I haven't even used the products yet because I'm waiting for my current moisturizer and eye cream to run out. So fast forward to XX/XX/2019, I look at my bank account on line and find that there is a pending charge for {$79.00} from XXXX XXXX. So I call the phone number that is on my bank statement ( XXXX ) and speak to a customer service representative that says in the fine print at the very bottom that I had 14 days to cancel my subscription for the product and get a refund for the two products that I ordered. I asked if I could return them since I had not used them yet and he informed me that it would be a restocking fee so well as two week process time and another {$10.00} for a shipping fee. I told him I had no idea that you had to cancel within 14 days not to be charged. I thought risk free meant just that -- risk free. In my research to find the website on the internet and XXXX I have found out that this is widely known scam on XXXX and that there are warnings from bloggers not to fall or buy from these sites. I would like a full refund of the {$79.00} plus the two {$4.00} charges for shipping and the {$1.00} recycling charge and I will gladly send the products back at my own cost at the address the seller provides. The reaction was a catastrophic, the strands began to tangle clump up and become matted ( As synthetic wigs do when exposed to moisture ). XX/XX/XXXX I took the wig unit to a professional hair dresser/wig enthusiast for a \" second opinion '' the hair technician, apologized to me because unfortunately \" \" the wig units are not 100 % human but infact made of a \" synthetic blend. '' \" when I first initiated a complaint to the merchant, on XX/XX/XXXX, she told me the factory had verified my order as \" 100 % human hair '', I then confronted her about the synthetic labeling on the shipping documents and she claimed the hair was human, and that the mislabeling is a kind of common practice between the merchant and the shipping company to avoid paying tariffs, involving me ( unknowingly ) in a federal crime. I believe she did this in an attempt to discredit me once I did discover the fraud, and tried to submit any claim. The fact is I paid for XXXX raw human hair wig units at {$600.00} ( the final total was {$610.00} ) and even offered to pay extra for a rush shipment The merchant told me If I purchased these XXXX, my shipping would be FREE. From there on, as far as I knew at the time, the shipping etc ..., was the duty of the merchant who is solely responsible for getting the products to me as far as I was concerned Her business practices, methods and ways of doing things were irrelevant to me, the way she stated these things to me I was under the impression as though she were providing me with legitimate customer service, I did not know her intentions were to commit federal crimes, defraud me, exploit me and this transaction to do so. As a new user to the XXXX platform with a lack of knowledge and experience concerning the processes and laws of importing and exporting goods, I believe I was targeted and taken full advantage of by this predatory seller who I had whole-heartedly trusted not to do something like this to me. \n\n\nXXXX. \" Violation of the FTC Textile Act '' I received these wig units in generic plastic packaging that only stated their length & texture but not their Fiber Composition ( It did not say on their individual bags if they were 100 % human or 100 % synthetic wig units ) The Textile Fiber Products Identification Act and FTC 16 CFR Part XXXX require that all hair products be labeled accurately regarding their fiber content ( XXXX XXXX XXXX XXXX XXXXXXXX mislabeled or unlabeled textile products is an illegal trade practice. A bank can not force me to pay for a transaction that was carried out through illegal means ( unlabeled bags/mislabeled contents ). \n\n\n\nXXXX. \" My attempt to return the items, the atrocious merchant and the unsatisfactory dispute resolution. '' When XXXX would not step in I was left XXXX deal with this merchant on my own, I was willing to return the items as well as pay to ship it back, as long as the merchant gave me their iron clad word that I would get back 100 % refund of what I paid for the XXXX units because they are not 100 % authentic. After discovering how strategic and sophisticatedly I had been defrauded and that I unknowingly been coerced into this merchants illegal activities, and that this entire transaction was illegal from the start, I Realized the true atrocious nature of this merchant, her deceptiveness and questionable business practices, not underestimating what she could be capable of, I no longer felt safe having any further correspondence with this individual \" XXXX XXXX '' or the hair factory in which she claimed to answer to. under XXXX XXXX XXXX, I am not required to return merchandise when the merchant has engaged in material misrepresentation and illegal business practices that make a return legally compromised or unsafe. \n\n\nXXXX. \" Deceptive Trade Practices ( Bait-and-Switch ), Substantive Unconscionability, Breach of the Implied Covenant of Good Faith and Fair Dealing, Failure of Consideration ( Services Not Rendered ), Facilitation of Fraud Unfair, Deceptive, or Abusive Acts or Practices ( UDAAP ), Bad Faith Adjudication, False Advertising '' The platform XXXX, That facilitated this transaction engaged in Deceptive Trade Practices by advertising a contractual guarantee ( Trade Assurance ) that they fundamentally failed to honor, despite clear evidence of merchant fraud. This constitutes XXXX XXXX and a XXXX of XXXX XXXX. XXXX marketing materials and XXXX XXXX ' advertisements promised XXXX % XXXX XXXX ' and a XXXX XXXX ' if the product did not match the description. I relied on these promises of transparency and legitimacy when choosing to shop here and purchase from XXXX of their 'Verified Suppliers. ' It boasts claims that no other e-commerce platform does, providing millions of customers with nothing more than a false sense of security, a sense of security that led me to confidently shop and purchase there as a new customer. I reached out to XXXX XXXX constantly. Despite XXXX XXXX XXXXXXXX XXXX of their own dispute rules ( concerning fraud ), XXXX would not waive, override or extend any of its policies or return windows. I was repeatedly denied on the grounds that I was past the XX/XX/XXXX day window. I chatted with customer support on the platform as well as through E-mail, I submitted screen shots of the conversation between the merchant and I, I submitted dispute letter after dispute letter explaining the fraud and warning them that if a satisfactory resolution was not met, that I would report the incident to the FTC. On my final attempt, trying to explain this matter to a different representative ( with hope that I would get a better or atleast different outcome ) after I provided all evidence of the merchant 's fraud and confession, the XXXX support agent closed the chat session with me without explanation. This total disregard is why I have filed with the Federal Trade Commission ( FTC ) both against the merchant for XXXX fraud and the XXXX e-commerce platform for facilitating fraudulent transactions, and not keeping to what the platform boast in their advertisements, so as a last resort I filed for a chargeback with my financial institution ( XXXXXXXX XXXX ) as a last attempt to seek justice. \n\n\nDENIED PASSED THE XXXX DAY WINDOW I never knew I could ask my bank for a chargeback until I realized I was a victim of a crime and began to do my research. I never fight for 5 % cancellation fee mentioned in terms and condition of PayPal invoice but seller has shown unethical business practice because case escalated to prevent her to ship the items but yet she still ship it.\n\n7. I raised my concern to PayPal and PayPal said i can refuse package from XXXX. Paypal will take care for me. But in this pandemic everyone needs money and i have conscience so i stop the shipment while still in USA. If i refuse the package after arrived in XXXX seller will loss another {$160.00} shipping cost back from XXXX to USA. Im being considerate here and try to save money and trouble for everyone but this is what i get in return. \n8. All calls i made to PayPal usa are recorded. I called PayPal on XXXX XX/XX/2021 to ask why case estimate pushed back to XXXX XX/XX/2021 and PayPal cs keep assuring me to wait until XXXX XX/XX/2021 PayPal promised i will get full refund of {$2700.00} invoice value if seller still not respond. And when i called PayPal XXXX XX/XX/2021 PayPal also assures me if within a day seller still not response to PayPal case will be closed in my favor. But all are empty promises. Fortunately i record all the call as precautions. \n\n9. Paypal emailed me on XXXX 2021 stated that PayPal has credited temporary provision refund to me but it doesnt reflected in my credit card. Therefore, yesterday i called PayPal. PayPal cs admitted its a mistake and never credit any refunds to me. What kind of mistake is this? Is this mistake acceptable for a big company like PayPal? PayPal is free to call and confirm with XXXX rather than keep me hanging and keep dragging me? Its such a huge amount of money. I would not pay {$1500.00} and makes me sink even deeper risking loosing {$2700.00}. \n\n11. I would like to clarify regarding seller statement on the case. First, seller excuse not to reply me because i change my XXXX name so she doesnt know me. Its total lie. Regardless what ame i changed into, the XXXX  has the message logs between me and her. She can scroll and find out who im. Or else, if shes lazy to screenshot she can ask me who im. And if she doesnt reply because she doesnt know me why she replies in XXXX  to a stranger who ask for her item availability? Second seller accused me to block her from XXXX. Attached the screenshot of the message in XXXX  of seller asked why i block her. My questions are if i block her how come i receive her message? And the funniest thing is, She has thousands dollar of my money why would i block her? Shouldn't be the other way around? \n\n12. Attached here the copy of XXXX label, airway and commercial invoice filled by the seller that i received from XXXX XXXX. As shown the package value written by the seller is {$2700.00}. It match the total value of the PayPal invoice billed to me. Its undeniable evidence prove that i never receive any items in the PayPal invoice before. Therefore as recorded on my call with PayPal. Paypal will refund me total of full amount of the invoice {$2700.00}. Please crosscheck the commercial invoice with XXXX to confirm if the commercial invoice sent to me by XXXX that i attached here is a correct commercial invoice seller provided to XXXX. \n\n13. Paypal change case filled on XXXX XXXX yesterday from item not received to item significantly different. How come PayPal justify its actions? Item returned to seller not even out from USA yet. Merchant can use it against me by saying im a liar. How come i claimed item significantly different if i never see it at all? \n\n14. After that i immediately call PayPal and make a complaint about this. PayPal then change back the case to item not received. But its back to square one. Back to first step of dispute. PAYPAL refuse to be responsible for their merchant invoice issued to me with excuse that its not an invoice eventhough the invoice has PayPal head logo on it. But in this pandemic everyone needs money and i have conscience so i stop the shipment while still in USA. It match the total value of the PayPal invoice billed to me. Its undeniable evidence prove that i never receive any items in the PayPal invoice before. Therefore as recorded on my call with PayPal. Paypal will refund me total of full amount of the invoice {$2700.00}.
