Meanwhile, XXXX was indifferent to my situation and even seemed pleased when I lost my car, as coworkers followed me home. Married couples fought over the new car I had just purchased. When I regained my sight with the lenses, others panicked to hide what I had already endured. Even though I lost some battles, regaining my sight gave me more ability to defend myself, and I haven't lost the war. XXXX repossessed the car with all of my belongings in it still! \n\nYes, you can file a complaint with the Consumer Financial Protection Bureau ( CFPB ) against Covington Capital regarding the repossession of your car. The CFPB handles consumer complaints about a wide range of financial products and services, including auto loans and vehicle repossessions. My complaint is that this is a Predatory Lending Company taking advantage of myself ( a Veteran ) and many other struggling citizens by having High Excessive Fees, and Hidden Charges, that Do Not Reduce the Principal Amount of the Loan or LOC. The person I spoke to on the phone was telling me that they are exempt from abiding by the Usury Law as it pertains to the LOC. \n\n\" Usury '' is the unlawful act of charging interest on a debt ( including discount points, fees and other charges ) at a rate greater than what is permitted under any applicable law or exemption from a law. \n\nWashington State has a usury law ( RCW 19.52 ) ) that sets limits on the maximum rate of interest a lender may charge a borrower. The usury law applies to consumer loans that are not related to a credit card debt, a retail installment contract or a consumer lease. \n\nAccording to RCW 19.52.020 ( 1 ), a lender may, if agreed in writing between the lender and borrower, charge an interest rate at a maximum rate of 12 % per year. Or, a lender may charge 4 % above the first auction quote on the Federal Reserves 26-week treasury bills made in the month preceding a written agreement between lender and borrower. A lender may use whichever rate is higher - 12 % or 4 % above the Federal Reserve rate on 26-week treasury bills. \n\nBut if the borrowers make only the minimum payment each month, the interest rate quickly mounts and the debt balloons. Now loan companies use open-end lines of credit to entice people who are down on their luck to run up big, seemingly never-ending debts. And this is exactly what NETCREDIT is doing at the moment. \n\nMy credit limit was {$3200.00} and its showing much more than that which is incorrect. I get paid once a month and my payment should reflect that as which was stated when I applied for the loan. Ive sent numerous emails and spoke with many representatives and added the multiple paystubs for the past three months and this circumstance is still UNRESOLVED on your end. It was my understanding as applying for the loan I would be making one payment according to the Line of Credit Utilized ( {$3200.00} ), with a major portion of the LOC being paid going to the principal amount of the loan. Im unhappy with the lack of follow through on your companys end and no timely response to fix this mistake of a loan and how its being handled. A ) One Payment Date : End of Month ( I GET PAID ONCE A MONTH ON THE LAST DAY OF THE MONTH - as specified in my loan application ) B ) MY LINE OF CREDIT SHOULD BE {$3200.00} NOT {$3600.00}. I read through their website and their repulsively deceptive \" What Makes Us Different? '' section, where they have the audacity to bring up other predatory lenders as the bad guys. Here 's how Uprova is different : they are FAR worse than any of the others that I know. \n\nAnyway -- I only needed {$700.00} and determined that for a relatively small loan, this seemed like an okay idea -- not great and not something I was excited about, but worth it so I could make the rent as I had gotten overwhelmed with other bills lately. I figured I would get a higher-than-ideal interest rate on this loan, probably higher than the already high 35 % which they advertised in big font, BUT it couldn't be that bad. Right? After all, they said these loans were \" fair '' and they talked about how they \" really care '' about consumers who are struggling to pay medical bills and for emergencies. \n\nI started my application and went through the steps. Early on they make you give your banking info which is a red flag I didn't see until later. BUT, I assumed that I would get a chance to review a standard promissory note and loan agreement terms PRIOR to signing anything -- as is the procedure with every other loan I've ever applied for. I hadn't authorized any debits and I hadn't committed to any loan at that point. I planned to make my payments on time ( which I did for every single payment up until very recently when I did my research on Uprova ) and do my best to pay more than the minimum required each time so that I could get ahead of whatever interest would accrue and that within a few months, the loan would be paid off. \n\nWhen applying for this loan, I was on my phone. Again, Uprova repeatedly advertises \" fair, transparent rates '' and says in big font on their site that \" some '' borrowers can get rates of ~35 %. This is the legal cap in my state for any creditor to charge. I went carefully through the remaining steps, reading and checking each page, and provided the requested information. Then, the loan application stated that it had calculated my \" monthly payments '' -- WITHOUT saying anything about the life/length of the loan or how much I would be paying in total at that rate. It displayed this figure and presented it as \" affordable '' ( which -- if it was only for a few months -- would be! ) and only this figure on the screen. It encouraged me to go to the next page. I clicked thinking the next step would be to review a pdf document where I could review the APR. Standard procedure. \n\nTo my surprise, I was then told that I was done/approved and would be getting my funds shortly. Really? It was that easy? I was hoping it wasn't too good to be true, but again even my worst fears couldn't prepare me for the reality. \n\nI need to emphasize this aspect of the process because the XXXX I spoke to tried to lie/gaslight me : Nowhere was any interest rate disclosed in the application process!!! You are pulled like a rabbit to a carrot through a few steps with minimal reading to do on each part and then it is a shameless, cruel bait-and-switch. I have never had an experience like this where the true fees were literally hidden from me and I entered into an agreement without even being aware that I was doing so. I can guarantee you I did not sign the document that the website generated with my signature. They simply copy and pasted it from the application where I'd provided it but that was before they even show you the document!! Many lenders will make you check a box before you click \" next '' ( and will freeze the page before you review/scroll to the bottom of all documents ) and they'll at least have the decency to display the most critical info for you to read/review, then ask if you are sure before you agree to anything. They do this to cover their XXXX XXXX XXXX XXXX and be able to say they were transparent and upfront about their terms so no one can say they didn't know. \n\nUprova doesn't even bother with the bare minimum ethics and they have the nerve to lie to you after the fact and try to tell you \" well you must have not seen the link ; it was there. '' NO, IT WAS NOT. Read multiple other people 's complaints. So many of them say the same thing : that the way Uprova discloses the loan information is very different from other lenders, and not just deceptive but straight up dishonest/LACKIN. If the astronomical APR had been provided or visible anywhere when I was still in the process of applying, I would have absolutely clicked and reviewed it. And? I would have immediately canceled the application and retracted any of my information/closed out the window yelling \" NOPE. '' The APR makes other predatory lenders ', e.g. XXXX with some rates of 160 %, look like angels. \n\nAfter reviewing the \" payment plan '' on nearly the final step which again only tells you the dollar amount of payments and no other info, faster than I could blink, the loan was \" approved, '' the funding was on its way, and only now could I navigate in the customer portal over to see my loan documents. When I found it and opened it up, I nearly launched myself to the moon as I had no idea how this was even possible. My credit was in the mid XXXX. The loan amount was low. Yet this brand new document which was NOT accessible previously said I would have to pay almost XXXX as much as I borrowed. \n\nThis is where Uprova is probably the most vile of the lenders I've ever encountered. They make a point of saying \" competitive, fixed-term, fixed-payment installment loans '' that \" aren't payday loans. '' That they are \" flexible. '' The only thing that is flexible is their interpretation of \" fair and transparent. '' There is nothing fair about the way this company operates. There was shame in the XXXX 's voice as he was on the phone with me and was telling me I could \" settle '' and pay an additional {$500.00}, after I've already paid almost {$900.00} on a {$700.00} loan. I could hear it -- he was talking quickly in a low tone trying to tell me that the tribe has the right to charge whatever it wants as it's not subject to state laws. \n\nIn XXXX, prior to this call in XXXX with a shifty guy who somehow sleeps at night, I had called, canceled my ACH payments and disconnected my bank account. Fortunately this was simple enough to do. They continue to harass me with emails on a daily basis to \" settle '' my balance ( which, if I did, would ultimately end up being 200+ % APR ).\n\nI hope this detailed and perhaps redundant explanation of my experience with Uprova is helpful to other people who are considering a \" quick solution '' and are in desperate circumstances, or who XXXX  \" fair non-predatory loans '' and got lured in by Uprova 's calculated and strategic SEO. \n\nIt is absolutely not worth it to get an Uprova loan, even if you have fair credit and even if it's a small loan. Left a short message explaining I needed a call back immediately and that I had been attempting to reach my account manager for more than 24 hours. \n\nXX/XX/XXXXXXXX Phone call was returned by XXXX XXXX XXXX stated over the phone that XXXX XXXX was out of the office and that he was supervising XXXX XXXX XXXX emails while XXXX XXXX was away. I began explaining about the financial hardship suffered through the hurricane and stated I needed a one-time extension or different arrangement only for the payment due in XXXX ( I had missed an entire week of work, we had no power for days, and our emergency funds were depleted on gas and other supplies through the storm ). XXXX XXXX TOLD me, not asked me, that our area of XXXX was not affected at all by the storm and that the payment had already been put into the system for processing. I argued that I have not had any issue making payments up until now and that I was not asking for the payment to be waived, just extended, so I could feed my son and keep gas in my car to go to work. I was harassed by XXXX XXXX stating that I had already agreed to make these payments and that {$XXXX} was \" not a big deal '' and \" you should be able to do just fine without {$XXXX} '', also had comments made to me like \" my grandma lives in XXXX and she was perfectly fine ... your area was n't hit at all by the storm or affected at all '' ( we had record flooding, some areas are still working on getting power back, and those of us who work contract jobs had no way to even earn money while offices were closed and we were trapped by the water ). When I expressed concern about my ability to make a balloon payment in such a short space of time, I was advised the loan would be converted to a 30 year/not to worry/cross that bridge, etc. \n\nIn early XXXX, I reached out and was initially offered a deferment, although, at that point, my loan was current. I don't recall the name, but I did receive a call/had conversations on XX/XX/XXXX with a gentleman who identified himself as my personal \" account specialist ''. The conversation we had was very difficult to understand ( he sounded like he was underwater ) and I never heard from him again. He told me I was no longer eligible for forbearance and something of something that \" my situation had changed ''. I received no further communications of any sort about this. \n\nIn XXXX I contacted Chase ( I believe mortgage forbearance, again ) and was cheerfully informed to not worry, I was eligible for a deferment and would I like to accept it? I agreed, it was a two month deferment. \n\nOn XX/XX/XXXX ( I know because I had a handyman over, have pictures of the new door uploaded on my phone ), I received a notice my account was now 5 months past due, I must pay the entire past due amount immediately or I would be foreclosed on. I called the number on the notice. The very nice and helpful lady who answered immediately told me I was \" eligible for a deferment and that would bring my account current, would I like to take that? \". I did, but I again made a point of discussing that my account should not BE approaching foreclosure, because it was, at most 60 days past due. \n\nI believe this was essentially ignored/brushed aside and I was told to not concern myself about this. \n\nOn XX/XX/XXXX ( I'm basing this on my payday -- -so I attempted to make a payment when my mortgage was either 60 days late, not the 150 days you continued to claim ), I submitted an online payment for half my mortgage payment. It was rejected. I inquired as to why and a copy of your \" good-bye letter '' was sent to me electronically. IT specifically states \" nothing will change about my account except for who I remit my payments to ''. I also called customer service about it, multiple times and was assured there would be a 60 day freeze of any negative activity and, since I was ( once again ) eligible for a deferment, that would be honored. \n\nI immediately began seeking to communicate with XXXX and was in later Approved for a trial payment plan/loan modification, even though the account would have been still frozen. I made my first trial payment to XXXX on or before XX/XX/XXXX, because it posted on that date. I would later be informed it \" doesn't count '' because it was made before the 60 day freeze was over ( or some such ). \n\nI decided during this time frame, while I had been treated unfairly, I would move forward because the modification would allow me to resume payments and pay off my loan, the only thing I had ever wanted to do. \n\nIn a conversation with my Single Point of Contact/Loss Mitigation XXXX, XXXX XXXX XXXX XXXX also included, so she and Shellpoint XXXX XXXX made aware of this, as I have requested, I was informed a Quit Claim Deed would be needed to proceed with the loan modification, once my trial payments were concluded successfully. \n\nI had not heard of this, was under the impression the property merely awarded to me is sufficient, but this is not the case. I was further informed in multiple, subsequent conversations with other XXXX representatives, XXXX would likely proceed with foreclosure if I did not obtain a Quit Claim Deed, which my ex refuses to sign. \n\nIn one of these conversations ( I had always planned on making much larger payments, anyway, as again, my only wish was to pay off my loan and live in my house ), I inquired about other options. I was informed even if I was deferment eligible, XXXX must have that in writing and they considered that to then be due immediately and upfront. Further more, because the last payment made ( ignoring the unapplied trial payments ) and they also ignored the Covid Mortgage protection, they considered my loan to be a full year past due and I must make 12 payments ( nearly the entire loan, in fact ) upfront. If I wanted to make a \" mere '' 3 upfront payments, I needed to prove, in writing, it was only 90 days past due when it came to them. Honestly, even {$4300.00} would be a struggle for me, but I'd certainly seek to find a way. \n\nWith this information, I reached out to Chase customer service to give me documents that supported my assertions. Each secure message grew progressively rude, dismissive and snotty. And failed to give me the information I had requested. The second such communication was so obnoxious, I realized this action has been illegal, advised I'd be pursuing legal action and submitting regulatory complaints unless I was satisfied. My complaint was escalated to XXXX XXXX ( not sure of the spelling ). I was assured of a reply within in 3 business days. \n\nI also began some cursory internet research and uncovered a variety of lawsuits and actions against Chase that are remarkably similar to my situation, indicating precedent and an ongoing pattern dating back over a decade. \n\nI called the line I was given for Mortgage Escalations ( XXXX ) daily : Thursday XX/XX/XXXX, Friday XX/XX/XXXX and Monday XXXX. I was assured \" an email was being sent '' to XXXX about this and he would call me as soon as he \" had completed his investigation ''. When I called Monday, I was first brushed off similarly, then the associate noticed a not had been left, again, brushing and dismissing my concerns. No one bothered to call and inquire as to specifics, nor did anybody seem concerned about my issue or my continued assurances of my intent to pursue legal action. \n\nI immediately demanded a supervisor and/or the Executive Office . The associate repeatedly tried to talk me out of this insisting, 'this is something we do all the time ''. Yes, I am fully aware you are legally entitled to sell my loan at any time, for any reason or no reason. You are NOT entitled to make verbal contracts with me, breach them and not inform me.
