While I acknowledge that ChexSystems reviewed the complaint and contacted the furnisher, the response does not resolve the fundamental issue raised in my complaint : I do not own, did not open, and did not authorize the account being reported, and I filed an FTC Identity Theft Report because the information is fraudulent. \n\nChexSystems response relies heavily on general descriptions of its role as a nationwide specialty consumer reporting agency and on statements that the furnisher has verified the information. However, the response does not include any original documentation or independent evidence proving that I personally opened or authorized the account. As a result, the information remains unverified from my perspective, and the explanation provided does not satisfy the requirements of a meaningful reinvestigation under the Fair Credit Reporting Act ( FCRA ), especially in the context of identity theft. \n1. I Do Not Own the Account and Did Not Authorize It The account or activity reported by ChexSystems does not belong to me. I did not open the account, did not authorize anyone else to open it on my behalf, and did not engage in any transactions associated with it. I have no relationship with the account being reported and no documentation tying me to it.\n\nI did not receive : Account-opening confirmations Statements or notices Overdraft or closure notifications Correspondence from the financial institution Any communication indicating an account existed in my name My first awareness of this issue came only after reviewing my consumer report. The lack of communication prior to discovery strongly supports that this account was not legitimately opened by me.\n\n2. I Filed an FTC Identity Theft Report Because the account is not mine, I filed an official FTC Identity Theft Report documenting that the account is fraudulent. This report is a legally recognized statement asserting that my identity was used without authorization.\n\nWhen an FTC Identity Theft Report is filed, the FCRA requires heightened scrutiny. Identity-theft disputes can not be handled in the same manner as ordinary disputes. The reporting agency must ensure that the information is verified with actual documentation and must not continue to report infor\nmation that can not be substantiated.\n\nChexSystems response acknowledges that a consumer may provide an identity theft report but does not explain how my FTC report was evaluated, incorporated, or applied in the reinvestigation. The response instead focuses on general policy language, which does not address the substance of my identity theft claim. \n\nXXXX. ChexSystems Did Not Provide Documentation Proving Ownership ChexSystems states that the furnisher verified the information as accurate and complete. However, no documentation was provided to me demonstrating how that conclusion was reached. Specifically, ChexSystems did not provide : An account application or agreement Proof of identity verification used at account opening Copies of identification allegedly presented Digital authentication records IP address or device information Branch or in-person records Fraud review notes or red-flag analysis Without these materials, there is no evidence showing that I opened or authorized the account. A statement that a furnisher has verified information, without supporting documentation, is insufficient in\n\nan identity-theft dispute. 4. Reliance on Policy Language Does Not Resolve the Dispute Much of ChexSystems response explains its role under the FCRA, its retention practices, and the fact that it relies on information furnished by financial institutions. While I understand ChexSystems general function, this explanation does not res\nolve my complaint.\n\nThe issue is not whether ChexSystems is permitted to retain information under certain circumstances. The issue is whether the information being retained is accurate, verifiable, and actually belongs to me. The response does not answer that question with evidence.\n\n5. Verification Must Be Evidence-Based, Not Conclusory In cases of identity theft, verification must be based on evidence. This includes original documents and records showing that the consumer opened the account. Internal notes, system summaries, or conclusory statements from a furnisher do not establish ownership.\n\nA meaningful reinvestigation requires : Reviewing original account-opening documents Comparing identity information to the consumers known identity Evaluating fraud indicators Determining whether the account could have been opened fraudulently ChexSystems response does not indicate that such steps were taken, nor does it provide the results of any such analysis.\n\n6. The FCRA Requires Removal of Unverifiable Information The FCRA requires consumer reporting agencies to ensure maximum possible accuracy. When information is disputed as identity theft and can not be verified with documentation, it must not continue to be reported. \n\nAt this time, the account remains unverifiable to me because : I do not recognize it I did not open it I filed an FTC Identity Theft Report No documentation has been produced Continuing to report unverifiable information causes ongoing harm and is inconsistent with the purpose of the FCRA.\n\n7. Harm Caused by Continued Reporting The continued presence of inaccurate ChexSystems information has caused and continues to cause harm, including : Difficulty opening legitimate bank accounts Negative risk assessments Delays or denials of financial services Time and effort spent correcting inaccurate records Stress and uncertainty regarding my financial reputation These harms persist as long as the information remains on file.\n\n8. What a Fair Resolution Requires A fair resolution requires ChexSystems to take one of the following actions : Option 1 : Provide Documentation ChexSystems should provide original, independent documentation proving that I personally opened and authorized the account, including : The account application Identity verification records Authentication or device data Fraud review results Option 2 : Remove the Account If such documentation can not be produced, the account should be removed from my ChexSystems consumer file as unverifiable and fraudulent.\n\n9. Clarification Regarding Furnisher Communication ChexSystems suggests that I may contact the furnisher directly. While I understand that option, my dispute is with ChexSystems reporting of the information. As a consumer reporting agency, ChexSystems has an independent obligation t\no ensure accuracy and can not defer that responsibility entirely to the furnisher.\n\n10. No Waiver of Rights My submission of this feedback does not waive any rights under the FCRA, including the right to : Request the method of verification Dispute future inaccuracies Seek correction or deletion of unverifiable information Receive notification of any reinsertion 11. Summary To summarize : I do not own the account I did not authorize it I filed an FTC Identity Theft Report ChexSystems did not provide proof of ownership Policy explanations do not substitute for evidence The information remains unverified Continued reporting causes harm 12. Final Request I respectfully request that the CFPB r\nequire ChexSystems to either : Provide verifiable documentation proving that I opened and authorized the account, or Remove the account from my ChexSystems consumer file in accordance with the FCRAs identity-theft and accuracy provisions.\n\nUntil such documentation is produced, the account should not continue to be reported.","date_sent_to_company":"2025-12-16T20:58:50.000Z","issue":"Attempts to collect debt not owed","sub_product":"I do not know","zip_code":"32810","tags":null,"has_narrative":true,"complaint_id":"18087494","timely":"Yes","company_response":"Closed with explanation","submitted_via":"Web","company":"Fidelity National Information Services, Inc. I am submitting this CFPB case to request immediate assistance in ensuring full compliance with federal law and the complete removal of this fraudulent account. \n\nXXXX. Background of the Identity Theft Incident The appearance of the XXXX account on my credit report was the first indicator that a fraudulent incident had occurred. I did not apply for, open, or authorize any account with XXXX nor have I ever conducted business with this company in any capacity. I have never signed any agreement, never provided permission for any credit inquiry, and never provided any identifying information that would reasonably connect me to this account. The mere presence of this account on my report signals that a third party obtained and used my personal information without authorization. \n\nIn response to discovering this unauthorized activity, I immediately began documenting the identity theft. I filed an official complaint with the Federal Trade Commission ( FTC ), generated an Identity Theft Report, and retained copies of this documentation for all related disputes. In effect, the FTC Identity Theft Report formally establishes that I am a victim of identity theft and triggers protections under federal law, specifically those outlined in the Fair Credit Reporting Act ( FCRA ). \n\nXXXX. The Account Does Not Belong to Me and Can not Be Verified I want to be absolutely clear that I do not own this account. I never applied for it, never received any credit benefits from it, and never had any contract or communication with XXXX. Any documents, applications, digital signatures, login attempts, device associations, or transaction histories associated with this account are fraudulent. \n\nUnder the FCRA specifically 602 ( A ) ( accuracy ), 607 ( B ) ( reasonable procedures ), and 611 ( a ) ( reinvestigation ) furnishers such as XXXX have a legal obligation to report information accurately and to reinvestigate any disputed information. XXXX can not legally verify this account because I am not the one who created it, and therefore no legitimate validation documents exist that tie it to my identity. \n\nIf XXXX claims otherwise, they must produce : An application signed BY ME Identification documents provided BY ME IP address logs tied TO devices that I own Device ID or digital fingerprinting linking TO my personal electronics Phone number verification logs tied TO numbers that belong to me Geolocation verification reflecting my confirmed address Transaction logs originating FROM me Any form of payment instrument belonging TO me Because none of these items exist, XXXX can not authenticate any element of this account. If any such documentation appears in their system, it was generated by a fraudster and should be immediately categorized as identity theft. \n\nXXXX. Filing the FTC Identity Theft Report and Taking All Required Steps Upon discovering this unauthorized account, I followed the federal requirements outlined by the FTC and the Consumer Financial Protection Bureau for consumers dealing with identity theft. My actions included : Filing an FTC Identity Theft Report Creating an identity theft affidavit Contacting the credit bureaus to report the fraud Disputing the XXXX account directly with the bureaus Freezing my credit Reviewing my credit report for other fraudulent entries Retaining documentation for legal and regulatory review The FTC Identity Theft Report serves as a legally recognized statement that I am a victim of identity theft. Under FCRA 605B, once a consumer provides an identity theft report, the furnisher and the credit bureaus are required to block all fraudulent information from the consumers file within four business days unless the furnisher provides clear evidence that the information is accurate. XXXX has not provided any such evidence. \n\nXXXX. The Harm Caused by XXXX Continued Reporting The presence of this fraudulent account has caused ongoing and escalating damage to my financial well-being, including but not limited to : A\n\n. Credit Score Damage A fraudulent account, especially one in delinquency or derogatory status, severely harms my credit standing. It increases my debt-to-income ratio, displays payment history that is not mine, and negatively affects my credit utilization and creditworthiness. B. Denial of Credit Opportunities Because of this fraudulent information, lenders may incorrectly assume I have unmanaged or unpaid debt. This has the potential to cause denials for loans, credit cards, housing applications, or employment screenings. \n\nC. Emotional Distress Managing identity theft is mentally exhausting. The repeated disputes, documentation requirements, and uncertainty about my financial security cause significant stress and XXXX \n\nD. Damage to My Reputation False reporting implies irresponsibility with credit, which harms my personal and professional reputation.\n\nE. Continued Risk of Reinsertion If the account remains unblocked or is not deleted entirely, it may reappear even after dispute resolutions a problem explicitly addressed under FCRA 611 ( a ) ( 5 ) ( B ). \n\nThe damage will continue unless the account is permanently removed. \n\nXXXX. XXXX Failure to Validate the Alleged Account When disputing this account with the credit bureaus, XXXX failed to provide any : Contract Signature Verified application Documentation with matching personal identifiers Device verification logs Consent records Legally binding proof Instead, the account remains on my credit report with no supporting evidence. Because the burden of proof lies with the furnisher not the victim this failure requires immediate deletion of the account. \n\nIf XXXX continues to report the account without proper authentication, it constitutes : Willful noncompliance Negligent noncompliance Violations of federal reporting guidelines A failure to follow reasonable procedures for dispute investigations This is a violation of my rights as a consumer. \n\nXXXX. How This Account Likely Resulted From Identity Theft Although I do not know the exact method used by the fraudster, identity thieves commonly use : Previously leaked personal data Stolen mail Phishing attempts Synthetic identity construction Unauthorized use of old or compromised digital credentials Without stricter validation measures, accounts can be opened with falsified or incomplete identification especially when done entirely online. \n\nI have no connection with XXXX, no history of attempting to open an account with them, and no reason why I would ever initiate this form of credit. This strengthens the evidence that the account was opened by someone else using my information without permission. \n\n7. Requirements Under Federal Law for Identity Theft Victims The FCRA provides strong protections for victims of identity theft, which include : A. Blocking Fraudulent Information ( 605B ) Once notified and given proper documentation, the furnisher MUST block fraudulent information.\n\nB. Reinvestigation Requirements ( 611 ) The furnisher must conduct an independent, good-faith reinvestigation, not merely rely on automated e-OSCAR responses.\n\nC. Furnisher Responsibilities ( 623 ( A ) ) Information provided to credit bureaus must be accurate and verifiable.\n\nD. Reasonable Procedures Requirement ( 607 ( B ) ) Furnishers must have robust systems to avoid reporting fraudulent data. \n\nXXXXs continued reporting of this account despite the identity theft documentation is inconsistent with these federal mandates. \n\nXXXX. What I Requested From XXXX and Why They Must Comply I have already requested that XXXX : Validate the account Provide documentation Remove the fraudulent entry Cease all reporting Stop furnishing inaccurate information To date, XXXX has not satisfied these requirements. They have not produced any documentation linking me to this account. Their inaction places them in violation of federal reporting standards and harms me as a victim of identity theft. \n\nXXXX. Detailed Explanation of the Ongoing Issues A. Lack of Communication and Transparency I have not received any substantive responses or explanations directly from XXXX. \n\nB. Continued Appearance on My Credit Reports Even after filing the FTC report, the account remains on my file. \n\nC. Automated Verification Failures Many furnishers use automated systems ( like XXXX ), which can not properly handle identity theft cases. This may have allowed the fraudulent account to remain despite my disputes. \n\nD. Incorrect Reporting to All Three Credit Bureaus This increases the difficulty of clearing my name and amplifies the damage.\n\nE. Threat of Further Fraud The existence of this account suggests my information is still at risk. \n\nXXXX. Why This Account Must Be Immediately Deleted A fraudulent account can not be corrected it can only be removed. \n\nBecause : I had no involvement in creating it XXXX can not verify it The FTC Identity Theft Report is filed The FCRA mandates blocking The account harms my accuracy rights The account is legally invalid The only lawful and fair action is permanent deletion. \n\nXXXX. The Damage Will Continue Until This Account Is Removed Every day that this account remains : It harms my credit It misrepresents my financial behavior It limits my opportunities It compounds identity theft trauma It undermines federal consumer protection laws The longer XXXX delays, the greater the violations become. \n\nXXXX. My Full Request to the CFPB I respectfully request that the CFPB require XXXX to : Delete the fraudulent XXXX account ( Ref : XXXXXXXX XXXX ) from all credit bureaus Stop reporting or re-reporting this fraudulent information Cease all collection efforts Acknowledge that I am not responsible for any associated debt Comply fully with the FTC Identity Theft guidelines and FCRA provisions Provide written confirmation of the resolution I have done everything required of me as a victim of identity theft. XXXX must now do its part and comply with federal law. \n\nXXXX. Conclusion The XXXX account appearing on my credit report is fraudulent and the result of identity theft. I do not own it, I did not authorize it, and XXXX has no legally valid basis for continuing to report it. I have filed an FTC Identity Theft Report, disputed the account, and taken every step required by the FCRA. At this point, the only lawful and fair resolution is the complete removal of the account from all credit bureaus and confirmation that I owe nothing related to it. \n\nI respectfully request the CFPBs assistance in ensuring that XXXX fully complies with its legal obligations under federal law and permanently deletes this fraudulent account.","date_sent_to_company":"2025-12-04T18:53:58.000Z","issue":"Attempts to collect debt not owed","sub_product":"I do not know","zip_code":"10801","tags":null,"has_narrative":true,"complaint_id":"18106185","timely":"Yes","company_response":"Closed with non-monetary relief","submitted_via":"Web","company":"HW Holding, Inc","date_received":"2025-12-04T18:49:20.000Z","state":"NY","company_public_response":null,"sub_issue":"Debt is not yours"},"highlight":{"complaint_what_happened":["The Damage Will Continue Until This Account Is Removed Every day that this account remains : It harms my credit It misrepresents my financial behavior It limits my opportunities It compounds identity theft trauma It undermines federal consumer protection laws The longer XXXX delays, the greater the violations become. \n\nXXXX."]},"sort":[17.895845,"18106185"]},{"_index":"complaint-public-v1","_id":"15667966","_score":17.756933,"_source":{"product":"Credit card","complaint_what_happened":"Company : The XXXX XXXX XXXX ( Issuer ) Additional Company Mentioned : Concora Credit Inc. When I accessed the account via Concora online, I noticed it had been approved for a {$700.00} credit line, and the mailing address used to apply on file belonged to another person in Maryland. \n\nUsing the phone number provided on the internet, I accessed the automated system and successfully froze the card to prevent use. \n\nEarly morning, XX/XX/XXXX : I called The XXXX XXXX XXXX as soon as their business hours opened and explicitly reported the fraud. This time, the automated system prompted me again with an option to press 3 to freeze the card. I also attempted to report unrecognized charges, but the system again responded that business hours are closed. This response does not constitute a fair, lawful, or complete resolution of the issues raised and fails to address the substance of my fraud and identity theft claim. \n\nWhile a cease-and-desist instruction may suspend collection activity, it does not resolve inaccurate credit reporting, does not cure the harm caused by fraudulent account reporting, and does not satisfy the obligations imposed when a consumer disputes an account as identity theft. The companys response therefore leaves the core dispute unresolved and shifts the ongoing burden and harm entirely onto the consumer.\n\n1. A Cease-and-Desist Is Not a Resolution to Inaccurate or Fraudulent Reporting The companys response acknowledges the request for a cease-and-desist and confirms that collection activity has been suspended. However, the company simultaneously states that it has verified the account as accurate and will continue reporting it to the credit reporting agencies.\n\nThis position is fundamentally flawed. A cease-and-desist instruction addresses communication and collection conduct, not accuracy of reporting. When the dispute centers on whether an account belongs to the consumer at all, stopping collection activity while maintaining adverse credit reporting does not resolve the disputeit merely pauses one form of harm while allowing another to continue.\n\nThe primary injury in this matter is not unwanted communication ; it is the continued reporting of an account that I do not own. The companys response fails to address that injury.\n\n2. Identity Theft Claims Require More Than Internal Verification The company states that its Account Protection ( Fraud ) team completed a fraud investigation and found no basis to support the fraud claim. This conclusory statement lacks transparency and does not demonstrate that a meaningful investigation occurred.\n\nWhen a consumer asserts identity theft and provides notice of fraud, the standard is not whether the companys internal records reflect the account as valid. Internal account notes, automated verification systems, or data inherited from a prior creditor do not constitute independent proof of consumer liability.\n\nA meaningful fraud investigation requires : Verification of how the account was opened Review of the original application or contract Confirmation of consumer identity at origination Evaluation of IP address, device data, signatures, or authentication methods Consideration of whether the account activity is consistent with the consumers known financial behavior The company has not provided evidence that such steps were taken, nor has it identified what documentation was reviewed to conclude that the account was not fraudulent. Simply stating that the account was verified is not sufficient when the consumer disputes ownership of the account itself.\n\n3. Continued Reporting Without Proof Perpetuates Harm The company asserts that it is required by law to report factual information and that it verified were reporting the account correctly. This assertion misstates the companys obligations.\n\nCredit reporting laws do not require a furnisher to report information that is disputed, unproven, or the subject of a fraud claim. To the contrary, furnishers are required to ensure maximum possible accuracy and to refrain from reporting information that can not be substantiated when challenged.\n\nWhen a consumer disputes an account as identity theft, continued reporting without providing proof of liability shifts the risk of fraud entirely onto the consumer. This undermines the purpose of consumer protection laws and results in ongoing reputational and financial harm to someone who may not owe the debt at all.\n\nThe companys response acknowledges that it is no longer the creditor on the account, yet it continues to report the account and rely on information obtained from another entity. This raises further concerns about whether the company has access to original documentation sufficient to establish consumer liability.\n\n4. A Cease-and-Desist While Maintaining Reporting Is Procedurally Unfair Placing an account into cease-and-desist status while refusing to correct or remove disputed reporting creates an inequitable outcome : The consumer remains harmed by negative credit reporting The company avoids further investigation by closing the complaint The burden shifts entirely to the consumer to file new disputes or complaints The underlying accuracy issue is never resolved This approach treats cease-and-desist as a substitute for compliance, when in fact it is merely a communication preference. It does not address whether the account belongs to the consumer, whether the reporting is accurate, or whether fraud occurred.\n\n5. Failure to Address the Substance of the Dispute The original complaint raised substantive issues regarding : Account ownership Fraud and identity theft Lack of original documentation Continued reporting despite dispute The companys response does not meaningfully address these points. It does not explain : What evidence proves the account belongs to me What documentation supports the reporting Why the fraud claim was rejected Why continued reporting is appropriate despite dispute Instead, the response relies on generalized statements and policy language without engaging with the facts of the dispute.\n\n6. Closure of the Case Without Resolution Is Inappropriate The prior CFPB case was closed with non-monetary relief based solely on the implementation of a cease-and-desist. This outcome does not resolve the dispute and should not be treated as final.\n\nThe account continues to appear on my credit reports.\n\nThe fraud dispute remains unresolved.\n\nThe harm continues.\n\nFor these reasons, I am creating a new CFPB case because the prior case was closed without correcting the disputed reporting or addressing the fraud claim in a substantive way.\n\n7. What a Proper Resolution Should Have Included A fair and compliant response would have included one or more of the following actions : Temporary suppression or removal of the account pending investigation Provision of documentation proving consumer liability Clear explanation of the fraud investigation process and findings Correction or deletion of unverifiable reporting Written confirmation of the accounts status and ownership None of these were provided.\n\n8. Ongoing Harm to the Consumer As a result of the companys decision to maintain reporting while closing the complaint, I continue to experience : Credit score damage Increased difficulty obtaining credit Reputational harm Time and emotional burden associated with repeated disputes This harm is ongoing and avoidable.\n\n9. Conclusion The companys cease-and-desistonly response is procedurally inadequate, substantively deficient, and fails to resolve the core dispute. It does not address whether the account is mine, does not provide proof of liability, and does not cure the inaccurate reporting that continues to harm me.\n\nAccordingly, I reject the cease-and-desistonly response as an insufficient resolution and submit this rebuttal to document that the issues raised remain unresolved. The continued reporting of this account warrants further review, investigation, and corrective action.","date_sent_to_company":"2026-01-28T00:22:08.000Z","issue":"Took or threatened to take negative or legal action","sub_product":"I do not know","zip_code":"63031","tags":null,"has_narrative":true,"complaint_id":"19055882","timely":"Yes","company_response":"Closed with explanation","submitted_via":"Web","company":"Bread Financial Holdings, Inc.","date_received":"2026-01-28T00:19:28.000Z","state":"MO","company_public_response":null,"sub_issue":"Sued you in a state where you do not live or did not sign for the debt"},"highlight":{"complaint_what_happened":["the account was not fraudulent."],"company":["Bread Financial Holdings, Inc."]},"sort":[16.546864,"19055882"]},{"_index":"complaint-public-v1","_id":"14391895","_score":16.439875,"_source":{"product":"Credit reporting or other personal consumer reports","complaint_what_happened":"PLEASE PUBLISH TO CONSUMERFINANCE.GOV To Whom It May Concern at the CFPB : I am writing to formally complain about XXXX mishandling of my credit dispute under the Fair Credit Reporting Act ( FCRA ), Section 611. I never claimed identity theft in that complaint, nor did I authorize any fraud-related dispute. However, Experian mishandled my dispute and transmitted incorrect information to my XXXX loan servicer, XXXX, falsely indicating that my account was involved in an identity theft or forgery claim. \nAs a result of Experians actions, XXXX fraudulently designated my account as fraud-related, triggering unnecessary fraud procedures that have caused administrative burdens and potential harm to my credit report. I formally disputed this misclassification by filing CFPB Complaint ID XXXX against XXXX, which responded on XX/XX/XXXX, at XXXX XXXX EST, referencing my original Experian dispute as the reason for the fraud designation. \nThis means that Experian is the direct cause of this fraudulent misclassification, and its failure to ensure accurate reporting has led to a violation of multiple federal and XXXX consumer protection laws. \nLegal Violations Committed by Experian Under Federal, XXXX, and XXXX Laws Experians fraudulent misclassification of my student loan as an identity theft dispute has triggered multiple legal violations at the federal, XXXX, and XXXX levels. Below is a comprehensive legal breakdown proving Experians liability under each jurisdiction. \nI. Federal Law Violations ( FCRA, CFPA, FACTA, Accuracy & Integrity Rule ) 1. Fair Credit Reporting Act ( FCRA ) Violations FCRA 1681i ( a ) ( 1 ) Failure to Conduct a Reasonable Reinvestigation You failed to properly reinvestigate my dispute in CFPB Complaint ID XXXX, leading to a fraudulent misclassification that directly harmed my XXXX loan account. \nInstead of verifying my dispute, you passed false information to XXXX, which then wrongfully flagged my account under fraud protocols. \nFCRA 1681i ( a ) ( 6 ) ( B ) Failure to Notify Consumer of Investigation Results You never informed me that you were transmitting my dispute as a fraud-related claim to XXXX. \nI was never notified of any changes that resulted from your dispute processing, violating my right to due process in credit reporting. \nFCRA 1681e ( b ) Failure to Maintain Maximum Possible Accuracy Your failure to accurately process my dispute resulted in material inaccuracies on my credit report. \nThe wrongful identity theft designation created an unnecessary burden, requiring me to dispute an issue that you unlawfully triggered. \nFCRA 1681c-2 ( a ) Failure to Block Information in Cases of Identity Theft If you processed my dispute as an identity theft case but failed to provide me with protections under FCRA 1681c-2 ( a ), then you are in violation of this law. \nYou improperly flagged my loan under fraud status without verifying the claim, which is the exact type of harm this law was meant to prevent. \n15 U.S.C. 1681n Willful Noncompliance with FCRA If you knowingly misclassified my dispute, this constitutes willful misconduct under the FCRA.\n\n15 U.S.C. 1681o Negligent Noncompliance with FCRA Even if this was an error, your failure to correct it after my CFPB complaints and dispute filings constitutes negligence. \n2. Consumer Financial Protection Act ( CFPA ) Unfair, Deceptive, and Abusive Acts or Practices ( UDAAP ) ( 12 U.S.C. 5536 ( a ) ( 1 ) ( B ) ) Unfair Business Practices You misclassified my dispute as identity theft, misrepresented your findings to XXXX, and failed to notify me, which meets the legal definition of unfair business practices. \nDeceptive Representation of My Dispute You misled me by processing my dispute as identity theft when that was never my claim. \nYou failed to provide transparency on how my dispute was processed, making it impossible for me to correct the error before it harmed my XXXX loan account. \n3. FACTA ( FCRA 312 ) Failure to Maintain Data Accuracy Failure to Ensure Data Integrity You failed to ensure data accuracy and security, allowing false identity theft claims to be passed to a loan servicer, which then applied an unlawful fraud classification. \nFailure to Identify Systemic Errors in Processing Disputes FACTA requires CRAs to establish data security and fraud prevention measuresyour actions indicate a breakdown in those safeguards. \n4. Accuracy and Integrity Rule ( 12 C.F.R. 1022.43 ) Failure to Maintain Reasonable Procedures to Ensure Accurate Reporting You failed to verify the nature of my dispute before transmitting it to XXXX. \nThis misclassification demonstrates systemic failures in your data integrity procedures. \nXXXX. XXXX Consumer Protection Procedures Act ( XXXX CPPA ) Violations XXXX CPPA XXXX ( XXXX ) Misrepresentation of a Material Fact Your misrepresentation of my dispute as identity theft constitutes a false representation under XXXX XXXX XXXX \nThis misrepresentation directly resulted in XXXX classifying my XXXX loan as fraud-related. \nXXXX XXXX XXXX ( f ) Failure to Perform a Legal Duty You had a legal obligation to process my dispute correctly but failed to do so. \nBy failing to conduct a proper reinvestigation and misclassifying my account, you failed to perform a legal duty owed to me under XXXX law. \nXXXX. XXXX. Identity Theft Protection Act XXXX ( a ) Failure to Protect Personal Information Failure to Take Reasonable Steps to Prevent Identity Misclassification If you mishandled a dispute related to identity theft but failed to provide me with proper consumer protections, you may have violated this provision. \nFailure to Properly Handle Dispute Data Your failure to verify the identity theft status of my dispute before flagging it to a data furnisher constitutes a failure to protect my sensitive consumer information. \nXXXX. California Consumer Credit Reporting Agencies Act ( CCRAA ) Violations California Civil Code 1785.16 ( a ) - ( d ) Failure to Investigate Disputes Properly You did not reinvestigate my dispute properly, instead misclassifying it as identity theft and forwarding this incorrect information to a loan servicer. \nCalifornia Civil Code 1785.14 ( b ) Failure to Ensure Maximum Possible Accuracy Your failure to maintain accurate reporting resulted in a fraud misclassification, which created unnecessary burdens on my XXXX loan account. \nXXXX. California Unfair Competition Law ( UCL ) Violations California Business and Professions Code XXXX Engaging in Unfair and Deceptive Business Practices Your misclassification of my dispute meets the UCLs definition of an unfair business practice. \nYou engaged in deceptive conduct by failing to accurately process my dispute while misleading me about the results. \nHarm Caused by Experians Fraudulent Misclassification As a direct result of Experians reckless and unlawful misclassification of my dispute, I have suffered substantial harm, undue burden, and financial consequences that continue to affect my ability to manage my financial affairs. \nThe impact of Experians misconduct is both immediate and ongoing, creating unnecessary obstacles that would not have existed had Experian complied with its legal obligations. \nMy XXXX loan servicer ( XXXX ) improperly flagged my account as fraud-related, resulting in unjustified administrative hurdles, additional documentation requirements, and unnecessary verifications. These excessive procedures have delayed my ability to manage my XXXX loan account efficiently, creating avoidable confusion and financial uncertainty. \nI have been forced to expend significant time and effort disputing an issue that I never caused. Experians failure to conduct a proper reinvestigation has required me to submit multiple disputes and regulatory complaints to correct an error that originated from Experians own misconduct. The time, effort, and administrative burdens placed on me constitute an unjustified and avoidable intrusion into my personal and financial affairs. \nExperians fraudulent misclassification may have directly harmed my credit profile. Fraud and identity theft designations on a consumer 's file can trigger heightened fraud monitoring, unnecessary account restrictions, and increased scrutiny from financial institutions. These negative consequences have the potential to restrict my access to credit, interfere with loan servicing, and damage my financial standing. \nThe wrongful designation may have triggered alerts or automated risk assessments by lenders, potentially affecting my ability to secure favorable financial terms. Experian 's actions could have led to increased difficulty obtaining credit, higher interest rates, or unwarranted account reviews by financial institutions. \nExperians failure to properly investigate my dispute has created an ongoing cycle of harm, forcing me to pursue additional regulatory action to correct their misconduct. This has caused undue emotional distress, financial uncertainty, and administrative burdens that were entirely avoidable had Experian complied with its legal obligations under federal and state laws. \nThe cumulative impact of Experians misconduct is not limited to administrative burdensit has resulted in financial harm, potential damage to my credit profile, and unnecessary disruptions to my financial security. I have been forced to navigate a situation entirely of Experians making, enduring consequences that Experian had a legal duty to prevent. Experian must be held fully accountable for the harm caused by its negligence, willful noncompliance, and reckless disregard for consumer protection laws. \nRequested Regulatory Action From Experian ( CFPB ) I request that the Consumer Financial Protection Bureau ( CFPB ) initiate a formal investigation into Experian for violations of the Fair Credit Reporting Act ( FCRA ), the Consumer Financial Protection Act ( CFPA ), and Washington, XXXX. consumer protection laws. \nTo ensure accountability and compliance, I request that the CFPB take the following actions : 1. Immediately investigate Experians role in fraudulently misclassifying my XXXX loan dispute and determine the full extent of their systemic failures in dispute handling. \nXXXX. Require Experian to remove any fraud or identity theft designation associated with my name, credit report, or linked disputes. \n3. Compel Experian to disclose all internal records, communications, and investigation notes related to CFPB Complaint ID XXXX and any other dispute Experian has associated with my XXXX loan. \nXXXX. Mandate that Experian provide a formal, written explanation detailing : o How my dispute was processed o Who within Experian was responsible for the misclassification o What internal procedures ( or failures ) led to the erroneous fraud designation XXXX. Ensure that Experian formally confirms in writing that no adverse credit reporting has resulted from this fraudulent misclassification. \nExperians reckless and unlawful misclassification created undue harm and violated multiple federal and state consumer protection laws. The CFPB must take enforcement action to ensure Experians compliance with all applicable regulations and prevent similar violations from occurring in the future.\n\nDemanded Corrective Action from Experian Experians fraudulent misclassification of my XXXX loan dispute is a direct violation of its legal obligations under federal and state consumer protection laws. To mitigate the harm caused by this misconduct, I am demanding that Experian immediately take corrective action by : XXXX. Removing any fraud or identity theft classification associated with my XXXX loan account and ensuring that Aidvantage updates its internal records accordingly. \nXXXX. Providing me with all internal records, investigation notes, and communications related to CFPB Complaint ID XXXX and any other dispute that led to this misclassification. \nXXXX. Issuing a formal written explanation detailing why my dispute was misclassified and the internal failures that led to this violation. \nXXXX. Providing written confirmation that no negative reporting, alerts, or fraud-related designations have impacted my credit report. \nXXXX. Outlining the corrective measures that Experian is implementing to prevent future misclassifications and failures in dispute processing. \nExperians failure to comply with these corrective actions within 30 business days will result in further escalation, including additional regulatory complaints, legal action, and direct engagement with consumer protection agencies. \nAttached as Evidence The following documents are attached as supporting evidence of Experians fraudulent misclassification, failure to conduct a proper investigation, and noncompliance with federal and XXXX consumer protection laws : Sworn and Notarized Affidavit of Truth ( AOT ) : A master legal record establishing the foundation for my disputes and outlining systemic issues with Experians dispute-handling practices. \nCFPB Complaint ID XXXX : My original dispute against Experian that was wrongly used to trigger an identity theft claim with XXXX. \nCFPB Complaint ID XXXX : The complaint filed against XXXX regarding its fraudulent identity theft classification, to which XXXX responded XXXX XX/XX/XXXX, at XXXX XXXX EST, citing Experian as the source of the misclassification. \nFTC Fraud Report ID XXXX : A report filed with the Federal Trade Commission ( FTC ) officially documenting that Experians fraudulent misclassification of my dispute caused XXXX to process an identity theft claim that I never submitted. This report serves as a formal record of Experians role in triggering the erroneous fraud designation and requests an investigation into its dispute-handling failures and violations of federal and state consumer protection laws. \nExperians Violations and My Commitment to Accountability Experian had an obligation to process my dispute accurately and in full compliance with federal and state consumer protection laws. Instead, it made a deliberate choice to misclassify my dispute, misrepresent the results, and transmit false information that directly harmed my XXXX loan account. These actions reflect a fundamental failure of Experians dispute resolution processes and a blatant disregard for consumer rights. \nAt every step, I have acted diligently, lawfully, and in full accordance with my rights under the Fair Credit Reporting Act ( FCRA ), the Consumer Financial Protection Act ( CFPA ), and the Washington, XXXX Consumer Protection Procedures Act ( XXXX CPPA ). I have meticulously documented every inaccuracy, disputed every misrepresentation, and engaged with the appropriate regulatory authorities to demand compliance and accountability. \nThis complaint is not merely a request for correctionit is a formal demand for regulatory intervention, enforcement action, and systemic accountability. Experians failure to uphold its legal obligations has caused demonstrable harm, and it is imperative that this matter be addressed not only to rectify the damage done to me but to ensure that no other consumers are subjected to similar misconduct. \nExperian now has a choiceit can comply with the law, take full responsibility, and correct its failures, or it can continue its pattern of noncompliance and face escalating regulatory and legal consequences. I am fully prepared to pursue every available avenue to ensure that Experian is held accountable at every level necessary. \nNotice of Accountability, Enforcement & Consequences Experian is now formally on notice that this matter remains unresolved and requires immediate corrective action. I have acted in full compliance with all applicable laws, followed every proper procedure, and engaged the appropriate regulatory agencies to ensure Experian is held accountable for its violations. \nAt this stage, the harm caused is undeniable. The issue is no longer whether I have been affectedit is whether Experian will take responsibility, correct its errors, and comply with federal and state consumer protection laws. \nIf Experian stays on this path, it risks federal litigation, regulatory fines, and intensified oversight : Lawsuit Exposure Violations under F\n\nCRA 1681n, UDAAP, and state consumer laws could lead to statutory damages and injunctive relief. Regulatory Penalties The CFPB has authority under 12 U.S.C. 5565\n( a ) to impose fines for repeated violations. Continued noncompliance could escalate enforcement actions.\n\nSystemic Investigation If misclassification patterns persist, the CFPB may have no choice but to pursue a consent order, stricter oversight, or legal action to force compliance. \nIf Experian fails to act, I will escalate through all available legal and regulatory channels. Any further action taken will be in direct response to Experians ongoing failure to correct its misclassification and ensure compliance. My approach remains measured, lawful, and necessary to enforce my rights and prevent further harm. \nSincerely, XXXX XXXX XXXX","date_sent_to_company":"2025-03-17T22:46:33.000Z","issue":"Problem with
