This loan is entirely fraudulent, and I am the victim of identity theft. \n\nI have attached my full XXXX  report. As an average American, we ca n't defend ourselves against the abusive practices that many big companies get away with.\n_________ I spoke with Advance America 's loan manager  XXXX , on   XXXX   XXXX   XXXX   and he was able to protect Advance America 's interest by admission and correction of mistakes made by   XXXX   at   XXXX   XXXX   CA, in regard to the installment loan taken out on   XXXX  , contract loan ID  XXXX . The new contract with corrections is  XXXX  dated  XX/XX/XXXX . However, customer has yet to reconcile on other issues of suspected fraud and abuse. Manager lying to customer, withholding information in regard to loan disclosure ( lack of transparency ) and personal rights, human rights and discrimination violations. These additional corrections are possibly out of the hands of   XXXX   XXXX   control or ability to correct. Possibly some issues are for CFPB and also for Advance America Corporate to fix. Customer asks for reconciliation and compensation as stated herein.\n________ 1. Customer seeks a written apology from the manager  XXXX , at Advance America in   XXXX   XXXX  , CA, and reimbursement of food costs that he felt forced and coerced to provide ; afraid he would not be allowed proper customer service or a loan. Sometimes customer would give her an additional {$5.00} for lunch from his payday loan cash, which {$45.00} in interest had already been deducted from. Leaving him with {$250.00} on the {$300.00} loan. She accepted the money in replacement of a meal. When she asked where is my food, I would sometimes tell her I do n't have time to go get you food today but you can go get a   XXXX   XXXX   XXXX   pizza for {$5.00} and feed the whole office.\n________ 2. Customer deserves a written apology due to each past payday loan, when manager ignores customer requests for securing payday loans taken out in the past approximate two years ; not offering and when mentioned, ignoring him and not allowing customer to secure the loans by a written check ; which past two Advance America 's did do. In other words, she violated the law each and every time a payday loan was taken out, by applying ACH to all those loans, regardless of the customers requests not to do it that way. Company should be fined.\n_________ Customer is a long time faithful customer since about  XXXX , starting out at the  XXXX  and  XXXX ,   XXXX   CA store. Always on time. Those stores of past always insisted on a written check for security. This is why he knows there is something wrong with management at   XXXX   XXXX   CA, Advance America.\n_________ 3. Customer demands written apology for discrimination by  XXXX , when she took a snap photo with her phone app, and dressed him like a woman and shared it with  XXXX  and laughed at him. Making customer feel discriminated against because that is what they thought about him.\n_________ 4. Customer deserves an additional written apology from   XXXX   for  XXXX  shorting him {$10.00} cash upon a {$960.00} payment.   XXXX   applied {$950.00} on   XXXX   XXXX   XXXX  , to the installment loan. Had customer not caught it, then then  XXXX  and  XXXX  would have had {$10.00} extra for themselves. Causing customer to suspect extortion and/or, fraud because of the way he has been looked upon, made fun of, manipulated and mistreated previously by manager  XXXX  in the presence of   XXXX    ; including asking for food and accepting cash instead, for lunch when customer had no time to go get   XXXX   food ; and by  XXXX  allowing  XXXX  to assign a higher interest loan prior to that payment, then snickering about it, immediately after and then dragging   XXXX   away, outdoors quickly after the check and contract was handed to customer, etc..\nThis causes customer to be more suspect than ever, because he feels   XXXX   is teaching  XXXX  these bad habits. These two started treating customer differently over the past few months prior. Showing bad attitude and rejection, after customer made a large payment at another AA on a previous installment loan when it was not accepted by  XXXX . Customer was also forced to take out a payday loan at another AA when  XXXX  insisted customers bank account was closed ; causing customer stress and worry and it turned out to be a lie. These are the games customer has been putting up with.\nEven after that, manager   XXXX   refused customers new statement of proof of active bank account, when he took it in to prove it was not closed. And, manager   XXXX   locks  XXXX  out of taking payments or giving loans while manager goes on break so, only  XXXX  ( the less experienced and poorly groomed clerk ) could access computer for processing payments and loans. Customer would have preferred  XXXX , because of the way he was being treated by  XXXX  and  XXXX , and  XXXX  is the one with more experience, she is careful, mature and  XXXX  has not treated customer with disrespect or tricks.  XXXX  does not ask for food or mistreat customer.\n__________ Customer holds Advance America and it 's manager  XXXX , at   XXXX   XXXX   CA, responsible for these violations of laws, abuses and discrepancies. He knows that she absolutely deceived him by withholding important information and lied to him besides that about refinancing, and had become abusive in different ways as mentioned herein and evasive and unhelpful about issues and requests at times.\n___________ Advance America Complaints, has received three previous letters from customer concerning these human rights, personal rights, discrimination, loan law violations, abuses ; coercion, mistreatment, deceptions, possible fraud, withholding information, mistakes, unnecessary delays, rude treatment, gouging, manipulation of loan policy, not allowing a physical check as security, evasiveness, failure of disclosure and transparency, lying, extorting for food and delivery or, payment for food, etc.. These actions indicate probable hidden agenda. The actions are for sure unscrupulous and unlawful activity ; predatory in nature and practice. My mother had someone living with her at the time named XXXX XXXX who she kicked out in XXXX. XXXX would have had access to all of my information. Advance America also stated the person used an email XXXX. My personal email is XXXX. Additionally they lied about my monthly income ( XXXX ). As an XXXX XXXX my base pay is XXXX a year, much more than XXXX. Finally, they advised me that when this happened a hard pull would have taken place on my credit reports. The account they are attempting to collect was written off by Zions Bank years ago, and only became late because of my XXXX, as they ( XXXX XXXX, collections department ) are aware. \n\nAccording to ConsumerFinance.gov, banks and credit unions are required to protect up to two months of VA or other XXXX benefits, no matter what. ( See CFPB link below. ) In my case as a XXXX XXXX XXXX veteran, my monthly VA benefits are {$2900.00}, so up to {$5900.00} is legally protected from any garnishment at any given time. \n\nEarly this month, in an attempt to pay off a credit card that I use to pay all of my expenses each month, I deposited an amount representing roughly my entire VA income for the month of {$2900.00} plus a roughly {$2200.00} high interest payday loan advance ( at about 260 % ) on next months VA income into a Zions Bank personal account. The high interest loan was intended to be for only one day, as I was going to pay off the loan using that credit card the next day, which would have saved me from paying roughly {$150.00} in interest for the month. ( There is no room for interest or fees of any kind in my budget because of unusually high health care expenses not covered by the VA. ) Knowing I am a XXXX XXXX XXXX veteran as of XX/XX/2017 and having my monthly budget as of XX/XX/XXXX, on approximately XX/XX/XXXX or XX/XX/XXXX and again on the XX/XX/XXXX, Zions Banks Collection department for a second and then third time returned my credit card payment and illegally placed holds on all of these funds, causing significant problems with all of my finances and projected finances for the future, as I am not able to cover any of my other expenses including rent, phone, utilities, health related expenses, food, and more. I have no other source of income at this time, and my father is retired, so he is unable to help. I have exactly {$7.00} in another account, and a lot of people and personal needs like food asking for it. Thats it. \n\nOn the XX/XX/XXXX, I provided a branch with a copy of the regulation that shows it is illegal to freeze or take protected XXXX funds. The teller temporarily unfroze the funds, then concerned she might be violating the banks interests, called the collection department who told her to freeze it again, in spite of warnings that there could be statutory damages for holding XXXX funds. Through a bank manager, the collection department told me to sue them. \n\nAs Zions Bank has taken all of my funds other than the aforementioned {$7.00}, I am not able to personally bear the expense of a lawsuit, let alone buy food or pay for shelter, so I am asking the CFPB to intervene. ( If this doesnt work there might be contingency fee based lawyers who will help and take a longer time, by which time I am likely to be on the street for a  second time in the last three years, an eventuality XXXX payments and their protection are intended to avoid, but I am asking you first. ) If possible I would appreciate having my significant fee and interest losses recovered as well as any statutory damages related to Zions Banks multiple and repeated blatant violations of consumer financial protection law and medical expenses that have or will be incurred related to the substantial distress this illegal activity has caused me. ( Ive been averaging about 3 hours of sleep a night since the incident. ) XXXX is especially harmful to me because of a XXXX XXXX condition I sustained due to service in XXXX that has become progressively worse. I get a voicemail from a number in XXXX, Texas ( XXXX ) from XXXX XXXX saying that it was a \" documented attempt to make contact, in reference to a complaint filed against my name and my social. '' I immediately call back because, again, I had completely forgotten about this loan. I fully admit that that is on me. She is rude from the beginning, bullying me into giving her money. It takes me a while to remember the loan, but when I do I calmly state that I understand I didn't pay it back, but that I would like a written record that Money Key sold the debt to them and that they are indeed that company. How am I supposed to know that they're the company. As I told them, I heard nothing from Money Key about this ( I later found an email from Money Key in my junk folder saying they sold my debt ( but it was only that one email, this is the first phone call ) but the name and number they say they sold it to isn't the same number I got a call from ). I'm on the bus when this is happening and I tell her I can barely hear her. We get disconnected. That {$30000.00} is paid over 2 years in 2-3 payments. So you're really only making about {$15000.00} a year. I'm not rich. I barely have a XXXX in my account. But I did have an expense account at my last job, when I was salaried, and you can't use a company expense account to pay back a loan/personal expenses -- that's illegal. He pushes for me to pay the full. I'm getting frustrated because I am offering to pay via a monthly payment plan and he's aggressively trying to get me to instead pay the full amount. The transactions didnt begin coming through til later that day around XXXX XXXX, thats when i noticed the first XXXX to Credit acceptance was pending long with others that were minor and i was puzzled, in the next hour more transactions pending began to appear, and bamn there it was, the rep didnt bother to cancel the XXXX payment and it too was pending i was hitting the roof, i went into my stock account immediately and liquidated all my stock trying to come up with the funds to transfer into my account to cover the negative before my bank would hit me with NFS fees of XXXX a pop, but found i couldn't transfer anything cause it was a newly bought stock and needed tme to accumulate, so this now put me in probation mode for 30 days meaning i couldn't touch anything for 3 months! Thats when i really hit the roof! \n\nXX/XX/XXXX, - my balance in my bank is now negative XXXX! so I called my bank and filed a dispute to have that loan company reverse the charges and then i called the loan place and chewed out another rep and told her, if that money isnt reversed within 24 hours im reporting this as theft! she told me i could of left the scheduled payment as is and the money would of been retrieved the next working business day, and i told her how in the XXXX am i to know that? and what makes you people think i can jump on a computer and cancel when XXXX XXXX an XXXX XXXX  all day long? its time consuming and now you people have put me in a XXXX of a situation. On XX/XX/XXXX, received notice from XXXX XXXX a debt collection representative of William and Fudge Inc trying to collect on this private loan for XXXX did not respond. On XX/XX/XXXX received a secure e-document from William and Fudge and another on XX/XX/XXXX from XXXX of William and Fudge. Did not respond. On XX/XX/XXXX, received another email on this same loan from another representative XXXX XXXX to which I did not respond. However, I received a phone call at my place of employment around XX/XX/XXXX from XXXX 's from a financial aid representative from XXXX who once I answered and stated my name proceeded to tell me that my loan was due and that i needed to make payments and that they verified I was employed for XXXX XXXX  and could make payments. You mentioned in the email bi-weekly payments but I think you meant every 4 weeks, correct? The dates you specified are every 4 weeks,  not bi-weekly. \n\nI will honor your request and set up {$100.00} to come out every 4 weeks starting XX/XX/XXXX. Payments are set up through your checking account by either your debit card account number and expiration date or ACH information ( routing and account number ). On XX/XX/XXXX, I received two emails email from XXXX which upset me and confused me because they listed the same account but two significantly different amounts and more owed and worded in away as though this was a brand new attempt to collect on a brand new and completely different debt. \nI responded via email : Please verify this debt information with the original documents. I only had one institutional loan through XXXX  XXXX University, so what is this? \n\nXXXX responded via email : with a link to download, what was the original loan documents that were no different from the documents provided in XXXX of XXXX. He did not state anything or try to explain to me what was going on. So I was upset and super nervous about this because I have already given them access to my account information and I have already consented to payment of this debt but this seems aggregious. So i called his direct number ( XXXX ) and it another representative stated that they took the call because XXXX XXXX was out to lunch. I proceeded to tell the person my concerns and confusion and stated I was upset about the deceit that my account was insufficient funds to pay the payment when there is nothing to support that and then they turn around and take a payment from the same account. I stated that it seemed that they were trying to be decietful and play me like I lacked basic common sense when it was obvious they were trying to create a fiscade to make it look like payments were rejected when in actuality they just make an internal mistake and didnt submit for payments. The representative proceeded to say he showed my card had been declined and I said please send me that information via email to which he then changed his statement and said he did see anything saying and that there would not be any proof becuase I listed my debit card and not my actual account number. I became upset and said that I would call my bank and verify that they were lying. The representative then proceeded to say '' well why dont you just take out a personal loan and pay it and get it over with ''. i told him he was out of line and cant tell me to take out a loan when i set up a payment plan and that he was being rude. So my bank representative then gave me the number for William and Fudge and advised to call them on the phone on three way to share that information and have them confirm any payments they showed declined.
