However, when I followed up, I was informed by representatives, including a manager identified as XXXX and an agent named XXXX, that the balance being reported was correct and would not be changed. No meaningful investigation or correction was completed based on the documentation provided. \n\nAdditionally, during communications with the company, I was told that the reporting could negatively impact my ability to obtain housing, loans, or financing. I was informed that my loans had been transferred from XXXX to Aidvantage by the Department of Education in XX/XX/XXXX. However, Aidvantage claims that I was past due for 188 days, and they are refusing to remove this information even though the account is now in good standing following an administrative forbearance processed on XX/XX/XXXX. \n\nTheir continued reporting of this negative history is severely impacting my creditworthiness. These incidents were promptly reported to both onsite management and regional management. Despite repeated reports and follow-up communications, management failed to take appropriate corrective action or meaningfully respond to the safety concerns. Instead, the matter was repeatedly redirected to hourly staff who lacked the authority to investigate or remedy the structural hazards. Senior regional management also failed to address the issue despite direct communication. Management represented on multiple occasions that the conditions had been repaired ; however, additional collapses subsequently occurred, confirming that the hazards had not been remedied. As a result, portions of the unit became unsafe and unusable, preventing full and safe occupancy. Due to the complexs continued failure to address these hazardous conditions, we provided written notice to the property asserting our legal position under Colorados Warranty of Habitability statute ( C.R.S. 38-12-505 ). Our correspondence explained that rent obligations were disputed because the landlord had failed to remedy serious habitability violations within the statutory timeframe, which materially affected the safe use of the premises. The property management company failed to respond substantively to these notices. Months later, after a new property manager assumed the role, we received a generalized statement asserting that rent remained owed. This response did not address the documented hazards, prior communications, or the propertys compliance with the statutory requirements under Colorado law. We sent additional written correspondence reiterating that the property could not lawfully collect rent while in violation of the Warranty of Habitability statute and again requested that the matter be addressed. These communications were ignored. Rather than resolve the dispute or investigate the underlying safety violations, the property referred the alleged balance to a collection agency without addressing the legal validity of the claim. We first became aware that the account had been placed in collections in late XX/XX/XXXX. We promptly disputed the alleged debt with the collection agency and provided extensive documentation demonstrating the ongoing dispute and the basis for contesting the alleged rent obligation. Our initial dispute letter was delivered on XX/XX/XXXX, and proof of delivery is available. The collection agency, XXXX XXXX XXXX XXXX, failed to provide proper validation of the alleged debt. Their response merely confirmed that my husband and I were listed on the lease and resided at the property. These facts were never in dispute. The agency did not provide documentation demonstrating that the claimed balance was legally owed, did not produce an itemized accounting of the charges, and did not provide evidence addressing the propertys compliance with XXXX XXXXXXXX XXXX XXXXXXXX statute. Because the response failed to constitute proper validation of the disputed debt, we issued a second written dispute and notice of insufficient verification to IQ Data International Inc. This letter again requested competent evidence demonstrating that the alleged debt was legally enforceable and reminded the agency of its obligation to cease collection activity until proper verification was provided. This second dispute letter was also delivered with proof of delivery and was delivered on XX/XX/XXXX ( was sent out on XX/XX/XXXX ). This letter was completely ignored. Your response ( which is scanned and included ) does notconstitute proper verification under the Fair Debt Collection Practices Act, 15 U.S.C. 1692g ( b ). I do not dispute my identity, residency, or the existence of a lease. Those facts were never in dispute. The debt is disputed because the alleged rent is not legally owed due to the landlords violations of Colorados Warranty of Habitability statute, C.R.S. 38-12-507, which excuses or limits rent obligations when qualifying violations exist and are not remedied after proper notice. This reporting has negatively impacted both my husbands and my credit. After discovering the collection account on our credit reports, we filed disputes with both XXXX XXXX XXXX  In response, the credit bureaus informed us that IQ Data International Inc. had verified the account as valid. However, at no point has the collection agency provided proper validation of the alleged debt. Their responses have merely asserted that the account belongs to us without providing any competent evidence demonstrating that the debt is legally owed or addressing the substance of our dispute. So, we now formally addressing the CFPB and are writing a formal complaint : Subject : Complaint Against IQ Data International Inc Failure to Validate Debt and Unlawful Credit Reporting To the Consumer Financial Protection Bureau, I am filing a formal complaint against IQ Data International Inc regarding a disputed debt they claim I owe relating to an apartment lease with the alleged original creditor, XXXX on Market. On XX/XX/XXXX, I sent IQ Data International Inc a written dispute and request for proper validation of the alleged debt pursuant to the Fair Debt Collection Practices Act ( FDCPA ), 15 U.S.C. 1692g ( b ). A copy of this dispute letter is attached. In that letter, I clearly explained that the alleged rent balance is disputed because the landlord violated Colorados Warranty of Habitability statute ( C.R.S. 38-12-507 ). After I notified them that their response was insufficient and again requested proper verification, they failed to respond further. Despite this unresolved dispute and their failure to provide proper validation, IQ Data International Inc subsequently reported this alleged debt as a collection account to the credit reporting agencies, damaging my credit. Reporting a debt to credit bureaus is considered collection activity. Under 15 U.S.C. 1692g ( b ), a debt collector must cease collection activity until proper verification of a disputed debt is provided.
