When they didn't stop I copied the URL to the website and using their log-in instructions, found a loan document in my name, complete with old bank account information -- the bank account is still active but I barely use it and haven't in years because the nearest branch is over XXXX hours away from me. I never applied for a loan with this company. I scrolled through the application and saw it was a payday company. I never signed. Then I started getting messages to verify my bank account so they could see my balances by linking them to it electronically. I NEVER do that except with reputable companies, government agencies or other banks. I closed the website and ignored it all. \n\nThe next day ( XXXX. XXXX ) I got another email saying to check my bank account. I ignored it. Then, on XX/XX/XXXX I got a overdraw notice from my bank. I checked my account and they had tried to withdraw a payment for {$300.00} and change. I didn't have that in my account so my bank refused but charged me {$24.00}. I immediately emailed customer service ( at the email I provided in this complaint ) and was told that I applied for a loan. I said I did not. The next response they admitted I hadn't : \" you're right you didn't apply with us but we got your information. '' How is that okay? They just somehow hacked my personal information, put it in a loan application and somehow got access to my bank account? \n\nThen, they said that I did \" e-sign '' the application and sent me a copy, with my electronic \" signature '' on XXXX. I did not sign anything, I just scrolled through portions of the document, not even the entire thing. \n\nSince they, I have repeatedly asked them to quit attempting withdrawals, told them they had no authorization or consent. They kept repeating that an email with that request in writing wasn't \" acceptable '' as part of their process. That is not my understanding of the law. I have very poor cell phone service out where I live and I was not going to call someone I never initiated contact with in the first place and that was likely scamming me. I also reminded them that I never did any electronic or online bank verification process. Then they later told me ( again, via email ) they'd only stop withdrawal attempts if I sent them 3 months of bank statements. I told them I wasn't going to send bank statements to a random individual from an organization I'd never heard of before. \n\nSo far they have tried to withdraw payments 8 times, resulting in over {$200.00} in overdraft fees TO ME. The total amount to pay was {$580.00} ( {$500.00} for the Principal amount + {$89.00} for the interest fees ). I've been a regular customer and has been doing business with this particular store for about a year now and I had never had any issue. However, within the last month or so they must have hired a new employee and this was my second interaction with her. So on this particular day, I went to the store around XXXX XXXX   on Friday, XXXX XXXX and told the lady my last name so as to pull my account. She told me the amount which I owed that I made the payment like I always did. I handed the lady {$590.00} in cash ( 5 {$100.00} bills, 1 {$50.00} bill, and 2 {$20.00} bills ). I signed my paperwork certifying the transaction and she handed me back {$0.00} change. The paperwork which I have copy states at this time it was XXXX XXXX. Until this point everything looked normal. I went ahead and told her I'm resigning for another loan. I told her I had all the necessary documents ( a blank personal check and also a current pay statement in case I needed a new one ). She looked into the system and said yes, I needed a new pay statement since the one on file had expired. So I filled out and signed the new check while she did the new paperwork. I handed her both my signed check and my new pay statement. I then asked her if there's a way I could get an extension on this new one because I wouldn't be in town on the day it would be due. She said, \" We will see, let me finish this new application. '' This whole time it was me and her alone in the store. Then another customer walks in and out of nowhere, the lady tells me if I could step aside in order for her to help this new customer since my application would take a little longer. This was my first \" red flag '' because I have never been asked to let another customer skip line since the protocol was all customers were served on a first-come-first-serve basis. I was a little bit confused but eventually did comply. After she got done with the customer, I went back to her and this is where everything began making sense. She said I'll help you get the extension and went ahead and said, \" But you'll owe me. '' I then said \" what do you mean, I'll owe you? '' She asked how much I was resigning for. I said the same {$500.00}. She then said I'll only get {$350.00} today. I was confused at this point and I asked \" but I'm resigning for {$500.00}? '' She said yes, but I'm helping you out with the extension. I then knew what she was getting at which was I would personally pay her out of the {$500.00} for the favor of extending my due date. All I was asking is for an extension from the company and not as a personal favor. I immediately told her that doesn't sound right or legal. At this point my application had gone through and she said I'm only giving you {$350.00}. I went ahead and told her, \" To forget it because I'm not doing it and I don't want it anymore. Give me back my documents. '' She then refused. I warned her I'll call the cops on her. Realizing I wasn't bluffing, she then switched her story and said, \" Actually, you owe me from last time. '' \" I overpaid you last time. '' I knew that she was trying to get back at me for not going along with her side-deal and so I told her thats a lie. I asked for the proof and she said there was none. She said to have realized it when I had left. I warned her one last time to give me back my documents or I'll call the cops. She started doing something hurriedly on her PC and I knew something wasn't right. I called the cops right away and reported I was in the middle of a fraudulent scheme and being swindled. When she saw me on the phone with the dispatcher she also got on her phone to call her supervisor. She went far away that way I couldn't hear what she was saying. While I waited for the cops to come, she got off the phone and tried to have a conversation with me. I told her the cops were on their way and I don't want to discuss anything further. I asked for my receipt from the paid loan and that's when she said, I voided it. I was like, \" excused me? I already paid, signed, and got changed for it. '' She then switched her story again and said, you never paid the whole amount. She said I only paid {$220.00}. At this point, I knew she was trying to cover herself and even then continued to get rid of some paperwork and all sorts of things. I didn't see what she doing due to the fact of the glass barrier between her and me. I knew there were cameras and so I wasn't worried that much. So when the cop showed up, I told him what had happened and at this point the lady was on her phone again presumably with her supervisor. Her supervisor was telling her to count the money in the drawer again and this whole time the cop and I waited for her to finish. The cop asked to speak to the Supervisor and they talked for a little and at some point asked if the cameras worked. When he got off the phone, the lady tried to offer me the {$220.00} back and the cop advised not to take any money from her. He had recorded my statement oh his police-issued camera. Since my folder was still visible on the desk, I told the cop I did sign some paperwork showing me making the payment. I told him it's in the folder and pointed it out to him. The lady said that wasn't my folder in which the cop insisted to see it. My name was on it. When she opened the folder, the paperwork was on top. The cop asked for the copy and that's how I got it. It shows how much I owed, how much I paid, how much cash she received and how much change I got. It shows the date and time and any if there was any void transaction it happened later on after I had called the cops. I even showed the cop the actual change handed to me. It's all in his video. I was advised to file a complaint with the headquarters to which I did that same day after leaving the store. I do have a case number but haven't heard anything from them yet. I went a step further to file this. The lady in question said her name is XXXX XXXX if she actually gave me her real name. I still cant believe she was trying to lure me in on a pay-on-the-side deal which ended up backfiring on her. Then while trying to cover for herself after I involved the cops, she recklessly tried to sabotage my account. I'm sure I'm not the first person she's done this to. Here 's how Uprova is different : they are FAR worse than any of the others that I know. \n\nAnyway -- I only needed {$700.00} and determined that for a relatively small loan, this seemed like an okay idea -- not great and not something I was excited about, but worth it so I could make the rent as I had gotten overwhelmed with other bills lately. I figured I would get a higher-than-ideal interest rate on this loan, probably higher than the already high 35 % which they advertised in big font, BUT it couldn't be that bad. Right? After all, they said these loans were \" fair '' and they talked about how they \" really care '' about consumers who are struggling to pay medical bills and for emergencies. \n\nI started my application and went through the steps. Early on they make you give your banking info which is a red flag I didn't see until later. BUT, I assumed that I would get a chance to review a standard promissory note and loan agreement terms PRIOR to signing anything -- as is the procedure with every other loan I've ever applied for. I hadn't authorized any debits and I hadn't committed to any loan at that point. I planned to make my payments on time ( which I did for every single payment up until very recently when I did my research on Uprova ) and do my best to pay more than the minimum required each time so that I could get ahead of whatever interest would accrue and that within a few months, the loan would be paid off. \n\nWhen applying for this loan, I was on my phone. Again, Uprova repeatedly advertises \" fair, transparent rates '' and says in big font on their site that \" some '' borrowers can get rates of ~35 %. This is the legal cap in my state for any creditor to charge. I went carefully through the remaining steps, reading and checking each page, and provided the requested information. Then, the loan application stated that it had calculated my \" monthly payments '' -- WITHOUT saying anything about the life/length of the loan or how much I would be paying in total at that rate. It displayed this figure and presented it as \" affordable '' ( which -- if it was only for a few months -- would be! ) and only this figure on the screen. It encouraged me to go to the next page. I clicked thinking the next step would be to review a pdf document where I could review the APR. Standard procedure. \n\nTo my surprise, I was then told that I was done/approved and would be getting my funds shortly. Really? It was that easy? I was hoping it wasn't too good to be true, but again even my worst fears couldn't prepare me for the reality. \n\nI need to emphasize this aspect of the process because the XXXX I spoke to tried to lie/gaslight me : Nowhere was any interest rate disclosed in the application process!!! You are pulled like a rabbit to a carrot through a few steps with minimal reading to do on each part and then it is a shameless, cruel bait-and-switch. I have never had an experience like this where the true fees were literally hidden from me and I entered into an agreement without even being aware that I was doing so. I can guarantee you I did not sign the document that the website generated with my signature. They simply copy and pasted it from the application where I'd provided it but that was before they even show you the document!! Many lenders will make you check a box before you click \" next '' ( and will freeze the page before you review/scroll to the bottom of all documents ) and they'll at least have the decency to display the most critical info for you to read/review, then ask if you are sure before you agree to anything. They do this to cover their XXXX XXXX XXXX XXXX and be able to say they were transparent and upfront about their terms so no one can say they didn't know. \n\nUprova doesn't even bother with the bare minimum ethics and they have the nerve to lie to you after the fact and try to tell you \" well you must have not seen the link ; it was there. '' NO, IT WAS NOT. Read multiple other people 's complaints. So many of them say the same thing : that the way Uprova discloses the loan information is very different from other lenders, and not just deceptive but straight up dishonest/LACKIN. If the astronomical APR had been provided or visible anywhere when I was still in the process of applying, I would have absolutely clicked and reviewed it. And? I would have immediately canceled the application and retracted any of my information/closed out the window yelling \" NOPE. '' The APR makes other predatory lenders ', e.g. XXXX with some rates of 160 %, look like angels. \n\nAfter reviewing the \" payment plan '' on nearly the final step which again only tells you the dollar amount of payments and no other info, faster than I could blink, the loan was \" approved, '' the funding was on its way, and only now could I navigate in the customer portal over to see my loan documents. When I found it and opened it up, I nearly launched myself to the moon as I had no idea how this was even possible. My credit was in the mid XXXX. The loan amount was low. Yet this brand new document which was NOT accessible previously said I would have to pay almost XXXX as much as I borrowed. \n\nThis is where Uprova is probably the most vile of the lenders I've ever encountered. Around the same time I switched banks to an online bank I liked better because of its high yield saving account and other features. I just honestly forgot about repaying them. How am I supposed to know that they're the company. As I told them, I heard nothing from Money Key about this ( I later found an email from Money Key in my junk folder saying they sold my debt ( but it was only that one email, this is the first phone call ) but the name and number they say they sold it to isn't the same number I got a call from ). I'm on the bus when this is happening and I tell her I can barely hear her. We get disconnected. When I get to my friend 's place, I call back asking to speak to her but a guy named XXXX picks up and he won't transfer me to XXXX ( even though XXXX left me another voicemail and called three times from the same number ). I'm here to visit my XXXX   XXXX. I'm nowhere close to rich, haha, most XXXX  do not get paid a lot at all. XXXX do get paid an advance but the way it works is say you get {$30000.00} for a book. That {$30000.00} is paid over 2 years in 2-3 payments. So you're really only making about {$15000.00} a year. I'm not rich. I barely have a XXXX in my account. But I did have an expense account at my last job, when I was salaried, and you can't use a company expense account to pay back a loan/personal expenses -- that's illegal. So I'm trying to explain this to him, and I'm finally like listen, I work XXXX  I can't pay it all ( about {$1900.00} ) right now, but I get paid a lump sum on XX/XX/XXXX and I can send most of it over then ( but again, I emphasize that I want something mailed or emailed ). He's like we can't wait that long it's been a year. ( It hasn't been a year yet, I got the loan in XXXX. ) But still I get that, so I'm like okay then can we do a payment plan? He pushes for me to pay the full. I'm getting frustrated because I am offering to pay via a monthly payment plan and he's aggressively trying to get me to instead pay the full amount. I'd prefer to handle this when I'm in the United States so that I'm also not getting charged a ton for making international calls because it's clear this is going to be a long conversation ( even though it didn't have to be, why not just email me the record I'm asking for and setup the payment plan ). During this phone call he also had me verify my parents numbers and my job, so now I'm worried they're going to start harassing them. So then I call Money Key ( the client ) because I would prefer to handle directly with them. They say that they sold the account and can't handle it anymore. I tell them that these people told me they would call them/the client if they refused to pay. They're like why would they call us, we sold the account. Money Key gives me a XXXX number for the company that they sold the account to. I call that number and can't get through -- it's also not the same number that called me which I find very suspicious. I'm not trying to evade my payment, I understand I shouldn't let Money Key know when I changed accounts ( again, I had just lost a dear friend and wasn't in the right headspace ). But I am trying to fix the issue now. If I didn't want to fix the issue, why would I have called them in the first place? I could've just ignored their calls. I said ok, she stated that it was XXXX XXXX XXXX XXXX, California XXXX. This raised another concern about this being legitimate company due to the fact I have never in my life known a corporate office to have a PO box as a physical address. I then asked for the telephone number to the company and her response was the one I had called from XXXX. I had also been given another number previously of XXXX that she did not disclose. I asked her for her hours of operation and where she was located and she told me they were open till 5 and that all she could tell me about her location was that she was calling from Florida near the XXXX XXXX area. I requested to know what their professional license # was so that I could verify the business according to my conversation with the FTC, when I contacted them regarding my suspicions about the company trying to collect this debt. I was told by XXXX XXXX that she would not give me the information about the license # and that by law she didn't have to disclose that information. I told her that the FTC informed me that she can in fact give me that information that it was available to the public and she flat out refused. At the end of the day I did receive an email with just the title of XXXX XXXX. no letterhead, no logo and my name, address, account number with the cash store and account ID the letter reads : This letter is to confirm that XXXX XXXX has received your installment for the above referenced account on XX/XX/XXXX. \n\nYour installments are as follows : Starting date : XX/XX/XXXX Installment Frequency : Bi-weekly Upon receipt of the final installment, your account will be considered Paid in Full. \n\nOnce that final installment has cleared, the account will be reported paid in full, and a XXXX  balance will be reported to the proper credit reporting agencies, if applicable. Furthermore, you will be released of any financial and legal obligations pertaining to the above referenced account and any remaining balance. \n\nIf you have any questions related to your account, please do not hesitate to contact the office at XXXX Monday through Friday from XXXX to XXXX EST. Please refer to the ACCOUNT ID indicated above on all questions and installments. \n\nSincerely, XXXX XXXX XXXX. XXXX  XXXX XXXX, CA XXXX XXXX IMPORTANT : In the event that any transaction is not honored by the bank, becomes disputed, chargeback or unauthorized, this letter will be terminated and voided. You may be responsible for the balance if full, less installments made and costs allowable by law. \n-- end of letter -- The letter besides having no company logo, and in a basic XXXX XXXX  format, shows my installments starting on XX/XX/XXXX however, I had already given one installment on XX/XX/XXXX. The letter also did not disclose XXXX XXXX or anyone else 's name for contact as well, and the contact number was different than what was previously given to me as well. I also noticed that the address provided at the bottom was a DIFFERENT address than the one I verified with XXXX XXXX over the phone several times and had even read back to her. I have already contacted The Cash Store on the same afternoon and learned that my debt was not settled like I thought, but that it was sold in XX/XX/XXXX to XXXX  XXXX  XXXX I contacted that business and was told the debt was sold again to XXXX  XXXX   XXXX  at XXXX. I contacted that company and was told that the debt was again sold to another company XXXX XXXX XXXX at XXXX. I have left several messages with that company to please contact me regarding my debt and have yet to hear back from anyone or get a call back to verify who at last has this debt and I am fine with paying what I owe, but just want to verify that this XXXX XXXX or XXXX  XXXX  XXXX  is who should actually have my debt since I do not even list this as an open debt on my credit reports and have gotten very little to NO solid information regarding the validity of this debt or the validity of this company. I would like to know what company owns my debt to settle if any at this point and ensure that this is not a fraudulent attempt to collect a debt. This \" company '' has a \" locator '' that has contacted my mother and my best friend in regards to locating me due to a \" case '' that is being filed against me in XXXX county. They disclose my case number in voicemails to them and that I still have saved on my phone. In the voicemail XXXX XXXX states that they are trying to locate me and that they will contact my employer and speak to my supervisor to locate me. They also disclose that I need to contact the legal department about this case and I would need to contact them before my case is filed and that once my case is discharged from their office that my legal rights will be forfeited. I believe this to be a violation of my rights to be contacting other persons besides my self and stating personal information about a debt on someone's voicemail about me. I also do not believe that if this is discharged from their office that my legal rights will be forfeited as claimed since I can always represent myself in a court of law or have an attorney represent my case so this does not make sense to me. I contacted the \" locator '' company and wanted to know why they contacted my best friend about my personal debt within the last hour after already speaking to a representative that morning. I was told that they did not call my best friend within that hour and the woman even told me that my friend was lying to me. There is something severely NOT acceptable with the way this company, if someone can even prove they are an actual company with the lack of information and evidence to prove so, handles someones personal business.
