birth, and ZIP code, to the merchant, XXXX. \n\nThe return transaction involves a bespoke, one-of-a-kind XXXX XXXX XXXX XXXX by XXXX, originally purchased on XX/XX/XXXX for {$24000.00}, during a one-day event at XXXX in XXXX, Texas. The return was processed on XX/XX/XXXX, at XXXXXXXX XXXX  at the XXXX, Texas location and reflected on the receipt as an XXXX  return. This transaction was completed without my presence or authorization and without any written explanation or notice from Comenity Bank at the time it was processed. Following the return, I was not notified by Comenity Bank that a return had occurred, nor was I provided confirmation that my personal identifying information had been accessed or used in connection with the transaction. It was not until later that evening, at approximately XXXX XXXX, that I observed a pending in-store return labeled XXXX, TX on my Comenity online account. At XXXX XXXX, I contacted Comenity to report that I had not authorized the return. During that call, I was informed that the return had been processed by the merchant, XXXX, on the back end. The call lasted approximately 12 minutes. \n\nOn XX/XX/XXXX at approximately XXXX XXXX, during a recorded call with Comenity, a representative named XXXX stated that Comenity had processed the return on the back end. This statement conflicted with prior representations made to me regarding who initiated and processed the return. He also indicated that the system reflected the return as a pending in-store XXXX, Tx transaction dated XX/XX/XXXX. During the same call, XXXX stated that someone at XXXX began accessing my account on XX/XX/XXXX at approximately XXXX XXXX He stated that this individual had waived my minimum payment and removed late fees. I informed him that no late payment should have existed, as my minimum payment of {$940.00} was not due until XX/XX/XXXX and it had already been paid in cash in-store on XX/XX/XXXX. When I expressed concern that my personal identifying information, including my Social Security number, may have been accessed or used without my authorization, he stated that Comenity does not give out your information and that he personally could not view my Social Security number. However, no explanation was provided regarding how my personal information was accessed or how it was protected in connection with the return transaction. He described the situation as very weird and stated that I was the first customer he had encountered with this type of issue. The call lasted approximately 35 minutes. \n\nOn XX/XX/XXXX at XXXXXXXX XXXX, I contacted Comenitys fraud department. I was informed that Comenity did not process the return and that it had been completed in-store by XXXX. I was redirected to the dispute department. This call lasted approximately 14 minutes. \n\nOn XX/XX/XXXX at XXXXXXXX XXXX, I spoke with a representative named XXXX, who let me know that Comenity would now open a dispute about this matter, that I would be mailed letter with a dispute number, and that they would notify me the results once completed. This call lasted approximately 29 minutes. \n\nOn XX/XX/XXXX at approximately XXXXXXXX XXXX, I spoke with a Comenity Bank representative regarding activity on my account. During the call, the representative confirmed that a phone number XXXX was listed on my account as a home phone number. I told him that this number has never belonged to me and was never provided by me at any time. When I asked how the number had been added without my authorization, he stated that he could no longer see when it had been added but believed he remembered it being added on XX/XX/XXXX. He also stated that he had removed the number from my account. \n\nI then asked who had accessed my account and made changes on XX/XX/XXXX. The representative stated that XXXX XXXX, Customer Care Supervisor ( Employee ID # XXXX ), had accessed my account to suppress a {$99.00} financial charge and to waive a late fee. I asked whether she was also the individual who initiated the promotional plan transfer for {$26000.00} on XX/XX/XXXX. He doesnt confirm if XXXX initiated the transfer or not. I asked if the promotional plan transfer has to manually be done. He explained that if a dispute was initiated, then Comenity would have manually adjusted it. I then asked whether Comenity had processed the promotional plan transfer on XX/XX/XXXX or if it was XXXX. He said it was done by Comenity. And I asked if they did that as a result of the return transaction that occurred on XX/XX/XXXX. The representative stated that the dispute was still current so he could not speak to the details of the dispute itself. I clarified that I was not asking about the dispute, but clarification on whats in the notes on my account. \n\nI then asked whether XXXX had initiated the return on XX/XX/XXXX. I followed by stating, Well, it says in-store return, so I guess she didnt initiate that. He was looking at the notes on XX/XX/XXXX and was not able to see the return notification. I then said, So that means Comenity didnt do it, because you would be able to see it if they did? He responded, That is correct. I then asked whether XXXX had the ability to remove the transaction in the amount of {$24000.00} on XX/XX/XXXX. He stated that he did not have access to that information because the dispute was still open. \n\nI also asked about the dispute filing process. I explained that I had opened the dispute on XX/XX/XXXX and wanted to confirm when I should expect to receive written notice by mail. He stated that dispute letters are typically mailed within 710 business days and that the overall dispute process generally takes 4560 days. I later received an email notice in my online Comenity email dated XX/XX/XXXX ; however, as of XX/XX/XXXX, I have not received a mailed copy of the dispute notice or been provided with a dispute reference number. \n\nI then circled back to XX/XX/XXXX and asked if my account was being accessed because Comenity just wanted to access it or was it being accessed because XXXX called them? He said it was to remove a late fee and to suppress the financial charge for one billing cycle. I asked if they just automatically do that? He said no, it was a manual access. He clarified, when its an automatic process the notification is reflected as XXXX and doesnt show any agents name but at this time its showing a supervisor XXXX . I ask does it say whos directing her to do that? He stated that she probably received a pin set up by a regular agent or generated one herself in order to access the account to remove the late fee and suppress the financial charge. So I asked, if I had called and requested something to be done, are you going to see that the owner of the account called and said that she wanted this done? He responded that all processes are made with the consent of the account holder. He says we can not access my account without my approval because we can only set a pin when the account holder is on the line. I asked so how and why could she do any of that if I didnt call? He said let me review and he didnt answer my question. We then discussed the access history on my account. The representative\nconfirmed that my account was accessed on XX/XX/XXXX and again on XX/XX/XXXX. I acknowledged that I was aware of the XX/XX/XXXX access, as Comenity had adjusted my promotional financing from 18 months to 60 months at that time, which was also confirmed to me by the XXXX general manager via text. \n\nI said Im confused as to why my account was being accessed on XX/XX/XXXX if I didnt have any knowledge of that and why on XX/XX/XXXX there was an in-store return done without me present. He said he does not have any data related to any return on my notes in his system. He said the return was done by XXXX. \n\nI said XXXX had my social security number that day to be able to process the in-store XXXX  return and I asked if it was possible when my account was being accessed on XX/XX/XXXX by XXXX if she had access to my social security number and gave XXXX my social? He responded, No, we do not provide your personal information to other institutions and plus, if you already have an account with XXXX, XXXX could access your account and make changes within your account without your social security number. I stated that I only authorized them to use my social security number when I didnt have my credit card and they needed to pull up my Comenity account because yall are a different entity. He said regular agents, even supervisors dont have access to your full social security number we only have access to the last four numbers. I said XXXX only needs the last four. He said to access my account he needs my full social security number and that he can not access my account without my social security number, my full account number or any phone number to make the search. I reiterated XXXX only needed the last four and Im not sure how they got it. He explained further, our systems are separated. We are different companies. Different institutions and we do not share data between us. Even if you update a phone number with us or a mailing address with us, those updates are not going to be reflected on your XXXX account only on your XXXX credit line with Comenity. Theyre completely different systems. This call lasted approximately 34 minutes. \n\nBased on this XX/XX/XXXX conversation alone, Id like to note specific things : 1. I have only ever provided my full Social Security number to Comenity at the time my account was opened.\n\n2. When I call Comenity they verify its me with only the last four digits of my social, never my full social security number.\n\n3. Ive never been asked to provide my full account number or a phone number to verify my account on the phone. I thought it was odd that he said that especially since a random number was attached to my Comenity account.\n\n4. When I dont have my Comenity credit card for a purchase or a return at XXXX I have to give them the last four of my social to pull up my Comenity account. Ive been told my last four are not saved in XXXX system and based on Jareds CFPB response its implied they didnt have it, they state Comenity provided it and that they didnt store it thereafter. \n\nOn XX/XX/XXXX, I went to the XXXX XXXX location in XXXX, Texas to request receipt documentation related to the return. An employee printed a copy of the return receipt and consulted with store management to confirm whether it could be provided to me. This consultation involved the General Manager, the District Manager, XXXX XXXX, and XXXX XXXX, Director of Customer Service. I was provided a copy of the return receipt at approximately XXXX XXXX  that day. I was not presented with, nor did I sign, any original return documentation ; the receipt provided to me was a printed copy generated by the store. In a recorded video, the XXXX manager stated that she had been provided the information necessary to process the in-store return by the district manager over the phone which was the last four of my social, my birth date and my zip code. Separately, the manager also stated to me that the information had been provided to the district manager by them. \n\nOn XX/XX/XXXX, I received a response associated with CFPB Complaint # XXXX, in which XXXX stated : We contacted Comenity who provided us with your date of birth, ZIP code and the last four digits of your SSN which is the information needed to process the return. That evening at XXXXXXXX XXXX, I contacted Comenity to ask whether there were any circumstances under which my Social Security number or other personal identifying information would be provided to a merchant, including in situations described as unable to deliver the goods. I was told that there were no such circumstances and that Comenity does not share that information. I specifically asked whether any exception existed, and I was told no. The call lasted approximately 13 minutes. \n\nOn XX/XX/XXXX, I posted a XXXX  discussing XXXX Consumer Financial Protection Bureau response and its reference to Comenitys role in the return transaction. \n\nOn XX/XX/XXXX at XXXXXXXX XXXX, I observed that XXXX, the vendor referenced in XXXX CFPB response, had disabled public tagging and mentions on its social media accounts. I documented this change with screenshots for my records. \n\nOn XX/XX/XXXX at XXXXXXXX XXXX, I contacted Comenity again to confirm the information stated in XXXX CFPB response. I was advised that there are no circumstances under which Comenity would share my personal identifying information. I was also provided with the mailing addresses for Comenitys Credit Bureau Disputes and Customer Care departments. The call lasted approximately 13 minutes. \n\nOn XX/XX/XXXX, I sent written correspondence via certified mail to both departments requesting clarification regarding the following : Whether Comenity accessed, used, or shared my personal identifying information in connection with the XX/XX/XXXX return Whether Comenity authorized, approved, or verified the return Whether Comenitys internal systems reflect any access to my personal information related to this transaction Whether XXXX statement to the CFPB regarding Comenity providing my personal information is accurate Written confirmation if such information was not provided A reinvestigation and correction or deletion of any information furnished to consumer reporting agencies that inaccurately suggests the return was consumer-authorized or consumer-present, along with written results of any such reinvestigation as required under the Fair Credit Reporting Act. This has resulted in three Hard Inquiries- on each of the credit bureaus that has negatively impacted my credit score. \n\nEven so, instead of being accountable for their lack of transparency and poor customer service- they are placing an onerous burden on me to remedy what is essentially their mistake. \n\nThis is despite the fact that Ive been a Capital One customer for over a decade. I opened my Capital One 360 checking and savings accounts in XXXX and a Capital One Quicksilver credit card in XX/XX/XXXX. \n\nI also want to let CFPB know Capital One made the reparation process for their XXXX data breech exceptionally cumbersome. \n\nFinally, Capital Ones customer service is only available in small windows, with call menus that waste customers time before letting us know no ones available - and their website and app are down way too often. \n\nDetails are as follows : THREE HARD INQUIRIES DUE TO CAP ONE DYSFUNCTION On XX/XX/XXXX, I applied for a Capital One Spark credit card, which offered a {$500.00} bonus if you spent {$4500.00} in 90 days, as I had some big expenses coming up. \n\nOver the next few days, I was surprised to not hear back about my application. Besides being a loyal Capital One customer, my credit rating had been in the low XXXX most of my adult life. I hadnt carried a balance on any credit card since the late XXXX. So when I apply for credit cards, Im always approved immediately. \n\nSo I called Capital One to inquire as to why my application was held up, but no one could tell me anything except it it takes 7-10 days processing. So I assumed it would be coming. \n\nAlmost two weeks later, I received a letter from Capital One, in the mail, saying my application had been declined but with NO information as to why On XX/XX/XXXX, I called Capital One but still could not get any information as to why my application was declined. I escalated the call to XXXX, who also offered no insight as to why Id been declined. She simply offered to put the application through again, i.e., reapply- which I did. \n\nShortly thereafter, I received another letter saying that my application had been denied. \n\nI called Capital One again! At some point, I was able to ascertain that in my on-line application, Id accidentally put my last name in the first name box, and my first name in the last name box! This is why Id been declined- even though all the financial information was accurate - and in every other way, it was clear it was me. Even so, the agent offered no solace, apologies, and most importantly - no solutions. \n\nBy this time, my expenses were coming up. So I applied for a XXXX XXXX and XXXX XXXX XXXX XXXX. Though they offered lower cash bonuses than a Spark card, they would help. My application with both banks was immediately approved so I was able to use them for my expenses. \n\nOn XX/XX/XXXX, I had more expenses possibly coming up - so I started a new application for a Capital One Spark card. This time, since I didnt swap my last name for first name. The application was immediately approved. \n\nUnfortunately, my upcoming expenses did not materialize so towards the end of my 90 days, not having spent the {$4500.00}. I decided instead to buy some gift cards to bring my total up to {$4500.00}. However Capital One told me that pending charges would not count towards earning me that bonus. NOTE : Most other credit cards DO include charges that are still pending at the cut-off date of the bonus period!!! \n\nWhile I never received any benefit from the Capital One Spark card, as you can see from the attached page of my XXXX Credit Report, there are three Hard Inquiries from Capital One : XX/XX/XXXX ; XX/XX/XXXX ; and XX/XX/XXXX. \n\nFor contrast, during this same period, I applied for and received credit cards from XXXX XXXX XXXX XXXX XXXX XXXX XXXX, and a second XXXX XXXX XXXX XXXX - NONE of which created a hard inquiry! \n\nIn XXXX, I checked my credit score and saw it had dipped to the high XXXX with two of the three credit bureaus. I did some research and learned that Hard Inquiries negatively impact ones credit score. \n\nSo on XX/XX/XXXX, I called XXXX Disputes Department at XXXX to file a dispute. However the agent told me there was no bridge for her to remove the Hard Inquiry because - although she could see the last name and first name were swapped - ALL THE FINANCIAL DATA WAS CORRECT. She agreed this should not have been an obstacle for the bank. So I requested my Credit Report to see what she was referring to Also on XX/XX/XXXX, I called Capital One to dispute their Hard Inquiries. The agent said I needed to send a letter to Capital One, XXXX XXXX XXXX, XXXX XXXX XXXX, UT XXXX. In that letter, I needed to indicate my name, address, Spark account number, social security number, date of birth, as well as the credit bureau in question and include detailed information/documentation - including images- with the incorrect item circled. She said Capital One would review my request within 30 days - and mail out a response which would take another 7-10 days. \n\nNOTE : Best case scenario, Capital One is accountable to their error, this prolonged process adds another 1-1/2 months that my credit score is dragged down by their error. \n\nOn XX/XX/XXXX, I received XXXX credit report - all 14 pages, only one of which includes the Hard Inquiries. Also, I dont want to remove a page from my credit report so - should I scan it and print it out again for Capital One? \n\nIt now occurs to me, this wont fix the Hard Inquiries with XXXX and XXXX. Though I discover I can order all my credit reports on XXXX I also realize I can only do so once a year. This seems like a total waste - and additional burden. \n\nOn XX/XX/XXXX, I call Capital One again and am told that- not only does Capital One insist I send a document showing the incorrect information- but theyll only remove the Hard Inquiry from ALL THREE credit bureau, if I send ALL THREE FULL CREDIT REPORTS!! \n\nSo basically, Im being asked to send highly sensitive material in the mail - not just a letter with my social security number and birthdate - but also my three credit reports. First- as someone whos been the victim of five data breeches in XXXX and XXXX alone - including one from Capital One- it strikes me as highly risky - not just to send this personal information through the USPS mail- but to have floating it around Capital One offices - after theyve proved themselves to be a highly dysfunctional organization that cant even process a simple credit card application with the last and first name swapped. \nSecondly, theyre asking me to send my valuable credit reports to which Im only entitled once a year - unless I have the 50 double-side pages photocopied - a time-consuming and expensive process. Not to mention, the cost in time and money - of mailing the package, especially in a secure fashion. Thats a significant gap, during which time my data was exposed, unbeknownst to me. The gap also makes it impossible to track the fact that my email address is now on the XXXX XXXX \n\nWhile Cap One offered XXXX credit monitoring, they made a deadline of XX/XX/XXXX to sign up. That seemed to me a very short window. Since XXXX data breach was still in the news, I passed on signing up, especially since I still had credit monitoring from either the XXXX or the XXXX data breach. \n\nOn XX/XX/XXXX, almost three years after the breach, I received ONE EMAIL notice of a Class Action Settlement. I had no idea there was even a case!! \n\nAlso - the notification method was not really befitting something so important as one email, especially for me, with hundreds of spam emails a day - thanks to a data breach. \n\nFinally, the remuneration process was paltry. Not only was it challenging to prove whether or not I was directly affected, but the XX/XX/XXXX deadline to enroll in the class action suit was short notice for those of us with busy lives. \n\nWorse, although they offered three years of identity protection to those of us who couldnt prove direct harm, it was almost IMPOSSIBLE to get it. \n\nStarting XX/XX/XXXX and for over a year, I called every few weeks to get the identity protection. I spoke to XXXX first. He told me I had to just keep checking the website. I called more times and talked to XXXX, XXXX, XXXX and others. But instead of getting the protection service, I was sent to the website again and again. This was listed on all of my credit reports showing a false debt in the amount of {$810.00}, with an alleged or supposed date of first delinquency on XX/XX/XXXX. This was and is horrifying to me because I am not their customer nor am I a customer of any affiliates. XXXX XXXX never mailed me, never emailed me and never called me about any account or accounts with them or any other creditor. Their fraudulent information just appeared on my credit reports.\n\nThey did not comply with me or with the credit bureaus within 30 days to validate the debt. Since they did not respond to my dispute I called them to inquire and possibly dispute by phone. They said it was a Capital One account that was delinquent since XX/XX/XXXX and asked would I be scheduling a payment. XX/XX/XXXX is beyond the statue of limitations. I explained that the account did not belong to me and that I needed to speak with Capital One to find out what was going on. When I asked for the name and badge number of the XXXX rep I was speaking with she changed her story and gave a different account number XXXX, different dates and false addresses and insisted that I give her my mailing address and social security number. That was alarming so I ended the conversation with XXXX  and called Capital One and asked them if I had or have an account in my name. They said if I did it could be found a few different ways and when none of the options turned up an account in my name they asked me to verify my social. I was hesitant, but I was under pressure to get this resolved with XXXX. When I gave Capital One my social they discovered 2 accounts for me, which added to my anxiety. They asked if I had any idea who would do something like this and I could not hold it in anymore. I broke down crying on the phone and shared some of the worst things I have ever experienced in my life with a stranger. The Capital One Rep said she was sorry to cause me to relive the trauma, but that she was working to have both accounts removed from all four credit bureaus and needed a good mailing address and phone number to reach me and if they needed anything else from me I could fax it to XXXX. They never called back to request additional information beyond a police incident number. The other account was XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, VA XXXX account number CAPIT- ending in XXXX  in the amount of {$1900.00}.\n\nI have been very depressed over this because it is difficult to try to have a normal life after years of living in fear that my attackers who made my life a living hell may find me! I decided to check my credit reports online yesterday XX/XX/XXXX and XXXX XXXX XXXX was removed from XXXX and XXXX, so I thought that apparently Capital One kept their word to have these fraudulent accounts removed from the credit bureaus in my name. I called XXXX  again on XX/XX/XXXX to update them and they took me through a frightening series of unscrupulous business practices trying to pry my social security number from me, seeking to collect a debt that is not mine. They know it is not mine even after I explained to them that Capital One assured me on XX/XX/XXXX that they would have the items removed from all credit reports as soon as possible because they verified that none of the addresses or phone numbers or email addresses used to open the accounts belonged to me ...\n\nOn XX/XX/XXXX Capital One said they could see that even the home address listed a XXXX XXXX ... Capital One asked did I know how this could have happened or who could have done this to me ... I explained to them that I am a victim of violent crime associated with gang violence. My personal information was compromised when they stole my IDs and opened accounts in my name.\n\nI am the victim in this circumstance and yet XXXX  threatened to sue me and completely disregarded the fact that Capital One already acknowledged that the information on file does not match anything associated with me and that fraud occurred. I needed help to get XXXX to cooperate. They know I reached out to them almost 3 or 4 months ago with the dispute and so has the credit bureaus. XXXX   needs to be removed from my credit reports and be held accountable for insubordination, non-compliance and corrupt procedures. Please help me! Concerning the statute of limitations, their representative claimed that the debt dates back to XX/XX/XXXX and I noticed how they refused to give her name and badge number as well and did not comment on the fact that-that was withheld from me. They also failed to acknowledge that I called them in XX/XX/XXXX when I first saw fraudulent activity related to this account on my credit reports. They show a lack of compassion. They show greed by any means necessary ... the strong desire to collect a debt that is not mine and a desire to make me go in circles ... a stunt to keep this on my credit reports. They act as if XXXX  did not conduct a thorough investigation, as if XXXX did not contact them stating that the debt is fraud and the result of identity theft and therefore XXXX  removed it from my credit report, along with other related items! XXXX XXXX claims that the first time they received anything from me was on XX/XX/XXXX yet they acknowledged receiving correspondence from the credit bureaus in writing FROM ME ... they failed to mention that they received this information in early XX/XX/XXXX.\n\nInitially, Capital One said they could not find these accounts in my name with the account numbers that were listed on my credit reports ... only after asking for my social security number, drivers license number, date of birth and address on XX/XX/XXXX did Capital One find that I had accounts with them, but they acknowledged that the accounts could not belong to me after asking a series of questions ... there were 3 accounts on my XXXX  credit report related to Capital One and one was listed in good standing though it was not mine! Capital One acknowledged that they are not my accounts on XX/XX/XXXX they opened a case and assured me that they would remove them from my credit reports and no longer seek to collect the debts.\n\nYet one of the collection agencies that they sold one of the debts to was giving me opposition on every hand, XXXX XXXX.\n\nI noticed that XXXX XXXX also failed to admit this and that ALL of the contact information linked with the account does not match any information linked to me. This is conveniently evasive of XXXX XXXX. They are transparent. Does it make sense that the first time they have been contacted by me was XX/XX/XXXX? Perhaps that is a typo and they meant to say XX/XX/XXXX or XX/XX/XXXX ... maybe it is an oversight. Otherwise, it is gross negligence on their part.\n\nI need help to resolve all of this once and for all.\n\nNow to make matters worse Capital One is not properly communicating within their various departments to help resolve this completely. XXXX was taken care of properly, or so I thought, but not XXXX XXXX XXXX- my credit report from XXXX in XX/XX/XXXX shows 3 accounts for Capital One. Two were collection accounts and one was showing good standing pays on time. I disputed all 3 and 2 out of three were removed. The problem is Capital One listed the same fraud debt twice. I have a copy- as if trying to double dip or collect twice on a fraud debt. This is illegal. They already acknowledged that the accounts were fraud to me on XX/XX/XXXX and to XXXX and removed the one in alleged good standing that said pays on time, but left the one they sold for the same debt to XXXX XXXX XXXX and now companies harass me and worst of all Capital One changed the address associated with the dispute to the address linked with the account. I confronted them because they and the credit bureaus said the address on file listed a XXXX XXXX as the residence so the accounts or applications should have never been approved by Capital One.\n\nFurther more, when confronted, they changed their story claiming that the address listed from the disputes through the credit bureaus was the one used to open the accounts, which is false! They already told me that XXXX XXXX were used and listed as a residence on the applications. Either they are completely deceitful and took advantage of my dispute contact information that I used when disputing through the credit bureaus and through the XXXX  and switched it in their system or this is a nasty oversight. Then again, they could have lied to me on XX/XX/XXXX about helping me and used all of the valid information they said they needed in order to find the accounts, because they claimed that the account numbers I gave them from the credit reports did not pull up any accounts for me in their system.\n\nThey are caught because when I disputed with XXXX, I used my parents address to communicate about the disputes to Capital One. That is when another collection agency, XXXX XXXX XXXX, that bought one of the debts from Capital One sent alleged information about the account to my parents house and all of the addresses on their documents from Capital One list a XXXX XXXX shown as a residence and none of the information matches any address, email or phone number of mine. Either way, I need them to remove this from my credit reports with all 4 credit bureaus and never attempt to collect again.\n\nToday, XX/XX/XXXX, I found a piece of mail from Capital One concerning the debt they sold to XXXX XXXX. My parents credit reports are the same. Its quite obvious the agent assigned to the non-store accounts ( XXXX ) has some sort of bias applied to my cases. On the other hand, there is a new case opened as of yesterday on the store account by an investigator ( XXXX  ). Unfortunately, XXXX does not understand, nor does she believe in Identity Theft. Thats really too bad as I would not wish it upon my worst enemy. In her letter from today she again does not address some very important details.\n\n1. I am the victim of ID Theft that began in XXXX as documented by the police report regarding the theft of my computer at that time 2. Though I did everything in my power to protect my family from any issues, fraud, etc. it appears all for naught. The crooks broke into my information and stole the most precious data they could ; including my familys Social Security numbers, our birth certificates, our drivers licenses and of course our passports as well. \n3. What XXXX neglects to understand is that they also found my card data in computer bag or on the completer instelf, since I dont go out with everything when I am out of town. She tends to believe that she is righteous though she hasnt even provided the common courtesy to call me and discuss. On the other hand, XXXX has and he is getter the right information from the real XXXX XXXX where XXXX is believing information from a fraudster that is not the real XXXX XXXX. \n4. XXXX, in turn called me on XX/XX/XXXX to advise me that he was reopening all cases because there were obvious issues that were not taken into account ; namely the ID Theft and therefore Account Take over leading to the fraud in XXXX and XXXX for starters. \n5. Its quite evident I was not in town via both of those declared statements. \n6. XXXX, who has never actually called me to rationally discuss anything has been reading notes and/or reviewing calls from fraudsters. How one could actually believe that I would call from XXXX XXXX, which has been proven by my cell letter and the flight itineraries boggles the mind. XXXX is either reading notes given from the fraudsters or listening to calls made by the fraudsters. She simply does not get it and this case needs to be completely reassigned to a non-biased investigator that actually understands ID Theft and Account Takeover that leads to other types of fraud, including gift cards and bounced ACH payments made by fraudsters from account that have nothing to do with myself and/or family. So far, I have supplied proof from XXXX XXXX that I dont have any records with them for any accounts now or in the far-reaching past. XXXX, XXXX and XXXX XXXX XXXX XXXX  have now confirmed the same so all of your ACH bonces are fraudulent and were not from myself or my family. I will have these during this coming week and will supply once received. ( see XXXX XXXX info attached ) 7. I was not in the US between XXXX so going to Target, etc. during this time frame is not at all possible. Id have to be superhuman to have been in XXXX XXXX working and in XXXX at the same time. Never mind in XXXX where XXXX has verified calls came from while I was out of country. Even then, XXXX is Thousands of miles from XXXX and it would have been impossible for me to be in a XXXX Target during that time. But, alas, I was in XXXX XXXX and did not make the calls XXXX references on XX/XX/XXXX to Citis Customer Service Department. This is all a big fat fraud and XXXX is allowing it to happen to a very good customer, citizen and family. XXXX needs to be retrained in ID Theft, Account Take over, Fraud and ACH bounced payments.\n\n8. Additionally, I supplied two letters this past week. One pertained to closing my Best Buy Account in XXXX because I was not pleased with a small charge, appearing to be fraud, that Citi marked as late. Rather than fight this and waste the time we have with this issue, we paid it and disputed it. Citi did nothing and we moved on. This Best Buy account should never been open and Citi CREATED FRAUD THAT SHOULD NOT EVEN HAVE HAD AN OPEN ACCOUNT. What kind of protection for customers is Citi doing, NONE? The second letter pertains to a letter I sent in XXXX advising not to take any 3rd party payments from anyone, unless authorized in writing by myself. This didnt happen of course and Citi began taking payments by a person who had stolen my familys identity and taken over my accounts. How is this Citi? Why did you go against my requirement? Are you really that bad at updating customer accounts properly? Wow, that letter was 10 years ago and seeing that none this type of fraud had taken place I thought you heard me and did as I required! You didnt though and you opened the door to even more gift card fraud and 3rd party payments as time went along. How shameful!\n\n9. On or about XX/XX/XXXX our community mailboxes were hit by mail fraud ( see pictures attached ). While asking my wife for the mail key at the beginning of May she advised that they had been broken into and all mail was stolen from all residents! I let Citi know of this at the time but still it does not seem to resonate with XXXX at all. In this case, there were a new set of fraudsters XXXX amazing ). Citi allowed one of these fraudsters to make a purchase from XXXX Florida from a Company called XXXX XXXX XXXX. Well as I have said, first I live in XXXX, not XXXX Florida so that Card could not have been present. Second, I dont smoke, I am an XXXX and dont condone smoking either. Finally, I dont own a smoke shop, nor do I distribute any smoking paraphernalia. Also, this charge is exactly {$7000.00}! Where is the state and federal tax on smoking items? They are some of the highest taxed items as my research proves. So, did the cigar company eat the tax for 2 states as well as the federal tax as well? And how was my card present? It wasnt! I also received no calls about this and again if Citi did, it was from a fraudster and boy would I love to hear this call because its a lie or a complete farce made up by XXXX of the fraudsters. Are the Customer Service Rep and the fraudsters in cahoots because now this is looking like an inside job! This is very fishy and absolute fraud. Also, just an observation, wouldnt this type of call have been handled by a fraud agent, not a Customer Service agent that knows little about fraud?\n\n10. So, in both of the cases above XXXX calls me a liar and says I contacted the Customer Service Department ( again why customer service when the fraud team are the experts. This make no sense at all and so I am now calling XXXX out ). She really does not understand ID Theft or Account Takeover. In fact, I dont think she should be in the fraud prevention or investigation businesses at all because she is making assumptions without any proof that it was me at all. Yet I have provided proof of where I live, where I was out of the country via my itineraries and letter from XXXX.
