When it was time to the lease to get over I went to the store and sat for hours and they tried to look up the contract that said I could pay fair market value and I was informed that the contract was under the ssn of my ex husband and did not apply. They did not know what fair market value was for my phone and I would have to pay {$200.00} to cancel my contract and pay for the phone in full or to wait until the system says I can purchase the phone and then get credit for the months I had paid on the lease past the time allowed by contract that was not mine. mean while the phone was having problems with charging so I went to the company store to have it looked at. they did not do a loaner phone or back up because they said it will only be a few hours ... .They then said it was a bigger problem and sent it off to be worked on and activated my old phone. i was informed while working on the phone that they lost everything I had on the phone and needed to replace the phone with what they said would be a upgrade. they sent a XXXX XXXX that had been recalled and that will not even be allowed on a plane, it was over heating and shutting off on its own.I called about both problems and they took the payment to end the lease but did not reimburse me for the payment made as I was told would happen. I took off work and sat all day at the company store again to get it fixed. they replaced the battery and told me it would be fine ... .I walked out of store as it was closing and within 15 minutes it over heated and turned off again ... unable to miss any more work and sit all day aging I call the insurance that I had been also paying on the phone how also told me I had to go to store there is no other way. I I am in XXXX XXXX and all my signs and cards, contacts and registration was to that phone number. I called XXXX and explained I had a XXXX on my XXXX from the phone the sold me and I had to where gloves to hold it on a air conditioner to cool it on speaker phone to make to call to them. They would not fix the problem. I was forced to give up my number and end service with XXXX. I have a XXXX on my XXXX and a phone that is not operable. They own me and XXXX ***does not have a contract** on the phone and account in my name and ssn. I am out thousands due to all the problems and missed calls with XXXX. All the records lost and personal information/documents/photos/numbers. When I complained to the loan manager at Citibank about the low appraisal, he waived it off and suggested there must have been some other reason for it to come in low. We were planning to renovate our bathroom so I did not order another appraisal at that time and I did not want to hold up the process, so I let it go. My upstairs neighbors were able to complete their refinance ( their lease is the same as ours ) and they are able to take advantage of historically low rates, while we have been locked out. I called the Ally help desk and was told repeatedly that the back of the car or rear of the car was gone and I owed Ally for it. I then asked to speak to a manager and they said a manager would call me. No such call was received. \nWhat followed was a morass of calls ( and letters ) from Ally demanding payment, with me continually stating that the back of the car was there when I turned the car in. It did not matter to the person calling, I owed Ally money for the back of the car. \nAt some point ( over a month after turning the car in ) someone at Ally told me that it was not the back of the car that was missing, but rather the charging unit for the XXXX ( it is an electric car ). I told this person that I did have the charging unit. When I took over the lease from the prior lessee, he gave me the charger ( he was giving it to me with the car and I understood it was his personal property which he did not need anymore ). I was not aware that the charging unit was to be returned with the car. In any event, I told the Ally representative that I did have the charging unit and would gladly drop it off for Ally. I was told it was now too late and that I must pay for the charger ( roughly {$500.00} ). \nI told the Ally representative, and have repeated it many times to the numerous calls seeking money from me, that I was glad to return the charger but would not pay for it. Since Ally did not tell me what the actual problem was for well over a month, I was not paying for a charging unit when your firm told me that I owed Ally for the back of the car. \nThe upshot of this is I recently tried to get a loan from XXXX on my home. While I would normally not have had a problem getting a loan, this issue with Ally regarding the lease of the subject vehicle is significantly and negatively impacting my credit score. The amount of the loan was limited, and according to XXXX, I was now paying 88 more basis point for the loan due to my credit score having fallen more than 200 points. The reason for the credit score falling was Ally reporting me as delinquent on this loan. The problem is that they are telling me the only option is to reinstate the past due balance in full, while they are having a foreclosure attorney contact me. I am very frustrated and concerned with the way they have handled the servicing of my mortgage loan. I had some major issues due to loss of employment, fire and injury that put me on workmens compensation. I have tried to communicate with Carrington and I got an email that said XXXX is reviewing my application, but I have not sent any application in. When I call to follow up I get conflicting information and it sounds like this is a delay tactic because now I am in the foreclosure system at Carrington. I thought there were programs that could help someone in my situation save their home. It sounds like Carrington has moved past that part of the program and instead started trying to auction off my home. I am back on my feet financially and can make things right if Carrington were to allow access to government programs they are supposed to offer. \n\nThis home was owned by my parents since XXXX. When they passed away I bought the house with a loan from XXXX XXXX  in XXXX. I refinanced with XXXX in XXXX and got some cash out to get caught up on bills. I have worked as a truck driver for 30 years and it is a business with a lot of ups and downs and I was never able to save very much money. In fall of XXXX my ex-girlfriend was going to move several hours away and take our XXXX XXXX XXXX daughter with her. My daughter did not want to go and I desperately tried to come up with a plan so she could stay close to me and her grandparents. I put together the money I had and bought an RV and a space at an RV park and my daughter and I stayed there while I commuted to work and my primary residence. This lasted a few months and put me into a tough place financially and I defaulted on the loan. I contacted XXXX  and they worked with me and put me into a HUD program to put the past due payments into a second XXXX so I could resume making the regular mortgage payments. I was able to make the first couple of payments as my daughter had moved in with her grandparents but I was still in a lease for the RV Park and then my work truck caught on fire and it was a crazy situation and while I was trying to put the fire out I seriously injured my shoulder. This put me out of work. Due to all of these problems I fell behind on the mortgage payment again and was on workmens compensation for a couple of months. \n\nWhen I fell behind after getting the help in XXXX the loan had transferred to Carrington. They issued a deferrment, which deferred my lease payments. I was under the belief that it was another extension, so I continued to make my car payments as usual. I also continued to receive statements from XXXX XXXX XXXX showing me how great I was doing with my payments and no action was required by me at that time. As such, I believed the matter non urgent as long as I continued to pay. I was dealing with a personal health crisis with my dog all summer long, in and out of vet emergency hospitals, so I didnt have the luxury of car shopping. \nI continued my payments through XXXX and XXXX, and also communicated to the company I was going to look into another lease from them, or possible purchase the car. There did not seem to be any issue with this arrangement. With dealerships not accepting cars, why didn't Chase arrange to pick up my car if they wanted it back? My payments were pre-paid through XXXX of XXXX. In XX/XX/XXXX, Chase charged off my lease. It hit my credit for 150 points and made it impossible to get a loan to purchase the car, or any car. They ruined my handyman business by repossessing the car in XX/XX/XXXX. I had no way to work without my car to carry my tools. \nI had a stellar record with this company for my previous 2 XXXX purchases ; with this action, even though there was open communication with them, took the route to actively destroy my credit, while I was 100 % current with my payments. \nI am attaching copies of my payment history at 98 %, and the statements from chase AFTER my lease was supposed to be up, showing no problems or issues. Weeks later we learned it was not. XXXX forwarded us to closing specialist, XXXX XXXX. \nAgain, we went through the explanation of how XXXX works on commission and has income but it is sporadic. We also have assets in a brokerage account, IRAs and as I mentioned before, I have a job where I get paid every other week and income from real estate sales. Every time I spoke to XXXX I was reassured he was looking into the problem and would call me back but I never heard from him until I called him. \n\nFor this loan we paid off a car loan and a credit card balance to bring our DTI down. I would have to keep calling him back then learned this whole time they were working off of our old credit scores. \n\nAfter many calls to XXXX we were told the loan was approved and just In their queue to close. \nMany calls later we learn that it is not approved. \nWe paid off a car loan and a credit card balance to get this loan. We hired an attorney to transfer the deed to myself and my husband which was one of the steps Rocket mortgage told us to perform. Now what do we do? \nMy sister has expected this money since they told us starting in XXXX that it was approved. \nThis dragged on and they strung us along for 5 months. That is outrageous and unconscionable that they are so flip and casual about earning our trust, telling us my husbands XXXX XXXX is no problem and then basically screwing us. There must be some timeframe that they should have said yes or no to us in, 5 months is appalling. \nI missed the most vigorous spring market in suburban NY history and could have sold this apartment. \nThe week before last I asked XXXX what they would lend us and he said he had to work some numbers and he would get back to us. Of course I didnt hear from him and had to call him today. He said he had to run some numbers and to hold on. \nWhile he was doing this he had the arrogance to comment that my husband hasnt gotten paid for a while and ask how do we manage, hes just curious. WHAT IS THE COMPLAINT ABOUT? \n\nThe complaint concerns Wells Fargo Home Mortgages process for refinancing a home mortgage loan on my primary residence. Wells Fargo holds the current mortgage on my primary residence at a high interest rate for a term of 30 years. I thought that the refinancing of my mortgage would be easier if I continued with Wells Fargo. However, once I started the refinance process at a lower interest rate with a term of 15 years, it became evident that Wells Fargo had commenced to complicate my refinance loan application and to discourage me from completing the refinancing of my primary residence. \n\nDespite having an excellent credit score, a good income source, and financial resources, I contend that I was unfairly treated because of the following : 1 ) As an existing customer of Wells Fargo, it may be more advantageous for Wells Fargo if I were to maintain my 30 year, high interest mortgage loan instead of refinancing a new 15 year mortgage with a lower interest rate. \n\n2 ) Wells Fargo used their XXXX survey to unfairly treat me. I completed this survey because it stated that by providing the requested information it would not be used to hamper the processing and approval of my refinance home mortgage loan ; however, this did not prove to be the case. \n\n\n2. WHAT TYPE OF PROBLEMS ARE YOU HAVING? \n\nThe problem is that I had to cancel my refinancing loan application despite the fact that I was able to lock in on a very low interest rate for a 15 year mortgage loan and had received the loan approval. However, Wells Fargo made it very difficult and stressful for me to fulfill all of their requirements and conditions prior to closing on the loan. \n\nBasically, Wells Fargo made repeated requests for documentation that I had already previously submitted and made requests for new documents that were impossible to produce. Additionally, extreme pressure was applied because all of the documentation requests came with unreasonable time constraints. Wells Fargo used excessive documentation as a method to delay and to hamper me from ever going to closing on my refinance home mortgage loan. In summary, I believe that Wells Fargo actions created a very hostile environment, which contributed to me having no other choice but to terminate my loan application prior to closing. \n\n\n3. WHAT HAPPENED? \n\nOn XX/XX/XXXX, I signed a Notice of Intent to Proceed, which gave Well Fargo Home Mortgage permission to move forward on the processing of my refinance loan application. From JXXXX XXXX  XX/XX/XXXX thru XX/XX/XXXX, Wells Fargo requested over 20 documents related to the processing of my loan application, which I provided timely while under pressure to meet strict time frames. \n\nOn XX/XX/XXXX, Wells Fargo requested 11 additional documents despite me having submitted over 20 documents previously. My major problem with meeting their documentation requests commenced when it became evident that Wells Fargo requests were excessive, repetitive, and not relevant to my ability to finance a new loan. The following are examples of some of their punitive documentation requests, which were very stressful and unreasonable : A. Document Request : Provide a current mortgage loan statement for my rental property. \nPROBLEM : I have been requested three times to provide the mortgage loan statement for my rental property, which is co-owned with my brother. The first time I submitted the requested mortgage loan statement for my rental property was on XX/XX/XXXX, it was not recent enough. On XX/XX/XXXX, I resubmitted the requested statement for XX/XX/XXXX ( the most current ). Then on XX/XX/XXXX, Wells Fargo requested this document a third time, this time they wanted the XX/XX/XXXX statement, which was impossible to provide, since this statement had not yet been generated by the bank. I was told that the loan statement for XX/XX/XXXX was needed because my refinance loan would not close until XX/XX/XXXX. Apparently between XX/XX/XXXX and XX/XX/XXXX, Wells Fargo expects that something was going to change with respect to my ability to make the mortgage payment on the rental property. ( Harassment - repetitive and unreasonable requests from Wells Fargo. My rental property should not be a factor in the refinancing of my primary residence mortgage loan ) B. Document RequesXXXX : Provide a recent bank statement showing my monthly gross Pension Income. \nPROBLEM : On XX/XX/XXXX and XX/XX/XXXX, I provided three supporting documents pertaining to my pension income. I submitted OPMs Notice of Annuity for XXXX ( which provides my Gross and Net Income ) ; Form 1099R Statement of Annuity Paid for XXXX ; and IRS 1040 - XXXX Income Tax Return. All three documents would verify my pension income. On XX/XX/XXXX, Wells Fargo requested that I provide a recent bank statement which would reflect my gross income. This request is impossible because my bank statement will only show my net income. But I had already provided excellent support documentation regarding my pension income. ( Petty and vindictive request from Wells Fargo since I have fully demonstrated that my income is sufficient to handle this new loan ) C. Document Request : Provide Income Tax Returns ( IRS 1040 ) for the most recent two years that shows my rental income. \nPROBLEM : On XX/XX/XXXX and XX/XX/XXXX, I provided three supporting documents pertaining to my rental income. I submitted IRS 1040 - XXXX Income Tax Return with all the schedules ; Form 1099-Misc for XXXX Rental Income ; and, Form 1040 -Schedule E - XXXX Supplemental Income and Loss. All three documents would verify my rental income. On XX/XX/XXXX, Wells Fargo requested that I resubmit my IRS 1040 Income Tax Return with all schedules for XXXX as well as for XXXX. ( Harassment - repetitive and unreasonable requests from Wells Fargo. My rental income should not be a factor in the refinancing of my primary residence mortgage loan ) D. Document Request : Provide Lease Agreement for my rental property showing monthly rent. \nPROBLEM : On XX/XX/XXXX, Wells Fargo made a request for the Lease Agreement to verify monthly rent for my rental property. I did not provide the lease agreement. ( Excessive and unreasonable request from Wells Fargo. My rental income should not be a factor in the refinancing of my primary residence mortgage loan ) E. Document Request : Provide a letter of explanation for address variances, confirm if I have any ownership in the properties. \nPROBLEM : On XX/XX/XXXX, Wells Fargo requested a letter from me stating that I did not have any ownership in my brothers primary residence and my P.O. Box mailing address. My brothers address is included on the rental property documentation because we are co-owners. Despite having previously explained this to Wells Fargo, the bank still requested additional documentation. Additionally, I explained that all my mail is not delivered to my primary residence but to a P.O. Box mailing address, Wells Fargo requested that I verify that I had no ownership in the US Postal Service. ( Harassment - unreasonable and vindictive request from Wells Fargo ) F. Document Request : Provide Homeowner Association documentation that shows the amount and and frequency of my HOA dues for my primary residence and rental property. \nPROBLEM : In my initial application, I provided information about my HOA dues. It is very stressful and labor intensive for me to contact the proper HOA representatives, who would provide documentation on the HOA dues related to my specific properties. Payments of $ XXXXmonth and $ XXXXmonth in HOA fees should never be a factor in determining if I am at risk of defaulting on a loan. I have never been late paying a bill in my life. However, instead of having loan finalized with the more favorable rate that XXXX congratulated me with just hours earlier in the day, I, as instructed by XXXX, checked email later in evening, and saw nothing finalized. \nRemaining very frustrated by my haunting experience with Upstart this entire week, I called once again to check with XXXX what additional delay might have ensued. \nWhile I was on hold, I saw an adjustment again on my loan offer, this time cutting the principal in half and raising the rate back up to the highest APR. \nThis was just another of many efforts Upstart has made in trying to discourage me from borrowing from them. I sent them ample documents and followed up diligently on all of their request of me, yet they have continued to mislead me and cyber bully me by requiring me to send more and more documents, including documents already sent. They had me send pay stubs 3 times, and XXXX forms multiple times. \nThey requested that I send rental lease agreements and tax information regarding rental property that I own, and then later told me that they could not use the rental income in their calculations because they do n't fund commercial loans??? \nDespite that, they later made another request for my rental property lease agreements, that I had previously sent. \nI have been put through the ringer with Upstart. The explanation given for reducing loan amount from {$31000.00} to {$28000.00} was reported to me because they could not consider my rental income. \nI was offered the {$28000.00} with lower APR this afternoon by XXXX, and he actually congratulated me and said only problem was that with this being Friday, he would not be able to send funds to my bank until next Tuesday. I accepted those terms, yet within three hours, I was once again misled and all terms changed, and principal cut in half with highest APR offered, 29.9 %. I was then asked multiple times by managers at Upstart if I still wanted the loan. But then cash one keeps telling me that a payment didnt come in or was sent back to the bank or some kind of crazy situation and then my banks get involved explaining what cash 1 loan is doing so then I have to call cash 1 loan and speak with supervisor to explain because my bank says they show I been paying on time every month same payments never missing a payment my transaction for proof/ I ask cash 1 loan why my interestwas so high and why is it taking so long for my money to move down the line to show improvement that my loan is going down below while making my payments they keep telling me that am on a 18 months loan and if I can pay more then my monthly payments of XXXX then my loan will show some improvement such as lower payment amount. The manager, together with the sale person ( XXXX ) offered to pay the 5 months of my XXXX XXXX lease car totaled about {$1600.00} just to get out of the lease. \nWith the new car deal and as promised, my daughter was approved for 3.4 % if we buy the XXXX   XXXX XXXX for {$29000.00} with {$1000.00} down for 72 months payment, 2 years bumper to bumper, up to XXXX,XXXX miles engine warranty, will make all the windows tinted plus they will pay off the rest of my XXXX XXXX XXXX lease car for {$1600.00}. It so appealing and such a great deal that we end up agreeing to all this. \n\nWhile waiting for all this deals and the financing documents are being reviewed, the XXXX XXXX finance person named XXXX XXXX were giving us different information. 1st, was when I declined the Gap Insurance the personality changed to something defensive, unwelcoming and rude. \n2nd, was the information provided by the manager and sales person about the 2 years bumper to bumper warranty was wrong and I was told that they had a mistake in giving me that information. It should only be 1 year bumper to bumper   warranty. \nTowards the discussion and dealing, We end up signing the given deal. This XXXX XXXX XXXX will be financed with 3.4 %, with 1 year bumper to bumper warranty, XXXX miles warranty, the company will pay off the 5 months left of my XXXX XXXX XXXX Lease car for {$1600.00}. \nWith that being said, all documents were signed and ended. Copied provided to me and my daughter and told us that it will take 2 weeks for the returned XXXX XXXX lease car ( 5 months ) payment to be mailed to us. On that same day ( XXXX XXXX, XXXX ) they gave us the car. We took it home without any problem. \nXX/XX/XXXX Car tinting job was done. There was no problem. No questions asked. Everyone was nice at the dealer XX/XX/XXXX I noticed that the back chair needs some work done and I called my sales person XXXX if he can have this fix and he scheduled the repair on XX/XX/XXXX. \n\nToday, XX/XX/XXXX when my daughter took the car by herself to the dealer. \n2 weeks after we have the car on our possession, the dealer told her that they have to changed her financing rate from 3.4 % to 5.9 %. The monthly payment went up and my daughter were so confused and surprised because everything they promised was changed suddenly. I spoked to the Finance person ( XXXX XXXX ) and asked the reason because I don't think it is right to suddenly change the deal after everything was settled 2 weeks ago. I was told that my daughter can not be approved for 3.4 % bec she will have 3 cars under her name. The XXXX XXXX dealer knows this before they finalized the financing options and the deal. The problem with this was misinforming us and keep promising us of all this good deal until they get us to buy the car. \nFirst of all, we were not notified for 2 weeks about this unapproved rate. Not sure when did they decided to change it. When the car dealer saw my daughter with the car, she was asked to re-signed the vehicle contract and agreement. I am not present when they did this re-signing today. My daughter called me and asked me about this which I am not aware. I don't think this is right. I find this so unfair and unjust. The deal that was made and finalized 2 weeks ago should not be changed without appropriate notification. \nOn the other hand, I still did not received the promised returned lease car 5 months payoff amount. \nThis company runs business wrong. Just to sell cars they will mislead and misinformed the consumer. Promise to give you a great deal but yet not disclosing the right information. \nNot notifying the consumer about the rate and suddenly decided to change without notification. Failing to mail the promised payout amount of the previous lease car is so wrong. \nThe worst thing they made in this deal was to back date the document re-signed today by my daughter to XX/XX/XXXX instead of today 's date XX/XX/XXXX. This is totally wrong. This needs attention to protect consumer about their dealing practice. \nThis never happened to me in the past. It is upsetting, we felt like we were treated unfairly, given a dishonest deal and wrong information. I left in good terms with the XXXX XXXX XXXX and they never asked me for any additional payments. \n\nI'm not sure where this collection company National Credit Systems has reported a collection debt in my name and it is reported on my credit file. I never received any info on this until when in late XX/XX/XXXX and early XX/XX/XXXX through my daughter loan officer. My daughter was trying to get loan approval and asked me to be her cosigner but the loan officer informed that I have a collection charges in my name. I never was aware of this or contacted by either the collection company National Credit Systems or XXXX XXXX XXXX while these charges have been posted since XX/XX/XXXX. It is not fair to me. It is not just impacting my score but I can not help my daughters out with either their loan applications or even signing for utility company such as XXXX as even that my daughter had to do for me as she has a good credit. I need help in getting rid of this false collection charge by the company National Credit Systems. If there was an early termination per lease agreement then XXXX XXXX XXXX should have given me that correct info and my financial responsibility at that time when I was vacating specially when I did inquire and expressed my financial obligation. It has been consistant for more than 11 years without interruption. I explained I needed this income to be included in order to qualify for the loan the very first times I spoke with your loan reps back in XXXX. After checking into this they told me the property would be no problem and I should go ahead and order an appraisal. At this point, with interest rates at XXXX for a conventional 30 year mortgage, I stopped looking for other lenders and believed I had a locked in rate and the loan would get done. I received two notices in the mail that my request had been received and acknowledged ( dated XXXX XXXX and XXXX XXXX ). Since then, no action has been taken on the part of LoanCare to produce the stock and lease and they have refused to coordinate with my attorney to set a closing date. Both myself and my attorney have called them many times ( every business day for the past several weeks ) and every time are told that there is no update. They have said that they would \" escalate '' the request, but still nothing has been done. On Friday XXXX XXXX, I spoke with a supervisor who told me that she could see digital copies of all of the documents XXXX received when they purchased the loan and that the stock and lease were not among those documents. I asked if that meant they were lost, and explained ( as I have done multiple times now ) that the documents themselves can be replaced if that is the problem. She informed me that it appeared they were lost and made a note in my file that the documents were missing and that we would like to close without them. On Mon. XXXX XXXX and today ( the XXXX ) my attorney contacted them to have see if we can proceed without the physical documents, request them to complete an affidavit of lost stock and lease ( needed to replace them at closing ) and move ahead with scheduling a closing date. Their response, once again, was that they don't have an answer yet. They refuse to cooperate with myself or my attorney, refuse to schedule a closing date and refuse to communicate at all. This request was made XX/XX/XXXX and in the two and a half months since, no action has been taken on their part to complete it. My estimated closing date was XXXX XXXX. My buyers ' interest rate lock expired yesterday ( I do not know if they paid to extend it ). We are not able to close before XXXX XXXX and as of this weekend we will be in breach of the contract. My buyers are threatening to walk away and very soon they will be able to. We have been ready to close since the end of XXXX and LoanCare will not let us. They are quite literally holding my property hostage and my sale is about to fall through because they will not allow us to complete it for unknown reasons. Meanwhile I am forced to continue to pay them interest on a mortgage which should have been closed out weeks ago.
