Ive offered all 1099s which is all thats received for taxes. Ive excepted either a denial letter or confirmation of the loan being processed. I have not been allowed to have my application submitted to the underwriter. \n\nAlso in the last 6 months to a year Rocket Mortgage has played games with my mortgage saying that my escrow is low. When I switched my insurance I was not informed by Rocket Mortgage that any refunds provided may need to be provided to ensure that the escrow account is paid in full so when the XXXX renewal date returns youll need to be paid up evenly. They kept playing games till my payment were almost {$1700.00} a month. At this time I canceled my principal only payment to reduce my principal at a quicker rate. \n\nNow ROCKET MORTGAGE had no problem with my payment being {$1700.00} a month, without reaching out saying if you received a refund we can apply it to escrow to stop your payments from increasing. Nor are the loan officers willing to submit it to underwriting for an approval for a refinancing with a cash out option. My reasoning for the loan is to get my debt paid off and remodel the inside of the house. Every time I called for help or visited a Wells Fargo office, they told me they were unfamiliar with balloon mortgages, or they no longer offer them and were unable to help me. I even had XXXX lady at an office say she did not have my phone number and that is why I was never contacted about refinancing ( my phone number was clearly listed on my account ). I also requested an amortization schedule in which they showed my mortgage as a conventional loan ( see attached ). Then they said that the amortization schedule was an error and they made a mistake. \n\nLoan Origination : XX/XX/XXXX Loan Amount : {$46000.00} Loan Interest : 9.25 % Maturity Date : XX/XX/XXXX Amount paid on this loan to date {$55000.00} XXXX today : {$37000.00} The balloon mortgage has now reached its maturity and I am unable to pay the balance and I can not afford to refinance and pay this off. This has been very frustrating and a huge financial burden on my life. Since the Dodd Frank Act, Balloon mortgage loans should be forgiven for first-time home buyers and illegal in general. \nPlease provide transcripts for the following : XXXX. In XXXX of XXXX, Wells Fargo representative said I could refinance the second mortgage into a single mortgage in a few years and that is what most people do. I was told that the most recent request was mailed XXXX. I do not have it yet. I made three prior requests for copies as well. Two requests were made in XXXX of last year and most recently in XXXX of this year. \nWhen the loan was sold to SLS in XXXX it was conventional with XXXX months. Far from ideal, but a portfolio in which my loan was included was sold. In fact the organization that sold the loan to SLS was not the loan originator. My loan had been firmly established. \nIn XXXX I inherited a childhood home that I sold one year later. Until I sold it, I rented to tenants who were often late with payments. I was left in the position of managing a home equity line of credit and two mortgages- my own and the remaining mortgage on my family 's home. I survived by selling the house in XXXX. In fact I am in a far different position now. During that time SLS offered what had been presented as a 30 year fixed mortgage. What it appears that I have is a 52 year mess. How does one go from a 30 year fixed conventional loan to a refi of 52 years WITH a balloon attachment? I became aware of the balloon attachment when I checked my credit report, and it stated that my balance on the house was {$120000.00} last year. It was recently presented to XXXX XXXX at {$130000.00}. \nMy principal balance on the loan in XXXX XXXX  was {$88000.00}. This was according to the information on SLS 's website.\n\nI have complained to CFPB in the past about SLS 's affinity to negatively amortize loans- my escrow payments were far out of proportion to my principal payments. Banks like Wells Fargo claim that they focus on doing whats best for the consumer. That is NOT the case here. \n\nI am not asking for any additional money from Wells Fargo. I currently have a first mortgage and a HELOC from Wells Fargo from when I originally purchased the home. I am just consolidating the two mortgages. The only party that benefits from me not refinancing is Wells Fargo as they can continue to hold my current mortgage at an above market rate. \n\nMy credit profile is very strong. My credit score is XXXX based on a range from XXXX to XXXX. My debt to income is 42 %. I have basically no other debt except for the mortgage. My loan to value is also 67 %. The cash in my bank account and my other assets are well over the 12 months liquidity required by the bank. In summary, I meet all the credit metrics required for the loan. \n\nI have always responded quickly and have supplied many pages of documentation in a timely manner when asked over the course of several months. At last count, I have submitted over 40 pieces of documentation including my tax returns. I believe I have satisfied all the documentation requests that were required based on my conversations with the loan officer and processor of the mortgage. As proof of this, the first underwriter did approve the mortgage in XX/XX/XXXX. \n\nHowever, an issue arose when it was sent up the approval chain. This is the point at which I believe Im being treated unfairly. \n\nThe original underwriter for this refinancing spent two months reviewing my application before giving his approval. Meanwhile, the second underwriter spent 1 day before denying my application. The short amount of time spent on the application by the second underwriter was very concerning. I would have expected a more thorough analysis like the first underwriter rather than a relatively quick judgement. \nAs background, this is the second time I am applying for a refinancing with Wells Fargo. The first time, I was not approved for the refinancing ; the reason that I was given was that my debt to income ratio was too high. I subsequently cured this issue by paying down almost all the non housing debt and thereby lowering my debt to income to acceptable levels. \n\nBased on my current, cured credit profile, I more than meet the qualifications for the new refinancing. However, Wells Fargo is basing the current denial of the refinancing on my prior application. For example, the actual cash and assets in my accounts more than meet the 12 months liquidity requirement. Despite the seasoned nature of the assets ( I have 2 months of statements showing the liquidity ), Wells is reducing the liquidity number based on my last mortgage application. \n\nAlso, the second underwriter has called out the purely subjective rationale of layered risk as a basis for a denial. Again, this is based on my prior application before I took the necessary steps to cure my profile. \n\nSo Wells Fargo is moving the goal posts on me even though I fixed the original issue. \n\nThat is a big reason why I think Wells is treating me unfairly. If I fixed the issue I had before, but Im still going to get denied on the same issues, what reasonable person would go back to Wells Fargo to reapply? No one at Wells Fargo gave me any indication that I would have NO chance to succeed on the second attempt. If I thought that I would have issues related to the prior application, I would not have wasted months of time and effort and would have instead gone to another bank. Not only have I wasted time, but I will have spent extra money with the delay with my elevated interest payments and the fact that rates have gone up since my application. \n\nIn fact, if Wells did not have any history of my first refinancing attempt, I am certain that I would have been successfully approved and closed by now. Thats the question for Wells : based on my most recent data and documentation, would I have been approved? Everything else is water under the bridge, just like with any other new applicant off the street. Instead, my loyalty has cost me dearly now. \n\nImportantly, I understand that exceptions are granted on a regular basis for other borrowers. As you see, I have a number of compensating factors, especially considering my current credit profile. The only issue is that they are relying solely on old data to make the current decision to deny my refinancing ( which benefits Wells Fargo as the holder of my current above market rate mortgage ). \n\nI am shocked by Wells Fargos behavior in this matter. I am a long time loyal customer that has a spotless history with Wells. I am seeking to improve my financial condition just by lowering my interest payments to a market level that we agreed upon. So it is clearly in the best interests of myself as a consumer. My credit profile is strong and the refinancing will only improve my financial condition. That requirement calls for a pre-existing, current relationship with Chase for at least 90 days in duration has to have been in place - solely because of having a significant ownership interest in my business and its being my primary source of income. There is or was no question about the viability of the business nor the level of income derived therefrom - it's merely having my own business. ( The efficacy and level of my credit scores, personal finances and financial performance of my business were never questioned. ). \n\nThere was no notice of this requirement prior to my being told my application could not go forward. There was no opportunity to cure nor opportunity for me to decline initiating an application and thereby avoid wasting time, energy and pursuing other avenues. On XX/XX/XXXX, we received an email from the Loan Processor, XXXX XXXX, asking for the insurance company to add Discover to the declaration page. This was submitted to XXXX on XX/XX/XXXX. The document was rejecting stating that the loan # was not included ; however, I doubled checked it and replied back to XXXX email  letting him know that the # was included and to look again. On XX/XX/XXXX, I received another email stating the # was not included on the declaration page. This was completely absurd. I emailed XXXX back on the XXXX with an image of the document, circling where the # was added ( the loan # was added to the declaration ; it is on page 2 of 3 of the declaration ). Also, prior to receiving this email, I spoke to XXXX from the contact center on Friday, XXXX XXXX, and she confirmed that she could see the number on the page. \n\nI never received a response from XXXX after my email on the XXXX, instead on XX/XX/XXXX, I received another email asking for the insurance to be updated. Completely ridiculous. So, I called into the call center again and spoke to XXXX who informed me that Discover had everything, except now they still need to verify my employment. I informed XXXX that my employer uses The Work Number for work verification and provided him the information via phone ( I gave this information to another associate at Discover the week before, so I'm not sure why there is a disconnect within their center ). I followed up with an email to XXXX with the same information and asked for an acknowledgement of my email since I wasn't getting anywhere with him and we were almost a month into the loan processing timeframe. \n\nOn XX/XX/XXXX, I received another email from XXXX asking me about the employment verification. After getting the email, I immediately called Discover Home Loans and finally spoke to XXXX. He stated that he was reaching out to an HR employee at my employer who was not responding to him ( I gave him her name previously but later found out that my employer used the 3rd party ) ; I told XXXX that he would have to use The Work Number for the verification ; XXXX said that he did use their information and he was told I was on leave which I confirmed was correct. I previously communicated this information to XXXX in my email on the XXXX and I informed the other folks previously during my calls into the center. After our call, I emailed XXXX on XX/XX/XXXX, stating again that I am on medical leave from work ; however, I am still employed by my employer and have been receiving short-term XXXX benefits via XXXX ( this information was previously shared with Discover ). Also, during our conversation, XXXX stated that we could move forward into the Underwriting phase which would take another 2 weeks until closing. \n\nTo our surprise, we got another email on XX/XX/XXXX where XXXX wanted to make sure he had everything he needed to move forward with the process. He said that he had his leaders review the loan 'just to make sure no documents were missed. ' XXXX stated that, 'Since we spoke on the phone and you had stated that the leave was extended, I would need updated documents showing the leave was extended to XXXX since the documents I have shows approved through XX/XX/XXXX. ' This was a complete shock. We were over a month into the process and now they were asking for more information. The documentation that I provided was all valid ; however, because of XXXX XXXX and the unnecessary back and forth, I needed to provide more information ( I also had to resubmit paystubs because of this delay ). I called into the call center again and spoke to XXXX sharing my disappointment and I explained to him that the way medical leaves work is based on the doctor 's recommendation ; so XXXX only approves the leave until the next doctor 's appointment regardless of the doctor saying XXXX during my XX/XX/XXXX visit. XXXX said that I needed to provide something stating my leave was approved until XXXX which I said would be my doctor 's medical notes and I did not think Discover would need that documentation since it breaks HIPPA laws. I asked to speak to a supervisor who basically reiterated the same information as XXXX. I shared my disappointment in XXXX lack of response and customer service and asked for a new processor. In the meantime, I followed up with other individuals from my workplace to help with the employment verification ( Discover also wanted to verify my last two years of pay ). \n\nOur loan was assigned to XXXX XXXX who asked for the employment verification again. I connected XXXX with folks from my employer and they provided her with completed documentation on XX/XX/XXXX ( the documentation verified my employment and provided Discover verification of my payroll for the past two years ). XXXX reviewed the documentation and then sent us an email requesting 'a document produced by your employer with the agreed-upon return date. ' I called XXXX and explained to her again that the leave was being managed by XXXX and that my employer would not provide a document with the date since the doctor was managing the medical leave and my return-to-work date. I explained since I had my last doctor 's appointment was on XX/XX/XXXX, the leave would be approved until my next doctor 's visit on XX/XX/XXXX, which again would still not say XXXX. I began to cry on the call because all I wanted to do was make sure my bills were being paid since I was on a XXXX  XXXX. This was not the type of stress I needed, and as an existing Discover customer, I would have thought we would have received better service. XXXX again said the same thing and I ended the call because I was at wits end. \n\nWe did not understand why they needed to see this XXXX date in order to have our loan go to the underwriter ; they kept saying it was their policy. I questioned this policy since I'm sure I am not the only person that has been on a medical leave applying for a loan from Discover. My husband also followed up with an email expressing that this situation was unacceptable. We were more than patient and provided all the necessary documentation to move forward. Also, during all the back and forth, my husband and I both asked if there were other options under these circumstances or an exception. We were told that this was the policy and all customers must be treated the same way which we understand if I was not on XXXX XXXX and being asked to provide documentation that was non-existent. \n\nOn XX/XX/XXXX, we received an email from XXXX stating 'Per our policy and procedures, we need a document produced by your employer with the agreed upon return-to-work date. XXXX stated that would be provided by XXXX in 5-7 business days. My leadership did advise that an email correspondence with the agreed date would be acceptable. Perhaps this could be obtained quicker? Once the proper documentation is received, I will prioritize your file and send to the next step. I apologize for any stress this has caused you. We have time to obtain that document and then your file will be submitted to Underwriting for the Underwriter to review the documentation. ' After receiving this email, I contacted XXXX on XX/XX/XXXX asking them if they knew if I could get a document showing the XXXX date for Discover and they said, 'no '. They even agreed that my employer would not provide such a document since the leave was managed by XXXX. On XX/XX/XXXX, I uploaded the new approval letter from XXXX via the Discover portal, and emailed XXXX reminding her that the letter would show the date of XX/XX/XXXX as my approval date since that is the date for my next doctors visit. Again, it would not show the XXXX date. \n\nOn XX/XX/XXXX, we received an email from XXXX stating 'My leadership heard back from the Underwriter who stated the file can not be submitted without a return date from your employer. I am sorry because that was not the answer that you nor I wanted to hear. Due to the age of your file, I was advised to provide a deadline for the return-to- work date by the end of the day on Monday, XXXX, XXXX. If that is not provided, your file will be submitted for decline, and you can reapply when you have the required date. ' We were shocked at Discover 's audacity to bring up the age of the file since the delays started back in XXXX with XXXX. XXXX was unresponsive for several weeks, which put us in this predicament, and had XXXX done his job from the start, we wouldn't be facing this issue. \n\nAfter receiving XXXX 's email, I replied, 'Please cancel our loan request. This is completely ridiculous. ' We then received the following reply from XXXX, XXXX your request, I have submitted your file for decline. Good news, we do not report the declines to the credit bureaus so this does not negatively impact you. You will receive a letter in the mail in 7-10 business days. We will send a request to your homeowners insurance company to remove Discover as a mortgagee. Thank you for your interest in our Discover Home Loans and I wish you all the best. ' I emailed XXXX questioning why Discover is electing to use the term decline. ' This should not show as a decline since we are requesting to close out the loan application. We never received a reply back. \n\nNeedless to say, Discover 's handling of this matter only added unnecessary stress to personal situation, and has been very disappointing.
