In the meantime, their collection department called on a regular basis, threatening foreclosure. We told them we were applying for a loan modification, but they refused to verify this with the loan modification department. The collection department sent the loan into foreclosure while the loan modification was still in process. We paid the default amounts, legal and court fees and THEN got an offer of a loan modification. The terms of the modification were actually WORSE than the original loan, so we turned down the loan modification. We feel that Saxon Mortgage acted in bad faith during the transaction. We followed their instructions and they reported us as being delinquent. We only followed their instructions for getting a loan modification. We had the money to pay during the application and they took a whole year to offer a loan modification with terms worse than the original note, which we chose to reinstate. But XXXX mishandled foreclosures and provided consumers with false information. The second mortgage was extinguished under the second lien modification program XXXX guideline requirements from the U.S. Department of Treasury. \nWe have continued to pay this modified mortgage payment on time to Bank of America until they sold our single modified loan to XXXX. XXXX  in XXXX of XXXX. See the consistent payment history from XXXX XXXX covering XX/XX/XXXX to XX/XX/XXXX. \nIn XXXX of XXXX, we received a statement from XXXX XXXX XXXX  claiming that we owe them {$100000.00} for the second mortgage that was extinguished by Bank of America under the HAMP and XXXX guidelines in XX/XX/XXXX. We also received notice for foreclosure on our house dated XX/XX/XXXX, from XXXX, XXXX, XXXX, and XXXX XXXX which is XXXX XXXX XXXX  attorney. We contacted XXXX XXXX XXXX and spoke to an account manageXXXX XXXX XXXX. We advised him that this was all incorrect information because our loan was modified in XX/XX/XXXX. He advised they own the note and that we owe them {$100000.00}. He advised that a loan modification was never recorded by Bank of America to the deed of trust in our local register office. He advised that if there was proof of a modification on file that they would have never pursued to file the deed of trust filing and foreclosure process in XX/XX/XXXX. He advised me to send him proof of the loan modification. We did. \nWe contacted Bank of America and provided them with all our previous account numbers to request a copy of our loan modification agreement documentation. Unfortunately, they had no record of our previous first mortgage, second mortgage, nor the loan modification. This was very disappointing customer service from Bank of America. We contacted the Housing and Urban Development office outreach program who directed us to the Department of Treasury to inquire about any extinguishment proof and they also assisted us in obtaining a copy of our loan modification agreement from our current mortgage services provider XXXX XXXX. We emailed the signed loan modification agreement and website link https : XXXX to show the detail required guidelines service providers were supposed to follow under the Home Affordable Modification Program ( HAMP ) Home Affordable Modification Program HAMP 1 and the Second Lien Modification Program ( XXXX ) directive XXXX. This information was sent to XXXX XXXX at Real Time Resolution and their attorney at XXXX, XXXX, XXXX, and XXXX XXXX. to review. We expected that would clear up all the confusion to help Real Time Resolutions realize that their pursuit of collection on a paid off XXXX balance second mortgage loan was incorrect and that it was paid off and extinguished back in XXXX with the Second Lien Modification Program ( XXXX ) using funds provided to Bank of America from the Department of Treasury. \nMy credit report has shown the extinguished second mortgage as XXXX balance after our loan was modified in XX/XX/XXXX. \nWe received a notice of sale postponement from XXXX, XXXX, XXXX, and XXXX XXXX. advising that foreclosure sale postponed from XX/XX/XXXX, to XX/XX/XXXX. \nWe are filling this complaint because we are constantly being asked by attorney 's if we need help to file bankruptcy and asked by investor if we want to sell our home to avoid foreclosure. This feels like XXXX XXXX XXXX is trying to complete a foreclosure money scam that was set up by Bank of America because they neglected to properly record our loan modification in XX/XX/XXXX and have totally erased all our past mortgage documents to prevent us from obtaining evidence of our loan modification. However, the first mortgage was fully paid off years earlier, and a Release of Obligation was recorded on the public record in XXXX showing that the original XXXX XXXXXXXX XXXX was paid in full for {$100000.00}. \n\nSelect Portfolio Servicing ( SPS ), the current loan servicer, has failed to provide any proof of a valid second mortgage or documentation evidencing who received the payoff funds of {$190000.00} listed on the XXXX XXXX XXXX. The only documents SPS has provided are loan documents from XXXX XXXX with no proof of disbursement or funding of these amounts. The XXXX XXXX XXXX is false and unsupported by any evidence of actual disbursement, which is required under California Civil Code 2924.17. \n\nIn XX/XX/XXXX, SPS offered a trial loan modification to stop the scheduled foreclosure sale set for XX/XX/XXXX. I made payments totaling {$4900.00} covering XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX in good faith, believing these payments would secure the home during the ongoing fraud investigation. The Trial Period Plan documents repeatedly reference active mortgage assistance, modification approval, escalation rights, and foreclosure alternatives. The package also states that no foreclosure sale would occur during portions of the appeal/review process. \n\nAt the same time, the Trial Period Plan package acknowledged : ongoing loss mitigation review, mortgage assistance eligibility, appeal rights, and continuation of the modification process. \n\nHowever, less than two months later, Onity Mortgage issued a reinstatement quote dated XX/XX/XXXX stating : The account is in foreclosure we may continue with foreclosure proceedings and demanding certified reinstatement funds. \n\nThe reinstatement quote simultaneously : references mortgage assistance personnel, provides reinstatement curing instructions, identifies a suspense balance credit, and states that the next regular payment would become due after reinstatement. \n\nThis creates a contradictory servicing posture where the account was simultaneously : under an approved Trial Period Plan modification, in active loss mitigation, subject to reinstatement review, treated as an active foreclosure account, and being negatively reported to XXXX, XXXX, and XXXX. \n\nI dispute the validity of the servicing/accounting used to establish and continue the alleged delinquency beginning XX/XX/XXXX. I also dispute the continued derogatory reporting and foreclosure escalation while active mitigation and modification activity remained ongoing. \n\nOn or about XX/XX/XXXX, this reporting caused my credit score to drop approximately XXXX points, creating immediate credit harm while the account remains under active dispute, loss mitigation, and Trial Period Plan modification. \n\nThe reinstatement quote also contains significant escrow-related balances, including approximately {$9400.00} in escrow charges, additional collection/attorney fee language, and references to continuing foreclosure costs. See the consistent payment history from XXXX XXXX covering XX/XX/XXXX to XX/XX/XXXX. \nIn XXXX of XXXX, we received a statement from Real Time Resolutions claiming that we owe them {$100000.00} for the second mortgage that was extinguished by XXXX XXXX XXXX under the HAMP and 2MP guidelines in XX/XX/XXXX. We also received notice for foreclosure on our house dated XX/XX/XXXX, from XXXX, XXXX, XXXX, and XXXX XXXX which is Real Time Resolutions attorney. We contacted Real Time Resolutions and spoke to an account XXXX XXXX XXXX. We advised him that this was all incorrect information because our loan was modified in XX/XX/XXXX. He advised they own the note and that we owe them {$100000.00}. He advised that a loan modification was never recorded by XXXX XXXX XXXX to the deed of trust in our local register office. He advised that if there was proof of a modification on file that they would have never pursued to file the deed of trust filing and foreclosure process in XX/XX/XXXX. He advised me to send him proof of the loan modification. We did. \nWe contacted XXXX XXXX XXXX  and provided them with all our previous account numbers to request a copy of our loan modification agreement documentation. Unfortunately, they had no record of our previous first mortgage, second mortgage, nor the loan modification. This was very disappointing customer service from XXXX XXXX XXXX We contacted the Housing and Urban Development office outreach program who directed us to the Department of Treasury to inquire about any extinguishment proof and they also assisted us in obtaining a copy of our loan modification agreement from our current mortgage services provider XXXX XXXX. I went to One West for my loan modification on XX/XX/XXXX Indymac Loan number XXXX and Investor Loan number XXXX. One West and their title affiliates did the modification without clearing a Second mortgage that had disapeared for years. I mean disapear because they did not contact me via mail, email, Phone calls or text. The only communication i received was the letter dated XX/XX/XXXX with a foreclosure document attached. \nI was just informed the 2nd loan of {$49000.00} was never included in the modification and as a result I have received a notice of default on XX/XX/XXXX. \nHowever, In the pass 10 years I never received any notices by mail or collection calls that had anything to do with the 2nd loan being defaulted. \n\nWhen I purchased and refinanced my home I had no Idea what a preditory loan was until my mortgage began to fluctuate. This was when I was forced to modify and I thought that I was under protection with my first loan and my second mortgage. Now I learn that the second mortgage went dormant possibly to wait for equity on my home and come back as another predatory lender seeking to take my home away thru foreclosure.
