Then, in a classic Bait and Switch, I receive bills from Tenet and their subordinates for {$7200.00}! \nThis is part of XXXX 's response : \" We have contacted our client and verified that the consumer was provided and signed a financial responsibility agreement prior to receiving services. The consumer was provided with a copy of this document at the time of service to keep for their records. '' I dispute this response as even if I did sign something ( I have no copy of this ), being at a level 10 threshold of pain, had n't eaten solid food for almost 2 days, was severely dehydrated, and due to these conditions any such \" signing of financial responsibility '' was not made with informed consent - I was in too much pain to comprehend anything such as signing a responsibility agreement. ANY SIGNING WAS DONE UNDER DURESS, WITHOUT INFORMED CONSENT! \nLet 's look at who we are dealing with - Tenet - who paid XXXX XXXX a few years ago when prosecuted for XXXX fraud, and just lately agreed to pay over XXXX XXXX for XXXX fraud! XXXX executives are now charged in this recent case as well. \nMy point is twofold - TENET IS A CORRUPT CORPORATION AND ROUTINELY LIES TO PAD ITS PROFITS! TENET WAS/IS LYING WHEN THEY STATED THAT THEY COULD FIND NO EVIDENCE OF THEIR EMPLOYEE INFORMING ME MY XXXX VISIT WAS FREE OF CHARGE. AS WELL, THEY BILLED ME FOR OVER XXXX PERCENT MORE THAN XXXX WOULD PAY FOR SUCH SERVICES! THEIR BILL IS AGAIN ATTACHED TO THIS COMPLAINT. I have previously reported, in at least 3 separate complaints to the CFPB different incidents regarding Equifax and my credit report. I have proof that they have tried to botch my credit report to prevent me from obtaining credit, which may have played a role in a recent credit denial I received. This has caused monetary loss, as well as pain and suffering for the months I 've been harassed by them and tried to get help from agencies to not much avail. I want this to be public so that if other people besides me are experiencing this, they know they 're not alone and that perhaps we can file a class action at some point. <P/>To begin, Equifax has added to three different accounts a consumer statement that I DID NOT add or tell them them add. I did not know this was even legal. If it 's not, then I 'm wondering why something has not been done about this already. Since when can they add a consumer statement that is n't from the consumer? It 's clear in black in white that the statement they 've added is even gone so far as to be in third person. Saying \" consumer disputes this information ''. Which means they are clearly writing on BEHALF of me without my permission. What concerns me the most is that they 've added this statement to an account in good standing, in which I 've never had any issues with. It is my understanding that if something is under a dispute it will not show on a credit report. If this is the case with this, legal action should be taken, or something absolutely should be done. This would prove that they are trying to prevent positive/accurate information from showing on a credit report by their own statements they 've added. I did n't add the statement, they did. It 's even in third person, it ca n't be denied. Even if it is still showing on my credit report and I 'm mistaken, that makes it seem like the information on that account is incorrect or something is not right about it. This is not the case. One last time, I would swear under penalty of perjury that I have NEVER disputed the information on this XXXX XXXX account. Nor have I added any statement to it. They added this statement without my permission. <P/>Please ask them where they got this information from. Please do something about this. They need to remove all 3 instances of this from my credit report, because they have no right to add any consumer statement without my permission. They do not have my permission to add any consumer statements that they wrote. Only statements that I have submitted MYSELF, written MYSELF, and asked to be put as a statement MYSELF. I spoke to several representatives and a supervisor ... XXXX. I explained the issue and advised I want my call pulled. Someone falsified my account and I was filing a complaint. I took called a few times to take the survey,, as the 1st time I asked XXXX to transfer me but he must have stayed on the line because the survey system kept asking saying the same thing after I was trying to make my selection. Apparently, he did n't disconnect the call because if you do n't release the call ... the survey wo n't be activated. Very Poor service ... this company creativity is shot in my book and I want action taken, my account to be reviewed and something to be done ... .I do n't trust this company at this point. The reason the BK had been deleted about 5 years ago was do to the fact there was many inaccuracy reporting on the Bankruptcy. Such as wrong filing date, date the BK was closed the address and name of the correct Bankruptcy court. They even had my address incorrect. After I filed my complaint XXXX  sent me a letter stating that they had removed the Bankruptcy off my credit. I was really relieved considering at the time I was in the middle of closing on some rental property and had to take a big financial lose because of what had just inspired with my credit taking a major hit which caused me a lot of stress and some miner physical pain. So now both XXXX  and XXXX   was showing my credit report correctly and I just knew TransUnion would follow suite , but they did just the opposite. On XX/XX/XXXX I received a letter from Transunion stating that on the date of XX/XX/XXXX and XX/XX/XXXX they had did an investigation into Texas Federal Court XXXX and at that time when they did investigation they had verified the account. So they went on to say that they would reopen the case and do an new investigation into the matter and send me out a letter once its been done with the new results. XX/XX/XXXX is the last I've herd from Transunion. From my understanding they have 30-45 days to do an investigation and send out the results or they must remove the item off the consumer report. I have yet to receive anything but yet they are still reporting this on my credit which is a violation of FCRA. Transunion is also in violation for not sending out a letter with in 5 days of reinserting a deleted item. I don't understand why Transunion claimed they did investigation back in XXXX and XX/XX/XXXX because its irrelevant considering it was deleted anyways back then for the violation that i noted. But from my true understanding section 609 protects me against false reporting and i would like to point out that this exactly what this is. TransUnion is the only bureau reporting this on my credit and have yet to explain why or show any prove. It included a copy of a letter from the original owner of the debt XXXX XXXX to the real debtor and a summary page with the past due amount. Incidentally, all of the bank correspondence to the debtor was sent to an address in Florida. \n\nAt this point I thought it best to hire an attorney. \n\nOn XX/XX/XXXX my attorney sent a letter to Portfolio Recovery Associates requesting further information. He specifically asked for a complete executed copy of any agreement between XXXX and myself. On XX/XX/XXXX Portfolio Recovery Associates again responded but did not send the information he specifically requested. All he received were more summary credit card statements. \n\nThe reason that Portfolio Recovery Associates can not provide any proof that it is my debt - is because it simply does not exist. And yet, on XX/XX/XXXX and again on XX/XX/2019 Portfolio Recovery Associates informed the credit reporting company XXXX   that this account was in collection under my name. \n\nThe facts are : 1 ) all correspondence from XXXX to the real debtor were sent to XXXX XXXX, XXXX XXXX XXXX CT XXXX, FL XXXX. I have never lived in or even visited Florida. Tax and real estate records will prove this. XXXX own dispute report # XXXX dated XX/XX/2019 validates this. \n\n2 ) I have a history of paying the balance on my credit cards every month and have done so for at least 20 years. I do not let credit card debt accumulate nor do I make late payments. A simple review of our credit history would have verified this. XXXX own dispute report # XXXX dated XX/XX/2019 validates this also. \n\nI believe that Portfolio Recovery Associates is in violation of The Fair Credit Reporting Act ( FCRA ) Section 623 by reporting this disputed account to credit reporting agencies after being informed ( multiple times ) that the information is inaccurate. In addition to what I told Portfolio Recovery Associates multiple times, they also have access to my credit history and dealings. When opening the account, I transferred {$1000.00} to my account. On XX/XX/XXXX and XXXX, XXXX, I transferred two rounds of {$100000.00} each from my XXXX account to Citibank totaling {$200000.00}. Shortly after transferred {$10000.00} out of my account to XXXX XXXX. This left me with {$190000.00} sitting in my Citibank account. \nTo my surprise, on XX/XX/2022, I received written notice that my account was being terminated by Citibank and that all funds would be returned to me within XXXX business days. Despite making numerous calls to Citibank and speaking with different agents about why this occurred, I was given conflicting information each time, causing further confusion and concern. \nOne agent falsely claimed that the Citibank couldnt verify the transfer and had returned my {$190000.00} money to my XXXX account. Another agent claimed that the transferred funds were not under the same name as my Citibank account, so Citibank never accepted the money from the ACH transfer in the first place, which was also untrue. A third agent informed me that my account was under investigation by a third party, which was a surprising development. A fourth agent told me that I would not receive my {$190000.00} back. After the 60 business day mark passed, I still heard nothing and it was only when I called again that an agent told me they would escalate the issue. Despite this, I have still not heard any further updates from Citibank and my money has been frozen by the bank for almost XXXX months at this point. To date, the only confirmation I have received that Citibank even still possesses my money ( despite what customer service agents told me ), is through a Form 1099 that I received from Citibank in the last few weeks with interest income paid to me from my savings account. \nI have also discovered that I am not the only person who has faced such issues with Citibank this is a pervasive issue. I found numerous complaints online from customers who have had their accounts terminated without valid reasons, and with little or no information about the status of their funds. Some consumers have lost access to their money for more than XXXX  months. \nI am now requesting that Citibank return my hard-earned money, which totals {$190000.00}, with interest as soon as possible. The stress and worry caused by this ordeal have been immense and unacceptable, and it is unacceptable that Citibank has not provided me with clear and consistent information regarding the status of my funds or in their investigation process. Being custodians and trusted intermediaries of public money, Citibank is bound to be transparent and accountable to its customers, and they have utterly failed. These commitments have not been honored. As of now, multiple promised callbacks have not occurred, and no supervisor has contacted me. \n\nThis pattern of behavior has made it extremely difficult to resolve the issue and raises concerns about whether I am being intentionally delayed or cycled through a process without any real intention of resolving the matter. \n\nAt the same time, the original issue remains unresolved. I continue to be told that my bank statements are being rejected for inconsistent and shifting reasons, despite the fact that they were downloaded directly from my banks official portal. My financial institution has confirmed that the format of these statements is standard and that certain requested details, such as full account numbers, are not included for security reasons. \n\nI have now made numerous attempts to comply, including multiple document uploads and repeated calls, yet I am still being denied access to my funds and am unable to close my account until this issue is resolved. \n\nAdditionally, I have identified other customers experiencing the same issue, including identical rejection language and repeated resubmission cycles. This indicates that this may be a broader systemic issue rather than an isolated case. \n\nAt this point, this is no longer a customer service issue. It is a failure of process, communication, and resolution that is directly impacting my ability to access my own funds. \n\nI am requesting immediate escalation and resolution, including a clear and consistent explanation of what is required, and the removal of any restrictions once valid documentation has been provided. Through discussions with other individuals on public forums and online chat groups, I have identified multiple customers who are experiencing the same issues I am encountering. Specifically, they report identical document rejection reasons, repeated requests to resubmit valid bank statements, prolonged delays, and lack of follow-through from customer service, including missed supervisor callbacks. The consistency of these experiences strongly suggests that this is not an isolated incident, but rather a broader systemic issue within American Expresss verification and account handling process. Our money is being held by American Express, violating consumer laws with no clear explanation. I have never lived in or even visited Florida. Tax and real estate records will prove this. I explained to her that the bank account was opened online and because it was opened online it was an electronic signature which is basically the process which Bank of America does when accounts are opened online, most banks do not have the option to open an account online however Bank of America does have the option and the same way they can hold you liable for paying your credit card based on electronic signature this is nothing different than that. Despite the fact that I have withdrawn cash from my account several times before it was closed and therefore it was simply torture which they obviously do not care and to be honest I do not see why they should care after all the financial industry is one piece of fraud which is why the Consumer Financial Protection Agency was created. \n\nAfter hundreds of phone calls and I mean hundreds and probably more, and the good thing is or phone calls are being recorded and monitored which means the cfpb can request them just to see what they did to me. I hung up and called another representative and the other representative told me your account is already closed and we already mailed out a check. A day later I log into my account and I see it 's still open I called in and they told me your account is pending closure and we suspect for old and we need you to go in that banking center to identify yourself. And I do n't want to go into all the XXXX phone calls which I literally was busy with for over a month XXXX hours a day and every representative gave me different information, I have no clue what 's going on I could n't focus on my business I could n't deposit checks I could n't do anything I was in extreme XXXX and it 's not possible for no money in the world for Bank of America to make this up to me it 's literally not possible for no money in the world what I have accepted the amount of pain they put me through. Then all of the sudden I log into my account and its walls I believe XXXX XXXX and I see that a recurring payment that I scheduled was successfully paid for my account. Which means that the account is not closed yet. I called them again they told me I can go that banking center without any problem even there is no signature on file I can have them release my funds to me in cash. I went that Bank XXXX and again after XXXX hours they told me they are not able to do it. Being the fact that I have nothing else to do with my day and this is the biggest headache I decided to go to a different branch if you miles away and they told me they are able to do it and they started preparing everything and the last minute they backed out. Then I went to different backing Center and they told me all I need to do is sign a signature card and then the next day I can come withdraw the phones on my account. I came the next day and that was not the case. However they chose to take this opportunity and tell me that I will have to wait XXXX  days for them to investigate what happened and after XXXX days maybe if I am lucky they will issue me a new Bank check. Being the fact that every representative tells me something else I do n't even believe that there such a thing of XXXX days and if they will indeed release it after XXXX days. My main concern is the fact that I did not receive the phones and it 's absolutely not acceptable and not moral for them to make me wait 90 days because they need to investigate what happened when it 's not my problem what happened it 's their problem. Again it is Bank of America 's problem the fact that I did not receive the check. And because it is their problem they should immediately mail out overnight shipping a new check to me. They should not put it on me and tell me I need to wait 90 days for them to investigate and I should have a XXXX XXXX during this XXXX days and maybe then they will issue me a new Bank check. There 's no way in the world they are not able to see that it was not cashed and put a stop payment on it and issue me a new Bank check. And even they are not able to do it again, it 's not my problem I went to the banking Center, to be exact I went to approximately 15 different branches because I needed the funds emergency to continue my business, they decided not to give me the back check in the back and Center for my security. But to mail out a check with XXXX that is very secure then they take my security very seriously. But let me reiterate I make it clear it is not ethical and not moral and I do not even believe it 's legal to allow Bank of America make me wait XXXX days when they have a problem. I'm getting absolutely no where with XXXX XXXX, and do not want to get any eviction on my record, I feel as if I am losing control of my finances at this <em>point</em>."]},"sort":[8.192133,"2813298"]},{"_index":"complaint-public-v1","_id":"3377580","_score":8.135828,"_source":{"product":"Credit card or prepaid card","complaint_what_happened":"Amounts of USD {$210.00} on XX/XX/XXXX and amount of USD {$280.00} on XX/XX/XXXX were wrongfully charged to my account. \n\nI filed the first fraud complaint to Bank of America ( BoA ) in XX/XX/XXXX and again repeatedly almost every month since XX/XX/XXXX through XX/XX/XXXX. \n\nI spoke with the BoA fraud department and credit card department at least once per month since XX/XX/XXXX to try and urge the bank to conduct a proper and thorough investigation. They promised me several times that they would contact the store where the card was used to make the fraudulent transactions ( the only information BoA gave to me was that the card was used in person to buy furniture from a chain department store specifically located in XXXX on a date that I was not even in that city, at a store that I had never heard of and had never stepped foot into, certainly I had never bought furniture as a I was a tourist! ). Bank of America closed my fraud case on three occasions stating that they had no proof that I had not made those payments, but without providing me any proof from their supposed 'investigation ' findings ( despite their promise to do so ). Had BoA actually taken steps to conduct a thorough investigation, they could have easily requested the security tapes from the department store which would have shown who made these payments ( since BoA did have information, they told me, that the charges were made using my card and in person at the store ). Clearly BoA did not conduct any significant investigation, else they would have information to share with me about the fraudulent activity, and they would have found evidence that could have protected me, proven that it was not me, and helped ensure my trust in the bank which I have been a loyal customer of for more than 15 years! \n\nAlso, my card was blocked by BoA and only after several months I reported the fraudulent activity many times, did I receive a replacement card in the mail, still it has not been secure for me to use my credit card, especially since BoA did not conduct a thorough investigation and did not provide me with any information about what happened nor information about how I could set up more security to protect me from any potential future fraud on my card ; and thus I have had to suffer from not having the option to use my card -very important for my security in making payments while travelling ( ATM withdraws are very dangerous in XXXX due to the high rate of ATM scams and robberies ), which is difficult as I am a tourist traveling in XXXX XXXX all these months. I asked BoA to put some extra layers of security on my credit card so that we could try and prevent future fraudulent activity but they said to me that there were no options to do so, not even placing a pin number on the card! \n\nI conducted my own research and found several potential reasons for this fraudulent activity on my credit card : ( 1 ) perhaps my card was cloned by someone unknown when I had used it at a restaurant or store to make an authentic purchase previous to the date of the fraud activity ( I hear that this has happened in XXXX ) ; ( 2 ) I had requested BoA to send me new credit and debit cards in the mail last fall previous to the incident because my cards ' chips were scratched and not able to be read in swiping for payment in card readers -BoA was supposed to send me a replacement card and I hadn't received it, so I called to complain last fall and I think what they did was maybe send another card after my complaint but in the meantime maybe the first replacement card they sent was not cancelled by BoA and then maybe arrived to some location in XXXX without my knowing. I had asked BoA to cancel their first replacement card sent, and to send me a new one with new security details ( with a new credit card number ) so that it was not a 'replacement card ' / 'copy ' but rather a new card with a new number, but I think BoA failed to make this security assurance and perhaps two cards arrived in the mail to XXXX with one being stolen by some other person.. ; ( 3 ) perhaps this was part of a larger BoA scam from within the company. Regarding this last point, I am not accusing BoA of frauding my account, but it does not rule out the possibility of this happening. I looked at the consumer complaint database on the CFPB website, using the filtration system, I searched for complaints against BoA for credit card fraud / wrongful charges on customers ' credit cards, and found about 200 of 1,384,105 reported complaints similar to mine. This said I would want CFPB to conduct an investigation to find out why so many customers of one of America 's largest and important banks all experienced the same thing? \n\nOn top of all of this, BoA made me feel like a criminal as they accused me of making the fraudulent payments when I called them on the phone on several occasions. \n\nI had to undergo extreme financial stress as I didnt have access to using my card all those months, I underwent emotional, psychological trauma and in consequence personal problems in my relationships and this also affected my ability to work. I also underwent financial and time loss as I had to call BoA and wait for hours on the phone, I was consistently disconnected and had to call again and again waiting for 40 minutes each time to reach a representative, then disconnected when transferring me to different departments.. It was a living nightmare of 8 months that I experienced because of BoA 's negligence, accusatory behavior, failure to be organized and take seriously a fraudulent case against one of its loyal customers, failure to help a customer set up security and prevent fraud. \n\nAll this while I have been in a serious semi / permanent health condition suffering serious injury to my XXXX and I told BoA on the phone each time every month that I had to wait and struggle with them, that all this stress was causing my physical condition to worsen, but they did not give me any care for my XXXX by speeding up the process or taking extra care to reduce my pain and stress. I have suffered further from my injury because of the disrespect of BoA towards me in failing to put care into my case. \n\nI first filed a complaint against BoA with CFPB in XX/XX/2019 and BoA responded to CFPB 's letter to BoA regarding my case with refunding me the money. However, this is only half justice, I suffered so much for 8 months because of BoA incompetencies and maybe corruption against its customers. I am writing to CFPB asking for help with the following : 1. please write to / contact BoA to give them the chance to do right on their wrong towards me in not providing me with information from their investigation findings that shows evidence on what exactly happened with the fraud case on my card. I was promised by BoA that they would do this and inform me of findings, but they never did so and never communicated any findings to me. They simply accused me of making those payments without any proof either way..\n\n2. I want to file a suit against BoA and know that CFPB does not provide legal advice in any way, however, I would ask CFPB if it could provide any further information about those 200 cases of consumer complaints against BoA, all of which were for wrongful charges on their cards, just like mine. I would want to know when exactly those other credit card fraud cases happened ( were they during similar times as mine -I put in a filter on timing ranging dates similar to those I experienced fraud ) ; I would also want to know more about those cases, whether they received refunds, whether the banks gave reason and proof /evidence from their investigations.. Conveniently, this action began soon after the interest rate environment made the interest rate locked for that adjustment undesirable to WFHM. It remains an open question as to how much this nefarious behavior by WFHM has expanded since the interest environment provided the bank with a string profit motive to do so. \nFurthermore, the banks errors and mishandling of my case demonstrate the banks continued activity flouting the requirements laid out in the XXXX XXXX Summary judgement against WFHM ( XXXX ) First some established facts : 1. I am a proven good faith actor : I have a perfect track record in making payments and providing documents and responses over 8 year 2. WFHM is an actor with a track record of consumer abuse, fraudulent and negligent behavior with numerous class action and regulatory actions against them. In the course of this one case, WFHM has missed committed deadlines and created long delays in at least 4 different incidents WFHM is guilty of several wrongdoings : 1. Failing to abide by our mortgage adjustment agreement by countersigning and allowing execution of the contract. This was despite clear actions that bind us in our contract : a. Having a verbal commitment from me as an identity-verified counterparty on a recorded call stating for the record that I have absolute intent to sign, notarize and send in this contract, and a confirmation by WFHM that the sending of said contract represents a commitment to that contract under law. WFHM has established numerous oral agreements with me for years, so the precedent and expectation had been set. \nb. Cancelling the mortgage modification on false and/or grossly unjust pretenses : i. Cancelling the mortgage adjustment for lack of a signed contract despite being in possession of the signed notarized contract at the time of cancellation. on XX/XX/XXXX because they had not received the contract by that time. My XXXX tracking data indicates the package was sent guaranteed 2-day A.M. delivery on XX/XX/XXXX. The package was not accepted by WFHM until XX/XX/XXXX. 2 days later, WFHM cancelled the mortgage adjustment even though they possessed the signed contract ii. That contract had already been sent to WFHM back in XXXX. The contract was notarized on XX/XX/XXXX by a notary AT a Shipping store. While I do not have tracking info for that package, it is clear that WFHM had a contract that had been signed and notarized back in XXXX when they cancelled the mortgage adjustment. \niii. I received no communication indicating that we were at risk of missing a new deadline before that deadline had passed. I called WFHM in XXXX, weeks after sending the contract, which was the conversation where I learned they had not received the contract. They never attempted to notify me of this. Once I learned this information, I verbally committed to the contract and committed to sending the contract. I did then suffer a series of health crises, including escalating XXXX pain from a Long XXXX condition that required immediate XXXX XXXX  XXXX. WFHM I claims to have sent a notification that the final deadline for submitting the contract was XX/XX/XXXX. If I had that communication, there is no way that I would have sent the package 2 day. I would have overnighted it. I did not learn if this deadline until a mailing I received ion XX/XX/XXXX. At that point, I immediately called WFHM, as their recorded calls will support. WFHM has no evidence that I received any notice of such a deadline. From my perspective, they somehow lost the first contract, I committed to sending a second, and I did so. 2 weeks later, they communicated a backdated deadline I could not possibly meet 2. Representing delayed written communications, delays in their processing of incoming mail, and failures to receive signed notarized documents as lost in the mail or never sent despite clear evidence of massive delays in their processing of incoming mail. Yet asserting that all of their mail would have arrived on a timely basis, despite us not having received crucial information about contract deadlines 3. Failing to respond on a timely basis to complaints about these issues in a manner violating the OCCs requirements Banks failure to timely detect, prevent, and quantify inaccurate loan modification decisions and failure to fully and timely remediate harmed customers. This included a. the escalation process is 2 months and counting, despite repeated commitments that it would be resolved earlier b. failure in 4 incidents to meet committed turnaround times when escalation complaints were submitted. \n4. Providing misleading information and unreasonable delays to create a payments crisis situation for customers : a. WFHM has still not made its decision, but has already begun sending default notices. WFHM refused to move that deadline despite repeated processing delays. I will have AT MOST 7 business days to come up with $ XXXX to make the account current, or face default proceedings. Even if I can manage to do so, it would require incurring massive cost in equity value losses and tax expenses. It will force me to drain my 401k/IRA retirement savings prematurely during a down market. Even then, the lead time may not be enough to liquidate assets, transfer the funds b. WFHM case manager represented on a recorded call they would offer to spread that $ XXXX of accrued mortgage payments due to COVID forbearance /Natural Disaster over 6 months. 2 weeks later, once I trioed to set up a payment plan they reversed course and declined that option 5. Committing financial institution negligence - failing to respond to my complaint, and failing to respond to all key elements of that complaint. They actually falsely lead me to believe that they were evaluating my complaint all along that time, and still have not directly responded to most of the contents of this complaint. I gave 3 primary reasons why they were at fault : ( 1 ) UPS tracking # proving their receipt of the contract before cancellation ( 2 ) oral commitment to the contract ( 3 ) the fact that I had mailed in the contract back in XXXX from a mail store where we were physically present, since they were our notary. After two months their response did not address a single one of these issues. '' On XX/XX/XXXX, EMPLOYEE ID : XXXX- XXXX said she couldn't find me in the system because her computer froze. She found me after another attempt. She said, \" I'm going to send you over to the \" SPECIALIZED DEPARTMENT '' that would be able to assist you since I'm from customer service... I'm not able to pull up the account ; they would be able to pull up the account. '' I doubt this department 's mission is to make the consumer feel special. \n\nOn XX/XX/XXXX at about XXXXXXXX XXXX, EMPLOYEE ID : XXXX - XXXX stated that she couldn't find me in the system and had to refer me to another department. EMPLOYEE ID XXXX - XXXX from the \" SPECIALIZED, PLATINUM SERVICES, CEASE AND DESIST DEPARTMENT '' stated I do not have an account after I provided her the account number ending in XXXX. \n\nSCUSA has furnished statements and other communications to coerce me into believing I am participating in repaying an alleged obligation that is not mine. 15 U.S. Code 1692j - Furnishing certain deceptive forms. Below is the only means of communication a debt collector is supposed to have with me, as prescribed by the United States Trustee, Congress. \n\n15 USC 1692c ( c ) Ceasing communication If a consumer notifies a debt collector in writing that the consumer refuses to pay a debt or that the consumer wishes the debt collector to cease further communication with the consumer, the debt collector shall not communicate further with the consumer with respect to such debt, except ( 1 ) to advise the consumer that the debt collector 's further efforts are being terminated ; ( 2 ) to notify the consumer that the debt collector or creditor may invoke specified remedies which are ordinarily invoked by such debt collector or creditor; or ( 3 ) where applicable, to notify the consumer that the debt collector or creditor intends to invoke a specified remedy. \nIf such notice from the consumer is made by mail, notification shall be complete upon receipt. \n\nBased on the dates on the face of the envelope, the communication is willful and knowing at this point. In XXXX, I bought my first home located at XXXX XXXX XXXX in XXXX, MA ( XXXX ) and Ive lived there ever since ; this is my mailing address as well. WIthout any notice, the mortgage companies changed a few times through the years with the last one being NationStar dba Mr. Cooper and thats when my nightmare began. \n\nBack in XXXX, a modification was offered and approved. I successfully completed the trial period and for no reason and without an explanation, they then denied it. I refused to pay the new slightly higher mortgage payments until they honored the modification agreement. Trying to get anybody to speak to me to straighten out the modification issue was impossible. I gave up and when I tried to pay the mortgage payments I had missed, they refused to accept them. Shortly after, I got a foreclosure sale notice in the mail from Mr. Cooper. Mr. Coopers unjustified and unnecessary actions forced me to get legal representation and to file bankruptcy when I shouldnt have had to. Im a teacher and I live paycheck to paycheck and what I had to do to save my house ruined my credit and ruined me financially, which to this day I still havent recovered. The emotional pain and suffering that I have endured since is immeasurable. \n\nDue to the constant stress I was under, I couldnt focus, I was sick often and I was unjustly let go of my job of 17 years as a teacher in the XXXX. Even though the Unemployment Dept reversed my employers decision, the damage was done and it was about to get worse. The unemployment benefits were only a percentage of my salary and I couldnt keep up with Mr. Coopers payment demands. Against everyone 's advice, I withdrew my retirement benefits early to pay for what I owed. Not only did I lose every cent I had saved for my retirement but I lost about {$35000.00} during that transaction due to penalties related to the early withdrawal. I was honest with the Unemployment Division and when I told them that I had withdrawn my retirement benefits, the benefits ceased. I guess they considered my retirement benefits as income. I probably couldve contested their decision but I was too emotionally drained to fight it and in all honesty, they came through for me when I needed it the most so I just let it go. This was the lowest point of my life and Mr. Cooper continued to push but I managed to pay for every cent I owed up to that point and more afterwards ( I have copies of the checks ). \n\nMy payments altogether total about $ XXXX. To make matters worse, the $ XXXX went missing ; that money was never credited to my account which Ive come to find out seems to happen a lot with Mr. Cooper XXXX My lawyer even missed that and when I pushed him to question them, Mr. Coopers lawyer admitted to it. While Im very surprised that he admitted to their oversight, I dont buy it. To me, missing one payment may be considered an honest mistake. Missing crediting my account on six different occasions ( or more ) is no different than illegally withdrawing money from borrowers without their consent, one of the many charges Mr. Cooper has been found guilty of. I have no idea where that money is but thats one of the stipulations that need to be clarified in the settlement.\n\nI believe during or shortly after Mr. Coopers big indictment in XXXX, XXXX XXXX approached my lawyer to negotiate a settlement. A whole year went by and nothing happened. XXXX XXXX didnt contact my lawyer and my lawyer didnt follow up to him either until I insisted. My lawyer finally sent XXXX XXXX a short letter on XX/XX/XXXX and XXXX XXXX responded shortly after, on XX/XX/XXXX, saying that he would get back to him soon. And that was almost a month ago? He has already taken another month to reply and before that he took over a year! What can I possibly do at this point? I dont know if taking months, a year to respond is standard procedure in this type of case and/or amongst lawyers but as my level of anxiety keeps rising, I dont know how much longer I can wait. I dont trust Mr. Cooper - Im scared that they will take back what they said they would include in their settlement, and attempt to force me out of my house again. Their MO is so predictable! and they continue acting this way because they know they can get away with it when their accuser '' is somebody like me, a divorced teacher with no legal representation, and no direction.\n\nAnd thats where Im at with this part of the case. I may be wrong but I dont think their lawyer is going to get back to me any time soon, especially knowing now that Im no longer represented. XXXX XXXX from the DOB suggested I file a complaint through you and I truly hope you can assist me.\n\nLike I said, for years, we have tried to reach an agreement with Mr. Cooper so things can go back to normal but nothing has gotten done, for one reason or another. In order for me to agree to a settlement, Mr. Coopers lawyer would have to 1 ) agree to honor the modification they had agreed on almost five years ago and later withdrew 2 ) pay my former lawyer XXXX XXXX legal fees ( they kind of agreed to that but they don't know the amount ) and XXXX ) offer monetary compensation for my emotional distress. 4 ) He would also have to put in writing that they have waived the mortgage payments in arrears ( he also agreed to that as well but I obviously want him to agree to an amount and put it in writing along with the other conditions ) and 5 ) deposit my $ 33k ( approxly ) into an escrow account or apply it towards my mortgage balance ( as they were supposed to but never did ). \n\nUnfortunately, there is more to complain about. Back on XX/XX/XXXX, my kitchen caught on fire. The kitchen was destroyed and the smoke and soot went all over the house. Ive been living in a hotel since then and its been the opposite of Heaven. Here we are, 9 months later and my house is still not fixed because XXXX, a subsidiary of Mr. Cooper has simply decided to keep the money. Not only they havent released any of the funds but they havent given me an explanation as to why they are doing that either- is that even legal? \n\nThe check from the insurance company I received in XXXX to repair my home was made payable to me and Mr. Cooper. Based on their track history of losing money, I didnt want them to have the check. I tried asking them to endorse it so I could keep it but they refused. I tried to figure out other options with XXXX and that didnt work either. When I asked XXXX XXXX for information about where to send the check, he told me to just send it to him and that he would figure out where to send it. I refused and demanded to have in writing the name and contact info of whoever would be handling my case and a description of their claim procedures. I never got any detailed information from XXXX XXXX about their procedures ; all he gave me was the name XXXX and the address and that took months! Assurants addresses are : Regular Mail Overnight Mail Mr. Cooper Mr. Cooper Attn : Loss Drafts Attn : Loss Drafts XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX, OH XXXX XXXX, OH XXXX Ph # XXXX While waiting for some kind of response from XXXX XXXX, the original check from XXXX expired and I had to contact the insurance company to get another check issued. XXXX was not aware that the home repairs had not yet begun and needless to say, they were appalled. Thats when I was notified by XXXX that my ALE benefits that are currently paying for my hotel stay while my house was supposed to be getting repaired will be terminated at the end of XXXX. Since five months had already passed at this point and with the fear of becoming homeless soon, I felt I had no choice but to send the check to XXXX and hope for the best. \n\nOn XX/XX/XXXX, I reluctantly forwarded a check in the amount of {$26000.00} to XXXX. As I mentioned earlier, this check was issued by XXXX with the sole purpose of repairing the damages done to my property by the kitchen fire. Along with the aforementioned check, I included the insurance repair estimates, the contractor 's report and a Declaration of Intent to Repair form. As its their usual tactic to delay things, they asked me yet for another Intent to Repair form through their website. I immediately filled it out and submitted it and I still havent heard from them once ; not a letter, not a phone call - nothing. Ive also been checking their useless website for updates and there is nothing there either. Not only it doesnt have an updated status but the information is contradicting and deceitful. In one section, it says Were going to take you to Step 3 : Receive Partial Claim Funds. Then the next screen says : Claim Funds Sent to you but when I scroll down, in smaller print, it says funds not yet sent. Again, no explanations. ( I have pictures of the screens ). \n\nI decided to call their Customer Service Dept and that was another nightmare in itself. One of the many reps I spoke to informed me that none of the Customer Service reps could discuss the case with me because my case is coded LITIGATION. Nobody can discuss the case with you, she said. My own case! She then proceeded to give me a list of generic emails to file complaints about Mr. Cooper to Mr. Cooper ( the links on the website to file a complaint, www.mrcooper.com/legal/complaints, don't even work! I also have the pictures of the error messages. ) When I demanded the name of someone with authority that I could speak to about my case, she simply replied that she had no names to give me. This is all so unfair, so wrong. I have never encountered a situation like this where a company wont inform me of whats going on with my own claim and then tells me that theres nobody I could speak to about the situation! \n\nI tried to explain to the CS rep that there is no litigation '' going on, that Ive been involved in a serious situation with Mr. Coopers Mortgage Division for the past 4+ years about a shady modification offer and an unjustified attempt to foreclose on my home but that we are not battling it in court nor am I being represented by a lawyer. I explained further that negotiations for a settlement with Mr. Coopers legal counsel XXXX XXXX XXXX, XXXX on the mortgage case have begun and that I hoped to reach a final resolution soon, one way or another. My explanations didnt matter ; she just kept saying file a complaint with Mr. Cooper . I cant waste my time with Mr. Cooper aymore so here I am, I decided to file my complaints where they matter and where I may have a chance to get some kind of resolution. \n\nAs I mentioned above, my insurance company will no longer pay for my hotel stay after XXXX which means Mr. Cooper is pushing me into homelessness once again. To avoid this from happening, my house would have to be deemed safe and livable for me to move back in and the only way to accomplish that is if the contractor starts working on my house now and finish all major repairs within a very unrealistic short amount of time and with non-existent building materials or appliances as I havent been able to order any of them. And thats if he is available to work. He has been waiting to start this project since I got the first check back in XXXX. Being aware of the situation and Mr. Cooper 's reputation, my contractor will not do any work until I can confirm that the entire {$26000.00} is available to him and that there will be no more issues if and when additional funds are needed. And the same goes for any contractor in the area. \n\nWithout that money, my house wont get repaired - plain and simple. And their unjustified and intentional delays have not only affected everybody involved but the condition of my home continues to deteriorate as its still covered with smoke residue and soot. At this point, when so much time has passed and nothing has gotten done, a partial disbursement or half of the funds now and the second half later is not acceptable. The entire amount is needed now to complete all the major repairs at once and as fast as possible. ( 6 ) They also need to have the LITIGATION code removed from my claim case immediately. ( 7 ) This is something Im sure Mr. Coopers lawyer could request but Im even more sure that it wont happen unless somebody with more knowledge and power intervenes on my behalf. \n\nBecause of the pending settlement negotiations, I have taken a closer look at my case and I was really embarrassed because Mr. Coopers deceptions were very obvious from the beginning and a more aggressive approach shouldve been taken. I started doing my research and thats when I realized that what Ive experienced with Mr. Cooper, thousands of consumers have gone through it as well : the shady modification offers, unjustified foreclosures, repetitive requests for the same information, lost documents/payments, among other unfair and deceptive practices. To their long list, I can add failure to communicate ( a year+ on one case and 60 days on the other ) and misappropriation of funds, for wrongfully keeping the insurance funds that I need to repair my home. I hope you can help me put an end to this nightmare once and for all!
