Despite having them fully paid off and the account being closed. Right after they were Paid and Closed, Nelnet continues adding more inaccurate information of late payments including claims of 30, 60, 90 and 120-day late payments from over 10 years ago. These reports are false, and Nelnet refusal to provide any evidence to substantiate these claims demonstrates their negligence and bad faith. \n\nI have disputed these inaccuracies more than **40 times** with both the servicer and the credit reporting agencies, yet the service provider refuses to correct their erroneous reporting. Fair Credit Reporting Act ( FCRA ) 15 U.S.C. 1681 : Section 1681s-2 ( b ) : The servicer is obligated to investigate disputes and remove or correct inaccurate information. Their failure to comply with this requirement, even after numerous disputes, constitutes a violation of federal law. \n- Section 1681e ( b ) : Credit reporting agencies are required to maintain accurate credit files. Despite the servicers false reporting, the credit bureaus have failed to remove this information.\n\n2. Truth in Lending Act ( TILA ) 15 U.S.C. 1601 et seq.\n\n- The servicer is responsible for providing accurate information regarding the terms and status of my loan. I was hospitalized and, following discharge, placed in a rigid neck brace and ordered to remain on extended bed rest. During this period, I was physically unable to perform basic daily activities independently, including driving, working, or managing financial obligations. I relied heavily on friends and family members for essential care. \n\nBecause of this medical incapacity, I was unable to manage my student loan payments or consistently receive and respond to account communications and mail. This resulted in missed payments that were later reported as delinquent to credit bureaus, causing approximately a XXXX point drop in my credit score and contributing to housing instability and financial hardship. \n\nAfter recovering enough to address my financial situation, I contacted Nelnet to request hardship assistance. Nelnet eventually placed my loans into forbearance, acknowledging my financial hardship. However, Nelnet refused to retroactively apply hardship forbearance or review the credit reporting impact that occurred during my medically documented incapacity period. \n\nMore concerning, Nelnet representatives informed me that they are not allowed to request goodwill credit reporting adjustments or reconsider credit reporting unless the borrower was either actively enrolled in school or serving in the military. I have a recorded call documenting this statement. \n\nI believe this information is misleading and inconsistent with federal student loan servicing requirements and consumer protection laws. Under the Dodd-Frank Act ( 12 U.S.C. 5531 and 5536 ), student loan servicers are prohibited from engaging in unfair, deceptive, or abusive acts or practices, including misrepresenting borrower relief options. \n\nAdditionally, federal regulation 34 CFR 685.205 allows servicers to grant discretionary forbearance when borrowers are experiencing financial hardship or other acceptable circumstances, which reasonably includes documented medical incapacity.
