Something came back, probably my Tax Lien as I have a current payment plan with the IRS, so the loan was denied. I had a loan from the company that was taken out in XX/XX/XXXX to cover an increased insurance premium from a car accident my XXXX daughter who had just gotten her license in XX/XX/XXXX incurred. My insurance provider XXXX XXXX contacted me letting me know the premium would increase by {$2000.00} and then monthly payments would go from {$330.00} to {$620.00}.\n\nWith no other options or savings I went to Speedy Cash to cover the amount because my insurance is set to automatic payments. I worked with XXXX to make arrangements and was able to lower the amount to {$1400.00} with additional discounts. \n\nI originally expected to pay off the loan immediately but inadvertently ran into a number of financial issues ( no child support received, work bonus not granted ). \n\nAs a result the loan was extended out much longer than I anticipated. I was upset but had no choice and continued making the outrageous interest payments of {$400.00} bi-weekly estimating to {$800.00} per month just for the interest and then having problems paying the loan off and hence affecting my personal budget. \n\nI contacted Speedy Cash on a couple of instances in the fall and let them know my situation. I asked if there was a program or allowance where since I had already paid back so much interest that I could pay just the principal. I had done this years ago with another lender where if you had financial problems you could request and they then took the full amount of the loan and broke it down into 4-6 payments so that you could pay it off. You could only use the option once per year. Speedy Cash informed me that they had no such options to assist me and stated if you were having problems paying back the loan the only thing I could do was make the payment or they could help by pushing the date out a few days to a week. I asked what if I didnt have the money in my account and she said they would only work with you if the account bounced or payment returned. I told her I didnt want to bounce a check or have ISF fees I simply wanted to make arrangements with them to pay off the loan with limited interest as I had gotten over my head with the debt and needed to find a way out as I had been paying the {$800.00} payment over 6 months. \n\nI realized in XX/XX/XXXX that my XXXX XXXX debit card was set to expire in XX/XX/XXXX. Speedy Cash sent me multiple emails and phone calls asking me to update the card last email was XX/XX/XXXX. \n\n\n\nI chose not to update the card in hopes that it would be declined since they had no active card and hence I could start the process to request assistance from Speedy Cash in paying off the debt. \n\nTypically Speedy Cash will send emails in regards to your payment being due and also call you with reminders. I received none of those calls in XX/XX/XXXX. On XX/XX/XXXX Speedy Cash charged my XXXX XXXX account with the full amount due of {$2500.00}. This transaction was done without my knowledge or authorization. I had no idea the payment had been submitted until a few days later when I got a notice from XXXX about insufficient funds and then an email from Speedy saying thank you for your payment. \n\n\n\nNeedless to say I was beyond upset. As a result of their actions : I was charged {$320.00} in ISF fees and the action affected multiple payments that I had scheduled Money I had slated to go to XXXX XXXX XXXX XXXX was not there and hence I was charged ISF fees from their credit union on my checking account My credit card payment from XXXX, XXXX and another card was then denied and then they as well charged me a {$39.00} fee for each card and transaction. \nMy rent payment could not be made and I had to contact my landlord and was stressed about being put out of my home. \n\nAs a result of their actions my credit score and history are now negatively affected because Im showing 3 missed payments when in the past I had 0 missed payments. \n\nIt also greatly affected my health and I had XXXX XXXX XXXX in the span of 2 weeks. My account was overdrawn by approximately {$1800.00} for two weeks and of course when I got paid I was still behind due to the negative amount. I have had to drastically alter my life and was unable to buy essentials. \n\nI have had issues with Speedy Cash in the past where they inadvertently charged the wrong bank card on my account. At that time it was brought to their attention and they did nothing. Sometime later after they were sued they reached out to me and requested that I send the documentation for the ISF fees and sent me a check but it was almost a year later. While I understand businesses have issues their problems seem systemic. \n\nAs a consumer and single parent with middle-class income I would like to be compensated for duress, anxiety and financial mess that they created. I also want some sort of consumer protection against being taking advantage of. I understand that I chose the loan but the interest rates are beyond unacceptable. Payments are automatically ( required ) to be taken out on your paydays per their stipulations. My pay days were every other Tuesday, so they debited the XXXX dollars out of my account every other Tuesday. The problems started when I changed jobs. With the new job, my pay days are every other Friday instead of Tuesday. They kept taking my money out of my account every other Tuesday like those were still my pay days, which caused my account to be over drawn twice. I called them and told them this. They said they would make the changes in my account of my new pay days so the payments would go through on the correct days. The changes did n't happen and my account was overdrawn again. I called them again and told them this, which because of all this caused me to be behind XXXX payments to them because they were drawing the money out on the wrong days. I called them and told them the problem yet again. Spoke to two different representatives and set up a payment arrangement to be taken out of my account to catch me up the following Friday. The following day another major problem happened. I called again to ask another question about my account and when I verified my information ( my name and ssn ) they said that the info I gave them did n't match what was on file. ( mind you I had just spoken with and verified my information with two different customer service reps the day before ). Frustrated, I was told I had to call one of the local Speedycash stores and give them my information again and the customer service rep at the store had to the call customer service center and give them my information. This did n't make sense to have that level of incompetency happen that fast with my personal information. The day of this writing, XXXX dollars was taken which caused my account to be overdrawn again and the same amount was tried last Friday, which caused me to be late on my car payment. The only thing I am left to do is to change the account # on my account information that they have so they wont be able to just go in my account Something needs to be down about this company and their shady business practices. They have lied to me when I have called and asked about how and when my payments go though my account, saying that its all up to a computer system and that they have no control over it. I was even told that payment arrangements are n't always honored because of this so called system. They asked for a copy of the loan docs, a payment ledger and my bank statements to show all complied with NYS lending laws and that XXXX were a legitimate loan management firm ( not a payday or predatory lender ). Upon initiating this process, I found that XXXX had sold my account to SST without notification. Furthermore, XXXX was negligent in their reporting- supplying false numbers to credit agencies as well as incorrect balances and dates on their website. They had the cash loan amount as {$7000.00}, payments were listed as only {$130.00} per month and entire payments were missing not reflecting my perfect payment history or paydown of the debt balance. As of XX/XX/XXXX, the portal showed that I had made payments of {$3500.00} but payoff would be an additional {$5500.00}. None of the numbers added up to my bank records or credit reports. When I got home from work, I immediately accessed my credit report and noted that a hard inquiry by XXXX XXXX XXXX had been completed. I had not sought out the services of XXXX XXXX XXXX nor authorized XXXX XXXX XXXX to perform any inquiry. I immediately called XXXX XXXX XXXX and notified them of possible identity theft and fraudulent activity. They stated that it was an \" online '' loan application. I then stated that it definitely was not me and I was provided a customer service reference number by XXXX XXXX XXXX. I then began the process of placing security freezes and fraud alerts with XXXX, XXXX, and XXXX. When reviewing my credit reports I saw an unauthorized inquiry by FactorTrust, Incorporated. I did not recognize that company so looked it up on the internet and found that they are an \" alternative credit bureau '' that is used by XXXX XXXX XXXX. I was unable to talk to a customer service representative at FactorTrust that evening because their hours of operation are from XXXX XXXX to XXXX XXXX Eastern Time. So, I attempted to access THAT credit report to place a security freeze and I was unable to successfully \" verify my identity '' by the questions posed ( I now know that they have created a credit report on me FULL of inaccuracies and will explain further. ) As I was unable to answer the verification questions ( which I have been able to do for over 30+ years with no problems with all other agencies ) I called their customer service number on XX/XX/2020 to notify them that XXXX XXXX XXXX was not authorized to do a credit inquiry and to place a fraud alert and security freeze on the credit report. The representative I spoke with did note that I had had difficulty signing on because of the \" failures '' on the security questions. Once I satisfactorily answered questions to verify my identity with the agent, I was provided a fax number and provided directions on placing a security freeze. I filled out a form and faxed it with supporting identification on XX/XX/2020. I have YET to receive confirmation on the security freeze as of XX/XX/2020. As I was able to finally see the \" credit report '' generated by FactorTrust ( once the agent assisted me ) I noticed multiple inaccuracies and items on the report that are not part of credit reports. First off, the report generated by FactorTrust , Inc. was done on XX/XX/2020 ... they have nothing prior to XX/XX/2020. Secondly, it had information included on the credit report that is not on the \" big '' three namely, a bank routing and account number and a loan number for XXXX XXXX XXXX with the amount of the \" payday '' loan ( yes, it said the type of loan it was ). In addition, it had my so-called salary and my so-called payroll frequency ( both incorrect ). With this information, I looked up the routing number and called the bank ( not a bank nor branch available in my state so obviously not mine ) and I notified that bank that my name, DOB, and SSN was used to obtain a loan fraudulently and that their bank is listed on my credit report. Their customer service department took the information on the evening of the 7th and said that they were forwarding it to their fraud department. I spent hours on the 7th and 8th trying to reach \" real '' people in various agencies/companies desperate to make sure the thief 's damage was contained. On XX/XX/2020 I filed an Identity Theft Report with the Federal Trade Commission naming XXXX XXXX XXXX and FactorTrust, Incorporated as unauthorized users of my personal information. Copies of the the FTC Identity Theft Report were provided XXXX XXXX XXXX and to all credit reporting agencies including FactorTrust, Incorporated, and disputes filed to have the inquiries removed. After filing the report and reading my rights under the Fair Credit Reporting Act I contacted the bank that was listed on my FactorTrust, Incorporated credit report to ask what information I needed to provide to them to obtain copies of the application someone used to open the bank account using my information. It was at this point that I learned that the bank account was not associated with my name and SSN. I explained that FactorTrust, Inc. has it associated with my personal identifying information and the bank stated that the information must have come from the XXXX XXXX XXXX loan application. In truth, FactorTrust, Inc. generated an inaccurate, falsified Consumer Disclosure Credit Report about ME using information from an ONLINE PAYDAY LOAN application. On XX/XX/2020 I mailed a letter to FactorTrust, Incorporated requesting that they A ) delete and block XXXX XXXX XXXX from my credit report, and B ) that they delete and remove my entire consumer report file that they generated as the result of identity theft and fraud. On XX/XX/2020, I faxed a duplicate request to FactorTrust Incorporated along with the FTC Identity Theft Report. To date, FactorTrust, Inc. has still not notified me of my requested security freeze status. To date, FactorTrust Inc. is the only credit reporting agency that has not removed the fraudulent inquiry and information. To date, the only correspondence I have received from them is an email in response to my disputes about the false information and the XXXX XXXX XXXX inquiry. They stated there is no credit inquiry activity unless I am applying and they claim they're not pulling credit inquiries ( which is not true, obviously, see below ). I asked them when my last application was and they state it was over 5 years ago ( as expected ). \n\nThey ( or their partners/associates ) are pulling reports 5+ times a year and they claim they are not. \n\nPROBLEM 2 : After being forced to assume there is an automated process involved that customer service supervisors are not aware of, I also asked them to cease all pre-approval efforts and I asked them to opt-out my name/email/phone numbers/addresses from all pre-approval efforts. For the record, I am opted out in my credit file for 5 years already, as well. Their response was that I am not in any opted in database but they marked me down anyway for removal after I pressed them and referred them to their own website and privacy and sharing to third party associates/partners policies which state I have the right to opt-out from. \n\nI spoke with 3 people, XXXX via chat, XXXX ( spelling ) via phone, and another person ( male, who transfered me to XXXX the supervisor via phone ). I also emailed customer XXXX regarding this matter and included the below information and request to cease all credit inquiry activities. I never agreed to repeated credit inquiries and I have not authorized any recent inquiries nor do I need their services. \n\nI can only assume either this is fraud, unlawful/unauthorized use of my personal credit file, and/or they are inept and do not know their own processes. Either way, I've asked them to cease all activity, but I do not believe they have done anything nor will they do anything to correct this issue based on the discussions I've had with them. When I initially took out the loan, it was supposed to be set up on those days anyway, and I wanted to make sure they would get paid without worrying about an EFT being refused. I received email verification, and was told in the email the next pay due date would be XX/XX/XXXX, but it could take a few days to process, so I may still see a charge on the next due date, which would have been XX/XX/XXXX. When no charge came out on XX/XX/XXXX, I went by what the email said, that the next payment taken would be XX/XX/XXXX. On XX/XX/XXXX, the lender took two EFTs from my account. I wrote an email inquiring about the error, and informing them it caused my bank to charge me two overdraft fees. They replied with an apology and a promise to refund the payments and the fees. On XX/XX/XXXX, I did receive one of the amounts back, but not the other, and not the fees. I wrote another email asking why I didn't get the other charge and fees back yet, and was wondering if they were just keeping it in lieu of the payment for the XXXX. I didn't receive a response back immediately, but the following Monday I received an email saying that they were unable to process my payment on XX/XX/XXXX, and it was past due. It was for an amount larger than I had previously been paying. I've tried emailing, calling, and chatting, and I do still have all of the emails, including the one they admitted fault and asked why the bill was larger, and why I never received the other funds. The calls were pointless because the customer service people forwarded me to collections after I explained what happened, and then collections routed me back to customer service after I explained it to them, and didn't even give me a chance to tell them that customer service had sent me to them. I waited for about five minutes and there was not even any hold music, so I think the transfer either didn't go through, or they were just trying to get me to hang up. I tried the online chat feature on their website and got passed around a little too, but the last person I chatted with said she had escalated the problem to a manager and I would hear something back soon. A couple of days ago I finally got the fees back, but not before my bank charged an additional overdraft fee that wouldn't have happened if they hadn't made the error in the first place. They sent an email to me yesterday saying that they are going to forgive the amount they already refunded me, and that I was still overdue for the larger amount they failed to take on the XXXX. I replied that didn't make any sense to me, as they had admitted it was their mistake, not mine, when the two payments came out on the XXXX, and that I was not satisfied with their solution, since I've incurred another fee, and they still haven't explained why the bill went up. I've since closed that bank account and opened a new one with the same bank to avoid them being able to take anything else out. In my communications with them I opted out of the EFT payment method, but didn't have confidence that they would not try anyway. I've been searching for a lawyer, and have reported them to the XXXX and Tennessee Consumer Affairs. I asked them almost a week ago in an email to stop calling my work number, and the next day I received two calls from them at work. I sent another email that evening providing them my work number in case they weren't aware which number was which, and they could feel free to call my cell number and leave a message if I didn't answer. After that email, I've received two phone calls from them at work, and a few missed calls on my cell phone. I leave the ringer on silent while at work, and don't answer personal calls unless I'm on my lunch break. By the end of the day it can be XXXX or XXXX XXXX depending on schedules when im to shut down by federal law for 10 hours before my time resets for XXXX XXXX. I am not going to throw my job or customer to the curb for any measly little business on the side, certainly not this one or any other. \n\nCAR REPAIRS STARTED 2 MOS AFTER PURCHASE : Within 2 months of having this vehicle, I had to replace the alternator which i was charged for by the dealership which was supposed to be covered under warranty, XXXX 6 months later after that I had to buy a brand new battery because the car was dead.. \nwhich is covered for a year by the manufacturer, my company ordered the battery for me which is deducted out of my paycheck, however within 8 months I needed another battery because that one died. \n\nNow mind you, i am paying this loan joke XXXX every month on time as said in contract, however the car began giving me engine problems, not to forget the fact, when this car was bought it had a fuel hose throat problem, you couldn't fill the car like you would normally, which usually takes 15 minutes to fill up a car depending on pump speed which is usually pretty quick, it would take me 30 minutes because the fuel would begin to pump but cut off midstream, i had to wait 5 minutes each time before beginning to pump again. This is what the dealership sold me was a complete lemon of problems, then the heater coils i found out were bad, couldn't defrost the windows, no heat would come out, AC worked great that's it, so to get the coils fixed and the fuel issue fixed that ran me approx XXXX that was in XXXX, then the engine went, some valve or gasket blew, another XXXX approx, all out of pocket expense while still paying credit acceptance XXXX each month, XXXX rolls around, now i have a window button problem for the drivers side, and the air in one of the tires is leaking, dont know which one as well as some fuel cap warning coming up on the dash board. Back in shop it goes, another XXXX bucks out of pocket, except for the tire leakage. XXXX XXXX would of charged me a XXXX allot more using the excuse my warranty wouldn't cover these things, so i went to another recommended mechanic who even though was pricey but fair, they did the job right the first time! The only regret I had was the dealership never bothered to really check this used car before putting it on the lot to sell, they just bought it from another sales place and went with what ever info of ownership was on the paper work, the car isnt even worth XXXX period, these cars or suvs value when they were in manufacturing roughly under XXXX, XXXX / XXXX stopped making them due to the recalls of problems people had with them, various different issues. \n\nNow here comes battery number 3 just 1 month over the year warranty of the other 2 and i had too buy another new battery. \n\nBy this time, According to Credit Acceptance, my balance from XXXX grand is now XXXX, XXXX pay off, but heres where it gets down right XXXX ... \nEach time i had to call these people for an adjustment over the phone from their reps they claimed are so highly trained properly ( cough ) i was met with ignorance, XXXX and XXXX behavior enough to get me to begin screaming at them as they wasted my time, I dont know how many times i have told this joke of a place, I dont have time to call you when you snap your fingers asking me to jump buildings at your demands, nor do i have to explain to you my personal routines so you can come up with ideas to XXXX me over cause you got a issue you dont make good money where you work, that's not my XXXX problem! \nThey have a website where you can schedule a payment ahead of time which i have used many times because i cant call this payment in every XXXX day of each month, so i make arrangements for it to be scheduled for these dates or earlier, course this loan place will drag its feet collecting the funds tying me up to move forward to pay other bills. \n\nWell the killer of this was over the XXXX weekend ... I knew my schedules with work were going to be pushed as the holidays were rolling in so was high demands of getting XXXX and such XXXX, I was going to be too busy to be bothered making calls, and it being the holidays most places would be closed. I get paid every Thursday per week, I made an arrangement on their site to pay this time XXXX on the XXXX of XXXX, however our pay period let us know we would be getting paid a day early. So Since i was at a customer on XX/XX/XXXX, and had to make a fast call to CA asking them if they could cancel the XXXX schedule and use the XXXX schedule to make the payment as the banks would be closed etc, i was met with a XXXX lazy rep who had nerve to tell me, you can do this yourself online! Oh that did it! I hit the roof, again here i am explaining to another XXXX i dont have the time to change anything online, that is why i am calling, can you just cancel the XXXX scheduled XXXX and use it for the XXXX? how hard is it to grasp this? She said fine, or so i thought it was fine, I proceeded to make the XXXX payment, paid their XXXX merchant fees of paymentaus, and ended the call. 2 hours later i checked my bank and saw i had roughly XXXX around there left in balance after the car payment went through, so i took the opportunity to pay some other bills in advance to avoid late fees etc, and calculated it down to a T, leaving me enough to use while over XXXX XXXX til next payday. \n\nCOVID 19 EXCUSES This pandemic i know has made it hard to many to work, some dont have any work others are forced to work from home, credit acceptance is one of those who have their reps work from home. I have heard the excuse due to this covid 19, people make mistakes, XXXX! Thats as lame as a student telling the teacher the dog ate their homework. \n\nWell here comes the XXXX, and i check my bank account, and to my horror i am now negative XXXX! I am like what the XXXX happened? The transactions didnt begin coming through til later that day around XXXX XXXX, thats when i noticed the first XXXX to Credit acceptance was pending long with others that were minor and i was puzzled, in the next hour more transactions pending began to appear, and bamn there it was, the rep didnt bother to cancel the XXXX payment and it too was pending i was hitting the roof, i went into my stock account immediately and liquidated all my stock trying to come up with the funds to transfer into my account to cover the negative before my bank would hit me with NFS fees of XXXX a pop, but found i couldn't transfer anything cause it was a newly bought stock and needed tme to accumulate, so this now put me in probation mode for 30 days meaning i couldn't touch anything for 3 months! Thats when i really hit the roof! \n\nXX/XX/XXXX, - my balance in my bank is now negative XXXX! so I called my bank and filed a dispute to have that loan company reverse the charges and then i called the loan place and chewed out another rep and told her, if that money isnt reversed within 24 hours im reporting this as theft! she told me i could of left the scheduled payment as is and the money would of been retrieved the next working business day, and i told her how in the XXXX am i to know that? and what makes you people think i can jump on a computer and cancel when XXXX XXXX an XXXX XXXX all day long? its time consuming and now you people have put me in a XXXX of a situation. I cant have this, since XXXX i have been haggled by you people trying to make adjustments i have tried to be pleasant only to end up screaming at you all because you ask all these XXXX questions like im in some XXXX deposition for court! I dont have time to be held up while you all sit on your butts doing nothing at home blaming covid 19 for your hangups! GET REAL! \n\nAS of TODAY XX/XX/XXXX, i am now negative XXXX! \nThe repairs on this car shouldn't of had to happen, the cost of this car over its value was a sham, and now im dealing with amateurs who shouldn't be running this frat at all. I reported it to the Michigan XXXX where this company apparently is based out of, and told them I am killing the contract, i dont want the car,, i dont need to do business with XXXX, i will be contacting the creditor bureaus explaining the deflect of my decision cause i know just like with XXXX XXXX, these people are going to throw a coniption fit and spew allot of negative remarks on my credit report. Frankly i dont give a XXXX because i am just going to save up all i can and buy my next car BRAND NEW STRAIGHT OUT so i dont have to deal with loan sharks anymore. \n\nSo if you CPFB feel this poor babies are being bullied by me in such a hateful manner after the sham they just pulled, how about i contact XXXX XXXX investigation report and have them air it online? This was a long and arduous process including much therapy and 2 more surgeries. During this time the increased care for my son and inability for my wife to contribute financially put strain on the household. \n\nOver the following year we continued to make the monthly payments on our mortgage. Due to our finances being stretched, due dates of bills, and the dates of my paydays, we were usually late on our payments, but they were always made ( until XX/XX/XXXX ). \n\nAround XXXX of XXXX we began receiving \" offers '' for a \"XX/XX/XXXXStreamlined Refi '' from a company named XXXX XXXX XXXX XXXX ( XX/XX/XXXX. Since we were running late on our mortgage payments, we had considered it. A \" lower interest rate and lower monthly payment '' sounded good. XXXX contacted us regularly, at least once a month, to attempt to convince us to choose them to refinance our loan. We never considered that they may not have been operating toward our best interests. \n\nAs I previously mentioned, we made our monthly payments on our mortgage. We were contacted each month when the payment was due, and PRMI was aware of the hardship we were encountering. When asking PRMI what we could do to try to alleviate the problem of late payments we were just told to \" try making your payments on time ''. This was never a serious issue until the aforementioned date of XX/XX/XXXX. It was my payday, and I was working XXXX, per my regular shift. I clocked-out from work at approximately XXXX. I drove home and arrived just before XXXX. As soon as I was home, I got online, as I had done each month previously, to make our payment. When I attempted to make the payment online it would not allow me. I tried several times to no avail. It kept giving me a network or account error. I resolved to call customer service Monday, XX/XX/XXXX ; which I did. When I called PRMI on XX/XX/XXXX, I was informed that my account is \" Now in default ''. I explained to them how I had tried to pay it online, but was not allowed to. I was informed that our payment had to be posted \" before XXXX on Friday, XX/XX/XXXX ''. I told them I was unaware of such a policy. They were unwavering. I asked what I would need to do to get our account back in good standing. They said that I would have to make 2 ( two ) payments on our account immediately. I informed them that they knew our situation and that this would be impossible. I asked if I could go ahead and make my XXXX payment and I could find some way to make the XXXX payment before XX/XX/XXXX ( when the account would incur penalties ). I was told that PRMI \" would NOT accept partial payments '' and that we had to make the entire amount of 2 payments ( though we had only \" missed '' ONE ). I told them that if they would not take care of us, I would have to find someone who would help. This was only the beginning of our problems with PRMI. \n\nI had no real plan for what we were going to do to save our home, but I had to do something. So, I contacted XXXX about the mortgage refinance that we had been offered. They told me that they would take care of us and we would not have to make a payment for 90 days, and that would just be added into our refinance. Everything seemed fine until we got a notice from PRMI that our home was now in foreclosure. XXXX was not doing what they claimed to be doing for us. I was able to contact XXXX about what was happening and was told that they had been unable to complete our application, but never gave a clear reason why. I then called PRMI to see what we could do about the issues with our account. I was told it was in foreclosure and we were facing the sale of our property due to being in arrears. I told PRMI about how we had been involved with XXXX for a refi and they had not done what they claimed. I was told that they got that story a lot and that we would just have to deal with things how they were. \n\nI got the amount from PRMI for the account balance to bring it current. I informed them that we could have the money for them next Wednesday. When I called PRMI on Wednesday to pay the balance to cover the arrears, I was told that our account had been referred to the foreclosure attorney on Tuesday, the day before. I told PRMI that they had said we could catch our account up on Wednesday. I was told that we never said we ( PRMI ) werent going to move forward with the foreclosure. I then contacted their Arkansas attorney, XXXX XXXX XXXX XXXX In XXXX XXXX. They informed me that the account hadnt even been processed yet and we may be able to stop the foreclosure. I contacted XXXX again to let them know that I had spoken with the attorneys office and they said I could stop it if the arrears were paid in full. They told me that it was too late and that it had been submitted. I would have to deal with the attorney, now. Of course, we did not have the additional funds to pay for the attorney fees. \n\nI began to search for help to keep our property. I came across a company called XXXX XXXX XXXX offering mediation for foreclosure assistance. XXXX claimed that they would stop the foreclosure and get PRMI to re-evaluate our mortgage agreement. PRMI actually responded positively to the initial contact from XXXX, allowing them to enter negotiations over our account. We began paying XXXX the equivalent of our mortgage payment ( {$700.00} ) each month for their promise to have our mortgage re-evaluated. Then, Covid-19 happened ... and in XX/XX/XXXX our world shut-down. \n\nOver the course of about 4 months we stayed in contact with XX/XX/XXXXbout the status of our acct. They always claimed to be working on it. They never moved forward to get anything done for us. They were just collecting our monthly payments. I began complaining regularly about never having any forward momentum with the case. In XX/XX/XXXX I received notice from XXXX that they had negotiated a forbearance for our account. It seems they didnt realize that I knew it was a newly implemented Federal mandate. I complained about their inability to make any progress with our acct, until a temporary solution was handed to them, that they took credit for. I told them that I was going to contact the Attorney General to let them know what they were doing. I was immediately offered a complete refund of the funds ( equaling {$2800.00} ) that we had paid forXX/XX/XXXX to help. We were now under the mortgage forbearance for our account, allowing us to partially breathe a temporary sigh of relief knowing that we werent losing our home, right then. \n\nI paid close attention to the mandates and how the government was trying to assist the public. I knew that we were only protected by a 90-day forbearance and that we would have to request an extension before it ended. XX/XX/XXXX was the last day to be able to request furthering the forbearance. I emailed PRMI XX/XX/XXXX about our desire to extend the forbearance and that I may be able to even send a payment to keep our account from falling further behind. I thought that we had done all that was needed ( according to Federal guidelines ) to keep our account protected. I then received a letter from PRMI that our forbearance had ended and that the entire account balance was due. I contacted PRMI about the fact that we had requested the forbearance extension. We were told that they werent sure because of the verbiage of my email that was what we wanted since I had said we would try to make a payment also. I told them it was, and according to guidelines, we were still eligible for it. I even sent them a copy of the USDA Guidelines for Government guaranteed loans. They still would not extend the forbearance, and told me that those guidelines did not apply to me ( when they did ), but offered for us to begin the Loss Mitigation ( LM ) process. I felt like we had no other option. I began supplying documents, as requested, to the LM department. \n\nOver the course of the next year, we were constantly harassed by PRMI and their attorney, threatening foreclosure. We would not relent. Each time we would complete the LM process, we were told it was not enough and there would always be another stipulation that we were expected to meet. During this time, I also did some research on PRMI and XXXX. I found that the people I was dealing with in the PRMI LM Dept had ties to the agents at XXXX. XXXX and XXXX XXXX with PRMI, and XXXX and XXXX XXXX with XXXX were connected ( among other people ). I know, in fact, that XXXX XXXX worked with PRMI before his work with XXXX. XXXX started contacting us months before our account was even in default. \n\nDuring the duration of the LM process, I did not feel that we were being handled properly and ethically. I contacted the USDA to ensure that PRMI was operating according to Federal Guidelines for Covid. They were not. The USDA contacted PRMI about adhering to the set guidelines. After that, it seemed PRMIs actions were almost vengeful. They increased the pressure from the foreclosure attorney, and began demanding much more from us for the LM department. \n\nThis added stress prompted me on XX/XX/XXXX to contact XXXX XXXX with the Office of the Attorney General ( Consumer Complaint No. XXXX ), and later the XX/XX/XXXX XXXX XXXX PRMI responded to the AG on XX/XX/XXXX. Of course, PRMI claims their strict adherence to law ( and even denies affiliation with XXXX XXXX XXXX ). I can prove otherwise. \n\nThis brings us to our current situation of still being stuck in their loop of Loss Mitigation. We were still covered by Covid guidelines. But, now, they insist on referring to the hardship from my sons injuries and ignoring USDA standards for Covid relief. This has to stop. \n\nTheir Loss Mitigation \" Hardship Application '' asked for property repairs needed. Our 30yr old HVAC system had recently gone out ( after multiple repairs ) and we have had issues with our septic since we bought the property. We got a verbal quote from XXXX XXXX XXXX for a complete replacement. I listed these things as \" needed repairs '' on our home. They added \" windows '' and \" insulation '' to the list- when we had not mentioned them, because it was how we had purchased the home. Now, our Loss Mitigation application has been \" accepted/approved '', but is \" delayed '' due to these \" repairs being needed ''. We fear they are still doing all they can to take our home instead of help us keep it as the law states.","date_sent_to_company":"2022-05-26T16:12:53.000Z","issue":"Struggling to pay mortgage","sub_product":"Other type of mortgage","zip_code":"72104","tags":null,"has_narrative":true,"complaint_id":"5560011","timely":"Yes","company_response":"Closed with explanation","submitted_via":"Web","company":"PRIMARY RESIDENTIAL MORTGAGE","date_received":"2022-05-14T15:00:19.000Z","state":"AR","company_public_response":null,"sub_issue":null},"highlight":{"complaint_what_happened":["When asking PRMI what we could do to try to alleviate the problem of late payments we were just told to \" try making your payments on time ''. This oral conversation is further corroborated by the above email from XXXX about the school contacting him about my balance. Please note all of this is AFTER he consented in writing to the payment arrangment I offered in writing and stated he would honor the payment arrangement. I mentioned this fact to him, and said that XXXX could not count my money and make assumptions about what \" i can afford to pay '' based off of my place of employment and I stated especially considering that I work at a XXXX XXXX so salaries are not public so this was unfair and without any merit, furthermore I reminded him that I am a single mother with XXXX kids and daycare cost etc. I ended the conversation by stating that I would pay XXXX dollars bi-weekly based on my bi weekly payment schedule and authorized the payments to be automatically deducted on my paydays. Any information obtained will be used for that purpose. \nThis collection agency is licensed by the Division of Banking in the Wisconsin Department of Financial Institutions, www.wdfi.org. \n\nI responded via email : XXXX XXXX <XXXX> Mon, XX/XX/XXXX, XXXX XXXX ( 11 days ago ) to XXXX No my a Debit card has not changed. I hope this balance listed below reflects the payments you Have debited and I hope I am not being charged interest for an error on your part. \n\nFurthermore, there is no information on my bank statements that reflect declined payments. Also there would not be a decline considering the payment schedule for this account is set to debit and has debited from my account on MY PAYMENT DATES. Please also note that I have several recurring automatic draft payments from this same account and no problems. \n\nAt this point I was livid and nervous because it was so confusing and upsetting and it was obvious that they had made an internal mistake and instead of not acknowledging the error, tried to make it seem as though I was at fault and had not honored my agreement, and were now just scurrying to cover their own backs. This was further substantiated when I did not receive a response from XXXX XXXX, however, on XX/XX/XXXX, Williams and Fudge debited my account, the same one referenced above for the XXXX but never sent proof of payment nor did they acknowledge their mistake etc. So I became very nervous and scared about doing business with them because this is so unprofessional and unethical and could have bad consequences for me. On XX/XX/XXXX, I received two emails email from XXXX which upset me and confused me because they listed the same account but two significantly different amounts and more owed and worded in away as though this was a brand new attempt to collect on a brand new and completely different debt. \nI responded via email : Please verify this debt information with the original documents. I only had one institutional loan through XXXX XXXX University, so what is this? \n\nXXXX responded via email : with a link to download, what was the original loan documents that were no different from the documents provided in XXXX of XXXX. He did not state anything or try to explain to me what was going on. So I was upset and super nervous about this because I have already given them access to my account information and I have already consented to payment of this debt but this seems aggregious. So i called his direct number ( XXXX ) and it another representative stated that they took the call because XXXX XXXX was out to lunch. I proceeded to tell the person my concerns and confusion and stated I was upset about the deceit that my account was insufficient funds to pay the payment when there is nothing to support that and then they turn around and take a payment from the same account. I stated that it seemed that they were trying to be decietful and play me like I lacked basic common sense when it was obvious they were trying to create a fiscade to make it look like payments were rejected when in actuality they just make an internal mistake and didnt submit for payments. The representative proceeded to say he showed my card had been declined and I said please send me that information via email to which he then changed his statement and said he did see anything saying and that there would not be any proof becuase I listed my debit card and not my actual account number. I became upset and said that I would call my bank and verify that they were lying. The representative then proceeded to say '' well why dont you just take out a personal loan and pay it and get it over with ''. i told him he was out of line and cant tell me to take out a loan when i set up a payment plan and that he was being rude. He then completely just deflected from my question on how it is that I am responsible for William and Fudges mistake in not debiting my account for an Automatic payment deduction I approved. He then ended the call. Later that night at around XXXX, I called my bank and a representative confirmed that there was no proof that Williams and Fudge had submitted payments that were declined. She also confirmed the payments that had come out from XXXX and XXXX that totaled XXXX dollars plus the recent payment deduction from them on XX/XX/XXXX for XXXX that had cleared my account. So my bank representative then gave me the number for William and Fudge and advised to call them on the phone on three way to share that information and have them confirm any payments they showed declined. We spoke with one male representative who could not answer the questions or explain how it was that occured, so he put a manager on. The manager finally acknowledged she could see there was an error on their end and not mine. I requested that my account be reviewed completely from scratch, that the amounts of the alledged debt be reverified and proof provided via in writing, and that whatever, interest they were saying was now included that the client had submitted and had a right to include be outlined and broken down and proven where they could claim I owe one debt and then change the debt amount after i have already agreed to one amount. The manager assured me should would relay my request and review. I also requested that the calls be reviewed especially the call from earlier that day and that the representative not be coached but receive a more severe disciplinary action based on his rude and unprofessional comments. The next morning, XX/XX/XXXX, I received a email from XXXX listed the : XXXX XXXX UNIVERSITY XXXX {$7200.00} XXXX XXXX UNIVERSITY XXXX {$4700.00} Consumer Information Williams & Fudge Consumer ID # Williams & Fudge Pin # Amount Due for Account ( s ) Listed XXXX XXXX {$11000.00} XX/XX/XXXX RE : XXXX XXXX Good morning XXXX, When you have a moment, can you call me directly so I can explain what had happened last year on your account? \n\nThanks in advance, XXXX XXXX Now this just infuriated me more because it could be inferred yet again that this was an attempt to not acknowledge anything in writing after I specifically requested this, and to be manipulative, which further supports my concerns about the ethics of this company and my ability to receive a fair and accurate statement that can be trusted and to not be swindled. \nMy response : XXXX XXXX <XXXX> XX/XX/XXXX, XXXX XXXX ( 1 day ago ) to XXXX Please send all information in written format to my email and outline why this balance is completely different and doesnt reflect the payments made. \n\nAlso please provide WRITTEN information explaining the right to change this balance. More importantly, the original loan amounts were for XXXX and XXXX respectively at a 6 % fixed interest rate for the term of the loan. The loan outlines that repayment started for both XX/XX/XXXX, XXXX XX/XX/XXXX, with monthly payments of the XXXX at 83 dollars roughly and the XXXX at 50 dollars roughly if paid according to terms and 0 % interest would be charged. Furthermore, the loan stated that a if i did not pay accordingly, the amount of the monthly payments would include interest ( 6 % ) and roughly total XXXX for the XXXX and XXXX dollars for the XXXX. Now all of a sudden the total owed is almost 12k and the amount listed on all communications until as late as XX/XX/XXXX were XXXX and on XX/XX/XXXX the balance document showed a balance of XXXX. This is very concerning because i have verified a debt that was already at XXXX and my loans totaled XXXX k and not they have increased that amount even more. Not too mention the loan period was for XXXX payments for both the XXXX and XXXX to start on XX/XX/XXXX and XXXX XX/XX/XXXX, so i have missed XXXX payments before the XXXX payment and those payments were for XXXX per month which was roughly 50 dollars more than if I just started and picked up the payments so that was money to go towards the missed payments. \nWilliams and Fudge representatives have been deceitful and conniving by not honoring the written agreement for payment arrangement after confirming what i meant and being manipulative and calling me to try to increase and change a written agreement all be XXXX made an assumption on What they think I should pay because they saw where i am employed but do not know what I make at my job. Williams and Fudge was manipulative because instead of acknowledging that they had already agreed to my payment arrangement and admitting fault to XXXX if they were not satisfied with the amount it was William and Fudges fault because they should have verified what amount was acceptable before confirming my payments. Additionally, it has been placed with a collection agency so i dont see how the original debt collector is driving the terms of the payments or how they can just change amounts owed once they have confirmed and sent original documents.Nor does the significant increase make sense when the interest rate is fixed at 6 % nor has anyone been forthcoming about explaining this. The collection agency is changing amounts of debt and sending notices but yet they clearly dont even have an accurate accounting of this. The loan is not even due until XX/XX/XXXX so i dont even see how it could be a total amount owed of almost 12k even with missed payments.","date_sent_to_company":"2020-02-14T18:29:27.000Z","issue":"Took or threatened to take negative or legal action","sub_product":"Private student loan debt","zip_code":"54956","tags":null,"has_narrative":true,"complaint_id":"3532574","timely":"Yes","company_response":"Closed with explanation","submitted_via":"Web","company":"Williams & Fudge, Inc","date_received":"2020-02-14T16:30:58.000Z","state":"WI","company_public_response":null,"sub_issue":"Threatened or suggested your credit would be damaged"},"highlight":{"complaint_what_happened":["The representative then proceeded to say '' well why dont you just take out a personal loan and pay it and get it over with ''. i told him he was out of line and cant tell me to take out a loan when i set up a payment plan and that he was being rude.
