The absence of this packet meant I had no documentation of the transaction from the moment of purchase. \nI made loan payments to XXXX from XX/XX/XXXX onward without any knowledge of a title defect. In XXXX, when I attempted to sell the vehicle back to Carvana, I was directed to contact XXXX XXXX to obtain the title. Upon calling XXXX XXXX, I was informed that no account existed in my name and that the vehicle remained titled under the name of XXXX XXXX the previous owner. The title had never been transferred out of her name and into mine despite my having purchased, possessed, registered, and made payments on the vehicle for approximately XXXX years. \nWhen I contacted Carvana to report this title discrepancy, they stated they could not assist me and directed me to XXXX. At no point did Carvana provide any written documentation, explanation, or resolution regarding the failure to transfer the vehicle title at the time of sale. Every attempt I made to obtain documentation or a written response was refused or redirected. I am attaching a screenshot from Carvana 's own website showing my name associated with this vehicle, the matching VIN ( XXXX ), the purchase date of XX/XX/XXXX, and a prior buyback offer of {$2000.00} confirming Carvana 's own records acknowledge this vehicle as mine while the title was never legally transferred into my name. I am also attaching a screenshot of the vehicle 's original Carvana listing showing it was sold for {$16000.00}. \nI have a recorded phone call in which XXXX XXXX XXXX representatives, including a manager identified as XXXX ( Employee ID : XXXX XXXX ), verbally confirmed that the account was never in my name and that XXXX XXXX still held the title and XXXX on the vehicle under XXXX XXXXXXXX XXXX name. A repossession was subsequently reported to all three major credit bureaus under my name in XX/XX/XXXX for a vehicle that was never legally titled in my name. I was about two months ahead of when the lease expired and was told that if I financed a new vehicle purchase that I would pay nothing to return the leased vehicle early ; XXXX would cover all the costs and all I would be paying for was the new vehicle. I was excited, signed my lease, got set up with a loan, and drove off with my shiny new car. \n\nAbout two months after purchasing my new car, I received a notice in the mail about an outstanding balance of {$1800.00}. Apparently I was being charged with {$880.00} in unpaid lease payments, {$400.00} in early termination fees, {$79.00} in taxes, and {$440.00} in excess wear and tear fees. The unpaid lease payment, early termination fees, and taxes were all supposed to be waived according to my dealership, so I contacted them to get everything squared away. After some back and forth they agreed to pay for everything but my excess wear and tear fees. However, the original contract I signed when leasing my first XXXX ( the XX/XX/XXXX XXXX ) showed that I had paid up-front for excess wear and tear protection. In fact, I paid {$600.00} for the protection, which is more than what the actual fees came out to. Instead of the dealership or XXXX finance resolving the matter, I was directed to file a claim with some XXXX-party company, have my case looked at, and hope I got a resolution before Hyundai Motor Finance put out a collections on this obviously bogus charge. \n\nThe dealership eventually agreed to pay off even the excess wear and tear fees, after more than a month of back and forth conversation. When I attempted to check on the status with Hyundai Motor Finance they told me they had applied the first check but apparently they apply these payments in an almost random manner. My unpaid lease payments were at a XXXX-balance but I suddenly had a disposition fee, whereas on my original invoice it said {$0.00}, and no early termination fee, less taxes, and only about {$25.00} for excess wear and tear. The total of the new charges came out to {$440.00}, which is exactly how much I owed for the excess wear and tear in my original invoice. Instead of sanely applying the payment where it was meant to go they used a shotgun solution, not caring about consumer understanding of the line-item reductions as long as the final total was correct. \n\nAlthough the dealership was awful at handling my case, they eventually attempted to correct things. They also messed up on my DMV papers, causing me to receive a registration renewal payment notice for my old car ( which I no longer had at that point ) and delaying my new car 's registration until XXXX XXXX which meant I did n't have a properly registered vehicle, or license plates, for more than 3 months. But Hyundai Motor Finance is absolutely atrocious. They refuse to apply any kind of customer service to any situation, basically saying \" go have someone else fix the problems we created. I called Chase Bank and was told that they had the title delivered to our home ( which we had never received ) and that we were supposed to bring it to the DMV. After explaining that we had never received a title, I asked them to generate a duplicate title and was told it would be sent out in 6-8 weeks.\n\nThe duplicate title never arrived. For the last TWO YEARS, we have found ourselves in a cycle of attempting to request a duplicate title every few months - and each time, the title department treats it as if it were a new request, never acknowledging that we've repeatedly made the request before. When trying to solve this issue directly with the DMV, they informed us that Chase had sent a {$1200.00} check attached to our name, that is simply sitting there - unprocessed - because no one has any idea what it is for. \n\nI have been pulled over 3 times and have had to explain the situation to police in hopes that they would not impound my car ( as I can not afford to pay to get it out of impound ; so far, I have been lucky ). I can not guarantee that my insurance company will cover any damage or injury should I end up in an accident, as I can not register my car as required by insurance. I have attempted to get a new title generated for the car by getting an auto loan through a new bank ... but have been told that I will only be approved for a new auto loan when the registration is up to date on the vehicle. This portal screenshot also shows that Bridgecrest is actively pursuing collection on this account while I have a formal and documented title dispute outstanding. \nBridgecrest charged off the account in XX/XX/XXXX and a repossession was subsequently reported to all three major credit bureaus XXXX XXXX XXXX XXXX under my name in XX/XX/XXXX. This reporting is inaccurate and invalid, as the vehicle was never legally titled in my name. Bridgecrest collected payments from me for approximately XXXX years on a vehicle whose title was never properly transferred to me, refused to investigate or address the title defect when I raised it, refused to provide any written documentation of their position, and then penalized me with a charge-off and repossession on my credit record. The account was originally in both my wife and I 's name at the time it was taken out. You can imagine my surprise that they had let the payment get this late without reaching out to my ex-wife who was the one who had traded the car in and two never attempted to contact me on an account I did not even have access to any longer. In fact, American Honda Financial had removed my ability to even make payments on this account in their online portal and through the phone. It was the middle of winter, XXXX desperately wanted to sell a bike, and lied to me during which time about several important factors that lead to my decision to back away from the purchase. First of all, my cousin had just died, I have a fear of airplanes, and motorcycles, so in attempt to overcome obstacles I decided to learn to ride. Never got a chance to because I was so upset over this purchase. The dealer started by telling me I could change the front foot controls, to mid controls. After putting down a deposit, and leaving a post dated check I learned this was untrue, you can only put mids on the XXXX XXXX edition, and I just happened to purchase the XXXX edition. This created a concern of keeping the bike stable, and balanced while riding because I have a damaged right leg due to the result of XXXXXXXX XXXX into my XXXX XXXX XXXX while driving in XXXX County prior to this purchase. Further more, the finance manager was rude, and I complained about him seeming XXXX. They changed the person I was working with to a lady, who then unlawfully added the price of add on equipment into the bike which actually should have been paid for in cash in attempt to get more loan money from the lender. This caused me additional interest that could have been prevented if the dealership was not using deceitful tactics. I removed the funds from my bank, because I gave them about {$400.00} in cash, and a {$2800.00} check that I did not want to go through after they refused to refund my cash over the lies they told to sell the bike. They then used the XXXX district attorney office to threaten me into paying, at the time I did not realize my consumer rights were being violated due to morning the death of a family member, I came in cursing, and paid. Your officers may remember getting called upstairs about me, if you review the letter that was sent out from bad checks. The check was not bad, as you see I had all the cash that I paid at the district attorney office by reviewing your records. They used you to force me into a purchase made under duress using deception, and fraud while XXXX discriminating against me. You should also be advised the bike never started before, during, or after the purchase. I never heard the motorcycle cut on, it was a rushed process I was tricked into. They told me a new battery would be put in, before sending me upstairs to look for other items because this vehicle was on the showroom sells floor and would not fully cut on, only the lights would turn on. When parts told me that the salesman gave me the wrong information I got upset which started the chain of events causing me to not want to finish the purchase, until your office sent a letter threatening me of a felony if I didn't follow through on a bad deal after being discriminated against. They had trucks outside in the parking lot with confederate flags that belonged to the employees. To make things worst after I tried backing out, but they would not allow me, the general manager signed a paper stating he would buy the bike back if I didn't drop it. The bike didn't run to be dropped, I called the buy back manager before the date of XX/XX/XXXX, and only kept getting told he was out in the warehouse, would call back later. When I did reach XXXX XXXX he told me he would look into the matter, but never followed back up, ignoring all calls, voicemails afterwards trying to not take the bike back at the price promised by the date. Which now has lead to them trying to buy bike for cheaper amount even through motorcycle has never been rode. The miles on the paperwork did not match mileage on bike, dealer attempted to type lower amount on title then what they delivered it with which is tampering with odometer. After dealer forced me into purchase I was so angry I didn't go back to location, because I was afraid XXXX PD would be called if I started disturbing the peace, so I called telling them to deliver what I paid for. When they did bring the bike it did not have oil, and it did not start. I have XXXX, I was so stressed out, I got XXXX, and just left it parked in my daughters, mothers garage because I had no clue what else to do. I made 2 payments because I was worried about my credit, tried calling HDFS to explain the situation, they never followed back up so I ceased payments. After telling the financial company my concerns about the bike being tampered with, delivered damaged ( non-running ), and the deception their response was to sell the account off to XXXX XXXX XXXX who should be called Con artists for attempting to illegally collect an invalid debt that should've been voided in the first place if it wasn't for the XXXX check department forcing me to pay after I was lied to which is not right! We had caught up on the payments when my wife contacted Ally after the hurricane that we experienced here in XXXX in XX/XX/XXXX,  and the vehicle payments were placed at the end of the loan. We then set up autopayments once the bankruptcy was started. Once the bankruptcy was formally acknowledged by the courts and the meeting of creditors took place, the online account for the auto loan was shut down. There was no communication with me directly from Ally regarding payments, where to direct payments if online payments were not being processed as arranged by us to make sure that the car payment continued. THE ONLY information I received was a copy of the claim that Ally made to the courts regarding the vehicle. There was no letter, documentation or instructions related to how I, the primary account holder and NOT included in the bankruptcy should make payments or advised the online auto payment account had been cancelled. Because the claim was filed with the courts, no one at Ally would discuss with me because they made the claim in the court. According to the claim, the only monies that the account was behind was the late charges previously mentioned, but showed the account current otherwise with payments. \n\nBased on the complaint response to my wife 's contact with the company, and after discussion with a rather rude, arrogant young lady in the bankruptcy department, there are some factual discrepancies First the letter referred to is from XX/XX/XXXX. Which was after the hurricane in Florida in XX/XX/XXXX, my wife called rectified the payment situation, and we have a claim in the courts showing that the payments, other than opposed late fees were due at the time of my wife filing bankruptcy in XX/XX/XXXX. \n\nThe second complaint I have is that the bank did NOT EVER reach out to me personally to rectify payments. They state that they contacted me x 2, however, the calls were not received by the number listed on our account. There was no notification by mail, email on file, or certified letter advising me of the issues with the account. There were no attempts to rectify this situation with me EVER prior to the tow truck showing up in our driveway on XX/XX/XXXX at XXXX, it was repossessed in my name. Per the rude individual that my wife had spoken to, the bank was notified by the courts that the stay was lifted on XX/XX/XXXX and that it wasn't her problem that we had the car repossessed without a conversation with me regarding a resolution. \n\nDue to the fact that they repossessed the vehicle in my name, I am the primary account holder, not involved or named in the bankruptcy, the fact that they made no attempts to educate, instruct or contact me regarding continuing payments because they cancelled the online auto pay I want the company to retro the payments to the back of the loan, and allow us to take the vehicle back. Because of the financial hardship and danger that this put our family in because of the lack of a vehicle and having an XXXX  and XXXX XXXX XXXX in the house that limited our access to them if emergency situations would occur and the fact that we have had to rent a weekly because of the slow response of the bank to my wife 's complaint, because they chose to place the repossession on my credit file before there was even a consideration of rectifying the situation, and because they knew my wife had a bankruptcy on file, the fact of trying to purchase, or lease a vehicle is out of the question. \n\nI am requesting that the company retro the payments due to the back of the loan, this would not harm them, this would only make them more money based on the interest rate of the loan, and you can not tell me that there has not been exceptions made previously by this bank. Just send them your payments. WELL, its really Not that simple. First of all, WPM is a Collection Agency. Does anyone know what that really means? All of the accounts are in Collections! Why is that ok? Collection Agencies handle accounts that are delinquent and the original creditor has made all attempts for customers to pay, unavailable and unsuccessful. \n\nA Collection Agency on your credit can cause your credit score to plummet by XXXX XXXX. A Collection Agency on your credit can cause people to Not be hired or Lose a Current Job. A Collection Agency on your credit can prevent a home purchase. Why should the people that were doing business with XXXX  have to suffer because they decided to shut the business down? Not only is the Collection Agency issue a problem, but what do they do about warranty issues. WPM has made it clear that they will Not honor any warranty. There are people with their vehicles STUCK in the shop because they were never paid for repairs. They have also told individuals that the term of their car notes is 136 months! Do you know how many Years 136 months is? XXXX Would you pay a car note that long? Another issue is most didnt even know they were leasing their vehicle until all of this happened. Others found out after they paid their deposits. These are people that werent able to get a car loan, and now theyre APPROVED! The excitement about having a nice vehicle with an affordable down payment blinded most of us. Nothing about XXXX said Lease. They were the King of Credit. It was a Buy Here Pay Here Car Lot. What about that says Lease? \n\nI dont know of a vehicle from them worth more than {$15000.00} and to own it will cost at least {$30000.00}. With a lease certain terms that were available. You could turn it in and walk away. You could trade it in for another vehicle. You could make a balloon payment and then begin a purchase. These options werent even known by many of the customers, but now None of those options are available anymore. Theres nowhere to return the vehicle. WPM says they only collect on the debt and even if you return the car, youll still have to pay for it! There are people with a car and No Paperwork. They have Nothing saying they even have a vehicle from XXXX. Nothing! They cant even register the vehicle! WPM doesnt have anything on them! They just have a vehicle they cant do anything with, not even operate legally! Just pay yall say. There's not even a guarantee that WPM even had the titles. Have you even looked at the reviews? Horrible! People are waiting for titles long after paying for their vehicles. I know of someone that had their vehicle totaled and cant do anything with the check from the insurance company because XXXX is on it and WPM doesnt have her account! Now she has No vehicle and a check that might as well be a piece of blank paper. Just pay the yall say! \n\nWPM says they dont need to issue any new contracts because theyre honoring the original contract. How is that when theyve canceled the warranty, changed the terms of the payments, removed the lease options, dont have titles, and dont even have everyones account! Just pay yall say. Would you pay? We Demand to be heard! \n\nWPM has made hard inquiries on peoples credit without any consent! They have automatically deducted payments on bank accounts without permission! They harass people by calling several times a day from different numbers! They dont care about how they speak to people! They even hang up or yell over people. People have cars in other peoples name that they didnt know about. People have vehicles with VINs different than their paperwork. People have accident reports on their insurance since theyve had the vehicles that they did didnt make or know about. Pay them YALL say! WPM is a debt collection agency and most of the people werent even delinquent! Tell us again that we should just shut up and pay. \n\nPeople are scared. People are stressed to the max. Why pay again? Because they bought the information? What about XXXX filing bankruptcy followed by XXXX XXXX XXXX Are our vehicles part of the bankruptcy? Are they listed as assets? Should ANYONE be collecting while the bankruptcy is in process? Who do we have in our corner? Who cares about us? \n\nThey had over 40 dealerships in 10 states! I then asked if they would fix the alarm and call me when it was ready, and I would come back to pick up the car. He told me that I had to take the car right then or the sale was off. He did say that Carvana would fi the car at no cost to me. Reluctantly I agreed and left with the vehicle. \nCarvanas partner company, XXXX, reached out to me with three shops. Two of the shops, both XXXX XXXX XXXX XXXX ( different locations ) did not answer the phone, so I went with the third shop, XXXX XXXX XXXX XXXX XXXX. This shop was 40 miles away from my location in XXXX XXXXXXXX, MO, so the owner, XXXX XXXX, agreed to meet me so she could look at the vehicle. \nXX/XX/XXXX Met with XXXX XXXX from XXXX XXXX XXXX XXXX XXXXXXXX. She determined that the problem was that the lift gate was not aligned properly. She said she would sent the estimate to XXXX and then she would call me to let me know when she could fit me into the shop. She said it would probably only take a couple of hours. \nXX/XX/XXXX Finally heard back from XXXX XXXX. She apologized for not calling me back sooner and said I was on her to-do-list. \nXX/XX/XXXX Contacted XXXX XXXX reminding her that I was moving to Washington state the next week and that I absolutely needed to get the car in that week. Never heard from her again. \nXX/XX/XXXX Took the vehicle to XXXX XXXX in XXXX, Kansas. They determined that the rear hatch just needed to be replaced. They estimated that it would cost {$500.00} and in a couple of hours, the car would be repaired. I agreed. After 6 hours, they still did not know what was wrong with the car. It was not the hatch. I paid {$450.00} out of pocket for diagnostics. Went to Carvana. They told me that Carvana would pay to get the car fixed at XXXX, even though it is not an authorized repair facility. \nXX/XX/XXXX Dropped the car off at XXXX again. Rented a minivan to drive to Washington at a personal cost of {$580.00}. \nXX/XX/XXXX Paid first car payment of {$770.00} on a car I can not drive. \nXX/XX/XXXX XXXX is still attempting to diagnose the problem. They discover the car has been wrecked and repaired with non-XXXX  parts. They make a note of after-market modifications. \nXX/XX/XXXX XX/XX/XXXX Multiple calls, texts, and emails with Carvana, XXXX, and XXXX. Carvana is insisting that they need proof that the car has been wrecked. Customer care advocate, XXXX XXXX, states that he understands if the car has been previously wrecked it would hold less value than a car that had not been wrecked, however he needs proof that it has been wrecked. XXXX communicates to Carvana that the car has been wrecked. XXXX then confers with his legal team and states that it wasnt wrecked when it left their lot so I must have wrecked it and had it repaired sometime between XX/XX/XXXX and XX/XX/XXXX. A Collection Agency on your credit can cause people to Not be hired or Lose a Current Job. A Collection Agency on your credit can prevent a home purchase. Not only is the Collection Agency issue a problem, but what do they do about warranty issues. WPM has made it clear that they will Not honor any warranty. There are people with their vehicles STUCK in the shop because they were never paid for repairs. They have also told individuals that the term of their car notes is 136 months!! Do you know how many Years 136 months is?? XXXX Would you pay a car note that long? \nAnother issue is most didnt even know they were leasing their vehicle until all of this happened. Others found out after they paid their deposits. These are people that werent able to get a car loan, and now theyre APPROVED! The excitement about having a nice vehicle with an affordable down payment blinded most of us. Nothing about XXXX said Lease. They were the XXXXXXXX XXXX XXXXXXXX. It was a Buy Here Pay Here Car Lot. What about that says Lease? \nI dont know of a vehicle from them worth more than {$15000.00} and to own it will cost at least {$30000.00}. With a lease certain terms that were available. You could turn it in and walk away. You could trade it in for another vehicle. You could make a balloon payment and then begin a purchase. These options werent even known by many of the customers, but now None of those options are available anymore. Theres nowhere to return the vehicle. WPM says they only collect on the debt and even if you return the car, youll still have to pay for it!! There are people with a car and No Paperwork. They have Nothing saying they even have a vehicle from XXXX. Nothing! They cant even register the vehicle! WPM doesnt have anything on them!! They just have a vehicle they cant do anything with, not even operate legally!! Just pay yall say. \nTheres not even a guarantee that WPM even had the titles. Have you even looked at the reviews?? Then I submitted my information online and had to Answer some security questions just like the other companies except these questions I was given 4 had nothing to do with proving my identity. They asked me if normal questions about my self then came the 4 questions to prove it was me. First question was do you have a vehicle that you lease from 2014. I answered no because I do not. Then second question who do I have my loan for this vehicle with I answered none of the above. 3rd question how much is your payment each month on that vehicle One again I answered none of the above. Then I was told we cant confirm your identity. We will need more information. Thats fine with me so a few hours later My mom does her credit freeze with Equifax and attempts to prove her identity which shes lived at same residence for almost 20 yrs. I have no issues with sending more paper work to prove mine or my moms identity. So my moms gets her security questions and all the exact same about a vehicle form 2014 She of course answers the questions and same issue cant prove her identity. No problem so I call explain whats going on and the person who worked there says ok I can see the issue then asked me to verify with questions pertaining to me and I get them all correct. Then she says I cant tell you anything else until you send paperwork once again thats fine. The other 2 credit report agencies ask about my self or family things that actually pertain to me instead of some questions about a vehicle. No problem Ill send the paper work in. Heres my complaint they are one of the 3 major credit agencies and they are extremely rude very unprofessional and they have all my personal information. and millions of Americans. They played the run around game when I tried to speak to someone else she hung up on me and I just told her my entire S.S. # thats when I felt very uncomfortable.I end up talking to another employee that doesnt state that he is the supervisor like I requested.So basically same run round extremely rude. Not one out of 3 who I talked with were even close to a professional level. I honestly wish I never called but as one of major 3 credit agencies we kind of have no choice. So Then I say can we at lest get my moms credit frozen so she gets on phone says its not her vehicle either he states its a mistake and verified her credit as hes mumbling into the phone unprofessional.My mom gets off the phone and she said right away I dont feel comfortable at all with them having my SS #. My issues are that they are completely unprofessional my mom I will never call Equfax again. well just use the other credit agencies. They havent emailed either of us like the other companies did. I just feel that something needs to be done and people have no choice but to use them for credit and major financial issues. My current mortgage with XXXX XXXX XXXX began at over XXXX  XXXX, currently approximately {$820000.00} outstanding, and during the last 8 years these payments were made on time other than one month when my husband forgot to link the checking account and was about 2 weeks late ( the only negative mark on my credit profile prior to XX/XX/XXXX ).\n\nBeginning in the fall of XX/XX/XXXX through the summer of XX/XX/XXXX, I became the victim of a significant round of  identity theft incidents. I was diagnosed with XXXX in XX/XX/XXXX, in and out of the hospital, recovering from XXXX and going through a complex divorce case, and I was not aware of the fraud that was occurring until months later. I eventually discovered with the assistance of a computer forensic analyst that my computer had been hacked and my social security number and personal information was used to access my checking accounts at Wells Fargo, XXXX XXXX, XXXX XXXX XXXX and XXXX XXXX and a series of fraudulent transactions occurred on my accounts. The events harming my XXXX report included a series of events and fraudulent transactions using my bank accounts and credit cards due to extensive identity theft which has had a major detrimental impact on my banking/credit profile. \n\nMy account logins and passwords were accessed and changed, fraudulent transactions occurred, including attempted wires into and out of my accounts resulting in overdrafts and the eventual closure of these accounts and negative remarks made on my XXXX report. Each of these banks acknowledged verbally that they were suspicious that I had been a victim of fraud, but their reports to the XXXX XXXX did not clarify that I was the VICTIM of the fraud and not the one responsible for the fraudulent transactions. \n\nUpon discovering the vulnerability to my computer, the computer forensic analyst assisted in securing my computer and blocking further hacks. Immediately after blocking the hacker from accessing my computer, I began receiving a series of personal threats and extortion emails. This led me to contact the XXXX XXXX XXXX Police Department, filing an identity theft report initially, which the detective later upgraded to an investigation of Felony Threats and Extortion. I filed disputes with the banks involved, alerted the credit agencies, obtained a life lock subscription and purchased a subscription to the Wells Fargo ID Theft program. However, by the time I had learned the extent of hack, the damage was so extensive it resulted in the closure of my deposit accounts at Wells Fargo, XXXX and XXXX XXXX XXXX. I now am facing difficulties gaining access to deposit accounts, and when I have been able to open an account, twice it was closed within a few weeks after opening the account upon the bank doing a second pass review and presumably seeing the marks on my XXXX report related to the fraud that occurred. \n\nI am currently working with an attorney to rectify the damage to my credit profile and credit score due to multiple false charges on my credits and new credit cards opened in my name, but my XXXX report has been badly damaged due to the identity theft.
