I sent this information to them more than once. The last time was in XXXX of 2020. That was according to them, per our conversation on XX/XX/2020. \n\nI recently went to apply for an XXXX XXXX  when I discovered the items were still there. I reached out for some legal advice on how to handle this. I was then educated about the FCRA and the XXXX. Experian refused to block the accounts when I called. \n\nI asked them if the federal regulations didnt apply. The lady from the fraud department told me that I didnt qualify. I asked her how I didnt qualify to be protected by federal regulations at that point, in which she said that it was company policy. She said she couldnt tell me why I didnt qualify and continued to argue that company policy supersedes federal regulations. \n\nI am now at risk of losing my employees during these hard times because Experian feels like they need to take the law into their own hands. Please help me to get this resolved. I didnt ask Experian to store my personal records. Wells Fargo continues to close consumer accounts improperly without valid justification. I was informed that the risk department closed my XXXX XXXX Propel ( Ending XXXX ) and Business Platinum credit card ( Ending XXXX ) due to \" suspicions of irregular payment behavior and suspected fraud. '' I was told this was because I am making multiple payments within a month, but Wells Fargo never notified me that making more than XXXX payments each month was outside of its standard policies. XXXX, XXXX XXXX XXXX, XXXX XXXX, XXXX, XXXX, and XXXX XXXX all permit multiple payments ; thus, I had no idea that Wells Fargo regarded this as \" suspicion of fraud. '' I am a frequent foreign traveler who enjoys accumulating credit card points for future trips. If I have made more than four monthly payments, it is because Id rather put the charge on my credit card instead of running the same charge through my debit card and accumulating zero points. Hence, if an unexpected expense has to be paid and I do not have enough available credit, I would make an additional payment to cover the amount to accumulate credit card points. It appears that some employees in the risk department are unaware of the allure of credit card points and overseas travel in todays times. \n\nWells Fargo also used a stop payment request from my other bank, XXXX XXXX, to justify the closure of my account, despite the fact that I had phone representatives add notes to my account. The payment was made on XX/XX/XXXX, and after noticing that it did not post quickly, as it regularly does, I called the call center to inquire whether the payment would post that evening. I was somewhat relieved when I was informed that it would be posted because my statement was scheduled to close that evening. I attempted to pay down the balance before it was reported to the credit bureaus. The following morning, XX/XX/XXXX, I observed that the payment had not yet been posted, so I called Wells Fargo again to request that they cancel the payment. Instead, I withdrew the {$1200.00} payment from XXXX XXXX and then deposited it into my Wells Fargo everyday checking account ( ending XXXX ). I was informed that the rep could cancel the payment, and I inquired as to whether it would still be processed through my XXXX account. I was informed that the payment would not be presented to my XXXX account. Monday morning, XX/XX/XXXX, a {$1200.00} payment from Wells Fargo was pending on my XXXX account. Given that I had already deposited the funds into my Wells Fargo account to make the payment, I called XXXX to initiate a stop payment. My XXXX account had pending items that were at risk of not being covered due to the duplicate {$1200.00} payment that was pending. \n\nA few days later, I checked my Wells Fargo app to discover that my XXXX XXXX XXXX XXXX ( Limit {$12000.00} ) had been closed and that the Business Platinum card ( Limit {$2500.00} ) was also in the process of being canceled. I was quite outraged because I had previously provided explanations and had phone agents document it ; however, I was still unfairly penalized. Wells Fargo 's risk department marked the tradeline as \" potential fraud, '' and my credit score took a hit in addition to the closure as my average age of account history was reduced. \n\nI should also mention that I have both personal and business checking accounts ; my monthly personal checking account deposits range from {$18000.00} to {$50000.00}. My monthly business checking balance ranges from {$10000.00} to {$25000.00}. Since Wells Fargo can see my deposits because I do most of my primary banking with them, they incorrectly viewed me as a risk. The average XXXX does not deposit the amount XXXX deposit into Wells Fargo monthly. I contacted the Wells Fargo XXXX XXXX, who referred the matter back to the Risk department for evaluation, but I was denied reinstatement due to \" Possible Fraud, '' as the Wells Fargo XXXX department termed it. Even though the XXXX XXXX XXXX XXXX listened to all the phone records supporting my case and supplied facts to the risk department, Wells Fargo still flagged me as a potential fraud. This is incorrect on ALL agreements, and it is a slap in the face from a bank I've been with since XXXX. Today 's Wells Fargo client base is dwindling, and rather than making every effort to maintain long-term, loyal consumers ; the bank is pushing its core foundation away each day. \n\nI am requesting the reinstatement of my credit cards, as I have not engaged in any fraudulent behavior. I can not tolerate my primary bank closing my credit accounts and falsely accusing me of any wrongdoing. I will fight with every fiber of my being to reject the wrongful accusation they have imposed on me. As of today, I have not received any package from XXXX XXXX XXXX, I have done everything the merchant told me to, file a police report and file for bank dispute, I also have submitted a complaint through the XXXX XXXX XXXX, I really dont see anything I have done wrong here and I dont believe it would be fair for me to take the such a huge loss for jewelry that never reached my possession. Falsely filing a police report is a crime, the official police report should work as proof of I did not receive the merchandise. Firstly, prior to the merchant sending out this package ( value XXXX $ ), the merchant was aware that there is a security risk at my address, the previous package from this merchant have been falsely signed by someone else, and when I was in another state doing a job interview, those previous packages contained less value product yet required signature. However, under such a circumstance, the merchant still sent out such a high-value item without any security measures to ensure the package reach the hand of the correct recipient. I have provided the official police report to prove that I didn't receive the item as falsely submitting a police report is a crime. It is the merchant 's responsibility to ensure the package reaches the hand of the correct recipient therefore I don't believe I am responsible for the loss of the merchandise. \nSecondly, the proof of delivery provided by the merchant did not show whom it was received by, why should I be paying for the item when I did not receive the item? It is ridiculous for a luxury merchant to send out high-value items without any security measures, no signature or ID check nor did the carrier attempt to contact me for the delivery. The signature requirement was automatically applied when making a purchase at the merchants website, I did not opt out and why did the merchant have a signature requirement on the less valued items yet did not require a signature on the delivery of shipment that contained higher value? Under the circumstance that the merchant is aware there is a security risk at my address even with previous shipments that required signature, the merchant is supposed to take additional security measures such as an ID check or have me pick it up at one of the couriers locations to ensure that the next package ( the {$10000.00} product ) reaches the correct recipient. \nIn conclusion, the responsibility for the loss of the merchandise lies with the merchant, they should be the ones at fault for the loss of the item, as they failed to take sufficient security measures to ensure that the package reached the correct recipient, despite being aware of the security risk at my address. The merchant is responsible for ensuring that the package is delivered safely and to the correct recipient. It is unreasonable for me to be held responsible for the loss of the merchandise when there is no evidence to suggest that I received it. All unnecessary because that was not the agency they used. \n\nThe reason I acquired this card in the first place was to make several major purchases and then, hopefully, pay down the balance prior to expiration of the no interest period. One of those items was a camera and I found a great deal ( for {$1700.00} ) on my chosen model prior to getting the card so I put it on another card. I then decided to use my new Citibank card exclusively for all smaller purchases until they totaled {$1700.00}. Which I began to do. \n\nAnother item I wanted to purchase were components to build a new desktop PC. I had an email with a one-day sale at XXXX including several of the items I wanted. I spent several hours putting together an order and tried to pay with my Citibank card. That was XX/XX/XXXX. \n\nThats when the nightmare started. After I entered the credit card info, I was given a weird message that I was being directed to my cards website for some kind of verification. Ive been using credit cards for decades and shopping online for a very long time and have never seen anything like that before. I entered the requested information and was sent back to XXXX. I saw an order confirmation email and didnt think any more of it. But after a little while I notice several emails including one that my card had been declined with link to re-enter credit card information. I tried again but my Citibank card was declined again. \n\nI then signed on to my online Citi account and saw a warning about possible fraud and there was a number to call. So I did. But I didnt get through and then called the number on the back of the card. But I used my home phone instead of my cell ( I used my cell # when I set up my account ). Im not sure if using my home phone was a problem. If it was a problem Citi should have ended the call with instructions to call back using the number I had used to open the account. Or end the call and then Citi call me back on the number on my account. Citi has never called, ever. Other credit cards call me if there is something suspicious and the situation is quickly resolved. Just like the XXXX XXXX ad on TV. I have since added my home phone number to my account. \n\nThe phone call was ridiculous. No issues with the rep. She was doing the best she could with lousy Citi procedures. She wanted to know about other credit cards & bank accounts I had. Apparently, she needed to contact another bank for reasons I do not understand. But every bank was the same story : Im sorry sir, we do have an agreement with that bank. They created a security risk for me by requesting that information. Any information they are entitled to is on my credit report, which they got when I applied. \n\nWe made no progress and I was told I would have to wait for a letter with a form to complete & send back. Its clear to me that this is all about protecting Citibank. The risk from fraud is theirs, not mine. But they have never explained what the fraud was XXXX I doubt there was any ). I didnt want waste all the time ( and sale prices ) I had put into my order for Newegg so I put the order on another ( interest bearing ) credit card. \n\nAgain, that was XXXX. I was able to use my card earlier that day but it has been frozen since. But was only able to charge about {$760.00} before my card was frozen. \n\nThe next day ( XXXX ) I called back, this time on my cell phone ( the number associated with my account ). But no luck. I still have to wait for the letter. But at one point the rep asked for my password. I cant believe I was so stupid to give out my password over the phone. Citi created a security risk for me. No other card or bank has ever asked for a password. Giving them my password proved it was really me but I still had to wait for the letter. I have since changed my password. \n\nThe letter arrived on XXXX with IRS form XXXX. It said something about changing my SSN. I was stunned. I certainly never asked to change my SSN. I didnt know you could do that. I called immediately. Sorry for the confusion, just fill it out & send it back and you can FAX it to this #. So, I did that day XX/XX/XXXX, and sent it via USPS the next day. But I've had no response since. No phone call, no letter, no explanation, nothing. They don't need my SSN. They got it when I applied. \n\nNext, I sent them a detailed letter, dated XXXX, containing much of the above paragraphs and more. I sent it certified with delivery confirmation and received the confirmation. I gave them 10 days to respond, but, again, no phone call, no letter, no explanation, nothing. My credit card is still unusable as of today, XX/XX/XXXX. I know it's been a while so I guess I'm guilty of being too patient. \n\nI have excellent credit. Citi sent me an email inviting me to check my FICO score. XXXX out of XXXX. My insurance credit score is XXXX. I asked to have inquiry removed as their incompetence has caused me another ding to my credit. They stated they could not do anything to remove the inquiry. This company is outsourced and reps can barely speak comprehendible English. I asked for verification as they said they will email me it to me ... never came. She stated she would also mail it to me. When I check confirmation number in their \" check status '' it says cant be found. I am at a deadlock because this company has fallen through many times! I am not able to obtain a mortgage unless they do their job! Their service is highly incompetent and poses a risk to the American consumer. Rep purposely refuses to hang up when advised I'm waiting for the survey after the call. This single account alone has prevented me from being approved for a vehicle loan, forcing me to rely on unreliable transportation. It must be deleted immediately. \nXXXX XXXXXXXX XXXX High Balance : {$430.00} Date Opened : XX/XX/XXXX Collection * * This account is another inaccurate collection. No evidence of liability has been provided. Because of this entry, I was denied a store credit line to purchase essential household goods. I had to borrow money from friends, leaving me humiliated and dependent on others. FCRA 1681s-2 ( b ) requires furnishers to correct inaccurate information, which has not been done. This item must be deleted. \nXXXX XXXX XXXX High Balance : {$730.00} Date Opened : XX/XX/XXXX Collection * * Portfolio Recovery is reporting this debt inaccurately and without validation. Because of this item, I was denied medical financing during an emergency, which left me scrambling to find money for treatment. The XXXX  and fear I endured during that period can not be described. FDCPA 1692e prohibits false or misleading representation of debts. This account must be removed. \nHard Inquiries Unauthorized & Damaging Under FCRA 1681b, a credit report can only be accessed for permissible purposes. These inquiries were not authorized by me, and many are duplicative or fraudulent. They have lowered my credit score, created suspicion with lenders, and damaged my ability to secure credit. \nXXXX XX/XX/XXXX Unauthorized inquiry. I never gave consent. During that period, my email and account information were compromised, and I experienced significant security issues. Because of this, I decided to discontinue my XXXX XXXX XXXX service. \n\nDuring my communications with AT & T regarding the final balances, an XXXX XXXX XXXX agent explicitly informed me that the remaining device balances would be written off due to the circumstances surrounding the breach and the issues with my account. Based on that confirmation, I understood the matter to be resolved. \n\nXXXX XXXX  XXXX Reversal and Improper Transfer to Collections Despite the agents confirmation, XXXX XXXX XXXX later reversed that decision and claimed the balances were still owed. XXXX XXXX XXXX then sold the alleged debt to a collection agency. \n\nI disputed the debt with the credit reporting agencies and provided documentation concerning the breach and the misinformation from XXXX XXXX XXXX. The credit bureaus removed the item from my reports, acknowledging the inconsistencies and concerns. \n\nReselling the Debt After Removal Despite the item being removed, XXXX XXXX XXXX ( or the previous collection agency ) subsequently resold the same account to a new debt collector, Credence Resource Management, who then reinserted the item on my credit report. \nThis raises multiple concerns : Reinsertion of previously removed information without proper certification notice, as required by the FCRA Reselling of a disputed and compromised account Failure to acknowledge prior disputes and removals Potential violation of consumer rights Suspicious and Unnecessary Requests for Sensitive Information After I disputed Credences reporting, I received mail requesting that I send them the following sensitive information : Social Security number Drivers license Additional personal identifying information This request is highly suspicious and unnecessary, considering : XXXX. They failed to do so. Because of this entry, I was denied a mortgage refinance, which cost me thousands in additional interest payments. I never received proper validation. It has been reported in a way that makes me look irresponsible when the information itself can not be verified. Under FCRA 1681i and FDCPA 1692e, this is unlawful. This single account alone has prevented me from being approved for a vehicle loan, forcing me to rely on unreliable transportation. It has negatively affected my employment opportunities as well, since reliable transportation is essential. \nXXXX XXXX High Balance : {$2600.00} Date Opened : XX/XX/XXXX Late payment This account is reporting late payments from XXXX, which is obsolete information. Under FCRA 1681c ( a ) ( 4 ), negative information can not be reported beyond 7 years. Yet this still appears. Because of this, I was embarrassed when a bank officer told me I had late student loan payments from over 20 years ago. This is false, unlawful, and emotionally damaging. It creates the impression that I am financially irresponsible for life, when in fact the law clearly protects me from such reporting. \nXXXX XXXX High Balance : {$2600.00} Date Opened : XX/XX/XXXX Late payment This is another obsolete account showing late payments beyond the legal reporting limit. Under FCRA 1681c, this is strictly prohibited. Despite disputes, this entry remains, damaging my score. Because of this, I was denied a small business loan I needed to expand my income. The denial has prevented me from improving my financial life, and I am left with XXXX, XXXX, and fewer opportunities because of illegal reporting. \nXXXX XXXX  XXXXXXXX XXXX  High Balance : {$810.00} Date Opened : XX/XX/XXXX Collection * * This is a duplicate of the above XXXX account. Two different entries for the same debt unfairly punish me twice. Because of this duplication, lenders considered me high risk and denied me a needed auto loan. This forced me to rely on unreliable transportation, which nearly cost me my job. The XXXX, embarrassment, and real-life damage from this duplicate entry is unacceptable. It must be deleted immediately. \nXXXX XXXX XXXX  High Balance : {$430.00} Date Opened : XX/XX/XXXX Collection * * This account is another inaccurate collection. No evidence of liability has been provided. Because of this entry, I was denied a store credit line to purchase essential household goods. I had to borrow money from friends, leaving me humiliated and dependent on others. FCRA 1681s-2 ( b ) requires furnishers to correct inaccurate information, which has not been done. This item must be deleted. \nXXXX XXXX XXXX High Balance : {$730.00} Date Opened : XX/XX/XXXX Collection * * Portfolio Recovery is reporting this debt inaccurately and without validation. Because of this item, I was denied medical financing during an emergency, which left me scrambling to find money for treatment. The XXXX  and fear I endured during that period can not be described. FDCPA 1692e prohibits false or misleading representation of debts. This account must be removed. \nXXXX XXXXXXXX High Balance : {$4700.00} Date Opened : XX/XX/XXXX Collection * This large collection is unverified and damaging. Because of it, my rental application was denied. I was left in an unstable housing situation, unsure where my family could stay. The humiliation of being rejected in front of my children left me broken. Under FCRA 1681e ( b ), reporting agencies must ensure accuracy, but they failed. This unlawful entry must be deleted. \nHard Inquiries Unauthorized & Damaging Under FCRA 1681b, a credit report can only be accessed for permissible purposes. These inquiries were not authorized by me, and many are duplicative or fraudulent. They have lowered my credit score, created suspicion with lenders, and damaged my ability to secure credit. \nXXXX XXXX  XX/XX/XXXX Duplicate inquiry for the same company. This double reporting worsened my score unfairly. The duplication caused lenders to question my stability, leading to denial of financing. \nXXXX XXXX XXXX XXXX XX/XX/XXXX Unauthorized inquiry. I was not even in communication with this company. Because of this, I was denied a personal loan for emergency travel. Because of this, my score decreased, and I was denied a credit card approval. \nXXXX XXXX XXXX XX/XX/XXXX This inquiry was made without permission. It damaged my creditworthiness and created suspicion with other lenders. This is unlawful under FCRA 1681b. \nXXXX XXXX XXXX XX/XX/XXXX Unauthorized auto inquiry. I did not apply here. Fact, I, a woman, the consumer know that The Fair Credit Reporting Act 15 USC 1681 was made by congress to ensure accuracy and fairness of credit reporting. The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system.\n\n2. Fact, I, a woman, the consumer knows that 15 U.S. Code 1681q - Obtaining information under false pretenses. Any person who knowingly and willfully obtains information on a consumer from a consumer reporting agency under false pretenses shall be fined under title 18, imprisoned for not more than 2 years, or both. Notice, it is a fact, any person, which includes an organization such as Experian who willfully and knowingly obtains information on a consumer, like I, the affiant from another consumer reporting agency, without the written instructions or authorization pursuant to 1681b is information obtained under false pretenses. You have no lawful authority, and this is a crime under Title 18 and fines are described within 18 U.S. Code 3571.\n\n3. Fact, I, a woman, the consumer also knows that 15 U.S. Code 1681e ( b ) is in regard to compliance procedures that discussed the accuracy of a consumer report. \nWhenever a consumer reporting agency prepares a consumer report it shall follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates. Exhibits A-I shows how Experian allowed inquiries and incorrect personal information to be placed on my consumer report without verifying the accuracy of each entry, so they violated my consumer rights to a fair and accurate reporting of my credit. How did they verify the accuracy of these accounts? What process did they use to verify this information? When asked to be removed via mail and phone, Experian stated they have to report fair and accurate information and can not remove but I have sent them my ID showing proof of identification and a lease showing proof of my residence that they requested so how can they say that when the information on my report was not accurate nor matched the documents I sent in and then was later removed which proves they did not follow 15 U.S. Code 1681e ( b ) and violated my consumer rights. The inquiries showing in the documentation that was deleted does not comply with the law and does not comply with this maximum possible accuracy standard and must be removed due to its failure to maintain reasonable procedures, which is a violation of 15 U.S.Code 1681e ( b ) .Even though they was deleted, the damage was already done beforehand and when requesting the deletion I was advised on many occasions they were doing the job the right way and I had to wait for these items to fall off on their own. This was very damaging to my character because again my score dropped drastically, and I was denied for loans and other credit card opportunities that caused a financial burden on me to not be able to have the opportunity for credit and loans to help with my own financial issues because creditors seen all these inaccurate inquiries that showed them I was applying for too much credit in a short period of time but that was false.\n\n4. Fact, I, a woman, the consumer knows that 15 U.S. Code 1681n ( a ) ( 1 ) ( A ) states that unauthorized inquiries hold civil liability up to the amount of {$1000.00} or the actual damage as the cause of this failure, whatever is greater. Notice, it is a fact, affiant is aware, these unauthorized inquires which allowed third parties to obtain my consumer report under false pretenses has brought damage to my consumer report and reputation in the amount of {$1000.00} dollars per inquiry and Experian is in violation of 15 U.S. Code 1681n ( a ) ( 1 ) ( A ) and is liable for each unauthorized inquiry as shown in Exhibits A-I. When an investigative report is prepared, no adverse information in a consumer report may be included in a subsequent consumer report unless the reported was verified. Each month this false information was incorrectly verified making Experian liable for each consecutive reporting shown in documents provided. These unauthorized inquiries on my report caused me stressed and XXXX because I was being constantly denied for credit and loans that could have helped me out of my financial burden and also provide a better living situation for me and my family. \n\n5. Fact, I, a woman, the consumer knows that 1681b ( c ) ( 1 ) ( A ) ( B ) ( i ) ( 3 ) states the inquiries on my consumer report is unauthorized and has been furnished without my consent. There was no permissible purpose and is a violation of 15 U.S. Code 1681b ( c ) ( 1 ) ( A ) ( B ) ( i ) ( 3 ). I have attached Exhibits A-I showing after months even years later the inquires and incorrect addresses and names finally being removed but before doing so the damage is already done. I was denied for loans and credit opportunities due to lenders seeing this false information furnished my Experian and denied me multiple times which has caused severe and ACTUAL DAMAGE and INJURY to not only my personal but business life. Being denied has cause a financial burden to be able to take advantage of lower interest rates and high credit limits or even better car and home offers. I suffered from emotional distress because of the effects this inaccurate information on my consumer report causing me to be afraid and bad XXXX  of trying to get myself out this financial burden by applying for loans and credit help but creditors would not trust me and seen me as a high risk because of what they saw on my consumer report. I had hard time sleeping at night and became depressed because of fighting for the accuracy on my reports and being told by Experian that it was when it actually was not and then later on, they finally agreed and removed but it cost me a lot of loss during the time they would not fix their mistake when they were knowingly in the wrong. \n\n6. Fact, I, a woman, the consumer knows that 15 U.S. Code 1681g ( f ) ( 2 ) ( A ) ( i ) defines a credit score being a risk score. Notice, it is a fact, affiant is aware, a credit score is a risk score pursuant to 15 U.S. Code 1681g ( f ) ( 2 ) ( A ) ( i ). Like other risk scores, a credit score is a calculated score that tells you how severe a risk is, based on several factors to predict the likelihood of certain credit behaviors such as default. Because my credit score determines my risk with creditors the inaccurate reporting by Experian with these unauthorized inquiries and personal information, they reported caused me to be a high-risk factor and creditors denied me for there products and services.\n\n7. Fact, I, a woman, the consumer knows that 15 U.S. Code 1681o ( a ) ( 1 ) is for negligent noncompliance, or in other words, failure to comply even though they should have known they must comply, is equal to the sum of action damages.15 U.S. Code 1681o is acting like they didnt know it was wrong, even though they should is still a violation.
