I have a certified letter from XXXX XXXX XXXX stating that they verified my credit information is being reported correctly and to all three credit bureaus. \n\nIf your agency can help it would be greatly appreciated because this matter is greatly affecting my ability to get any credit. On XX/XX/XXXX, I created an account on the Rushmore website and viewed the invoice for my first mortgage payment to Rushmore. The invoice was for {$740.00}, due by XX/XX/XXXX. \nI attached a screenshot of that invoice page to this complaint. \n\nIn XXXX, I timely paid the {$740.00} amount due. \nEvery month after XX/XX/XXXX, I have paid the mortgage payment to Rushmore, in full, on time. \nI never missed a payment in any month, and never made a late payment.\n\nI attached a screen shot of my Rushmore payment history to this complaint. \n\nDuring XXXX, XXXX, XXXX, XXXX, and early XXXX of XXXX, Rushmore never sent me any message or notice of a late or missed payment. Since I was paying the mortgage every month, I had no reason to think anything was wrong. \n\nIn XXXX XXXX, Rushmore began sending me notices that my mortgage payment was late. I had never missed a payment, so I assumed that Rushmore made an accounting error, and I began to communicate with Rushmore, explaining that I never missed a payment, and they needed to fix this problem. \n\nDuring XXXX, XXXX, and XXXX, I created XXXX different tickets on the Rushmore Customer Service page asking for resolution of this problem.\n\nEach time, Rushmore responded with a message that I did not need to do anything else at this time, and, that their Research Team was investigating the problem.\n\nI attached screenshots of those chat messages to this complaint. \nI never received any response, explanation, or resolution from the Rushmore Research Team in XXXX, XXXX, or the first three weeks of XXXX. \n\nHowever, beginning in either XXXX or XXXX, without my knowledge, Rushmore began to report to credit agencies that I was 30 and 60 days late on my mortgage payment. I did not know Rushmore was doing this until my bank informed me that new items had appeared on my credit report. \n\nRushmore 's actions were unethical, misleading, unfair, and damaging to my credit rating.\n\nI paid my mortgage on time, in full, every month.\n\nEach month, I paid the amount that Rushmore said was due.\n\nWhen Rushmore began to say that I missed a payment, I worked in good faith to resolve the issue with Rushmore, and Rushmore 's replies to my tickets assured me that I did not need to do anything else until I received a response from the Research Team, which never came. \n\nIf a lender tells a borrower to wait while the lender investigates a billing problem, but the simultaneously reports the borrower as being late on payments, that is unscrupulous conduct. It is unfair and harmful to consumers. \n\nIn XX/XX/XXXX, during a phone call with a Rushmore CS agent, we discovered that the source of the problem was the mistaken information on the very first Rushmore payment invoice from XX/XX/XXXX. That Rushmore invoice should have informed me that the amount due by XX/XX/XXXX was a double-payment of {$1400.00}, for XXXX and XXXX. \n\nAfter the XXXX phone call revealed the problem, I made XXXX XXXX mortgage payments to Rushmore to bring my account current, and then I made a timely payment in XXXX. The payment issue has been RESOLVED. \n\nRushmore did not discover their billing error for almost five months. From XXXX through XXXX, Rushmore never mentioned a late or missed payment. \nIn XXXX and XXXX, they still did not mention any XXXX payment, they only told me that I missed a payment, to which I responded that I had never missed a payment in any month. \n\nWhen I asked them to fix the problem, they said they would investigate it and told me to wait until I heard back from the Research Team. But without my knowledge, they also started reporting my mortgage payment as 30 or 60 days late. UNETHICAL AND UNFAIR PRACTICE! \n\nIf I was paying the mortgage every month, how could I be 30 days late? \nIf I was paying every month, it is impossible that I was ever 60 days late. \nIf they told me I didn't need to do anything else while waiting for a finding from their Research Team, how could I be late on a payment? \nIf their XXXX, XXXX, XXXX, and XXXX invoices all told me to pay {$740.00}, and I paid that amount each month, how can Rushmore say I was late if I was timely paying the amount they told me to pay? \n\nI never received any message or mailing from the Research Team until late XXXX, after the billing issue had been resolved. I feel since the correct signed reaffirmation paperwork was submitted to them by at least XX/XX/XXXX and the bankruptcy wasn't discharged until XX/XX/XXXX that Wells Fargo Home Mortgage had plenty of time to file the reaffirmation to the court and therefore should be reporting my credit to the credit bureaus retroactively for XX/XX/XXXX payment to present which have all been on time or within the banks 10 day grace period since I may pay from my bank on the due date and Wells Fargo may not post it for 2 to 3 days. Each time we have contacted them regarding this issue, they say they are investigating the problem and come back after at least a month and say it's my problem, no one told me it was on someone's desk for 2 weeks, no such phone call took place and they will not report my payments to the credit bureaus. This is how I pay my mortgage since origination. I always make online schedule payments to be paid to my account but in this particular situation, I requested payment to be made and those payments were canceled due to the fact that my bank without prior notification, closed any access to withdraw or deposit to this account due to the fact that there was an intrusion. My banks fraud department proceeded to investigate.\n\nFraud packets were sent to the credit card agency as well as my mortgage company. Also there was two letters from my bank taking ownership for prematurely do an emergency freeze of my accounts without prior notification. This action was historical to my account and was out of the ordinary if you look at my baking history.\n\nI requested my mortgage company to update this information. And I sent in the documents that they requested so that they may review it. Before the documents could even be received by the mortgage company , the mortgage company responded back stating that the information was accurate. Without the documentation from the banks I find that very difficult to make this determination.\n\nI also have an issue with the fact that this mortgage company servicer, stated that they received the documents even though they did not. This means that no investigation was conducted because there was no documentation received in order to review. Undoubtably this mortgage servicer did not complete a proper investigation into my request. The credit report Nac did not conduct a proper investigation if they did not have the documentation from the mortgage servicer to make a proper decision. These companies are just making decisions and not actually going through the actual process of review. This is unfair to every consumer who puts their faith in a mortgage service provider to do the right thing and to actually investigate and review request by the consumers. A few weeks later we receive a letter from Chase telling us our account is delinquent. That XXXX of the checks, my check from my XXXX account, was an ISF check. I knew that was a lie because I had the funds to cover my check plus {$6000.00} worth of overdraft protection. More than enough to cover a {$770.00} check. I started to investigate and saw that our mortgage account was credited for the full payment on XXXX XXXX 2015, and then 6 days later it was reversed and labeled a \" Misapplied Payment. My wife noticed her check cleared her account but my check was never presented to XXXX for processing. I called the Chase help desk and explained that my check was not an ISF check and asked where my check was. No one could tell me. They also said an investigation can take three weeks. I asked to speak with Supervisors and went through XXXX individuals, the last of which changed the alibi from a ISF check to that XXXX refused to process the check. XXXX told me my check was never presented for processing. Still no sign of my check. Now Chase hit my credit report with a negative post as being Delinquent. My credit rating went down by XXXX points from an \" Excellent '' to a \" Good '' rating and all of this without any indication of what happened to my check that was handed to a teller at Chase branch in XXXX New York. Meanwhile Chase had my wife 's check of {$770.00} and did not credit our mortgage account with those funds. I finally reached an Assistant Vice President by the name of XXXX XXXX. Within an half hour she saw that it was a Bank error and told me the scanner at the branch was not able to read the numbers on the check accurately and the teller should have realized the problem right away. XXXX XXXX told me that Chase would reverse all negative postings to my credit report and that all I needed to da was provide Chase with another check, which I did on XXXX XXXX, 2015. \nHow can a bank hit your credit report in a negative manner without even concluding an investigation? I have heard stories of people have major problems with correcting errors on their credit report, is Chase going to help me with this problem if it occurs. Chase should be fined due to their lack of professional behavior with this issue. Labeling my payment as an ISF entitled them to collect fees and this was the first excuse for the problem which turned out to be an error on the banks part. Up to this date, I still do not have my original check, copy or hard copy. Should I put a stop payment? Is Chase going to pay the fee for the stop payment? Ridiculous, the public bails out these banks and they continue to behave in a way that only is to their benefit.
