We applied for and received this mortgage from XXXX of Weichert Financial Services with the express understanding from him that at the time we sold our home, we would be able to use the sales proceeds to immediately pay down the mortgage on our new home, get rid of the PMI, and take over our own escrow. We asked about this numerous times, both on the telephone, texts, and I have emails between me and the mortgage broker where he assures us that this can be done right away ( and in fact that Weichert was retaining our loan so that this could be done ). We even asked the buyers of our former home to use Weichert Financial for their mortgage on the purchase of our former home ( which they did ) so that this transaction could be seamless and we could apply the proceeds to our new mortgage right away. We closed on our new home on XX/XX/2016 and closed on the sale of our former home on XX/XX/2016. When I contacted XXXX of Weichert to pay down the loan, remove PMI and escrows, he now informs me that this can not be done. He informed me that I would have to make XXXX payments on the mortgage before I could even apply to lower the payment and infuse the money into the mortgage. He made no mention of not being able to get rid of PMI. I contacted corporate at Weichert Financial Services and will attach the paperwork. I spoke to XXXX, who informed me that they can not lower the payment or get rid of the PMI. She was surprised XXXX also did not tell me about the PMI. After her email on this issue, no one is getting back to me now. I have even asked for the name of their legal counsel/legal department -- no response. I have also written to XXXX, the Senior Vice President of Weichert Financial ( see attached ). In sum, we were clearly induced into entering into a mortgage under false pretenses and misrepresentations. We are asking that Weichert Financial immediately accept the pay down on the mortgage, lower the payment, remove the PMI and release the escrow so that we can pay our own taxes and homeowners insurance -- all as promised to us MULTIPLE TIMES. These representations were also made in front of my husband and the Weichert Realtor that we used, XXXX. There is absolutely no way that XXXX can deny the misrepresentations that he made to us, which we relied on to our detriment. Moreover, once we infuse the mortgage with our sales proceeds of {$170000.00} to {$200000.00}, the loan to value ratio will be about 61 % which is more than enough to remove the PMI. We have already made the first mortgage payment due on XX/XX/2016. We are out thousands of dollars in interest and PMI payments which are totally unnecessary. We provided 10 % of the value of our home and our mortgage was {$1400.00} plus a MIP of {$390.00} or {$1800.00} per month with an interest rate of 2.5 %. By the end of the fifth year payments blew up to {$2800.00} plus {$390.00} of MIP to {$3200.00} per month. Just the mortgage grew 127.20 %. \nDuring that process XXXX sold our mortgage to several other banks including CountryWide Home Loans and Bank of America. \nBefore the 127.20 % increase in our mortgage payment came through we requested Bank of America to refinance and their response every time was \" you are paying on time we ca n't help you ''. We kept on calling until XXXX Bank of America representative stated that the reason they were unable to help us was because we were current with our payments and we needed to be in default for them to be able to help ''. \nBased on those instructions we defaulted and 60 days later re-applied through the Home Affordable Refinance Act XXXX times. Even thou we fulfilled 100 % of the criteria BOA refused to refinance and proceeded with a foreclosure. \nSince we found the whole situation building up against us we hired an attorney and we did a compliance stress test of our mortgage with a certified reputable Loan Analyst for the RESPA and TILA and the result stated that the mortgage generator and its successors violated many RESPA and TILA federal and state statutes. \nWe filed a counter claim at the court stating that not only the mortgage note are unforceable due to direct violations of TILA but also of the HOEPA and failed to deliver a notice of acceleration to us the homeowners violating the Federal Debt Collection Practices Act and also Bank of America breached the mortgage agreement by force placed insurance in an amount in excess of that required under the mortgage. The mortgage also understated the finance charges and annual percentage rate violating the Truth in Lending Disclosure Statement at the time of closing. \nTo top all that we requested a Home Equity Line of Credit for {$100000.00} which Bank of America provided even though our home did n't have enough equity. When attempting to pay ahead, the mortgage company only applied the payment to principle thus not showing a payment made early and never being able to set up the biweekly payment. \n\nFast forward to XX/XX/XXXX. Flagstar increased new mortgage {$2300.00}. When inquiring the huge increase, it was broken down and explained as follows ; New Mortgage Insurance {$350.00} ( Increase of {$210.00} ), Home Owners Insurance {$320.00} ( Increase of {$220.00} ), Taxes {$210.00} ( increase of {$63.00} ). Now understanding insurance costs were raised across the board due to a natural disaster storm, and property taxes also increased across the board. Although the drastic increase in Mortgage Insurance is fluctuated by the company based on biased opinions. My Credit score remained the same, if not better, and the amount on the loan decreased. So what justified the drastic increase in fee calculated. In addition, the difference the mortgage company added on top as a cushion fee for Escrow. \nI expected an increase in monthly mortgage cost due to Insurance and Taxes, which would have increased my monthly cost to just over {$2000.00}. I of course could have shopped around for better insurance to allow for additional savings. Yet due to Mortgage company EXCUSE blaming Escrow I saw an additional hike of almost {$400.00} more! Even more so, Mortgage Company blamed the increase on Home Owners Insurance. Although as explained, homeowners insurance was a fraction of the increase.\n\nWhen contacting the company to dispute and get explanations, they initially stated they would send me an application to remove my insurance from Escrow. Shortly followed by no they cant and wont. Even if I switched Insurances to a different provider for better rates, they would still pay and force the tacking on additional costs to still see the drastic hike on monthly costs.
