At some point in XXXX 2015, my account was victim of fraudulent charges, after which I had to be issued a new card. Upon discovering one the charges ( by XXXX XXXX ), I immediately called the merchant to inform them of that charge ( Ref # XXXX, {$2500.00} ). I also contacted Citibank regarding the fraudulent charge. Citibank promised to investigate the matter but did not readily credit the disputed amount. Given the exorbitant amount of the charge and the fact that I was unsure if the money would be credited back by Citibank, I tried to resolve the matter with the merchant, which took a lot of time and effort. The merchant eventually agreed to issue a courtesy credit of {$300.00} for the pain and suffering that the fraudulent charge had caused me, as well as the amount of time I had spent trying to resolve the issue. Eventually, Citibank also issued a credit on my account for the original amount of the fraudulent charge. On XXXX/XXXX/15, the abovementioned credit of {$300.00} was posted to my account. However, the credit was later reversed on or about XXXX/XXXX/15. When I called Citibank to inquire about why this credit had been reversed, I was informed that the credit had been reversed because I had been given a double credit for the same charge. \nI dispute the fact that I was given a double credit for the same charge. The credit of {$300.00} was specifically issued by the merchant on a voluntary basis, and as a courtesy to compensate me for pain and suffering due to the fraudulent charge and the time spent to try and resolve the issue, while the credit issued by Citibank was for the charge itself. I believe this credit of {$300.00} should either be put back on my account or returned to the merchant, and in no way should be kept by Citibank, as it was specifically issued to me by the merchant and for the specific reasons mentioned above. At this point, I want PennyMac to sell my loan to a company that will fairly credit my payments in a timely manner as required by law. I have never had a late mortgage payment and it is a pain in the neck to have to take extra measures to be able to prove that I mailed in my mortgage payment on time every month. \nOn this occasion, PennyMac did not credit my payment to my account until 12 days after I mailed it, then they charged a late fee to my account. When I asked the customer service representative why they did not credit my account in a timely fashion, she said the same thing that they said 2 years ago : We had bad weather across the country and it held up the mail. She even said that they had trouble getting to their lockbox even though it is in XXXX, Texas. \nThe bottom line is that this is the second time that I have submitted a formal complaint to CFPB about this practice at PennyMac. It is a heavy burden to write a large check every month for my mortgage and not know whether I will receive the credit that I am supposed to receive under law. At this point, it is clear that this is not an isolated incident with PennyMac. I will enclose an official Certificate of Mailing from the U.S. Postal Service showing that I mailed my payment on XXXX XXXX, XXXX, as I previously stated. \nIt is completely unreasonable that PennyMac credited my payment a full 12 days after I mailed it. Whenever I have sent my payment using Certified Mail, it usually arrives at PennyMac in 3 days. Occasionally, it takes 4 days but never more than that. Instead, the salesman pushed and pushed to have me sign everything the same day so i could not read it properly in length and have time to consider such a big purchase. I have read that the finance company is in litigation in other states because of misrepresentation by the solar company, and for HIDDEN FINANCE CHARGES, which to my knowledge is illegal under the Truth In Lending Act. I have been paying the finance company on time every month since XXXX, while also paying an electric bill that i was promised would not exist. They also told me that the solar panels on the north side of my roof would generate enough power and wouldn't be a problem, but they are almost never touched by the sun to generate any power whatsoever. The system has failure after failure, and is now causing mold damage to the north side of my roof, since the panels are almost in complete darkness even during the day, the underside of the panels has become a haven for mold. I just need some guidance as to how or what i can do to be free of this pain. The finance company gives me the runaround and wont let me see my loan when i try to go on their portal to view it, it says my loan does not exist. i have asked them about it and they say that they can see it on their end but give me no solution as to why i can not see it. I have contacted the Michigan Attorney General about this and they are working on something but who knows how long or what they are doing about it. I want help to see if they have hidden finance charges on my loan as well and also how would i find this information on my own if possible. The truth in lending act disclosure does not give any breakdown of the cost of the panels, installation, or anything, all it says is my loan amount and the apr, and the finance charge of it being paid over 30 years. Everybody is running in circles and now making up lies. ANd I believe the lies just fall in not wanting to do the work for a 60 day plus dispute. \n\nWhen I spoke to XXXX on XX/XX/XXXX he stated pretty much, take a seat and in 30 days will get back to you. So really this dispute will be going on 90 days, with no resolution just the runaround. \n\nBMW fails to understand that the account now showing hurts my credit tremendously. The same issue which is preventing me from getting the best rate personal loan at my Credit Union which pulls XXXX for XXXX, which I've postponed 2 times now, waiting on BMW. On XX/XX/XXXX I received a letter from Transunion stating that on the date of XX/XX/XXXX and XX/XX/XXXX they had did an investigation into Texas Federal Court XXXX and at that time when they did investigation they had verified the account. So they went on to say that they would reopen the case and do an new investigation into the matter and send me out a letter once its been done with the new results. XX/XX/XXXX is the last I've herd from Transunion. From my understanding they have 30-45 days to do an investigation and send out the results or they must remove the item off the consumer report. I have yet to receive anything but yet they are still reporting this on my credit which is a violation of FCRA. Transunion is also in violation for not sending out a letter with in 5 days of reinserting a deleted item. I don't understand why Transunion claimed they did investigation back in XXXX and XX/XX/XXXX because its irrelevant considering it was deleted anyways back then for the violation that i noted. But from my true understanding section 609 protects me against false reporting and i would like to point out that this exactly what this is. TransUnion is the only bureau reporting this on my credit and have yet to explain why or show any prove. Somehow being {$6700.00} in the negative has no bearing on my ability to afford to make student loan payments. But he said my loan would officially default now, as a result which was not supposed to happen. I was mislead into giving navient access to my account. BoA just brought it current which was of no use as we could not make payments and needed it paid off with Save the Dream funds. It took several more months to get BoA to get act together and finally with the remaining Save the Dream funds and added funds we borrowed from Family got XXXX paid off completely. We were told we could refi in 1 year on XX/XX/XXXX. Now have tried and just found out BoA messed up again. area with the speeds that they described to me as I said I went onto the Internet I found hundreds of cases with people were given misinformation lied to On that same day XXXX XXXX I contacted the technical people they said they literally set all the connections and that I would get a better speed of Internet service it would take between 12 and 24 hours I waited 24 hours at that point had no service whatsoever non-it was not functioning I call them back they told me to go and get a new Sim card went to the XXXX store in XXXX Pennsylvania and they gave me a new Sim card at no charge I went home and connected it there was still no connection I called back this technical people they told me they had a reset the connections 24 hours later there was no service whatsoever I called in and request a refund and to cancel the service they told me to contact my credit card company and request the chargeback and they would not contest I did that on XXXX XXXX so far they had sent me no receipt whatsoever they sent me numerous emails to my email would no receipt no invoice I contacted my credit card company and told him exactly what transpired they put in the dispute XXXX answer them back and they put the chargeback on my account I called my credit card company and they refused to do anything about the charge they requested that I spent {$1500.00} to have a private company come to my home and verify that XXXX 's Internet service was not working the charges {$44.00} they requested an invoice or receipt for the service which I never got I was never sent an invoice or receipt they advised me that they did receive an invoice or receipt from XXXX when I contested the service and they refused to share with me and wanted me to get a receipt from XXXX I call XXXX numerous times last It included a copy of a letter from the original owner of the debt XXXX XXXX to the real debtor and a summary page with the past due amount. Incidentally, all of the bank correspondence to the debtor was sent to an address in Florida. \n\nAt this point I thought it best to hire an attorney. \n\nOn XX/XX/XXXX my attorney sent a letter to Portfolio Recovery Associates requesting further information. He specifically asked for a complete executed copy of any agreement between XXXX and myself. On XX/XX/XXXX Portfolio Recovery Associates again responded but did not send the information he specifically requested. All he received were more summary credit card statements. \n\nThe reason that Portfolio Recovery Associates can not provide any proof that it is my debt - is because it simply does not exist. And yet, on XX/XX/XXXX and again on XX/XX/2019 Portfolio Recovery Associates informed the credit reporting company XXXX   that this account was in collection under my name. \n\nThe facts are : 1 ) all correspondence from XXXX to the real debtor were sent to XXXX XXXX, XXXX XXXX XXXX CT XXXX, FL XXXX. I have never lived in or even visited Florida. Tax and real estate records will prove this. XXXX own dispute report # XXXX dated XX/XX/2019 validates this. \n\n2 ) I have a history of paying the balance on my credit cards every month and have done so for at least 20 years. I do not let credit card debt accumulate nor do I make late payments. A simple review of our credit history would have verified this. In addition to what I told Portfolio Recovery Associates multiple times, they also have access to my credit history and dealings. Incidentally, all of the bank correspondence to the debtor was sent to an address in Florida. \n\nAt this point I thought it best to hire an attorney. \n\nOn XX/XX/XXXX my attorney sent a letter to XXXX XXXX XXXX requesting further information. He specifically asked for a complete executed copy of any agreement between CapitalOne and myself. On XX/XX/XXXX XXXX XXXX XXXX again responded but did not send the information he specifically requested. All he received were more summary credit card statements. \n\nThe reason that XXXX XXXX XXXX can not provide any proof that it is my debt - is because it simply does not exist. And yet, on XX/XX/XXXX and again on XX/XX/2019 XXXX XXXX XXXX informed the credit reporting company XXXX that this account was in collection under my name. \n\nThe facts are : 1 ) all correspondence from CapitalOne to the real debtor were sent to XXXX XXXX, XXXX XXXX XXXX CT XXXX, FL XXXX. I have never lived in or even visited Florida. Tax and real estate records will prove this. XXXX own dispute report # XXXX dated XX/XX/2019 validates this. \n\n2 ) I have a history of paying the balance on my credit cards every month and have done so for at least 20 years. I do not let credit card debt accumulate nor do I make late payments. A simple review of our credit history would have verified this.
