I only became aware of the excessive rent charge after reviewing the lease documentation after the fact. \n\nThis is a violation of the Consumer Leasing Act ( CLA ) and Regulation M, which require clear disclosure of all financing costs, including rent charges, before lease execution. I believe this was an intentional omission to obscure an inflated money factor one I would have challenged had I known. \nI have also filed a complaint with South Carolina consumer affairs the case is open and active. Upon the discovery of the XXXX rent charge I contacted XXXX XXXX and was put in touch with the XXXX office. The woman I spoke with reviewed my contract she explained that she is embarrassed that she has no explanation and has never seen anything like that before. They have also opened an investigation on their end. \nI have all documents pertaining to this complaint and copies of lease agreements, and contact with dealership. \nHere is the complaint id associated with XXXX  Complaint ID : XXXX. \nBelow I also attached a copy of my previous lease that was with in fiscal year XXXX as well, the vehicle ended up having a serious and life threatening incident which is what consumer affairs is handling. The dealership replaced the rear shock coil due to recall XXXXXXXX XXXX XXXX XXXX XXXX The replacement piece failed shot out of the vehicle while parked in my driveway. I was very close to being injured as I was about to load luggage into my trunk for a XXXX hour car ride. When I notified the dealership of what happened they said oh its no big deal you wouldnt have wrecked nothing wouldve happened. The car shouldve been declared a lemon since it had been brought into serve 3 times over recall XXXX. I encourage whomever reads this complaint to please look up VIN number associated with the XXXX XXXX XXXX and under recall repairs which is also required by law to be published. When you click the link associated with that repair it says page not found. They tried to hide that anything ever even happened. The vehicle has since been sold to someone else. I was told they paid off that entire loan it wouldnt roll over into the new lease due to their negligence claiming to make things right. If you take a close examination of that contract you will see clearly the rent charge for that lease was only {$2400.00}. It is my assumption the dealership hid the financial loss they incurred due to what happened with the XXXX XXXX in the rent charge of my XXXX agreement. Credit score did not change within the time frame of changing vehicles. The XXXX contract also states that I was given a {$2400.00} trade in allowance from the old XXXX. Clearly that wasnt the case. This is false information.  Ditech is m y mortgage company. I do not escrow any funds with them, and they sent me no income checks or any other form of income in   XX/XX/XXXX  . I immediately called  Ditech to fi nd out why added income was reported to the IRS false ly. Ditech  has abysmal customer service - very disorganized and each time  one calls, one g ets different, varying information after lengthy times on hold - none of which so far appears to be correct now that it 's  six month later. During this time period, I have repeatedly had to call Ditech  and explain this mess, to no avail as of this date.     After numerous phone calls trying to find out what the alleged check was for and why they reported false information to the IRS and askin g Ditech to correct this false information sent by them to the IRS, I was told by Ditech  the check was for {$81.00} for interest they paid me because they had held onto my insurance claim check for so long in   XX/XX/XXXX .  ( I had roof damage/storm damage repaired in   XX/XX/XXXX   so my insurance company had sent me payment on the claim, but  Ditech insisted the check be signed over to them until the job was completed and inspected by Ditech. S omething I thought was very fishy, given what I feel is the suspicious nature of this company. I never chose to do business with  Ditech - apparently my mortgage was sold to them or they changed their name from Green Tree  after another mortgage outfit went bankrupt several years ago, from what I have been able to piece together. ) After numerous promises throughout   XX/XX/XXXX through  XX/XX/XXXX  an d numerous phone calls by me to  this Ditech outfit, (  somehow related  to Green Tree,  which I recall from decades ago was involved in the infamous Savings and Loan scandal, causing  XXXX   XXXX  to spend time in prison ) I still had received no check. I called again, and on   XX/XX/XXXX , received a \" check ' ' fro m Ditech for {$81.00}. I cashed the check at   XXXX   XXXX  ,  only to find o ut  XX/XX/XXXX , t hat the check was worthless!     XXXX   XXXX   assessed my account back for the {$81.00} plus {$12.00} in penalty fees.\nI called Ditech     XX/XX/XXXX , t o report this latest  XXXX . I was told they realized they had sent out checks with the wrong routing number or wrong account number. I was told they had now \" overnighted '' replacement checks  ( including {$35.00} extra for penalty fees )  to the damaged customers, and that I should have my check by now. It is n ow  XX/XX/XXXX , an d I still do not have the check. I called  Ditech aga in today about this. As usual, they kept me on hold for a lengthy time, seemed confused, had incomplete records of what has transpired, and initially said no check at all had been sent ever. After more time on hold, they then said yes, they had overnighted replacement checks last Friday and promised ( once again   ) the check 's in the mail.\nAfter nearly six   months of dealing with this company, sending them emails, and making numerous lengthy phone calls, I have no confidence in them. I would like to have my mortgage held and serviced by a different company, as  Ditech is no t fit to be in this business. I want them to  1  ) correct the information sent in   XX/XX/XXXX    to   the IRS,  2  ) send me the interest check plus penalty fees in   XX/XX/XXXX ,   3  ) not retaliate against my mortgage account or me, which are both entirely in good standing, and  4 )  sell my mortgage or its serviicing to a more reputable company, as I wish to cease doing business with this company. I had been told that the replacement refrigerator was less than the XXXX one by enough that I had expected it to be paid off by that time. Instead I was told that I owed over {$2000.00}, I want to say {$2400.00} which is about what we were supposed to pay for the XXXX refrigerator. The second one was less than {$2000.00}.. \n\nI immediately asked for help because something was wrong. My assumption is that they never actually refunded our account for the refrigerator that they picked up when they delivered the replacement. \n\nI thought it would be an easy fix. But better I am being sued and to spite countless hours on the phone, dozens of requests. And a trip to the store where we made the purchase all I have been able to get a copy of is the receipt for the XXXX refrigerator and the claim that I only paid {$100.00} towards it. \n\nNothing to tell me where my money went. And no real way to dispute a charge that the credit card co ( Citibank ) that Best Buy uses refuses to divulge. But apparently applied the money that I paid towards the bill they keep sending me towards something else. \n\nI feel that i have the right to know where my money went! \n\nI am sure that I have spent in excess of XXXX hours on this. I was hung up on multiple times. I was harassed with phone calls, after asking repeatedly for them to just send me copies of any receipts from XXXX forward so that I would know what they are charging me for. Rather someone else used my card? Or I somehow don't recall using it. Although I think I would know if I had a {$2000.00} plus item in my home that was that new. \n\nI requested the info from the attorney and once again I get the exact same receipt information with a condescending explanation about how they applied interest that was equal to my loan amount when I stopped XXXX payments. As if I didn't understand that. I was not asking how {$2000.00} became {$4000.00} I was asking again where the {$2000.00} that I paid them went! \n\nAnd once again that information has not been provided. As far as I can tell they haven't even attempted to find out where my payments went. A few times like at the store, I was told that charges were transferred from another card so they couldn't access them .. To my knowledge I only ever had XXXX card in recent times. Which I also explained. Maybe they transferred some other person with the same name 's balance to my account? I don't know, because no one can tell me what other charges there were. When? What location? Or where my money actually went! \n\nHow can a credit card co not divulge where they applied your payments? To spite repeated requests for YEARS! \n\nAt XXXX point I was speaking with yet another faceless voice on the phone trying to resolve this. She seemed really nice and sympathetic. After a really long time of searching she suddenly said \" I've got it! '' In an excited tone. And I thought finally. Asking what she found. The line disconnected and she didn't call back. \n\nBut the constant calls that i had begged them to stop finally stopped. So I stupidly assumed that she had found the issue and fixed it. \n\nOf course not... But I was dealing with so much overwhelming stuff in my life that I didn't have the energy nor time to keep trying. Calling and begging for what should have been a simple piece of information! \n\nIt is unconscionable that in these years I have not been able to get this simple answer. Where did my money go? Did they infact not refund me for the refrigerator that their delivery truck took back? \n\nWhy can't either of these multimillion dollar companies answer these questions? Even the attorneys have refused to provide this information. Instead asking if I am willing to negotiate a settlement. I have told them the same thing since I called to do the payoff, Show me where these charges are from and where my money went and if I actually owe money I would have paid it off before the deadline. It should not have taken more than a few hours to get this information. And certainly an attorney who is handling a lawsuit should be able to do it. XXXX XXXX casually mentioned that they had a great rate on loans right now if I was interested, and because I had just come back from a three week vacation where I had run up some credit card debit I thought this might be a good way to save some money by using a low interest loan to pay off a higher-rated credit card. \n\nOn XX/XX/XXXX I received an email from XXXX stating that my paperwork was ready to be signed. I believe it was the morning of XX/XX/XXXX that I actually stopped in to sign the paperwork, but it may have XX/XX/XXXX ( according to the email I am attaching, I had stated that I would be in on Thursday ). It wasn't until I was in the office reviewing the paperwork that I realized this wasn't a loan kind of transaction- where I could pay it off early and be done with it- but that it was a line of credit that I would be locked into for a minimum of three years or I would have to pay a {$500.00} fee. But XXXX and the loan application both stated that I had three business days to change my mind, so rather than make a rash decision, I decided to review the paperwork over the weekend before making a final decision. \n\nAfter reviewing the paperwork over the weekend, I came to the realization that I definitely did not want to go through with the home equity line of credit. Because I had to work dayshift for the next few days and knew I would not be able to get to the bank, I emailed XXXX the evening of Sunday, XX/XX/XXXX to advise her that I had changed my mind about the HELOC and didn't want to go through with it after all. \n\nOn Monday, XX/XX/XXXX, I received a reply back from XXXX stating that she would check into a few things and get back to me. On Thursday, XX/XX/XXXX I received an email from XXXX asking me to confirm that I did not want to go through with the HELOC, and I confirmed that I wanted to cancel my application and not go through with the loan. \n\nShortly thereafter, I began receiving frantic emails and phone messages asking me to contact her at the bank right away. After receiving the messages and calling her back, I was informed that it was too late to cancel the HELOC as the application had already gone through, and the only way to cancel it was to pay the {$500.00} cancellation fee. \n\nI believe it was either XX/XX/XXXX or XX/XX/XXXX I called the bank to talk to XXXX, who was president at the time. ( I can't recall his name right now, and he is no longer there. ) I was informed that he was in the XXXX, Mt office so I contacted him there. He advised me that the loan couldn't be cancelled without paying the {$500.00} fee because that was how much the title company charged the bank. He further advised me that the only way I could have cancelled the application was to go to the bank in person and put it in writing within the three business days. \n\nI explained that nothing in my HELOC application did it state that my three day window to cancel required my physically being present in the bank, only that it had to be in writing, and that my email was a form of written communication that his staff was well aware belonged to me. Furthermore, I explained that his staff knows that I work out of town and that I am unable to just stop into a branch office unless I am on my days off. I also stated that when XXXX received my initial e-mailed request to cancel the HELOC application, she never gave any indication that my emailed notification was insufficient. \n\nHe stated that he would look into the matter and get back to me, but I never heard from him again. \n\nAll of this had me very upset and it was several months before I could even discuss the matter with anyone. Every time I would start to calm down about it, I would get another piece of mail or email requesting proof the property was insurance or \" convenience checks '' or a statement. Although I wanted to go to the bank to discuss it, I knew there was no way I could do so without totally losing my temper. While I happened to be in a neighboring town, I went into their branch of the US Bank and I cancelled all of my accounts except my REI credit card and the checking account that I am required to keep open as per the terms of the HELOC- and I keep a minimal amount of money there. \n\nI believe it was some time in either the summer or fall that I heard that the bank president was gone. No fanfare or retirement party, just an announcement that he was no longer the president of the XXXX Branch of US Bank and no longer in their office. \n\nAfter about a year I had finally calmed down and I decided to just let it go since I had no plans to ever use the money anyway. Then, at the end of XXXX, I logged into my US Bank account to check the balance on my REI card ( I rarely use it and pay the balance in full when I do so that US Bank isn't getting any extra money out of me ) and discovered my checking account was overdrawn due to an annual fee from the HELOC and several overdraft fees. \n\nThis got me mad all over again. But this time I contacted XXXX XXXX, a fellow board-member of the local XXXX XXXX XXXX, and XXXX 's replacement after his departure. I was still furious enough that I couldn't go into the bank branch to discuss this matter face-to-face ( although I have been in the bank a couple of times in recent months to discuss XXXX  matters ), so I emailed her with a brief explanation of what had happened. \n\nHer response made it clear that she was aware and still recalled what had happened with my HELOC application more than a year before- this was not something I had ever discussed with her, and I had only confided in two friends, neither of whom was likely to have mentioned it to her. The fact that she knew about what had happened indicates to me that the whole incident was discussed among the bank staff, and I can see several reasons why there would have been discussion about it- including a compulsion to defend themselves because they knew they screwed up, but also a discussion in the hopes that someone would be able to find a way to fix it. \n\nXXXX sent me an email on XX/XX/XXXX that she was able to refund me my overdraft fees, but stated that she didn't have the authority to refund me the {$90.00} annual fee for the HELOC. She did tell me that she would refer the matter higher up the chain and asked if anything else could be done to resolve this matter to my satisfaction. I told her that I would like to be refunded my {$90.00} and have the HELOC closes at no cost to me, since it never should have happened to begin with. \n\nThen, in XXXX and XXXX, I started receiving snail mail from some division of US Bank advising me that I needed to provide ( again ) proof of insurance. Every piece of mail I get about this HELOC is just an angry reminder of how the bank with whom I was a loyal customer for 11 years just screwed me over with their incompetence. I went online in early XXXX and submitted a copy of the proof of insurance, but I continued to receive these letters into the first few days of XXXX threatening to get me very expensive coverage at my expense if I don't show them proof my house insured. When I called them the first week of XXXX to ask whether they didn't get my proof of insurance or if I had uploaded the wrong document, I was told that they had gotten it after all, but letters were sent out to anyone that hadn't gotten their proof of insurance in by XX/XX/XXXX. \n\nWhen I feel like I am a valued customer, I can be loyal to a fault. I get that I let this go for too long- but I was so very angry about the whole thing for so long that I knew I couldn't discuss it without losing my temper. If I hadn't been a happy, long-term customer it wouldn't have upset me near as much as it did. But I am very proud of the fact that I own my house outright- or did until this HELOC came along. I am a XXXX year old single ( never married ) woman with a good job and excellent credit. \n\nHowever, it took me a long time to get here- I've always had good credit, but I used to have a lot of debt. US Bank helped me get where I am today by approving various loan applications over the years to help me get out of debt. I paid the vehicle off making final payment in XXXX and never received title. I moved from XXXX  to XXXX  in XXXX and requested title from Ally in XX/XX/XXXX, provided mailing address and was told 7-10 days. XX/XX/XXXX i still hadnt received title, called and was told it was lost in the mail and I would need to pay for replacement an amount in the {$300.00} range I requested release of lien and was denied as I refused to pay the {$300.00}. I then mailed letter from DMV,  original inspection report, application and a money order {$190.00} for XXXX registration fees to Ally and requested title be transferred with lien so the vehicle could be registered, and still today this has not been done. I have made several calls to Ally requesting transfer and title and I an told no due to an account balance but no one could ever give me a balance. Each call I initiated at least four, I am told title will be requested receive in 7-10 days and nothing, when I follow up there is a balance due but no amount. XX/XX/XXXX I mailed again the DMV letter, originsl application, and {$190.00} for DMV fees requesting again title be transferred. I initiated contact at least 4 times since then always told I need to pay a balance without an amount. XX/XX/XXXX, after I demanded someone resolve this issue and provide details, i was transferred to Collection department who told me no record of amount, but there is s balance due and someone would contact me in 3-5 days, never received contact. The vehicle has been sitting all this time as it can not be registered, with the exception of 2-21day use permits in XXXX and currently a 21 day use permit that expires XX/XX/XXXX. On XX/XX/XXXX I filed a complaint with XXXX, XX/XX/XXXX received message from Executive Services department, returned call with message on XX/XX/XXXX and again on XX/XX/XXXX. XX/XX/XXXX received call and spoke with agent regarding my complaint. Provided details of my complaint and requested resolution including the title to my vehicle or a release of lien. During this conversation I provided details and VIN for the car so he could pull up the title information. He mentioned the same as all previous agents that there wasnt a balance he could see either. He stated he would contact his title department and get back to me. XX/XX/XXXX and XX/XX/XXXX he left message for my return call while I was at work. XX/XX/XXXX I returned his call and he informed me that the title was never sent because there was a balance due, I dont recall exact amount but in the {$1700.00} range. I disputed and asked for what and was told from the original balance. I asked for details and he told me he couldnt send what he had but could put something together. He then said that they received my request to transfer title with lien in XX/XX/XXXX, but they didnt, and they mailed me a letter XX/XX/XXXX explaining they needed the original application. He confirmed the letter was mailed to the wrong address, and confirmed he had the right address. I told him it was the original that was sent as well as the original inspection report and a money order for {$190.00} for registration fees. He could not confirm they had the physical documents sent due to the time period only that the system note said it was not the original. He said more than likely they no longer have the inspection report or money order either. He confirmed the numerous attempts Ive made to resolve and told me that no one could ever pull the information and provide the details due to the age of the account. He indicated the audio from past calls where I was told it was sent and there was no balance due were no longer available, and all he had was the notes he could find. He stated the information was hard to find and piece together. And, the balance had been turned over to numerous collection agencies over the years. He stated they did not have access to full the details due to the amount being charged off, and in order to obtain the title I would have to pay the amount due to an outside agency as they were no longer able to collect the payment. I told him I did not agree with the balance and that the last payment was made XXXX, and I never received a call, a letter or notice of the debt until now, with the exception of just being told there was a balance due. He said he would contact the title department to see what else he could do and find out if they had original documents to transfer the title so I could register the vehicle. The vehicle has sat for all but two months since XX/XX/XXXX when I operated the vehicle with 3 separate 21 day use permits. These permits each cost {$32.00}. The vehicle needs a full inspection as belts are squealing, tires, and fresh fluids as a direct result of sitting and currently is my only vehicle. The use permit expires XX/XX/XXXX. After 8 years since last payment, and 6 years of initiating contact myself numerous times I am told to pay a balance still owed from original debt based on the notes and information he could find over the past 15 days, that the account was charged off, that they received my request to transfer in XXXX but didnt transfer, that they mailed the correspondence to the wrong address even though they had the right one, and that they couldnt collect the payment for the title they hold.
