Late XX/XX/XXXX, we started working with XXXX XXXX XXXX ( XXXX ) to purchase the vehicle. Mid-XX/XX/XXXX we started working with Alliant Credit Union ( ACU ) to finance the vehicle purchase. Its been downhill from there. \nOur existing rate on the loan is 3.74 %, but we are being threatened with a 24.000 % Punitive rate by Alliant Credit Union over issues with the vehicle title. \nChronology is below, we have been very proactive and engaged since the beginning in doing our part to fulfill the title transactions, but problems on both the XXXX and Alliant ends have us 120+ days in without the title processed. \nXX/XX/XXXX Receipt of XXXX paperwork, returned by us XX/XX/XXXX and received at XXXX on the XX/XX/XXXX. This mailer included all signed directives regarding the title. \nXX/XX/XXXX Alliant sends us their paperwork, returned by us XX/XX/XXXX. This mailer includes all signed directives regarding the title. Their letter to us states : After your packet is delivered to us, we will send you an email to confirm that weve received it. If you dont receive a confirmation email from us after one week XX/XX/XXXX We receive our end of sale XXXX mailer, which their cover memo indicates it is the final paperwork on their end of our vehicle purchase transaction. This includes a Bill of Sale, that shows amongst other things the Sales Tax paid in the transaction. \nXX/XX/XXXX Having heard nor seen anything from ACU on their end of the transaction at all ( besides their automated withdrawals of our loan payments ), we begin the first of MANY contacts by us to them inquiring as to the status by Secure Messaging in their app., by phone call, by fax, and by regular mail. ACU does not meaningfully or substantively respond to any of these. \nXX/XX/XXXX XXXX mid-XXXX transaction with our states Department of Motor Vehicles ( DMV ) to renew the expiring license plate sticker and vehicle registration is rejected due to titling issues. This is the first time and first notice to us that there is a problem. She then spends hours visiting the DMV, calling XXXX, and calling ACU to research. She follows ACU Lending Manager XXXX XXXX instructions to the last detail on what form is allegedly needed from XXXX to resolve. \nXX/XX/XXXX - Upon receipt of the XXXX paperwork that ACUs XXXX stated was required to complete this titling, XXXX visits the DMV and is again rejected. She again spends multiple hours talking with the DMV, calling XXXX, and calling ACU. Allegedly per ACU, XXXX indicates XXXX will not release the title over unpaid sales taxes. ACU Title Services telephones XXXX back on XX/XX/XXXX and indicates they and XXXX  have spoken and this should be moving forward. \nXX/XX/XXXX We receive a form letter First Notice from ACU dated XX/XX/XXXX threatening us with the punitive 24.000 % interest rate on our loan. \nXX/XX/XXXX We receive a call from ACU Title Services asking if we want them to ship us the final paperwork including Title, for the DMV completion of the transaction. We affirm we would appreciate this, and receive said mailer on XX/XX/XXXX. We take the paperwork into the DMV on Friday, XXXX and are told by the DMV that XXXX requested a new title in their name on XX/XX/XXXX, so the title ACU sent us is null and void. \nXX/XX/XXXX We fax both XXXX and ACU with the current status, that is unable to move forward with DMV until the new title that XXXX requested on the same day ACU sent us the existing title is received. \nXXXX XXXX We receive an ACU letter dated XX/XX/XXXX indicating our rate will move to 24.000 % onXX/XX/XXXX. The letter is signed Member Engagement Office and is in response to both our XX/XX/XXXX Complaint to their CEO and our XX/XX/XXXX fax about the latest title problem. It is the first and only written correspondence from Alliant on this entire matter, besides the canned First Notice received in XX/XX/XXXX and the overnight package with the now unusable title. \n\nAlliant Credit Union issues : 1. Lack of engagement, lack of responsiveness to our multiple contacts and complaints. We should have known before XX/XX/XXXX and the  messenger ought not to have been the IL DMV that there was a problem. \n2. Mis-information from their Lending staff on what was/was not needed to address this issue and resolve it. \n\nXXXX XXXX XXXX issues : 1. Erroneously withholding critical documents over unpaid sales taxes when they had two months prior sent us final documents including Bill of Sale signing off on Sales Taxes paid.\n\n2. Despite providing all the required documentation to verify my tax-exempt status from the time I started leasing the vehicle, Honda/Acura Financial Service continues to call me and tell me I owe payment for personal property taxes. I have reiterated to multiple agents that, by law, I do not in fact owe the tax and that if XXXX has been paying it unnecessarily on my behalf over the last 2 years, that is their problem to fix, not mine. \n\nHonda/Acura Financial Services has now reported my account to XXXX  as being delinquent based on this property tax issue, despite the fact that I own the vehicle and have no outstanding payments due. When I called their 1-800 number to dispute this debt, the representative was unable to put me through to a supervisor and told me it is my responsibility to contact the tax agency in the county where we purchased the vehicle to verify my tax-exempt status. Not only do I no longer live in NC anymore due to moving to my new XXXX XXXX over 2 years ago, but Honda/Acura Financial Services is essentially transferring the blame for their paperwork error to me, telling me I am responsible for fixing it, and damaging my otherwise perfect credit. The representative claimed I will receive a call-back from a supervisor within 24-48 hours. Meanwhile, this issue remains my responsibility to fix. He told me it might take months for them to get it rectified with the credit agency. I told him that was completely unacceptable and I expected it would be rectified in a matter of days. I called Chase Bank and was told that they had the title delivered to our home ( which we had never received ) and that we were supposed to bring it to the DMV. After explaining that we had never received a title, I asked them to generate a duplicate title and was told it would be sent out in 6-8 weeks.\n\nThe duplicate title never arrived. For the last TWO YEARS, we have found ourselves in a cycle of attempting to request a duplicate title every few months - and each time, the title department treats it as if it were a new request, never acknowledging that we've repeatedly made the request before. When trying to solve this issue directly with the DMV, they informed us that Chase had sent a {$1200.00} check attached to our name, that is simply sitting there - unprocessed - because no one has any idea what it is for. \n\nI have been pulled over 3 times and have had to explain the situation to police in hopes that they would not impound my car ( as I can not afford to pay to get it out of impound ; so far, I have been lucky ). I can not guarantee that my insurance company will cover any damage or injury should I end up in an accident, as I can not register my car as required by insurance. I have attempted to get a new title generated for the car by getting an auto loan through a new bank ... but have been told that I will only be approved for a new auto loan when the registration is up to date on the vehicle. Again incorrect information provided by Chase. \n\n- On XX/XX/XXXX contacted Chase again to request that THEY submit XXXX XXXX information to the XXXX  XXXX and was told that they have submitted the XXXX XXXX documentation to the XXXX  XXXX and I should revert back to Chase within XXXX business days to confirm. \n\n- On XX/XX/XXXX contact Chase again to be told that no such information was submitted, instead they re-sent the lien release documentation to me, which was supposedly already sent on XX/XX/XXXX. They had made no effort to contact XXXX  XXXX to provide XXXX XXXX documentation and I was instructed to wait another XXXX business days to receive my lien release documentation. During this time, my vehicle has been paid in full, the check has cleared and the funds deducted from my account. Despite this, I am unable to register the vehicle in my name, because I do not have the title or XXXX release documentation. \n\n- On XX/XX/XXXX I received the notarized XXXX release document from Chase. Per Chase 's instructions I was asked to submit this information to the XXXX  XXXX to request a lien release myself. I over nighted the required documentation to the XXXX  XXXX, which included the notarized lien release, a loss of affidavit, a new title request and an exemption from XXXX  address request and a personal check for {$85.00} for a quick title. These documents reached XXXX  XXXX on Monday XX/XX/XXXX. \n\n- On XX/XX/XXXX I called XXXX XXXX to verify that the documents had arrived, they confirmed they had received my documents, but also alerted me to the fact that Chase had contacted the XXXX XXXX on the XX/XX/XXXX and requested a duplicate title, which overrode my request for a new title. Chase did not request a quick title and my timeline was elongated to XXXX weeks vs the XXXX business day turn around for a quick title. \n\n- During this time, with my CFPB complaint my case had been escalated to the chase XXXX team, who did nothing to solve this problem. \n\n- On XX/XX/XXXX I contacted XXXX  XXXX to understand the status of my title request. I was then told by the XXXX  XXXX, that Chase had not requested a lien release, but rather RE-ADDED the lease to the title, even though the vehicle was paid off in full on XX/XX/XXXX. The XXXX  XXXX representative confirmed that the title was converted from a lease to a loan in XXXX and described Chase actions as, quote, \" a botch job ''. Intentionally making the process for me to get the title for my paid off vehicle even more challenging. \n\n- I was then told that the XXXX release document i have would no longer allow me to get a clean title, because Chase requested that a lease be re-added to my title and I would now need a lease release document. \n\n- It is now 34 days since my vehicle was paid off in full, with no clear timeline to receive a clean title in order to register my vehicle. I had lived in XXXX XXXX for 2 years and been at my employment for 14 months. I had just sent XXXX a monthly payment in early XXXX. On XX/XX/XXXX, I came home to and found a letter in my mail ( not even certified ) that was from my corporate payroll office in XXXX XXXX   notifying me that my wages were going to be garnished with the next pay which was 2 weeks later in the amount of {$89.00} by a company called GCC Services. All the letter contained was a phone number, no address. I called the number to speak to a male representative and after explaining why I was calling he advised me they were Student Loan Collection Company and they had 10 of my loans. I was floored as the one thing I know is that I can not run from  Student Loans and had been in touch with XXXX who had told me in the last 2 years they had all of my loans. Also these loans in question were all acquired from XX/XX/XXXX-XX/XX/XXXX when I attended XXXX XXXX ( online ) XXXX, XXXX. I was informed via email and by XXXX about a year prior that those loans are being investigated as the school was deemed unaccredited and I would be informed when and if I would begin repayment. I asked the Rep to provide me with an address, provided ALL of my contact information, including email and asked for detailed statements/bills of each loan as I have never received anything. I never received anything from the company. I went to an attorney 4 days later and started bankruptcy proceedings, my Chapter XXXX was confirmed on XX/XX/XXXX. I was encouraged to include my vehicle. There was one garnishment payment that was deducted from my payroll and it was refunded a month later via Chapter XXXX, however, once finalized I was informed by my corporate payroll office that on XX/XX/XXXX, the company actually sent a \" cancellation of wage garnishment '' but I cant find out why. This was in XXXX when I learned this and about 3 weeks later, towards end of XXXX, I called GCC Services back ( XXXX, XXXX ) and asked why I didn't receive anything. However, I was promised the information. Then he informed me that he now cant find anything as far as statements because my loans were sent back to the Dept of Education and they no longer had them. Then I had a XXXX XXXX XXXX XXXX XXXX that has required me to go on unemployment and await approval for XXXX. In XX/XX/XXXX I was completely unable to return to work and had no income at all and had to apply for public assistance for medical and food stamps, but I remained in contact with NationStar / Mr. Cooper about my situation. By this time I had missed two months of payments. I XX/XX/XXXX, I was awarded unemployment and contacted NationStar / Mr Cooper to inform them that I would receive a lump sum payment and would be able to pay part of the amount owed and was informed that unless it was the full amount it would not be accepted and would be returned, it was like they wanted me to lose my property. So I felt like I had nowhere to turn and did not qualify for any programs because I had no other form of income and as the months went by the mortgage payments continue to add up. \n\nMy husband and I share the household income and expenses. I applied for a loan modification with my housing counseling agency, XXXX XXXX XXXX, in early XX/XX/XXXX. I was told that NationStar / Mr Cooper does not work with housing counseling agencies, and will only agree to work directly with me as the borrower. ( This seems untrue. ) I had to resubmit my application on my own and did so again in late XXXX. I provided all the missing information that NationStar / Mr Cooper requested to complete my application in a timely manner. Then, after waiting and providing all my documentation and having conversations with Nationstar / Mr Cooper reps for a month, I was  finally called and told that I do not qualify for a loan modification because I owned my home for less than 12 months. \n\nAt the time of facing foreclosure and did not understand why I did not qualify for a loan modification, or why I was not told this right in the beginning because it was no mystery to NationStar / Mr Cooper how long I owned the house. Also, I did not receive anything in writing to inform me of this denial ; I was only told over the phone. NationStar / Mr Cooper went forward with the process to foreclose on my home and  accumulated attorney 's fees. In XX/XX/XXXX my daughter was XXXX   and I contacted Nationstar / Mr Cooper to inform them that I would be able to make the payment in full in XX/XX/XXXX, I was told that no attorney had been assigned to the case as of yet but they had hired a law firm. I contacted the law firm to get the amount owed and was to conflicting amounts and who to pay. The law firm told me to pay them, and the mortgage company told me to pay them. I read over my documents and it said to pay Nationstar / Mr Cooper and they would pay the attorney 's from the amount, but that did not happen ; I am left with a balance of {$1400.00} dollars. I paid the full past due amount of {$4000.00} minus the attorney 's fees from the proceeds of my daughter 's life insurance policy. I have had numerous conversations with NationStar / Mr Cooper that this was a temporary fix to my hardship and that it would get me  caught up but eventually I would still need the assistance of programs available to me. And was told that I could reapply for a loan modification in XX/XX/XXXX and now it is XX/XX/XXXX and feel that I will get the same results. \n\nI explained that I felt it was unfair that I was not given the chance or opportunity to apply for programs prior to the hiring of attorney 's. I would like a chance to appeal this decision of attempted foreclosure on the property without seeing if I qualified for any other program and the attorney fees that I am being charged, but have received no instructions on how to do so. I also feel like it would be important to inform me of any other options that Nationstar / Mr. Cooper might determine I may be  eligible for that would allow me to make affordable timely mortgage payments until my financial hardship changes, without continuing or beginning foreclosure on my property. The time of the first attempt to foreclosure on my property, I did not have any indication that there are any possible solution to my problem other than move out. I have contacted them early enough in hopes that there will be other options available. This seems unreasonable that as a homeowner there is nothing they could offer me to assist me. \n\nThis home was already marked for foreclosure before I signed the documents. There was a problem the night before that I was not made on the sellers part that I was not aware of and was still allowed to sign. This happened with sellers agent, my agents, loan company, and title and escrow company. There was a lot of problems with this home that was swept under the rug that is why the property tried to switch hands so quickly that it did not give the title company a chance to get the paperwork correct until XX/XX/XXXX ; over two months. I don't want to make this about race but I believe you are placed in specific types of programs where they know you will not be able to keep up just so they can take it back, such as FHA. I was not even offered any first time home buyer programs or assistance with FHA. \n\nFHA has weakened it guidelines so that they do not have to complete their appraisals by close examination, now they just glance from a distance. It lowered its credit score acceptance to XXXX or above so that more people can qualify and purchase homes within a specific price range and most of those homes have major issues. They improperly changed rates and closing costs to improve their financial outcome. Amerisave failed to provide disclosure documents on several occasions following loan changes indicated by loan agent. Amerisave also may have provided false disclosure to improve their financial outcome. In addition, Amerisave failed to seek consent for recording financial related phone conversations given that California is a two-party consent state. \nIn mid-XXXX  XXXX, when rates were down, my wife and I decided to look to see if we could improve our situation, so we started looking at companies to refi with. We were not looking to get cash out just a simple refi to lower rates and an escrow impound account. We got several quotes from various companies most of the rates were about 3 to 2.875 % with {$4.00} to $ XXXX closing costs. When we talked to Amerisave, we provided info to best of our knowledge on incomes, credit scores and home value which we estimated at $ XXXX. They sent us two different quotes, one was 2.775 % with no points and {$1700.00} closing cost ( $ XXXX in lender credits ) the other one was 2.5 % with 1 point for {$4400.00} total closing cost. We decided to proceed with the 2.5 % and initial loan estimate of $ XXXX from Amerisave. Our original Lending agent was very attentive to our requests and always responded back right away. This process started quickly. We had an appraisal done ( which came in at $ XXXX ) within a couple days of the paperwork processing ( income statements, insurance, solar panel lease agreement and several other items ) and changing the mortgage clause of our home insurance. \nOn XX/XX/XXXX we received a new disclosure document, reflecting the change in LTV from our estimate of home value ( $ XXXX ) to the appraisal value ( $ XXXX ) as well as difference in loan balance. Thus, at this time our LTV would be over 70 % and rate was 2.5 %. Throughout this process, our original Lender kept in touch and was responsive to inquiries. On XX/XX/XXXX, we were contacted by the original lending agent by email, indicating things were moving swiftly and they even provided a snapshot of the progress. ( PreClear Status : the following were completed : Credit, Income, Assets, Appraisal, Condo and PUD, Hazard Insurance, Flood Cert/Flood Insurance, Fraud analysis and Disclosures and RESPA while Property Tax was in progress and Title, XXXX, Settlement Fee, Payoff were listed as pending ). They indicated we could possibly close before the New Year and would be a nice way to start of the New Year off. Later in XXXX, we had received notice from our original mortgage company that they had received a payoff request so thought, XXXX! We are going to be able to get this done quickly! Our current mortgage company must have been expecting a payoff soon because it seemed like our XXXX mortgage payment took longer to post the usual ( almost 7 days later when its usually the same day or next ). \nThe XX/XX/XXXX email appears to be last contact we would have with our original Lending agent. I started trying to get ahold of our Agent with no success. On XX/XX/XXXX, I was contacted by another Lending agent from Amerisave indicating that our original lending agent had to take an unexpected leave of absence and they would handling the process now and had a bunch of applicants dropped on them so to give them some time to review. I later received a call from the agent saying that underwriting had kicked out our application because as he mentioned on the phone, there was a discrepancy between what I had told them the value of my home ( $ XXXX ) was and what appraisal ( $ XXXX ) had come in at, despite being adjusted back XX/XX/XXXX after the appraisal was completed. It surprised me as to why the value I had mentioned mattered when they already had the appraisal. On the call he said he would fix the problem and resubmit the paperwork. I believe if this happened, this process should have kicked off a new disclosure on their part since it would have been a change in LTV ratio. Based on the information we had provided to Amerisave upon origination, our LTV would be about 69 % prior to adjustment by appraisal. Following adjustment from the appraisal our LTV was over 70 %. Thus, Amerisave knew on XX/XX/XXXX that our LTV was over 70 % and if the agent made the changes he indicated, they would have known again that we had an LTV was over 70 %. Now this entire discussion occurred over the phone. Now, when I talk to other financial institutions they indicate right off hand that this convo is being recorded and are you ok with that. There was no mention by person or machine about convo being recorded. Since we reside in California which is a two-party consent state I believe they have recorded our convo without consent. \nAfterwards, this started a prolong process of continual delays. On XX/XX/XXXX, our agent emailed us indicated that there was a lien on the house that we were not aware of from our solar panel company. He indicated it just takes time and money. During this time, I had asked if he wanted me to contact the companies and see if I can expedite it and said no it is fine. Now I would have figured after having submitted our solar lease agreement back in XXXX and near completion of the underwriting process in XXXX that this would have been discovered during that time. It has also come to my attention subsequently, that since we pay our lease by direct monthly payments to the solar panel company and not through property tax, that this should have not been a major issue. \nAfter a while of this ongoing waiting game, Wife and I had thought maybe we could roll the cost of the solar panels into the mortgage and not have to go through the subordination process. We had purchased our home about a year earlier and we had the option to purchase ( through mortgage ) or Lease. I had contacted our Lending Agent and he indicated we could do that. He and his manager requested copies of our solar lease again, solar panel monthly billing statement and the payoff statement for the solar panels, which was a process. However, instead of having us upload the documents into Amerisave upload portal, he asked us to send the documents to his Amerisave email account. All of the exchanges about the subordination and modifying the loan including the purchase of the solar panels occurred in email. I now realize this should have created a new disclosure release as well for us to sign, however that never occurred. Also, with the agent processing the new changes in the Loan as he indicated, he should have realized that our LTV would not be in the 60 's but instead over 70 %. \nDuring all these times, I had sent several emails to him about the status of our rate. He never responded to any question pertaining to rates in email. On phone however, several times he indicated our rates were still good. One time on phone, I had asked him about them and he indicated we are still good and that 2.5 % would be the worst-case situation. \nOn Monday XX/XX/XXXX, I was contacted by a Loan processor indicating that our loan was approved. Now anyone following the rates knows, the rates have been creeping up with a large increase in rates on Thursday XX/XX/XXXX and stayed high on Friday XX/XX/XXXX. I had called the loan processor back the same day. I first asked the processor if the loan was approved with the solar panels? They indicated that there wasn't anything about the solar panels in the loan. I asked the loan processor the rate at which the loan was approved and indicated 2.5 %. However, they indicated that the rate was not fixed. They also indicated that there was a cash out for over $ 6K. The Loan processor indicated that we needed to contact the loan originator and have them make the corrections. Later that day, I got a call from the lending agent congratulating us the approval and then started talking about the rate. He mentioned that everything was based on value that I had provided them during origination and that our LTV ratio had now changed from the 60 's to the 70 's thus Amerisave was unable to offer us the 2.5 % rate. He indicated the best they could is 2.875 % with no points, I asked what would a point do and said 2.775 % and suggested it wasn't worth it. I was XXXX and mad and asked him why didn't you tell me this back in XXXX when you had the appraisal. He indicated he just processed the numbers now despite indicating he made changes to the loan early XXXX and modifying the loan in XXXX. He indicated he could do a 30-day lock for about {$1600.00} or a 15-day lock for {$1300.00}. I told him I had to talk to my wife before deciding. After talking to my wife and explaining they played us and that we didn't have much choice since rates were high now and with the subordination issue we either take it or leave it. I emailed him back to lock in the 2.875 % and he indicated I would have the corrected closing docs by next day. I got a call from the Loan processor the next day and we talked about the process and set up an apt for the Notary and that my wife and I would receive the closing docs that day and had to review them several days before the expect close date of XX/XX/XXXX. When I opened the documents, there was still a cash out of over $ 3K and closing costs were almost {$5500.00} with total loan at $ XXXX. Somehow, the closing costs now, without points were a $ XXXX more than what it was with a point added for lower rate during origination. I emailed my agent back about the $ 3K and he said he couldn't do anything since in processing but would let them know and he said it shouldn't have been over 2K. I told him it should have been XXXX, we didn't want or need any cash out. Another issue was that almost 70 % of property tax was placed in non-escrowed property costs for year 1. Also, thinking there would have been a subordination fee detailed in the closing cost, since I hadn't paid it, there was nothing about subordination in the closing documents. I also indicated if they would honor the $ XXXX in credits initially offered for no-point closing costs. I eventually received an email with contact info to start the process over again with a new Loan originator. \nAmerisave knew in XXXX that our LTV was no longer in the upper 60 % but over 70 %. In addition, based on discussion described above with the second loan agent, Amerisave should have realized in early XXXX and XXXX that our LTV was in the 70 %, however they never disclosed during these times that they would be unable to honor the original rate of 2.5 %. It wasn't until the loan was approved and rates had increased did Amerisave disclose their inability to honor the original term rate. In addition to this failure to disclose, Amerisave ultimately provided a product that was unrecognizable from our initial desire of no cash out and funded escrow account. Amerisave added excessive cash out options and fees at zero points in excess of what was offered during origination with 1 point added. Amerisave set up a severely underfunded escrow account which could have major financial issues later down the road. Amerisaves failure to disclose as early as XXXX their inability to honor the original rate, deprived us from being able to make informed decisions about our financial future to their benefit. We were either forced to accept a product we did not desire at a rate we were ambushed with or jump back into the waters of higher rates. I ended up finding a nice one bedroom apartment for {$620.00} a month in the XXXX. I proceeded to contact the poster/landlord and set up a visit to the apartment to see it as well as meet him. I immediately headed there after moving all my stuff into the storage unit and once I arrived found that the apartment had been put up for rent just the day before, the previous tenant still had a few bags and a mattress left at the apartment. The landlord told me that they would be moving their stuff out before the following Wednesday ( XX/XX/XXXX ) and I would be able to move in on that date if I was able to provide the down payment and first months rent. He also mentioned that 4 other people were supposedly looking at the apartment after I was and that he had already spoken to one or two people before I came. I couldnt help but be eager to take advantage of the opportunity that was in front of me so I quickly got loaned the few hundred dollars I needed to immediately put down the security deposit/down payment of {$650.00} ( extra {$30.00} to cover the keys and some broker fee or something he said ). He was very happy I was so interested and said that if I was able to send the money right away that we could go walk to the hardware store and have copies of the building and apartment room keys made for me. I sent the {$650.00} and we quickly made copies and went back to make sure they worked and he told me that hed call me the moment she had her stuff out and that I could come and sign the lease then as long as I had {$620.00} for the first months rent. Wednesday came around and she supposedly still had her stuff there, he kept pushing the day back until it finally came to the XXXX of XXXX when he said I was able to come sign the lease because the previous tenants lease officially ended on the XXXX and we both had busy schedules that week so I went and signed a lease/contract starting the XXXX of XX/XX/XXXX and ended XXXX if XX/XX/XXXX. I sent the money and then went home. I took a photo of the first page of the contract but he said not to take a picture of the signature page because it wouldnt be necessary until it was officially notarized. He then proceeded to tell me that he would send photos of the notarized lease as well as a few other documents I requested. He sent one or two of the documents but not the lease and the few photos he did send me didnt  exactly make full sense. Every night he would tell me she was supposedly moving her stuff out and every hour the story would change. I went there multiple nights after work because her stuff was supposed to be gone but when I got there her stuff was still there. Once the XXXX came around I went while he was at work and I went inside and waited for her to hopefully show up and get her stuff out. Then he said he was going to get a court order from a judge to have the lady formally evicted and that it would guarantee she would be out in 7 days from that day. He still repeatedly told me that she was coming to get her stuff on random days/night between the XXXX and the XXXX. Multiple times I went while no one was there just to double check that her stuff was actually still there. It always was there and even though he said that the entire apartment was fully cleaned and repaired, it seemed to get progressively dirtier every time I went. Two days before the XXXX he told me that he gave her {$150.00} to get a uhaul in order to get everything out by the XXXX. I asked for proof of that as well as proof that she actually rented the uhaul. He kept postponing sending the photos. Once the XXXX came around I went and check if her stuff was out yet. While I was there I found out his full name and did a little research on him. It turns out hes a scammer who normally works in XXXX and is very good at it. I found a few contracts identical to mine signed by other people for similar prices but all the same address. I have photographs and plan to take action but he is now accusing me of supposedly stealing from his apartment but Im sure this is just another ploy to receive some form of extra profit from this scam. I spoke to a couple other tenants in the building and apparently there was no lady who lived there before so I decided to check the bags that were supposedly hers and the bags just didnt make sense, they just seemed like it was for show. While I was there I had called the cops multiple times and even had to hide from someone trying to get into the apartment. He has sent me {$700.00} back so far but {$570.00} still remains and I am worried all the time and effort put into a court case wont be worth it in the long run. If he hadnt sent back the money Id most likely be able to just start living at the residence and simply refuse to leave/change the locks but due to him partially paying me back I am technically unable to do that. Since this incident I have done a massive amount of research and even contacted the company/landlord/company owner that owns the building and explained the full situation, he told me I was stupid for going through XXXX and that its not his problem or business what goes on in the building. Even though this is an illegal sublet and the tenant is also using the illegal sublet to scam people out of thousands of dollars. \n\nI am now in the middle of filing an internal affairs complaint, a recall request with XXXX  XXXX XXXX, a small claims court case, and also potentially being investigated for a crime that I didnt commit. I dont know what to do next, I dont know what steps to take, and I dont know what questions to ask. All help is welcome, any form of advice or even a contact that could help me are more than appreciated. If anyone knows of a lawyer that would be willing to defend me for cheap or even just give minor advice for a lower price. \n\nI know Im an XXXX for getting myself into this mess and for not seeing the signs pointing towards it being a scam. My cell phone was suspended on XX/XX/XXXX, which I owe over {$600.00} plus payments on devices still owed, to XXXX XXXX XXXX. My bank account was closed, due to negative funds for over 60 days. I explain all of this information every time that I call and speak with Navient, but they insist that I have enough income to pay them every month. She would constantly argue with me about what I would tell her. She questioned everything I said about my situation like I was lying to her. Almost every time myself or my Co-borrower speaks with Navient, we are ensued in an argument, like we are lying and just trying not to pay the loan. I would love to be able to pay the loan, so that I can get rid of the loan. I would also love to be able to pay all my other bills too!!! Yes, Navient has helped me in the past, but it usually took multiple phone calls to speak with someone that would actually care to help. It was not explained to me that there was only 24 months of forbearance time. Forbearance was always the solution Navient would give me, instead of lowering my payments. The loan was almost in default the last time I needed help. And then all I was asking was to lower my payments 20 %, since I was cut 20 % of my hours at work, due to the current XXXX slow down at the time, for which I \" misspoke '' on the previous complaint saying \" I luckily found a job a few weeks later, but I am not cut 20 % of my pay do to the current XXXX  glut. Which leaves me with {$100.00} for gas that will take me 2 hours away to XXXX XXXX for doctors appointments, any interviews that I finally get for jobs, and getting to my military unit for monthly drill duty. I currently live with my father and step-mother, who are living check to check, dealing with their own medical bills and expenses. My father will pay for my gas to get to doctors appointments, interviews, and drill, if I do not have the money, and only if I spent the money on my cell phone and vehicle insurance. If I were to start paying loans instead of my bills, I will not receive help from my father, and will still be in the same situation I am in now. It's a lose lose situation, until I can start working. And even after I start working, I will have to get another apartment, and get utilities setup again. After I finally get a job again, I will still probably need two to three months to be financially stable enough to start paying loans again. I tried to  explain to Navient that they are not the only company I can not pay. Navient told me to pay them, and figure out how to pay my cell phone, vehicle insurance, and gas after that! The supervisor told me that my bills are not her problem, the loan is. When I asked about working for Navient, she told me to see if there are any jobs open in my area, well of course I don't live near any Navient jobs, so she said I being condescending. All of my payments have been put into a suspended funds account so over $ XXXX is just sitting there and has not been applied to my mortgage. \n\nCURRENT STATUS & COMPLAINT : Once US Bank had decided I did not qualify for the COVID FORBEARANCE program ( despite being approved multiple times and sent incorrect paperwork - see original complaint ) they offered another application for mortgage assistance which was generally impossible for me to prove past hardship ( see feedback below ). When it was decided that I had no other choice, I obtained a loan for the funds to just pay back the amount from the paused payment months in forbearance. I called US Bank on XX/XX/XXXX to request the exact amount necessary to get my account back to good standing. I was advised that I needed an Account Reinstatement letter and that I would be sent this within 7-10 business days. I called twice to check on the status of this but never received it, or the amount. Then on XX/XX/XXXX US Bank reverted my loan back to foreclosure status. I received a letter dated XX/XX/XXXX informing me of this. I called as soon as I got the letter which arrived XX/XX/XXXX or XXXX and I checked the mail on the XXXX and called immediately. I told them repeatedly and begged them to just let me pay it. They stated that they could not accept the payment because of the status of my account, that funds would be returned to me. They also stated that the reason I did not get a Reinstatement Letter was because my account was not in foreclosure at the time I requested it. So, I called to find out what the exact amount was to pay and was told I needed to formally get the Account Reinstatement Letter on XX/XX/XXXX and no-one bothered to tell me that the person that requested that was wrong to do so. Not a single soul at that company could pick up the phone and communicate with me the amount to pay to fix this? Then XX/XX/XXXX, foreclosure status again. \n\nTo summarize : I simply wanted to opt in to the COVID Forbearance program in XXXX. \nUS Bank made countless errors I assumed were being fixed but instead sent my account to Foreclosure ( even though I had been paying my monthly payments without fail and they did not notify me ) XXXX of XXXX I begged for help to fix this and was offered the COVID modification again and signed/returned the papers only to be later rejected and told that I didnt qualify US Bank then sent an application for mortgage assistance that wanted me to prove hardship from 2 years ago ( which was basically impossible for me. The whole point of the COVID forbearance program was that it was assumed people who paused their payments had a reason. I was unable to work and so was my former tenant ) XX/XX/XXXX, I decided to take out a loan to pay the amount that was supposed to be in forbearance and request the exact amount to send to get my account back to good standing XX/XX/XXXX US Bank put my account back in foreclosure XX/XX/XXXX & XXXX XXXX called to try again to sort it out and was basically told to wait I have never been able to speak with the same person twice, nor have I been assigned a case manager. This has never been escalated despite all of my formal complaints or pleas for help. \nI have lost my tenants over this because they did not feel they have a secure home to live in. \nI lost money on tax filing because my payments werent correctly applied and are just sitting in a suspense account I fielded countless calls a day from aggressive sharks wanting to save me and buy my foreclosing home It took about 18 phone calls and multiple emails to request sites like XXXX and XXXX remove the foreclosure status on the property so that I could list it for rent and try to find new tenants. \nI have spent countless hours and lost many nights of sleep and shed many tears trying to fix this. It has affected my XXXX XXXX and my marriage. I am an upstanding member of the community. I own my own XXXX  & XXXX  XXXX. I am a mother. I am not the delinquent that they are treating me like. \nUSBank Home Mortgage company is so broken. The people are unqualified and uninformed and disconnected. I dont trust a single word I have heard from any of them. \nHow a company like this can not escalate a case like this and assign a knowledgable human to help is dumbfounding. \nI do not deserve this. They offered for me to apply for a modification that required me to prove my hardship from the past ( impossible ). I simply wanted the COVID Forbearance modification that I had been previously approved for multiple times but because they kept screwing up the papers on their end it had to be re-done and the rules changed. The offered solution also required an appraisal of my home at my cost and none of it guaranteed I would receive any help. I have had to take another loan to pay off the amount that was supposed to be in COVID forbearance. It has been a month since I requested the payoff statement to bring my account current and they still have not sent it. The fallout from this situation has greatly affected my life. I lost tenants because of their fear of the home being foreclosed on. I am still fielding calls from multiple people wanting to buy my foreclosing house. I had to fight for months to get my home removed from multiple auction sites. I have to take out a loan at a higher interest rate than my mortgage just to get this settled. My taxes were also affected because none of the interest paid was allotted correctly. I absolutely despise the poor level of service this company provides. It is impossible to speak to the same person twice and I have never been assigned any kind of case manager. Each time I call the representatives are absolutely clueless and I have to spend hours waiting for them to try to understand or help while they message supervisors. This company should be ashamed with how they do business and treat people. I would refinance and move my loan immediately if I could afford to. \n\n\n\n\nORIGINAL COMPLAINT FILED WITH CFPB : I have a mortgage with US Bank. I purchased in XXXX and have been in excellent standing for the life of this mortgage. In XXXX of XXXX I was XXXX  due to COVID and the tenant of my home was as well. I opted to sign up for the COVID Forbearance program to alleviate the financial stress. I went through the underwriting process with US Bank and they approved the loan modification. They sent the papers and when I went to have them notarized we realized they were in my maiden name ( I purchased the home 8 years before I met my husband ). I sent them a name change form and marriage certificate to change the name on my mortgage and have them reissue the papers. US Bank sent new loan modification documents but they added my husbands name to the loan! This was never requested by us nor did my husband authorize them to add his name to anything. I asked them to please remove his name and re-issue the papers. They sent papers with his name again and told me it was required because Colorado is a Common Property state. This is 100 % false. I insisted that they were wrong, and to please remove his name. US Bank then informed me that I had to sign a Quit Claim Deed to remove his name. Again, I insisted that they were wrong. I stated that I should not have to sign an incorrect document removing him as we never added him. The conversation about the Quit Claim Deed was in XXXX of XXXX. I asked them to please get it right and send me the correct documents. Many months went by and I assumed that it was being escalated and it was just delayed because it was complicated ( and everything seemed complicated with COVID rules ). I never missed a payment outside of that forbearance period and resumed my automated payments. Fast forward to XX/XX/XXXX... I find out from my tenants that there has been a foreclosure notice taped to the front door. I had NO IDEA. There was no communication from US BANK. I had been making my regular payments, all automated and on time. I called the Public Trustee and confirmed that my home was in fact listed on the foreclosure list with a XX/XX/XXXX sale date. I immediately called the filing attorney and US Bank to try to fix things. US Bank then reviewed my account and informed me that on XX/XX/XXXX they marked my account as \" customer denied loan modification ''. I never denied the program, I was just unwilling to execute incorrect documents. I assumed that whole time between XXXX and XXXX that it was just stuck in the process somewhere. This is my only fault - assuming someone was doing their job. On XX/XX/XXXX after panicking about the foreclosure and contacting them to fix things they re-opened the loan modification process again and sent to underwriting. They approved and send new loan modification documents ( with just my name! ) and immediately executed and returned to US Bank ( they received on XX/XX/XXXX ). Today ( XX/XX/XXXX - two full weeks later ) I called to check the status because they had not communicated anything to me. They informed me today that my modification was rejected because the home is not owner occupied. They said that because I was trying to modify it post-COVID, after the fact that it had to be owner occupied. This was not the rule when I qualified for the loan modification in the first place and it was in underwriting and approved multiple times. The only reason I am doing anything \" post-COVID after the fact '' is because US Bank made error after error. The extended timeline of this modification is because of US Bank 's errors. Also, one additional point, each time I start a call with US Bank they have a standard set of questions they ask and one of them is \" is this your primary residence '' and I always answer \" no it is tenant occupied ''. My tenants no longer have faith that they have a secure place to live and want to break their lease. US Bank has treated me as if I am in default and in the wrong. The trouble began in XXXX when the economy crashed, I lost three jobs within a few months and I had to finance all medical payments for my brother in XXXX after a 'plane crash. The following is a timeline of the events occurring during my 12-YEAR ATTEMPT AND FAILURE TO GET A LOAN MODIFICATION. \n\nMY COMPLAINT IS AGAINST FAY SERVICING, which took over the loan after XXXX, then XXXX XXXX. \n\nMY COMPLAINT : On XX/XX/XXXX, the judge in XXXX County ordered the foreclosure and sale of the property. It had taken Fay Servicing an entire year to set the auction date, mainly because they had neglected to meet deadlines for properly advertising the property in local newspapers in XXXX. Meanwhile, they charged me all the extra interest and fees for an entire year, when the delay was due to their own incompetence, not mine. \n\n1. I have resided at XXXX XXXX XXXX, XXXX XXXX, NY XXXX since XXXX. My efforts to come to some sort of resolution with XXXX/XXXX XXXX began in XXXX, XXXX and have continued since then with little or no progress whatsoever. For the purposes of this document, since XXXX was taken over by XXXX XXXX, I refer only to the Bank, which is understood to be XXXX at the start of this procedure, and XXXX XXXX as of XX/XX/XXXX. \n\n2. I have been asked to submit the same documents ( proof of income, profit and loss statements, proof of employment, hardship letters, utilities bills, rental leases, bank statements, tax returns, and more ) over and over and over again, and during the last court session with a referee in XXXX in XX/XX/XXXX, realized that the banks attorney and the banks representative, both of whom were present, had still been unable to correctly calculate my income, despite the fact that I had sent every document they requested time and time again. \n\n3. In XX/XX/XXXX I took a XXXX jumbo mortgage for {$940000.00} on XXXX XXXX XXXX, XXXX XXXX. It was a 4-arm balloon mortgage and I was paying interest only for 4 years. I was told by the broker that the value of my house would always shoot up and I could always refinance when the 4-year period was up. \n\n4. In XXXX I lost two jobs and I had to pay for my brothers medical expenses after a plane crash ; I had to support my daughter who had XXXX problems ; and I had tenants who disappeared without paying rent. At this time I was paying the mortgage. \n\n5. On XX/XX/XXXX, I attempted to refinance my loan with a special deal offered by the Bank and sent all the documents they requested, including a hardship letter outlining the events of my life in XXXX. \n\n6. Instead of refinancing my loan, I was told I could apply for a modification and was asked to send documents to XXXX XXXX, applying for the modification with a reduction in principal to {$720000.00} and the remainder interest-free for 3 years. I was denied the modification. \n\n7. In XX/XX/XXXX I put my house at XXXX XXXX XXXX up for sale for {$950000.00} which was the amount of the loan at that time. Its value had plummeted from {$1.00} XXXX. \n\n8. I was in arrears on the mortgage for XXXX and XXXX. I wrote to the Bank with a hardship letter and asked for a loan deferment for those months only. I was denied the deferment, but I CONTINUED TO PAY THE MORTGAGE. \n\n9. On XX/XX/XXXX, I was told by the Bank to send in another application. I requested a 3-month deferral of the 2 months arrears and sent documents again. Yet again, even after being told to send in the application, I was DENIED. \n\n10. On XX/XX/XXXX, I was again asked to send in another application. I sent a new hardship letter and a request for deferral, along with all the documents. Once again I was DENIED. \n11. In XX/XX/XXXX I hired XXXX XXXX  XXXX, CA, for help, and paid them {$3500.00}. They assured me that they could get the modification. \n\n12. By XX/XX/XXXX I was still paying regular mortgage payments on my XXXX XXXX property. I applied again for a deferral of the outstanding 2 months mortgage payments. I also applied again for the loan modification program. I sent another hardship letter and sent the same documents again. I was again DENIED the deferral. \n\n13. On XX/XX/XXXX, after trying in vain to reach XXXX XXXX   XXXX, I learned that it was a scam, and the company was being sued by the State Attorney General in CA. Of course, they had done nothing at all about my modification. \n\n14. In XX/XX/XXXX one of the loan counselors at the Bank told me to make a payment of {$4000.00} which I did. I then received a phone call from that counselor stating that it was not enough and I needed to pay another {$320.00}. I paid immediately. \n\n15. On XX/XX/XXXX, in a lengthy phone conversation with a Bank counselor, I was told that since I was three months in arrears, I was now eligible for the LOAN MITIGATION MORTGAGE ASSISTANCE PLAN. The loan counselor TOLD ME NOT TO MAKE ANY FURTHER PAYMENTS because I was already in pre-foreclosure and making payments would make me ineligible for the modification. I stopped all further payments just as I was told to do by the Banks counselor.\n\n16. XX/XX/XXXX I sent a letter to the Bank and another complete set of documents, as requested by the loan counselor. \n\n17. At the end of XXXX the Bank returned the checks for {$4000.00} and {$320.00} to me with no explanation. \n\n18. In XX/XX/XXXX I took XXXX XXXX XXXX off the market. Although the property was listed with a major realtor in the area, in 9 months, there had been not a single offer. \n\n19. On XX/XX/XXXX, unable to deal with the Bank on my own, I hired attorney XXXX XXXX XXXX, XXXX. XXXX. Who has been the Attorney of Record since then.\n\n20. On XX/XX/XXXX I received a letter from the Bank stating that they had never received documents from me and I appeared to be uninterested in a loan modification. They asked for more documents, which I sent. \n\n21. In XXXX, I had a conversation with XXXX XXXX, HAMP, at XXXX XXXX, who requested more documents. He explained to me that the bank has a new deadline every month, and that if no one at the bank has looked at my documents within that month, they become obsolete, and I must resend them with up-to-date bank account statements. \n22. On XX/XX/XXXX, I forwarded all my documents to my attorney who then forwarded all of these documents to XXXX XXXX at XXXX XXXX. \n\n23. On XX/XX/XXXX, despite sending all of the documents requested by the Bank several times over, I received a letter from them stating that my file had been closed due to non-receipt of documents. \n\n24. On XX/XX/XXXX I received a letter from the Bank denying my HAMP modification with the statement that my loan was too large for the HAMP program. \n\n25. On XXXX, XXXX, XXXX, although I had been denied the HAMP program, I received a letter from the Bank asking for the same documents again, which again were sent to the Bank for review. \n\n26. On XX/XX/XXXX, I received a letter from Loan Counseling at XXXX XXXX stating that their records indicated that I was not interested in any payment assistance a remarkable statement considering the number of phone calls I made and the number of times I sent large packets of documentation. At no point have I ever stated or indicated in any way whatsoever that I was and am not interested in mortgage relief and assistance. \n\n27. On XX/XX/XXXX, I sent all of my documents again to the Bank to show that I was interested in assistance and a modification. \n\n28. On XX/XX/XXXX, right after sending them a whole package, I was sent a letter claiming that XXXX XXXX had not received all the documents I had sent, so I once again sent them everything they requested. \n\n29. In XXXX, XXXX, in addition to the false statements made by the bank, they served foreclosure papers to my residence ay XXXX XXXX XXXX. A s I was not present, the papers were delivered to my tenants despite the fact that they had already been instructed to send all correspondence to my attorney and not to my residence. My personal financial information was thus revealed to a third unrelated party, who then used this information to break their existing lease, causing me a huge loss of income. \n\n30. In XXXX, XXXX, I was out of the country on a working trip and had arranged to have all mail forwarded to a friend who would look out for anything from the Bank. She did not receive any mail at all from the Bank. On my return on XX/XX/XXXX, I received a letter from the Bank stating that they had been unable to reach me and were proceeding with the foreclosure. They took this measure although they had been instructed to send all correspondence to the Attorney of Record and not to me. I also learned that the Post office will not forward official mail from any bank, so the letter had been returned to the Bank. They interpreted this as being a lack of interest on my part. \n31. Even though I once again sent documents to the Bank as requested, I received yet another letter at the end of XXXX that the file had been closed because no documents had been received. \n\n32. On XX/XX/XXXX the Bank sent me another letter requesting more documents. I was asked to send the Profit and Loss statement for XXXX XXXX, which I did, although I had already sent it to the Bank numerous times. \n\n33. On XX/XX/XXXX, the Bank claimed that they had not received any documents, although they had been sent through counsel, as requested. \n\n34. On XX/XX/XXXX, although I had already been denied HAMP several months before, I received another letter from the Bank denying a HAMP modification for which I was no longer applying! \n\n35. On XX/XX/XXXX, I wrote again to the Bank requesting them to stop sending any correspondence to me and to direct everything to my counsel XXXX XXXX XXXX, XXXX. XXXX. I confirmed that she was and still is - my attorney of record. \n\n36. Through counsel, I provided the Bank with the profit and loss statement for all my properties. \n\n37. At the end of XXXX/early XX/XX/XXXX, my counsel spoke to the loan counselor who confirmed that they had received all of my documents and everything was in order and the modification was ready to go to forward. \n\n38. In XXXX, XXXX I received a call from the Bank stating that I had been approved for a three ( 3 ) -month trial period, but had been not approved for the modification. They stated that I had to complete an interview over the phone to show eligibility for a new program that had just come into place. \n\n39. My Counsel conducted the interview for me as I was suffering from acute stress and didnt feel able to handle it properly. \n\n40. On XX/XX/XXXX, I was admitted to the emergency room at XXXX Hospital for XXXX  XXXX, XXXX, XXXX, and XXXX XXXX due to the XXXX  Ive been experiencing for years as a result of this foreclosure issue. \n\n41. In XX/XX/XXXX, I received a letter from the Town of  XXXX informing me that, although required to pay the property taxes during this process, the bank had failed to pay the second half of the property taxes for the year. I was forced to spend long hours on the phone with the bank to get them to pay the taxes. \n\n42. On XX/XX/XXXX the Bank sent me a letter requesting documents ; I sent everything that was requested, including rental leases as proof of income. \n43. Despite the fact that the Bank had known for months that XXXX XXXX XXXX, XXXX. XXXX had been retained as my attorney since XX/XX/XXXX, and they have been directed to correspond only with her, they continued to send correspondence to me. Yet again, I had to send the bank a letter explaining that all correspondence must go through my counsel, and that they can not send any mail to my address. \n\n44. In XX/XX/XXXX, I received a Class Action document against XXXX stating that as a Member of Class C, I am eligible for a permanent loan modification and a financial settlement, which must be granted by law. Nothing ever happened about this action and I received no further information. \n\n45. In XX/XX/XXXX, I received a letter from XXXX XXXX at the Bank requesting more updated documents. \n\n46. On XX/XX/XXXX I sent a new hardship letter along with every document requested. \n\n47. On XX/XX/XXXX, I sent a letter to XXXX XXXX explaining my sources of income and why, as a XXXX XXXX  and XXXX XXXXXXXX, those sources often change as jobs and tenants change, but that my net income remains fairly stable. \n\n48. On XX/XX/XXXX, through counsel I sent more letters to the Bank as requested : Confirming that I pay tenants utilities bills at XXXX XXXX myself ; explaining that XXXX XXXX XXXX is based at my home office, XXXX XXXX XXXX ; Explaining continued hardship but improved finances. \n\n49. On XX/XX/XXXX, I received a letter from XXXX XXXX XXXX, representing XXXX XXXX, attempting to collect the full debt of {>= $1,000,000}. \n\n50. On XX/XX/XXXX, I sent the Bank my documents again including but not limited to my profit and loss statement for XXXX XXXX and all the requested documents from my tenants, confirming their leases, as requested. \n\n51. On XX/XX/XXXX, I followed up with the Bank, confirming that my tenants reimburse me their share of my utilities bills. \n\n52. On XX/XX/XXXX, I sent letters to the Bank confirming my employment at XXXX XXXX XXXX, XXXX, and XXXX XXXX, XXXX, as requested. \n\n53. Throughout this whole process, I continued to send copies of all deposits made to my bank account with a full explanation for each deposit, as requested. \n\n54. In XX/XX/XXXX, the Bank requested yet again that I send another Profit and Loss statement for XXXX XXXX, which I complied with and sent. \n\n55. In XX/XX/XXXX, XXXX XXXX sent me a letter asking for {$250000.00} to cure the default. \n\n56. In XXXX, XXXX XXXX XXXX yet again requested documents, which I sent through my counsel, including but not limited to : Social Security Award letter, XXXX XXXX  Award Letter ; Proof of Income for XXXX XXXX ; Profit and Loss for XXXX XXXX ; Proof of Income for XXXX XXXX XXXX ; 2 Months Bank Statements showing Social Security and Rental received ; Proof of Occupancy for Tenants and all leases. \n\n57. In XX/XX/XXXX, while I was out of the country, XXXX XXXX once again served my tenants with foreclosure papers, which included all my personal private financial information. For the second time, my tenants then used this to cease paying rent and I was forced to move forward with an eviction, suffering a loss of {$8000.00} in rent and {$2500.00} in legal costs. XXXX XXXX had been instructed multiple times not to serve me or my tenants at my residence, but to serve my Attorney on file. XXXX XXXX continued to ignore my requests to have all correspondence sent to my attorney. \n\n58. On XX/XX/XXXX, my attorney XXXX XXXX XXXX, XXXX. XXXX   received a stipulation for discontinuing the first foreclosure action. \n\n59. For this foreclosure action I complied and sent all the documents yet again to XXXX XXXX immediately. \n\n60. On XX/XX/XXXX and XXXX, following another request from the Bank, I sent all the requested documents including but not limited to : XXXX pension award with letter of explanation TWICE in the same month ; 2 most recent bank statements, all pages ; XXXX tax return with certified profit and loss from the accountant for the rental income ; real estate owned ; schedule E for all properties ; profit and loss for film company 61. On XX/XX/XXXX, I sent an explanation of expected total income in XXXX, as requested. \n\n62. On XX/XX/XXXX, I sent a corrected interpretation of my bank statement and an updated hardship letter, as requested. \n\n63. In late XX/XX/XXXX, I was requested to send the same documents that I had already provided in XXXX. Once again, I sent, as requested : leases, bank statements, XXXX tax return, etc. \n\n64. In XXXX, XXXX, the tax assessment of XXXX XXXX XXXX showed the assessed value had been reduced from {>= $1,000,000} to {$850000.00}. \n\n65. On XX/XX/XXXX, as requested, I again sent all details of expenses for my properties, such as insurance and taxes for each property ; latest bank statements with XXXX XXXX  and Social Security deposits ; Profit & Loss for XXXX XXXX XXXX from XXXX XXXX - XX/XX/XXXX ; Schedule of Real Estate Owned ; Principal, Interest, Taxes and Insurance along with Gross Monthly Rental received and mortgage loan balances. \n66. On XX/XX/XXXX, I sent the schedule for XXXX XXXX, XXXX as requested by the Bank. ( One property is owned by this LLC,  which is in turned owned by the XXXX XXXX XXXX XXXX XXXX ). \n\n67. On XX/XX/XXXX, the first foreclosure settlement conference took place, which I attended with my counsel. \n\n68. During that conference my counsel and I were again asked to submit a whole package of documents. \n\n69. On XX/XX/XXXX, my Counsel submitted all the documents requested. \n\n70. On XX/XX/XXXX I was informed by Plaintiffs counsel they had all the documents. \n\n71. After submission of all the documents, on XX/XX/XXXX XXXX XXXX once again requested the exact same documents that had just been submitted with explanations. \n\n72. XX/XX/XXXX, my counsel sent an email explaining everything, pointing out those documents that had already been sent, and re-sending some documents as well. \n\n73. The Bank blatantly ignored the documents which had been sent along with full explanations by my counsel ; they continued to request the same documents yet again, including documents for a property that I did not own and were informed accordingly by my counsel. \n\n74. On XX/XX/XXXX, the second conference in this matter took place. The referee stated that the bank could not request any further documents and set a date for a third conference, ordering a bank representative to be present. The referee was disturbed by the banks failure to review the documents sent, and their failure to even review the letter sent by my counsel. \n\n75. On XX/XX/XXXX, at a third conference, the banks attorney was present, but the banks representative did not attend, although he had been ordered to appear. The bank requested more documents and in an act of good faith, I consented to provide a few more documents so that my case could finally reach a decision on the modification. \n\n76. The referee ordered a fourth and last conference at which the banks representative was ordered to be present. \n\n77. On XX/XX/XXXX, we held the fourth and final conference. The attorney and banks representative were both present. \n\n78. Before we even entered the conference room, the banks representative informed me that they could not give me a modification because my income is too low. \n\n79. During the conference, I learned that the Bank had based their calculations on the income from only one property, instead of using the total income from three properties ( and other sundry income ), which I had provided to the bank multiple times. They had not calculated the income correctly, despite the hundreds of documents that they had requested and received over a period of more than FIVE YEARS.\n\n80. I informed the Bank representative that they had calculated my income incorrectly. He confirmed this by showing me the income statement for only THREE MONTHS for ONLY ONE PROPERTY, which I had previously sent among all the other documents, on which he had based his calculations. He was not even aware that I have three income-producing properties, or he was deliberately ignoring this fact. It is absolutely evident from every document they have requested, and from all tax returns of the past 5 years. \n\nWe appealed the case. It was denied again because the judge stated that we had brought no new information to the proceedings. Our argument was that the original information had not been properly assessed. \nThe Judge did observe that the bank had not issued me with the correct 90-day warning re foreclosure, and a hearing about this is scheduled for XX/XX/XXXX. \n\n81. A trial was set for XX/XX/XXXX, to address the issue of an INCORRECT 90-DAY NOTICE OF FORECLOSURE LETTER from XXXX XXXX, which came directly from the bank instead of from their attorney and which was not delivered to me correctly. At the court, however, two ladies appeared as representatives of XXXX XXXX one a direct link to the bank, the other a representative of the banks attorneys, XXXX XXXX. Both ladies seemed eager to cooperate and promised to ensure that the bank would react in good faith. The Judge set a series of deadlines for compliance, as follows : XX/XX/XXXX I was to send in all requested documents for a full modification package, as listed by the banks representatives. Plaintiff was to review and request missing documents by XXXX. Defendant to provide missing documents by XX/XX/XXXX. Plaintiff to make decision re modification by XX/XX/XXXX. Defendant will contribute escrow advance amount XXXX to cover property taxes paid by the bank ). Loss mitigation package to be submitted by Defense counsel to Plaintiffs counsel, XXXX XXXX. Hearing and compliance conference set for XXXX. \n\n82. On XX/XX/XXXX, I sent all documents requested by the bank to XXXX XXXX via a XXXX  link. On XX/XX/XXXX, I sent the remaining documents via XXXX. XXXX forward these docs to XXXX XXXX at XXXX XXXX XXXX at XXXX on XX/XX/XXXX, and was directed to send them to a XXXX XXXX. XXXX received confirmation of receipt. \n\n83. On XX/XX/XXXX, one day after the courts deadline, XXXX received an email from XXXX XXXX at XXXX stating : I just wanted to give you an heads up that I know our MDL was due yesterday but there was an oversight by my previous clerk and we are working feverishly today to get an update. Ill have a MDL as soon as possible, and since we do not have to be back until XXXX, would be fine with extending our stipulation if need be. \n84. On XX/XX/XXXX, XXXX XXXX sent a MISSING DOCUMENTS letter indicating that they had not received ANY of the documents I had submitted to XXXX and that she had submitted to XXXX in a timely manner. \n\n85. On XX/XX/XXXX, XXXX XXXX responded : XXXX, i have a huge problem with the attached missing documents letter. It indicates no package was submitted and all of the documents marked not yet received were in fact included in the original submission, sent on time. Not only has your client not complied with the deadline to review the documents and issue a missing documents letter, when they finally do send a missing documents letter, it clearly indicates they did not review the package submitted as it shows every single document is missing and not yet received. I will need to bring all of this to the courts attention and I must say I am extremely disappointed as it was my understanding your office and the bank representative assured us you would actually stay on top of this review. \n85. On XX/XX/XXXX and XX/XX/XXXX I sent emails to XXXX XXXX asking her to find out when docs were sent from XXXX to XXXX XXXX. I also sent XXXX my response to the Missing Documents letter asking her to forward it to XXXX. Despite several phone calls to her office to ensure that she had received my response, I finally learned that XXXX was absent due to the death of her father. I tried to reach an assistant to no avail. Twice, I also tried to reach both XXXX XXXX at XXXX ( as XXXX XXXX was absent and he had forwarded the Missing Docs letter ) and XXXX XXXX, my case worker at XXXX XXXX Home Preservation Division who had signed the Missing Docs letter. I never received any response from either person. \nA few days later, I received a reprimand from XXXX XXXX for having tried to reach him directly. \n86. On XX/XX/XXXX, I sent my response to the Missing Docs letter with an explanation and details of the XXXX folder containing the requested updated documents to the following : XXXX XXXX ; XXXX XXXX ; XXXX XXXX XXXX ; XXXX XXXX ; XXXX XXXX all at XXXX. \n\nUpdated docs included : Updated tenant leases ; updated tax award letter ; updated XXXX XXXX  award letter ; Deed and Title for XXXX XXXX ; invoices addressed to XXXX XXXX as proof of residence ; my letter of response to the Missing Docs document, with signature page. \n\n87. On XX/XX/XXXX, I attended court with XXXX XXXX. The banks representative and attorney were present, but the judge was absent. We had a conference in which I was able to state my case. I gave both representatives this timeline as proof of the number of years and incidents that have been recorded to date. The banks representatives admitted that THEY ARE UNABLE TO DEAL WITH XXXX  AS THEY DO NOT KNOW HOW TO USE IT but they neglected to inform XXXX XXXX, choosing instead to make ME guilty of not sending the requested documents. We again agreed to a series of deadlines as follows : The bank requested further documents which I was to provide by XX/XX/XXXX. They were to review and I was to send further documents if requested by XX/XX/XXXX. On XX/XX/XXXX, the bank was to reach a decision. We are to appear in Court on XX/XX/XXXX. \n\n88. On XX/XX/XXXX ( a few days late as I was not aware of the deadline on the XXXX ) I sent documents to XXXX XXXX as requested, via XXXX : 4506-T More bank statements Letter explaining that XXXX XXXX XXXX was purchased with cash no mortgage 89. On XX/XX/XXXX, I sent the same documents to XXXX XXXX as email attachments. \n\n90. On XX/XX/XXXX, I sent documents requested by the bank after review as follows : P and L for XXXX XXXX, XXXX Revised 4506 T Letter explaining why there is no 44506-T for XXXX XXXX, only for XXXX XXXX XXXX. On XX/XX/XXXX, the deadline for a decision, no communication was received from the bank, nor on any day afterwards. \n\n91. On XX/XX/XXXX, we received a HAMP application from XXXX XXXX at XXXX XXXX the exact same application that I had submitted in XXXX, for which I was deemed ineligible. More documents were requested. XXXX responded to the banks attorney re the HAMP application, asking if this was a joke 92. At XXXX on XX/XX/XXXX, XXXX XXXX was in her car preparing to drive to Court in XXXX  when she received a phone call from the banks representative, who was ALREADY AT COURT, even though our date was for XXXX. He had already requested a further postponement of the case. \n\n93. On XX/XX/XXXX, I asked XXXX if we could press the bank for a decision since they had received all the documentation, and would have had to provide a decision by XX/XX/XXXX in any case. However, the courts were closed for two weeks for XXXX and the date of XX/XX/XXXX was the earliest that could be obtained. \n\n94. A few days before the Court date, we again received notice that it had been postponed to XX/XX/XXXX. \n\n95. On XX/XX/XXXX I received a statement from XXXX XXXX outlining the outstanding debts. \n\n96. Since XX/XX/XXXX, the saga has continued. The mortgage was taken over by FAY SERVICING in XXXX. I continued to try to receive a loan modification to no avail. \n\n97. My partner, Mr. XXXX XXXX, offered to be a co-borrower on a refinance and was refused because he was not actually resident on the premises. \n\n98. In a further court hearing, it was determined that I was just {$400.00} a month short of the required amount for a loan modification. \n\n99. In XX/XX/XXXX, I put the property up for sale with two top realtors. After 18 months there were no offers at all, although the property is in the XXXX  and in an excellent location and in great condition. I did not want to lower the sales price below the debt owed so that I could pay off the debt. \n\n100. On XX/XX/XXXX the judge ordered foreclosure and sale, but Fay servicing neglected to follow proper procedure for the sale. \n\n101.Since the property did not sell, I offered Fay Servicing a very reasonable short sale of {>= $1,000,000} when the debt was {>= $1,000,000}. They refused the offer. \n\n101. The property was set for auction on XX/XX/XXXX. I attended and was perplexed as there seemed to be no officials and no buyers. The auction had been postponed but no one had thought it necessary to let me know. \n\n102. On XX/XX/XXXX, my home of 33 years was auctioned off and sold for {>= $1,000,000}, ie LESS THAN THE SHORTSALE AMOUNT I HAD OFFERED. Not one single person was present at the auction, and I am convinced that the buyer had INSIDE INFORMATION as he is just another investor. So in fact, the bank DID take a short sale. That investor now has the property back on the market for the exact same price that I had in XXXX. I am a licensed professional in Florida, had waited many years to be ready, and had many options for lenders. Every time I told Quicken ( XXXX ) that had a better offer, she sweetened my deal, she blew up my phone repeatedly making me offers for mortgage. Finally I applied, I made the worst mistake of my life, and chose Quicken Rocket Mortgage. My experience preparing was a miserable and torturous process, working with XXXX, my mortgage adviser, nobody at Quicken ever answers the phone, lack of communication throughout. In the midst of my purchase COVID hit, I am a XXXX, everyone 's life changed, but as a XXXX, I was still employed, thankfully, even got additional income ... .but my employer wrote in my verification letter that I had been previously paid through company payroll, but at some point in XXXX, during our \" shelter-at-home '' my employer wanted to pay me through their personal account for logistics, the employer submitted that in writing to Quicken. I was approved and received my Clear to Close. Quicken never said it would be problem. Then, literally the night before closing, my seller who had lost his employment, defaulted on the contract and refused to sell! Quicken assured me if I found another property, they could close it quickly, and could \" transfer my whole file right over to a new property '' Although it had been a miserable process and I was unhappy dealing with Quicken, I stayed with them, it sounded like the easiest path to least resistance, as I had my \" clear to close ''. I found another property, submitted everything that was again requested, no \" transfer '' of file ever occurred, I spent another torturous month submitting documents, every day I would wake up to find an email with another 5 things requested! As we finally neared the closing, someone re-verifiied my employment and instead of calling my employers directly which I had supplied, Quicken contacted the company HR dept, spoke to an employee who knew nothing about the fact that the owners of the company had moved me to their home, and I was still there everyday. I was still working, same job, but now I worked from employers home, and she told Quicken that I was no longer employed. Immediately my employer, their attorney, everyone possibly involved contacted Quicken to correct this misinformation. Quicken requested documentation, phone verification, which was AGAIN provided. So, On Monday night, three days before my scheduled closing, I had received a call from my Loan Rep stating that my loan was all set, and instructed me to purchase my Home Owners policy, and told me that if I could get the insurance policy to them by Tuesday morning, we were \" all set to close '' On Tuesday morning they wanted to telephone verify my employment, My employer and the former HR employee both on conference call with Quicken once again confirmed my employment was the same, same pay, my Employer confirmed that NOTHING HAD CHANGED IN MY EMPLOYMENT, but reminded Quicken that I would be paid from my employers personal account during the COVID shelter-at-home period. Now, and only now for the first time, Quicken had a problem with this COVID plan. On Tuesday afternoon at XXXX ; XXXX I received a call from Quicken, Sage my Loan Rep, saying there was a problem. If i was being paid personally by employer, he explained, that would make me a 1099, and I would no longer qualify for my mortgage, since I had no history ( they required 2-years if you are self-employed ) as a 199 XXXX  person. I immediately informed Quicken that I had not received even one private-pay check yet, I reiterated that I was NOT self-employed that this was just my employers idea while we worked from home during COVIDF, and, I explained that if it was a problem, I would request my employer continue to pay me through the payroll system as I had always been. I explained that I was absolutely sure my employer would do whatever was needed, as Quicken would prefer, and that as of yet, nothing had changed, no private check had been given/taken by me. Quicken told me they would look into the matter and get back to me. Wednesday morning which was my scheduled closing day, I called Quicken Client Relations Team first thing in morning and requested to speak to Supervisor. I finally reached someone named XXXX, I told her the whole story, she knew nothing about it, I told supervisor what happened, and once again implored her to speak to underwriting and be sure they understood that my employer was absolutely willing to continue paying me through payroll system during COVID, and any problem they had with our temp plan during COVID would be immediately resolved! Initially she said she would get back to me within 24 hours. I informed her that in 24 hours I would be in default of my real estate purchase contract, I implored her to look at my file as she explained she needed to do, but that I desperately and urgently needed an answer immediately, at the latest I had to notify my Realtor by XXXX that day, if I would be denied, so that I would have time to put my mortgage contingency in place and officially withdraw from my purchase agreement, or request the seller give me an extension to close. I literally begged her to get back to me quickly with some information or I would be in Default of my contract. I spent the next 6 hours calling, emailing everyone I had ever been in contact with at quicken, requested to speak to supervisors, my loan officers supervisor, I even wrote the offie of the CEO of Quicken, begging them for information, and asking that they not allow me to Default from my Purchase Agreement, I needed an answer or explanation of whatever problem there was so I could either fix it, or withdraw. The entire day, I called one person after another, literally, nobody answered or returned my emails, nobody at this company that I had dealt with answered their phones hour after hour of calling, I kept leaving messages as the hours ticked toward XXXX. I received a call from the Manager XXXX XXXX, at approx XXXX and he said he had no information, but that XXXX who I had spoken to that morning was still researching a resolution. at XXXX I finally got someone to answer the phone by calling the main number and going through a client relations representative, who was finally able to trick the gal I had spoken with ( XXXX ) that morning, who although I had begged, never bothered to return my call all day ... .it was, when I finally reached her, XXXX, 40 minutes until Default time ... ... yet, she kept telling me in that phone call, that nobody had returned her call all day, she could not reach anyone, she had had other things to do that day, she had a meeting, she was busy ... ... .I would not allow her to hang up the call, as she insisted that I needed to speak to XXXX, who had answers, I explained that I had just spoken to XXXX, and he said that it was XXXX that was XXXX searching for a resolution to my mortgage status and closing '' he told me he knew nothing ... ... as I had been ignored all day, this felt surreal ... ..and by now, I knew, Quicken, unless they want something from you, they just do not answer their phones! I told her I would lose my deposit, which was my life savings if I did not withdraw from the contract by XXXX, yet she, nor any body at Quicken could tell me the status of my loan, which she told me was now officially in \" suspension ''. I implored them to speak again to my employer, my job had not changed, my position had not changed, my income had not changed and I was NOT self-employed, never had been! We had notified quicken two month prior, in writing on XX/XX/XXXX, of our COVID temporary plan, they had had nearly two months prior to my XX/XX/XXXX closing to let me or my employer know they would not approve such a temporary plan to pay me personally, and instruct me to remain on payroll. They never said a word, having had that information for two months, but waited until the day of my closing, and the last possible day for me to withdraw from my purchase agreement to discover they did not like this plan. We offered to change back to payroll, but Quicken insisted that although I had not taken even one personal check yet, that I was now a 1099, self-employed person, and that was a problem. while speak to her XXXX informed me that she got an answer from underwriting, and they reported that my Employer had written saying I was no longer their nurse, but that I was \" helping them around their home ''. I explained to XXXX that at some point in this process, when Quicken remote accessed my bank account, and saw an additional {$3000.00} deposit and asked what it was, I explained that while we worked from their home, my Employer had offered me an additional role, to deal with their home vendors, maintenance people etc., and they would compensate me OVER AND Above my XXXX salary, as an additional job! I explained that was an entirely different matter, for which Quicken had asked my employer to explain in writing, and I told XXXX I thought underwriting was confused, couldn't I speak with them to explain properly what was in my file, She refused. I begged XXXX, and then finally she said she had finally in touch with that Manger XXXX XXXX and would conference him on the line with us. I begged XXXX, that if they would deny my mortgage, then I must be notified of that in writing so I could legally withdraw from my purchase, or would lose my life savings in the deposit, and potentially be open to a Breech of Contract lawsuit, as I talked and watched the clock tick well past XXXX. He tried to lecture me on how \" mortgage applicants don't understand the changing times that we were in '' and initially they both told me they were not authorized to issue me a denial, I was still in \" suspension '' and not until the phone call got ugly, when I was tired and sick of listening to rhetoric, did XXXX finally inform me that in fact Quicken was denying my loan, and the notification was \" on its way to me as we spoke ''. Well, long story short, I did not receive that Notification until hours after my contractual time deadline, Quicken had a copy of my Contract, and that I had spent nearly 8 hours that day warning them of my deadline, which they failed, or even seemed to care to meet. So, after three horrible, miserable and unprofessional months of processing my mortgage application, countless submission of documents, paying for inspections and appraisals, I have defaulted my contract, lost my \" new home '' and on Friday when my lease expires, I will be homeless! These are the most unprofessional, inept, uncaring and thoughtless people I ever had the misfortune of working with. They purposefully ignore phone calls, they do not provide communication timely, nor communicate information pertinent to the outcome of one of the most important of all life situations, buying a new home! The final decision, which I was told that day was that \" new COVID Guidelines that had been issued of Quicken '' \" had now made my Application unable to be approved! '' I was all of a sudden, on the day of closing, undesirable to fund! In early XX/XX/XXXX, I handed the insurance check to my construction foreman, XXXX XXXX. \n\nNO WHERE on the check was the name of the contractor, XXXX XXXX, nor any of their employees/owner. Out of the blue, the company ( XXXX, XXXX, I think was the name ), came and took it away. At first, I thought this was maybe good news. He gave lots of excuses, was super defensive and threatened to drop me as a client if i kept calling him. \n\nOn XX/XX/XXXX, I was near his office/warehouse and decided to stop in for a visit. ( It was a 45-minute drive from my home, so I had only been there one other occasion ). When I arrived, there was a \" for lease '' sign in from of the building, a sign in the window had been scraped off and when I peered inside, it was vacant. \n\nOf course, I could not get ahold of anyone at XXXX. All phone calls went straight to voicemail. \n\nThe next morning, I called the phone number on the \" for lease '' sign at the office/warehouse of XXXX and was informed that they had to force XXXX out of the property for non-payment of rent and utilities. \n\nI also called the dumpster company. ( Thankfully I had taken a picture of the sign on the dumpster a few months before ). I was informed that XXXX never paid for the dumpster and that $ XXXX was due on the account. \n\nThe following week I found 2 invoices for {$19000.00} and {$6800.00} on my door, because XXXX never paid the framing company, XXXX XXXX XXXX. XXXX even threatened to put a lien on my house. Thankfully, they aren't doing that yet. \n\nAfter all of this, I finally figured out that XXXX had taken the FULL insurance check, for {$310000.00}. They were supposed to receive 6 separate \" draw '' payment amounts, through the course of the restoration of my house, following county inspections to ensure the project was done properly. \n\nNo county inspections were ever done. I called XXXX XXXX XXXX to make arrangements for a voluntary repossession but they would say they would have to call me back but don't. \nOn XXXX XXXXXXXX my daughter was staying the day with me and she came running into the house and said my car was gone. I already knew it was repoed. Somehow I got his phone number and was able to call him. He and his wife brought me my things out the car the next day, which I thought was really nice. I asked him if he just worked for Car Mart or did he work for different companies. He said that he worked for a third party towing company so he could pick up for anyone. Since he was nice enough to bring me my stuff and I knew the receive commission told him about my Harley.I told him were it was and asked him if he would be able to legally return it to the other company and he said yes and he would be able to look up the location to drop it off at so I didn't have to worry about that. I gave him the storage unit place XXXX XXXX XXXX FXXXX XXXX  TX, XXXX. I gave him the XXXX XXXX under the impression that he was legally taking the XXXX back to the company and that was his profession or would have not given him the keys. After that I didn't hear anything else from Car Mart. Not how to get my car back, no notice of intent to sell property, no date/time/location/choice on sale, no judgment date to give the right for my day in court to settle if I wanted, no deficiency notice for me the chance to pay it before it went on my credit report. Not only Did they just throw it on my credit report before giving me the right to rectify it but they also put it incorrectly on one stating I still owed around & XXXX. Which violates Texas Administrative Code Title 7, Part 5, Chapter 84, Subchapter H ; where it states the creditor not only have to give the debtor notice 10 days before the sale of the vehicle, they have to let them have have the opportunity to get their vehicle back, and know when, where, and if the sale was done in a commercially manner. Causing this to be considered a wrongful repossession. \nI wouldn't have known they had done that to me if, because of being denied every time I tried to even get a secured loan I was denied. I told her no because the bike was repossessed almost a year ago. She tells me she will have to call me back but doesn't. \nI called XXXX which is the licensing agency for towing and the only license a repossession operator is required to have in the State of Texas and was informed that per regulation they have to inform the local police they are going to be working in the area. I called XXXX and XXXX Police to see if I could get the Towing company ; s information because I didn't have it anymore due to not knowing there was an issue. Both Police departments said that they were not informed on or around that date of any repossessions in the area. XXXX police officer incident # XXXX stated that I couldnt file a stolen car report because the bike was no longer my property. That as soon as it went into the custody of the towing possession it became their responsibility not mine. I called car Mart and XXXX XXXX and they both told me that it was my problem not theirs. Car Mart also said that the tow guy wasn't even their normal guy and didn't know who he was and it was definitely not her problem. \nAs of right now XX/XX/XXXX The motorcycle is still missing, possibly stolen by the mystery towing company. That may or may not have a license because the manager hates my ex XXXX fiance and had her friend pick it up faking to be tow guy. I actually had no choice in signing the lease because its coerced debt but the manager didn't care. Violated my rights with a wrongful repossession, unfair credit reporting, and unethical business practices. XXXX XXXX XXXX billed me and had me in collections for almost a year if the towing guy was telling the truth. All over a vehicle they had. They also committed a wrongful repossession because they also didn't send me the notices and offer me the chance to rectify the loan.
