XXXX XXXX XXXX, XXXX were unlicensed in the State of Nevada to do mortgages. Per the State of Nevada Department of Business and Industry Division of Mortgage Lending. They were operating illegally to process mortgage transactions, deed of trust, promissory notes and all the above mortgage documents. This may render all the above mortgage documents null and void. Unlicensed dealings in loans are prohibited : XXXX XXXX. These companies acted without malice to defraud, materially misrepresent, mislead, falsify and forge my signature on ( Good Faith Estimate, Truth In Lending Disclosure, Borrower Signature Authorization and Notice to the Home Loan Applicant ) mortgage documents causing Mortgage Lending Fraud NRS 205.372.. They are in Violation of the SAFE ACT Secure and Fair Enforcement of Mortgage Lending 2008 12 USC Chapter 51. For being an unlicensed broker, lender, and processor of mortgages. They have violated State, Federal and HUD laws Nationstar Mortgage is the current servicer of the loan and is attempting to do a wrongful foreclosure. We have been through 5 mediations over the past 11 years with XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX and Nationstar Mortgage. None of the above were able to give a loan modification, principal reduction, or short payoff. But the lenders and servicers continue to use deceptive, fraudulent business practices to violate our lending rights. They state that XXXX XXXX XXXX XXXX XXXX is the current investor of the loan, but they have an assignment from XXXX XXXX XXXX XXXX Nationstar Mortgage as the last assignment on record. There is NO assignment from XXXX XXXX XXXX XXXX XXXX to Nationstar Mortgage. Causing a cloud on the title. Nationstar Mortgage is in breach of contract, breach of the implied duty of good faith and fair dealings. There are multiple issues that have led to XXXX XXXX XXXX XXXX XXXX XXXX 's fundamental inability to foreclose on the underlying note via the recorded Notice of Breach and Election to Sell. The original offer was for the full price and the seller would pay {$8200.00} of my closing costs. The appraisal came back lower than the asking price and the seller countered with accepting the lower price but wouldn't cover any of the closing costs. I accepted that offer. My broker was upset about this but I couldnt figure out why. He then took a break for a week, immediately before our scheduled closing date of XXXX XXXX. He said he was going to be unavailable at all that week because he was going to be in the woods with no signal. When he returned he admitted that he couldve had me close on time if he hadnt gone offline for a week. \n\nAs he was acting as an agent of Carrington Mortgage, they wouldn't allow me to speak with anyone there. I was informed that the broker was the only person that I could address any of my concerns with. \n\nMy original closing date was XXXX XX/XX/2020 but was pushed back again and again until we finally closed on XXXX XX/XX/2020 ( 60 days exactly from when I submitted the offer ). During the back and forth with the broker regarding information that he had already been sent, I received a number of Closing Disclosures varying in cash to close of anywhere from {$2600.00} to {$19000.00}, finally settling in at XXXX after being told by the mortgage broker on XX/XX/2020 that my closing costs would be {$5900.00}. My final Closing Disclosure, which increased my cash to close by over {$300.00} that had to be wired from my credit union or in a cashiers check from my credit union account, was sent to me on XX/XX/2020 at XXXX ( EDT ) which was less than 24 hours before closing. \n\nI had asked repeatedly to have the discount points explained to me to no avail. Eventually one of the people at XXXX XXXX Mortgage did admit that the points were, in fact origination fees. \n\nAfter closing on the house and discussing this fiasco with a friend who works in the mortgage industry, she explained that there are a number of items that a VA loan borrower can not pay. One of those is the broker fees for a mortgage broker. Since the seller wouldnt pay any closing costs on the lowered price of the home, the  origination fees were fraudulently disguised as discount points even though my rate was still over 5 %. The attorneys fees were all fraudulently listed as Title in order to get by with charging me these fees as well. Since they didnt actually label the origination fees correctly, they also put underwriting fees in there as well. It looks to me like this broker did everything he could to subvert the rules that the VA has in place to protect the borrower and pad his own pocket. That explains why he was upset regarding me accepting the counter offer of the lowered price and no seller concessions. Of course, I do have an answering machine and when the line is busy calls go directly to voice mail. I have no record of receiving any such call to either my home or cell phone numbers.  XXXX   XXXX  claimed that the reason for  XXXX   XXXX  's call was regarding her inability to locate some of my financial documents, when in fact I sent all of the documents listed on the  AAG Conditional Approval N otice dated  X/XX/XX . So I immediately called and then followed up with an email since she did n't answer her phone. I continued calling  XXXX   XXXX  on   XXXX   and she finally answered the phone and said that she was busy with another client and that she would call me back in  XXXX  minutes. I never heard from her. So I sent her another email asking what additional information she needed.  XXXX   XXXX  did not respond to my email. So over the period of approximately  eight days I  continuously called her leaving voice messages along with emails. I was finally able to speak to  XXXX   XXXX  on  X/XX/XX , and reiterated to her that I did provide all of the required documents via a \" confirmed ''  XXXX   2nd D ay service delivery to her attention on   XXXX   XXXX   XXXX  .  XXXX   XXXX  's request for me to re-submit documents via email which I had already provided causes me to believe that this company was irresponsible and failed to securely handle the requested documents containing my highly sensitive and personal information. Again not receiving any updated information from  XXXX   XXXX ,  I conti nue to email  XXXX   XXXX  and ask him to assist me.by forwarding my messages to  XXXX   XXXX  and that she please call me. After my initial contact with  AAG in    XXXX   XXXX   XXXX  , I was informed by  XXXX   XXXX  that the loan process could take as few as 60 days and that the average was about 90 days to complete. Based upon this information I secured money from a private source for legal fees which had to be paid immediately. However because of the excessively long processing time of my  AAG \" Advantage Loan '', this private funding has cost me over {$8000.00} in interest. In addition, t he estimate d AAG  origination charge of {$7200.0 0} ( equaling  approximately 4.9 % of the total loan ) is unreasonably excessive ... and further contributes to the financial burden already placed on me. Then on  X/XX/XX , af ter five ( 5 ) month s since initiating the process, I received a Notice o f Denial from AAG. I t stated that they are not able to approve my loan due to \" Insufficient equity for  XXXX  loan amount requested ''. First,  AAG offered m e the specified loan amount. Second, it seems apparent that the CFPB  Consent Order a nd civil money penalty issued to this company on   XXXX   XXXX   XXXX   did not sufficiently motivate them enough to ensure that I would be provided with the highest quality of customer service. A letter dated  X/XX/XX  from me to  XXXX   XXXX  was delivered by United States Postal Service \" certified mail '' on  X/XX/XX  and contained all of the facts presented in this complaint.
