This means that while I was under the forbearance agreement, late payments should not have been reported on my credit history. \n\nLate payments in : XX/XX/year>, XX/XX/year> and XX/XX/year>. \n\nAs we can see I only had late payments within the first 3 months of the XXXX beginning and before i always paid on time, and even after those 3 months i always was diligent with my payments. \n\nSince my account was current before the pandemic and I requested forbearance due to loss of employment related to the pandemic, your decision to report the payments as late constitutes a direct violation of the CARES Act. Merely stating that the relief provided was the waiver of interest charges is insufficient to comply with the CARES Act, as the law clearly stipulates that my account status should have remained \" current '' during the relief period.\n\nReference to Section 4021 of the CARES Act : Credit Status Protection : The CARES Act modifies the Fair Credit Reporting Act ( FCRA ) to protect consumers who were in good standing with their accounts prior to the pandemic. SLS while it offered some some of forbearance did not offer additional COVID protections/COVID-19 payment deferral at the exit of Forebearance despite requests.\n\nCOVID-19 payment deferral Immediately after your forbearance plan ends, an amended federal law allows loan servicers ( SLS ) to offer a payment deferral option to homeowners who finish a coronavirus-related forbearancewithout requiring a complete loss mitigation application. SLS Did not do this, therefore making me delinquent internally. \n\n\nThe Federal CARES Act ( Coronavirus Aid, Relief, and Economic Security ) offers the following protections for homeowners with federally backed mortgages : 1. Mortgage Forbearance. Servicers required to provide 180 days of mortgage forbearance ( with option to extend for an additional 180 days ) to borrowers attesting to COVID-19 financial hardship. Servicer may not charge any fees, interest, or penalties beyond amounts scheduled or calculated as if borrower made payments on time and in full. My loan was current at the time I entered into the program and was then reported as late while I was going through the approval process. As indicated in my original complaint, my payments are being reported as past due after entering into a payment modification relief program that is part of the federal Covid relief and in the state of Georgia called the HAF program. My loan was current at the time I entered into the program and was then reported as late while I was going through the approval process. I was approved for the program and my loan was modified and payments made to be current in XX/XX/XXXX. I am disputing the response from XXXX as they are not following the rules and limiting the protection of my credit as not being qualifying as I was not in forbearance. At that time I was approved for a forbearance program with Virginia Housing. I have discovered that Virginia Housing has reported missed payments to credit bureaus. I have verified with a Financial Education counselor at the XXXX  XXXX Extension office that the federal CARES Act directs lenders to not report missed payments as part of a forbearance program associated with hardship and the COVID-19 pandemic so long as the account was current at the time of the forbearance program application. \n\nI have explained this to my forbearance program representative and a customer service representative over the past few months, but my credit report still reflects missed payments to Virginia Housing. I received a letter this month stating that Virginia Housing would not be correcting the information because it is \" accurate. This is solidified in the Coronavirus Aid, Relief, and Economic Security ( CARES ) Act ( P.L. 116-136 ) and invocation of the Higher Education Relief Opportunities for Students Act of XXXX ( HEROES Act ). \n\nBased on the actions the Department of Education put for the following policies : Accrual of interest on ED-held student loans and certain non-ED-held student loans was suspended from XX/XX/XXXX, through XX/XX/XXXX. \nED-held loans were placed in a special administrative forbearance ( payment pause ) for XX/XX/XXXX, through XX/XX/XXXX. During this time, borrowers were not required to make payments on their loans. This special administrative forbearance counted toward the 120 monthly payments required to qualify for Public Service Loan Forgiveness ( PSLF ), the maximum repayment periods under the income-driven repayment ( IDR ) plans, and the nine voluntary payments required for individuals to rehabilitate their defaulted loans. \nDebt collection activities, including involuntary collection activities such as wage garnishment and offset of certain federal benefits ( e.g., Social Security benefits ), were suspended on ED-held student loans for XX/XX/XXXX, through XX/XX/XXXX. \nMultiple rules related to the 120 monthly payments required to qualify for PSLF were waived.\n\nA one-time revision was made to the accounts of borrowers with ED-held loans to provide credit toward the IDR plan maximum repayment period for any months in which they were in repayment status and for specified periods of deferment or forbearance. \n\nMy XXXX  student loans were owned by the Department of Education ( proven by the Department of Education XXXX approval ). As per court order ( CFPB vs XXXX XXXX ) XXXX has been banned from servicing student loans based on decades of systemic predatory and deceptive practices, my loans have been moved to another servicing agent. \n\nXXXX is no longer responding to verification requests. \nThe credit report company is now responsible for removing incorrect and inaccurate reporting information on my credit report. \n\nAs per CARES Act and HEROS Act any and all XXXX late payment information from XXXX XX/XX/XXXX through XXXX XXXX is inaccurate and incorrect. \n\nAny and All late payment information from that time period needs to be removed immediately. I am currently in a situation where they have put me in a trial period for a loan modification and that I have to make three payments in the trial to be approved for the loan modification. I went into the forebearance due to losing my job and having my social security stopped as well so I had not enough money to pay the mortgage. I really thought this was my only option as I searched for work which I know have secured. I have never missed a payment on this account, but due to financial hardship, a payment was made late. Furthermore, the negative impact that these late payments are having on my XXXX credit report is causing additional financial hardship as it is impacting my ability to obtain credit at favorable terms. This is particularly concerning as I am now in a better financial position. I have now stabilized and have been making timely payments since then. I am therefore requesting that you remove these late payment entries from my credit, as they are not a true representation of my creditworthiness. I would like to bring to your attention that during my XXXX XXXX with the XXXX, I was a member of the Servicemembers Civil Relief Act ( SCRA ). Throughout my time as a Home Depot cardholder and military member, Home Depot has been very supportive of my military commitments, and they extended their support to me during my financial hardships and helped me get two HVAC systems for my home through The Purple Hearts program. I am a 100 % XXXX veteran, and I appreciate what they have done for me in the past. I would like to request that Home Depot remove the one late payment from my credit report in accordance with the Fair Credit Reporting Act ( FCRA ), which requires that credit reporting agencies and furnishers of credit information report accurate and complete information. If the consumer did not provide written consent to Home Depot to report to the credit bureaus, they may have grounds to dispute the accuracy of the information being reported on their credit report, and request that Home Depot and XXXX remove any negative information that was reported without their consent.
