another for {$7600.00}, along with some smaller payments for FDA licenses, overdrafts, and transaction fees between banks. I have proof of all this. XXXX agreed and told me that to show that this was a transparent negotiation, I would have control over the bank account of her business, XXXX XXXX. \n\nThe surprise came when I saw the accounts had many pending charges, which I ended up assuming as the investor in this scam project. Besides that, she would send me countless XXXX conversations, supposedly with cargo managers, suppliers, brokers, and clients, along with many XXXX sheets with supposedly financial information. It was quite convincing, and she was now living in XXXX, Illinois, where she supposedly still resides. One detail to remember is that one of her past partners, a young man named XXXX, of Turkish origin, who was supposedly her star salesman and in charge of the company 's image and marketing, had control of the website and lived with her. After some time, I learned they had a terrible falling out, which led me to believe she also robbed him. \n\nThis man closed the website and limited his contacts completely, seriously affecting XXXX 's image in the market. I don't know how many people XXXX has robbed or scammed, but I do know she has moved to several countries and mysteriously disappeared from them. Without any reason, she pretends to be a supply chain XXXX and an expert in imports and exports. Heres the surprise : after forcing me to pay the amounts for the XXXX, which could never enter the country because it did not meet FDA or Global GAP requirements to be brought from XXXX to the XXXX. \n\nIt was almost {$15000.00} for the payment of that cargo, where I sent the money I could obtain from the credit card. I never received purchase orders, invoices, or anything to guarantee that I had paid for this product. I received some pro forma invoices with stamps and logos from a company called XXXX XXXX XXXX, XXXX. XXXX, and another for a payment of almost {$9000.00} that I made to XXXX XXXX. XXXX said that one company would be the supplier and the other the handler or the one who would pack and ship the cargo to the carrier. Everything perfectly fit the scam.\n\nI had already paid more than {$25000.00}, which wasnt even mine, and now I find myself paying off that debt. I learned that in the hotel where she was staying, they were going to evict her because the house she was supposed to rent as an office was not given to her. Another sign that XXXX is a shameless person who takes advantage of peoples goodwill. \n\nThe granadilla could not reach the XXXX, and once the supplier from XXXX, XXXX XXXX, told me that it needed to be moved as soon as possible because it was going bad. Thats when I started discovering more nonsensical things : neither XXXX had the super experience nor the logic in this business, and she didnt even investigate how products could be accessed in a country as demanding as the XXXX XXXX \n\nStrangely, the last conversation I had with the supplier was aggressive because I confronted both of them to see who was telling the truth. Of course, XXXX was caught in all the lies, but I had already paid, and there were no more options. There was one last card to playthe basilbecause it was accepted everywhere. But another situation arose : the basil hadnt passed the quality tests required by the United States, so it couldnt be shipped. This issue dragged on until this date, and the cargo handlers didnt have space, etc.\n\nNow the question is : if it were a big client, would they wait almost XXXX months to receive their product? Of course not. This money was also lost. There was no refund, no supplier, no client. this money was paid with my credit card from chase bank, and some money from my personal account i have never received any product i had purchased. \n\n\n\nI tried to outsmart her and found a company that handles international collections, including various types of insurance claims. This company claimed it could pursue the international collection of this debt against XXXX XXXX. However, my problems only worsened, as I was now entangled in an uncollectible matter, making me responsible for another obligation and introducing a new level of stress. The company had this case for almost XXXX months and resolved nothing. If the case was withdrawn, they would charge a high cancellation fee. Something tells me XXXX knew this person and that they were part of the scam. \n\n\n\nXXXX is someone whose appearance is perfect for manipulating and scamming others. Collecting this money was not easy, and the situation worsened as I still hadnt received any money, yet the credit card bills and the deterioration of my finances continued. This situation has been extremely painful, leaving me mentally destroyed and desperate, but I tried to stay calm and think of another strategy. \n\n\n\nI met some clients from XXXX, a serious and well-structured company called XXXX XXXX XXXX which coincidentally needed granadilla for export to XXXX and XXXX. XXXX contacted her suppliers in XXXX, claiming they had the required certifications for export to XXXX. However, another scam was brewing, as XXXX complicit supplier lacked the certifications for granadilla and only had them for other products. XXXX intended to make them pay a 70 % advance for the goods, which were to be shipped under the CIF incoterm. \n\n\n\nThe scam almost went through until the clients partners met and discovered that the certification process would take XXXX months, which would be a huge problem. The shipment was approximately XXXX pallets, worth about USD XXXX, the same amount she scammed me out of. XXXX has since remained out of contact, not answering phone calls or responding to any communications, even after promising to start making payments this month. She feels untouchable and seems to think that U.S. laws are a joke, as she didnt even bother to attend the court hearing for the lawsuit for the more than USD XXXX she owes me. \n\n\n\nWhen I think about how many people she has scammed, I estimate it could be around XXXX individuals. The problem they were facing was that each state has its own licensing fees, corporate taxes, and regulatory costs that XXXX  would have had to pay in order to do business. Thats when they cooked up the scheme. Instead of becoming licensed and registered in every state, XXXX  simply made up a trade name ( XXXX  ) that they could register in every state that would slide under the radar of the regulators. They made up the innocuous name XXXX XXXX XXXX and got to work. \nTheir scheme worked and nobody noticed that XXXX XXXX XXXX wasnt a corporation registered or licensed to do business in their state. There have been many experts to write articles about these scams and schemes used in the banking and mortgaging industries. We have had some insight given to us by such names as XXXX XXXX, XXXX XXXX and many others who were seeking to help people like us in this stand of a XXXXXXXX XXXX XXXX scenario. Well we know that XXXX  got cranking and created XXXX XXXX loans across every state in the country under the XXXX XXXX XXXX XXXXEspecially an average everyday working individual like myself, well what Do I know now through research and a few good Samaritans. \nThe catch is that a XXXX  such as XXXX  XXXX XXXX is not a legal entity. It is simply a trade name. A XXXX has no ability to own property, file lawsuits, or hold any security interests. \nAfter a little while some local recorders began to notice and refused to record the loans because the lender was just a XXXX, not a licensed lender in the state. At this point XXXX  decided to commit ANOTHER fraud by listing the lender on their mortgages as XXXX XXXX XXXX, a Corporation organized and existing under the laws of New York. With this subtle but incredibly fraudulent change, XXXX resubmitted the loans and they went through without a hitch. At this point no one realized that XXXX XXXX XXXX wasnt a registered corporation at all. \nAfter they made the loans, XXXX  never sold them to a securitized trust as they were required to do by the pooling agreements. Instead, the loans were controlled by Bank of America ( BOA ). As a result, BOA was collecting payments and foreclosing on loans despite the fact that it never owned or funded any of the actual loans. BOA continued the fraud with a few upgrades. \nAfter the creation of XXXX, Bank of America needed to find a way to make it so that XXXX could make no claims to the loans. What they did was get MERS to create an assignment on behalf of XXXX which assigned the loan to XXXX XXXX XXXX XXXX XXXX XXXX XXXX  or XXXX XXXX. After these fraudulent assignments, the bank attaches them to their foreclosure proceedings to trick the court into believing it is the legal owner of the loan. \nThis is all made even more infuriating when we have realized that all of these XXXX XXXX fraudulent loans have been fully repaid by taxpayers in the TARP bailout and by the various insurance companies who insured the securitized trusts these loans were supposed to be a part of. We now realize how our loan origination was changed and we know that The OCC was impartially part of or fully aware of many loan situation like mine under XXXX XXXX XXXX a stock company for XXXX  XXXX XXXX XXXX XXXX Its Successors And /Or Its Assigns A.T.I.M.A the address of XXXX XXXX XXXX XXXX XXXX XXXX, Tx XXXX, XXXX # XXXX Policy # XXXX Loan # XXXX TYPE of LOAN IMPOUND/OCC Notice # XXXX Effective Date XX/XX/XXXX. \n\nBased upon court records in 22 states involving lawsuits against XXXX that went to default judgment, including bankruptcy cases, it appears that borrowers were able to cancel approximately XXXX XXXX dollars worth of the fraudulent loans created by XXXX  with taxpayers money. \nCurrently, we also now know the more sophisticated foreclosure fraud designed by BOA which includes XXXX XXXX XXXX XXXX XXXX XXXX XXXX, and XXXX XXXX  XXXX is in full operation. Despite a second offer made as late as XX/XX/XXXX by XXXX corporate counsel to Bank Of America counsel to purchase XXXX  and stop the fraudulent foreclosures, BOA once again refused the offer in favor of continuing their enormous fraud. Here is how the fraud was being conducted by BOA on the XXXX XXXX loans that BOA did not pay a single dime for. Remember these loans were not funded by XXXX  or BOA. \nAs the loan servicer, investor, owner as stated by BOA and or parent company Bank of America N.A. makes its own determination that the loan is in default. It first notified us through its RAN network attorney at that time XXXX XXXX XXXX that it will begin foreclosure proceedings. Because of the foreclosure fraud committed during that time lasting for years by certain lenders in all 50 states, most states now have enacted requirements that the foreclosing lender produce documents attached to the foreclosure documents that prove they are actually the lender unfortunately Georgia is still a Title Theory State and people like myself solely have to rely on character of CPFB, or OCC etc to protect us the consumer. \nSo Since B of A and now Bank of America N.A. claim to have bought the loan from XXXXXXXX XXXX XXXX XXXX  they can only receive the rights that XXXX XXXX XXXX had. Which are no rights at all? You have to be, or have the Rights of, a Natural Person under the United States constitution. What is XXXX XXXX XXXX? It was a wholesale division of XXXX  XXXX XXXX. It was not in any way a legal business entity in New York and it was not a corporation formed under the laws of the state of New York as the note and Trust Deed state. They were at best a nonentity and at worst perpetrating a huge fraud on the entire industry and now the American people. Hopefully This summary will give you a more detail description of the situation since this complaint is not a single incident but several. \nWe contacted Sun Trust Bank on XX/XX/XXXX immediately after we noticed suspicious deposits made in our account to ask to freeze, block, close our accounts to prevent fraud from happening and also to unlink the checking and saving account to prevent overdraft transactions form taking place. We also called Sun Trust while unauthorized transactions were taking place asking Sun Trust to put STOP PAYMMENTS in place, freeze, block, close our accounts, and Sun Trust said that wasnt possible ( yet weeks later they started setting stop payments to some unauthorized transactions ) we feel Sun Trust failed to protect our account and they didnt take the time to understand we could not attend to a branch in person to verify our identity since we moved to XXXX   and Sun Trust Bank does not have any locations in XXXX  allowing more time to pass and more unauthorized transactions to post. There was a lot of confusion on various calls we made within the representatives some had little to no idea of the previous conversation we held with Sun Trust, they couldnt locate the notes or steps taken in previous conversations. We followed step by step all the procedures we were asked to follow in order to recuperate our money back and yet claim number XXXX was denied. When fraud was taking place in our checking account from XX/XX/XXXX to XX/XX/XXXX, I was attending work in XXXX XXXX six days out of the week. I work in XXXX XXXX as a XXXX XXXX and my husband was taking care of his XXXX XXXX   business in XXXX XXXX, XXXX  XXXX  for the holiday season, in fact he was there from XX/XX/XXXX to XX/XX/XXXX so we couldnt had made the disputed charges. \nOn XX/XX/XXXX My husband received a call from XXXX a Sun Trust representative her phone number is XXXX extension XXXX she asked which was our last legitimate transaction ; last transaction we made was on XX/XX/XXXX for a withdrawal made in XXXX XXXX, NV in the amount of {$200.00} plus a {$7.00} convenience fee for a total shown on the bank statement of {$200.00}. He recalls, XXXX also mentioned that after doing some investigation they could see the transactions were fraud and were made using a debit card to which he mentioned that it was not possible because he had the actual card with him. Whoever committed this transaction must had used a counterfeited debit card or some other method. We obtained a sales receipt from The XXXX  XXXX XXXX showings a XXXX name on it for a purchased made with our card information. XXXX let my husband know she was going to email a rebuttal form, we needed to filled it out, sign and fax them back in order to recover the funds ; these forms were filled out and faxed back along affidavit of fraud and a fraud charge list on XX/XX/XXXX by my husband. \nWe did not committed fraud, did not make nor authorized any transactions or allowed anyone to use or clone our debit cards. We really think that we are in this situation because of a security data breech Sun Trust was a victim of in XX/XX/XXXX in which the information of 1.5 million of customers was compromised and/or stolen. We dont think it is right for Sun Trust to deny our claim and feel so disappointed and powerless, yet hopeful that whoever receives this information in Sun Trust Bank really goes a step further and gets to the bottom of this case and approve a full refund in the amount we are owed of {$1700.00}. This claim was denied over an email received on XX/XX/XXXX XX/XX/XXXX received a call from Sun trust representative XXXX. she was going to mail some form that we needed to submit. \nXX/XX/XXXX we received a fraud charge list and an affidavit of fraud which XX/XX/XXXX we faxed back a fraud charge list and an affidavit of fraud to XXXX XX/XX/XXXX received an email containing a Rebuttal Form XX/XX/XXXX filled out rebuttal form and faxed to XXXX along a fraud charge list and an affidavit of fraud XX/XX/XXXX received an email stating that the rebuttal form failed to offer any additional details that would overturn the original decision rendered on our case. The only thing XXXX mentioned to include was our last legit transaction ; which we did include. \nXX/XX/XXXX contacted Sun Trust to ask which details they needed us to provide and they couldn't specify what information they wanted from us. We also requested a copy of all documents used in decisioning our claim XX/XX/XXXX contacted Sun Trust to follow up on documents requested, they said there were no records of such request and submitted a second request. \nXX/XX/XXXX followed up on the second request to obtain documents, once again Sun Representative stated there were no records, call was escalated to a supervisor and the request was submitted again for a third time. \nXX/XX/XXXX received an email stating that we had requested the documents and that such documents were enclosed. the only document enclosed was a copy of letter they had email us on XX/XX/XXXX. \nXX/XX/XXXX contacted Sun Trust again and we were told the case had been closed and that there was nothing else to be done. \nHi, I XXXX and husband XXXX opened a Joint checking and a savings account in XXXX XXXX  in XXXX with Sun Trust Bank. \nXX/XX/XXXX My husband called Sun Trust when we noticed suspicious activity posted on our checking account. We noticed two credits posted on our checking account # ending on XXXX on XX/XX/XXXX one credit in the amount of {$.00} cents and a second credit for {$.00} cents from XXXX The same day a debit in the amount of {$.00} cents was posted also from XXXX I knew my husband or I had never done business with XXXX using our Sun Trust Bank accounts so my husband contacted Sun Trust to express our concern of our account being compromised. My husband asked if there was a way to freeze or close the accounts, shut down the debit cards or other ways to protect our money and bank accounts. At this point they said, they were going to look into the matter and that they were going to open a claim ( Claim number XXXX ). They also advised us to stop by a branch to verify our identity. I informed them that stopping in person by a branch was not an option since my husband and I had moved to XXXX   and that Sun Trust didnt have any locations in XXXX. They also said, that they couldnt freeze the account and that we were responsible of any charges on the account. \nXX/XX/XXXX a debit from XXXX  in the amount of {$5.00} had posted, my husband contacted Sun Trust and let them know that it was not a legitimate debit and we wanted to opened a claim. We were given provisional credit for {$5.00} on XX/XX/XXXX. My husband also asked to escalate the call to a supervisor hoping that the supervisor could help us to protect the accounts and stop all payments, freeze or close the accounts, he was told, that they were not going to be able to stop any payments coming to the account. Again, we were told to stop in person in a branch. My husband explained once again that we no longer lived in XXXX  and that there were no branches in XXXX, that we needed to conduct business by phone, online or another way but one thing was clear that we needed help protecting our money. My husband tried to pursue our ways to keep us from losing more money since we felt we were on our own and that we could not count with Sun Trust to protect our money. We came up with the idea to ask Sun Trust for help wiring the money to another account under my husband name in another bank institution, he was told, they could not authorize the wire over the phone. My husband again asked them to set stop payments, to freeze, close the accounts, or to give us other options, the response from Sun Trust was, they could not help us over the phone and did nothing. My husband mentioned to them that he couldnt understand how our other bank institutions would block the accounts right away after they notice suspicious activity in the accounts and that Sun Trust wasnt doing anything about it even though we were calling to inform them of what was happening. He tried to reason with them telling them that if we were trying to commit fraud ourselves why would we be calling Sun Trust to ask to freeze or close the accounts, that It didnt make sense. \nWe were concerned about our savings account being linked to the checking account as overdraft protection and since Sun Trust Bank would not freeze, block close the account or do anything to protect our money from our checking account or stop any unauthorize transactions. My husband asked Sun Trust to unlink the saving from the checking to prevent funds being transfer to our checking account and protect our savings. Again, the response from Sun Trust bank representative was, that they could not unlink the accounts. At this point we are afraid, feeling powerless and in disbelieve that Sun Trust would not help us at all and fearing that all of our money could be at risk and we could be a victim of fraud and Sun Trust Bank was not willing to protect the accounts and/or our money. \n\nOn early conversations we held with Sun Trust there were many misunderstandings and confusion because every time we would be talking to a new representative and explaining the situation over and over again sometimes they couldnt find the notes that the previous representative had taken, and according to some representatives, sometimes there were no notes made we also feel Sun Trust representatives did not take the time to understand our situation of us not being able to attend in person to a branch since we live in the XXXX  and there are no Sun Trust locations in XXXX  this allowed more time for the fraud to escalate. We continue to monitored both accounts constantly for the next couple of weeks and we did not notice any unusual activity and thought Sun Trust had upped the security levels in our account and that our accounts were protected once again. \n\nXX/XX/XXXX, unfortunately what we feared and tried to prevent became reality starting XX/XX/XXXX. My husband noticed unauthorized transactions on our checking account and called Sun Trust Bank right away to notify them that there were unauthorized transactions on our checking account and wanted to freeze, block or close the account and also wanted to dispute all transactions on the account beginning on XX/XX/XXXX ( case number XXXX in the amount of {$1600.00} opened over the phone ). Again, Sun Trust said, they could not help us over the phone and to visit a Sun Trust branch, my husband told them we did not live in XXXX  anymore and needed help to resolve this matter in another way without us being there in person. He even asked them if we could give a notarized affidavit to a friend or family member so they could go to a Sun Trust Bank in our behalf. He explained to them how could it be possible that Sun Trust could not even help us to freeze or close the account to protect our money and the response was the same, that they can not help us over the phone. We were frustrated and told them how disappointed we were in Sun Trust, we expressed to them our past experiences with XXXX XXXX and XXXX XXXX XXXX these two bank institutions would freeze or block the accounts as soon as they detected suspicious activity and even went a step further and would contact us to verify each transaction. We couldnt believe Sun Trust would not protect our accounts even though we were calling them to report the fraudulent transactions once again and prevent more transactions from taking place. \n\nMore transactions continue to appear and the balance on the checking account started to run low and since the savings account was linked to the checking it was going to start to provide overdraft protection and we feared of losing all of our savings as well. We called again and asked to unlink the accounts before any funds from the savings were withdrawn as overdraft transfers and prevent losing more money. That fear became a reality as more transactions continue to post overdrawing the checking account at which point the money from the savings account started to provide overdraft protection to the checking account in the following amounts : XX/XX/XXXX overdraft transferred in the amount of {$400.00}, XX/XX/XXXX overdraft in the amount of {$140.00} and a final overdraft transfer on XX/XX/XXXX in the amount {$37.00} in a total of {$580.00} in overdraft transfers. Each overdraft transfers also triggered a fee of {$12.00} per transfer made adding up to a total of {$37.00}. We were able to unlink the accounts on our own after we did some research and were able to unlink our saving from our checking account using online banking on XX/XX/XXXX since Sun Trust let us know the bank could not unlink the account. Unfortunately, it took a few days for the change to go into effect allowing a couple more overdraft transfers to take place. \n\nXX/XX/XXXX. My husband called the fraud department at XXXX to open a dispute for fraud charges made now to the savings account ending on XXXX in the amount of {$5700.00} CASE NUMBER XXXX for the following charges : XX/XX/XXXX {$4.00} XXXX, XX/XX/XXXX XXXX  XXXX  bill pay {$2600.00}, XX/XX/XXXX XXXX  online payment {$3100.00}. This time Sun Trust Bank put a stop payment on all three transaction ( see documents attached ) we were happy to noticed how Sun Trust was finally catching up, understanding the situation and finally doing something about it. We were relief and wished Sun Trust would had taken the same steps since the beginning and had set those stops payments in our checking account as well. How is it possible they were able to take this step now, but they refused to set stop payments since the beginning in our checking account when we requested it a few times. \n\nOn this day my husband also contacted Customer Care Department to dispute the overdraft fees, they said they could not help him and asked him to contact Account Security Department at XXXX to help us make sure the overdraft protection from the savings to checking had kicked in and/or to help us unlink the accounts and ask how we could recover the overdraft protections fees. This time they were going to make sure what we have done to unlink the accounts using online banking had taken place and if for whatever reason the accounts were still link, they were going to unlink them themselves. We were happy to hear that and started to feel like Sun Trust was finally stepping up and started to do the right thing and help us, we started to regain a sense of trust worthiness in our bank institution once again and trusted they would recover our money and credit it back to us. \n\nXX/XX/XXXX, we received an email regarding case XXXX for fraud in our savings account XXXX. This email contained three written statements of unauthorized debit forms, in the amount of {$5700.00} CASE NUMBER XXXX for the following charges : First on XX/XX/XXXX from XXXX in the amount of {$4.00}, Second on XXXX/XXXX/XXXX from XXXX  XXXX  bill pay in the amount of {$2600.00}, third on XX/XX/XXXX from XXXX online payment in the amount of {$3100.00}. \n\nXX/XX/XXXX My husband received a call from XXXX a Sun Trust representative her line number is XXXX extension XXXX regarding case number XXXX in the amount of {$1600.00} from our checking account. In this call they talked about how Sun Trust had denied the original case that was opened over the phone. They discussed which was the last legitimate transaction we had made to which he let her know it was in XX/XX/XXXX for a withdrawal made in XXXX XXXX, NV in the amount of {$200.00} plus a {$7.00} convenience fee for a total shown on the bank statement of {$200.00}. She also mentioned that after doing some investigation they could see the transactions were fraud made using a debit card to which he mentioned that that was not possible because we had the actual card with. We are no experts but thats what the people that committed fraud does to make it look that way, or someone could have clone our card, etcetera there could be many scenarios, but for sure we did not make nor authorized any transactions or allowed anyone to use or clone our debit cards. Hackers hack accounts and still all the information they needed to commit fraud in many ways that we are not even aware of. This conversation made us recall a big breech Sun Trust was a victim of in XX/XX/XXXX about 6 months before we had this happened in our account. We believe we are victims of the security breech That Sun Trust went through in which an actual Sun Trust Bank employee committed this breech successfully stealing information of 1.5 million customers. XXXX let my husband know she was going to email a rebuttal form, we needed to filled them out, sign and fax them back in order to recover the funds ; these forms were filled out and faxed back along affidavit of fraud and a fraud charge list on XX/XX/XXXX by my husband. Please see documents attached. \n\nXX/XX/XXXX, we received an email from Sun Trust denying case # XXXX in the amount of {$1600.00} for fraudulent transactions posted on our checking account from XX/XX/XXXX to XX/XX/XXXX due to an action taken by SunTrust and that we would assume full responsibility for the debits and associated fees. To which we think it is outrageous since we did not make those transactions nor authorized them. Please see letter attached dated XX/XX/XXXX. Our debit card has a Mastercard logo on it and is our understanding Sun Trust as well as MasterCard have a policy that costumers are not responsible for fraud or unauthorized transactions. see letter is attached. We also didnt give much importance to the letter since we had just talk to XXXX the day before and we new a new action was taken and we had to wait for the rebuttal form and faxed it back. \n\nXX/XX/XXXX we were given a provisional credit in the amount of {$5700.00} from claim number XXXX XX/XX/XXXX, we called to inform Sun Trust of yet another unauthorized transaction in the amount of {$980.00} case number XXXX XX/XX/XXXX, received an email containing the written statement of unauthorized debit form in the amount of {$980.00} posted on XX/XX/XXXX case number XXXX. \n\nXX/XX/XXXX, we received a new email with the same forms we had received on XX/XX/XXXX for case number XXXX. My husband filled out and faxed the forms back on XX/XX/XXXX to XXXX XXXX XX/XX/XXXX. My husband called the fraud department at XXXX to let them know there were two suspicious credits in our savings account. On XX/XX/XXXX Credit from U.S Bank for $ .XXXXcents, on XX/XX/XXXX XXXX XXXX  credit for {$.00} cents and a Debit in the amount of {$.00} cents from XXXX XXXX on XX/XX/XXXX. The representative opened a new claim in the amount {$.00} cents for such transactions. \n\nXX/XX/XXXX, He also reported two pending transactions that were made in the amounts of {$200.00} and {$250.00}. The Representative stated, that there was not going to be a case number because the system was down at the moment, but that we would receive the documents for these cases over the mail that we needed to filled them out and mail them back to them. The Representative also mentioned, he was going to enter the information into the system when the system was back up and running. That he was also placing a stop payment on those transaction and that we would receive confirmation over the mail. \nThe representative also mentioned, he was going to contact the Internal Department on our behalf ( since he was not authorized to provide their direct phone number ) so they could freeze our accounts we were unable to go into a branch in person and also was going to ask them to set a NO DEBIT STATUS on the account so no new transactions would post on the accounts either by us or anyone else till the cases and investigations were completed. My husband mentioned to him how we just wish they would had taken such steps since we contacted them before the fraud had taken place on the checking and savings account, that we didnt understand how it was possible that we were told, they could not do anything to protect the accounts and set the NO DEBIT STATUS back then ; we contacted them before the transactions posted, and also while the fraud charges were occurring on our checking account and before they were able to make any overdraft transfers and also before fraud in the savings account started to occur in order to prevent all of this from happening. \n\nXX/XX/XXXX, my husband contacted Sun Trust to follow up on the claim he made over the phone the day before and also to double check and make sure the NO DEBIT STATUS was in place. The representative mentioned, the charges made on XX/XX/XXXX in the amounts of {$200.00} and {$250.00} had fallen out and that they were not going to show on the statement since they were not paid. On the same phone call, they confirmed the the no debit status had been placed. \n\nXX/XX/XXXX We re-open case # XXXX Sun Trust email us a fraud charge list form and an affidavit of fraud ; my husband XXXX XXXX filled out the affidavit of Fraud, Fraud charge List and faxed them back to Sun Trust for claim number XXXX in the amount of {$1600.00} from our checking account Please see attached forms that were faxed to Sun Trust. \n\nXX/XX/XXXX, opened a new claim in our savings account in the amount of {$4500.00} ( claim number XXXX XXXX XX/XX/XXXX my husband faxed a filled out written statement of unauthorized debit form that was email to us for case number XXXX. We received a full credit back into our account on XX/XX/XXXX as stated on a letter we received on XX/XX/XXXX from Sun Trust. \n\nXX/XX/XXXX, XXXX XXXX XXXX opened a new claim on our savings account in the same amount as before for {$4500.00} ( claim number XXXX ) this claim was denied on XX/XX/XXXX because it was considered a duplicate of case XXXX. However, we could see online therefore two different withdrawals made for {$4500.00} and we made both claims because there were to separate transactions at the time the claims were made. What happened was that there was the first withdrawal of {$4500.00} and when we contacted Sun Trust and opened case number XXXX, Sun Trust refunded the money or gave us temporary credit for the whole {$4500.00} then a second withdrawal or another attempt to withdraw {$4500.00} was made and thats when we contacted Sun Trust again and open the new claim for the same amount of {$4500.00} case number XXXX. Sun Trust had credited us both claims in the amount of {$4500.00} each but adjustments were made in the account and the extra {$4500.00} were taken back by the bank on XX/XX/XXXX. \n\nXX/XX/XXXX, we filed a new claim in the amount of {$980.00} for a charge made in the savings account. Case number XXXX Sun Trust put a Stop Payment ( see documents attached and payment was never made we received a full refund ) I mentioned to them that my understanding was that the account had a NO DEBIT STATUS in placed so no transactions were going to post in the account whether they were made by us or anybody else. how was possible that this transactions were taking place if the account had A NO DEBUT STATUS in place? \n\nI was told by the Fraud Support Unit that I needed to contact the CARE DEPARTMENT at XXXX to close or freeze the account, which it was exactly what we had asked them to do numerous times before. My husband contacted CARE DEPARTMENT and they transferred him to ACCOUNT SECURITY & CLAIM at XXXX he was on this phone call for about 178 minutes ( close to 3 hours ). He was given the following phone numbers SALES DEPARTMENT ( to open a new account ) they mentioned, we needed to open new accounts so they could deposit the credits from the previous claims and any money left on the savings account before they could close the savings account. XXXX, to close the accounts to contact CONSUMER CARE at XXXX and to follow up on case number XXXX and new case number XXXX to dial XXXX. \n\nXX/XX/XXXX, we received an email from Sun Trust containing a rebuttal form for claim number XXXX in the amount of {$1600.00} we were advised to mention on the rebuttal form which was our last legitimate transaction and to fax it to XXXX we faxed it back along the affidavit of fraud and fraud charge list forms to Sun Trust on XX/XX/XXXX XX/XX/XXXX, My Husband called to get help opening a new account. He was told they couldnt open an account for us at this point. They said for us to contact the Fraud Department to make notes on our current account before we would be eligible to open a new account with sun Trust. They transferred him to SECURITY DEPARTMENT to have it done ; however, the phone call dropped while holding to be transferred. My husband was given the contact information for a representative by the name of XXXX at XXXX at the sales department with extension XXXX to get help opening a new account. \nXX/XX/XXXX, we also received a call from the Fraud Department letting us know we had a credit of {$6100.00} as of XX/XX/XXXX in the savings account. This balance of {$6100.00} includes the funds from claim number XXXX in the amount of {$5700.00} and any money that was left on the original saving account. \nWe were expecting to have a total of {$6700.00} credited back to us in our account since that was the balance we had as of XX/XX/XXXX before any fraud occurred. They mentioned that there had been 3 overdraft transfers made to our checking account in the amount of {$580.00} that this amount should account for the difference. But is not the case based on the following math : balance in saving account as of XX/XX/XXXX before fraud took place {$6700.00} minus refund given to us in the amount $ XXXX {$580.00} that leave our savings account with a deficit of - {$5.00}. \n\nXX/XX/XXXX My husband faxed a rebuttal form dated XX/XX/XXXX for case number case # XXXX in the amount of {$1600.00} for fraudulent transactions posted on our checking account from XX/XX/XXXX to XX/XX/XXXX in which he states we wanted a full credit on our checking account for {$1100.00} which is the amount we had in our checking account as of XX/XX/XXXX before the fraud took place. My husband also stated we expected a full refund of {$6700.00} credited back in our new savings account since that was the balance as of XX/XX/XXXX before any fraud occurred. This was the first and only time we submitted the rebuttal form after we had our conversation with Sun Trust representative by name XXXX at XXXX extension XXXX on XX/XX/XXXX in our conversation, she mentioned that we should state which was our last transaction and on which amount and thats what we did. See documents attached. \n\nXX/XX/XXXX, Rebuttal form was received and updated in their system they said it could take up to 45 days for a final decision. I was advised to contact the SALES CONSUMER DEPARTMENT to open a new account. Customer Care Department at XXXX Opt XXXX. XXXX XXXX or XXXX ( dont know the right spelling ) ext XXXX XX/XX/XXXX, I received an email from Sun Trust in reference to case number XXXX from fraud in our savings account in the amount of {$980.00}. The letter stated that after investigating the claim they concluded the initial amount of {$980.00} never posted and that they removed the initial incident from the case. \n\nXX/XX/XXXX, new accounts were created checking essential account # XXXX we founded the account with {$500.00} using my husband XXXX XXXX Account. New essential savings account # XXXX Sun Trust transferred the funds from the old savings account # XXXX into the new savings account in the amount of {$6100.00}. Also, we agreed to closed the old savings Account completely. It took 3 months to close the account. \n\nXX/XX/XXXX, my husband contacted Sun Trust to follow up on case # XXXX after we had received an email dated XX/XX/XXXX stating the claim was denied based on the fact that the rebuttal letter we had Submitted failed to offer any additional details that would overturn the original decision render in our case. My husband asked the representative to help him understand which additional information they wanted from us, to tell him over the phone or email which documents or information they expected us to provide them with to which they said, they couldnt tell us or provide us with any links online that would help us understand or state which information or documents we were supposed to include along the rebuttal form. My husband asked the representative to put himself in our place and see how difficult would be for us to provide them with something we had no idea what it was they wanted from us. \n\n\nWe were so disappointed that we had waited 45 days trusting Sun Trust would do right by us and for Sun Trust to conduct an appropriate investigation, gathering signed sale receipts, ask for surveillance video or photos from businesses and/or ATM machines were the fraud charges were made, etcetera. We expected for Sun Trust to have evidence and prove who and/or how the fraud was done and where and how it had taken place, especially since they had already mentioned over the phone in earlier conversations they could see the transactions were fraudulent and all we needed to do was to submit the rebuttal form. At this point we were furious and opted to request a copy of all documents that were used in decisioning our claim as it was stated on the letter, we received from Sun Trust ( see letter attached ) dated XX/XX/XXXX they said, they were supposed to mail those documents to us. My husband also mentioned to them that he didnt think Sun Trust had done right by us and that we felt victimized by Sun Trust and that we had been forced to look for additional help to settle this fraud case because it was not okay for them to deny our claim and also we couldnt give up on the money we were losing because of their refusal and incompetence to freeze, block or close the accounts and/or to set stop payments. We are owed {$1600.00} from claim number XXXX plus the overdraft fees they had incurred ; each overdraft fee cost us {$12.00}, x times 3 overdrafts = equals {$37.00} for a total of {$1700.00} Since we mentioned to them we had been forced to seek additional help Sun Trust has Shut down to provide us with any information and has denied the chance to re-opened the case once again to provide them with the additional details, they want from us once they clarify which details or information, they expect from us. We really have no idea as of what to do and what is they want us to provide them with, is not our area of expertise. They have a whole fraud department and have dedicated years and millions to become experts in the financial and fraud industry. BUSINESS PURCHASE CLOSED ON XX/XX/XXXX I was set-up by Wells Fargo to fail on the day of the closing of my business purchase because the frauds were going on years before the XX/XX/XXXX closing on the SBA Loan. \nBackground of fraud - From the time I had closed on the purchase of XXXX XXXX in XX/XX/XXXX up to the mid to late XXXX, the fees that came out of my account was pretty significant for a small business like mine and I felt pressured to take the {$6800.00} from the mediators. The letter that I send to the mediator made it clear that the fees were crippling my business and I had been complaining to Wells Fargo about the excessive fees since late XXXX ( I spoke with XXXX XXXX of Wells Fargo via phone several times and emailed him on XX/XX/XXXX ) and was told that my fees were cheaper than other options - at the time I was not satisfied with the answer. Then in late XXXX, I heard about the fraud in the news and then in XX/XX/XXXX I called Wells Fargo and spoke to XXXX XXXX in the Wells Fargo National Business Banking Center and he confirmed that I was part of the fraud and set up in the wrong product/business checking account and he immediately switched me over to the significantly cheaper and more appropriate Platinum bank account. So I mailed appropriate correspondence to Wells Fargo headquarters, who confirmed receipt of my correspondence ; shortly thereafter I filed a claim with the mediator. \n2. REVENUE TREND - my revenue was trending upwards, I was picking up new accounts, hiring new employees and then when the fraud hit there was a direct correlation with the drop in revenue primarily tied to Wells Fargo suddenly turning their back on me as if they never met me. And the drop continued and some of it was related to the SELF-Investigation I had no control over ( discussed in item I.11 below ). Conference call on XX/XX/XXXX with an investor, XXXX XXXX and his company AMP and there was no mention of Borrowers consent form ii. Conference call on XX/XX/XXXX ( and many other times/occasions ) XXXX spoke with XXXX XXXX, my financial advisor/banking broker, who was working with me to help secure working capital. USDA - The USDA Rural Development provides access to capital through its Business & Industry Cares Act Program with a 90 % loan guarantee program. Information can be found at XXXX. This program is designed to address the need for working capital to recover during COVID pandemic timeframe and this program requires a supportive lender. The USDA only provides guaranteed funds instead of direct loan funds. Wells Fargo replied that they do not participate in this program... but the point is Wells Fargo ruined my credit and my chances to work with other USDA lenders. \nD. XX/XX/XXXX in XX/XX/XXXX, a highly valued customer, XX/XX/XXXX, called XXXX, left a message and she did not return the phone call E. XXXX XXXX another highly valued customer was interested in purchasing or investing in XXXX XXXX. I sent an email to XXXX XXXX explaining this opportunity and, as usual, there was no response F. MULTIPLE OTHER LENDERS AND INVESTORS 5. SALES OPPORTUNITIES I sent multiple emails to XXXX XXXX detailing significant sales opportunities that would support conventional working XXXX XXXX. XXXX ignored all of the emails 6. STEERING TOWARDS PREDATORY LENDERS I have an email from a Wells Fargo employee XXXX XXXX, my Business Banker, advising ( see attached email ) I should look into Merchant Cash Advance ( XXXX ) lenders I never heard of these types of lenders. I relied upon his advice and guidance to check out the predatory XXXX lenders and it resulted in the beginning of massive collateral damages. Under no circumstances, is it appropriate for a Wells Fargo employee to steer me toward predatory lenders which puts me at risk as an XXXX customer and also puts the tax-payer-funded XXXX loan program at risk. HIGH-INTEREST PREDATORY LOANS Since the Wells Fargo multiple frauds destroyed my credit and my XXXX, I could not qualify for conventional affordable working capital. Instead as noted above, I was steered towards XXXX predatory lenders. I was making payments of approximately {$800.00} per day while also paying the monthly SBA loan payment of {$15000.00} per month and some other debt payments to the seller of the business. I could not sustain these payments while cash receipts from accounts receivable were collected every 30-45 days. Most of the cash from the predatory lenders were being used to pay the same daily ( and in some cases weekly ) high-interest loan payments. My cash flow position became negative very quickly 8. USE OF FUNDS FROM PREDATORY LENDERS ironically some of the funds were used to pay the monthly SBA loan payment. By asking for financial statements, Wells Fargo knew about the predatory loans and considering they have a fiduciary responsibility with the SBA, Wells Fargo did not carry out their fiduciary responsibilities by allowing risky high-interest loan payments that impacted my ability to continue to make payments on the SBA loan. Accepting payments for the SBA monthly loan with funds sourced from predatory lenders is a massive failure to act in good-faith by Wells Fargo and extremely poor risk management. \n9. COMPLAINTS FILED - Starting in XX/XX/XXXX I have filed multiple complaints with government agencies, especially the Consumer Financial Protection Bureau and the SBA but none of the agencies can open an investigation into Wells Fargo unless Wells Fargo ask for payment of the SBA 's 75 % guarantee 10. SBA LOAN PAYMENT MODIFICATIONS Wells Fargo approved 5 SBA Loan payment modifications that deferred the monthly payments but offered no working capital. The only thing the loan modifications offered was ratcheting up more collateral damage because it allowed me to seek and get approved for even more working XXXX XXXX from predatory lenders that Wells Fargo approved of when they reviewed my financial statements which showed the high-interest payments being made to predatory lenders. We are still dealing with the impacts of the frauds since Wells Fargo has been evasive including lying and dodging... Wells Fargo opened a Self-Investigation in XX/XX/XXXX and here we are over 2 years later and the investigation is still going on. Wells Fargo has effectively controlled my XXXX with undue influence, unconscionable conduct and failure to act in good-faith a. I had no participation in the 2 + year-long investigation despite pleading to participate b. nor did Well Fargo look at any of the correspondences/documentation, or reply to my emails, text messages, phone calls, conference calls, certified letters with return receipt requested ( and none of the return receipts were ever received by me ), offers to visit my plant, offers from me to visit Wells Fargo, etc... this is a massive failure to act in good-faith and failure to have a good-faith discussions with fair dealings, poor management, incompetence, etc., and demonstrates Wells Fargo unwillingness to stop harming me/my family, my business and my employees so basically the investigation was a SELF-INVESTIGATION where Wells Fargo was the judge, jury and executioner. LOYAL CUSTOMERS AND VENDORS REFUSED TO BUSINESS WITH ME WHILE THE SELF INVESTIGATION WAS GOING ON c. how can Wells Fargo justify at least 23 delay letters from XXXX XXXX over a 2 + year period with no regard for my business being able to operate because customers refused to do business with me out of fear their inventory would be ceased and vendors refused to do business with me because they may not get paid and all of this hesitation to do business with me is because my customers/vendors were afraid of liquidation proceedings by Wells Fargo? My customers and vendors were well aware of the frauds, collateral damages and the unconscionable 2 + year-long SELF-Investigation held in secret behind closed doors with no participation from me despite my pleads to be involved and all of my pleads were ignored 12. CUSTOMERS AND VENDORS REFUSED TO DO BUSINESS WITH ME Loyal customers and vendors refused to do business with me while the 2 + year-long SELF-Investigation was going on. \n13.
