When they take the payments, between {$120.00} and {$150.00} of it is nothing but their fees. Two payments ; possibly 3, per month and {$20.00} to {$30.00} of each payment is going to the principal. The way this is trap is set up ; it will take 30 months to pay off the loan of {$1800.00}. The original loan amount of {$1800.00} will cost me {$9600.00}. One would think that every law in lending has been broken. \n\nMobiloans.com has taken XXXX XXXX and XXXX XXXX 's playbook. Everything from the way it is advertised to how the products work is all a scam. The loan was taken out to report to the credit agencies and to help with the overall credit picture. We were trying to paint a picture for VA Home Lenders to finally live the American Dream and purchase a home. \n\nSomething needs to be done with this to protect us as a consumer. There is no way a company should be able to advertise this product as a personal installment loan when it is nothing but predatory payday loans. This guy was stating I took out XXXX different loans worth XXXX dollars and if i didnt take immediate action that i could be charged with bank fraud and have my drivers license suspended. He said that he could get rid XXXX of the loans and i would just have to pay XXXX dollars. I told him this is news too me, never in my life have i ever taken out a payday loan. I explained to him that i need this to be investigated because i know for a fact that someone has stolen my personal information. He said he would help with the investigation but that i would need to provide him with my debit card number that we could start our settlement and this wouldnt be taken to court. I feeling vulnerable and scared gave him my debit card number but after i did more info later that day i called my bank and had them cancel out my old card and supply me with a new one. I honestly dont know what to do. I know i never took out these loans. Should i file a police report for identity theft? Or should i just ignore these calls. The site then tells you your first ACH debit will be on the next expected payday date. It also claims to have \" no interest fees and no prepayment penalties. '' This is misleading and their fees are fraudulent and make it impossible to ever pay off the amount borrowed. Every ACH debit has NOT been on my payday date and has caused my checking account to be overdrawn repeatedly. Also I requested a copy of my loan agreement along with the terms and conditions and was denied. I have never received a copy of the terms and conditions at any time. Also, Enova ( NetCredit ) has taken ACH debits in the amount of over {$530.00} and has only applied {$7.00} towards the principal balance of {$1800.00}. I was approved for {$1800.00} but only received {$1600.00} but was never given an explanation as to why or what the {$200.00} they subtracted was for. There is no explanation of their fees. I called Enova and requested a copy of my loan disclosures and was not provided them at any time. I also told the representative that I didn't approve them debiting my checking account on dates that were outside my payday dates. The representative was rude and said \" well you signed the terms and conditions. \" I told her she is required to provide me a copy but was denied. I asked why out of the {$530.00} they have taken via ACH debits from my checking that I did NOT authorize is only showing {$7.00} off my principal balance due? Enova representative said that they don't charge interest but charge \" statement fees of {$85.00} or more from payments of {$110.00} ( estimated ) or higher. I told her that I did not agree to that and the application was misleading and never cited any \" statement fees. '' Enova representative then said \" well you signed the agreements so you have to pay it. '' I told her that is fraudulent and misleading and makes it impossible to repay. I tried to call the number listed but it was just a voice recording and the only option I was able to press was to continue in English, and then the line would disconnect. When I looked up XXXX XXXX XXXX, I found multiple complaints from other people stating they had debt collectors calling to collect for a loan they had never taken out and had never hear of XXXX XXXX XXXX. I researched XXXX XXXX Money and found out that they used to be a payday loan service that was shut down by the FTC in XXXX. I knew in fact that I have never had business with this company and have never taken out a payday loan. I relayed this to the caller and he began to state that he has all of my information. He told me he knows my address, my social, my previous employer, and my bank account information and correctly told me this information. He then said that the debt is real and I am liable for it. I again told him I am confident that I did not ever have contact with XXXX XXXX in any way and asked for proof. He stated that they would put the debt in dispute and that they would provide proof that the debt was real and that I can compare signatures to show it's mine. I was able to locate a number for XXXX 's corporate office and on XX/XX/XXXX contacted them. A recording played saying \" If you receive a call or letter stating you owe money on a debt do not pay and contact local law enforcement ''. I spoke with a customer service agent and she advised that she can look up my information to determine if I was ever a customer. Customer asks for reconciliation and compensation as stated herein.\n________ 1. Customer seeks a written apology from the manager  XXXX , at Advance America in   XXXX   XXXX  , CA, and reimbursement of food costs that he felt forced and coerced to provide ; afraid he would not be allowed proper customer service or a loan. Sometimes customer would give her an additional {$5.00} for lunch from his payday loan cash, which {$45.00} in interest had already been deducted from. Leaving him with {$250.00} on the {$300.00} loan. She accepted the money in replacement of a meal. When she asked where is my food, I would sometimes tell her I do n't have time to go get you food today but you can go get a   XXXX   XXXX   XXXX   pizza for {$5.00} and feed the whole office.\n________ 2. Customer deserves a written apology due to each past payday loan, when manager ignores customer requests for securing payday loans taken out in the past approximate two years ; not offering and when mentioned, ignoring him and not allowing customer to secure the loans by a written check ; which past two Advance America 's did do. In other words, she violated the law each and every time a payday loan was taken out, by applying ACH to all those loans, regardless of the customers requests not to do it that way. Company should be fined.\n_________ Customer is a long time faithful customer since about  XXXX , starting out at the  XXXX  and  XXXX ,   XXXX   CA store. Always on time. Those stores of past always insisted on a written check for security. This is why he knows there is something wrong with management at   XXXX   XXXX   CA, Advance America.\n_________ 3. Customer demands written apology for discrimination by  XXXX , when she took a snap photo with her phone app, and dressed him like a woman and shared it with  XXXX  and laughed at him. Making customer feel discriminated against because that is what they thought about him.\n_________ 4. Customer deserves an additional written apology from   XXXX   for  XXXX  shorting him {$10.00} cash upon a {$960.00} payment.   XXXX   applied {$950.00} on   XXXX   XXXX   XXXX  , to the installment loan. Had customer not caught it, then then  XXXX  and  XXXX  would have had {$10.00} extra for themselves. Causing customer to suspect extortion and/or, fraud because of the way he has been looked upon, made fun of, manipulated and mistreated previously by manager  XXXX  in the presence of   XXXX    ; including asking for food and accepting cash instead, for lunch when customer had no time to go get   XXXX   food ; and by  XXXX  allowing  XXXX  to assign a higher interest loan prior to that payment, then snickering about it, immediately after and then dragging   XXXX   away, outdoors quickly after the check and contract was handed to customer, etc..\nThis causes customer to be more suspect than ever, because he feels   XXXX   is teaching  XXXX  these bad habits. These two started treating customer differently over the past few months prior. Showing bad attitude and rejection, after customer made a large payment at another AA on a previous installment loan when it was not accepted by  XXXX . Customer was also forced to take out a payday loan at another AA when  XXXX  insisted customers bank account was closed ; causing customer stress and worry and it turned out to be a lie. These are the games customer has been putting up with.\nEven after that, manager   XXXX   refused customers new statement of proof of active bank account, when he took it in to prove it was not closed. And, manager   XXXX   locks  XXXX  out of taking payments or giving loans while manager goes on break so, only  XXXX  ( the less experienced and poorly groomed clerk ) could access computer for processing payments and loans. Customer would have preferred  XXXX , because of the way he was being treated by  XXXX  and  XXXX , and  XXXX  is the one with more experience, she is careful, mature and  XXXX  has not treated customer with disrespect or tricks.  XXXX  does not ask for food or mistreat customer.\n__________ Customer holds Advance America and it 's manager  XXXX , at   XXXX   XXXX   CA, responsible for these violations of laws, abuses and discrepancies. While your case is being reviewed, ( 2-3 years ) stop payment and stop collections status supposed to be in effect. \nI APPlied XX/XX/XXXX, re-applied in XXXX b/c they cant find app, and still as of XXXX, cant find either app, no status change. \n- there were 8 original defaulted loans, consolidated into one on XXXX. \nSo 8 loans in XXXX ... they multiplied when changing hands from XXXX to XXXX XXXX XXXX XXXX in XXXX ( now 16 loans ) and again in XXXX ownership went back to XXXX, and 8 more loans were  added .... now 24 plus the consolidated loan makes 25. \n?? Must be magic?? \nSo these 24 magical loans are still reporting late payments every month even tho they defaulted XXXX. \nI have disputed with all 3 agencies at least 8 times in the last year and every time they update something and get it all wrong again. \nI asked XXXX what they are reporting & they said only the current, consolidated loan. \n\nNONE of that should be reported since XXXX XXXX original loans are fraudulent. \nTheyve been reporting to the world that I dont pay my bills, and that I dont deserve credit or nice things and its all LiES. \n\n- the next issue is XXXX XXXX has been doing Hard Pulls every month for the last few years. My pay days were every other Tuesday, so they debited the XXXX dollars out of my account every other Tuesday. The problems started when I changed jobs. With the new job, my pay days are every other Friday instead of Tuesday. They kept taking my money out of my account every other Tuesday like those were still my pay days, which caused my account to be over drawn twice. I called them and told them this. They said they would make the changes in my account of my new pay days so the payments would go through on the correct days. The changes did n't happen and my account was overdrawn again. I called them again and told them this, which because of all this caused me to be behind XXXX payments to them because they were drawing the money out on the wrong days. I called them and told them the problem yet again. Spoke to two different representatives and set up a payment arrangement to be taken out of my account to catch me up the following Friday. The following day another major problem happened. I called again to ask another question about my account and when I verified my information ( my name and ssn ) they said that the info I gave them did n't match what was on file. ( mind you I had just spoken with and verified my information with two different customer service reps the day before ). Frustrated, I was told I had to call one of the local Speedycash stores and give them my information again and the customer service rep at the store had to the call customer service center and give them my information. This did n't make sense to have that level of incompetency happen that fast with my personal information. Once that was cleared up just in the last few weeks and the day of this writing they have been ( attempting ) to take money out of my account on days when I have n't authorized. The day of this writing, XXXX dollars was taken which caused my account to be overdrawn again and the same amount was tried last Friday, which caused me to be late on my car payment. The only thing I am left to do is to change the account # on my account information that they have so they wont be able to just go in my account Something needs to be down about this company and their shady business practices. They have lied to me when I have called and asked about how and when my payments go though my account, saying that its all up to a computer system and that they have no control over it. I was even told that payment arrangements are n't always honored because of this so called system. After being convinced that this was an emergent civil case against me which could lead to a law suit against me, I ( not knowing I could dispute this, nor that the statute of limitations had been exceeded for this debt, nor that you can not be criminally prosecuted in court for owing debt ) complied with payment of the one time settlement. I was then referred for payment processing to Nationwide Recovery Group, LLC out of XXXX, New York. They processed my payment and sent my an email that looked like a reciept, but had no invoice number or transaction number, and lacked visual authenticity. I feel like I was just scammed out of almost XXXX dollars, and that has put my family of XXXX in a tight finacial situation just before my rent is due. I want to sue the responsible party for the payed amount of XXXX cents plus an addition XXXX dollars for emotional distress, time loss in legal research and discovery, and financial burden. I have had to take a personal loan, which I will need to pay back, in order to make up the portion of rent I just lost. Please stress the urgency that they return payment for this time-barred debt, or face further legal action.
