There were pictures of a specific laser on the XXXX web site which showed the serial number and shot count ( the number of shots is the only indicator of use of a laser such as the mileage on a car ). I called XXXX XXXX and asked about that specific lase advertised and was told it was still available. I made an offer on the laser, XXXX accepted the offer. When the laser was later delivered several weeks later, I checked the serial number, it was different than the one I thought I was purchasing. I then turned on the laser to check the shot count. The laser advertised on the web site that I thought I was purchasing had a shot count of approximately 51,000 shots. The one delivered had a shot count of over 3,600,000 shots. This is a significant difference in the amount of use, over 70 times the amount, such as comparing one car with a certain amount of miles to one with 70 times the miles. Clearly different and worth different amounts. XXXX XXXX, the CEO of XXXX, informed me by email, that the picture of the laser should have been removed once not available, it had not, and also that it was the policy of XXXX that if an advertised laser was not available, that they would then notify the potential buyer of other options and would get approval of the buyer if the other laser would be acceptable prior to a sale, I was never told that laser was not available and given what other lasers were available. This is false and misleading advertising. XXXX refused to take the laser back, I called them the day it was delivered to my office about the wrong laser being sent. They refused to issue a refund. I contacted Chase and was told that to dispute this claim that I had to return the laser. I called XXXX but they refused to take it back. I then took the laser to XXXX. XXXX  packaged the laser, it was insured for the full amount, and XXXX sent it back to XXXX. XXXX claimed that the laser was damaged in shipping by XXXX. One month ago, XXXX XXXX, CEO of XXXX, sent me an email stating that he wanted me to agree to take the same laser back and that XXXX would guarantee that it was fully functional. Clearly, the laser is not damaged as he previously claimed. XXXX also refused to provide any written or visual proof of the damage to the laser and refused to aid in filing a claim with XXXX for damages. So now, I do not have the laser, it is still at XXXX in Utah, Chase has debited back to my card the original sum of {$15000.00} and I am out the cost of shipping/insurance by XXXX for shipping the laser back to XXXX   for {$950.00}. I have filed a police report with the XXXX XXXX Police Department. Again, XXXX advertised a laser with a specific shot count and specific serial number. I initially contacted XXXX about that specific laser and was told it was available. XXXX sold me a different laser with a vastly greater amount of use without ever informing me of this switch. It is a bait and switch. Attached is my response to XXXX XXXX 's response to the initial dispute, attached is the police report and copies of emails. I have pictures of the web site showing the laser advertised at the time I contacted XXXX with the specific serial number and shot count. I was clearly deceived and Chase has not protected me in this dispute. I also met in person with a Chase representative at my local bank branch. As there is no laser therapist in our area and his current therapist is a 4-hour drive away, I decided just to purchase a laser device which I desperately need even up to date as my dog is still unable to walk. On XX/XX/2021, I received the laser device that I ordered from XXXX, the seller. To my surprise, the device was not sealed, no user manual, already fully charged, no thin clear plastic removable cover on the laser and the USB chord was just placed on top of the device. Later, after purchasing exactly similar device from another seller, it became conclusive to me that the device sold by XXXX is a USED one. This was bolstered by the fact that on my first use, the device stopped working. I then immediately turned it off, and on, and it worked again. For almost 10 days since its delivery, the device will occasionally stop in the middle of my dogs treatment and functioning again after turning it off until XX/XX/2021 when the device completely shut off. \n\nXXXX is guilty of unfair and trade practices on following grounds : 1. Selling used and defective merchandise under pretense that it is new. \nSee discussion above. \n\n2. Every sale in the state of Louisiana carries with it the legal warranty that the thing sold is free of hidden defects or redhibitory vices. \n\nLA CC Art. 2475 Seller 's obligations of delivery and warranty. The seller is bound to deliver the thing sold and to warrant to the buyer ownership and peaceful possession of, and the absence of hidden defects in, that thing. The seller also warrants that the thing sold is fit for its intended use. \n\nFurther, Article 2520 of the Louisiana Civil Code provides that the seller warrants the buyer against redhibitory defects, or vices, in the thing sold, and further defines the term redhibitory as a defect which renders the thing useless, or its use so inconvenient that it must be presumed that a buyer would not have bought the thing had he known of the defect. \n\nThe device was used for approximately 10 days until it completely stopped working. Clearly, XXXX warranty against hidden defects and/or redhibitory defect was/were breached. Since the device is no longer working, XXXX likewise violated its warranty that the thing sold is fit for its intended use. \n\n3. Return/Refund policy of XXXX lasts for 14 days. \nSince XXXX violated the law of Louisiana, the Return/Refund policy of XXXX is inapplicable as the law governs first and foremost. \n\n( Nevertheless, the following premises are based on the assumption that XXXX warranty obligation under Louisiana law is not breached. ) Attached is a copy of the XXXX Return/ Refund Policy. The merchandise was received on XX/XX/2021 and it completely stopped working on XX/XX/2021, but that day was a holiday as well as the following day which is XXXX day thus, I was unable to inform XXXX. I purchased 2 similar items from XXXX which later proved to be ineffective and were able to return the items for a refund without questions asked. \n\n5. XXXX is guilty of price gouging. \n\nThe original advertised price of the disputed device is $ XXXX and XXXX is claiming that it is selling half its price which is {$250.00}. On the contrary, when I later purchased exactly similar device, the price I paid for the device is less than {$100.00}. \n\n6. XXXX is guilty of unlawful appropriation. \n\nAfter XXXX asked for the return of the device, XXXX is now misappropriating my device by refusing to issue a refund. They are currently keeping my money and my device, too. On its last email, XXXX acknowledged the return of the device and alleged that, We never refused to refund you. \n\nXXXX intentionally made their Refund Policy completely ambiguous ; apparently, to include all merchandise that they sell not eligible for a refund. I was not made aware of this at the time of signing up. I check my balance frequently to track how long it would be until it is paid off, but that's all. I did receive a physical credit card in the mail, but I've never used it on any purchase. This line of credit was only opened for the purpose of paying for this laser package. The terms and conditions were not advertised adequately at the time of sign-up. I felt pressured to agree to opening this line of credit to get the laser package at the time of signing up and have been completely blindsided by this. The interest I was charged was over {$2200.00}, bringing my balance above my credit limit and significantly impacting my credit. I am a college-aged female and I feel I've been prayed upon by both XXXX XXXX  and XXXX XXXX with Comenity Bank and have been scammed. I was under the impression this entire time that I was paying a balance on a single purchase and would not be charged 2 years worth of monthly interest in one transaction. Had I known these details I would have made additional payments to prevent this, or not signed up in the first place.
